NTC needs ‘super’ powers to control telcos, says senator

Senator Win Gatchalian is asserting the need to confer the National Telecommunications Commission (NTC) with “super” powers to more effectively carry outs its regulatory mandate over powerful players in the telecommunications industry. Gatchalian, chairperson of the Senate Committee on Economic Affairs, is recommending that the NTC be granted additional authority to allow it to more effectively discipline erring or incompetent telecom-

munication companies. The recommendation will be among the salient points that Gatchalian will include in the committee report. He plans to submit to the plenary in relation to the committee discussions on Senate Resolution No. 213, which called on the Senate to look into the economic effects on consumers and the national economy of the present model of operation and regulation of the telco industry. “The objective here is to see if we have enough

regulatory mechanisms to make the playing field even. Telecommunications is a public utility, and just like other public utilities, it has to be regulated to make sure that the playing field is even, to make sure that customers are getting the value that they are paying for.” Gatchalian said. Gatchalian noted admissions made during the committee hearing last week that the NTC has been hard put at imposing drastic penalties against telcos which fail to deliver satisfactory services

to consumers. He cited as example the disclosure of NTC Deputy Commissioner Edgardo Cabarios that they have failed to compel industry giants GLOBE and SMART to deliver the minimum speed of 12 mbps in Internet connectivity that their advertisements guarantee to their subscribers. Cabarios said that since the NTC and the two telcos differ on the issue of whether or not data connection speed limits can be imposed, the NTC has opted to be silent on the issue “because of the limitations in the law.” He added that the measly penalty of P200 per day for Notice Notice is hereby given that the intestate estate of late Yu Tieng Su, who died on April 2, 1970. make sure that it gets the same powers like the ERC (Energy Regulatory Commission),” he said. The ERC is the body that regulates the energy sector. It has extensive powers, including quasi-judicial powers, to control and penalize erring power companies.

AS the Department of Education (DepEd) finalized its decision to buck condom distribution in high schools in the country, pro-lifers are all too happy with the development, calling it a “wise” move. “It was a wise move. PCC chief vows to crack down on unfair completion

Arsenio Balisacan, first chairman of the Philippine Competition Commission (PCC), promised on Tuesday to zero in on the newly-created commission’s mandate to crack down on unfair competition in the Philippine markets. “As the country’s antitrust body, we endeavor to crack down on cartels, break up monopolies, penalize and fine companies that are found guilty of anti-competitive behaviors,” Balisacan said during Palace media briefing. PLEASE open the Holy Words in your cell phone. I also suggest to download a free offline Bible in your phone so that the words of the Almighty One are being just a click of your finger. It might be nonsensical to say that WW3 has started, but just be open minded and continue reading. I intend not to write the passage of the Holy Book so that you will search it yourself. I encourage you to have your own Holy Bible and start reading and studying, it will amazingly change your mindsets. Here we go. Please read the passage about world war in Revelation 8:7, Revelation 9:15, Ezekiel 38 and 39. The Holy Book of Christians, which is commonly called “Bible”, (it is not found in the scriptures, but it was taken from the Greek word “Biblos” which means books), fully laid down the story of the creation of the universe, the story of mankind and predicted the coming world wars and finally the end of the world. I am not writing this to sow seeds of fear in your hearts, but for you to ponder the possibility of this scary world event. The very

famous French physician and astrological consultant Nostradamus who lived 500 years ago had predicted that there will be 3 world wars that will happen before the end of the world. The WW1 happened from 1914 to 1918 and approximately 10 million people died. After 21 years, WW2 erupted and it lasted for 6 years from 1939 to 1945. WW2 was known as the highly pernicious conflict in human history for it claimed 70 million dead. Today, when you google and search for WW3 you will find several links and it is trending in the social media. In 2015, I heard from Pope Francis, in one of his speeches, that the war in the Middle East is a “piece of a meal” comparing it to WW3. During the 70th Celebration of the United Nations in New York, I personally heard the speech of the King of Jordan, King Abdullah II, when he said, that the on-going conflict in the Middle East has already been the inception of WW3. Take note, that the conflict in Iraq and Syria and the battle against ISIS

already involved the super power nations of Europe and America. I read one time on the internet that a Russian Military officer explained to the world that their actions to destroy the rebels against President Assad of Syria is for them to stop the WW3. Right now, NATO has criticized Russia’s “aggressive military posturing” and that it will not help alleviate tensions between the two. In a statement by Russian President Vladimir Putin, he acknowledged moving his nuclear-enabled missiles closer to Europe in response to NATO’s extension into Baltic territory. Last week, January 28, President Donald Trump made a shocking Executive Order of the travel ban to 7 countries which cause a global confusion. Until today, protesters are flooding the airports, green card holders were not allowed to enter America and heads of 7 nations are too much disappointed. Whether this is true or not, our job is to search the Holy Word of God and do some preparations. When WW3 will truly happen, 1/3 of the world’s population

