President Rodrigo Duterte said he will not release 130 political prisoners before Christmas day unless he receives a signed bilateral ceasefire agreement between the government and the National Democratic Front (NDF) peace panels and witnessed by the third party facilitator from the Royal Norwegian Government, claiming he has “conceded to the communists too much too soon.”

NDF peace consultant: No release, no ceasefire

Filipinos urged: ‘Oppose death penalty’

Filipinos need to unite against the reimposition of capital punishment more urgently than ever amid attempts to “railroad” the passage of the death penalty bill, a ranking Catholic archbishop said.

Archbishop Socrates Villegas of Lingayen-Dagupan said it is a “tragedy” that the proposed measure is being pushed for approval in Congress before Christmas.

“In resisting the threat of the restoration of the death penalty, we cannot be disunited or indifferent.

On this pro-life issue let us truly unite. Come out and make a stand!” said the prelate.

Voting 12-6-1, the bill restoring the death penalty for all heinous crimes hurdled the House justice committee on December 7.

leon Alvarez, one of the co-authors of the bill, said he is confident the measure will be approved by the Lower House by Christmas.

Railroad Rodolfo Diamante, executive secretary of the bishops’ Commission on Prison Pastoral Care, said lawmakers allied with the Duterte administration are “trying to railroad” the passage of the bill.

This was despite the fact, he said, that during the committee hearings the anti-death penalty advocates presented pieces of evidence that the death penalty is not a deterrent to crime, is anti-poor, and violates international agreements. “ The major ity blo c Congressmen just wants it passed, period. And they want it fast as it is among

the campaign promises of the incumbent President,” he said.

Diamante urged those who believe in the sanctity of human life and the dignity of every person to “stand up and resist this railroad attempt to pass this anti-life and anti-poor measure.”

“Let us make a more forceful stand against the death penalty,” he said. “Now more than ever we need to act fast and swiftly to counteract the prevailing culture of death in our society.’

In Pangasinan, Villegas also called on the faithful to join a prayer rally at the Parish of St. Dominic in San Carlos City on December 12.

“I am calling on the God-loving people of the Archdiocese of Lingayen – Dagupan to come together in prayer to resist the treat of the death penalty in our country. The death penalty is contrary to our Catholic moral life,” he said in a circular that enjoined the faithful in his archdiocese to hold a “Prayer Rally for Life” on Dec. 12, 2016, the Feast of Our Lady of Guadalupe.

Addressing the drug trade by killing people, most of whom are poor, will not resolve the problem, Manila Auxiliary Bishop Broderick Pabillo told over 200 faithful during a Mass at Christ the King Seminary on November 8.

“Those who suffer are mostly helpless and poor people,” said the prelate.

Over 5, 000 lives had been lost to the state’s war against drugs just few months into Duterte’s term.

But the drug trade continues to thrive, he said, despite the bloody campaign.

‘Culture of death’ “The culture of death

in the country is creeping,” stressed Pabillo.

Just recently, the House of Representatives committee on justice approved the reimposition of the death penalty.

Fr. Ranhilio AquinoCallangan expressed his opposition to the restoration of capital punishment in a Facebook post on Dec. 2.

The priest said: “There is a fundamental reason that the death penalty should not be imposed… No factfinding proceeding is ever infallible, and when you punish with death you must be infallible.”

If political leaders confuse us more instead of leading us in the right way, we cry out for a satisfying answer through the institutional church.

Modesty will never get them what they actually deserve. Charity and brotherly or sisterly love, as the bible teaches us, are becoming foreign terms.

Moral and human values are badly needed to drive and our energy and vigor in our daily life as we stroll into painful indifference and peppered egoism.

Human Rights violations continue to rise amid peace talks THE worsening human rights violations in Mindanao have been disregarded by the Duterte government despite the unilateral ceasefire of the GRP and his declaration of support to the peace talks.

The relentless military operations of government troops in the rural communities have resulted in the encampment of community schools, extra-judicial killings, harassment and vilification involving community teachers, peasants and lumad leaders of progressive organizations.

