TIME poll shows widespread support for Pres. Duterte gov’t

Malacañang on Monday welcomed a TIME Magazine online poll on the world’s most influential people which showed President Rodrigo Duterte leading early results, saying it only attests to the strong support of Filipinos to his agenda of real change.

“We note that President Rodrigo Roa Duterte has been included in TIME magazine’s annual list of the 100 most influential persons in the world. President Duterte is grateful to the Filipino people all over the world for their support for him and his agenda of real change in Philippine society,” Presidential Spokesperson Ernesto Abella said in a statement.

Early TIME online survey results on the world’s most influential people showed Duterte garnering 4 percent of the votes, leading other prominent figures such as the Pope and Facebook founder Zuckerberg with 3 percent each.

Malacañang on Monday said the series of New York Times (NYT) articles on President Rodrigo Duterte is clearly a part of a well-funded demolition job mounted by certain groups that include politicians.

“NYT’s very obvious demolition work flies in the face of the very high approval of PPRD enjoys.

The newspaper tries to stir global outrage in a nation

that welcomes its newfound peace and order,” Presidential Spokesperson Ernesto Abella said in a statement.

“One can only conclude that certain personalities and politicians have mounted a well-funded campaign utilizing hack writers and their ilk in their bid to oust President Duterte,” Abella said.

The Palace official noted how in a span of one week,

He said the news feature “Becoming Duterte: The Making of a Philippine Strongman” narrated the rise to power of Duterte under the context of violence.

DAVAO CITY -- All hospitals in Compostela Valley that are accredited by the Philippine Health Insurance Corporation (PHIC) or PHILHEALTH are equipped with the Institution Health Care Provider (IHCP) Portal.

Rise of minors exposed to online sexual exploitation alarms anti-trafficking groups DAVAO CITY - The increasing number of minors exposed to online sexual exploitation has alarmed a non-government organization and the Inter-Agency Council Against Trafficking (IACAT).

Talikala , a social development organization in Davao City helping improve the quality of life of women who are victims and survivors of sex trafficking and prostitution, already recorded 82 minors, aged 10 to 17, from January to March in online sexual exploitation.

Jeneatte Ampog, Talikala executive director, said on Monday these minors are from seven barangays namely Leon Garcia, Lapu-Lapu, 76-A, 5-A, Matina Aplaya and Mintal.

The minors use the “Piso Net,” an internet scheme that is very accessible in the barangays , or through the Smart phones, where they are being asked to strip off their clothes. In other times, Ampog said the minors are offered by pimps.

They are either paid in cash or with high-end gadgets like iPhones and laptops by their clients who are mostly Americans, Indians, Nicaraguans and Chinese.

At one time, Ampog said one of the minors earned as much as PHP60 , 000, sent through money transfer.

They are just the tip of the iceberg, Ampog said in an interview. She said they have been conducting consultations because the situation involving the minors is alarming.

Ampog said they already voiced this concern to government partners and barangay officials, with Talikala urging the strict regulation of the “Piso Nets” by installing firewalls, since porn sites would just popup in the monitors.

Ampog said it would be difficult to protect minors who are using smart phones from online sexual exploitation.

Aside from online sexual exploitation, Talikala also

expressed concern over the increasing number of minors brought to Manila for jobs in restaurants and bars. In the past, minors being trafficked were brought only to nearby provinces in Mindanao.

She said this is worrisome because most of those trafficked are already exposed to their advocacy on sexual exploitation and trafficking, yet they are still being enticed by things or money like high-end gadgets, “hair rebonding” and plane tickets.

Deputy regional prosecutor Barbara Mae Flores, an IACAT member, said there is really a need to raise further awareness on trafficking and the active involvement of the Department of Education in instilling values among the youth.

Flores also noted the gains of the anti-trafficking campaign in the country.

