717 projects for Region 10 completed THE Department of Public Works and Highways (DPWH) in Region 10 has completed a total of 717 infrastructure projects for 2015, bagging them the best performing DPWH regional office last year among the 17 DPWH regional offices nationwide.

T he s e c ompl e te d projects, according to DPWH Secretary Rogelio L. Singson, will further boost the potential of Northern Mindanao as an investment area.

DPWH Region 10 Director Evelyn T. Barroso said with the cooperation and participation of staff from the regional office and 13 district engineering offices (DEOs), they were able to accomplish 94.38% or 717 projects out of the 875 projects for 2015 worth P18.7 billion.

Barroso said that out of 717 completed infrastructure contracts, 39 are asset preservation of national roads; 41 road network development projects; 23 road upgrading projects; 68 bridges construction/ maintenance

Duterte thumbs-down amendment to CLUP

DAVAO City––Environmental groups in Davao City were all praises after City Mayor Rodrigo Duterte vetoed the amended Comprehensive Land Use Plan and Zoning Ordinance, which integrated the 10-percent green space to the

30-percent open space provision in all land developments.

But Mary Ann Fuertes, executive director of Interface Development Interventions (IDIS), said during the Kapehan sa Dabaw at SM City they have to face yet again another hurdle, that is, whether the City Council would override the veto on Tuesday.

Fuertes said members of the Green Davao Coalition held a vigil outside Quezon Park here at 5 a.m. on Monday in what they thought would be their last resort to urge Duterte to decide in favor of their call to veto the controversial amendment.

IDIS is co-convener of the coalition.

To their surprise, she said the environmental groups found out that the veto was already signed

by Duterte on Monday, the last of the10-day window for the local chief executive to veto the amendments, starting from the day the it was forwarded to the executive branch on February 12.

Tagum city officials, employees move to new City Hall DAVAO City -- City officials and employees of the Tagum City government are moving to the new City Hall building built at P1 billion in Barangay Apokon. The building will be inaugurated on March 7.

“It’s a dream come true!

It’s exciting, it’s fulfilling, it’s tagumpay (success)!,” enthused Mayor Allan Rellon when asked in an interview.

Rellon sees the full transfer on March 7, which is the 18th founding anniversary of the city. Rellon said that there would be no lavish and extravagant celebration on that day. They will serve native delicacies to an estimated 15,000-18,000 Tagumenyos who are expected to witness the grand opening of the new City Hall.

Rellon will also deliver his State of the City Address as one of the highlights of lined up activities.

“It’s really a date with an affair of the Tagumenyos, and since it’s election time

already, we are not inviting national politicians to grace the affair, although they can come in and of course, we will welcome them,” the mayor said. “It’s for the Tagumenyos and we don’t want to politicize,” he said.

The new City Hall sits on the sprawling eight-hectare land donated by Davao business magnate, the late Jesus V. Ayala.

The construction of the City Hall was started by Uy from a P200-million loan from the Development Bank of the Philippines secured in late 2007.

“Soon the next bank loans came in after that first P200 million, the P275 million, P162 million and that P231 million, for a total of P868 million, plus the around P100 million equity of the city government, it’s almost P1 billion,” said the acting city planning and development coordinator (CPDC) Sonny Manigo.

It may be recalled that

there were allegations of corruption hounding the construction of the new city hall. There were allegations of ghost deliveries of materials worth slightly more than P200 million for which the bulk of the loan was intended for.

Two of the four affected suppliers claimed that the materials were indeed delivered and already used. They sued Rellon and his city legal counsel Arman Seras, who is now in the private sector.

Two cases related to the new City Hall are pending with two Regional Trial Courts in Tagum City, but Rellon said he is awaiting for court decisions before he would file counter charges on alleged ghost deliveries.

Earlier, Rellon questioned the deliveries alleging that “there were POs (purchase orders) but there were no deliveries as certified by the city engineer’s and general services offices.” Three of the four affected suppliers

responded to the notices of the termination of contracts sent in December 2014. The four affected suppliers remained unpaid.

Manigo said that the new City Hall is 95 percent complete, and what remains to be completed in the main structure is the 5th floor, which is the viewing deck.

