Federalism first; BBL if it fails

DAVAO City––Federalism first, Bangsamoro Basic Law (BBL) if it fails.

This is the preview of the Bangsamoro peace roadmap that President Rodrigo Duterte announced before hundreds of Moro religious and political leaders attending the Mindanao Hariraya Eid’l Fitr 2016 at the SMX Convention Center here on Friday night.

“But if the Filipino nation in a plebiscite would not want it (federal form of government) then I am ready to concede whatever is there in the BBL,” Duterte said, adding, “we will see to it that it will pass.”

Immediately after saying he will see to it that the BBL is passed if federalism is rejected in the plebiscite,

Duterte said, “in fairness to Nur (Misuari),” the founding chair of the MNLF and Duterte’s personal friend, “we might also configure his territory of the Tausug nation.”

“Then, we will have new boundaries and these boundaries do not really intend to separate our brother Moro from the Christian” but is intended only to “delineate territories” and “not keep us apart from being Mindanawons,” Duterte said, adding that most of the Christians in Mindanao “are supporting the federalism and the BBL.” ‘New boundaries’ The “new boundaries” Duterte is referring to is the new composition of what would replace the present-day Autonomous Region in Muslim Mindanao (ARMM). The Comprehensive Agreement on the Bangsamoro (CAB) between the government (GPH) and the MILF in March 2014 provides for the passage of the BBL that would pave the way for the creation of a new autonomous political entity called the Bangsamoro, to replace the ARMM which had earlier been criticized as a “failed experiment.”

Under the CAB, the ARMM is deemed abolished upon ratification of the BBL. Invoking the grace of Allah, Duterte, the seventh President since Ferdinand Marcos who will attempt within his six-year term to finally resolve the “Bangsamoro Question.”

“It will not come overnight. Certainly, it will not come next year. Probably, it will be something about two to three years from now. But I assure you that something will change before I end my term,” he vowed.

“Let us build a nation that will be founded on peace and understanding,” said the first Mindanawon head of state, who introduced himself during his campaign sorties as having a grandmother who is Maranao and grandchildren who are Tausugs.

Initiated by Kauswagan mayor Rommel Arnado, the arms-to-farms program was designed to promote peace in Mindanao and to empower the MILF and MNLF fighters to become food producers.

In the past years, Kauswagan has been one of the areas affected by armed conflict between government troops and the Moro

rebels.

In her speech, Robredo said she long wanted to visit the town when Arnado told her about Kauswagan’s transformation from being conflict-riddled to becoming Lanao’s sustainable agriculture model.

She said the purpose of her visit was to listen to the stories of the farmers, especially the rebel returnees.

“Their success should be an inspiration to others, (that what happened in Kauswagan) can be replicated elsewhere,” Robredo said.

Arnado said since the organic food production was initiated, the town’s poverty incidence went down from 70 percent to around 30 percent at present.

For Ismael Sarip, of the MILF Indirapatra Brigade, said he decided to avail of the town’s program and is reaping the harvest of his labor. At his two-hectare farm in Lininding, Lanao del Sur, Sarip planted rice, coffee and various fruits.

His three-month farm production training in Bukidnon has helped him double his rice harvest from 35 to 70 sacks due to farming techniques he had acquired.

“When I was rebel, I used to carry firearms. Now my weapons are my farm tools.

The arms-to-farms programs has really helped me and my family,” Sarip said.

President Duterte’s war on crime: A nuclear explosion of violence PRESIDENT DUTERTE’S war on crime has spawned a nuclear explosion of violence that is spiraling out of control and creating a nation without judges, without law, and without reason.

Do we really want to give the man with the gun the power to judge who are criminals and to kill them? To decide who is bad and who is good, who deserves to live and who deserves to die? We might as well disband our courts, dissolve the Department of Justice, and abolish Congress. For there really is no need for law when the barrel of the gun dispenses justice.

The bandwagon that the President has created is

a bandwagon of hate – a mob mentality that not only condones but encourages the taking of lives “because they deserve it.” Yes, drug pushers destroy lives. Yes, criminals behave like animals. But are those who kill them any better? And will the killing stop there?

Our people have seen what a mob can do in the hands of a tyrant who knows no law but his own. Lest we forget, the first person that Marcos executed was a drug pusher. But did he stop there? By the time he was ousted, he was responsible for killing thousands upon thousands of people whose only fault was their belief in justice, the rule of law, and human rights.

President Duterte, do not kill in my name. That is not your mandate, that is not what you were elected for.