For the first time, she said that the Philippines was placed in Tier 1, the highest rank in the 2016 US Trafficking in Persons (TIP) report. Tier 1 indicates that the government has acknowledged the existence of human trafficking, made efforts to address the problem and complies with the Victim’s Protection Act. Flores reported that in 2016, the country filed 3,065 cases of violation of the Anti-Trafficking in Persons Act. Since 2005, the country recorded 273 convictions involving 303 persons. She said that 10,121 victims have been rescued and 3,040 offenders were apprehended since 2012.

In Davao region, Flores said there were 95 cases filed in court. Of the number, 14 resulted to conviction, 14 were dismissed, four were withdrawn, 12 were archived, six resulted to acquittal and 45 cases are still being heard.

Flores reported that these cases involved a Kiwi, three Koreans (at large), three Americans (detained) and one British (at large).

Davao gender unit backs Pres. Duterte’s stand vs same sex marriage DAVAO CITY -- A unit pushing for gender equality and promotion in the city is rallying behind President Rodrigo Duterte’s stand on same sex marriage.

“The Philippine Constitution does not allow same sex marriage,” Lorna Mandin, Integrated Gender and Development Division (IGDD) chief, said Tuesday.

“Our legal system supports heterosexual marriages,” she added.

Mandin said part of the gender mainstreaming advo-

cacy of IGDD is the inclusion of respect for gender and the rights of lesbians, gays, bisexuals and transgender (LGBT).

She said many LGBTs in the city do not really want gay marriages, although they want more respect for same-sex relationships.

“I think that it is a nonissue,” she said. However, she admitted there are LGBT groups in Congress espousing same sex marriages.

It can be recalled that Duterte stressed that mar-

riage in the Philippines should be between a man and a woman only. This is clearly stated in the Philippine Constitution and should be followed, he added.

He criticized the West for pushing its liberated mind-set to Filipinos who are conservative. Duterte said he had nothing against homosexuals and while he respects the culture of the West, it should not be imposed on Filipinos who are predominantly Catholics.

Mandin said the Presi-

dent’s stand against same-sex marriages does not mean Duterte is already anti-gay.

“He was actually the one who pushed for the approval of the city’s antidiscrimination ordinance,” she said. What he was saying is that for now, same-sex marriage is not possible in the Philippines because of our laws.

Chief Peace Negotiator Labor Secretary Silvestre Bello III on Tuesday asked combatants to “observe restraint” to avoid further bloodshed.

“We are really saddened by these unfortunate incidents. We have communicated with our counterparts and they vowed to look into it,” Bello said after learning that another firefight occurred in Misamis Occidental last March 18.

“We remain firm and confident that we can still proceed according to the agreement we just signed in Utrecht to swiftly reinstate our respective unilateral ceasefires while we work on the terms of an interim bilateral ceasefire agreement,” he pointed out.

It has come to his attention that the Western Mindanao Command is now conducting pursuit operations against New People’s

Army (NPA) rebels after the communist camp was overran in Tudela town.

The rebel lair was seized following encounters with 55th Infantry Battalion troops and members of the NPA’s Western Mindanao Regional Party Committee.

No soldier was killed nor hurt in the fighting.

Between April 2 to 6, 2017, a new round of peace talks between the Philippine Government and NDFP is

scheduled for a new round in The Netherlands.

Erik Førner, the Norwegian Ambassador to the Philippines said in a statement that he is pleased that representatives of the Philippine Government and the NDFP will meet for a new round of talks. This will be the fourth round of talks since formal negotiations were resumed summer 2016.

“Despite challenges along

the way, the parties continue to show their commitment to peace. Norway will continue to assist the parties as the third party facilitator of the peace process,” he said.

This round will focus on issues such as social and economic reforms and a bilateral ceasefire agreement.

The talks will be chaired by the Norwegian Special Envoy to the peace process, Ms. Elisabeth Slåttum, with

Cebu Pacific Air inks maintenance pact with Air France KLM MRO arm Manila, Philippines, 28 March 2017 -- The Philippines’ leading carrier, Cebu Pacific Air (PSE: CEB) taps Air France Industries KLM Engineering & Maintenance (AFI KLM E&M) to provide component support for its Airbus A320 fleet.