The planning officer has been working for 18 years in the old City Hall and as the head of the committee on city hall transfer, he said: “I’m having mixed emotions; I’m excited, for us who’ve been working here for a long time. It’s not in our wildest expectations before that one day we will transfer to a new office.”

Meanwhile, Rellon wants to convert the old City Hall as the “Tagum City Cultural Historical Center.”

“We will improve this old building with P10-20 million budget to make this as a heritage pride shining at the center of a developed city. This building started with the structure of the ‘40s and we need to preserve, and improve this with Muslim and indigenous motifs laid all over and a museum inside,” the mayor said.

As to the Sangguniang Panlungsod Building in Barangay Magugpo, Rellon said he has already requested to convert it to a barangay hall.

DTI-Misor focused on improving provincial competitiveness THE Department of Trade and Industry (DTI) in Misamis Oriental has given a top priority to the improvement of the province’s competitiveness for 2016.

At the sidelines of the media briefing for 2015 Accomplishments of Region 10 held last December at a hotel in Cagayan de Oro, Ma. Eliza A. Pabillore, DTI Misamis Oriental provincial director, also shared the major accomplishments of the province done through the assistance and intervention of DTI Misamis Oriental Provincial Office.

“Actually, the completeness of the data submitted by the cities and municipalities contributed a lot in the judging for the Most Competitive Province. Most municipalities and component cities in Misamis Oriental were able to submit the data substantiating its ranking as one of the most competitive provinces in the country,” PD Pabillore noted. “But of course the major contributory factors are the 3 categories in NCC which is government efficiency, infrastructure and economic dynamism.”

“We all know that exports and investments are mostly generated in the province of Misamis Oriental,” she explained. “We have an international container port, an airport of international standards, and we

also have several 1st class municipalities. Those are the major contributors why the province was adjudged one of the most competitive in the country.”

The Province of Misamis Oriental was ranked the 2nd Most Competitive Province in the 3rd edition of the Cities and Municipalities Competitiveness Index (CMCI) conducted by the National Competitiveness Council (NCC), next to Davao del Sur. The Cities and Municipalities Competitiveness Index (CMCI) is a program which encourages LGUs to gather and voluntarily submit data which are used to measure their performance on three pillars anchored on global standards: Economic Dynamism, Government Efficiency, and Infrastructure.

Each pillar has indicators which provide a more detailed view of the economic status of the locality. There are 8 indicators for Economic Dynamism and 10 indicators for both Government Efficiency and Infrastructure, totaling 28 indicators. The data submitted by the LGUs, through the assistance of a partner Academe and the Regional Competitiveness Committees, is used for the final scoring and ranking.

Lessons from Failed Argumentation

I wish the next debate would show me more of what the candidates are made of and what they actually stand for. Because in this debate, instead of leading Filipinos to the candidate they should vote for, it has only taught nothing but whom not to vote.

I MEANT to comment on the recent Pilipinas Debate 2016 hosted by Capitol University which occurred last February 21, 2016. However, it was a sorry excuse for a “debate” which one cannot blame on the presidential candidates but on the debate organizers themselves.

First of all, pitting one candidate against another and forcing them to respond for 30 seconds does not open doors for dialogue or serve the purpose of this event-a debate. One of the front runners, Mayor Duterte, when asked to rebut about Senator Santiago’s record said, “What is to argue?” and in another instance against Secretary Roxas, responded in almost a sarcastic tone, “I can’t rebut... there’s nothing to rebut because it’s all good.”

Which brings me to my second point, not only is the format of the debate already terrible, the questions were not even debatable. They were all concede-able. One round discussed poverty and development and another discussed Mindanao: points and facts raised in these rounds were not contestable. Everyone agrees that

I am left wanting.

Nevertheless, there are still things to draw from the event. Personally, it solidified my idea of the kind of candidate I DO NOT want to vote for: One, I will not vote for a corrupt official. We all agree on that. Hands down. A government who steals from the people they are supposed to be serving should not be placed in a position of power or responsibility.