Let us share love to all people and promote acceptance and unity among all those who believe in God and His Holy Book. This is not the time to debate who is the true church. Donors of relief goods intended these items for victims only and no one else. The battle in Butig, Lanao del Norte is reportedly still raging despite deaths in the side of the rebels. The military must finish the last man standing on the opposite side to give the residents in the area total peace. THE EPIRA of 2001 states in Section 30: “Within one year from the effectivity of this Act, the DOE shall establish a wholesale electricity spot market composed of the wholesale electricity spot market participants.” And in Section 37, defining the powers and functions of the Department of Energy, the EPIRA mandates the DOE to “establish the wholesale electricity spot market and formulate the detailed rules governing the operations thereof ”. Noticeable in these statements, and in all references to the WESM in the EPIRA and in its Implementing Rules and Regulations, is that the EPIRA envisions only one wholesale electricity spot market for the Philippines. There was no idea of establishing WESMs in various places in the country. Thus, the mandate given to the DOE by the EPIRA is the establishment of only one WESM, and, consequent to this, it is the mandate of the DOE to EXTEND the WESM to Mindanao, or to INTEGRATE Mindanao into the WESM, when the conditions are favorable for doing so. It is not the mandate of the DOE to establish an isolated WESM in Mindanao, or in Palawan, or in

Before taking any action to extend the WESM to Mindanao the DOE will have to find out whether the conditions exist that would make it economically feasible for the WESM to be extended to Mindanao. A necessary condition for the extension of the WESM into an isolated electric power system is for that power system to be physically connected to the Luzon-Visayas grid through an interconnection with adequate capacity to enable the transport of the expected amount of electric power. In the case of Mindanao, a Visayas-Mindanao interconnection with a capacity of at least 400 MW must be constructed before Mindanao could be integrated into the WESM. Or maybe they have decided to amend the EPIRA in order to give DOE the mandate to establish isolated WESMs in all islands where a WESM would be economically beneficial to the populace. Or maybe they want to empower each state under a federal system of government to establish autonomous WESMs, even in the absence of electrical interconnection with any of the other regions. In any such scenario, the question still has to be answered whether the conditions exist that would make it beneficial for the citizens of the island or the state to establish an autonomous WESM. Isolated WESM in Mindanao: Anti-Consumer and Pro-Oligarch Would it be economically beneficial for the people of Mindanao to establish an isolated WESM? The rates for electricity will have to be increased to pay for the costs of establishing an isolated WESM. Around five billion pesos will be needed to establish a WESM in Mindanao with functional capability equivalent to the existing Philippine WESM. And it would cost around one billion pesos annually to operate the WESM. The initial capital investments and the annual operating costs would translate to an increase in the rate for power consumers in Mindanao in the amount of around twenty centavos per kilowatthour. This is peanuts in comparison with the Mt. Apo geothermal power plant getting an illegal approval from the Energy Regulatory Commission to increase the rates by more than two pesos per kilowatt-hour. But it would be almost impossible on the part of the electric cooperatives to get an increase of more than ten

centavos per kilowatt-hour for their distribution rates. So the increase in rates due to the establishment of a WESM in Mindanao is significant. The increase in rates due to the WESM could be compensated for by a reduction in the prices of power supply from the generating companies, resulting from the competitive regime established by the WESM. In Mindanao, however, there are only five significant bulk power suppliers: the Aboitiz Group, the Alcantara Group the Ayala Group, the FDC group of the Gotianun family, and San Miguel. It is easy for such a small group of power corporations to collude and dictate the price of electricity in the WESM. The price of intermediate and peaking power supply in Mindanao would rise to at least twenty pesos per kWh (the price of generation from modular diesel generating plants) with the operation of a WESM in which all energy would be priced at the highest bid accepted by the WESM. Thus, there could be no economic justification for the establishment of an isolated WESM in Mindanao. And one could conclude that the DOE, the PEMC, and the Mindanao Development Authority are endorsing the establishment of the WESM only because they have been