The selection of AFI KLM E&M came following a call for tenders by CEB in September 2016 for the carrier’s expanding fleet of Airbus passenger jets.

The long term contract covers a fleet of over 40 Airbus A320s, and encompasses

full component support and solutions, including repairs and local pool access to maximize aircraft availability, for both its A320s and its future A321neos.

CEB currently has a fleet of 59 aircraft, comprised of four Airbus A319, 36 Airbus A320ceo, seven Airbus A330, eight ATR 72-500, and four ATR 72-600 aircraft.

“This is our first agreement with Cebu Pacific and also our first component support contract in the strategic Philippines market,” said Gery Mortreux,

Between 2017 and 2021, CEB expects delivery of 45 brand-new aircraft as part of its fleet renewal program.

That the monthly rental shall be Php ________ Philippine Currency, to paid by the lessee at the office of the MEEDO on or before the 20th day of the month, in addition to dily cash tickets imposed under Municipal Ordinance No. 11.s-1997. A surcharge of twenty- five percent (25%)shall be paid for delayed payment . However, failure to pay monthly space rental for (3) three consecutive months shall be a sufficient ground for the revocation of this contract of lease. It is expressly agreed and understood that the payment of the rental stipulated herein shall be made without the necessity of express demand and without delay on any ground whatsoever, monthly space rental increase to be determined by the Sangguniang Bayan duly approved by the Municipal Mayor after a public hearing for said purpose. b.

After this lessee has terminated for any reason whatsoever and if the lessee continues the occupation of the premises with consent of the lessor said extension of lease shall be understood as running from month to month only under the term and condition herein stipulated and may be terminated by either party by means of written notice served upon the other party at least Thirty (30) days in advance prior to the date of such termination; g.

The leased premises shall be maintained in good condition and it is expressly understood that the lessor shall not under any circumstances be liable responsible for any breakdown, failure or non- performance of same parts or portion of the building whether due to calamity or any other cause or reason whatsoever; h.

The lessee expressly acknowledges that the leased premises are in good and tenantable condition and agrees to keep the same in such good and tenantable condition. Any provision of law, present or future, or any stipulation in this agreement to the contrary notwithstanding. The lessee hereby agrees and binds himself to undertake at his own expense all repairs necessary or otherwise such as may be required to maintain the same in good state of order. It is expressly agreed and understood, however, that the lessee shall not start or proceed with any repair work nor in any case introduce improvements or alterations in the leased premises without the written consent and approval of the lessor and the parties agree that all improvement or alterations of whatsoever nature as may be made thereon shall upon completion form integral parts of the leased premises and shall not be removed there form but shall belong to and become the exclusive property of the lessor without any right on the part of the lessee to the reimbursement of the cost or value thereof; i.

The lessee shall pay for and defray at his own expense, the consumption of water bill, electric light, telephone or other utility services in the leased premises all repairs in the utility service shall be made by the lessor but for the exclusive account of the lessee; j.

The lessee shall comply with any and all laws, ordinances, regulation or orders of the local government or any national agencies arising from or regarding the use, occupation and sanitation of the leased premises. Failure to comply with the said laws, ordinance, regulation or orders shall be at the exclusive risk and expense of the lessee; k.

The lessee shall not bring into or store in the leased premise any inflammable or explosive goods or materials nor any article which may expose the leased premise to fire or increase fire hazard; l.

The lessee shall comply with all sanitary rules and safety conditions which may be promulgated from time to time by the lessor or shall keep and maintain the leased premise in clean and sanitary condition and dispose all rubbish only through the means and places indicated by the lessor for the purpose. m.

The lessee shall not use leased premise for dwelling or sleeping purposes; n.

The lessee hereby expressly recognizes the right of the lessor to sell the leased premises, and in the event of sale, this contract of lease shall be deemed ipso facto cancelled and the right of said lessee to occupy the premises considered automatically terminated; o.

