Guialani decries arrest: ‘political harrassment’ Volume VI, No. 037

CAGAYAN de Oro City-William Guialani, the principal complainant in the anti-graft and disqualification charges against Mayor Oscar Moreno, decried his arrest Wednesday night as “political harassment.”

Guialani , the former village chief of Taglimao, was arrested Wednesday night on arrival from Manila at the Laguindingan Airport in Misamis Oriental on a warrant involving “acts of lasciviousness.”

From Laguindingan, Guialani was whisked to the police detention center in Cagayan De Oro City Police Office where he posted a Php 200,000 bail for his temporary liberty Thursday noon.

MISAMIS Oriental––Five persons were killed and one in critical condition in a road mishap Wednesday in Medina town, 111 kilometers east of Cagayan de Oro City.

Shell to inaugurate fuel import facility

CAGAYAN de Oro City-The P6-billion fuel import facility of the Pilipinas Shell Petroleum Corporation in Corrales Extension this city will finally be inaugurated on July 19.

Constructed since 2013, the facility is expected to accommodate petroleum imports consisting of motor gasoline, diesel and jet fuel with a total capacity of 170,000 cubic meters storage at any given time.

ity (NMIF), the project is also aligned with the policy thrust of the Department of Energy (DOE) to promote investment in the energy sector. These are (1) to promote development and upgrade of the downstream infrastructure, and (2) to update the Oil Supply Contingency Plan through the establishment of oil stockpile.

President Rodrigo R. Duterte is pushing for a Constitutional Convention (ConCon) as a mode of changing some provisions of the Constitution which is among the priorities of the administration, said Presidential Spokesperson Ernesto Abella who presided over the first press briefing in Malacanang on Monday.

“As far as we know, Presi-

dent Duterte favors ConCon,” said Abella, pointing out that “it’s more consultative and with more representation.”

He explained that ChaCha (charter change) is among the priorities of the President, pointing out that federalism as the form of government is strongly being pushed. “I don’t know exactly how high a priority it is, but it’s part of the

considerations that we do have several issues on hand.”

Abella added that freedom of information (FOI) is also a priority of the present administration which it intends to communicate to Congress for legislation even as an Executive Order (EO) is being prepared in line with the government’s policy of transparency.

DAVAO City––A total of 287 illegal drugs suspects surrendered to police authorities, 39 were arrested, and five were killed in the

city from July 1 to 5.

Outgoing Davao City Police Office (DCPO) spokesperson Milgrace Driz told reporters Wednesday that most of those who surrendered came mostly in Bunawan, Toril, Buhangin,

DPWH tells contractors to mind roadwork safety Friday, July 8, 2016

GENERAL Santos City--The Department of Public Works and Highways (DPWH) in Region 12 has adopted a “three-strike policy” for private construction firms working on government road projects that are violating standard roadwork safety measures.

Engr. Reynaldo Tamayo Sr., DPWH Region 12 director, said Thursday the move is mainly in response to the rising cases of accidents in the region involving road construction projects being implemented by the agency.

He did not cite specific figures but said their assessment showed that a number of road accidents were caused by worn-out signages usually made of tarpaulin as well as erroneous detour and informative signages.

In most cases, he said assigned contractors had failed to install proper signages and safety barricades to warn and inform the public about the ongoing projects.

He said several department orders had been issued in the past to address the problem but some contractors still failed to comply them.

“This (three-strike policy) is to ensure safety in the project sites and prevent accidents involving motorists,” Tamayo said.

The official said he has mobilized the agency’s project engineers and inspectors to lead the monitoring of ongoing construction projects, especially those involving road works.

He said the monitoring focuses the compliance of contractors to safety standards and the agency’s quality policy.

It includes the adherence to the standardized system of signs, lightings and traffic management, he said.

“Visible and adequate signages and traffic control devices must be installed, and traffic controllers must be assigned to both ends of the ongoing projects,” he said.

Tamayo said materials and construction wastes along road sections should be stockpiled properly during construction and maintenance activities to ensure the safety of motorist and pedestrians.

“We will strictly impose sanctions to all erring contractors for these lapses,” he said.

Village chief refuses to conduct ‘Tokhang’

CAGAYAN de Oro City–– At night, Barangay 23 here comes to life with motorcycles going in and out its streets and alleyways in a never ending frenzy to get stash of illegal drugs.

The Barangay 23 AntiDrug Council listed at least 15 names of shabu dealers plying their trade openly in their village.

“They (shabu dealers) conduct their business openly in full view of other residents. That is how brazen they have became,” Frias told MindaNews.

During a drug bust operations, the Philippine Drug Enforcement Agency supported by Barangay 23 officials seized P1.5 million worth of shabu last Dec. 3, 2015.

