4Ps membership’ sold for P100

THE Department of Social Welfare and Development (DSWD) is checking the activities on poor communities in other regions, following the reported money-making scheme of a group that claims to be with the Duterte administration on poor non-members and

members of the Pantawid Pamilyang Pilipino Program (4Ps).

Last Wednesday, the DSWD in Northern Mindanao (DSWD-10) has denounced a group using the name of President Rodrigo Duterte to collect money from residents in Camiguin province in exchange for DSWD’s “Pantawid Pamily-

ang Pilipino Program (4Ps) membership” rice and loan package.

In a statement, the DSWD-10 has clarified that it has nothing to do with the group whose members are allegedly asking for money from potential beneficiaries or regular members of DSWD’s Pantawid Pamilyang Pilipino Program (4Ps).

MOA for social pension program of Oro’s elderly under review CITY LEGISLATORS led by Vice Mayor Raineir Joaquin V. Uy, through the committee on senior citizens, is reviewing and evaluating the standard format of the Memorandum of Agreement (MOA) with the Department of Social Welfare and Development (DSWD) covering the social pension program for senior citizens.

The Power learned that the MOA is a requirement for the implementation of Social Pension through local government units using

the Cash Transfer Scheme wherein funds will be downloaded to LGUs. The MOA is in line with the grant of monthly pension to qualified indigent senior citizens in the amount of P500 as government assistance as stipulated under Republic Act 9994, otherwise known as the Expanded Senior Citizens Act of 2010.

This is in consonance with the 1987 Philippine Constitution and R.A. 7160, otherwise known as the Local Government Code,

among others.

Under the MOA, the DSWD shall review the quarterly updated list of eligible senior citizens submitted by the city, and coordinate and conduct quarterly meeting, among others.

For its part, the city shall facilitate the preparation and approval of payroll based on the Certificate of Eligibility issued by the DSWD field office and ensure the timely delivery of payment to the beneficiaries, among others. Kikang Uy

THE complaint regarding the presence of construction debris like rubbles and stones scattered along CM Recto Avenue was discussed during the meeting of the

City Council committee on public works chaired by Councilor Zaldy O. Ocon, last Friday, July 22, 2016.

The problem is reportedly caused by the on-

going construction of SM building located at Recto Avenue-Osmeña Streets, this city.

The committee invited the project engineer of SM,

DA set to implement RIPE program Cagayan de Oro City – In response to the agency’s bid of achieving rice self-sufficiency for the country, the Department of Agriculture (DA) is set to implement the Rice Productivity Enhancement (RIPE) program, starting next year.

Since he took helm of the aggie department, Agriculture Secretary Emmanuel F. Piñol, has coined the said Program. According to him, RIPE is seen to revisit the country’s water management and irrigation policies, and to lay down a comprehensive program to augment the farmers’ level of productiv-

ity thru the conduct of a nationwide soil analysis and effective soil rehabilitation, the provision of fertilizers, modern harvest and postharvest facilities, and the introduction of improved rice farming technologies and high-yielding varieties of rice.

During the recent press conference held in the city, Lealyn A. Ramos, regional director of DA-Regional Field Office 10 (RFO 10), shared to the media practitioners about the RIPE program, with emphasis on extending financial assistance to small-scale farm-

ers to defray for their farm input expenses, especially on seeds.

“Under DA chief Piñol, he underscored that the Philippines should not rely on importations for its rice requirements because our Asian neighbors are also affected by climate change and natural disasters,” Ramos relayed.

“Luke” is a White Bellied Sea Eagle at the Philippine Eagle Center

The Department of Justice (DOJ) granted the motion for reconsideration filed by the Philippine Deposit Insurance Corporation (PDIC) and directed the Prosecutor General to file charges against spouses Manu and Champa Gidwani, 86 other depositors of Legacy Banks, and the branch manager of Rizal Commercial Banking Corporation (RCBC) Bacolod Main branch, Andrew A. Jereza, for committing the complex crime of estafa through falsification of documents. In addition, the DOJ directed the filing of perjury charges under

Article 183 of the Revised Penal Code against the 86 depositors.

The DOJ further directed that the Gidwani spouses and the 86 depositors be charged for violating Section 4 (a) of the Anti-Money Laundering Act (AMLA).

The Prosecutor General was also directed to charge Jereza with violation of Section 4 (c) of the AMLA. Spouses Gidwani and the 86 other respondents filed with the PDIC deposit insurance claims with respect to various accounts maintained with the Legacy Banks. Per Resolution dated 03 June 2016, the DOJ

found sufficient evidence that through the respondents’ false pretenses and misrepresentations, PDIC was made to pay fraudulent deposit insurance claims amounting to PHP97.73 million. Since their separation, they had never been communicating or supporting either financially or emotionally to each other,neither minding each other affair’s; Petitioner’s seek judicial decree of divorce, thereby, severing their marriage bond on November 25, 2008, so that they will have free hand to do what a single man or woman could do without marital burdens. Reconciliation between them had already been diligently employed but all proved futile.

WHEREFORE, finding this petition to be sufficient in form and substance, set the initial hearing of this case on August 12, 2016 at 9:00 a.m at which time, date and place. Any interested party may appear and show why the petition should not be granted. This Application is filed in compliance with ERC RESOLUTION NO. 26, Series of 2009 (A Resolution Amending the Rules for Approval of Regulated Entities’ Capital Expenditure Projects)” adopted pursuant to the mandate of Section 43 of Republic Act No. 9136 otherwise known as the Electric Power Industry Reform Act of 2001 (EPIRA) and its implementing Rules and Regulations, which categorically provides that all capital expenditure projects (CAPEX) shall be submitted to and for the approval of the Commission prior to its implementation, in relation to ERC Resolution No. 20, Series of 2011 which sets the timelines for the filing of the instant application;

The aforecited amended rules was issued by the Honorable Commission to ensure that the projects are timely, appropriate, necessary and cost efficient; to ensure that the proposed capital projects are consistent with the Distribution Development Plan (DDP), the Philippine Grid Code (PGC), the Philippines Distribution Code (PDC), and other relevant government issuances; and to ensure that the procurement of equipment, materials and services are transparent, competitive and compliant with the applicable laws and regulations.