These operations are being justified by the Duterte government through the continued implementation of Oplan Bayanihan and in the guise of community peace and development program (COPD).

ists, Lumad teachers and peace advocates in urban centers who incessantly called for the pull-out of military forces in the rural communities. The case of Amy Pond who is on hospital arrest at the Southern Philippines Mindanao Center (SPMC) was the classic example of trumpedup charges perpetrated by military assets. Pond is a teacher and curriculum developer of the Salugpongan Ta Tanu Igkanugon and former Southern Mindanao Coordinator of the Rural Missionaries of the Philippines was arrested in Cebu City last August 19, 2016.

Since July 2016, there are at least eight cases of extra-judicial killings and two enforced disappearances have been recorded. The military personnel from the 39th, 68th, 66th and 46th Infantry Battalions are responsible of these extrajudicial killings occurred in

Southern Mindanao region.

One of these cases, was the killing of environmental anti-mining activist Joselito Pasaporte in Compostela Valley province last October 13. Human Rights have taken a serious beating the past few months.

The sneaky burial of the dictator Marcos was an assault on the thousands of human rights victims of the dictatorship. The unjust detention of more than 400 political prisoners is a continuing human rights violation and a breach of signed rights agreements by the Philippine government.

The militarization happening in the countryside throughout the country, in the guise of development operations, continues to terrorize the people and undermine peace efforts

by the President and the NDFP. Finally, the death toll in the government’s war on drugs is a shocking picture of impunity and police abuse that cannot be tolerated under any circumstances.

Lately, there have been congressional efforts to revive the death penalty. A general with questionable human rights record has been made Chief of Staff of the AFP. Some Palace officials have sent out a trial balloon on the suspension of the writ of habeas corpus. It is with these developments that we call on the people to go out, protest and stand for human rights on December 10. It is with a great sense of urgency that we ask the people to protest.

The Philippine State has been committing these human rights violations under various pretexts; drugs, terrorism, counter-insurgency, peace and development and so on. The abuses are being justified by various pronouncements f rom President Duterte himself.

The Marcos burial is not a mere legal issue because it is a historical, political and human rights issue. The release of political prisoners is not a matter of leveraging in the peace negotiations but a matter of justice long denied. A government that claims to be democratic can never justify the imprisonment of citizens because of their political beliefs,

The government and the MILF, which are yet to conclude the peace process, have a ceasefire agreement, as well as an agreement to work together in the interdiction of suspected criminals and terror groups.

Another lunar show this December People have another chance to see the Earth’s moon up close this December during the last supermoon event of 2016.

“The best time to observe the moon is after 12 a.m.

Wednesday (Dec. 14) but before dawn that day while it is still dark,” said Dario dela Cruz, chief of astronomy of the state weather bureau, PAGASA. Unless cloudy skies prevail, the moon during that period will appear bigger and brighter than usual, dela Cruz said.

The moon then will still be hours away from being a full moon at 8:06 a.m.

he said.

The distance of the moon from the Earth then will not be the perigee or nearest, which for this month is 358,564.36 km. at 7:29 a.m.

Supermoon is the word astrologer Richard Nolle reportedly coined at about 1979 to describe the occurrence of either a new or full moon that is coming within 361,524 km. or 90 percent of its approach to Earth.

The National Aeronautics and Space Administration (NASA) said that at present, supermoon already broadly refers to a full moon that is closer than average to Earth.

The moon reaches its perigee and is closer to Earth at certain times as, according to NASA, the

former revolves around the latter in an elliptical orbit.

Dela Cruz noted that the moon this early Wednesday can still be considered a supermoon since it is already nearing full moon state and is at closer-than-usual distance to Earth.

“For this December, it will be difficult to view the moon at perigee on Tuesday and when it becomes a full moon on Wednesday since both will occur during daytime,” he said.

He said if weather is favorable, however, people can still view the moon’s expected distinct appearance during pre-dawn hours on Wednesday.

According to NASA, a supermoon can be as much as 14 percent bigger and 30 percent brighter than a full moon at its apogee or farthest distance from Earth.

ban lights can however mask such increase in the moon’s brightness, NASA noted.

