3rd Northern Mindanao Journalism Excellence Awards eliminations held Story and photo by MARK FRANCISCO

CAGAYAN DE ORO CITY -- A total of 69 junior high school students and ten government information officers joined the eliminations of the 3rd Northern Mindanao Journalism Excellence Awards held Saturday at Phinma-COC Auditorium in Cagayan de Oro City.

The participants joined the following categories: feature writing, news writing, sports writing, photo journalism, business reporting and community journalism.

Prior to the half-day quiz, the participants listened to a two-hour crash course of the topics they participated in. GSIS pensioners to receive Christmas cash gift Dec. 16 STATE pension fund Government Service Insurance System (GSIS) is set to release the yearly Christmas cash gift to a total of 281,000 old-age and disability pensioners starting December 16.

According to GSIS Officer-in-Charge and Senior Vice President for NCR Operations Atty Nora Malubay-Saludares, a total of

PHP2.67 billion has been earmarked for this benefit.

Pensioners whose 2015 Christmas cash gift is above PHP10,000 will be granted an amount equivalent to one-month current pension up to a maximum of PHP12,600.

While, pensioners whose 2015 Christmas cash gift is PHP10,000 and below will be granted an amount

equivalent to one-month current pension up to a maximum of PHP10,000.

Those who resumed their regular monthly pension after December 31, 2015 (after the five-year guaranteed period) will be granted an amount equivalent to one month current pension up to a maximum of PHP10,000.

Pensioners living abroad and those in the Autono-

mous Region of Muslim Mindanao who are on suspended status as of 31 December 2016 are also eligible to receive this benefit provided they activate their status not later than 30 April 2017. They will receive their cash gift not later than 31 May 2017.

My Reflection on Billy Jenkins (2009) on “Instructional Leadership”

School head as instructional builders is one of the tasks being inherent by them in their position. Instructional Leadership has been found important in the early 1990s, as a product of research and that principals should look into it ( Brookover &Lezotte,1982). But this concept of instructional leadership has not given very important according to Lashway (1990).But recently instructional leadership has its come back according to Jenkins (2009).

Jenkins(2009) manifestation explicitly shows that need of school heads to be an instructional leader. That, he must help his co- teacher to improve teaching outcomes, that is desirable to the taste of the DepEd curriculum.

Instructional supplements should be done in spite of the training the teachers had during their pre-service occupation. They need to be reminded on their strategies in teaching and pedagogies . Instructional leadership requires principals to free themselves of bureaucratic task and focus their efforts on improving teaching and learning (Jenkins,2009).That school head personally hands

on to instruction building, not to be delegated to anybody else.

Effective Instructional builders can’t be done if the school head is not fully equipped, without giving himself enough knowledge on instructional leadership. According to Stronge (1998),said that “While most would agree that instructional leadership is critical in the realization of effective schools, it is seldom prioritized. For example, among the many tasks performed by principals, only one-tenth of their time is devoted to instructional leadership. The statement of Stronge was further justified

by Flath(1989 and Fullan (1991) when they cited reasons for giving less emphasis to instructional leadership are lack of in-depth training, lack of time, increased paper works and the communities perception of the principal’s role as that of the manager. In today’s time the school leaders seek to balance their role as manager-administrator and instructional leader Flath (1991 differentiate instructional leaders from that of administrator or manager in a number of ways. as administrator usually are too preoccupied in dealing with strictly managerial duties, while principal who are instructional leaders involve themselves in setting clear goals, allocating resources to instruction, managing the curriculum, monitoring lesson plans and evaluating teachers.

In addition, Whitaker(1997) identifies four skills essentials for instructional leadership.

First, effective instructional leaders need to be resource provider. It is not enough for principals to know the strength and weaknesses of their faculties; they must also recognize teachers’ desires to be acknowledged and appreciated for a job well done. Second, need to be Instructional Resource. Teacher count on their principals as resources of information on current trends and effective instructional practices. Third, An instructional leaders need to be a good communicators.