So it came as no surprise that the Cagayan de Oro City Police Office asked Barangay 23 officials of the list of suspected drug dealers last week.

Frias, a former journalist who still writes occasional sports stories for

news publications, said he and their barangay council complied but told police officials they should not use the list to stage “Oplan Tokhang” (toktok hangyo) in their village.

“I am very firm on this.

No tokhang in our barangay.

It is a clear human rights violation,” Frias said.

Frias said inviting or identifying the suspects without evidence or criminal case filed before the courts is a gross violation of their rights.

Furthermore, Frias said the children of these alleged suspects will be traumatized learning that their parents are under suspicion for selling illegal drugs.

“What if all our information are not true? The damage will be irreparable.

The children will bear the brunt of shame,” he said.

Frias said he asked the police to file the appropriate criminal charges against the suspects rather than subject them to a shame campaign.

The official said the “three- strike policy” will cover all contractors, including those on partnership or joint venture agreements.

For the first and second violations or strikes, he said first and second warnings will be issued to the viola-

tors.

For the third violation, contractors will be subjected to administrative sanctions, including a suspension of one year from participating in any procurement process of the agency.

Tamayo said contractors

will get a two-year suspension for the succeeding set of violations.

In the case of their project engineers and inspectors, he said they will impose administrative sanctions if they would fail to submit complete and verifiable

“three-strike” reports.

He said the concerned personnel will be reprimanded for the first set of “three-strikes” or violations; suspension of up to 30 days for the second set; and dismissal from service for the third set.

PRESIDENT Digong Duterte who accused five generals of links to the business of illegal drugs has admitted he has no solid evidence against them.

How can this be? As a lawyer, he should have known fully well that maliciously humiliating and putting to public shame anyone is a crime as well as bad lifestyle and conduct. He must have leaned so much on his presidential immunity to suits, but how about the tears of the generals and their families? Who gave him the false information and for what reason? I cannot figure out the pain inflicted to the generals. Three of the five generals saw Bato and all of them were emotional on the matter.

They denied the charges.

I have been saying during the campaign that Duterte is one guy who talks too much. Certainly, there is nothing wrong in opening one’s mouth excessively as long as there is a basis in the pronouncements.

000 Tension between America and China is getting hotter on the issue of the Scarborough Shoal. The international tribunal in the Hague will render its decision anytime this week on the petition of the Philippines relative to ownership of the disputed seas and it is believed the judgment will be in favor of our country.

China, however, said it will not accept any unfavorable decision and will go on with its claim of the shoal. When American warned China

about the issue, the latter declared they are not afraid of trouble. Notwithstanding the hot atmosphere on the matter, I still hope peace and friendship between the two superpowers will prevail.

000 I wish to inform the people of Cagayan de Oro that Mayor Oscar Moreno who is facing cases has numerous remedies on the issue. There is the court of appeals and the Supreme court. Meantime, I wish those noisy supporters and politicians to close their mouth and wait to avoid disturbing the tranquility in the city. Let us give peace a chance.

000 Politics in the Philippines has bred dirty people, yet adored and cherished by everybody. The activity does not end even after the elections. Fighting in and outrage until supporters are killed. Protests, violence and others prevail year round.

This is just ugly and people around the world are laughing at us. It is a shame.

000 The disputed Philippine seas is being patrolled by several countries such as America, China, Indonesia, Vietnam and other claimants. The Scarborough is worth fighting for because of its huge deposits of oil and other expensive minerals reportedly worth billions of dollars.

000 Accusing former president Noy Aquino of some of his alleged failures like those

of the Mamansapano incident and others is definitely linked to political rivalry.

As far I am concerned, Aquino is one president who has done more good for the country than harm.

He has modernized our military by buying updated fighter jets and battleships and many more. He should be remembered by his honest leadership and set aside politics because it has no basis in truth and in fact.

000 I thought the Communists in the Philippines will stop fighting the government when Duterte sits as president. Lately, an NPA commander declared they will continue in their war against the government. I know why. Their objective is to take over the country and declare it a communist state and nothing else. They have disturbed the country for almost half a century (47 years) and still they cannot win the war. It is a foolish war.

000 Our country is now in the typhoon season, We should not be surprised if typhoons come and go in short intervals. Just be ready to evacuate to safe grounds when the need arises. Never trust the weather season because it has victimized so many people. Those who reside in river banks better go up to the hills and plant bananas rather than complain.

that he was serious about his threats. And to make his point crystal clear, he appointed his most trusted police officer, Gen. Ronald “Bato” dela Rosa, as the new Director General of the Philippine National Police (PNP).

Dela Rosa, on his first day on the job, warned the policemen involved in illegal drugs that “they have 48 hours to surrender to him.”

