The police identified the victims as Rolly Ello, Mark Lester Dacubor and Carlo Dacubor. A certain Eduardo Caculba, 28, was reportedly wounded in the attack. He was undergoing treatment in a hospital. NDF peace consultant arrested at military checkpoint DAVAO City--A consultant of the National Democratic Front (NDF) peace panel was arrested by authorities along with his liaison officer at the Task Force Davao checkpoint in Barangay Sirawan, Toril district at 9:21 a.m. Monday. The arrest came barely 15 hours after President Rodrigo Duterte declared in Cagayan de Oro City Sunday night that the NDF is a “terrorist group” and ordered the arrest of 21 NDF consultants who were temporarily released in August to participate in the peace negotiations. Lt.Col. Nestor Mondia, the detachment commander of Task Force Sirawan identified the consultant as Ariel Arbitrario alias Marlon, Secretary of Guerilla Front GF2, Southern Mindanao Regional Command ( SMRC) and Roderick Manuyac alias Caloy, liaison officer, of the SMRC. MMV to ban entry of arrogant, boastful homeowner’s nuisance, noisy vehicles By BONG FABE Contributing Editor

CAGAYAN de Oro City-Now that the court has finally spoken, officials of a posh subdivision in the upper part of this city vowed to implement its homeowners’ association’s board resolution banning entry to the village of the nuisance and noisy vehicles of a socalled “arrogant, boastful and disrespectful” resident. “We will do that as the court ruled that we have the right to enforce village rules,” said Morning Mist Village Homeowners Association (MMVHOA) Board Secretary Arthur P. Aranas in a message. On Monday, February 6, RTC Branch 38 Judge Emmanuel P. Pasal ruled in favor of the MMVHOA and denied Juan Miguel Araneta’s petition for a TRO and Writ of Preliminary Injunction that would have prevented the MMV Board from implementing its January 17 Board Resolution # 2017-0117 which “ban the entry of Mr. Juan Miguel Araneta’s vehicles…into MMV effective January 18, 2017 and until such time this public nuisance is corrected.” The resolution, signed

by all MMV Board officers led by lawyer Angel Lim, also ordered Araneta “to show cause within 15 days from receipt of this resolution why he should not be declared ‘persona non grata’ or ‘unwelcome person’.” On January 18, MMV Board president Lim also sent an order to the MMV security guards, headed by Dante Detablan, to strictly enforce the Resolution banning Araneta’s vehicles from the subdivision. But Araneta continues to disobey the subdivision’s rules and regulations. He also refuses to heed the Board Resolution. One CCTV footage from MMV clearly showed Araneta himself raising the wooden barrier at the village gate after the guard on duty refused him entry after handing him a copy of the resolution. Rules No. 5 & 6 of the HOA Basic Rules and Regulations, issued by the Pueblo de Oro Development Corporation, developer of the subdivision, which the MMVHOA adopted, respectively states that “No vehicle shall travel faster than 20kph inside the village” and “Noisy or smoky vehicles, off-road unlicensed vehicle may not enter the

village.” In ruling against the plaintiff, Judge Pasal pointed out that the defendants were “merely enforcing” the rules of the subdivision.” “A preliminary assessment of the evidence shows that among the Basic Rules and Regulations of the association is the prohibition against noisy vehicles. It therefore appears that defendants (MMVHOA) were merely enforcing the rules,” he said. “While plaintiff will suffer inconvenience, mere grave and irreparable injury to one party will not justify the use of the strong arm of equity, otherwise known as restraining orders and injunctions. The relative conveniences of the parties also come into play; in other words, the damage to the recipient of the injunctive order must also be considered,” said the judge, adding: “In this case, one man’s enjoyment of a noisy car is achieved at the expense of the rest of the community who member do not share his passion.” Pasal also junked Araneta’s argument that he was not given due process. “As to the claim of due process, it appears from the record

that plaintiff was indeed notified of the complaints against him and his vehicles and that there were attempts to meet him but plaintiff did not attend.” The MMV Board stated in its Resolution that they have “invited Mr. Araneta to a meeting to give him due process and to amicably resolve this concern, but Mr. Araneta refused to cooperate and even threw out the formal notice of the Board which was handed-over to him by BOD Art Aranas in former’s residence on January 15, 2017. Such conduct of throwing to BOD Aranas (former President of MMV) along with the words uttered such as “What’s your problem!”, “Get a lawyer!”, “get out of here!” by Mr. Araneta, the Board finds it as boastful, arrogant, blatant disrespect to authority, and contemptuous conduct not in accord with the spirit of harmony, peace, tranquility, and good neighbors the MMV long cherished.” “Juan Miguel Araneta was given his right to due process by giving him ample opportunity to be heard as he was twice duly notified/ invited of the schedule hearing which was on January 18, 2017 at 8PM at the MMV

He must have seen the Board and homeowners gathered in the multipurpose hall as it is open and can be readily seen from the road where he is passing. However, instead of coming to the said hearing/meeting, he merely passed around twice with his loud sports car and not even cared to come. Note that his house is just around 15 meters from the multipurpose hall.” On January 20, independent residents of MMV filed a petition before Land Transportation Office-X (LTO-10) in which they sought “legal sanction to be imposed” on Araneta for continually flouting the law. The petitioner alleged that “Mr. Araneta drove his car in a speed beyond the legal speed limit. Likewise, he altered its muffler by using a booster-muffler without proper authority from LTO, this created a loud sonic-boom-like sound that is so irritating and annoying even at a radius of 1 km. By its nature, it

