4 cops killed, 1 hurt in DavSur ambush DAVAO CITY -- Some four policemen were killed and another wounded in an ambush by still unidentified armed men in Barangay Sibayan, Bansalan, Davao del Sur around 7:40 a.m. on Wednesday.

Police Regional Office X1 Chief Supt. Manuel Gaerlan said names of the victims have been withheld until families of the victims are informed of the incident.

Police said the team left Digos police station for Sibayan at around 6:30 a.m. on board a patrol car to respond to a report from Barangay Captain Eddie Dicdican about a murder case.

The route was initially cleared, prompting the police team to proceed to the area.

Based on the report, a member of the SOCO team managed to call by phone while firing was going on.

The ambush happened about a hundred meters from the scene of the murder.

As of this posting, the police are still conducting investigation of the incident.

Ombudsman raps Nograles, 25 others for PDAF misuse

Ombudsman Conchita Carpio Morales has ordered the filing before the Sandiganbayan of charges against former House Speaker Prospero Nograles and 25 others for their involvement in the alleged anomalous utilization of the Priority Development Assistance Fund (PDAF).

Nograles is set to face trial for three counts of violation of Section 3 ( e) of Republic Act No. 3019, or the “Anti-Graft and Corrupt Practices Act”, one count of malversation and two counts of malversation thru falsification of public documents.

Digos court orders arrest of self-confessed hitman Matobato DAVAO CITY -- The Regional Trial Court (RTC) in Digos City, Davao del Sur has issued a warrant of arrest against selfconfessed Davao Death Squad (DDS) hitman Edgar Matobato for the alleged slay tr y on a retired Department of Agrarian Reform (DAR) executive in 2014.

RCT Branch 19 Judge Carmelita Davin ordered the arrest of Matobato for the frustrated murder case filed by lawyer Abeto Salcedo,

DAR- Davao del Sur adjudicator, last year. The warrant was issued on March 2 but it was released only Tuesday.

In the warrant, Davin said Matobato should be brought before the court as soon as possible so he can be dealt with according to law.

Salcedo said in his affidavit that he watched the live coverage of the Senate hearing last year when he saw Matobato in the witness stand being questioned by senators.

After Salcedo saw Matobato on television, he immediately called the National Bureau of Investigation to ask for assistance.

Salcedo identified Matobato as the one who shot him on October 23, 2014, as he was stepping out of the DAR regional office in Digos.

Salcedo was wounded in the incident. Matobato had implicated President Rodrigo R. Duterte as behind the DDS when he was still the mayor of Davao City. (PNA) Matobato

Ombudsman probers traced the anomaly as originating during the tenure of former Congressman Danilo Lagbas who passed away in 2008.

D o c uments showe d that from 2007 to 2009, the Department of Budget and Management (DBM) released PHP47.5 million as part of Lagbas’ PDAF. Several non-government organizations (NGOs) were chosen to implement the Integrated Livelihood Projects in the 1st district, with NABCOR, TRC and NLDC as implementing agencies.

In the field verification conducted by the Ombudsman Field Investigation Unit in Mindanao, it was found that many of the livelihood project beneficiaries denied receipt of the livelihood technology kits/materials, grafted seedlings, hand tractors and water pumps.

Davao Norte governor is new RDC-11 chair TAGUM CITY, Davao del Norte –- President Rodrigo R. Duterte has named Davao del Norte Governor Anthony del Rosario as the new chair of the Regional Development Council (RDC) for Region 11 or the Davao region.

Del Rosario’s appointment was officially signed by the President last February 21. His term will end in 2019.

Pres. Duterte to study EO On Smoking Ban President Rodrigo Roa Duterte said he needs more time to study the proposed executive order banning smoking nationwide as he eyes to reach a compromise on the designated smoking areas.

The President said that he was still weighing expected resistance to the initiative and possible areas for compromise, citing as an example designated smoking areas inside a building.

In a media interview on Tuesday, March 7, at the Rizal Hall of the Malacañan Palace, the President explained that, “there are a lot of dynamics there. So

just give me enough time to study.”

The Chief Executive said he was supposed to sign this week the draft executive order submitted

by Health Secretary Paulyn Jean B. Rosell-Ubial, who was pushing for the approval of the order.

“I have to be very careful in trying to navigate the way how I can present it to the public,” the President said, noting that the smoking ban in Davao is a different case.

Meanwhile, Duterte said he wants to “strike a happy compromise” between the government and mining industry with a view to “protecting the public interest.”

He also appealed to lawmakers to allow Environment Secretary Gina Lopez, whose confirmation is pending at the Commission on Appointments, to present her case.

“If you’d listen to Gina present her case… but you have to concede something to (her). Talagang nagtatrabaho , and she has pointed out the so many factors that would eventually affect the environment of Mindanao,” he said.

“We cannot be allowing diggings forever in the every nook and corner of the mountain ranges. It would spell disaster,” he warned.

nation, and the commitment to pursue what needs to be pursued. However, it lightens the load as the teachers and the non-teaching staff of Naawan National High School are cooperative and that we are on the same ship heading towards everybody’s success and academic success.

School management and supervision do not only boil down to observing classes, solving perennial school problems, attending to meetings and conferences, and attending to teachers’ needs and concerns

but there is definitely more to it. As you are the one responsible person every inch to inch in the school, then everything that may arise, it is but your utmost concerned matter as well.

But, as said, the success of the school does not only depend on the management and supervision of the School Head but it brings to lead the united effort of everyone in the school, including parents, the stakeholders, and the community as well. All of these factors must contribute faithfully for

the success of the school, for without one of them, the latter’s achievement will be solely incomplete.

That is why, I would like also to thank the different stakeholders of Naawan National High School for their unending and continued support to our every program and activity that has contributed and helped so much in the realization of our vision and goals towards achieving academic success. Inspiring teachers to better manage the class

One of the factors that needs to be considered in delivering quality education is the management of the class, management of the classroom, in which it bears a big impact to the pupils in the process of learning. No matter how systematic the organization or structure is, if the classroom is not handled orderly, then the delivery of education will be affected. That is why every

teacher should take into best consideration the way he or she handles the class.

One way is that make your pupils understand why they are in school. Respect your pupils as much as you want to earn respect from them. Treat them as your children and make them understand that acquiring best education is anchored on valuing and living good values also.

Another, listen to their needs, beliefs and ideas. For

sure, these children have differing insights and ideas over a matter but on how you respond to them, is that all they will remember. Hear and appreciate their voices as they hear and appreciate your voice and thoughts. The moment they feel that they are being heard and attended, then that’s the moment they will listen without the teacher instilling fear over them, without the teacher begging the pupils to.

Set as a very good example.

Well, what you basically do and say, in the eyes of your pupils, it’s the right thing to do. Before you reprimand your pupils, you have to make it sure that you are portraying the good values, in which they can see you doing it. In their very eyes, what their teacher does and say, for them it is right and just.

Thus, better classroom management depends more importantly on the classroom manager, the teachers. Let us all be best examples to our pupils.

That said marriage did not last long due to lack of love and affection until the relationship manifested incompatibility and sustained misunderstanding between petitioners and reached the point of irreconcilability and they separated from each other for more than nine (9) years,they decided to separate live physically in bed and board thereby, executed Memorandum of Agreement in order to formalize their separation. Since their separation, they had never been communicating or supporting either financially or emotionally to each other,neither minding each other affair’s; Petitioner’s seek judicial decree of divorce, thereby, severing their marriage bond on November 22, 2003, so that they will have free hand to do what a single man or woman could do without marital burdens. Reconciliation between them had already been diligently employed but all proved futile.

WHEREFORE, finding this petition to be sufficient in form and substance, set the initial hearing of this case on April 7, 2017 at 9:00 a.m at which time, date and place. Any interested party may appear and show why the petition should not be granted. Let copy of this Order be published in a news paper of General Circulation in the City of Iligan once a week for three (3) consecutive weeks at the expense of the petitioners.

SECTION 1. TITLE. This Code shall be otherwise known as, “The Harmonized Fisheries Code of Iligan Bay Alliance in Misamis Occidental (IBAMO)”.

SECTION 2. DECLARATION OF POLICY. Cognizant of the critical state of their contiguous coastal area, the Provincial Government of Misamis Occidental hereby adopts the Harmonized Iligan Bay Alliance in Misamis Occidental Fisheries Code consistent and supplementing with the mandate of the Philippine Fisheries Code of 1998 as amended by Republic Act No. 10654.

SECTION 3. SCOPE AND COVERAGE. This Ordinance shall be applicable within Iligan Bay which composes the following municipalities, Plaridel, Lopez Jaena, Aloran, Panaon, Jimenez, Sinacaban and Tudela, and Oroquieta City, which jointly and severally work for the protection, restoration, preservation/conservation, and creation of opportunities for productivity of fishery resources and more importantly, in saving the Iligan Bay in a manner consistent with the well-being of the environment towards the attainment of sustainable fisheries & coastal resources for a progressively better quality of life for the people.

In addition to the powers, duties, and functions of the Municipal Mayor, City Mayor, and Provincial Governor to adopt adequate measures to safeguard and conserve land, mineral, marine, forest and other resources, as provided under Sections 389(b)(9), 444(3)(viii), 455(b) (3)(v), and 465(b)(3)(v) respectively, the local governments, with the applicable provisions of RA 8550, its implementing rules and regulations and Executive Order No. 533 ( Adopting Integrated Coastal Management as a National Strategy to Ensure the Sustainable Development of the Country’s Coastal and Marine Environment and Resources and Establishing Supporting Mechanisms for its Implementation) shall also provide the following coastal and marine resources management services and facilities.