If said premises is not surrendered at the end of the term, the lessee shall suffer by reason thereof and will indemnify the lessor against all claims made by and between any succeeding tenant against the lessor resulting from delay by the lessor in delivering possession of the premises to such succeeding tenant in so far as much delay is occasioned by failure of the lessee to surrender the premises; That the lessor reserves the right to prescribe or limit the weight of any heavy , safe equipment or other heavy articles which may be placed in the leased premises and to designate the position or location for such heavy objects within the premises for reason of safety and security.

That the lessor shall not be liable for the presence of bugs, vermin ants or insects, if any in the leased premises. The lessor shall not be liable for the failure of water supply and/ or electric supply.

That the lessee at the expiration of the term of the lease or the cancellation of this lease as herein provided, will promptly deliver the said premises to the lessor in as good and tenantable condition in all respect as the same now are, reasonable wear and tear excepted, devoid, of all occupants, furniture, articles and effects of any kind, provided, however , that non- compliance of the part of the lessee with the terms of this clause will give the lessor shall have complied with the terms thereof. The same penalty shall be likewise be imposed in case the lessee refuse to leave the leased premises after his right of lease has expired or terminated for any reason whatsoever; This lease agreement supersedes and renders void any all agreement and undertakings, oral or written, previously entered between the parties covering the property herein leased and this agreement may not hereafter be modified or altered except by instrument in writing duly signed by parties thereto; Upon signing of this agreement, the lessee shall pay by way of deposit unto the lessor, the sum of ________________________________ (P ______________) to be applied in payment of rental, in arrears and other expenses or charges that the lessee may owe in favor of the lessor.

Section 71. Compromise Power. Before a case is filed in Court for an offense which does not involve fraud, the Municipal Economic Enterprises and Development Manager is hereby authorized to settle such an offense upon payment of a compromise penalty of not less than Two Hundred Pesos (P200.00) nor more than One Thousand Pesos (P1,000.00).

ARTICLE XIII Penal Clause

Section 129. Penalty for Prohibited Acts. - Any person violating the provisions of this Code shall be penalized under the following schedule

1st offense 1,000.00

Section 130. Cancellation of lease and Ejectment. - Any violation of this Code shall be sufficient ground for the revocation or cancellation of a stallholder/vendor’s lease of contract or the right to occupy a stall, room, booth or space in the economic enterprises, except the Laguindingan public Cemetery and Laguindingan Slaughterhouse. Any such stallholder or vendor whose lease right or right occupancy has been cancelled or revoked, or who has been ejected from the stall, room, booth or space he is leasing or occupying, cannot anymore occupy any stall, room, in the economic enterprises of the municipality in the future.

Section 131. Selling Confiscated Goods. - Any law enforcement officer or Economic Enterprises Security Guard who confiscates goods from any vendor, ambulant or otherwise, and sells or offers those goods for sale by himself through a third person, shall upon conviction of the court, be fined of not less than One Thousand (Php 1,000.00) pesos but not more than Two Thousand Five Hundred (P2,500.00).

In cases, person guilty or selling or offering to sell confiscated goods shall indemnify the owner of the goods or a fine equal to the total value of the goods confiscated and sold or offered to be sold. The failure of any law enforcement officer or economic enterprise security guard who confiscated goods from any vendor, ambulant or otherwise, to render accounting of confiscated good, shall be a prima facie evidence against him.

Section 132. Weights and Measures. - Any stallholder found violating the provisions of existing laws regarding weights and measurers shall, for the first offense, be fined five hundred pesos (P500.00) only and required to correct any deficiency in said weights or measures, for the second offense, be fined one thousand pesos (P1,000.00); and for the third offense, shall be revocation of lease contract and ejectment from the stall, room, booth/space one occupied.

Section 133. – In addition to all administrative fines imposed on this code, an imprisonment of one (1) day to (30) days shall be imposed upon the discretion of the court.

Failure to pay said violations within 72 hours will be a ground for filling an appropriate case in a court of competent jurisdiction.