Indeed, Duterte couldn’t have chosen a better PNP Chief than Dela Rosa, who earned his moniker “Bato” – which means “Stone” – for what he is, a hardened cop who had served “The Punisher” well in fighting criminals. But calling him “Bato” would be kinder than what I’d call him – a pit bull… without a leash.

Duterte-and-dela-RosacrosshairsIt did not then come as a surprise when the drug lords put a P1-billion price on the heads of Digong (Duterte’s street moniker) and Bato. The bounty was offered by 20 imprisoned drug lords who’d pitch in P50 million each for their assassination.

But instead of cowering in fear from the jailed drug

lords’ threat to assassinate them, Digong and Bato went on the offensive. To put an end to the corrupt culture inside the New Bilibid Prison, where the drug lords are given VIP privileges, Duterte ordered the replacement of the correctional officers with commandos from the PNP’s elite Special Action Force (SAF).

Poverty and corruption Duterte’s unorthodox ways and style have earned him the respect of the people, who have been waiting for a “messiah” to deliver them from the clutches of poverty and the evils of corruption. But election after election, pretenders and charlatans promised to eradicate poverty and stop corruption, only to make the lives of the common tao worse than before. But they saw in Duterte someone who is like them and thinks like them. He talks, looks, and walks like them; therefore, he must be like them… nay, he is them! It is an alchemy that created a harmonious relationship between the people and him.

And, hopefully, that fusion would stand the test of time.

But Duterte doesn’t have too much time to deliver on his promises. He said he’d

000 Crimes are taking plce in the country every minute of day. This is terrible. I am extremely tired of hearing TV news stories about rapes, murders, homicide, kidnapping, robbery, etc. everyday. Ano ba yan, lol.

The irony is Duterte keeps on saying he will annihilate crimes in the country.

000 A congressman filed a bill that says “no work no pay” for members who are absent during office hours. I like this very much. Manny Pacquiao when he was a congressman attended only four sessions for the entire year and he got paid with allowances. The sad thing he just sat down and closed his mouth. And he was not ashamed despite criticisms from the media. Now he is senator.

Duterte’s unorthodoxy: The new orthodoxy

With no major political organization behind him and no big donors to fund his campaign, President Rodrigo “Rody” Duterte was propelled to power by people from all walks of life. He beat four other candidates, three of whom – Jejomar Binay, Mar Roxas, and Grace Poe — were funded by executives of some of the country’s top companies, including San Miguel Corporation, Araneta Group, and Aboitiz Group. Shunned by the major newspaper outlets – or was it an organized boycott? — Duterte waged an intensive grassroots campaign and used the social media to reach out to the ordinary people.

He hammered in a promise to fight – nay, kill – the criminals and drug lords, and stop corruption in government. He vowed to restore the death penalty by hanging. And for drug lords, he’d hang them twice – once to kill them and the second time to severe their heads.

And with his reputation as “The Punisher” during the two decades that he was mayor of Davao City, no criminal would ever doubt

stop crime and corruption in six months. While that might sound quixotic – and it is in all honesty – his determination to put an end poverty and corruption gives the people a flicker of hope.

However, it is a challenge that ordinary politicians would fail the moment they take the helm of leadership. Indeed, a few days ago, Sen. Ping Lacson said that corruption couldn’t be eradicated in six months, not in six year, and not in 60 years! In a way, he’s right, corruption has been with us in the last 70 years since the Philippines gained her independence.

But that’s putting it mildly.

The truth is: corruption has been ingrained in our culture since the Spanish era. That’s more than 400 years! So, how can it be eradicated in six months?

Impossible! But Duterte can at least start sending drug lords and corrupt politicians to the gallows. Only then do I know that corruption can be mitigated and could eventually be stopped.

Indeed, during the presidential campaign, he sent strong signals about his position vis-à-vis the territorial disputes in the West Philippine Sea (South China Sea). Early on, he wanted to initiate bilateral talks with China; thus, abandoning the multilateral negotiation that his predecessor, former president Benigno Aquino III, preferred. The Ambassador to the Philippines Zhao Jianhua took the cue and hopped into a plane to go visit Duterte in Davao City. And even Chinese President Xi Jinping wasted no time in conveying his congratulations when Duterte was being sworn into office.

Wind of change But following his swearing-in, Duterte’s tone changed. He said he’s going to wait until the PCA made its judgment on the arbitration case, which many believe would be favorable to the Philippines. However, China had repeated over and over again that she would not abide by the PCA’s ruling. If that would be the case, the international community might treat China as a “rogue” or “outlaw” state, which would have a highly negative impact on China’s economic and political standing with the rest of the world. The question is: What are Duterte’s options? With his penchant for doing the unexpected in

While Duterte was known to have links with communists and leftists during the early years of his mayorship of Davao City, he is a self-described “socialist.” It would alarm some people — especially those who are in the upper strata of Philippine society – who brand the socialists as “communists.” But there is a large chasm that separates the two; although, politically, they find them themselves rooting sometimes for the same causes that benefit the common tao – particularly the poor.