A. For coastal municipalities, pursuant to RA 7160 and other laws;

1. Enforcement of fishery laws in municipal waters, both national and locally promulgated, including the conservation of mangroves, sea grass beds, coral reefs, shoal, islet, extension and on-site research services and facilities related to fishery activities which include dispersal of fingerlings and other seedling materials for aquaculture pursuant to Section 17(b)(2)(i);

2. Implementation of the Rehabilitation in Conservation Hotspots (RICH);

3. Conservation of Rare and Endangered Species (CARE) activities in areas identified and delineated by the DENR;

4. Implementation of the applicable provisions under Convention on International Trade of Endangered Species (CITES);

5. Implementation of waste disposal and other environmental management and Services related to general hygiene and sanitation, such as sewage and household wastes disposal;

6. The municipal government has primary jurisdiction over the municipal waters and shall be responsible for the management, conservation, development, protection, utilization and disposition of all coastal and fishery resources within the municipal waters, and consistent with the policies of the IBAMO;

7. Enactment of the municipal government in consultation with the FARMC corresponding ordinances and issue executive orders. Provided, that all ordinances enacted and executive orders issued by the municipal government shall conform with the existing national and local laws and policies and shall not endanger the sustainability of the coastal and fishery resources or destroy the ecological balance: Provided, however, that the municipal government, in coordination with the FARMC and other concerned agencies and institutions, shall also enforce all fishery and environmental laws, rules and regulations as well as coastal and fishery resources-related ordinances enacted by the Sangguniang Bayan;

8. The municipal waters shall be reserved for municipal fisheries. Provided, that other activities, such as, but not limited to, research and monitoring activities may be allowed under appropriate regulations, for purely research, scientific, technological and educational purposes;

9. All fisheries and coastal- related activities in the municipal waters, subject to existing laws and regulations shall be undertaken by the residents and the municipal fishers, their organizations and cooperatives duly accredited by the Sangguniang Bayan. Provided, that municipal fishers from other municipalities may be allowed to use and exploit the coastal and fisheries resources of the municipality, subject to existing national and local rules and regulations. Provided, however, that no commercial fishing vessel is allowed to operate within the municipal waters;

10. The municipal government, shall maintain a registry of coastal and fishery resource users for the purpose of determining priority among them, of regulating and limiting entry into the municipal waters, and of monitoring fishing activities and/or other related purposes: Provided, that such registry shall be updated annually or as often as may be necessary, and shall be posted in barangay halls or other strategic locations where it shall be open to the public, for the purpose of validating the correctness and completeness of the list:

(i) Provided, however, that the municipal government, in consultation with the FARMC, shall formulate the necessary mechanisms that shall be most beneficial to the resident municipal fishers. The FARMC may likewise recommend such mechanisms:

(ii) Provided further, that the municipal government shall also maintain registry of municipal fishing vessels, type of gears and other boat and fishing particulars; support fishermen’s cooperatives and other collective organizations as well as the transfer of technology pursuant to Section 17(b)(3)(ii); A. For the Provincial Government of Misamis Occidental, pursuant to RA 7160: assistance to fishermen’s cooperatives and other collective organizations as well as the transfer of technology pursuant to Section 17(b)(3)(ii);

Provide a policy framework and guidelines for the creation of municipal ordinance/s for the management, development and conservation of fisheries and aquatic resources, specifically in the following areas, namely, designation of closed season, limited entry into overfished areas, establishment of fish sanctuary, mangrove protection and conservation, regulation on construction and operation of fish corrals, protection of other marine habitats, coastal aquaculture, regulation on construction and operation of fish pens and fish cages, registration of fish hatcheries and private fishponds, coastal and aquatic pollution, maintenance of water quality and cleanliness, artificial reefs and other fish aggregating devices, navigational route and procedures in the issuance of fishery licenses and permits.

SECTION 4. OBJECTIVES. This Code is enacted to ensure the attainment of the following objectives:

a) To conserve, protect and sustain ecological approach to fishery management of the resources both fishery and aquatic within the bounds of Iligan Bay;

b) To focus on poverty alleviation through the provision of alternative or supplemental livelihood among the fisherfolks residing in coastal areas along the bay;

c) To improve productivity by value- adding through the adoption of appropriate technologies in processing of fish and marine products;

d) To optimize utilization of harvested marine products that are within the municipal bay waters;

e) To provide and upgrade post harvest facilities and improve handling technologies and other infrastructures support.

SECTION 5. APPLICATION AND LIMITATION OF THIS CODE. The provisions of this Code shall apply to all activities or businesses relating to the use, development, conservation and management of the coastal, fisheries and aquatic resources with bay-wide implications within the territorial jurisdiction of Iligan Bay in Misamis Occidental.

SECTION 6. DEFINITION OF TERMS. As used in this Code, the following terms and phrases shall mean as follows: 1.

Alliance means the Iligan Bay Alliance of Misamis Occidental (IBAMO) in which formal agreement for merging was made by the LGUs within Iligan Bay of Misamis Occidental for specific purpose and efforts; 2.

Ancillary Industries refers to firms or companies related to the supply, construction and maintenance of fishing vessels, gears, nets and other fishing paraphernalia; fishery machine shops; and other facilities such as hatcheries, nurseries, feed plants, cold storage and refrigeration, processing plants and other storage - pre-harvest and post-harvest facilities; 3.

Aquarium ornamental animals is an additional term to aquatic animals kept in the aquarium as a hobby or as pets or for ornamental purposes, including fishes, invertebrates, crustaceans, and mollusks; 4.

Appropriate Fishing Technology refers to adaptable technology, both in fishing and ancillaryindustries, that is ecologically sound, locally source-based and labor intensive; 5.

Aquaculture is a fishery operation involving all forms of raising and culturing fish and other fishery species in fresh, brackish and marine water areas; 6.

Aquasilviculture is a banner program of the Department of Agriculture (DA) being implemented by the BFAR; 7.

Aquatic Pollution refers to the introduction by human or machine, directly or indirectly, of substances or energy to the aquatic environment which result or is likely to result in such deleterious effects as to harm living and non-living aquatic resources, pose potential and/ or real hazard to human health, hindrance to aquatic, activities such as fishing and navigation. Including dumping/diposal of waste and other marine litters, discharge of petroleum or residual products of petroleum materials/substances, and other, radioactive, noxious harmful liquid, gaseous or solid substances, from any water, land or air transport or other human-made structure; deforestation, unsound agricultural practices such as the use of banned chemicals and excessive use of chemicals, intensive use of artificial fish feeds, and wetland conversion, which cause similar hazards and deleterious effects shall also constitute aquatic pollution; 8.

Aquatic Resources includes fish, all other aquatic flora and fauna, and other living resources of the aquatic environment, including, but not limited to, salt and corals; 9.

Artificial Reefs refers to any structure of natural or man-made materials placed on a body of water to serve as shelter and habitat, source of food, breeding areas for fishery species and shoreline protection; 10.

Automatic Location Communicator (ALC) or Mobile Tracking is a transceiver unit that refers to an automatic tracking device approved by the Bureau to be installed on fishing vessels that utilize a satellite navigation and communication system for the purpose of transmitting information concerning the Philippine-flagged fishing vessel positions, fishing activities and other activity of the vessel as ay be required; 11.

Ban Period means a restricted period for fishing to ensure conservation of fish during its breeding period in a particular area or zone; 12.

Boso refers to a dangerous underwater fishing with the aid of air compressor to facilitate breathing through a thin plastic hose on a boat above them with the absence of regulating devices, mouthpieces, etc.; 13.

Catch Ceilings refers to the annual catch limits allowed to be taken, gathered or harvested from any fishing area in consideration of the need to prevent overfishing and harmful depletion of breeding stocks of aquatic organisms; 14.

Closed Season refers to the period during which the taking of specified fishery species by a specified fishing gear is prohibited in a specified area or areas in Philippines waters; 15.

Coastal Area/Zone is a band of dry land and adjacent ocean space (water and submerged land) in which terrestrial processes and uses directly affect oceanic processes and uses, and vice versa; its geographic extent may include areas within a landmark limit of one (1) kilometer from the shoreline at high tide to include mangrove swamps, brackish water ponds, nips swamps, estuarine rivers, sandy beaches and other areas within a seaward limit of 200 meters isobath that include coral reefs, algal flats, seagrass beds and other soft-bottom areas; 16.

Coastal habitats refers to the area that extends from as far as the tide comes in on the shoreline out to the edge of the continental shelf; 17.

Commercial Fishing means taking of fishery species by passive or active gear for trade, business or profit beyond subsistence or sports fishing, to be further classified as:

a. Small scale commercial fishing is a fishing with passive or active gear utilizing fishing vessels of 3.1 gross tons (GT) up to 20 GT;

b. Medium scale commercial fishing is a fishing utilizing active gears and vessels of 20.1 GT up to 150 GT; and

c. Large scale commercial fishing is a fishing utilizing active gears and vessels of more than 150 GT. 18.

Commercial Scale is a scheme of producing a minimum harvest per hectare per year of milkfish or other species including those raised in pens, cages, and tanks to be determined by the Department in consultation with the concerned sectors; 19.

CommunityService means any service or any activity that is performed for the benefit of the community or its institution in lieu of payment of fine imposed as administrative or criminal penalty;

20.

Conservation and Management Measures means measures to conserve and manage living marine resources that are adopted and applied consistently with the relevent rules for international law including those reflected in conventions, RFMO resolutions and laws other coastal states where Philippine-flagged vessels fish; 21.

Coral refers to the hard calcareous substance made up of the skeleton of marine coelenterate polyps which include reefs, shelves and atolls or any of the marine coelenterate animals living in colonies where their skeletons form a stony mass. It includes:

a. Skeletons of anthozoan coelenterates characterized as having a rigid axis of compact calcareous or horny spicules, belonging to the genus corallium as represented by the red, pink, and white corals which are considered precious corals;

b. Skeletons of anthozoan coelenterates characterized by thorny, horny axis such as the antipatharians represented by the black corals which are considered semi-precious corals; and

c. Ordinary corals which are any kind of corals that are not precious nor semi¬precious.

Coral Reef is a natural aggregation of coral skeleton, with or without living coral polyps, occurring in intertidal and subtidal marine waters; 23.

Demarcated Areas refers to the boundaries defined by markers and assigned exclusively to specific individuals or organizations for certain specified and limited uses such as:

a. Aquaculture, sea ranching and sea farming;

a. Fish aggregating devices;

b. Fixed and passive fishing gears; and

c. Fry and fingerlings gathering.

Department means the Department of Agriculture; 25.

Distant Water Fishing means fishing in the high areas or in waters of other states; 26.

Drift Gill Net refers to a large scale drift gill net which more than 500 meters in length and has an impact on the by- catch of threatened, protected and endangered species; 27.

Drowning is the condition wherein a person is submerged in the water experiencing respiratory impairment as a consequence; 28.

Easement area is a section of an area with rights to have a passage in waterways, etc.; 29.

Ecosystem-based approach to fisheries management means an approach to fisheries that strives to balance diverse societal objectives or needs by taking account of the knowledge and uncertainties about biotic, abiotic and human components of ecosystems and their interaction and applying an integrated approach to fisheries management within ecologically meaningful boundaries. It may be synonymously used with “ecosystem approach to fisheries management” (EAFM); 30.