Yes, go after the drug cartels and criminal syndicates, the corrupt, the criminals among us. But do it as an officer of the law you have sworn to uphold as a lawyer and a President.

AS I analyzed in my article, on the domain of communication, it is really very complex. The vocabularies spoken by public figure in politic domain indicate the real condition of the social, cultural, psychological, and even political problems.

They all emerge as a bulldozer, rolling down from the top to the bottom, becoming bigger and bigger. The new government in the Philippines needs huge supports from the new cabinets.

The setting is a country in shifting from the former leader to the new one with high degree of expectation. It is the expectation to solve the accumulated and immerged problems.

So, the words spoken by the number-one person— the elect president—shows

AT the rate killing is taking place in the country nowadays, I just cannot imagine how sad the Almighty God is. Mass media are filled with news reports about murder, homicide, shootout, war, rebellion--all kinds of criminal offenses that clearly violated one of the ten commandments of God, “thou shall not kill”. Our environment must have turned upside down and people just do not know what they are doing.

Honestly, I am terribly scared while watching newscasts from the Philippines about daily killings. This scenario never happened before since the time of Adam and I really felt the country is a war zone. It seems evil is on top of the situation and everybody cheers for such thing. Certainly, I find this stupid.

I agree to the program of annihilating criminality in the country, as a matter of fact, that is the thing that catapulted Duterte to power but not to the extent of executing suspects without due process of law.

Drug suspects have right to confront their accuser too and not killed for no reason at all. I am not defending these people, on the contrary I even hate them for indulging such illegal actuations but definitely killing them without trial is not part of our culture much less lifestyle.

What we are doing now is necessarily a repetition of history when people were uneducated and behaving like those wild animals in the jungle. Animals know no law and they are just guided by their instinct through their sense of smell

I just wondered by the time I was travelling in Davao city exactly in October 2014. I stayed in Davao and travelled a lot to some areas in its entire day and even night.

The style of getting away criminality encourages our youth and coming generation to kill because such thing is allowable and part of our culture. True enough, illegal drugs make our people commit the most heinous of crimes. And the funny thing about it is that, illegal drugs proliferate because there are millions of Filipinos who buy them, even if they are already dirt poor.

But then, Duterte must take into account the truth that the fight against illegal drugs could not be won on the basis merely of killing the small-time drug pushers, or of shaming, or even prosecuting, the generals

and their protectors. Yes, fear maybe installed in the hearts of criminals dealing with drugs for a while, but, sooner or later, they will find ways to push their wares once again!

With due respect, the real battle against drugs, or any other form of criminality for that matter, is in truly transforming the hearts and minds of our people.

We should take our people away from evil thoughts and desires, which are easy prey for drugs and crime

syndicates. We should teach them to love and fear God at all times, through His Word, whether it is called the Bible, or the Koran, or by any other name.

-oooFILIPINOS NO LONGER TRULY FEAR AND LOVE GOD: The truth is that, many of our countrymen have become capable of committing even the most dastardly offense---raping one year old babies and even octogenarian women, and killing fellow Filipinos for a measly amount, among others---because they no longer have the love and fear of God in their hearts.

Many may argue that there are more compelling reasons for this phenomenon of rising criminality among many of us, like poverty, graft and corruption among our officials that translate into minimized or eliminated opportunities for a better life, and immorality that seems to have become the rule rather

than the exception in our day-to-day lives.

And this could be true.

But then, we have to ask: why is there poverty? Why is there graft and corruption among our government and political leaders? Why is immorality now so prevalent among many nowadays?

The answer is, we no longer have fear and love of God in our hearts and minds.

-oooREAD AND OBEY, FOR TRUE CHANGE: How did Filipinos lose their fear and love of God? There are many reasons for this but, as far as I am concerned, the greatest reason is the fact that we no longer know who God is, and what He can truly do for, or to, all of

us. We no longer know that if we listen to, and obey, His commands, his blessings, guidance, and protection will come upon us.

We no longer know that if we no longer listen to, nor obey, His commands, God’s curses will overtake and devastate us, and transform all of us into criminals, whether of the more public kind like the drug pushers and the killers on the loose, or of the “closet” kind who plunder and steal, or engage in adultery, most often secretly.

How did it happen that we no longer know these things? Simply because we no longer read and study His Holy Book---the Bible for Christians, the Koran

for Muslims---in the way that this Holy Book should be read and studied, constraining us to either fail to obey or outrightly disobey what is written therein. We should read and obey, if we want true change to come!