This month’s supermoon won’t be as big and bright as it appeared last Nov. 14, dela Cruz clarified.

“The supermoon last month was closer to Earth,” he said.

PAGASA said the moon then was only 356,621.66 km. from Earth, the closest distance since January 26, 1948.

“The moon won’t be seen this close to Earth again until Nov. 26, 2034,” PAGASA noted.

Earlier, dela Cruz allayed fears about the occurrence of supermoons, citing the absence of scientific basis supporting beliefs surrounding these events.

“Supermoons are normal astronomical occurrences,” he said. Except for some above-average tidal rise due

to the moon’s closeness to Earth, he said the occurrence of supermoons has no adverse impact.

Among the beliefs associated with supermoons are the kindling of lunacy among these events’ viewers and the onslaught of long-term problems from altercations during these celestial occurrences.

Battalions and AFP Special Forces have continue to wreak havoc in Manobo, Talaandig, Mamanwa and Banwaon communities. These military forces used and encamped in community health centers, barangay hall, day care centers.

Meantime, a total of 426 political prisoners continue to languish in jail. They are political dissenters and activists who have been slapped with false criminal charges or whose political acts of rebellion have been criminalized. While a majority of them were detained under the Arroyo and Aquino regimes, they will certainly serve as the Duterte government’s “prisoners of conscience” if they continue to suffer the injustice of wrongful detention. President Duterte had been correct in offering a general amnesty for these political prisoners but it is apparent that sections in the AFP leadership are in vehement opposition to this sincere move on the part of the president.

Moreover, the appointment of the newly installed Armed Forces chief Lt. Gen. Eduardo Año who is known to the aggressive arrests and killing of the members and leaders of progressive organization including Jonas Burgos is likewise seen to aggravate the rising number of human rights violations.

We urge President Rodrigo Duterte as the Commander in Chief of the AFP to rein in his military forces against its utter disregard and sabotage of the ongoing peace process. The continuation and intensification of Oplan Bayanihan clearly promotes the legacy of the dreaded Aquino Regime which left a trail of blood spilled by activists, rights advocates, and community leaders.

President Duterte should not squander his political capital by pandering to rightist and hawkish forces in his administration. He should realize that his antiimperialist rhetoric should translate, among others, into the scrapping of Oplan Bayanihan which had been patterned after the 2009 United States Counterinsurgency Guide. Oplan Bayanihan stands opposite to a just and lasting peace!

We demand to President Duterte to uphold previously-signed agreements in the GPH-NDFP peace negotiations. The breakthroughs he has made in the peace process must be sustained by remaining sincere, desisting from laying down preconditions, and, as he had promised, keeping his ears on the ground.

The deployment of troops in civilian communities cannot be justified by saying the State has the right to deploy troops wherever it wants. The rising drugrelated-killings – whether by police or so-called vigilantes – cannot be justified

by Duterte’s “war on drugs.”

The President keeps saying that we cannot build a nation on the bones of dead Filipinos. Yet the bones keep piling up. The death toll keeps rising and there are no indications that the abuses will stop.

We have supported the President’s initiatives in asserting national sovereignty, resuming the peace talks and implementing propeople reforms. However, we will not countenance and we strongly denounce his stance on many human rights issues.

Our protests on December 10 are addressed directly to him as Chief Executive and Commander in Chief.

He has to stop the killings.

He has to end the militarization of the countryside.

He must release all political prisoners as a matter of justice. He should not aid in the rehabilitation of the Marcos family and pave the way for their return to power.

The President must listen to the people, not the generals, big business, multinational corporations, opportunist politicians, corrupt justices and other vested interests.

In a statement on Friday (Dec. 9), NDF peace panel chair Fidel Agcaoili said Duterte’s latest pronouncement is “disturbing and disappointing, being a complete turnaround” from the commitments he made to him and NDF consultants Benito and Wilma Tiamzon during a dinner at the Legaspi Suites in Davao City on December 2 “where he categorically committed to pardoning 40 convicted political prisoners and releasing 130 sick and elderly political detainees before Christmas.”