Electrofishing is the use of electricity generated by batteries, electric generators and other source of electric power to kill, stupefy, disable or render unconscious fishery species, whether or not the same are subsequently recovered; 31.

Endangered, Rare and/or Threatened Species refers to aquatic plants, animals, including some varieties of corals and sea shells in danger of extinction as provided for in existing fishery laws, rules and regulations or in the Protected Areas and Wildlife Bureau of the Department of Environment and Natural Resources (DENR) and in the Convention on the International Trade of Endangered Species of Flora and Fauna (CITES); 32.

Exclusive Economic Zone (EEZ) is an area beyond and adjacent to the territorial sea which shall not extend beyond 200 nautical miles from the baselines as defined under existing laws; 33.

FARMCs means Fisheries and Aquatic Resources Management Councils; 34.

Farm-to-Market Roads shall include roads linking the fisheries production sites; coastal landing points and other post-harvest facilities to major market and arterial roads and highways; 35.

Fine Mesh Net is a net with mesh size of less than three centimeters (3 cm.) measured between two (2) opposite knots of all mesh when stretched or as otherwise determined by the appropriate government agency; 36.

Fish and Fishery/Aquatic Products include not only finfish but also mollusks, crustaceans, echinoderms, marine mammals, and all other species of squatic flora and fauna, and all other products of aquatic living resources in any form; 37.

Fish Cage refers to an enclosure which is either stationary or floating made up of nets or screens sewn or fastened together and installed in the water with opening at the surface or covered and held in a place by wooden/bamboo posts or various types of anchors and floats;

38. Fish Corral or “Baklad” is a stationary weir or trap devised to intercept and capture fish consisting of rows of bamboo stakes, plastic nets and other materials fenced with split bamboo mattings or wire mattings with one or more enclosures, usually with easy entrance but difficult exit, and with or without leaders to direct the fish to the catching chambers, purse or bags; 39.

Fish Fingerlings refers to a stage in the life cycle of the fish measuring to about 6 –13 cm. depending on the species; 40.

Fish Fry refers to a stage at which a fish has just been hatched usually with sizes rom 1-2.5 cm.; 41.

Fish Pen is an artificial enclosure constructed within a body of water for culturing fish and fishery/aquatic resources made up of poles closely arranged in an enclosure with wooden materials, screen or nylon netting to prevent escape of fish; 42.

Fisherfolk refers to people directly or personally and physically engaged in taking and/ or culturing and processing fishery and / or aquatic resources; 43.

Fisherfolk Cooperative is a duly registered association of fisherfolk with a common bond of interest, who have voluntarily joined together to achieve a lawful common social or economic end, making equitable contribution to the capital requirement and accepting a fair share of the risks and benefits of the undertakings in accordance with universally accepted cooperative principles; 44.

Fisherfolk Organizations refers to an organized group, association, federation, alliance or an institution of fisherfolk which has at least fifteen (15) members, a set of officers, a constitution and by-laws, an organizational structure and a program of action; 45.

Fisheries refers to all activities relating to the act or business of fishing, culturing, preserving, processing, marketing, developing, conserving and managing aquatic resources and the fishery areas, including the privilege to fish or take aquatic resources thereof; 46. Fisheries Observer refers to a person duly authorized by the Philippine government or under a Regional Observer Program of the RFMO, to collect scientific, technical or fishing related data, and other information that may be required by the government of the RFMO and/or in compliance to a conservation and managment measure; 47.

Fish Pond refers to a land- based facility enclosed with earthen or stone material to impound water for growing fish; 48.

Fishing Boat/Gear License is a permit to operate specific types of fishing boat/ gear for specific duration in areas beyond municipal waters for demersal or pelagic fishery resources; 49.

Fishery Management Areas refers to a bay, gulf, lake or any other fishery area which may be delineated for fishery resource management purposes; 50.

Fishery Operator is one who owns and provides the means including land, labor, capital, fishing gears and vessels, but does not personally engage in fishery; 51.

Fishery Refuge and Sanctuaries is a designated area where fishing or other forms of activities which may damage the ecosystem of the area is prohibited and human access may be restricted; 52.

Fishery Reserve refers to a designated area where activities are regulated and set aside for educational and research purposes; 53.

Fishery Species refers to all aquatic flora and fauna including, but not restricted to, fish, algae, coelenterates, mollusks, crustaceans, echinoderms and cetaceans; 54.

Fishing is the taking of fishery species from their wild state or habitat, with or without the use of fishing gears; 55.

Fishing Gear refers to any instrument or device and its accessories utilized in taking fish and other fishery species;

a. Active fishing gear is a fishing device characterized by gear movements, and/ or the pursuit of the target species by towing, lifting, and pushing the gears, surrounding, covering, dredging, pumping and scaring the target species to impoundments; such as, but not limited to, trawl, purse seines, Danish seines, gagnets, paaling, drift gill net and tuna longline;

b. Passive fishing gear is characterized by the absence of gear movements and/ or the pursuit of the target species; such as, but not limited to, hook and line fishpots, traps and gill nets across the path of the fish; 56.

Fishing for daily food sustenance refers to fishing in which the fish caught, and/ or the proceeds thereof, are consumed directly by the families and kin rather than being bought by intermediaries and sold at the next larger market; 57.

Fishing Light Attractor refers to a fishing aid which employs lights using, among others, mercury vapor, high pressure sodium vapor, standard tungsten, tungsten halogen, flourescent or light imitting- diode, that are attached to a structure above water or suspended underwater to attract both fish and members of their food chain to specific areas in order to harvest them; 58.

Fishing vessel refers to any boat, ship or other watercraft equipped to be used for taking of fishery species or aiding or assisting one (1) or more vessels in the performance of any activity relating to fishing, including, but not limited to, preservation, supply, storage, refrigeration, transportation and / or processing.

59.

Fishing with Explosives refers to the use of the dynamite, other explosives or other chemical compounds that contains combustible elements or ingredients which upon ignition by friction, concussion, percussion or detonation of all or parts of the compound, will kill, stupefy, disable or render unconscious any fishery species. It also refers to the use of any other substances and/or device which causes an explosion that is capable of producing the said harmful effects on any fishery species and aquatic resources and capable of damaging and altering the natural habitat; 60.

Fishing Noxious or Poisonous Substances refer to the use of any substance, plant extracts or juice thereof, sodium cyanide and/or cyanide compounds or other chemicals either in a raw or processed form, harmful or harmless to human beings, which will kill, stupefy, disable or render unconscious any fishery. species and aquatic resources and capable of damaging and altering the natural habitat; 61.

Fishworker is a person regularly or not regularly employed in commercial fishing and related industries, whose income is either in wage, profit-sharing or stratified sharing base, including those working in fish pens, fish cages, fish corrals/traps, fishponds, prawn farms, sea farms, salt beds, fish ports, fishing boat or trawlers, or fish processing and / or packing plants. Excluded from this category are administrators, security guards and overseers; 62.

Food Security refers to any plan, policy or strategy aimed at ensuring adequate supplies of appropriate food at affordable prices. Food security may be achieved through self-sufficiency (i.e. ensuring adequate food supplies from domestic production), through self-reliance (i.e. ensuring adequate food supplies through a combination of domestic production and importation), or through pure importation; 63.

Foreshore Land is a string of land margining a body of water; the part of seashore between the low-water line usually at the seaward margin of a low tide terrace and the upper limit of wave wash at high tide usually marked by a beach scarp or berm; 64.

Fully-developed Fishpond Area is a clean leveled area enclosed by dikes at least one foot higher than the highest floodwater level in the locality and strong enough to resist pressure at the highest flood tide; consists of at least a nursery pond., a transition pond, a rearing pond or a combination of any or all said classes of ponds, and a functional water control system and producing in a commercial scale; 65.

Gross Tonnage includes the underdeck tonnage, permanently enclosed spaces above the tonnage deck, except for certain exemptions. In broad terms, all the vessels’s closed-in spaces expressed in volume terms on the bases of one hundred cubic feet (that equals one gross ton); 66.

Group Seine Operation/Group Seining refers to the fishing operations of purse seine or ring net fishing fleet consisting of a group of vessels that include the catcher vessel and its support vessels such as carriers, rangers, sonar boats, search boats, scout boars, and light boats; 67.

Harvest Control Rules refers to actions or set of actions to be taken to acheive a medium or long term target reference point while avoiding reaching or breaching a limit reference; 68.

Inland Fishery refers to the freshwater fishery and brackishwater fishponds; 69.

Kagulkol/bakulkol is a method of fishing using a scaring device or instrument to smash water, corals, etc. in pursuit or absent of pursuit of target species; 70.

Lake is an inland body of water, an expanded part of a river, a reservoir formed by a dam, or a lake basic intermittently or formerly covered by water; 71.

Lifesaving tools and equipment are Philippine Coast Guard accredited facilities to include, but not limited to, rescue tubes, rescue boards, life buoys, life ring, life jackets, first aid kits, and more; or tools and improvised equipment that qualifies the standard of the Philippine Red Cross or any PCG accredited organization; 72.

Life vest refers to life preserver consisting of a sleeveless jacket of bouyant or inflatable design life vest-life preserver consisting of a sleeveless jacket of buoyant or inflatable design cork jacket, life jacket, flotation device; life preserver, preserver-rescue equipment consisting of a buoyant belt or jacket, air jacket or an inflatable life jaket to keep a person from drowning; 73.

Likos means a hem in fish with stakes and nets so as to prevent fish from going back into the sea; 74.

Limited Access refers to a fishery policy by which a system of equitable resource use and allocation is established by law through fishery rights granting and licensing procedure as provided in this Code; 75.

Lumen is a measure of the total amount of visible light emitted by a source; 76.

Mangroves refers to a community of intertidal plants including all species of trees, shrubs, vines and herbs found on coasts, swamps, or border to swamps; 77.

Marginalized fisherfolk includes the self- employed fishermen whose nature and operation of their work are beyond the scope and reach of government legislation and regulations or fishermen accorded with lesser importance and underrepresented; 78.

Marine Habitat refers to an ecological or environmental area inhabited by one or more living species of marine life. It can be divided into coastal and open ocean habitats; 79.

Marine Protected Area (MPA) refers to a defined area of the sea established and set aside by law, administrative regulation, or any other effective means in order to conserve and protect a part of or the entire enclosed environment through the establishment of management guidelines. It is considered a generic term that includes all declared areas governed by specific rules or guidelines in order to protect and manage activities within the enclosed area; 80.

