THE Supreme Court decision regarding the unconstitutionality of “specific acts” in the Disbursement Acceleration Program (DAP) is a big blow to the Aquino administration. While the 92-page Supreme Court decision appears Solomonic (as most decisions of the High Court are especially if it is critical of government policy), it is, nevertheless, a declaration that the Aquino administration acted clearly well beyond its authority or jurisdiction in determining where and how a substantial amount of government funds would be spent. How substantial? Progressive groups estimate that it is 14 times more than the fund involved in the Napoles scam. The “specific acts” of the Aquino administration with regards the DAP that the High Court declared as unconstitutional are: 1. the seizure of “unobligated allotments” and “unreleased appropriations” of different

FRONT VIEW government agencies and the unilateral declaration of such as savings; 2. the realignment of funds from the executive to other branches of government (which is expressly prohibited by the Constitution); and 3. the funding of projects, activities and programs not identified by the General Appropriations Act. In sum, what the Aquino administration did was an arrogation of the power of the purse. At the same time, the Supreme Court declared that it is within the power of the President to come up with a policy such as the DAP to steer the economy toward growth and development. Did the Supreme Court decision state whether the Aquino administration, specifically Pres. Benigno Aquino III and Budget Sec. Florencio Abad, could be held liable for unconstitutional acts? Fr. THE Rotary Club of West Cagayan de Oro (RCWESTCDO), a premier club of Rotary International District 3870, sets today its joint 45th Handover and Induction Ceremony with the Inner Wheel Club of West Cagayan de Oro and Rotary Club of West CDO Foundation. Slated to be the rotary year’s showcasing of achievements and recognition of Rotarians and partners in rotary service, RCWESTCDO led by its outgoing president Rommel Esquerra and Presidentelect Dante Briones invited no less than Immediate Past District Governor of District 3830 (IPDG) Robert F. Kuan, the founder of Chowking and Chairman of the St. Lukes Medical Center. “All of us are part of the family of Rotary. We have gained so much from our Rotary service. We have made friends, helped our communities and we’ve
become truly a part of international network of volunteers”, quoting a personalized email message from Rotary International President Gary C. K. SC decision declaring DAP unconstitutional hailed MALAYBALAY CITY – Progressive groups in Mindanao today lauded the Supreme Court decision declaring the Disbursement Acceleration Program unconstitutional and urged that all those behind it should be held accountable. In a statement, Balay Mindanaw said it “lauds the courage and independence displayed by the SC in unanimously putting a stop to the abusive, unbridled and immoral use of the people's money.” “Now that the excesses have been exposed and de-
clared unconstitutional, the work towards transparent, accountable and responsible governance has finally been given a chance to succeed,” it added. The SC released Tuesday its unanimous decision on the controversial DAP which was the subject of nine petitions asking the High Tribunal to declare it unconstitutional. Among the petitioners were Bayan Muna, Integrated Bar of the Philippines and the Volunteers Against Crime and Corruption. Petitioners argued that
DAP, a discretionary fund of the President, had usurped the exclusive powers of Congress to appropriate funds. In a text message, Bayan Muna Rep. Carlos Isagani Zarate called the SC decision a “partial victory of the people in the fight against the pork barrel system.” Zarate called DAP a “form of budgetary dictatorship of the Aquino administration that ran afoul with the letter and spirit of the Constitution,” adding, “it exposes the hypocrisy of the administration’s hollow,
selective and even deceptive anti-corruption campaign.” He said Aquino, Budget Secretary Florencio Abad and all those responsible for the DAP should be made accountable, “in the same manner that those involved in the PDAF (Priority Development Assistance Fund) are to be made accountable.” But Cagayan de Oro City Rep. UTUAN City - A mining company in Caraga Region is giving priority to develop human resources by providing education and trainings especially to outof-school youths.