They need to communicate essentials beliefs regarding learning such as the conviction that all children can learn.

Fourth, effective instructional leaders need to create a visible presence. This includes focusing on learning objectives modeling behaviors of learning and designing programs and activities on instruction.

Finally ,according to Dufour(2002) the instructional leaders also needs to have an up-to-date knowledge on three areas of education. Firstly, on Curriculum; principals need to know about the changing conceptions of curriculum, educational philosophies and beliefs, curricular sources and conflict and curriculum evaluation and improvement. Secondly, on instruction; Principals need to know the different models of teaching, theoretical reason reasons for adopting a particular teaching model and theories underlying the technology-based environment. Lastly, on assessment; principals need to know about the principles of students assessment, assessment procedures with emphasis on alternative assessment methods, and assessment that aims to improve student learning.

All of the essentials skill mentioned above will be followed by all principals then no more disputes that he is an effective instructional leader in the school because I’m sure he could produce maximum achievement to the teachers as well as the achievement of the students.

Setting as a good example

Truth is whatever we say and whatever we act in front of our pupils, they will surely follow and imitate it. Yes, pupils see their teachers as an example of everything, as an example of what goodness and purity is all about. Pupils look up to teachers as an epitome of greatness and excellence, that is why we as teachers should not in any way destroy and wreck our good image to our pupils, to the community so as not to tarnish the good image of the Department of Education.

While it is true that we have also our own personal lives outside being a teacher, that we have the right and freedom to enjoy all the things this world has to offer, we should not forget that we must be careful and vigilant of our actions as an accessory to our profession is basically setting as a good example as well to the society and to the community we live in.

teacher is not only confided in the four walls of the classroom in the school but being a teacher is a lifetime commitment no one could take it from us.

Before we do things and compel things, we should always put in mind these things, “What might be its result?”, “What might be its effect?” or “Will it tarnish the image of the Department?”

That is why teachers are always encouraged to have proper decorum and conduct at all times, be it personal or work-related.

Yet, above all, I encourage my fellow teachers to set as good examples not only in times when someone is looking and monitoring over us, not only in times when our School Head is present, not only in times when our District Supervisor is checking on us or in times when the Superintendent examines us but to every moment and every day of our waking lives. We should at all times adhere to it.

MUNICIPAL ORDINANCE NO. 02 Authored by: Councilor Jaycel C. Macquinto Series of 2016 AN ORDINANCE DECLARING UNLAWFUL THE CATCHING OF FISHES DIRECTLY OR INDIRECTLY FROM THE PAYAO OF ANOTHER WHICH ARE ANCHORED IN THE MUNICIPAL WATERS OF MANTICAO AND PENALIZING VIOLATORS THEREOF.

WHEREAS, there are payaos anchored or established by our fishermen within the Municipal waters of Manticao, which are designed to attract variety of fishes to standby underneath the payao, thereby giving better opportunity to the owner of catching the fishes therein; WHEREAS, payao is among the fishing devices granted by the LGU and the Bureau of Fisheries and Aquatic Resources (BFAR) to our fisherfolks cooperative in the locality; WHEREAS, there are fishermen who take advantage of catching fishes from the payao of another without the permission of the latter; WHEREAS, this act constitutes a violation of the civil right of a payao owner who is supposed to have exclusive right to catch fishes from his payao; WHEREAS, this act defeats the perspectives of the LGU and the BFAR to promote better opportunities of our fisherfolks in the locality; WHEREAS, the LGU of Manticao shall protect and monitor its fishery programs and projects and to promote the lawful interest of the legitimate payao operators in the Municipal waters;

NOW THEREFORE, on motion of Councilor Eric F. Macacua,_duly seconded by Councilor Pete T. Faelnar, it was ; RESOLVED as it was hereby resolved to, enact an ordinance to wit: AN ORDINANCE DECLARING UNLAWFUL THE CATCHING OF FISHES DIRECTLY OR INDIRECTLY FROM THE PAYAO OF ANOTHER WHICH ARE ANCHORED IN THE MUNICIPAL WATERS OF MANTICAO AND PENALIZING VIOLATORS THEREOF. BE IT ENACTED by the Sangguniang Bayan of Manticao in session assembled: Section 1. Preliminary Provisions.

