DAVA O C i t y - - S o m e 170,000 voters in the Davao Region who have been cleansed from the database of the Commission on Elections (Comelec) 11 will not be able to cast their votes in the 2016 national and local elections after the Supreme Court junked on Wednesday the petition questioning the constitutionality of the poll body’s “No Bio, No Boto” policy for lack of merit.

Based on the records of the Comelec 11, most of the voters come from Davao City with 873,670 voters, followed by Davao del Norte with 525,343, Compostela Valley with 408,539, Davao del Sur with 373,692, Davao Oriental with 319,971, and Davao

Classroom management and management of pupils’ conduct are skills that teachers learn and hone over time. It cannot be learned in a day. It takes commitment and patience to fully understand the psychology of every pupil, every student, for each of them possesses different characteristics; characteristics that may completely vary from one classmate to another. Over the years, managing the pupils’ behaviour

The Wharton degree of Mar Roxas II By Elson T. Elizaga

First, Davao City mayor Rodrigo Duterte said Mar Roxas II is not a graduate of Wharton School of the University of Pennsylvania. Whenrappler.com and the Philippine Daily Inquirer confirmed the degree, the mayor changed his statement a bit: Roxas took an undergraduate course in Wharton, not an MBA, so Roxas is a graduate of the University of Pennsylvania, but not of Wharton. Two webpages support this view and suggest that the undergrad course taken by Mar Roxas at Wharton School is a small achievement. One writerstates that it is not even economics: “Mr. Roxas, no self-respecting presidential candidate will consider 4 years in high school [ at Ateneo de Manila University] and 3 years in [Wharton] college a ‘background in economics’.” Apparently, the writer has little idea about the quality of students and education at Wharton. Undergrads at Wharton are sought after by many firms. They are recruited even while they are still studying and offered exceptionally high salaries. Consider this excerpt from the Wikipedia entry on Wharton: “Wharton undergraduate students fare well in the recruitment process, with many leading firms conducting on-campus interviews. In 2013, 407 employers participated in the on-campus recruiting process; each

keeps himself in the news by churning out sound bites that could make you either applause or puke, depending on which side you’re on. Whenever he brags about how he keeps the peace in his city, you either cheer or jeer him. The man keeps the audience glued to him by presenting himself as a contradiction. He belongs to the system, and yet, his adoring devotees believe he is the antidote to the ills besetting it. But regardless of whether you’re amused or peeved,

Wikipedia, after all, states the entire article contains promotional material. Also, the figures in the excerpt are for 2013 only and may not be applicable to Roxas, because Roxas graduated from Wharton in 1979. Is

it possible the quality of Wharton education then was dismal and Roxas failed to find a job? To find the answer, I checked the Wikipedia entry on Roxas and found this: “After graduation, he [Roxas] worked for seven years as an investment banker in New York, and became an assistant vice president of the New York-based Allen & Company. Following the 1985 announcement by President Ferdinand Marcos of a snap election, he took a leave of absence to join the presidential campaign of Corazon Aquino. “In September 1986, President Corazon Aquino went to the United States. He [Roxas] was one of those who organized a series of investment round-table discussions with the American business community. From 1986 onwards, he visited the Philippines more frequently. “He then proposed to his company to set up shop in Asia, specifically in the Philippines, and later his superiors agreed. In 1991, he was stationed in the country under North Star Capitals, Inc. which took Jollibee public. In the United States, he participated in the first financing of Discovery Channel and Tri-Star Pictures.” How reliable are these bits of information? Wikipedia is a “free-access, freecontent Internet encyclopedia”, as many of us know. Most people still have the impression that Wikipedia articles are generally inac-