Monday, December 12, 2016 Duterte said the political prisoners are his aces and if the NDF keeps asking for more prisoners to be released every meeting, it will be like playing a poker game. “Maubos ang baraha ko. I-release ko lahat yan, ano pa ang pag-usapan namin?” (I will lose all my cards. If I release all of them, what will we be talking about?), he said.

He said he wants a document from the government and NDF peace panels with the Norwegian facilitator as witness, “that there is an agreement for a ceasefire for an indefinite period until such time that we can sort out things…”

Agcaoili said the President’s branding of the political prisoners as “all NPA” is a “rash accusation” that “betrays his adherence to his predecessors’ policy and practice of detaining political prisoners on the basis of trumped-up criminal charges and using them as hostages to leverage and pressure the NDFP into an indefinite ceasefire or negotiated capitulation.”

He said Duterte’s allusion to the peace negotiations as a high-stakes poker game is “deplorable, as it tragically leads to the inhumane treatment of close to 400 political prisoners as trump cards and the callous sweeping aside of justice by his deft playing hand.”

The government facilitated the release of 22 political prisoners who are serving as NDF peace panel consultants shortly before the start of the first round of formal peace talks in Oslo, Norway in August.

Since the Duterte administration took over on June 30, the two parties have had two rounds of formal peace negotiations. Each party has declared a unilateral ceasefire in August.

They were supposed to have come up with a bilateral ceasefire agreement in late October but no agreement has been forged.

“I do not want a war with anybody. I do not want to kill…I am tired of killing. Tapos na ako niyan,” Duterte said.

Later at the 7th anniversary of the Federalismo Alyansa ng Bikol, Duterte said he engaged in a long debate with the government peace panel on the matter of the release of 130 political prisoners.

“Ang sabi ko (I told them) ‘No, I will not give it to you. Mauubusan ako ng baraha’ (I will lose my cards). By the time … we have the grand finale…. wala na akong baraha (I won’t have any card). ..‘I have conceded so much too soon.’ That’s about it,” Duterte said.

But Duterte said he would release the 130 prisoners if he receives a signed ceasefire agreement.

“Give me a ceasefire agreement … and I will release the 130” (I will release the elderly and the sick first), he said, adding many of these detainees

are 70 years old and are no longer physically fit to take up arms “pero ‘yung mga hardcore na mga NPA fighter, kalokohan yan…”

Agcaoili said Duterte’s “rash accusation” that the political prisoners are all NPA members is in “gross violation” of bilateral agreements such as the Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law (CARHRIHL) signed on March 14, 1998 and the Joint Agreement on Safety and Immunity Guarantees (JASIG) signed on February 24, 1995, which his administration has reaffirmed.

As a former prosecutor, Duterte “knows that the criminalization of political offenses violates Philippine and international jurisprudence as well,” Agcaoili added.

Thirteen political prisoners have died while in detention, 12 under previous administrations and one under the Duterte administration – the 66-year old Bernabe Ocasla who passed away on November 28.

“What brought about President Duterte’s change of heart in just a matter of days is for him to answer to the Filipino people, especially the families, relatives and supporters of the political prisoners whose hopes and trust in his word are fast eroding,” Agcaoili said, adding he can “still redeem himself in their eyes” if he “makes good his word of releasing all of the close to 400 political prisoners soon after a bilateral ceasefire agreement is signed.”

“His own pronouncements that he can release political prisoners within 48 hours belie previous statements by the OPAPP (Office of the Presidential Adviser on the Peace Process) and GRP peace panel that they have been working in earnest for the release of 50 to 200 political prisoners but that the judicial processes require some time to effect the release,” he said.

He said the NDF had announced it would sit down with the GRP peace panel and work on a bilateral ceasefire accord “and have it ready for signing by the third week of January by the parties’ respective principals.”

He explained that the bilateral ceasefire “can take effect in 48 hours, the timeframe within which the President said he would order the release of all the political prisoners.”

Agcaoili reiterated that NDF’s stand on the release and amnesty of political prisoners “as a matter of justice and compliance with agreements,” noting it will serve as impetus to a more stable ceasefire and vastly improve the atmosphere for negotiations on socioeconomic reforms.”

The third round of formal peace talks has been scheduled for January 18 to 25 in Rome.