This ordinance is enacted as a matter of promoting livelihood opportunities and equal protection to the fishery sector in the locality, particularly those who anchored a payao in the municipal waters, but which fishes under their payao are harvested by other fishermen, directly or indirectly, employing lawful or unlawful means. Payao was among the fishing devices promoted and granted by the Bureau of Fisheries and Aquatic Resources (BFAR) and the Local Government Unit of Manticao in favor of our fisherfolks association, but had not factually given better opportunities to the association as there were other fishermen who took advantage of catching fishes therein for their own personal benefit. Allegedly, commercial fishing were also catching fishes from the payao anchored by our marginalized fishermen.Likewise commercial fishing alleges that there are marginalized fisherfolk that catch fishes from their payao.

With these facts and circumstances, being prejudicial to the livelihood opportunities of the payao owners, the LGU shall enact ordinance declaring unlawful the catching of fishes directly or indirectly from the payao of another within its municipal waters of which it has exclusive authority and jurisdiction.

Section 2. Definition of terms: As used in this ordinance, the following terms and phrases shall be construed as herein defined : a) RA 8550 ( as amended by RA 10654 )- the Philippine Fisheries Code of 1998. b) Municipal waters- the territorial sea of the municipality which is within 15 kilometers from the shoreline of which the LGU has authority and jurisdiction.

c) Payao – a fishing device with floating raft made up of palm or bamboo with a weighted part anchored in the water designed to attract fishes to standby underneath, thereby giving opportunities to the owner of catching fishes therein through any fishing instrument or paraphernalia. d) Directly catching- catching fishes directly from the payao e) Indirectly catching- employing strategies like the use of buga- buga or superlight to bring the attention of fishes from the payao and catch them.

Section 3. Regulated Acts.

No person shall catch fishes directly or indirectly from the payao of another, without the latter’s permission.

Section 4. Penalty.

The penalty of a fine not less than P500.00 but not exceeding P2,500.00 or imprisonment of not less than 15 days but not exceeding 90 days or both fine and imprisonment at the discretion of the court, shall be imposed upon any person who catches fishes directly or indirectly from the payao of another employing lawful or unlawful means.

Section 5.Effect of Amicable settlement between the owner and the violator.

Amicable settlement between the owner and the accused does not release the latter from the penalty which may be imposed under this ordinance. Such amicable settlement may apply only on separate civil action instituted by the owner against the accused.

Section 6. Accrual of Fines collected under this ordinance.

The fines imposed and collected under this ordinance shall accrue to the LGU. Private claims for damages may be undertaken by the private party through the filing of a separate legal action.

Section 7. When the means employed in violating this ordinance is also punishable under RA 8550 as amended.

In cases whereby a violation under this ordinance also constitutes a violation under RA 8550 as amended by RA 10654, a separate action shall be filed against the violator of this ordinance which shall run independent of the other actions.

Section 8. Dismissal of action under RA 8550 as amended.

This ordinance penalizes only the act of catching fishes directly or indirectly from the payao of another without the latter’s permission, notwithstanding the means or strategy employed by the violator. Hence, in the event the case filed under RA 8550 as amended is dismissed without prejudice of other actions, the action filed under this ordinance shall proceed.

Section 9. When the violator is also liable under separate Municipal Ordinance.

In cases whereby a single act or in the same series of transaction or events, the violator of this ordinance also violates a separate Municipal Ordinance, the actions shall be filed separately. However, actions for two separate violations may be joined by motion or upon order of the court.