Constantino, formerly of the Philippine National Police (PNP) Supervisory Office for Security and Investigation Agencies based in Camp Crame, received his new assignment as the regional director for Northern Mindanao in a turn-over ceremony held at the Camp Vicente Alagar in Barangay Lapasan here, Friday afternoon, July 8.

He replaced outgoing Chief Supt. Lyndel Desquitado, whose retirement took effect during Constantino’s assumption to office.

In his message, the new regional police chief said he will use the full force of the law in going after suspected criminals targeting specifically those involved in narcotics trade in Northern Mindanao.

He said the police will talk to the perpetrators not with words but with action as he asked them to yield to authorities voluntarily.

“If you refuse to surrender peacefully and insist on doing with your illicit activity, we will throw the book at you, we will hit you hard and hit you harder again and again until you are no longer able to do your illegal activity,” he said.

To police officers who are suspected of using or dealing in illegal drugs, he said they will be treated “just like any other ordinary criminal.”

Law enforcers and public servants who are identified as protectors of illegal drug traders, Constantino has urged them to stop coddling criminals and to come forward and confess what they know, “and who knows, the law will be more kind and considerate to you.”

As the new PNP-10 regional director, Constantino said: “Make no mistake, there will be no rest, there will be no letup in the total war against illegal drugs and other forms of organized crime in this region.”

Since he is not beholden to any individual or juridical entity, he said he can fully perform his mandated tasks and functions effectively.

Emano said that he has ordered the dismissal from service of the self-confessed “drug courier” as he ordered the investigation of the suspended jail guards.

A report reaching the provincial governor’s office said that the suspended jail guards reportedly tolerated when inmates were found in a “pot session” with a lady visitor.

“The jail guards reportedly saw the illegal drug activities right before their eyes, but did nothing to prevent it,” Emano said.

He said that he will not hesitate to dismiss jail guards found remiss of their duties and responsibilities.

Emano , who detests illegal drugs, has been in the forefront in the fight against illegal drugs since he was elected provincial governor in 2013.

BBL and Normalization The passage of the BBL is tied up with the normalization process, including the decommissioning of weapons and combatants of the Bangsamoro Islamic Armed Forces (BIAF), the MILF’s armed wing.

Then President Benigno Simeon Aquino III and the MILF’s Murad witnessed the ceremonial turnover of 55 high-powered and 20 crew-served weapons to the Independent Decommissioning Body (IDB) and the decommissioning of 145 BIAF members, in Sultan Kudarat, Maguindanao.

mated 10,000-strong armed force.

The CAB provides under the Annex on Normalization that 30% of the forces and weapons would be decommissioned when the BBL is ratified, 35% more in the third phase and the last 35% in the fourth phase.

In his inaugural address on June 30, Duterte said his administration is “committed to implement all signed peace agreements in step with constitutional and legal reforms.”

“I am elated by the expression of unity among our Moro brothers and leaders, and the response of everyone else to my call for peace,” he said.

He said he looks forward to the participation of other stakeholders, “particularly our indigenous peoples, to ensure inclusivity in the peace process.”

Bangsamoro, Federalism and ARMM Murad led a delegation of the MILF in a meeting with Duterte on June 17 in a Davao City hotel. He and Duterte had a one-on-one talk for around 20 minutes.

Asked what they talked about, Murad told MindaNews on June 25 that Duterte’s opening lines to him was “yung sinabi ko sa inyo, gagawin natin yan” (what I told you, we will do).

“Sabi niya ‘ang BBL ipapass natin yan… kasi gagawin natin yan na template para sa federalism’” (He said ‘we will pass the BBL… because we will make that the template for federalism), Murad said.

Murad said the draft BBL submitted to Congress in 2014 will be “improved” through a convergence of the 2014 CAB between the GPH and the MILF and the 1996 Final Peace Agreement (FPA) between the GPH and the MNLF before it is presented to the 17th Congress.

He expects the “convergence” to be done through the Bangsamoro Coordination Forum (BCF) that the 57-nation Organization of Islamic Cooperation (OIC) initiated in 2010 and which OIC Secretary General Iyad Ameen Madani strengthened during his visit in Davao City in April last year.

With Friday’s announcement, a major question that needs to be addressed is how the Duterte administration will address the interlocking concerns on the establishment of the Bangsamoro, the shift to federalism and the abolition of ARMM in relation to May 2019.

The ARMM, which the BBL sought to replace with the Bangsamoro, proceeded with its election on May 9, 2016 because the BBL was not passed.

The next scheduled ARMM election, if no BBL is passed, is on May 13, 2019, which is also the proposed date of plebiscite for the ratification of the new Constitution on federalism.