Two, I definitely will not vote for a candidate whose arguments center on making others look bad in order for them to look good, or what the US military calls, a Blue Falcon. This type of candidate is unwilling to take responsibility, and will always point fingers. They will throw a comrade under the bus and would sooner risk another’s life and reputation of others than their own. A person who cannot admit their shortcomings

or take responsibility lacks character and I believe this type of person is not fit to bear the country’s burden.

Three, I most certainly will not vote for a candidate who rides on the successes of others instead of campaign on the merit of their own ideas and accomplishments.

A person who steals credit or rides on a legacy they did not build themselves is a parasite who will try to cover up any of their failures by hiding in someone’s bigger awe-inspiring shadow.

And lastly, my vote will not go to an idealist. This country has held on to false hopes and empty promises for too long. Realistically, it is the doer who gets things done. Senator Santiago, when economic development proposals were raised, asked repeatedly, where will the funds come from?

Without a proper plan on where to source the funds, these are all “promises in the sky.” Any educated Filipino can make a business plan, but very few have the courage and resolve to enforce a cohesive and sustainable implementation plan.

I wish the next debate would show me more of what the candidates are made of and what they actually stand for. Because in this debate, instead of leading Filipinos to the candidate they should vote for, it has only taught nothing but whom not to vote.

Everyone agrees that Mindanao needs to be given more attention. Everybody agrees on national issues which even fourth graders understand.

The only parts where there were any arguments and debate at all were when the candidates’ histories and track records were brought up (which was, by the way, its own round).

What the debate organizers’ purpose for adding this round into the whole debate is unclear--unless they had intended for it to be a platform for candidates to bash each other as a form of entertainment. In that case, they were successful.

But it provided little benefit for viewers and voters who need to be educated on these presidentiables’ primary advocacies.

Performance-wise, I would give the debate to Grace Poe who was very graceful and eloquent.

However, I am aware that a two-hour debate does not fully uncover a candidate’s substance--especially in such a poorly structured “debate” format. In the end,

All human beings in the world should be lifted up in terms of their dignity without considering any attributes the human beings have. can make more propaganda for building good image for their candidates. They can build their candidates’ personal brandings. It is evidently proved in some countries that such mass media can succeed to do image building: bad image for the opponents and good image for their candidates.

In that situation, there is hegemony in life that is against humanity in general and again personal privacy in more specifically. Humanity as the term for all human beings should be enhanced for increasing human dignity. All human beings in the world should be lifted up in terms of their dignity without considering any attributes the human beings have.

Privacy such as personal history or personal affairs

can also be blown up into public for political purposes. In that case, if we are asked whether we want to be politicians for running for president, the answer must be not, not at all. But, the story will be different.

When the candidates have big ambition to get the goal for the political career, any strategy can be done. And, that is the time for them to forget the values of humanity and the values of privacy.

The police action was based on a Search Warrant No. 2016-41 issued

by Judge Hector B. Salise, of the Regional Trial Court Branch 7, Bayugan City for violation of R.A. 10591 (Comprehensive Law on Firearms and Ammunition).

The joint police team seized during the search

of the premises of the suspect’s house were Colt Caliber .45 pistol loaded with three ammunition, Caliber .38 revolver loaded with 6 ammunition, a homemade 12 gauge shotgun with 1 ammunition, 28 fired cartridges of Caliber .45, two ammunition of 12 gauge shotgun and 30 ammunition for Caliber .45.

Two other suspects identified by the police as Rocky Lhem G. Baldelovar, 26, a resident of Brgy. Kapatun-

gan, Trento in Agusan del Sur, and Nonilo F. Puntecha, 46 of Purok 6, Brgy. Poblacion, Trento were also arrested when the authorities seized unlicensed Caliber .38 revolvers tucked in their waist.

BIR marks PHP56.7-M increase in tax collection; adopts new collection approach in Zambo del Sur PAGADIAN CITY, Zamboanga del Sur -– The Bureau of Internal Revenue (BIR) through Revenue District Office No. 92 has registered in 2015 a 10.89 percent increase in collection of taxes representing PHP56,777,761.

Myrna Maslamama, RDO-92 officer-in-charge,

told the Philippines News Agency on Monday they have collected a total of PHP857,419,612.74 in 2015 which is higher by PHP56,777,761.57 compared to the PHP800,641,851.17 collection in 2014.