curate. But there is a way to discover if the claims are true. Nowadays, Wikipedia contains lots of referential footnotes. Check the footnotes. In the entry on Wharton, for example, read the contents of footnotes 42 and 43. Read other sources and keep an open mind. Finally, a disclaimer. This article does not endorse the political campaign of Roxas or other candidates. Whether a person is fit to be president of the Philippines because of a degree from Wharton, Yale or Xavier is another matter. What I’m trying to do is demonstrate that Wharton is different. There is no basis for concluding that because a student has spent only three years in Wharton, and because Philippine education requires four years of college, then that person’s degree in Wharton must be non-existent. the fact remains that he has managed to maintain media and public attention at no cost except for the amount of saliva that lands on the faces of his opponents and detractors. Such tack has worked since the day Duterte’s strategists floated his name for the presidency. He feigned coy to the idea, declaring every now and then that he wasn’t keen on the post. His body language however said the opposite; he went around the country selling federalism as a better setup compared to a highly centralized political structure. Alongside the sales pitch for federalism, Duterte’s publicists capitalized on Davao City’s image as a paragon of peace and order. Duterte himself reinforced the hype by boasting about

his unorthodox, not to say ironhanded, ways of dealing with criminals. He punctuated this with the warning that Manila Bay will become a dumpsite for bodies of suspected criminals [if he becomes president]. In a perfect world, such statement would have sent shock waves across the land. But, no, the people – or at least, many of us – yelled in approval. His supporters, feeling the momentum, raved on social media, eagerly endorsing the bloodbath he vowed would happen on an epic scale so that law-abiding citizens like you and me may enjoy restful nights. The few who opposed his avowed policy of employing summary methods against criminality found themselves at the receiv-

ing end of his supporters’ fury. Not a few echoed their idol’s expletive in bullying his critics into silence. PI became a household phrase overnight. 10 HIV cases in Surigao Norte from Jan. to Sept. By Roel Catoto of MindaNews

SURIGAO City––At least 10 people were found positive of Human Immunodeficiency Virus (HIV) in Surigao del Norte from January to September this year, a health official says. Jessica I. Nepomuceno, program coordinator of the Sexually Transmitted Infections /HIV/Acquired Immune Deficiency Syndrome (AIDS) program of the City Health Office said health officials expressed alarm over the rising number of persons with the dreaded disease. Nepomuceno, however, could not say from which municipalities the HIV patients came from. “We have 1 person per month, it’s alarming,” she told MindaNews yesterday at the City Health Office. She said the figure does not include the persons who tested positive at their laboratory since the findings on them need to be confirmed in Manila. She added the confirmatory tests were being done at the Sexually Transmitted Disease-HIV Cooperative Central Laboratory of San Lazaro Hospital. Early in 2014, one person from Dapa town tested positive. Two others from Gigaquit town and Surigao City were also found to have the disease. Nepomuceno said they discovered two new additional HIV patients this year in Surigao City. Both of them are male students at a local college. She said two persons also tested positive of HIV at the Caraga Regional Hospital this year. She said 96 percent of HIV cases were found on males and only 4% are found on females, and the disease is prevalent in males having sex with males. “Majority of these are homosexuals,” she added. “Having risky behavior is among the common factors why they got inflected with it,” she said. Elvin Francisco, peer educator on HIV in Surigao City said they are helping persons with HIV to combat the stigma. “Stigma kills faster than the disease. Some of them would commit suicide and we are helping them to combat this problem because most of them don’t know what to do,” he said. He said he told the HIV patients not to engage in risky behavior because they could infect others. Francisco is the current president of Surigao Gay Association (SUGA) and has conducted campaigns on HIV/AIDS among members and non-members alike. Dr. Romulo Ybiernas, a private doctor in Dinagat has been actively campaigning on HIV/AIDS awareness. “I keep telling my friends on safe sex methods,” he said. Comelec recognizes Duterte’s CoC for president THE name of the Davao City Mayor Rodrigo Duterte will be included in the list of candidates for the May 2016 elections after the Commission on Elections (Comelec) has accepted his Certificate of Candidacy (CoC) for President. In Comelec Resolution No. 10028, the Commission en banc, voting 6-1, recognized the CoC filed by the presidential aspirant last Nov. 27, substituting Martin Dino, as the standard-bearer of PDP-Laban. However, the poll body noted that the ruling was without prejudice to the pending case filed against the local chief executive of Davao City. “After due deliberation, the commission resolved, as it hereby resolves, to acknowledge and accept the Certificate of Candidacy for President of Rodrigo R. Duterte being a ministerial function of the Commission but this is entirely without prejudice to the pending disqualification case in SPA No. 15-194 (DC), entitled “Ruben H. Castor vs. Martin Dino,

