Oro police official, aide slap with ‘direct bribery’

CAGAYAN de Oro City––A charge of direct bribery has been filed against a ranking police officer and his aide here who were nabbed by National Bureau of Investigation agents last Monday in an entrapment operation.

City prosecutor Fidel Macauyag said traffic division chief Supt. John Michael Deloso and PO3 Ernesto Galleto were named respondents to the case.

Macauyag said the original complaint from lawyer Ernesto Palanan was for robbery with intimidation but “we found the proper charge is direct bribery.”

He said this is because of “receipt of money in consideration for refraining from responsibility of a public officer.” Palanan, president of the Xavier Heights Jeepney Operators and Drivers Association, alleged that Deloso and Galleto had been “demanding money” from their group so that the members would not be “apprehended” for traffic offenses. Macauyag said the respondents could face a penalty of from 4 years and 1 day to 8 years imprisonment if found guilty as charged.

He said the case falls under Article 210 of the Revised Penal Code. Deloso and Galleto were arrested in a hotel during the entrapment operation involving the giving of cash money placed in envelopes totalling P6,000.

out monthly recognition by awarding personnel and unit for their accomplishments.

The award-giving is an initiative of the new Police Regional Director to boost the morale of every police-

man and units in Northern Mindanao.

Last Monday (March 17), Misamis Occidental Provincial Police Office (MOCPPO) received a Plaque of Recognition

from the regional chief for conducting the most number of operations against illegal drugs among PPOs and CPOs for the period January to February, 2014.

In the regional office record of accomplishment, MOCPPO conducted a total of 24 operations, resulting in the arrest of 31 persons and confiscation of 14.08 grams of shsbu and 0.16 grams of dried marijuana leaves and the filing of 31 cases in court.

OIC-provincial director Sr. Supt. Archival Macala thanked his men fr the accomplishments and reiterated that his command will certainly strengthen its campaign against the proliferation of illegal drugs in Misamis Occidental.

Council okay’s expansion of Aboitiz coal powered plant

AVAO City - The Davao City Council approved an e w on Tu e s d ay t he expansion of the generating capacity of Aboitiz’ Therma South Incorporated (TSI)’s coal-fired power plant up to 650 megawatts.

The approval came amid concerns raised by some councilors regarding the impact of carbon emissions from coal plants.

Only two councilors, l aw yers L e a h L ibrado and Antoinette Principe, voted against the proposed expansion.

Therma South, a subsidiary of the Aboitiz Power, was approved by the city council in 2011 to build its 300-MW coalfired power plant located in Binugao, Toril that will begin operations by 2015. The approval came am i d s t opp o s it i on by environmental groups on the long-term effects of coal on health and on the environment.

But three years later, the company has proposed doubling the generation c ap a c i t y t o m e e t t h e projected power shortage in Mindanao.

President for Mindanao Affairs of Aboitiz, told reporters later that their projections in 2011 fell short.

“When we applied in 2011, the shortage of power by 2014 was projected at 484 MW. We had built the plant already but the DOE study said (the supply) is not enough by 2018. We decided that to help Mindanao’s problem in the past where there is not enough power plants to meet the demand, we proposed to build the plant.”

TSI would operate the expanded plant’s first unit generating 172.5 MW by 2017, and the second batch by 2018.

“We are confident that brownouts will become a thing of the past in Davao,” Orig said.

Orig earlier told the council their company “guarantees” the public they will meet the standards of carbon emissions set by government with the use of latest technology such as circulating fluidized bed and electro-static precipitator to trap coal emissions.

He claimed that they can monitor their carbon emissions “in real time.”

and Medium Enterprises (MSMEs) of priority clusters all over the country.

“The SSF project aims to improve the quality and productivity of MSMEs and give them access to better technology with more sophisticated equipment in order to accelerate their bid for competitiveness and help them graduate to a next level where they could tap a better and wider market,” he said.

It is a public-private partnership (PPP) initiative which is being implemented through private sector partners who can provide facilities to house the machinery and equipment.

The councilor found out from Aboitiz’s Assistant Vice President for Environment Soccoro Patindol that the company had complied only 25% of planting onemillion trees targeted by the company to absorb the carbon emissions.

“With 25% compliance (on tree planting) and the plant due to start next year, how will you assure ….

That’s a long, long way to go,” Acosta asked.