Section 10. Separability Clause.

If any portion of the provisions of this ordinance may be declared invalid by the court or any competent authority, the portion not affected therby shall remain in full force and effect.

Section 11. Repealing Clause.

Ordinances or resolutions contrary to the regulatory provisions of this ordinance are hereby repealed or modified accordingly.

Section 12. Effectivity.

This ordinance shall take effect 15 days after publication in newspaper of general circulation.

WHEREAS, based on police reports, there are minors who are involved in robbery or theft in the locality; WHEREAS, there are minors who committed it in their own will or discretion, or being induced or in conspiracy with adults; WHEREAS, commonly stolen by minors in the locality are scraps, electrical materials, coconut, banana, grocery items, fighting cocks and other things of value; WHEREAS, there are minors who sell personal or movable property of their parents without the knowledge or consent of the latter; WHEREAS, there are persons who buy anything of value from minors although they have personal knowledge that the thing to be sold by or proceeds from robbery or theft; WHEREAS, the LGU shall exercise its police power to regulate the rights of buyers of anything of value from minors without prejudice to existing laws; NOW THEREFORE, on motion of Councilor Jaycel C. Macquinto severally seconded by the members of the Council, it was; RESOLVED as this body hereby resolved to enact an ordinance to wit: AN ORDINANCE PROHIBITING A PERSON FROM BUYING ANYTHING OF VALUE FROM MINORS WITHOUT WRITTEN AUTHORITY FROM HIS PARENT OR GUARDIAN AND PENALIZING VIOLATORS THEREOF BE IT ENACTED by the Sangguniang Bayan in session assembled: Section 1. Title . This ordinance shall be known as BUYERS BEWARE, WHAT MINORS WILL SELL” .

Section 2. Preliminary Provisions.

This ordinance is enacted as a deterrence of theft and robbery incidents in the locality of which minors are involved either in their own will or discretion or being induced or in conspiracy with adults. The act punishable under this ordinance is only the act of buying anything of value from minor individual who has no written authority to sell from his parent or guardian. In case the minor is an orphan and living in his older brother or sister who is of legal age, they shall be considered as guardian for purposes of this ordinance. Robbery or Theft committed by minors are not within the jurisdiction of this ordinance though such criminal act is the reason of which this ordinance is enacted. This ordinance penalizes the buyer only, exempting the minor in all circumstances, subject to the applicable provisions of RA 9344, otherwise known as “The Juvenile Justice and Welfare Act of 2006” as amended. Prosecution under this ordinance shall proceed independently from a criminal action under PD 1602, otherwise known as the “ Anti-Fencing Law” and other criminal action under the Revised Penal Code or a civil action or both as the case may be.

This ordinance applies even if the minor or buyer or both are not residents of Manticao. It is sufficient that the act of buying is committed within the jurisdiction of this municipality.

Section 3. Definition of Terms.

The following terms shall mean as herein defined.

a.) Minors – a person below 18 years of age. b.) Conspiracy – when two or more persons come to an agreement concerning the commission of a felony and decide to commit it. c.) Good Faith – without malicious intention in committing a particular act. d.) Bad Faith – with malicious intent. e.) Induced-motivated or influenced by an adult to commit theft or robbery.

Section 4. Regulated Act. No person shall buy anything of value from minors without written authority from his parent or guardian.

Section 5. Separate Action Against the Buyer under the Revised Penal Code and PD 1612.

A buyer who is guilty under this ordinance on the ground that he has personal knowledge that the thing sold by minor derived from Robbery or Theft, may be prosecuted simultaneously under PD 1612 otherwise known as the “Anti-Fencing Law”.

Section 6. When the buyer is the one who induced the minor to commit robbery or theft.

In case the buyer is the one who induced the minor to commit robbery or theft and the latter sold the proceeds to the former, the buyer is liable under this ordinance and may be criminally liable as principal by induction.