as part of the Corporate Social Responsibility of the company, they are investing on the human capital as they believe that this is the only way where the local residents in Taganaan will be empowered as well as in sustaining the economic aspect of the locality. Aquino said majority of the local residents from the different barangays of Taganaan who have benefited the education and training programs sponsored by the company are out-of-school youths. “Specifically, since 2011, we have regularly supported trainees of Alternative Learning System (ALS) of t he D e p ar t me nt of Education (DepEd) and the Technical-Vocational Education and Training (TVET) of the Technical Education and Skills
Development Authority (TESDA),” he said. The official added to date, there are already 253 trainees of ALS who have graduated and the eldest of these trainees aged over 60 years old. “This shows that the Hinatuan Mining Company doesn’t mind age, as long as they can read and write,” Aquino said. Aquino said that with the ALS, the company together with the local government unit of Taganaan made sure that the curriculum set by DepEd was followed, while Hinatuan Mining Corporation is regularly g iv i ng honor ar iu m to teachers. of the island barangays of Hinatuan. According to Aquino, 63 youths are currently undergoing different trainings with TESDA through the agency’s Surigao del Norte Provincial Office. He added the company is not only aiming that these trainees will finish the training but as well as to inculcate in their minds the importance of values formation “for we believe that success is a product of hard work and good values,” Aquino said. Aside from the free tuition, miscellaneous fees, board and lodging and book allowance, Aquino said the beneficiaries were also provided with passport assistance. He explained that since some of the techvoc programs are intended for works that are required abroad such as the shipping industry, they have already prepared the trainees for their future employment abroad. Aqu i n o a d d e d t h at among the skilled works needed in the shipping industry and in abroad is welding where the trainees should undergo assessment not only from TESDA to obtain a National Certificate, but as well as international certifying body such as the American Standard. “To
obtain this, we send them to Davao through the KoreanPhilippine Training Center for the certification,” he said. Af ter re ceiv ing t he American Standard Certification from Kor-Phil Training Center, Aquino said the trainees will be sent to Keppel Batangas for their On-the-Job Training. “Afterwhich, because of the rigid training they’re into, they will now be ready for any employment opportunities both here and abroad,” Aquino said. The official likewise said that to date, around 20 scholars from Brgy. Talavera and the neighboring barangays of San Jose, Kampandan, Silang, and even as far as South Dinagat are in Laguna under the Panasonic company in Sta. Rosa to undergo a 10-month OJT in the field of welding and consumer electronics. Wit h t he re g u l ar assistance that Hinatuan Mining C ompany is offering to the community in the municipality of Taganaan, Aquino said may this serve as a key to eventually change their lives towards economic development which is one of the agenda of the national government. What happened to CARP? The government’s Comprehensive Agrarian Reform Program (CARP) has been abolished last week. Its death was cheered by both farmers and landlords. The farmers, who were supposed to be its beneficiaries, said its death is welcome news because, in the first place, it was a “total failure.” CARP failed to address the problems of landlessness and poverty in the rural areas, Critics say CARP was obviously a mere deception on the part of the landlord-dominated government in cahoots with the big landowners. The landlords, who were supposed to cease control of the lands they do not till, are only too happy that they now don’t have to resort to all sorts of deceptions to survive the program. Why did CARP failed? While CARP has noble goals, implementation of the laws governing it it has been labelled shady. . CARP has been badly im-
plemented from the start. It’s objective to give land to the landless has forced many landowners to declare they are landless too. Critics lamented that CARP has a program that ignored the meaning of what is fair and equitable. People whose lands have already been taken, still were left un paid by the government. Why? Farmers seeking the promise of lands they can tell were ignored by corrupt Municipal Agrarian Reform Officers. Drivers, teachers, OFWs and even their own MAROs were on the priority list but not the landless. Many of these cases were recorded by the Commission bu are still in court. The government, as usual, says the program was a huge success and that it will continue distributing lands to the poor although the CARP has expired. And to justify the continued existence of the
Department of Agrarian Reform that was created supposedly to implement the program and the law . The country’s latest attempt to distribute lands to the farmers and end the centuries- old feudal system in the Philippines was doomed from the start and could not address peasant poverty and landlessness because, in the words of IBON Foundation’s Sonny Africa, “it was never meant to.” Statistics from the Census and DAR revealed that after 26 years, “rural poverty continues to be widespread and millions of peasants still remain landless.” CARP is “not about free land distribution to the tiller, which is the core of a genuine land reform program.” Instead, CARP seeks to provide landlord compensation and require peasant beneficiaries to pay for land that they have been tilling for generations. CARP is essentially a land transaction between landlords and peasants with the government acting as the middleman,. “The revised CARP scope represents a concession to big private landed interests. The target was adjusted downwards to accommodate CARP exemptions. CARP allows landlords to retain five hectares of land and an additional three hectares for each of the heirs. PD No. 27 had a retention limit of seven hectares each. Landlords used these as a loophole, hurriedly subdividing their landholdings and coming out with multiple titles within the limits. Yet the scope of exemptions even broadened far beyond just retention limits. IBON Foundation says that at least 60,000 hectares of land in commercial farms and plantations were exempted from 1988 to 1998 and these remain undistributed even as the deferment period has already expired.