He said Duterte has already announced the release, but made a turnaround recently.

“We have always honored our agreement with the government. We expect the government to do the same,” Mapano said in an interview Saturday.

He said the political prisoners deserved to be set free as most of them are in jail due to trumped-up charges and many of them are already suffering from illnesses.

He said Duterte’s pronouncement has put the political prisoners, who are now waiting to be released, at a disadvantage.

According to the human rights group Karapatan, there are 401 political detainees in various prisons in the country.

Karapatan noted that of the 401 prisoners, 130 are sickly, 33 are elderly, 33 are women while 49 have been imprisoned for more than 10 years.

During the term of former President Benigno Aquino III, about 296 of them were illegally arrested, while 15 were imprisoned under the present administration.

They noted the Heede study is of “serious importance and consequence to the Philippines due to the country’s high vulnerability to impacts of climate change.”

According to experts, such impacts are increasing onslaught of extreme weather events as well as sea level and temperature rise.

“We must think out of the box on how to exact accountability for climate change,” the petitioners’ legal representative Grizelda MayoAnda said at the press conference.

She cited the petition against carbon majors as an opportunity to explore ways of exacting such accountability.

CHR’s hearing on the petition could also pave the way for policy reforms that will help protect the public from climate change, she said.

Fossil fuel use isn’t cheap as this has adverse effects on public health, the environment and climate, she noted.

“Our development perspective must change and be more attuned to the times,” she said.

About 20 of the carbon majors already filed before CHR and other venues respective responses to the petition, Cadiz said.

“The responses varied - some were cooperative while others questioned CHR’s jurisdiction to hold the inquiry,” he noted.

Cadiz also said CHR approved the petitioners’ motion for additional time to prepare their consolidated reply to such responses.

They have until Feb. 14 next year to submit the consolidated reply, he noted.

A11 “We want to give as much leeway for submitting what will facilitate resolution of issues raised in the petition,” he said.

CHR is open to giving the carbon majors the opportunity to prepare a corresponding consolidated reply if these companies want to, he continued.

“We can possibly give such respondents a month to submit that,” he said.

Government has not yet ruled out use of fossil fuel in Philippine power production but Greenpeace Southeast Asia Executive Director Naderev Saño remains optimistic about CHR’s hearing on the petition.

“We realize the political realities surrounding the case but welcome CHR’s national inquiry into the matter,” he said at the press conference.

Cadiz said CHR would set a pre-inquiry conference next year so the petitioners and carbon majors could identify issues to be tackled during the hearing.

He said after both camps agreed on issues to be tackled, other details pertaining to the hearing would be discussed next.

The hearing could take about six months, said Cadiz.

“Hopefully, we can already have a resolution of this case by December next year,” he said.

Such resolution could be a highlight of the annual global observance of Human Rights Day (HRD), he added.

The Namnama bridge, which is classified as a provincial bridge, was among the three bridges traversing the Marbel River in Koronadal City that were damaged by the floods in the area on June 24 last year.

The bridge’s center foundation and three-slab flooring totally collapsed, requiring the construction of a new 60-meter structure.

“The reconstruction of the bridge was made as a top priority at is considered a high-impact infrastructure that will directly help a lot of people in the area,” Tamayo said in a statement.

The rebuilt structure is a “60 linear meter pre-stressed concrete girder bridge with two spans at 30 meters each, resting on bored piles” traversing the Marbel River in Barangay Namnama.

The project, which started last June, has an approved budget of P70 million but the winning bid made by the contractor, Gemma Construction Corp., was only P60 million.

The bridge, which is within the Koronadal-Columbio road, connects the center of Koronadal City to three outlying farming barangays — San Jose, Namnama and Avanceña.

The road also leads to several barangays and the centers of the municipalities of Lutayan and Columbio in Sultan Kudarat.

Koronadal City is the regional seat and center as well as among the key commercial centers of Region 12.

Tamayo described the bridge as an “essential permanent link” towards the city proper of Koronadal.

“It is very beneficial to residents in the area, especially to to farmers and local commodity vendors,” he added. (MindaNews)