Patindol said Aboitiz has planted 1,000 trees in Marilog, and is targeting other hinterland areas such as Kiboloy, Baricatan, and Paquibato. She said they are also planting mangrove trees as these have higher capacity to “sequester” or absorb carbon emissions.

Orig said their treeplanting is right on schedule.

He also said that with the additional 345 MW plant, they are committed to plant a million more trees.

But Acosta proposed to add on the resolution requiring Aboitiz to plant trees yearly instead to help mitigate the impact of carbon emissions.

Councilor Diosdado Mahipus challenged the company to set a timeframe on when will the company cease its coal-powered plant, citing that European

countries had closed down their coal powered plants due to issues on excessive carbon emissions.

“The determining factor to tell you if there is a need to continue generating power from coal plants is the demand for power and the supply for power. Question is where would you get the supply for power to meet the demand. Right now we are using as much renewable energy from geothermal and hydro-powered plants, but renewable are not enough,” Orig said.

Salvador-Abella proposed the establishment of an ecological landscape plan that will have a design or system in the plant area that would include tree planting and coastal planting with mangroves.

But Councilor Antointette Principe is not convinced with the mitigating measures.

“I will not discount the mitigating measures; the TSI had efforts to put up such counter-measures.

But I c annot sle ep at night thinking about coal.

Because there is no such thing as clean coal, coal is still coal,” she told reporters after the session.

Principe said the country

should protect and explore renewable resources as alternatives.

There are other sources, if we can protect our natural resources; Ilocos Sur has wind energy, why can’t we explore that,” she said.

She and Librado said their vote hinged on a legal doctrine they learned from the Supreme Court about “inter-generational responsibility.”

“Our generation has the responsibility to protect the environment for the future generations to come. My vote is hinged on being a lawyer, legislator, and importantly as a mother,” Principe said. (davaotoday.com)

BIR 2014 tax campaign kicks off ILIGAN City – The Bureau of Internal Revenue (BIR) kick off the nationwide 2014 tax campaign today, March 18, 2014 in Iligan City with a motorcade at 9 a.m. starting from the new BIR building at Pala-o and ending at Gaisano City.

Around 200 stakeholders, professionals and tax payers participated in the activity. The tax campaign has as theme: I pay my taxes right. Its easy to register, file and pay. Do you look at the packaging date of the goods you buy?

You could be buying a poisonous food product if you do not carefully read its expiry date, or worse, if it has no label that contains packaging date.

By law, notices of packaging dates for fresh or processed meat, seafood and poultry in all retail food stores nationwide should be clearly visible to any consumer. But many businesses are not practicing it, especially in open food markets where such products have no package labels.

The government should seeks to protect consumers from deceptive, unfair and unconscionable sales acts and practices.

Good that a lawmaker has proposed a bill which will compel all retail food stores that offer for sale fresh or processed meats, poultry or seafood to post a sign or notice clearly visible to any consumer inspecting such product.

The sign or notice, according to the measure, shall be

Act now Cebuano Sen. Sergio “Serge” Osmena III warns of a power crisis by 2015 and blames this on the Aquino administration’s failure to address this concern since it assumed office.

But the Palace response that those who are painting a bleak power situation in the country are doomsayers is misplaced. And I don’t consider Osmena’s warning as coming from a doomsayer the fact that Mindanao is now experiencing rotating brownouts with Visayas facing the same prospects soon.

Yes it’s true that Osmena is close to the Aboitizes of Cebu who are into power generation and distribution business because one of the clan’s scions is married to a cousin of his. It is true also that Osmena himself is married to a Lopez scion, a family known for its involvement in the power generation business and was into power distribution as well in the past until the Pangilinan Group bought Manila Electric Co. All these facts, however, do not alter the fact that the power situation in the country is in a dire situation.

The situation is a repeat of what had happened during the last two to three years of the first Aquino presidency.

The son P-Noy is truly not learning any lesson from her mother’s presidency for still he did not do anything to avert this power crisis that is not just looming but happening already. And only fools refuse to learn lessons from history, if I may add.

Osmena’s goat against Energy Secretary Jericho Petilla, a former Leyte governor, is said to be triggered by the latter’s failure not only in preventing this power crisis but in his inability to push with less opposition the latest round of power rate increases. The latest increase that was ordered temporarily frozen by the Supreme Court and was eventually voided by the Energy Regulatory Commission will undeniably benefit the Aboitiz and Lopez groups.