A G AYA N d e O r o City - Aside from its popular pristine, smooth sand, clear water beaches, Medina town in Misamis Oriental is endowed too with a refreshing cold spring, perfect for the hot weather and a trademark Buko Pie, that is slowly but surely getting the attention of foodies everywhere. During its 66th Araw ng Me dina on Ju ly 1, 2014, Mayor Ken Niño T. Uyguangco emphasized that the Duka Bay Resort, is not the only place to get a dip in the town. He introduced the Alibuag Cold Spring, only 3km going up from the municipal hall. He said, what is special about this spring is that the source of its water is actually from its bed, from the bottom. There is no flowing water from the side. It looks like stagnant but
actually there is a current underneath that provides and is the source of water to the area. Even the ground of the pool is not cemented because the water comes from there. Also, huge trees surround the place. People can bring food and eat with family on the cottages which is maintained well by the local government unit (LGU). Uyguangco said that this tourism site is one of his priorities that the provincial government is also supporting. According to him, Governor Yevgeny Vincente “Bambi” B. Emano has set aside P5 million for its improvements. Meanwhile, he is also lobbying additional funding from Tourism Infrastructure and Enterprise Z one Authority (TIEZ A) to
put up more cottages and creation of a function hall to cater to various functions and seminars in the town. Buko Pie of MisOr The Agrarian Reform Community (ARC) Mananum Bag-o Multipurpose Cooperative, a farmer’s cooperative based in barangay Mananum Bag-o in Medina, Misamis Oriental started this Buko Pie venture in 2008 with the abundance of coconut raw material in the area. The technology was introduced by the Kinoguit an National Agricultural High School (KNAS) under t he Department of Agrarian Refor m (DAR) and Te c h n i c a l E d u c a t i o n and Skills Development Authority (TESDA) and developed further by the Department of Trade and Industry – Misamis Oriental
(DTI-MOR). Since then, various assistance ranging from product development to market access and trainings have been provided to the cooperative by DAR, DTI, LGU-Medina and the Office of C ongressman Peter Unabia. The coop is also eyeing on the Food and Dr ugs Administ rat ion (FDA) License to Operate Certification this year or early of 2015 after its training in Good Manufacturing Practices, Food Handlers and Sanitation Standards and Operating Procedures. Judy Aclan of DTI-MOR said that through DTI’s Shared Service Facility (SSF) the coop is provided with an oven, chiller, mixer and kneader which were turned over on April 2014. Exporters urged to address trade concerns on food, liquor, tobacco Philippine exporters especially of food, liquor and tobacco products are advised to address specific trade concerns (STCs) raised by the United States (US), European Union (EU) and Canada to continue serving key export markets. In a report, Ambassador E s t e b a n C on e j o s , Jr. , Phi lippine p er manent representative to the World Trade Organization (WTO), noted the increasing number of STCs during a recent meeting of WTO Technical Barriers to Trade
(TBT) Committee. “Although tariffs had significantly decreased, technical regulations and other non-tariff measures have grown in number, stif ling market access for Philippine exports,” Conejos said. He said the US, EU, Canada and Costa Rica during the meeting raised standards of food safety and food labelling requirements. Likewise, Conejos said the US, EU, Canada and Argentina brought up labelling requirements
and licensing regulations on alcoholic and liquor products. Cuba and Malawi, on the other hand, raised requirements for packaging tobacco products, he added. CANA holds transparency, accountability training in Ipil town By EMMANUEL D. TAGHOY