Maximum Sustainable Yield (MSY) is the largest average quantity of fish that can be harvested from a fish stock resource within a period of time (e..g. one year) on a sustainable basis under existing environmental conditions; 81.

Migration path means the migration route of spawning, schooling or feeding migratory species, going downstream migration; 82.

Migratory Species refers to any fishery species which in the course of their life could travel from freshwater to marine water or vice versa, or any marine species which travel over great distances in waters of the ocean as part of their behavioral adaptation for survival and speciation;

a) Anadromous species are marine fishes which migrate to freshwater areas to spawn; and

b) Catadromous species are afreshwater fishes which migrate to marine areas to spawn.

83.

Multiple violations as provided in Item 82 of Section 4 of RA 10654, refers to the commission of an offender at any one instance, of three (3) or more violations as defined thereof, which are not enumerated under (a) to (i) of Item 82 of Section (4) of RA 1065, resulting to actual damage of at least Php 5 Million which, taken together, constitute a serious disregard of the Code, and therefore qualify as a serious violation; 84.

Monitoring, Control and Surveillance

a) Monitoring means the requirement of continuously observing : 1) fishing effort which can be expressed by the number of days or hours of fishing, number of fishing gears and number of fisherfolk; 2) characteristics of fishery resources; and 3) resource yields (catch);

b) Control is the regulatory conditions (legal framework) under which the exploitation, utilization and disposition of the resource may be conducted; and

c) Surveillance is the degree and types of observations required to maintain compliance with regulations; 85.

Municipal Fisherfolk refers to any person who is directly or indirectly engaged in municipal fishing and other related fishing activities; 86.

Municipal Fishing refers to fishing within a municipal water using fishing vessels of three (3) gross tons or less, or fishing not requiring the use of fishing vessels; 87.

Municipal Waters includes not only streams, lakes, inland bodies of water and tidal waters within the municipality which are not included within the protected areas as defined under Republic Act No. 7586 (The NIPAS Law), public forest, timber lands, forest reserves or fishery reserves, but also marine waters included between two (2) lines drawn perpendicular to the general coastline from points where the boundary lines of the municipality touch the sea at low tide and a third line parallel with the general coastline including offshore islands and fifteen (15) kilometers from such coastline. Where two (2) municipalities are so situated on opposite shores that there is less than thirty (30) kilometers of marine water between them, the third line shall be equally distant from opposite shore of the respective municipalities; 88. Non-governmental Organization (NGO) is an agency, institution, a foundation or a group of persons whose purpose is to assist peoples organizations/ associations in various ways including, but not limited to, organizing, education, training, research and/or resource accessing; 89.

Obstruction to navigation and flow of water refers to all forms of water and land-based structures, whether permanent or movable, constructed without proper authorization from an appropriate government agency, which obstruct navigation or impede the flow of water, causing water stagnation, pollution or massive flooding, provided, that in the case of rivers or streams, the structures are constructed at least one- fourth (1/4) of the width of the river or stream measured from where the structure is erected or constructed; 90.

Open ocean habitats are found in the deep ocean beyond the edge of the continental shelf, including the extended continental shelf. Marine habitat includes the very organisms that make it up such as, but not limit to, corals, seagrass, seaweeds, and mangroves; 91.

Pakura means a small motorized boat, three (3) gross tons (GT) or less, using handline fishing gear and operates in conjunction with a commercial tuna handline vessel; 92.

Payao is a fish aggregating device consisting of a floating raft anchored by a weighted line with suspended materials such as palm fronds to attract pelagic and schooling species common in deep waters; 93.

Pearl Farm Lease is public waters lease for the purpose of producing cultured pearls; 94.

People’s Organization is a bonafide association of citizens with demonstrated capacity to promote the public interest and with identifiable leadership, membership and structure. Its members belong to a sector/s who voluntarily band themselvest together to work and by themselves for their own upliftment, development and greater good; 95.

Person is a natural or juridical entities such as individuals, associations, partnership, cooperatives or corporations; 96.

Philippine Waters includes all bodies of water within the Philippine territory such as lakes, rivers, streams, creeks, brooks, ponds, swamps, lagoons, gulfs, bays and seas and other bodies of water now existing or which may hereafter exist in the provinces, cities, municipalities, and barangays and the waters around, between and connecting the islands of the archipelago regardless of their breath and dimensions, the territorial sea, the sea beds, the insular shelves, and all other waters over which the Philippines has sovereignty and jurisdiction including the 6200 nautical miles Exclusive Economic Zone and the continental shelf; 97.

Post-harvest Facilities includes, but are not limited to, fishport, fishlanding, ice plants and cold storages, fish processing plants; 98.

Purse Seine is a form of encircling net having a line at the bottom passing through rings attached to the net, which can be drawn or pursed. In general, the net is set from boat or pair of boats around the school of fish. The bottom of the net is pulled closed with the purse line. The net is then pulled aboard the fishing boat or boats until the fish are concentrated in the bunt of fish bag; 99.

Reference Points means benchmark values often based on indicators such as fishery stock size or the level of fishing that serves as standard to compare estimates of a fishery stock size and fishing mortality over time depending on the biological characteristics of the species.

Reference points can mark:

a) a limit or a level that should be avoided;

b) a target, which should be achieved and maintained; and

c) a trigger that signal the need to take prescribed actions.

100. Regional Fisheries Management Organization (RFMO) means a multi- lateral organization with responsibility to coordinate management and establish conservation and management measures for highly migratory fish stocks that straddle national fisheries management boundaries and other high seas species; 101. Resource Rent means the difference between the value of the products produced from harvesting a publicly owned resource less the cost of producing it, where cost includes the normal return to capital and normal return to labor; 102. Safety Vest Device is a sleeveless garment, often having buttons down the front, worn usually over a shirt or blouse; 103. Scaring device refers to any apparatus or instrument design to control the movement of fish, to startle, scare away or preclude passage of fish from the entrance into restricted areas; 104. Sea Farming means the stocking of natural or hatchery- produced marine plants or animals, under controlled conditions, for purposes of rearing and harvesting, but not limited to, commercially-important fishes, mollusks (such as pearl and giant clam culture), including seaweeds and seagrasses.

105. Sea Ranching means the release of the young of fishery species reared in hatcheries and nurseries into natural bodies of water for subsequent harvest at a particular period; 106. Secretary refers to the Secretary of the Department of Agriculture; 107. Serious Violation means any of the following violations of the supervision of this Code;

a) Fishing without valid license, authorization or permit;

b) Fishing without reporting the catch or misreporting the catch;

c) Fishing during ban period in municipal waters;

d) Fishing in closed area or during a closed season;

e) Fishing of prohibited species;

f) Fishing with the use of prohibited gear or methods;

g) Falsifying, concealing or tampering with vessel markings, identity or registration to conceal vessel identity or lack of registration;

h) Concealing, tampering or disposing of evidence relating to an investigation of a violation;

i) Assaulting, resisting, intimidating, harassing, seriously interfering with, or unduly obstructing or delaying a fisheries law enforcer, authorized inspector, or observer or other duly authorized government officer;

j) Intentionally tampering with or disabling the vessel monitoring system; and

k) Commiting multiple violations which constitute a serious disregard of this Code.

108.

Sinsin is a fishing net or dragnet that hangs vertically in the water with its bottom edge held down by weights and its top edge buoyed by floats which can be deployed from the shore as a beach seine, manually or from a boat; 109.

Single Seine Operation/ Single Seining refers to the fishing operations of the purse seine catcher vessel having the capacity to store or preserve its catch, including the search and support operations of its skiff boats, aircraft, drone or any other support vessel; 110.

Sudsud or Push net refers to a fishing gear also known as sakay , suro, patono, consisting of a synthetic or natural fiber material attached to a rigid framed bamboo pole or wooden post or log, operated either manually or by the use of a motorized boat with single piston engine of not more than sixteen (16) horsepower, and used to catch acetes, small shrimps, anchovies and other fish; 111.

Superlight is a type of fishing attractor which employs extraordinary lights using, among others, mercury vapor, high pressure sodium vapor, standard tungsten, tungsten halogen, fluorescent or lightemitting diode, that are attached to a structure above water or suspended underwater to attract both fish and members of their food chain to specific areas in order to harvest them; 112.

Three highest officers for purposes of this Code, the Captain or Maestro shall be considered the highest officer and the Master Fisherman the second highest officer, the third highest officer shall be the next highest responsible person after the Master Fisherman and shall be responsible for decision – making in fishery operations. The three (3) officers must be on board the vessel; 113.

Transhipment refers to the transfer of all or any fish or fishery product from one fishing vessel to another; 114.

Total Allowable Catch (TAC) is the maximum harvest allowed to be taken during a given period of time from any fishery area, or from any fishery species or group of fishery species, or combination of area and species and normally would not exceed to MSY; 115.

Trawl is an active fishing gear consisting of a bag-shaped net with or without otter boards to open its opening which is dragged or towed along the bottom or through the water column to take fishery species by straining them from the water, including all variations and modifications of trawl (bottom, mid-water, and baby trawls) and tow nets; 116.

Unregulated Fishing refers to fishing activities conducted by:

a) Vessels without nationality, but operated by Filipino and/or Filipino corporation;

b) Philippine-flagged fishing vessels operating in areas managed by RFMOs to which the Philippines is not a party to; or

c) Philippine-flagged fishing vessels operating in areas or fish stocks where there are no applicable conservation and management measures; 117.

Unreported Fishing refers to fishing activities which have not been reported, or have been misreported to the Department, in contravention of national laws and regulations of the Philippines, or undertaken in the area of competence of a relevant RFMO which have not been reported or have been misreported, in contravention of the reporting procedures of that organization and further elaborated by regulations to be promulgated by the Department; 118.

Value of species except for threatened, endangered or rare species, refers to the regional market value of the species for the previous year as determined by the Philippine Fisheries Development Authority (PFDA) or in other cases, as the evidence may warrant; 119.

Vessel Monitoring Measure means a method or a system used to track and monitor the position, course and speed of the vessels at any given time for the purpose of management of fishing effort and fisheries resources and for traceability; 120.

Vessel without nationality means vessels without registration from any state or those bearing more than one registration or flying the flag of a state where it is not registered.