Section 7. When the buyer has personal knowledge that the thing to be sold by minor derived are proceeds from robbery or theft, but with written authority from the parent or guardian.

In cases whereby the thing to be sold by minor is supported with written authority from his parent, but the buyer has personal knowledge that it derived from robbery or theft, but still buys it, he is in bad faith and therefore, liable under this ordinance.

Section 8. Liability of parent or guardian who issued an authority in favor of the minor to sell stolen items, articles or anything of value.

The parent or guardian who issued a written authority in to his son or daughter who is a minor – to sell stolen item, is not liable under this ordinance for lack of jurisdiction but may be criminally or civilly liable or both under existing laws.

Section 9. Effect of dismissal of a criminal action or when the case is amicably settled by the buyer and the owner.

Except upon order of the court, dismissal of action or amicable settlement between the owner and the buyer, shall not affect the prosecution under this ordinance. It applies even if the victim is indemnified by the parent or by the buyer. It must be noted that this ordinance penalizes the mere buying of anything from minors absent of written authority from his parent or guardian. Any negotiation between the aggrieved party and the parent of the minor or the buyer, does not extinguish the violation and the penalty imposed under this ordinance.

Section 10. Good Faith ; not a Defense This ordinance penalizes the act, notwithstanding any good intention intention of the buyer. It applies even if subsequent to the sale, it appears that the thing sold belongs to the parents of the minor and even if his parents will invoke that such sale is authorized by them orally.

Section 11. Penalty.

Any person who buys anything of value from minors without written authority from his parent or guardian shall be meted the penalty of:

a.) First Offense – a fine of not less than P 500.00 but not more than P 1,000.00 or imprisonment of not less than 10 days but not more than 30 days or both fine and imprisonment at the discretion of the court. b.) Second Offense – a fine of not less than P 1,500.00 but not more than P 2,000.00 or imprisonment of not less than 45 days but not more than 60 days or both fine and imprisonment at the discretion of the court. c.) Third and Subsequent Offense – a fine of P 2,500 with imprisonment of not less than 90 days but not more than 120 days..00

Section 12. Separability Clause.

In cases whereby any part or portion of the provisions of this ordinance may be declared invalid by competent authority, the provisions not affected thereby shall remain in full force and effect.

Section 13. Repealing Clause.

Ordinances or resolutions contrary to the provisions of this ordinances are hereby repealed or modified accordingly.

Section 14. Effectivity.

This ordinance shall take effect after 15 days after its publication.

The Provincial Project Management Office Team headed by PARPO Andre B. Atega facilitated in capturing factual information from the farmer-groups whose proposed project [Abaca Value Chain] are still in project validation stage.

The project covers TUJAKITSAN cluster comprising 23 groups of farmers, beyond TUJAKITSAN cluster, but part of the abaca network, are the Municipalities of RTR and Cabadbaran whose farmer-groups also participated in the Abaca Value-Chain Project.

Planning Officer Annelyn Chan said that the Provincial Management Implementing Team is set to begin the implementation of the program aiming to uplift the lives of the farmers of TUJAKITSAN Cluster.

“Project ConVERGE offers change and hope to farmer-beneficiaries involve in abaca production in the province. It is hope for higher income and change in mindset and attitude from production to value addition. The project is focused on poverty alleviation,” Chan said.

“The Project ConVERGE is a multi-million project funded by International Fund for Agricultural Development (IFAD) under the support services component of the Department of Agrarian Reform.

MOGCHS student bags 1st place in BSP video essay contest

CAGAYAN DE ORO CITY -- A student from Misamis Oriental General Comprehensive High School (MOGCHS) emerged as the winner in the Inter-school Video Essay Contest of the Bangko Sentral ng Pilipinas (BSP) Cagayan de Oro Branch and the Orobankers Club, Inc. Irish Jane P. Acuman

bested 10 other amateur student-filmmakers in the contest with her entry “Prosperity Begins With Savings Money.”