Mayor Rodrigo Duterte, and Partido ng Demokratikong Pilipino (PDP) Laban”, or any other case that may be filed against him,” said the ruling promulgated on Thursday. Those who voted to accept Détente’s CoC were Comelec Chairman Juan Andres Bautista, Commissioners Christian Robert Lim, Al Parent, Luie Tito Guia, Arthur Lim and Sherrif Abas. Commissioner Rowena Amelia Guanzon has dissented noting that there was still a pending case that should be decided first before the CoC would be accepted. “There is a pending case, Castor v. Duterte wherein the petition alleges that Duterte’s CoC is void because it contains untruthful acts or misrepresentation. There is also the issue regarding his notarized documents. formance accountability. Some areas in the SBM were not addressed in the SIP. There is a need to address the problems on SBM assessment. The over-all impact for the teachers’ attitudes towards SBM practices is both “favourable” and “unfavourable”. THE Philippine Atmospheric, Geophysical and Astronomical Services Administration (PAGASA) raised public storm warning signal (PSWS) No. 1 over 12 areas in Mindanao on Thursday morning as tropical depression (TD) “Onyok” maintains its strength and continues to pose a threat over Caraga Region. PAGASA said that as of 10 a.m. Thursday, the center of TD “Onyok” was estimated based on all available data at 625 kilometers east of Hinatuan, Surigao del Sur (8.4°N, 132.0°E) packed

with maximum sustained winds of 55 kilometers per hour near the center. It is forecast to move westward at 15 kph. With its present speed and movement, “Onyok” is expected to make a landfall in Caraga Region by Friday afternoon or evening, the weather agency said. As this developed, PSWS No. 1 (30-60 kph winds expected in 36 hours) is hoisted over the provinces of Surigao del Sur, including Siargao Island, Surigao del Norte, Dinagat Province, Misamis Oriental, Camiguin,

Agusan del Norte, Agusan del Sur, Davao Oriental, Davao del Norte, Compostela Valley and Bukidnon. Residents in low-lying and mountainous areas of the provinces with the public storm warning signal are alerted against possible flash floods and landslides. The estimated rainfall amount is from moderate to heavy within the 100-km diameter of the tropical depression. TD “Onyok” is forecast to be at 273 km east of Hinatuan, Surigao del Sur by Friday morning.

On Saturday morning, it is expected to be in the vicinity of Katipunan, Zamboanga del Norte; and at 750 km west of Zamboanga City by Sunday morning. It is forecast to be at 1,445 km west-southwest of Zamboanga City or outside the Philippine Area of Responsibility (PAR) by Monday morning. Meanwhile, tropical depression “Nona” has weakened into a lowpressure area (LPA), prompting weathermen to lift all public storm warning signals in Luzon. As of 10 a.m. Thursday, PA-

GASA said the LPA was spotted some 75 km west of Olongapo City, Zambales (14.8°N, 119.6°E). It is expected to bring light to moderate rains and isolated thunderstorms over Metro Manila and the rest of Luzon. Climate change rapidly warming world’s lakes -- study CLIMATE change is rapidly warming lakes around the world, threatening freshwater supplies and ecosystems, a new global study led by an Indian-origin researcher has warned. The study is the largest of its kind and the first to use a combination of satellite temperature data and long-term ground measurements. “We found that lakes are warming at an average of 0.34 degrees Celsius each decade all around the world, threatening freshwater sup-

plies and ecosystems,” said Professor Sapna Sharma from York University in Toronto. “This can have profound effects on drinking water and the habitat of fish and other animals,” said Sharma, lead author of the study. For the study funded by the National Aeronautics and Space Administration (NASA) and the National Science Foundation in US, 235 lakes, representing more than half of the world’s freshwater supply, were monitored for at least 25 years.