Maslamama said they registered an increase in taxes collection in 2015

despite they failed to meet the PHP1,061,258,000 target collection representing a decline of 19.59 percent.

For this year, Maslamama said they were tasked to collect almost PHP1.3 billion, which is 44 percent higher than last year’s target collection goal.

However, she is confident

they will be able to meet this year’s target collection goal with the new approach they adopted under the leadership of Aminoding Macarampat, the new RDO92 chief.

December 3, 2015, a remarkable day for all the public school teachers. An ACT Party- List Consultative Assembly was held at Bukidnon National School of Home Industries, Maramag Bukidnon.

The speaker Raymond Duran Basilio, a Deputy Secretary General and National Campaign Officer, tackled some of the House Bills field by ACT Party- List Representative Antonio L. Tinio. He pointed out good news and accomplishments of ACT, the teachers’ voice in the congress.

One of the Accomplishments as stated in the official newsletter of ACT Teachers’ Party- List was the Increase in Salary 2016. Due to Tinio’s relentless campaign in congress highlighting the demand for decent salaries, government has to set aside P 50.664 billion salary increase for teachers. Other education personnel and all government employees’ increase will be implemented

starting January 2016.

Related increase were; higher chalk allowance, higher uniform clothing allowance, increased tax exemption of Bonuses like 13th month pay, PBB and other benefits. Voluntary election service for teachers was also included in the House Bill 5412 authored by Rep. Tinio, making election service non- compulsory for public school teachers. This historic bill has been approved on Third Reading in the house and is awaiting passage in the senate. Rep. Tinio also succeeded in enacting into law provisions mandating DEpEd to give priority to qualified contractual and volunteer teachers in the hiring of new teachers. Since then, thousands of volunteer teachers have been given permanent items nationwide.

Granvia Suites open for easy move-in JOHNDORF Ventures Corporation (JVC) has simplified the process for new homeowners at Granvia Suites to move in within just three months after they close their reservations, announced the company.

Moreover, a homeowner gets a rebate worth two months of one’s equity should one would already take out the purchased condominium unit with the release of one’s loan within six months from reservation.

All-weather road include municipal, provincial, national, and all other public roads traversable by trucks, cars, and other forms of motor vehicles under any kind of weather.

Section 5. MISCELLANEOUS PROVISIONS. 1. As a general rule, 100% base value per square meter for urban commercial, industrial and residential lands shall be applied to all lands within the first strip of 20 meters on commercial and industrial sections of zones, and within the 20 meters on residential sections or zones fronting asphalted or concretes streets or roads.

Section 6. SUPPLETORY DOCUMENT. The book prepared by the Office of the Provincial Assessor as indorsed by the Honorable Governor to the Sanggunian Panlalawigan of Camiguin, entitled: “SCHEDULE OF MARKET VALUES, 2014-2015, CAMIGUIN,” shall serve as a Suppletory Document to this Ordinance.

2. Lands beyond the standard depth of 20 meters for commercial and industrial lands, and 20 meters for residential lands, if any, shall be valued 80% for the 2nd strip, 60% for the third strip and 40% of the based value fixed for the street or roads fort the reaming area, Provide, however, that in the case the parcel of land abutting two streets or roads on two sides with the different base values stripping and valuations thereof shall be base on the principal street or road with the higher base value, but no lower than the schedule of value of the other street.

Section 7. REPEALING CLAUSE. Any provision of Ordinances which runs counter to the provisions of this Ordinance is deemed repealed or modified accordingly.

3. A reduction of 20%, shall be applied from the based value fixed for lands along gravel, earth or dirt, and proposed streets or roads, in similar manner, if the street or roads and/or sections thereof are subsequently improved or constructed, the appraisal and assessment of the same shall be adjusted accordingly.

4. For low and sunken areas of the land, a reduction from the base value per square meter may be allowed due to the cost of filling and compaction to bring the same at par with the adjoining developed lots, provided, however that such reduction will, in no case, exceed 30% of the base value thereof.

Section 8. EFFECTIVITY. This Ordinance shall take effect after compliance of Section 212 of the Local Government Code of 1991 on publication requirement.