The BSP awarded her the first prize trophy along with P7,000 cash during the BSP Christmas Party held on December 9 in Cagayan de Oro city.

The BSP also named Chester Lois Telleron Tee from Liceo de Cagayan Uni-

versity and Queenie Viel U. Bayong from Laguindingan National High School as the second and third placers, respectively.

Tee’s entry focused on the storyline “Molding Students’ Saving Habits while Bayong entry was titled “Passbook.”

Aside from bringing home a trophy, Tee also received a cash prize of P5,000 while Bayong received P3,000.

Essay Contest was launched this year by the BSP Cagayan de Oro Branch and the Orobankers Club, Inc. to encourage the habit of saving among the youth.

The contest was anchored on the theme “Saving: Molding the Habit (A Student’s Perspective).”

“It’s a unified effort, not a divided one” they came from different families, different orientations. As well as might as I am the one that needs to adjust to them as I am the teacher. Teaching them does not only takes me talking and discussing in front, giving them lessons for the day and then dismissing the class, but yes, there is more to it; there is more to just only discussing to them all about academics, all about what they have to learn and what they need to learn.

Here, in the class, when you have done your part as a teacher, your role and responsibility does not only end there but there is merely more of it, more to it. As an effective teacher, your

pupils should learn what you have taught and they should apply it in their daily endeavors. But should the pupils will not do their part, their role as well then your goal of academic success is not within reach.

In this journey, the school as well, needs the participation of the parents and the community.

When the pupils and the school cannot have the support of the parents and the community then it will bear a different result. We should always remember that the role of the parents is of much importance and significance as they have to mold and shape first their child and children at home; basically, education starts at home.

And yes, definitely, educating our young ones is not a one-man show.

It has a lot of stems and roots and twigs that are significant in the journey to achieving success at school and for their future.

Yes, I, we teachers need everyone else in the community for us to achieve success. I am encouraging everyone to bestow your utmost support and invest for the education of our young ones. We might never know what lies ahead but let us always remember that the greatest wealth one can have that cannot be stolen from us is education, good education. Again, this journey is a unified effort, not divided one.

The participants came from the following high schools: Macabalan National High School, Carmen National High School, Cagayan de Oro National High School, Tablon National High School, Bayabas National High School, Canitoan National High School, Bayanga National High School, Bulua National High School, Kong Hua School, Yumbing National High School, Lapasan National High School, Misamis Oriental General Comprehensive High School (Mogchs) and Puntod National High School; and from the following government agencies: Department of Environment and Natural Resources (DENR) 10, Cagayan de Oro Water District (COWD), Department of Interior and Local Government (DILG), Bureau of Fire Protection (BFP),

DENR – Lanao del Norte and DENR – Camiguin.

Semifinals will be announced at a later date. Regional contests for qualifying rounds is from December 16, 2016 to March 5, 2017. The final rounds and awarding program will be on March 20.

The 3rd Mindanao Journalism Excellence Awards is presented by PHINMACOC recognizes the potentials of writers who are not mainstream media practitioners and thereby encouraging them to use their skills a instrument for development.

Mindanao Daily publisher and president Dante Sudaria said that the project is a towards building better communities and for the betterment of Mindanao.

ACCLAIMED zumba instructor Ron Antonio landed in Cagayan de Oro last Saturday to host another Zayaw for a Cause, zayaw being a portmanteau of “zumba” and “sayaw.”

This was the second time that Antonio held the Zayaw for a Cause in an event that was organized by Arks Wellness Center and co-presented by Mindanao Daily and Limketkai Luxe Hotel at Lifestyle District in Cagayan de Oro City last December 10.

Arks Wellness Center proprietor Anna Strode said all proceeds of the event would go to the Home for the Girls, a shelter for abandoned and abused female

minors in this part of the country.