ARTICLE II MANAGEMENT, DEVELOPMENT AND CONSERVATION OF FISHERIES AND AQUATIC RESOURCES

SECTION 7. COLOR CODING OF MUNICIPAL FISHING BOATS. For easy identification and monitoring of municipal fishing boats within the IBAMO, the following colors are hereby adopted in the following IBAMO member-municipalities: a) Tudela -------- - Fuschia pink b) Sinacaban - - - - - - - - - Red c) Jimenez - - - - - - - - - Yellow d) Panaon - - - - - - - - - White e) Aloran - - - - - - - - - Orange f) Oroquieta City - - - - - - - - - Blue g) Lopez Jaena - - - - - - - - - Green h) Plaridel - - - - - - - - - Violet

The respective boats shall be painted with the above-mentioned assigned color.

SECTION 8. REQUIREMENTS FOR FISHING BOATS TO FISH. All municipal fishing boats shall only be allowed to fish, provided, the following requirements are complied with:

a) The upper part of the boat shall be painted at least one (1) foot or two (2) inches from the top with the corresponding assigned color of the LGU;

b) Secured the necessary permits and paid the corresponding fees;

c) Paid the necessary fines and penalties as required by this Code; and

d) Complied with the other necessary requirements as provided in this Code.

SECTION 9. BAN PERIOD FOR FISHING. In order for fishes to breed and spawn, banned periods are hereby declared, as agreed by the IBAMO LGUs, to be observed in 3 days, starting on the 3rd day at 12:00 midnight to the 5th day at 12:00 midnight after the first new moon.

SECTION 10. CLOSED SEASON FOR SPECIFIC FISH SPECIES. A “closed season” shall be declared and implemented in the area where specific species of fish are found upon results of a thorough scientific studies conducted by experts and with the endorsement from the local legislative body of the LGU concerned.

SECTION 11. COASTAL CLEAN-UP. In order to maintain the quality of the environment within the Iligan Bay coastal communities, a regular clean-up day shall be implemented. It shall fall on the last Friday of every month. Further, the observance of the International Coastal Clean-up on the 3rd Saturday of September every year shall also be complied with.

Proper waste segregation, recycling and sorting shall be enforced among the coastal communities within the IBAMO areas to reduce solid wastes.

SECTION 12. WASTE SEGREGATION. As part of the environmental protection efforts, beach resort owners/ operators shall observe proper waste segregation and provide Material Recovery Facility (MRF) in accordance with R.A. 9003 or the Ecological Solid Waste Management Act of 2000.

SECTION 13. SKILLS TRAINING FOR RECYCLING OF WASTES. Skills training shall be conducted to enable the women and other vulnerable groups to produce useful items, such as handicraft, house decors, etc. from the recycled wastes.

SECTION 14. REHABILITATION AND MAINTENANCE OF MANGROVE AND BEACH AREAS. The Alliance shall facilitate in the rehabilitation and maintenance of mangrove and beach areas to preserve the quality of the environment within the coastal areas which could also serve as an adaptive measure to mitigate the effect of climate change. Utilization of mangrove areas shall be allowed in a way that it will contribute to its protection and at the same time contribute to supplemental livelihood of the fisherfolks through the adoption of appropriate technologies, such as the aquasilviculture and sea ranching of high value marine products.

SECTION 15. PROTECTION OF CORALS AND SEA GRASS BEDS. There shall be Protection mechanisms of the coral reefs and seagrass to be implemented by the IBAMO within its areas.

SECTION 16. ADOPTION OF ECOSYSTEM APPROACH TO FISHERY MANAGEMENT. IBAMO shall adhere to the total approach of resource management through the protection and conservation of its natural resources as espoused under the Ridge-to-Reef and Ecosystem Approach to Fishery Management.

SECTION 17. COMPLIANCE WITH ENVIRONMENTAL AND SAFETY MEASURES. All establishments within coastal areas of the Iligan Bay shall comply with standard requirements such as comfort rooms, lifeguards, and other facilities for environmental and safety purposes.

SECTION 18. COASTAL LAW ENFORCEMENT IN THE MUNICIPAL WATERS OF IBAMO.

a) Composition. There shall be organized a Composite Task Force composed of the following:

And other representative/s as possible addition or identified by the LGUs. Functions/Duties/Responsibilities. IBAMO shall manage the task force and provide logistic support deemed necessary to operate effectively in the strict enforcement of the fishery laws and Ordinances.

The members of the Composite Task Force Team shall be permanently and officially designated by concerned agencies. Their functions shall be solely dedicated to coastal law enforcement.

SECTION 19. COASTAL RESOURCE MANAGEMENT. The Coastal Resource Management is an urgent need to manage and protect the coastal resource, develop and enhance environmental and food security. It is a management that includes spatial planning, economic evaluation, and environmental risk assessment and to further address the deteriorating coastal environment, loss of resources and increasing poverty.

It includes land use plans, development plans, CRM plans that describe the derived goals, objectives, provide specific strategies such as zoning and environmental guidelines:

1. Management of development impacts in areas of jurisdiction;

2. Prepare development plan of CRM;

3. Provide overall coordination & facilitation for planning & environmental assessment;

4. Manage solid waste and enforce pollution control laws at the local level;

5. Enforce cease-and-desist orders of the Pollution Adjudication Board;

6. Support local enforcement agencies;

7. May conduct reclamation projects subject to oversight by the National Public Estates Authority; and

8. May establish tourism facilities subject to coordination with the Department of Tourism. a) Creation of Coastal Resource Management Team (CRM) Team in IBAMO LGUs. The CRM Team is hereby created and shall be composed of the following:

1. Provincial Governor as Chairperson

2. IBAMO Municipal Mayors (Tudela, Sinacaban, Jimenez, Panaon, Aloran, Oroquieta, Lopez Jaena and Plaridel) as Members

3. IBAMO Secretariat b) Consolidation of Coastal Resource Management (CRM) Plans and Projects along IBAMO areas.

SECTION 20. MANAGING DEVELOPMENT IN COASTAL ZONES. Marine biodiversity has long been a key source of food security and economic activity, underpinning the economic and social development for the Filipinos that live within the coastal zone and whom live in poverty. Development project in the coastal zone and in upland areas can have widespread important on coastal habitats such as beaches, mangroves and coral reefs as well as fishery resources. The major impacts of development include:

a) Habitat destruction which include reclamation projects, conversion of mangroves to fishponds;

b) Alteration of natural ecosystem processes;

c) Erosion, accretion & hydrological imports; and

d) Adverse impacts on human health & welfare.

SECTION 21. PERIODIC ASSESSMENT. An assessment, monitoring and evaluation of the programs and plans of the IBAMO relative to the Coastal Resource Management shall be made periodically. The frequency of the assessment including the tools and methodologies to be used shall be identified by the Assessment Team. a) Creation of Assessment and Monitoring Team (Programs and Plans)

1.5 NGO Representative b) Functions, Duties and Responsibilities

1. Conduct assessment before the program and project implementation to covered IBAMO communities;

2. Identify tool and methodologies to be used during the assessment and monitoring of the program and projects of IBAMO;

3. Prepare and submit report and recommendations regularly based from the assessment and monitoring output on program and project implementation. c) Frequency of assessment and monitoring. Conduct semi and annual monitoring of the program and projects under IBAMO communities

SECTION 22. PROTECTION OF MARINE SANCTUARY. The Marine Protected Areas (MPAs) of the member-LGU shall be identified and recognized by the IBAMO as to its area, coverage and jurisdiction, maintenance & protection of marine sanctuary.

SECTION 23. FISHERIES & AQUATIC RESOURCES MANAGEMENT COUNCIL. Regular updating of the composition and functions of the M/CFARMC and Provincial FARMC Federation shall be done. a) Creation of the M/CFARMCs of the municipalities and cities abutting municipal waters. They shall serve in an advisory capacity to the LGUs. b) Functions of the M/CFARMCs.

The M/CFARMCs shall exercise the following functions:

1. Assists in the preparation of the Municipal Fishery Development Plan and submit such plan to the Municipal Development Council;

2. Recommends the enactment of municipal fishery ordinances to the Sangguniang Bayan/ Sangguniang Panlungsod through its Committee on Fisheries if any; or any other appropriate Committee;

3. Assists in the enforcement of fishery laws, rules and regulations in municipal waters;

4. Advises the Sangguniang Bayan/ Panlungsod on fishery matters through its Committee on Fisheries, if such has been organized; and

5. Performs such other functions which may be assigned by the Sangguniang Bayan/Panlungsod. c) Composition of the M/CFARMC.

The regular members of the M/CFARMCs shall be composed of:

1. Municipal/City Planning Development Officer;

2. Chairperson, Agriculture/Fishery Committee of the Sangguniang Bayan/Panlungsod;

3. Representative of the Municipal/City Development Council;

4. Representative from the accredited non-government organization;

5. Representative from the private sector;

6. Representative from the City/ Municipal Agriculture Office and/or City/Municipal Environment and Natural Resources Office

7. At least seven (7) fisherfolk representatives, seven (7) municipal fisherfolk, one (1) fishworker and three (3) commercial fishers in each municipality/city which include representative from youth and women sector. The Council shall adopt rules and regulations necessary to govern its proceeding and election.

SECTION 24. PROVINCIAL COASTAL RESOURCES MANAGEMENT FRAMEWORK. Section 77 of the Ordinance No. 22-16 of this Sanggunian, “The Revised Environment Code of Misamis Occidental” provides for the Provincial Coastal Resources Management Framework. In consideration of the transboundary character of the issues, challenges, and problems confronting our municipal waters and pursuant to the general welfare clause of RA 7160, the Governor shall establish a Provincial Coastal Resources Management Framework (CRMF) within six (6) months upon the effectivity of the Revised Environment Code, to serve as a guide for coastal municipalities in undertaking, among others, the delineation, establishment, management, and maintenance and protection of their municipal waters. The CRMF shall take into account the “reef-to-ridge” or “ecosystem-based” adaptation approach provided under EO 533.

At the minimum, the CRMF shall include working guides for the conduct of the following:

a) Delineation of boundaries of municipal waters;

b) Preparation of zoning and management plans covering municipal waters;

c) Strengthening the fisherfolk organizations;

d) Creation of organizational and institutional mechanisms;

e) Preparation of procedures in dealing with pollution (from liquid and solid waste) of municipal waters;

f) Creation of regulations governing recreational, educational, and scientific use of municipal waters;

g) Enhancement of investments promotion, revenue generation and livelihood;

h) Creation of procedures in dealing with abandoned, unproductive and illegal fishponds.

i) Rehabilitation of mangroves;

j) Development of alternative livelihood;

k) Formulation, promulgation, and enforcement of fishing laws, rules and regulations;

l) Assessment of Fish Stock and other Marine Resources;

m) Periodic monitoring and evaluation;

n) Review and inventory of foreshore leases and land titles within coastal zones.