5. Adjustment value of the frontage shall be added to the valuation of all commercial lots fronting streets or roads. The same is derived by multiplying the length of frontage in lineal meters by 50% of the unit base value thereof.

6. Corner influence value of 15% of the base value shall be added to the valuation of lots situated at the corner of the two street or roads. Provide, however, that if the streets or roads have different base value, the higher base value shall be used in the computation thereof.

7. Vacant or idle lands located in a purely residential area, shall be classified as residential. If such land is located in a purely commercial area, the same shall be classified as commercial. Mixed residential-commercial area the same shall be classified according to the class which is more predominant.

8. As far as property applicable, this schedule of base market values shall be controlling, but where the property to be assessed is of a kind not classified in this schedule or any for which a value is not herein fixed, it shall be appraised and assessed at its current and fair market value, independently of this schedule.

How do you solve a problem like El Nino?

According to experts, El Nino is a cyclical event that is caused by the warming of the eastern equatorial part of the Pacific Ocean. Its effect in the Philippines is dry (below normal rainfall), warm (slightly higher temperature than normal) and lesser number of tropical cyclones/typhoons resulting in drought or near drought conditions. Typically, El Nino happens at irregular intervals of 3–7 years and lasts nine months to two years. It is not a moving system like a typhoon.

El Nino is normally predicted a long time before it even makes any impact to a country. Its slow onset provides a longer lead time to prepare for possible negative impacts than any other weather condition, such as, a tropical cyclone.

As early as November 2014, PAGASA, our national meteorological agency has already released dry condition advisory and by March 2015, announced the onset of El Nino. It started as weak and eventually forecasted to be a strong El Nino by the latter part of 2015.

Reports of parched lands, burnt fields, crop losses, and food shortages, especially in Mindanao, have recently made headlines almost on a weekly basis. Stories of a farmer committing suicide and another farmer losing his sanity were attributed to many months of drought in the Southern Philippines, particularly in the Maguindanao province.

Maguindanao was predicted to be one of the hardest hit areas for this 2015-2016 El Nino event.

It comes at an opportune time and place, but the first ever Presidential debate on agriculture will happen on February 21 in Mindanao, the place where farmers are reeling from the impacts of El Nino. What are the plans

of the candidates to solve these problems by farmers now and in the future?

Where and what form of government support should take place? With a year to prepare, what has been done by the current government to proactively manage potential risks of El Nino? For the Presidential candidates, how do they envision the future of Filipino food and agriculture given the challenges posed by events such as El Nino?

Unfortunately, President Benigno Aquino III only approved the Php 19 billion budget for El Nino last December 11, 2015, and the funds are yet to be released.

2015: Significant Rainfall Reduction Sample climate data from PAGASA provincial stations in Bohol and Cotabato reveal an overall reduction of rainfall for the year compared to their normal rainfall over the last 30 years. Bohol is especially vulnerable, being an island

with highly limited irrigation services. Meanwhile, Cotabato is the nearest station to some of the areas where reported El Nino impacts are most severe.

El Nino, despite being a slow onset hazard, can be as disastrous as a typhoon. The most severe El Nino events affecting the Philippines were the 1982-1983, 1997-98 and 2009-2010 events. Total losses in terms of production value are in the billions of pesos. The 2009-2010 El Nino damage and losses to agriculture production reached Php 17.4 billion (US$ 365M) and affected 555,000 hectares of crops and livelihoods. The 19971998 El Nino event’s impacts were more widespread, affecting 677,441 hectares of crops and livelihoods.

A seasonal crop production loss can potentially reduce a poor farming family’s ability to survive for the next 4-5 months and beyond. It can further put them to indebtedness and tie

them down to dependency.

Thus it is essential to make farmers El Nino ready and resilient.

How do we make farmers El Nino ready?

El Nino develops slowly, so a climate-based warning on a daily, most importantly weekly and seasonal basis becomes highly important.

The daily and weekly farm management, informed by weather forecast, are important tools to effectively manage the slowly developing possible effects of El Nino.