The study found that lakes are warming at an average of 0.34 degrees Celsius each decade. That is greater than the warming rate of either the ocean or the atmosphere and can have profound effects, researchers said. Algal blooms, which can ultimately rob water of oxygen, are projected to increase 20 percent in lakes over the next century as warming rates increase. Algal blooms that are toxic to fish and animals would increase by 5 percent. If these rates continue, emissions

of methane, a greenhouse gas 25 times more powerful than carbon dioxide on 100-year time scales, will increase 4 percent over the next decade. “Society depends on surface water for the vast majority of human uses,” said Stephanie Hampton from Washington State University. “Not just for drinking water, but manufacturing, for energy production, for irrigation of our crops. Protein from freshwater fish is especially important in the developing world,” she added. The temperature of water influences

his supporters still won’t mind. He has produced results no matter the price. They’d rather have bodies of suspects sprawled on the streets – dead – than see them walk away scotfree owing to loopholes in the justice system and law enforcement. Yet, this is where the real

contradiction lies. For, Duterte’s methods, while being touted to have reaped results, have only made things worse, will only make things worse. Doing away with due process is not an indictment of the system as others would claim. On the contrary, resorting to shortcuts in

Every year, the group’s members have been increasing throughout the Philippines. 5.1.1 Building and related structures to be constructed.

a) At the space where the primary function is served and where facilities and ingress/egress of the building or structure are located, as to make such space accessible to the disabled persons; provided, however, that where the primary function can be served at the ingress level and where such level is provided with facilities, requirements for accessibility at other levels may be waived.

b) Ten percent (10%) of the total number of units of government-owned living accommodations shall be accessible and fully usable by the disabled persons with any fractional part in excess of one-half (1/2) in the computation thereof, to be considered as one unit; for privately-owned living accommodations the number of accessible units shall be as provided in Section 3 of Rule III thereof.

c) Ingress/egress from the street to the building or structure shall be made accessible.

d) Accessible slots in parking areas shall be located as near as possible to ingress/egress spaces of the building or structure.

5.1.2 Building and related structures to be repaired or renovated including those proposed for a change of occupancy if feasible, barrier-free facilities and accessibility features shall be provided in accordance with the requirement under Subsection 4.1.1 (1), (c) and (d): feasibility of incorporation of barrier-free facilities and accessibility features shall be determined from all the following conditions:

a) When the repair or renovation work is to be done in the space where the primary function is served; b) When the facilities can be made accessible at any other level which is accessible by means of an elevator with a minimum width of 800 mm; c) When the space allotted for the primary function will not be diminished by more than ten percent (10%) of its original area; d) When the capacity or strength of any major structural component, such as slabs, beams, girders, columns, bearing walls and footing of the building, or structure will not be diminished; e) When the cost (exclusive of the exception provided below) of such repair or renovation work is in excess of twenty percent (20%) of the total cost of the building or structure, based upon the computation of permit fees as provided under Rule III of the Implementing Rules and Regulations promulgated pursuant to P.D. 1096 entitled: The National Code of the Philippines; f) When there is no legal constraint which would not allow compliance with these regulations:

SECTION 1. TITLE. This Ordinance shall be known Accessibility Law of Butuan City. SECTION 2. POLICIES AND OBJECTIVES. It is the policy of the local government of the City of Butuan to promote social justice in all phases of community development, and to provide for the care of persons with disabilities, for them to have priority access to essential goods and services at affordable costs, to provide for their rehabilitation, self development and self reliance, to provide for their integration into the mainstream of society, and to ensure their full participation in all aspects of community life through having accessibility in the environment that will serve their best interests. SECTION 3. SCOPE AND COVERAGE. The provisions of these Rules and Regulations shall apply to the following:

3.1 Public and private buildings and related structures for public use and which shall be constructed, repaired or renovated;

3.3 Public transport vehicles which shall include:

4.1 ACCESSIBLE – refers to features that enable disabled persons to make use of the primary functions for which a structure is build.

4.2 BARRIER-FREE-unhindered, without obstructions to enable persons free passage or use of the facilities

4.3 BUILDINGS – public and private buildings and other related structures for public use. This is designed to accommodate and serve persons in the pursuit of educational, commercial, recreational, religious, occupational, medical, political, social activities and others of similar nature as enumerated and provided herein.