The Governor shall adopt all measures to encourage the municipal and city mayors and officials, coastal inhabitants, and concerned national government agencies to complete the delineation, establishment, management, and maintenance and protection of their municipal waters pursuant to the Local Government Code.

It shall be incumbent upon the concerned Municipal Mayor or City Mayor, as the case may be, to measure, delineate, demarcate, zonify, and produce maps of their respective territorial boundaries, employing in the process a certified engineer; provided, that the delineation of municipal territorial waters shall be undertaken jointly by contiguous municipalities to avoid future controversies in boundary lines; provided further, that the amicable settlement of boundary disputes between municipal waters shall be governed by Section 118 and Section 119 of RA 7160; provided finally, that no fishery privileges shall be issued, pursuant to Section 149, RA 7160, until the measurement, delineation, demarcation, zonification and mapping of municipal waters have been duly completed.

The Governor is hereby authorized to issue the appropriate implementing rules and regulations, circulars, directives and memoranda, including sanctions for the purpose of implementing the provisions of this Section.

SECTION 25. REEF-TO-RIDGE MANAGEMENT. The Reef- to-Ridge project shall directly address problems of the coastal communities such as:

a) Reversing degradation of coastal resources,

b) Enhancing livelihoods of coastal communities especially the fishermen and whose main source of living comes from the sea; and

c) Capacity building and information/data base management.

Thus, the following actions for projects shall be considered before its implementation:

a) Understanding material transfers from watersheds and reducing “downstream” effects of agriculture and forestry on coastal aquatic ecosystems;

b) Addressing non-optimal use of resources through valuation and “environmental payments”;

c) Identifying, mapping and strengthening management of critical coastal habitats;

d) Understanding the factors determining livelihoods for poor coastal communities and facilitate the application of Ecosystem Approach to Fisheries (EAF);

e) Restoring production from capture fisheries;

f) Developing technologies for alternative or supplementary livelihoods for coastal communities;

g) Resource mapping (Biodiversity Information System) for effective resource management and monitoring and;

h) Capacity Building in Biodiversity Conservation and Natural Resources Management

SECTION 26. CLIMATE RESILIENT. Rapid population growth, poor coastal planning and weak governance have subjected the ecosystems and society to extraordinary pressures over the years. This manifests itself at the community level with inconsistent MPA governance and enforcement, and a tendency for over-fishing and destructive fishing in and around MPAs to become socially tolerated. The result has been a dramatic reduction in biomass and ecosystem integrity, a trend now amplified by the increasing effects of climate change. Coastlines are one of the world’s most at-risk areas from climate change. Pride approach to train and support local leaders to deploy a combination of social marketing, program management, technical implementation, and scientific monitoring. Key elements include:

a) Integrated social marketing and communication campaigns that transform target communities’ positive engagement in and capacity to address overfishing, climate change adaptation, and related issues.

b) Intense investment in building and embedding local capacity and governance to implement MPA network and climate adaptation management.

c) Creative partnerships between organizations from different sectors (government, academe, NGO, business, etc.)

ARTICLE III FISHING GEARS AND FISHING METHODS

SECTION 27. USE OF ALLOWABLE FISHING GEARS AND METHODS.

Generally, only passive gears are allowed to be used in fishing within the municipal waters. Among others, the following are considered as those allowed:

a) Hook and line either single or multiple with local variations such as those used to catch squid and other fish species;

b) Fish pots (panggal or bobo) in varied designs with local innovations using bamboos and other local materials;

c) Fish traps, a fish net used to trap fishes with allowable mesh size not less than three centimeters (3 cms.);

d) Gill nets (bottom set gill net, palundag) must conform to 3 cms mesh size;

e) Gill net (Drift gill net, palutaw) must conform to 3 cms mesh size;

f) Lift net (sapyaw) must conform to 3 cms mesh size;

g) New look (stationary bagnet) can be included provided it stays stationary (passive) and only lifted to retrieve the catch;

h. Fish shelter (Payao) fish aggregating device provided that payao established within 10.1 to 15km is for commercial fishermen (small and medium scale only) and payao within 10 km and below is for municipal fishermen (refer to RA 8550 as amended by RA 10654).

SECTION 28. PROHIBITED GEARS AND FISHING METHODS.

The Alliance shall strictly prohibit the use of the following:

a) The use of fishing gears such as the “sudsud”, “paaling” trawls, purse seine nets, danish seine, which are destructive to corals and sea grass;

b) The use of explosives of any kind for fishing, and the mere possession of it will constitute grave offense and will be subject to the penalty imposed in the Philippine Fisheries Code;

c) The use of noxious or poisonous substances whether from plants or chemicals intended to catch fish and other marine creatures;

d) Electrofishing in both marine and fresh water bodies;

e) The use of superlights for municipal fishing;

f) Fine mesh nets below 3 cms mesh size, except, during bolinao, malangsi, guno, malagkas and “BANGUS FRY” season and only in designated areas where these nets can be used.

g.) The use of two-ply fishing net, adopting the Ordinance No. 03-S-2016 of the Sangguniang Bayan of Panaon, “An Ordinance Prohibiting the Use of Two-Ply Nets or more than this Number in Fishing within the Municipal Waters of Panaon, Misamis Occidental”.

h.) The use of three-ply or more ply fish nets (Kagulkol; Lampurnas/Sinsin; Likus)

i.) Buso (compressor); and

Ordinance

j.) Any gears modified/improvised which are destructive in nature is strictly prohibited.

SECTION 29. INVENTORY OF LOCAL GEARS/FISHING METHODS. The Alliance shall make an inventory of local gears/fishing methods and its local terms and agree what are to be allowed. This is necessary since the standard fishing gears have undergone some innovations among local fisherfolks which maybe illegal in some ways such as the 3-ply nets in the guise of complying with the legal mesh size prescribed in the Philippine Fisheries Code.

As part of its public information campaign to use only legal fishing gears among the fisherfolks, it should print out copies of said fishing gears, their description and other details so that it can be better visualized by the fisherfolks.

SECTION 30. REPORT OF TRANSFER OF OWNERSHIP OF BOATS AND FISHING GEARS. The owner/ operator of registered boats shall notify the concerned Municipal Government of the transfer of ownership of the boats and fishing gears within fifteen (15) days after its transfer.

ARTICLE IV LICENSES, PERMITS AND SCHEDULE OF FEES

SECTION 31. SECURING OF FISHERY LICENSES AND PERMITS. All municipal/city fisherfolk shall secure the necessary fishery licenses and permits from the municipality of residence before they will be allowed to fish. This shall include the fishing boat, the fishing gears or any fishing activities within IBAMO and shall be non-transferrable, and, provided further that the holders agree unconditionally to comply with all the laws, ordinances, policies, rules and regulations pertaining thereto.

SECTION 32. COMMERCIAL FISHING BOAT. The commercial fishing boats may be allowed to fish within 10.1 to 15 kilometers provided that such particular activity is allowed by the LGU concerned. Provided further, that corresponding permits are appropriately secured.

SECTION 33. RENEWAL OF LICENSE AND PERMIT. The fishery license and permit shall be renewed annually at least 60 days before its expiration date, and failure to do so will be subject to its cancellation.

SECTION 34. REQUIREMENTS FOR APPLICATION OF FISHERY LICENSE AND PERMIT. Any applicant for Fishery License and Permit shall submit the following to the City/Municipal Agriculture Office, Fisheries Division and/or City/Municipal Environment and Natural Resources Office (MENRO) Coastal Resources Management and Fisheries Division (CRMFD).

a) Fishery License;

b) Duly Accomplished Application Form;

c) Registration Papers (for motor boats);

d) Official Receipt of Payment of Permit Fee;

e) Other documents depending on the license applied for, and

f) Other regulatory fee.

The City/Municipal Agriculture Office, Fisheries Division and/or Coastal Resources Management and Fisheries Division (CRMFD) of the C/MENRO, in consultation with the C/MFARMC, shall recommend the issuance of the license and/or to the Municipal Mayor.

SECTION 35. SCHEDULE OF FEES. Permit to utilize, produce, culture, capture or gather fish of any species and other fishery products in the Municipal waters shall be granted upon payment of the corresponding fishery permit fees, the rate shall not exceed those fixed hereunder.

SECTION 36. SCHEDULE OF LICENSE FEES. License fee for specific fishery activity shall be granted only to permitted individuals, organization, cooperatives, partnerships and corporations upon payment of the corresponding fees at the rate not exceeding those fixed hereunder.

SECTION 37. PERMIT TO DOCK AND/OR ANCHOR. All fishing vessels (including transient) that will dock and/ or anchor in the municipal fishing port and in identified fish landing center shall pay the fish docking/anchorage fee to the City/Municipal Government concerned. The following are the types of vessels covered and the corresponding dock fees.

a) For sea craft of 3.0 gross tons and below, P3,000.00/annum or P500.00 per docking/ anchorage per annum

b) For sea craft more than 10 gross tons, P5,000.00/annum or P1,000.00/docking anchorage per annum

c) For Commercial Fishing Boat to fish in 10.1 to 15 km from shoreline, P24,000.00 per annum

SECTION 38. FEES EXCEEDING FIVE HUNDRED PESOS (P500.00). Fees exceeding FIVE HUNDRED PESOS (P500.00) may be paid on a quarterly basis on or before the third month of the quarter.

SECTION 39. FIXED RATES FOR THE USE OF BODIES OF WATER. Fixed rates for various uses of the bodies of water within IBAMO LGUs shall be referred to the respective City/Municipal Revenue Code based on the following categories:

a) Floating Restaurant

b) Diving Sites

c) Snorkeling sites

SECTION 40. OTHER FEES. Other fees that involve local application shall be the responsibility of the concerned LGU, and should be treated as such, with conditions that it will not violate any laws and rules and regulations as stated in R.A. 8550 as amended by R.A. 10654.

SECTION 41. GRATUITIOUS PERMIT. The City/Municipal Government concerned may issue gratuitous permits to local fishers to utilize, occupy, produce, culture, capture or gather fish of any species and other fishery products in the municipal waters. Government agency or institution of learning engage in any activities in the municipal waters for specific or educational purposes may also be given gratuitous permit subject to the terms and conditions as may be imposed by the concerned LGU. Provided further, that the utilized, occupied, produced, cultured, captured or gathered fish of any species and other fishery products taken out of the municipal waters should not exceed ten (10) kilos or not more than the value of two thousand pesos (P2,000.00) only.