Rice Watch and Action Network (R1) has been at the forefront of building climate resilient farms in different parts of the country (insert link to video). Aside from localizing climate information and making these available to farmers, R1 assists farming communities to establish community-based varietal seed trials, a municipal seed production and buffer stocking program and community based organic fertilizer production. This

will improve self-reliance in seeds and ensure availability of locally adapted farm production materials in times of need. Many farmers can attest that organically fertilized farms have proven to be more resilient during dry conditions as it helps improve water-holding capacities of soils.

On a more strategic direction, public investments ought be directed in setting up more rainwater harvesting systems. The country’s rainfall provides more than 600 billion tons[1] of rainfall per year but most just drain away and often causes devastating floods. Thus, it is important to collect and manage water both at community and household level to make it more useful especially in areas with very limited water endowment.

And this should happen way before the onset of El Nino.

Along with these practical ideas, farmers need to transform their values and attitude. Our farmers will

need to be more observant and nurturing. To manage the farm better, they will need to visit their farm more often, know the risks of their livelihoods to particular weather and be equipped with practical, sustainable and ecological risks management ideas to save or protect his livelihood. In the Philippines, the local governments should play a vital role in ensuring this, being the primary agency that should provide frontline agriculture services.

But now more than ever, we need a strong policy direction from the next President and Department of Agriculture Secretary for a climate resilient and ecological food and agriculture system.

This election season, our farmers ask our Presidential candidates: how do you solve a problem like El Nino?

RDC-X pushes key infra projects to consolidate regional competitiveness

“This road will cut travel time between the two destinations by at least one hour for private vehicles and two hours for public utility vehicles,” Balondo said. “But the benefits will redound to people even beyond these points like Davao, Misamis Occidental and Zamboanga regions for whom this project would result in tremendous saving in travel time and costs.”

Meantime, it was learned that the local government units of Misamis Oriental, Laguindingan and Alubijid had already submitted to RDC-10 their resolutions in support of the proposed Laguindingan port zone delineation.

Ayala Corporation has similarly expressed its support by indicating its willingness to donate the required land area for the seaport and access road. RDC10 secretariat has already commented on the draft deed of donation through the PMED staff and PPA PMO-Misamis Oriental/ CDO. DPWH-10 still has to conduct a parcellary survey of the approximately

491,745 square meters or 50 hectares needed for the project as requested by PPA PMO-Misamis Oriental/ CDO since the technical description is needed by Ayala Corp. to finalize its Deed of Donation.

DENR-10 is also slated to conduct an actual ground survey of the project area to ensure the proposed port would not adversely affect the ecosystems (corals and seagrass) within the area.

As an adjunct to the proposed Laguindingan port, DPWH-10 has already conducted a parcellary survey and identified affected improvements for the proposed port access road. Assessment of the affected improvements including houses and trees would be completed

by March 15, 2016 with the technical description to be forwarded to Ayala Corp. for the finalization of the Deed of Donation to DPWH-X. Not the least, the resolution asking NEDA Central Office for technical and funding support for the proposed Northern Mindanao Regional Transport Master Plan has been forwarded to the NEDA Infrastructure staff and is now being reviewed for possible Official Development Assistance (ODA) support.

TEACHER quality matters. In fact, it is the most important school-related factor influencing student achievement. That is why the quality of a teacher directly affects his or her effectiveness which can be translated to the grades of the students.

It is unarguable that the prestige of the institution a teacher has graduated has a positive effect on student achievement, particularly at the secondary level. This may partially be a reflection of the cognitive ability

of the teacher. Research also found out that teachers who have earned advanced degrees have a positive impact on science achievements when the degrees earned were in these subjects.

Quality teachers set high expectations for their students. They expect all of them in the classroom to achieve and they don’t give up on underachievers. This breed of teachers likewise have clear, written-out objectives.

Effective teachers have lesson plans that give students a clear idea of what they will be learning, what the assignments are and what the grading policy is.

Kalahi-CIDSS Caraga Reaps National Awards Manila -- The Department of Social Welfare and Development (DSWD) Caraga continues to banner the culture of excellence in the implementation of the Kapit-Bisig Laban sa Kahirapan – Comprehensive and Integrated Delivery of Social Services (Kalahi-CIDSS) as it bagged four (4) accolades during the Gawad Kalahi Awards 2015 held at Hotel H2O, Manila on February 9, 2016.