EXCEPTION: Repair or renovation work which consists only of heating, ventilating and air conditioning systems, including those which may be required only with respect to fire panic and explosion safety for existing spaces, shall not be subject to the requirements for barrier-free facilities and accessibility features.

4.4 CURB – a raised rim of concrete, stone or metal which forms the edge of street, sidewalk, planted area, etc. 4.5 CURB CUT-OUT – a break in the sidewalk or traffic island provided with an inclined surface to facilitate mobility of wheeled chairs, carriages and other similar conveyance. 4.6 DISABLED PERSONS – those suffering from restriction or lack of ability to perform an activity in the manner or within the range considered normal for a human being as a result of a mental, physical or sensory impairment. 4.7 EGRESS – an exit, or a means of going out.

SECTION 10. BUDGET. The City Mayor and the Sangguniang Panlungsod shall allocate a continuing annual budget for the operation and implementation of the approved plans, programs and services of the Persons with Disability beginning the current Fiscal Year 2016. A budget allocation shall be incorporated in the supplemental budget which may be made immediately after the effectivity of this Ordinance. SECTION 11. PENAL CLAUSE.

5.3 Transport vehicles for public use: a) No license or franchise for the operation of public buses, jeepneys and tricycles, passenger boats, ships and domestic airplanes shall be granted or issued unless the owner or operator thereof shall have provided and designated the number of seats and shall have placed audio-visual aids, except tricycles.

b) Government instrumentalities operating passenger airplanes shall provide and designate the number of seats for disabled persons and shall likewise place the audio-visual aids.

b. Any person who abuses the privileges granted herein shall be penalized at the discretion of the court.

5.3.1 Existing Public Transport Vehicles - The minimum accessibility requirements shall apply to all existing units of public transport vehicles, and including those units, which are to be repaired and renovated.

c. If the violator is a corporation, organization or any similar entity, the officials thereof directly involved shall be liable therefore.

d. If the violator is an alien or a foreigner, he shall be deported immediately after service of sentence without further proceedings.

e. PERSONS/INDIVIDUALS LIABLE FOR ANY VIOLATION OF THE ACT:

5.4 Public Telephones – At least one unit of public telephone for every four (4) units shall be accessible to disabled persons and shall be provided with visual aids required, provided that if only (1) public telephone is to be installed in a particular place the same shall be accessible to disabled persons. 5.5 Public Transport Terminals – The criteria and accessibility requirements, provided for public and private buildings and related structures for public use shall apply to public transport terminals.

SECTION 6. SPECIAL STANDARDS OF ACCESSIBILITY. Where the requirements for accessibility in the Rules will create hardship in design/construction, special standards of accessibility through the use of other methods and/or materials shall be allowed if better facilities can be provided subject to the approval of the DPWH/CAO per NCDA. SECTION 7. BASIC PHYSICAL PLANNING REQUIREMENTS. No group of people shall be deprived of full participation and enjoyment of the environment or be made unequal with the rest due to any disability. In order to achieve this goal adopted by the United Nations, certain basic principles shall be applied.

a) ACCESSIBILITY. The built environment shall be designed so that it shall be accessible to all people. This means that no criteria shall impede the use of facilities by either the handicapped or nondisabled citizens.

b) REACHABILITY. Provisions shall be adapted and introduced to the physical environment so that as many places or buildings as possible can be reached by all.

c) USABILITY. The built environment shall be designed so that all persons whether disabled or not, may use and enjoy it.

d) ORIENTATION. Finding a personal way inside and outside of a building or open space shall be made easy for everyone.

SECTION 8. ADDITIONAL FACILITIES/SERVICES. The following facilities and services are necessary for accessibility, assistance and facility of Persons witgh Disability:

a. Ramps b. Curbs/curb-out c. Sidewalks d. Walkways/passageways e. Landmarks/railings/hand-railings f. Mechanism for correction of impairments/decreasing the degree of disability especially in children g. Rehabilitative services for disable and indigent persons h. SECTION 9. INSPECTORATE TEAM. An Inspection Team should be composed to inspect and qualify institutions, establishments and buildings (old, new and to be constructed) in compliance with the National Building Code:

SECTION 12. SEPARABILITY CLAUSE. If any provision of this Ordinance is declared invalid or unconstitutional, the remaining provisions not affected shall continue to be in full force and effect. SECTION 13. REPEALING CLAUSE. All Ordinances, local issuances and rules inconsistent with this Ordinance are hereby repealed and/or modified accordingly. SECTION 14. EFFECTIVITY CLAUSE. This Ordinance shall take effect after its approval and publication for two (2) consecutive weeks, in a local newspaper of general circulation in Butuan City and posting in the bulletin board in two (2) other conspicuous places in the City. power generation and transmission assets, the time when there was only one supplier of electricity for the whole country has long gone so don’t celebrate just yet when a power plant goes up in your community. During the latest Media Forum hosted by the National Economic and Development Authority in Region 10 (NEDA-10) last December 16, the need for a change in the definition of an area’s energy security became evident following the presentation of the region’s installed and dependable capacities. According to figures culled from local distribution utilities, the Dept of Energy and the Power Sector Asset and Liabilities Management Corp. (PSALM), Region 10’s total installed capacity increased by 98 megawatts (MW) or a 9.17% increase, from 1,052.8MW during the 3rd quarter of 2014 to 1,166.4MW for the same period this year. This was attributed to the operationalization of embedded power plants of DUs in Iligan City and Panaon, Misamis Occidental. The installed capacity also includes embedded generators of the Cagayan Electric Power and Light Co., Iligan Light and Power Co (ILPI), FIBECO, MOELCI and MORESCO II that make up 18% of the total. Embedded generators are operated by generation companies (gencos) owned by affiliates of DUs which supply power exclusively within the franchise areas of their mother companies. It was similarly reported during the same forum that Region 10’s dependable capacity (or the electricity that the generators actually deliver to its customers) declined by 103MW or 10.31% for the third quarter of 2015 compared to the same period in 2014. This was attributed to the onset of the El Niño phenomenon

which significantly affected the water levels in the AgusPulangi power complexes which still supply over 50% of Mindanao’s energy to date. The dependable capacity of power plants in Region 10 reportedly makes up 70% of the total supply for Mindanao as of September 2015. Lest residents, and more importantly, decision makers make assumptions based on the traditional definition of energy security, they should be informed and educated on the changes being undertaken in the power industry, especially given the ongoing privatization of PSALM/NAPOCOR of the country’s remaining power generation and transmission assets. It would be misleading to say the region has this or that dependable capacity without clarifying where the power generated by a particular power plant ultimately goes. For instance, the FDC Misamis coal-fired power plant in Villanueva is designed to produce 405MW of electricity but that doesn’t mean that its host communities, even Villanueva or Misamis Oriental can claim it is “energy secure” because FDC Misamis is a merchant plant and will only supply power to DUs and industries which have a power supply contract with them approved by the Energy Regulatory Commission (ERC). Another case is the 110MW coal fired power plant of Minergy Coal under construction in Balingasag, Misamis Oriental. Since it is an embedded power plant of Cepalco, the host community will not even receive one megawatt of power since it is outside the franchise area of Cepalco. Eventually, when the Agus-Pulangi hydroelectric power plants are ultimately privatized, even if ownership remains with the government, the winning bidder through its Independent Power Producer Administrator (IPPA) contract will be the one to determine who it would allocate the power to through a power supply agreement (PSA) approved by the ERC. So don’t go celebrating the end of these pesky brownouts in your neighborhood yet just because there’s a coal-fired, diesel, solar, hydro or bio-mass power plant being constructed in your community. It would be well for residents and community leaders to first ask the power plant owners just where they are planning to sell all that power to.

Unfortunately, even if its pending application with the Energy Regulatory Commission has already exceeded the maximum 75 day actionable period since it was filed last September 15, 2015 yet, ERC officials say processing of the provisional authority which would enable Cepalco to feed the contracted power to its franchise area could still exceed that mandated period. “Even if there has already been an action or decision before the 75 day period expires, the preparation may take some time such that actual issuance of the order already happens beyond the period,” said Atty. Cepalco has a peak demand of 150-170MW within its franchise area covering Cagayan de Oro, and the Misamis Oriental towns of Tagoloan, Villanueva and Jasaan.