Personally, however, I look at all the innuendoes against Osmena merely as smokescreen to protect the failure of the Aquino administration to address this vital concern. It is the Aquino administration that gave Osmena the argument and the ammunition to accuse it of bad governance.

Mindanao’s rotating brownouts proves beyond doubt that the Aquino administration is a big failure in seeing to it that there’s ample power supply for the entire island. Is this not what the Aquino administration is sworn to do?

Sadly, it failed to do what it is sworn to do for no the other reasons but incompetence as what Osmena it of.

In this regard, I fully agree with him, and perhaps the millions of Mindanaoanons made to suffer because of the current rotating brownouts in the island.

The economic growth rate we experienced last year that is still being sustained up to this point will end for sure in a bust without power. When this happens, there is no one to blame but Aquino for lack of foresight.

This administration has consistently shown that it is allergic to criticisms even those that can be considered constructive. If it is truly sensitive to criticisms then it should shape up and do those that are good for the people.

Running after the corrupt, haling them to court and even sending them to jail is good. Abolishing in the minds of those who wield power whether economic or political the wangwang mentality is good. Not being corrupt

himself is likewise good.

But as President, he is mandated to solve the multifarious problems of the State. The power crisis is one of them. Solving this problem is very compelling because it’ll bring the economy down if it remained unaddressed.

In a previous column I said that good intentions on the part of Aquino are not enough for him to become a good President. While good intentions may make him as it is actually making him better than his predecessor, he needs to do even more and do them fast.

He should not leave a legacy that will only leave him sneered at by his bosses, the people. Playing partisan politics even up to this point of his presidency is one of them. Not prioritizing the legacies to leave like ensuring that the country is not plunged into darkness at the end of his term is another.

To end his term either a boon or bane to the nation is a decision he alone will make.

Coupled with the many world records, listed by Guinness, that the INC has been accomplishing especially in the areas of helping the poor and the needy, and in chalking up the most number of churches around the world, Pangan’s performance in the bar is another illustrious feather in the INC’s cap. So, congratulations Pangan, congratulations UP Law, especially to Dean Danny Concepcion, and congratulations INC.

-oooTHE WEAK VS. THE STRONG: What is more, Pangan’s “low” standing at the UP College of Law and his topping the 2013 bar has Biblical precedents.

In 1 Corinthians 1:26-29, the Bible is saying that the lowly and the humble are chosen by God to shame the rich, the powerful and the mighty. In part, this verse says: “…But God chose the foolish things of the world to

-oooNEWS STORIES ON MEDIA PAY-OFFS UNFAIR: With due respect, it is totally and grossly unfair to be saying, at this point, that pay-offs had been made to prominent media personalities out of the pork barrel funds of lawmakers which were allegedly diverted to bogus or non-existent nongovernmental organizations.

The point is that, if the programs or columns of mediamen were tapped to publicize the work of the NGOs, then it is the right of media to be paid. The word “pay-off ” suggests an under-the-table changing of money, which means that money was paid to mediamen either to kill a news story or distort the news. I am sure that, this was not the case with the broadcasters who are being named now as among those who received money from pork barrel.

Beng hopes UN extends Zambo aid

AMBOANGA City - The City Mayor Beng Climaco expressed hopes that United Nations humanitarian agencies will extend their assistance program for internally displaced persons (IDPs) in Zamboanga City saying that the city is not yet capable of being fully independent at this time.

This, as Climaco leads government representatives in a meeting with UN humanitarian agencies Tuesday, March 18 for an assessment, revision and possible extension of the Zamboanga Action Plan (ZAP) 2014.

Climaco said the assess-

ment of the ZAP is aimed to continue response to cluster needs and gaps for the remaining IDP families in evacuation centers, transition sites and host communities in support of the City Government’s long term plan for siege victims.

Nevertheless, she said, the city government along with national government agencies will have to prepare, as sooner or later, the city will be left on its own to tend to the needs of the victims of the September siege.

“With our without the UN assistance, we need to work well and do our work well,” she added.

MNLF leader endorses Duterte for president

AVAO CITY – A leader of a Moro organization here said that there is still hope for peace in the country if the “corrupt government” will be headed by Davao City Mayor Rodrigo Duterte.

“I hope he accepts the challenge to be the country’s next president. He can put our country in order,” said Moro National Front of the Philippines (MNLF) Davao City Chairman Orlando Olamit.