And being leftist or socialist sometimes puts someone in league with those who have anti-American sentiments, which begs the question: Would Duterte veer the country away from the United States and bring the country closer to communist China?

I have been wondering myself where he’d lead the country? Would he terminate the U.S.-Philippines Enhanced Defense Cooperation Agreement (EDCA), the Visiting Forces Agreement (VFA), the Logistics Support Agreement (LSA), and the Mutual Defense Treaty (MDT)? Guialani filed anti-graft charges against Moreno involving the illegal agreement with the Ajinomoto Phil. Inc., which lowered the total tax assessment due the city government to Php 300,000 instead of the actual tax due of Php 2.9 million.

The Ombudsman found Moreno and the city’s acting Treasurer Glenn Banez guilty of grave misconduct and abuse of authority from entering and consummating the tax agreement without the authority of the City Council.

dered Moreno and Banez dismissed from service and perpetual disqualification from holding public office, which decision was sustained last March 2016.

Based on the decision of the anti-graft court, Guialani filed a disqualification of Moreno’s Certificate of Candidacy (COC) with the Commissions on Elections (COMELEC) describing Moreno’s candidacy as “illegal, right from the very beginning.”

Moreno, who was reelected Mayor in the May 9, 2016 elections, said he would appeal the Ombudsman decision to the Court of Appeals (CA) and asked for the issuance of a temporary restraining order (TRO) to prevent the execution of the order.

Moreno said that he would defend hims elf against the charges “and is willing to stake his life” if only to find justice in behalf of the people who elected him to office..

Guialani assailed Moreno’s continued stay as City Mayor despite the Ombudsman’s order and threatened to file charges with “usurpation of authority” for refusing to vacate the mayoral post.

He expressed the suspicion that Moreno’s camp is behind his arrest because the hearing of the plunder case, which he also filed against Moreno is scheduled to be resolved any time soon.

DAVAO City––The hometown of President Rodrigo Duterte is reportedly facing threats from a global terrorist group, the Islamic State of Iraq and Syria (ISIS), according to his son, acting Mayor Paolo Duterte, but the Davao City Police Office maintained there is no ISIS-affiliated group in the region or Mindanao.

Newly-minted DCPO director Michael John Dubria told a press conference on Thursday that there are no reports from the intelligence community pertaining to the presence of any ISIS-recognized group here. “(You) remain calm but stay vigilant, there is no truth to the information that there is ISIS group, but it doesn’t mean that we do not have threats directed towards our city,” he said.

Acting Davao City Mayor Paolo Duterte on Thursday told reporters that the city is facing threats from ISIS, that he has ordered the police and military to beef up security and intensify intelligence gathering to avert possible attacks from the international terror group.

He said he already has some information about the whereabouts of the group but refused to give details.

“We are intensifying the gathering of information.

We cannot disclose details in the adjacent municipality of Tagoloan, Misamis Oriental.

The Davao City Information Office posted an “additional quote” from Duterte on its Facebook wall at 3:38 p.m., hours after the interview, that “whether the information is

real or not, whether there is an actual threat from ISIS or none, what is important is that the people are now informed. And because of that, all of us are vigilant now. The public and all concerned agencies have been alerted and are doing everything to avert the threat from ISIS. Kailangan nating magbantay. I repeat, we are still verifying this information.”

Dubria acknowledged t houg h t hat t here are “ISIS-like” armed groups and terrorist groups like the Bangsamoro Islamic Freedom Fighters (BIFF) operating in Mindanao who are trying to sow fear among the people in order to get the support of the ISIS. “Per intelligence exchange with our units and operatives, there is no ISIS group in PRO 11 area of responsibility… or in Mindanao. These groups like the BIFF are terrorist groups and they are trying to get the support of the ISIS, so we call them ISISinspired, but we don’t call them ISIS. I do not believe that we have ISIS-inspired groups in Region 11, it is possible in other places in Mindanao,” he said.

Dubria acknowledged that there are other threats the city is facing, not only against the President who prefers to spend a few days in the city before returning to his official residence in Malacañang at the National Capital Region, but also from lawless armed groups.

“Other regions are experiencing threats from lawless armed group. Davao Region is different because we not only experienced threats from lawless armed group but also from BIFF, ASG (Abu Sayyaf Group)… most especially now that the police have stepped up their campaign against illegal drugs, so it is also possible that drug lords and personalities involved in drugs and those whose businesses were affected in our intensified campaign against illegal drugs na they plan to retaliate.”