To get the Most Competitive Provinces, NCC introduced a new method to rank the qualified provinces for the index. For a province to qualify in the ranking, the combined population of all participating LGUs under the province should constitute at least 60% of the Total Provincial Population. A total of 68 out of 81 provinces qualified for provincial ranking.

For those provinces which qualified, the scoring was calculated as the population and income weighted average of the LGUs covered. Scores of the LGUs covered were aggregated. Scores were based on Overall Scores of participating Cities and Municipalities in the province and not the category scores.

Following this framework, the Province of Cebu got the third place, Province of Misamis Oriental got the second place, and the province of Davao Del Sur was awarded the most competitive province for 2015.

“We already have a reputation to protect and we should make sure that we will be submitting updated figures on investment, and all related data that is required in the CMCI survey,” PD Pabillore said.

This CMCI is conducted by the National Competitiveness Council, aligned with the goal to improve the country’s overall competitiveness, through collaborative efforts between the national and local government agencies, and the public and private sectors.

“We are one with the Commission on Elections in its objective to assure an orderly, peaceful and clean election in May. We have to address the fears regarding the allegation that there might be cheating in the elections,” Coloma told Malacañang media.

In 2010, Coloma said the government changed the election system from manual to automated to make sure that all the votes will be counted.

“The people are expecting that the system will be improve to eliminate the actual or alleged ways to cheat the election,” he said.

Coloma said there is also a need to strengthen the education campaign for the public particularly the voters to get inform and understand fully the automated voting system and to eventually wipe away doubts on the integrity of the system.

On the request by senatorial aspirant Richard Gordon to the Supreme Court to require Comelec to print ballot receipts, Coloma said the Comelec had previously explained that the printing of such receipts “present more disadvantages than advantages, in terms of possible vote-buying and actual

lengthening of voting hours.”

“As an independent constitutional body, the Comelec is tasked with ensuring the integrity and credibility of elections.

Now, it is up to the Supreme Court to act as final arbiter in disputes of this nature,” Coloma said.

Coloma, meanwhile, said the Philippine National Police (PNP) and the Armed Forces of the Philippines (AFP) continued to monitor the election hotspots following series of attacks by the New People’s Army (NPA) rebels on the government forces.

“The government will not be shaken by any threat that armed groups might sow,” he said.

Based on the Pulse Asia survey held two weeks before the election campaign started last Feb. 10, four of 10 Filipinos believed that cheating might possibly happen.

The survey also found out that 48 percent of Filipinos believe that the May 9 polls “will be clean and the results credible because the counting of votes is automated,” while 34 percent were undecided.

Last January 19, the City Council approved on third and final reading the amendment that was criticized by the Green Davao Coalition for failing to consult with the stakeholders and bypassing the Local Zoning Review Committee.

Vague, ambiguous, and ‘ultra veris’ Fuertes said they came to know that Duterte would veto the measure when an IDIS volunteer, Rey Anthony Sapid, asked the mayor after the presidential debate held at the Capitol University in Cagayan de Oro City on Sunday evening.

“There is a legal block there. It is beyond the power of the City Council to amend certain provisions of the national law. Yan ang ayaw ng City Legal Office, you will amend somehow provisions of the national law, which cannot be done because we are just local government,” he said in a voice clip forwarded to MindaNews by IDIS. In his three-page veto message released on Monday, the mayor said the amended version was “vague and ambiguous, prejudicial to public interest and an exercise of legislative power in ultra veris (beyond the powers).”

He added that he was “particularly disturbed with the legal issues/dilemma resulting from the amendment introduced.”

“The amended Ordinance is vague and ambiguous. It is not clear whether, in the development of green spaces, this shall be done within the allotted open space of the proponent, set back areas of home lots or sidewalk strips based on PD 957 or BP220 design

standards,” he said. (Presidential Decree 957 is about “regulating the sale of subdivision lots and condominiums” while Batas Pambansa 220 is about “establish[ing] and promulgat[ing] different levels of standards and technical requirements for economic and socialized housing projects in urban and rural areas.”)