SECTION 42. USAGE OF REVENUES. The fees/revenues generated from the licenses and permits provided under the preceding article shall be put in a Trust Fund and shall be used for fisheries’ management, fisherfolk’s livelihood and law enforcement.

2. Discovery of any person in an area where he has no permit or registration paper for a fishing vessel shall constitute a prime facie presumption that the person and/ or vessel is engaged in unauthorized fishing: Provided, that fishing for daily food sustenance or for leisure which is not for commercial, occupation or livelihood purposes may be allowed;

3. It shall be unlawful for any commercial fishing vessel to fish in bay and in such other fishery management areas which may hereinafter be declared as over- exploited.

Any commercial fishing boat captain or the three (3) highest officers of the boat who commit any of the above prohibited acts shall be also penalized.

4. It shall be unlawful for any person not listed in the registry of municipal fisherfolk to engage in any commercial fishing activity in municipal waters. Any municipal fisherfolk who commit such violation shall be punished by confiscation of their catch and a fine of Five hundred pesos (500.00). h) FISHING WITH THE USE OF EXPLOSIVES, NOXIOUS OR POISONOUS, SUBSTANCE, AND/ OR ELECTRICITY.

1. It shall be unlawful for any person to catch, take or gather or cause to be caught, taken or gathered, fish or any fishery species in Philippine waters with the use of electricity, explosives, noxious on poisonous substance such as sodium cyanide in the Philippine fishery areas, which will kill, stupefy, disable or render unconscious fish or fishery species: Provided, That the Department, subject to such safeguards and conditions deemed necessary and endorsement from the concerned LGUs, may allow, for research, educational or scientific purposes only, the use of electricity, poisonous or noxious substances to catch, take or gather fish or fishery species: Provided, further, That the use of poisonous or noxious substances to eradicate predators in fishponds in accordance with accepted scientific practices and without causing adverse environmental impact in neighboring waters and grounds shall not be construed as illegal fishing;

2. It will likewise be unlawful for any person, corporation or entity to possess, deal in, sell or in any manner dispose of, any fish or fishery species which have been illegally caught, taken or gathered.

The discovery of dynamite, other explosives and chemical compounds which contain combustible elements, or noxious or poisonous substances, or equipment or devise for electro- fishing in any fishing vessel or in the possession of any fisherfolk, operator, fishing boats official or fishworker shall constitute prima facie evidence, that the same was used for fishing in violation of this Code. The discovery in any fishing vessel of fish caught or killed with the use of explosive, noxious or poisonous substances or by electricity shall constitute prima facie evidence that the fisherfolk operator, boat official or fishworker is fishing with the use thereof;

3. Mere possession of explosive, noxious or poisonous substances or electrofishing devices for illegal fishing;

4. Actual use of explosive, noxious or poisonous substances or electrofishing devices for illegal fishing without prejudice to the filing of separate criminal cases when the use of the same result to physical injury or loss of human life;

5. Dealing in, selling, or in any manner disposing of, for profit, illegally caught/gathered fisheries species; and

6. In all cases enumerated above, the explosive, noxious or poisonous substances and/or electrical devices, as well as the fishing vessels, fishing equipment and catch shall be forfeited. i) USE OF FINE MESH NET. It shall be unlawful to engage in fishing using nets with mesh smaller than that which may be determined by this Code: Provided, that the prohibition on the use of the mesh net shall not apply to the gathering of fry, glass eels, alvers, tabios, and alamang and other species that by their nature are small but already mature, as identified in the implementing rules and regulations by the Department.

The discovery of a fine mesh net in a fishing vessel shall constitute a prima facie evidence that a net in a fishing vessel is engaged in fishing with the use of fine mesh net.

Upon finding of administrative liability, the LGU shall penalize the owner, operator, captain or master fisherman in case of commercial fishing vessel , or the municipal fisherfolk, with confiscation of the catch and fishing gear, and an administrative fine equivalent to three (3) times the value of the catch.

Provided, that if the offense is committed by a commercial fishing vessel, the boat captain and the master fisherman shall also be subject to the penalties as provided: Provided, further, that the owner/operator of the commercial fishing vessel who violates this provision shall be subjected to the same penalties as provided: Provided finally, that the LGU is hereby empowered to impose upon the offender an administrative fine and /or cancel his permit or license or both. j) USE OF ACTIVE GEAR IN THE MUNICIPAL WATERS AND BAY AND OTHER FISHERY MANAGEMENT AREAS. It shall be unlawful to engage in fishing within the municipal waters and Bay as well as other fishery management areas using active fishing gears as defined in this Code.

The following are the violators of the above prohibitions:

1. The boat captain and master fishernan of the vessels who participated in the violation;

2. The owner/operator of the vessel;

3. If the owner/ operator is a corporation, the penalty shall be imposed on the chief executive officer of the Corporation;

4. If the owner/operator is a partnership the penalty shall be imposed on the managing partner; and

5. The catch shall be confiscated and forfeited. k) BAN ON CORAL EXPLOITATION AND EXPORTATION. It shall be unlawful for any person or corporation to gather, possess, sell or export ordinary precious and semi-precious corals, whether raw or in processed form, except for scientific or research purposes.

Forfeiture of the subject corals, including the vessel and its proper disposition at the discretion of the Court.

The confiscated corals shall either be returned to the sea or donated to schools and museums for educational or scientific purposes or disposed through other appropriate means.

l) BAN ON MURO-AMI, OTHER METHODS AND GEAR DESTRUCTIVE TO CORAL REEFS AND OTHER MARINE HABITAT. It shall be unlawful for any person, natural or juridical, to fish with gear method that destroys coral reefs, seagrass beds, and other fishery marine life habitat as may be determined by the Department. “MuroAmi” and any of its variation, and such similar gear and methods that require diving, other physical or mechanical acts to pound the coral reefs and other habitat to entrap, gather or catch fish and other fishery species are also prohibited.

The following are the violators of the above prohibition: the operator, boat captain, master fisherman, and recruiter or organizer of fishworkers.

The catch and gear used shall be confiscated.

It shall likewise be unlawful for any person or corporation to gather, sell or export white sand, silica, pebbles and any other substances which make up any marine habitat. m) ILLEGAL USE OF SUPERLIGHTS. It shall be unlawful to engage in fishing with the use of superlights in municipal waters or in violation of the rules and regulations which may be promulgated by the Department on the use of superlights outside municipal waters.

The superlight, fishing gears and vessel shall be confiscated. n) CONVERSION OF MANGROVES. It shall be unlawful for any person to convert mangroves into fishponds or for any other purposes.

Provided, that if the area requires rehabilitation or restoration as determined by the court, the offender should also be required to restore or compensate for the restoration of the damage. o) FISHING IN OVERFISHED AREA. It shall be unlawful to fish in overfished area. p) FISHING IN FISHERY RESERVES, REFUGE AND SANCTUARIES. It shall be unlawful to fish in fishery areas declared by the Department as fishery reserves, refuge and sanctuaries. q) FISHING OR TAKING OF RARE, THREATENED OR ENDANGERED SPECIES. It shall be unlawful to fish or take rare, threatened or endangered species as determined by law, ordinance, legal issuance and by the Department. r) CAPTURE OF SABALO AND OTHER BREEDER/ SPAWNERS. It shall be unlawful for any person to catch, gather, capture or possess mature milkfish or “sabalo” and such other breeders or spawners of other fishery species as may be determined by the Department: Provided, That catching of “sabalo” and other breeders/spawners for local breeding purposes or scientific or research purposes may be allowed subject to guidelines to be promulgated by the Department. s) EXPORTATION OF BREEDERS, SPAWNERS, EGGS OR FRY. Exportation of breeders, spawners, eggs or fry as prohibited in this Code. t) IMPORTATION OR EXPORTATION OF FISH OR FISHERY SPECIES. Any importation or exportation of fish or fisheries in violation of this Code and destruction of live fishery species or forfeiture of non-live fishery species in favor of the department for its proper disposition: Provided, that violator of this provision shall be banned from being members or stock holders of companies currently engage in fisheries or companies to be created in the future, the guidelines for which shall be promulgated by the Department. u) VIOLATION OF CATCH CEILINGS. It shall be unlawful for any person to fish in violation of catch ceilings as determined by the Department. v) AQUATIC POLLUTION. Aquatic pollution, as defined in this Code shall be unlawful. w) OTHER VIOLATIONS. The following fisheries activities shall also be considered as a violation of this Code.

1. Failure to Comply with Minimum Safety Standards. The owner and captain of a commercial fishing vessel engaged in fishing who, upon demand by proper authorities, fails to exhibit or show proof of compliance with the safety standards provided in this Code, shall be immediately prevented from continuing with his fishing activity and escorted to the nearest port or landing point. The license to operate the commercial fishing vessel shall be suspended until the safety standard has been complied with; 2. Failure to Conduct a Yearly Report on all Fishponds, Fish Pens and Fish Cages. The Fishpond Lease Agreement (FLA) of the holder who fails to render a yearly report shall be immediately cancelled: Provided, That if the offender be the owner of the fishpond, fish pen or fish cage, he shall be subjected to the following penalties: (1) first offense, a fine of Five hundred pesos (P500.00) per unreported hectare; (2) subsequent offenses, a fine of One thousand pesos (P1,000.00) per unreported hectare; 3. Gathering and Marketing of Shell Fishes. It shall be unlawful for any person to take, sell, transfer, or have in possession for any purpose any shell fish which is sexually mature or below the minimum size or above the maximum quantities prescribed for the particular species; 4. Obstruction to Navigation or Flow and Ebb of Tide in any Stream, River, Lake or Bay. It shal be unlawful for any person who causes obstruction to navigation or flow or ebb of tide; 5. Construction and Operation of Fish Coral Traps, Fish Pens and Fish Cages. It shall be unlawful to construct and operate fish corrals/traps, fish pens and fish cages without a license/permit;

Every penalty imposed for the commission of an offense shall carry with it the forfeiture of the proceeds of such offense and the instruments or tools with which it was committed.

Such proceeds and instruments or tools shall be confiscated and forfeited in favor of the Government, unless they be the property of a third person not liable for the offense, but those articles which are not subject of lawful commerce shall be destroyed. x) COMMERCIAL FISHING VESSEL OPERATORS EMPLOYING UNLICENSED FISHERFOLK OR FISHEWORKER OR CREW. The owner/operator of a commercial fishing vessel employing unlicensed fisherfolk or fisherworker shall be fined Five hundred pesos (P500.00) each for every month that the same has been employed and/or One thousand pesos (P1,000.00) for every month for each unlicensed crew member who has been employed.