In accordance with the Amended CAPEX Rules, consistent with the Distribution Development Plan and the Philippine Distribution Code, Applicant shall acquire, construct and implement the following three (3) year capital expenditure projects for the years 2017-2019, with a total approximate cost of THREE HUNDRED FIFTY FIVE MILLION SIX HUNDRED THIRTY TWO THOUSAND EIGHT HUNDRED EIGHT PESOS AND SIXTY SIX CENTAVOS (Php 355,632,808.66).

JUSTIFICATION OF THE CAPITAL PROJECTS 6.

With the prevailing situation in the electric power industry vis-à-vis the consumers’ demand, Applicant deems it appropriate to embark on asset development and expansion in order to meet the growing demands; and

The procurement of the aforementioned project is of great necessity in the schedules herein provided, otherwise service decline is eminent, to the prejudice of the consumers.

If a Force Majeure or Fortuitous event, as the case may be, occurs, the Applicant shall seek the ERC’s confirmation of the implementation of the capital projects arising from such event.

APPLICATION FOR AUTHORITY TO SECURE LOAN WITH THE NATIONAL ELECTRIFICATION ADMINISTRATION (NEA) 14. That, Applicant reiterates and incorporate the foregoing allegations in support of its Application for Authority To Secure Loan with the National Electrification Administration (NEA for brevity) and further allege: 15. That the need of immediate implementation of the foregoing proposed Capital Expenditure Projects is imperative to ensure safety, quality of service and compliance with the power industry’s regulatory requirements; 16. That, unfortunately however, a setback in the implementation of the Projects is foreseen by Applicant due to insufficiency of funds. While Applicant has internally generated funds, same is insufficient and needs to be augmented by a loan through NEA’s lending program, designed to assist the electric cooperatives; hence, to apply for an authority to secure loan from the Commission is deemed prudent, necessary and consistent with Section 20 of Commonwealth Act No. 146, otherwise known as the Public Service Act, which for ready reference is hereunder quoted as follows:

“Sec. 20. Acts requiring the Approval of the Commission.Subject to established limitations and exceptions and saving provisions to the contrary, it shall be unlawful for any public service or owner, lessee or operator thereof, without approval and authorization of the Commission previously had-

(e) Hereafter x x x to issue any bonds or other evidence of indebtedness payable in more than one year from the issuance thereof x x x.”

COMPLIANCE WITH PRE-FILING REQUIREMENTS

17. In compliance with Section 2, Rule 6 of the ERC Rules of Practice and Procedure, copies of this Application together with all its annexes and accompanying documents had been furnished by Applicant the Legislative Body of the Municipality of San Francisco, where Applicant principally operates and the Legislative Body of the Province of Agusan del Sur. Likewise the Application was published in a newspaper of general circulation within the franchise area of the Applicant.

As proof of such compliances is the Affidavit of Service executed by ______________, an employee of the Applicant, and the first page of the Application bearing the stamp “RECEIVED”, herewith attached as Annex “E”, “F” and “G”, and the Affidavit of Publication executed by the Editor, and original copy of the issue showing the published application, copies of which are attached hereto as Annexes “H” and “I”, respectively; 19. In its Resolution, the DOJ ruled that the heavy influx of deposits to the Gidwani spouses’ account should have already prompted RCBC and Jereza to file a suspicious transaction report with the Anti-Money Laundering Council (AMLC). Jereza’s deliberate failure to do so is a violation of the AMLA and PDIC Bulletin No. 2010-14 enjoining all member-banks to strictly observe the provisions of the manual of regulations for banks on second-endorsed checks in relation to payments approved by PDIC for deposit insurance claims.

PDIC vigorously pursues legal action against erring parties that circumvent the deposit insurance scheme for their personal benefit.

The quest for justice against unscrupulous depositors is an important undertaking of PDIC to protect the Deposit Insurance Fund, PDIC’s funding source for payment of insured deposits.

Before this Court verified joint petition for the approval and registration of the Divorce filed by the petitioners and alleging among others.

That petitioners are husband and wife respectively in a marriage performed under Civil rites on February 19, 1997 at Don Carlos, Bukidnon , they converted to Islam faith, of which conversions to Islam were duly registered with this court, both of them can be served with summons and other legal processes relative to this case at the undersigned counsel at 109 Tiano Bros. St., Cagayan de Oro City respectively..

That said marriage did not last long due to lack of love and affection until the relationship manifested incompatibility and sustained misunderstanding between petitioners and reached the point of irreconcilability and they separated from each other for more than two (2) years already,they decided to separate live physically in bed and board thereby, executed Memorandum of Agreement in order to formalize their separation.

Since their separation, they had never been communicating or supporting either financially or emotionally to each other,neither minding each other affair’s; Petitioner’s seek judicial decree of divorce, thereby, severing their marriage bond on February 19, 1997, so that they will have free hand to do what a single man or woman could do without marital burdens. Reconciliation between them had already been diligently employed but all proved futile.

WHEREFORE, finding this petition to be sufficient in form and substance, set the initial hearing of this case on August 26, 2016 at 9:00 a.m at which time, date and place. Any interested party may appear and show why the petition should not be granted. Let copy of this Order be published in a news paper of General Circulation in the City of Iligan once a week for three (3) consecutive weeks at the expense of the petitioners.