MNLF members marked the 46th year anniversary of the Jabidah masscre at the Rizal Park Tuesday.

Jabidah was the commando unit created by the Marcos government for its Operation Merdeka.

“What happened was that our brothers were forcibly conscripted to fight our other brothers (in Sabah) and when they refused they were massacred,” said Olamit.

The massacre fueled

the Moro rebellion in the 1970s and gave birth to the founding of the MNLF by Nur Misuari.

Duterte earlier said he will consult with Misuari should he decide to become a presidential candidate in 2016.

Meanwhile, Suara Bangsamoro, Liga ng Kabataang Moro (Leagu of Moro Youth) and Moro human rights group Kawagib led a protest in Tantawan Park in Cotabato City to commemorate the massacre.

In a statement sent to the media, Suara Bangsamoro Spokesperson Jerome Succor Aba said that “Ang paggunita sa araw ng Jabidah Masaker

Transport group opposes Urban Sustainable Transport Project in Davao City DAVAO City - A Filipino transport and drivers' group called Transmision Piston-Southern Mindanao have protested Tuesday the Urban Sustainable Transport Project being pushed by the government through the so-called public private partnership.

The group said the project would not only have a serious impact to public transport drivers, but will also affect the poor majority here. Transport drivers have been steadily protesting the project.

But according to the Asian Development Bank which is involved in the project, there is a need for a sustainable transport system in Davao City.

In the project rationale, it said: "Strong economic growth has generated rapidly growing demand for travel within urban centers such as Davao. Worsening congestion, higher travel times and costs, deteriorating local air quality, and a failing road safety record are all symptoms of a transport system under pressure. Sustainable urban transport systems have modern, efficient, and affordable public transport services at their core."

"Public transport is the main mode of transport in Davao, accounting for 80% of trips. The public transport system has tricycles primarily for short trips and jeepneys, or multi-cab vehicles for longer distances within the city. Regulations governing Davao s public transport system are outdated, the city lacks an effective transport masterplan, and institutions responsible for managing urban transport presently do not coordinate their planning and enforcement. Current public transport routes, the coverage area, connectivity, and the frequency of service are poorly planned and fail to provide satisfactory service."

35 illegal structures in Lake Sebu demolished GENERAL SANTOS CITY — Environment workers in South Cotabato province have demolished an initial 35 illegal structures in parts of Lake Sebu as part of the continuing massive cleanup of the critical lake.

Lake Sebu Mayor Antonio Fungan said among those demolished were resort cottages, fish cages and other structures situated in the initial 20 meters from the lakeshore and those located near the outlets of the lake.

He said the demolition team, which comprised personnel from the municipal government and the Provincial Environment Management Office, also destroyed several shanties that were illegally put up along the lake.

The structures were demolished for violation of the provisions of the municipal revenue code, which sets the proper use of the lake waters and resources, he said.

“The demolition activities are presently ongoing and we will not stop until we finally clean up the lake of these illegal structures,” the mayor said in a radio interview.

The demolition team launched the cleanup of the illegal lake structures two weeks ago based on an order issued by the municipal government and the provincial government of South Cotabato.

Fungan said they initially scheduled the start of the demolition last January 20 but was eventually deferred until February 11 based on a request from the affected sectors.

He said they approved the temporary suspension of the demolition or cleanup after local fish cage and resort operators promised to demolish their illegally-built structures themselves.

The mayor said that prior to the start of the demolition activities, the affected fish cage and resort operators asked for another stay until June supposedly to give them enough time to self-demolish.

Macauyag said the Crimindal Investigation and Detection Group has named Dongon as a suspect in the Maxandrea bombing in October 2012 and in the Limketkai bombing in July 2013.

He said the CIDG included Dongon when it refiled the case of the Maxandrea bombing “this time with witnesses pointing to Dongon as one of the four guys who caused the bombing.”

Macauyag said the Maxandrea is expected to be resolved by April.

The CIDG also included Dongon among the additional respondents to the Limketkai case but Macauyag said there are “no witnesses pointing to Dongon” in this incident.

Some 30 additional respondents who are allegedly members of Khalifa Islamiya Mindanao were included by the CIDG in the Limketkai bombing case against a certain Usman Haphids and John Does.

Macauyag, however, said they still await eviudences to be submitted by the CIDG before proceeding with the case.