is injurious to the health and comfort of the community as well to the safety of pedestrians. It alters the quality of life and peace of mind as disturb the peace and tranquility of Morning Mist community.” The 58 petitioners, led by former Sugbongcogon Mayor Jerome Lagbas, also said that “early in the morning and even late a night, he (Araneta) revolution his car with engine in full throttle that sounds like a jet plane. Every then and now, he passed the streets of MMV and Pueblo de Oro with supersonic boom sound that disturbs residents and students that are studying at home and even to the extent of disrupting classes at Xavier University Grade School. Even Mass the St. Joseph the Worker and at St. Francis Xavier Church were not spared. Our rest and sleeping time were greatly affected. Countless times, we have been unduly vexed by this irritating and annoying noise coming from his car. IF the basic role of the government is to be the night watchman, then we should sleep soundly. A reliable night watchman looks after the safety of the community while the populace sleeps. Earlier this week, President Duterte convened his team, physically and by speaker phone, to discuss what was clearly a very serious problem: the reliability of a police force contaminated by so many scalawags. The meeting dragged into the wee hours, appropriately covered by journalists holding vigil at the Palace. In characteristic fashion, the President made quick decisions and barked orders in staccato fashion. He ordered police operations against illegal drugs suspended while the Philippine National Police is being rehabilitated. He declared that the effort to crush the apparatus of illegal drugs in the country would con-

no cessation of the talks even if it seems difficult at the moment to realize a cessation of hostilities. We believe it is realistic at this juncture to note that until the roots of the armed conflict are resolved, the conditions for hostilities to flare are ever present. And this, we believe, is a matter that both negotiating panels can competently tackle as the talks progress. As it is, the agenda for comprehensive social and economic reforms is already being sidestepped and muddled by military issues. The signing of the SER and its dutiful implementation is our hope that peace that is lasting and just will be achieved.

drugs and the diminished crime rate that came as its byproduct, the kidnapping and murder of Jee brought serious damage to the PNP’s credibility. Our people want a “cleaner” PNP to handle the job. There is no timetable announced for cleaning up the PNP. Judging by Dela Rosa’s response, however, we can expect swift action on the part of the police leadership. It could take years to complete the rehabilitation of the PNP but that does mean the campaign against illegal drugs will be shelved. The nocturnal meeting earlier this week was prompted by the case of Korean national Jee Ickjoo. He was kidnapped and brutally murdered late last year although the facts of the case became clear only over the past few weeks. It turns out that the men behind this dastardly crime belonged to the PNP AntiIllegal Drugs Group. Over the past few days, more evidence surfaced linking policemen to kidnapping and extortion activities using the war on drugs as cover. During the Senate hearing on the subject, Sen. Panfilo Lacson exhibited a video of policemen planting evidence moments before a raiding party descended. Several other cases of extortion were brought to light by that brave anticrime activist Teresita Ang-See. Clearly, we have a problem with the PNP. The current predicament visiting the peace process also means that greater confidence building measures such as the release of political prisoners need to be worked out so that there can be focus on Social and Economic Reforms and Political and Constitutional Reforms, and discussions for a bilateral ceasefire can continue. The DENR Breather Lopez’ bold act offers a glimmer of hope for the Duterte administration that is fatally suffering from a hemorrhage of credibility. We can only hope that other similar saving graces will follow the DENR lead. However, as some quarters have warned, it might be too early to rejoice over the initial salvo. Like the PNP and all other regulatory and lawenforcing agencies of the government, the DENR is house to incorrigible scoundrels and scalawags whose corrupt practices have long history in compromising the resources and the environment to enrich themselves. How else would you explain

the arrogant and wanton disregard of environmental regulations in the operation of the mining firms without the participation of DENR officials at all levels, by sleeping purposively on their job? A no- nonsense and apparently incorrigible DENR secretary Lopez while exceedingly important is not however sufficient to move the DENR forward in fighting criminality against the environment and the people, unless and until the agency is rid of its corrupt personnel and practices. a humble and honest man, from Silliman University in the person of Dr. Angel Alcala in the hope of reforming the agency. We must also give priority to reforming rogue policemen and corrupt judges. The excessively slow adjudication of court cases is one big reason for the spread of criminality. Often it is the poor who suffer from this system. We also call upon elected politicians to serve the common good of the people and not their own interests. In 2014 I reported to DENR Reg.10 Director Ruth Tawantawan the cutting, apparently without permit, of some 80 30-yr old planted narra and others trees at MSU Naawan campus. Tawantawan assured me to investigate on the incident and prosecute the guilty. The investigation came out with the finding that some MSU Naawan representatives applied for cutting permits but were not issued for their failure to comply with the necessary requirements. The trees were cut, notwithstanding, violating existing laws, rules and regulations. Alerted by the investigation, top MSU Naawan officials met with Dir Tawantawan. Five months later after the cutting incident, DENR issued a cutting permit to MSU Naawan. How is that? We can only speculate on the reason or concession why a permit was still issued after the trees had already been

cut months earlier. Instead of prosecuting the violators, the director cleared them without qualms of their accountabilities. How are we to believe the DENR with an anomaly like the above? If decisions could change in small no earth-shaking case as the foregoing, we can just imagine cases involving millions of individual and corporate investment such as in mining. Lopez needs to purge the DENR of damaging vermin in its rank if it has to move forward in halting the rape of the environment. Moreover, mining is a highly politicized industry. A mining concession cannot be had without an investment in politics, without political connection or intervention. This operates from the national to local level of transactions. In our highly centralized mode of governance, the current DENR crusade can only succeed if the political will of the national leadership prevails over patronage or payback politics. President Duterte shows responsiveness to the concerns of our citizens by convening that late-night meeting and issuing the orders he did. The corrupt police officers will be weeded out and the most infected units of the PNP dissolved. The President gives them no quarter.