ARTICLE V

FINAL PROVISIONS

PROHIBITIONS, FINES AND PENALTIES

SECTION 45. COMPLEMENTATION OF MUNICIPAL ORDINANCES. It is the purpose of this Harmonized Fisheries Code of IBAMO to strengthen and complement local ordinances in support of fishery management and, shall in any way, not prevent LGUs to formulate their ordinances, provided however they should conform to the provisions of the Philippine Fisheries Code and/or this Harmonized Fisheries Code.

This Harmonized Fisheries Code shall further complement the CRM Plans and Comprehensive Development Plans of the LGUs who are members of IBAMO.

SECTION 46. APPROPRIATION. The IBAMO shall allocate funds for the implementation of this Code, and shall likewise be supported by each member-LGU with funds allocated regularly in their Annual Investment Program.

SECTION 47. GENERAL PENAL PROVISIONS. If and when the fines & penalties are not stipulated in this Code, and the same act or omission committed are covered by another law, decree or order which provides for a heavier penalty, the latter shall be made applicable. Provided, however, that should any act or omission punishable under this Code be committed by a public official, the latter shall be prosecuted under the provisions of existing applicable laws.

SECTION 48. IMPLEMENTING RULES AND REGULATIONS. The Implementing Rules and Regulations of this Code shall be issued by the Office of the Provincial Governor within two (2) years after its approval.

SECTION 49. SEPARABILITY CLAUSE. If, for any reason, any provision, section or part of this Code is declared not valid by a Court of competent jurisdiction, or suspended or revoked by the authorities concerned, such judgment shall not affect or impair the remaining provisions, sections or parts which shall continue to be in force and effect.

SECTION 50. APPLICABILITY CLAUSE. All other matters relating to the impositions or regulations provided in this Code shall be governed by the pertinent provisions of existing laws and other ordinances.

SECTION 51. REPEALING CLAUSE. All ordinances and other issuances, which are inconsistent or contrary to the provisions of this Code, are hereby deemed repealed and/or amended accordingly.

SECTION 52. SEPARABILITY CLAUSE. If any portion or provision of this Ordinance is declared unconstitutional or invalid, the other portions or provisions hereof, which are not affected thereby, shall continue in full force and effect.

SECTION 53. EFFECTIVITY. This Code shall take effect after fifteen (15) days following the completion of its publication in a newspaper of general circulation in the Province of Misamis Occidental.

SECTION 43. FINE AND PENALTIES. Consistent & supplementing the provisions of pertinent laws, activities which are prohibited within the territorial jurisdiction of IBAMO, and with definite and express fines and imprisonment provided herein may be prosecuted in accordance with the provisions of this Code. Provided, however that in case when no fines or imprisonment for violation is stipulated in Sec. 44 hereof, it is deemed that Sec. 47 of this Code applies.

community service d) NON- AVAILABILITY OF LIFEJACKETS ON THE BOATS WHEN SAILING, DRIFTING, CRUISING AND FISHING. The availability of lifejacket or life vest/safety reflected device shall be accessible on the boats to prevent fishermen from drowning when fishing offshore. Life vests are vital piece of safety equipment that could save life.

The standard of wearing safety devices/ instruments can protect, promote public safety and security, and save lives to both, the operators, fishermen, their assistants/crew and or their passengers especially during nocturnity, emergency, accidents and calamities wherein they can be easily identified and located by the rescue.

Thus, non-availability of lifejacket/s on boats shall be penalized:

1st Offense Fine of P1,000.00

2nd Offense Fine of P2,000.00

3rd Offense Fine of P3,000.00

4th Offense Fine of P5,000.00 and 10 days imprisonment, and forfeiture

of the boat regardless of ownership

For this purpose, the IBAMO shall appropriate necessary funds for the procurement of lifejackets for duly registered fisherfolks. e) PENALTIES FOR NON-COMPLIANCE OF SECTION 17. The following penalties shall be imposed for violation/s of any of the provision/s of Section 17 hereof.

1st Offense – P1, 000.00 Fine

2nd Offense - P3, 000.00 Fine

3rd Offense - P5, 000.00 Fine plus one (1) month suspension of operation f) BAN ON CUTTING OF MANGROVES. It shall be unlawful for anyone to cut mangrove trees as prohibited under P.D. 705 and R.A. 8550 and R.A. 10654. Any violation thereof shall be subject to the provisions of the aforementioned laws. g) UNAUTHORIZED FISHING OR ENGAGING IN OTHER UNAUTHORIZED FISHERIES ACTIVITIES:

1. No person shall exploit, occupy, produce, breed, culture, capture or gather fish, fry or fingerlings any fishery species or fishery species or fishery products, or engage in any fishery activity in Iligan Bay without a license, lease or permit;

Lagbas and Nograles chose the four NGOs to implement the projects such as the Kabuhayan at Kalusugan Alay sa Masa Foundation, Inc. (KKAMFI), Kasangga sa Magandang Bukas Foundation, Inc. (KMBFI), Gabay at Pag-asa ng Masa Foundation, Inc. (GPMFI) and the Buhay Mo Mahal Ko Foundation, Inc. (BMMKFI).

The Ombudsman also found from the documents and testimonies that Lagbas, and upon his death, Nograles allegedly did not only propose, select, identify the programs to be funded out of the PDAF allocation, but also directly participated and inter vened in the various phases of the project implementation.

Findings from the Commission on Audit (COA) disclosed that the original receipts used by the alleged supplier, C.C. On the issue of Lagbas’ death, the Ombudsman said that “his death (in 2008) did not, in any way, extinguish the crime and probable guilt of the respondents.”

Citing the case of People of the Philippines versus Henry T. Go, the Ombudsman said that “if circumstances exist where the public officer may no longer be charged in court, as in the present case where the public officer has already died, the private person may be indicted alone.”

Insofar as Nograles is concerned, the Ombudsman said, “he took over as caretaker of the 1st district of Misamis Oriental and continued what had been started by Congressman L agbas by signing the letter-request to NLDC for the immediate release of the PDAF allocation of PHP10 , 000,000.00 to KKAMFI. Nograles likewise signed the MOA with NLDC and KKAMFI as well the work financial plans and project proposal.”

Education is the key to eliminating gender inequality, to reducing poverty, to creating a sustainable planet, to preventing needless deaths and illness, and to fostering peace. And in a knowledge economy, education is the new currency by which nations maintain economic competitiveness and global prosperity.

Education must also train one for quick, resolute and effective thinking. To think incisively and to think for one’s self is very difficult. We are prone to let our mental life become invaded by legions of half-truth, prejudices, and propaganda.

Education must enable one to sift and weigh evidence, to discern the true from the false, the real from the unreal,

and the facts from the fiction.

The function of education, therefore, is to teach one to think intensively and to think critically. But education which stops with efficiency may prove the greatest menace to society.

The most dangerous criminal may be the man gifted with reason but with no morals. We must also remember that intelligence is not enough. Intelligence plus character--that is the goal of true education. The complete education gives one not only power of concentration, but worthy objectives upon which

to concentrate.

The broad education will, therefore, transmit to one not only the accumulated knowledge of the race but also the accumulated experience of social living. If we are not careful, our colleges will produce a group of closeminded, unscientific, illogical propagandists, consumed with immoral acts. Be careful teachers.

Let us all be careful! Education should prepare young people for life, work and citizenship.

Once the hospital is completed, Portador said they are planning to build a 17-storey twin towers worth P1.5 billion.

In a release dated March 2014, the Davao Park District was Megaworld’s first township development in Mindanao.

Located on an 11-hectare property along the S.P. Dakudao Loop in Lanang, Davao City which used to be the Lanang Golf and Country Club, Davao Park District is envisioned to be Davao City’s central business district and a major center for information technology and business process outsourcing in Mindanao.

Megaworld is allocating P15 billion in the next five to seven years to build and develop Davao Park District.

First to rise in the township will be office towers suited for business process outsourcing companies and other corporate offices.

Aside from office towers, Davao Park District will feature themed residential condominiums that will be built by Suntrust Properties Inc., a whollyowned subsidiary of Megaworld.

Groundbreaking for upscale hospital in Davao set

DAVAO CITY -- A P2.5billion 12-storey upscale hospital will rise within the 11-hectare township of property giant Megaworld.

The Lanang Premiere Doctors Hospital Inc., which will be built at the Davao Park District S.P. Dakudao Loop in Lanang, this city, is scheduled for groundbreaking on March 14.

Lemuel Portador, chairman and chief executive officer of LPDHI, told a business forum that they will position the hospital as one of premiere medical tourism facilities in the Philippines once completed in two years’ time.

Portador, who owns the 25-year old Tagum Doctors’ Hospital, said he wants to build a topnotch

Promoting good education

As we get older, we develop a theory of getting a good education. Getting a good education depends on the person. Our parents also play a part in preparing you to receive it. From the first day of school parents want them child to do well in school. They encourage their child to do homework, study, and help them when needed. Parents want the best for their children.

Some people think that getting a good education depends on the school

you attend. Just because someone sends their child to private school does not make their education better than a child that has attended public school. Going to intercity or suburban school is looked at when determining who has received a good education. It is ever you make out of it.

It all depends on whether or not you want to sit there and take in what the teacher is teaching.

ELEMENTS OF EFFECTIVE READING INSTRUCTION

We already know a great deal about teaching reading to pupils generally, and increasingly there is a growing knowledge base about how to help pupils who struggle with reading. The following are the elements that form an effective reading instruction: . Phonemic awareness and the teaching of phonics . Decoding and word studies, including the learning of

a sight vocabulary . Language development, to include vocabulary development . The explicit teaching of comprehension strategies . Meaningful writing experiences . The development of fluent reading by reading and rereading familiar texts . A wide-range of reading materials . Opportunities for both

guided and independent reading Beyond this core content, it is clear that those who struggle with reading need enhanced teaching, and for many struggling readers, and particularly readers with dyslexia, the phonic element is most important.

Singleton (2009) emphasises the need for multi-sensory programmes that target phonic knowledge.

Thus, teachers need to ensure that pupils are given a healthy, balanced diet of literacy activities. However, it is not the remit of the learning support/ resource

teacher to deliver all elements cited. Shared reading, the teaching of subject specific comprehension skills and vocabulary building should all be happening in the mainstream classroom or subject lesson.

The task of the learning support teacher is to identify the area of greatest deficit or need. In our experience, the areas of greatest need for the majority of pupils with reading difficulties are phonic knowledge, word reading and reading fluency.