“It is also prejudicial to public interest and an exercise of legislative power in ‘ultra veris’. This is manifested by the use of the modal verb ‘shall’, connoting a mandatory requirement for the turnover of these green spaces to the homeowners association for proper maintenance. There is now the unwarranted burden of maintaining the green space, passed on to the homeowners association, which exceeds the requirement of PD 1216, (which states) only parks and playgrounds of the entire open space may be donated to homeowners associations,” he stated.

(Presidential Decree 1216: “Defining ‘open space’ in residential subdivisions and amending section 31 of PD No. 957 requiring subdivision owners to provide road alleys, sidewalks and reserve open space for parks or recreational use.”

‘No to override’ Ateneo de Davao University (ADDU) president Fr. Joel Tabora thanked Mayor Duterte in his Twitter account on Monday, “for listening to people on #green spaces issue in Davao.”

Asked for comment, Mylai Santos, executive director of Ecoteneo of ADDU, said the veto “is another Davao pride: a vote of good governance. A governance that is intelligent, legitimate, responsive and truly for the people.”

She urged the public to press the council not to override the veto.

“No to override. This is really for the sustainability of Davao City. We are leading in terms of the implementation good ordinances – firecracker ban and anti-smoking,” Santos said.

She also countered the previous statements of Vice Mayor Paolo Z. Duterte and Councilors Diosdado Mahipus and Bernard Al-ag that the 10-percent green space was not removed but integrated only to the 30-percent open space.

“The roads and other amenities of the developers have already taken up a big percentage. What would be left to the green space?”

Santos asked.

In a press conference last February 8, Santos said a green space can be a home to wildlife animals like birds and an effective carbon sink to sequester carbon dioxide in the air.

“Our councilors might have forgotten, but we have not forgotten them… Let’s remind them,” she said.

Legal means If the council overrides the veto, Fuertes said they will resort to filing a case in the local court.

“We don’t want to resort to legal battle but we are heading that way, that being our last resort,” she said.

Santos said they will file a case, if ever, against the Council on substantive and procedural grounds.

Paolo vs Acosta Fuertes also came to the defense of Councilor Mabel Sunga-Acosta from allegations by Vice Mayor Duterte that she was fueling the outcry of the environmentalists.

“From the start, her decision was ‘no’. Since we have the same stand, we helped each other out. It’s not that she influenced. We are a different group. We know how to think on our own.

If we don’t really care for the environment, we will not take action,” she said.

“I do not deserve the treatment that I got from my colleagues. Shabby, unfair, and uncalled for, it was. It is not necessary for everybody to like me, but my position as an elected representative of the people deserves respect,” Acosta said in statement issued on February 19.

Acosta said that she was not a member of the Committee of Rules, Privileges, and Ordinances, chaired

by Councilor Bernard Alag, and the Committee on Housing, under Councilor Victorio U. Advincula, that handled the item and that she only knew that the environmentalists were not consulted on the issue after the second reading.

“I did not know that the views and voices of environmental groups were not heard at all the whole time. I did not know that they were not given the chance to participate in the legislative process. I was as surprised as they were,” she said.

30% open space, no more green space Vice Mayor Duterte said it was stated in the revised CLUP that the green space provision was not deleted but rather incorporated only in the 30-percent open space.

Acosta objected to such move because she does not want the green space to be incorporated in the 30 percent, as this area is allotted for roads, drainage, water and energy facilities, community facilities, amenities “that may have been promised by the developer, like club house or multipurpose hall, gym, basketball court,

parks, playground.”

“In the 30-percent open space, a large part of it is already eaten up by roads and drainage. Only a fraction of it would be left for community facilities for homeowners,” she said.

The mayor said the amended provision was vague, ambiguous, and ultra veris, which means beyond power of local legislative department to override 30-percent green space provision as provided for in the national law.

Under the amended ordinance, Section 13 states that “for land development projects within the City of Davao which are socio condition of roads, streets, bridges, public buildings, and other public works under their control of supervision.”

“Thus, the amended measure unnecessarily makes the City Government of Davao liable for the damages that may arise from the negligence of homeowners association or their representatives. In such an event, the City will be forced to disburse public funds to cover the indemnity for damages resulting from the acts of the homeowners associations or its representatives to which it has no control over,” he stated.