prevailed upon to do so by the oligarchic generating companies, which are the only players in the electric power industry that would benefit from an isolated WESM in Mindanao. Recommendation for the Philippine Electricity Market Corporation The Mindanao Coalition of Power Consumers has recommendations for better things that the PEMC and the DOE could do for the electric power industry in the Philippines instead of wasting their time and resources in the establishment of a WESM in Mindanao that would be harmful to power consumers and the general public. The PEMC should work on restoring the confidence in the WESM that the players in the electric power industry had in the years immediately following the establishment WESM in June 2006. The WESM is a distinctively valuable institution for a developing country like the Philippines, and it should be valued and supported by EPI players and power consumers. But the weaknesses of the WESM were exposed in the aftermath of the price spikes in the LuzVi grid in December 2013, and the WESM has now reached a low point in public acceptability. It is now more than ten years after the establishment of the WESM, and the market operator is still the Philippine Electricity Market Corporation, which is a GOCC. While the PEMC did a good in its management and operation of the WESM in the early years of the WESM, it has done a bad job in recent years, and the WESM has reached the lowest point of acceptability to the players in the electric power industry

and to power consumers. Perhaps more important is that the prospective investors in the electric power industry no longer consider the WESM significant in making investment decisions. Trust in the market is essential to the efficient operation of any market, and the WESM no longer has that trust under the present management. The establishment of an Independent Market Operator by the DOE will help the WESM regain the trust and confidence that it has lost. ••• (Engr David A. The National Demonratic Front of the Philippines negotiating panel is expected to give notice of the termination today to its government counterpart. The CPP and the NPA maintained that the release of all political prisoners is an obligation of the GRP under the Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law (CARHRIHL) of 1998 and the Joint Agreement on Safety and Immunity Guarantees (Jasig). They added that the unilateral ceasefire declaration was issued on the mutual understanding with the GRP that the release of political prisoners would take effect within 60 days of August 28. The Duterte administration, however, failed to fulfill such promise. Since August, not one of the 395 political prisoners have been released in relation to the peace talks. The CPP and the NPA claimed that the “GRP has treacherously taken advantage of the unilateral declaration of interim ceasefire to encroach on the territory of the people’s democratic government.” They said that the military troops have occupied at least 500 barrios across 164 municipalities and 43 provinces. The CPP and the NPA cited the armed encounter that broke out on January 21 in Makilala, North Cotabato. They said that the suspension of military operations (SOMO) and suspension of police operations (SOPO) issued by the Armed Forces of the Philippines (AFP) and Philippine National Police (PNP) as basis of the GRP’s unilateral declaration of interim ceasefire have served as license for its armed troops, police personnel, paramilitary units and death squads to engage in hostile actions, provocations or movements, surveillance and other offensive operations that are labelled as “peace and development”, “civil-military”, “peace and order”, “anti drugs campaign,” “medical missions” or “law enforcement.” Still for peace negotiations Still, the CPP and the NPA said they continue to support the GRP-NDFP peace negotiations, adding it is possible to negotiate while fighting until the substantive agreements are forged to address the roots of the armed conflict and lay the basis for a just and lasting peace. “We oppose the use of interim ceasefires as basis for a protracted or indefinite ceasefire without substantial benefit for the people and their revolutionary forces and for laying aside peace negotiations on substantive issues such as social, economic and political reforms,” the CPP and the NPA said. “Such is tantamount to

All territorial and unit commands of the NPA are also ordered to take full initiative in planning, coordinating and carrying out military campaigns and tactical offensives against the AFP, PNP, the various paramilitary units and death squads of the Duterte government. The CPP leadership said the NPA will continue to enforce policies and laws of the people’s democratic government, perform necessary and appropriate functions of governance, and mobilize the people and resources in territories under its authority. Vice Governor Pelaez made known his position that he is seriously concerned about the future of students and youth insofar as access to affordable tertiary education is concerned in the province. He also sought for various solutions and alternative plans to address and secure their future. During the meeting, the BSU-ESC Center Administrators took turns in explaining their respective positions on the matter, shared their plans

and pointed out their innovations on how to better improve the delivery of quality tertiary education. They also committed to furnish the Office of the Vice Governor with a three-year survey and tracking of past graduates to support their claims that BSU-ESCs have been producing graduates who are now employed either in the government or private offices. According to the Center Administrators, the accomplishments of their students in the real world are a testament of the quality of graduates the BSU-ESCs are producing through the years of its operation.