He said it was learned that Dongon was arrested in Marawi City last May 2013 “for possession of explosives” but because of “lapses” was later released.

The Limketkai bombing case is pending at the Regional Trial Court Branch 20 although a warrant of arrest has been issued against the suspects.

Statement of Facts and of the Case 9. Peakpower Energy, Inc. (PEI), the mother company of Applicant PSFI sent a letter to the Board of Directors of ASELCO offering to build, operate and maintain an embedded power generation facility within the franchise area of ASELCO which would be aimed at addressing the adverse effects of the current power crisis in Mindanao and to supply the peaking power requirements of ASELCO. ASELCO received and evaluated other power supply offers from other potential suppliers as discussed further below. In the course of the evaluation of the different power supply offers received, the representatives of PSFI made a presentation to the Board of Directors of ASELCO on their power supply offer.

10. As will be discussed further below, ASELCO thereafter determined that the power supply offer of PEI/PSFI was the most advantageous due to the reasons cited below. Thereafter, Joint Applicants commenced negotiations for the execution of the PPTA. After evaluating the foregoing offers, Applicant ASELCO determined that the offer from San Miguel Consolidated Power Corporation and Filinvest Development Corporation would be available only by 2016 at the earliest since their respective coal plants would still have to be built and such would take around thirty six months to construct. Thus, the offers from San Miguel Consolidated Power Corporation and Filinvest Development Corporation would not address the immediate need for additional generating capacity of ASELCO due to the power crisis currently being experienced in Mindanao. Further, the supply offered by both San Miguel Consolidated Power Corporation and Filinvest Development Corporation would come from baseload coal fired power plants while the immediate requirement of ASELCO was for supply during its peak demand hours.

ASELCO also determined that the offer from Lim Solar Philippines was expensive due to the price of the solar panels and the generating unit would use diesel fuel.

26. Initial Delivery Date. The Initial Delivery Date under the PPTA was agreed to be one (1) year from the issuance of the ECC by the DENR for the Power Plant and not later than ninety (90) days thereafter.

ALLEGATIONS IN SUPPORT OF THE PRAYER FOR PROVISIONAL AUTHORITY 53. As stated in the Loan Agreement between PSFI and AUB as lender for the Power Plant, attached as Annex “T” of this Application, Joint Applicants must secure the provisional approval of the PPTA by the Honorable Commission as a pre-condition prior to the drawdown by Applicant PSFI from its loan with AUB; 54. Applicant PSFI has already begun construction of the Power Plant and is scheduled to draw on its loan with AUB by April 2014 in order for the Power Plant to be completed within the period stipulated in the PPTA. 55. Thus, in order for PSFI to be able to comply with its obligations under the PPTA and complete the Power Plant and deliver the Contracted Capacity to ASELCO by the Initial Delivery Date and for the Power Plant to bring relief to the consumers within the franchise area of ASELCO and further to insulate ASELCO from any power deficiency brought about by any power shortage in the Mindanao Grid, it is imperative that a Provisional Authority/Approval be granted by the Honorable Commission pending consideration and approval of the Application. Otherwise, the construction and completion of the Power Plant might be delayed, to the detriment of the security of the power supply of the consumers of Applicant ASELCO. In compliance with the Rules of the Honorable Commission, attached as Annex “V” of this Application is the Affidavit of Roel Z. Castro, President of Applicant PSFI, in support of the Prayer for Provisional Authority.

PRAYER WHEREFORE, premises considered, it is respectfully prayed that the Honorable Commission that: 1. An Order be issued treating Annexes “M”, “O”, “P”, “Q”, “R”, “S” and “T” of the instant Application, as confidential documents and the information contained therein as confidential and directing its non-disclosure pursuant to Rule 4, Section 1 of the ERC Rules of Practice and Procedure and prescribing the guidelines for the protection thereof; 2. Pending hearing of the Application on the merits, issue a Provisional Approval approving the Electricity Fees agreed upon by the Joint Applicants in the PPTA; 3. After full proceedings on the merits, issue a Decision APPROVING the terms of the Power Purchase and Transfer Agreement between Joint Applicants PSFI and ASELCO, thereby authorizing PSFI to charge and collect from ASELCO the Electricity Fees corresponding to the (1) Testing and Commissioning Period, and (2) Initial Delivery Date as contained in the PPTA and authorizing ASELCO to pass the full amount thereof to its consumers.