IPIL, Zamboanga Sibugay – “Economies collapsed due to human’s extreme greed,” said Monsignor Gilbert Gente, vicar-general of the Diocese Ipil during an orientation-training on transparency and accountability held here recently. “Corruption does not only enslave the people, but it insults humanity in general,” the vicar general furthered. The transparency and accountability training was spearheaded by the Citizen’s Action Network for Accountability (CANA), a non-government organization which believes that “the more ordinary people can understand and engage with the government, the more accountable and effective the people can be.” In his presentation, Ipil Mayor Eldwin Alibutdan said that transparency is a continuing struggle of each and every local government unit. He presented the initiatives undertaken by the municipal government to be more transparent and accountable in all its undertakings. “LGU Ipil is the only town with a working Electronic Business Permit and Licensing System (eBPLS),” disclosed
Mayor Alibutdan. Mr. Sonny Fernandez, director of the National Union of Journalist of the Philippines (NUJP) lauded the presentation of Mayor Alibutdan citing the town’s best practices. “Mayor Alibutdan showed that the town is really exerting its efforts to be transparent and to address the needs of the Ipileños,” said Fernandez. Fernandez also commended the CANA for spearheading the training saying “it is a good opportunity for the organized segments of the community, like the church and other people’s organization to engage with the local government.” The training also included a discussion about the Priority Development Assistance Fund (PDAF) of the government followed by an open forum. CANA is the third collaboration of the Institute for War and Peace Reporting (IPWR), the Center for Community Journalism and Development (CCJD), the MindaNews and the National Union of Journalists of the Philippines (NUJP). Zamboanga Mayor Climanco distributes books, school bags to students ZAMBOANGA CITY - In line with her administration’s priority in education, Mayor Beng Climaco on July 3, 2014, motored to the west coast barangays and distributed books and school bags to 416 students of two public high schools in the area. First stop of Mayor Climaco’s sortie in the west coast was the Talisayan National High School where she turned over 250 assorted books donated by the Children’s International Foundation. She also distributed school bags to all 163 Grade 7 students occupying the new two-storey building of the Tulungatung National High School. Assisting the mayor were Councilors Jawo Jimenez, Mel Sadain, Pin-Pin Pareja and Rudy Bayot together with the barangay officials of Tulungatung headed by Chairwoman Esther del Rosario and the school principal Olivia E. Soriano. Also there was the City Librarian Emmy Natividad. After the distribution, Mayor Climaco met with the barangay officials as part of her consultation process on various concerns involving the barangay, particularly security, health and education being the priority of her administration. From Tulungatung, the chief executive and her party proceeded to Talisayan National High School where she again distributed school bags to 253 Grade 7 students.

Alert on unverified terror threat unfair, says Davao tourism exec

AVAOCITY – President A q u i n o ’s order last week to City Mayor Rodrigo Duterte to raise an alert over an unverified terror threat was disheartening and unfair and may affect the upcoming Kadayawan Festival, a tourism official said.
Last week, Duterte revealed the president had called him to raise a terror alert in the city. Speaking to reporters at the sidelines of Thursday’s iSpeak forum at City Hall, City Tourism Officer Lisette Marques said the announcement had an impact because the order came from the president himself. “When you release an unverified report and send one of your top officials
based on an unverified report, it tells the public that there might be some degree of truth to it,” Marques said. “We should trust our own security measures,” she added. “So far, we have not been abandoned by our security forces,” she said, referring to the local police and the military’s Task Force Davao. Marques added national officials may have mistakenly dragged the city as a main target of the attacks when it was asked if the attacks would hit Metro Manila. “The officials were just clarifying that the attacks would not be in Manila, and that it was limited to Davao,” she said. Asked what the immediate reaction was to the terror alert, Marques said “there were no immediate cancellations” of visits to the city. But she admitted getting several queries from the private sector, especially those with offices outside the city.
“ T h e re w e re s m a l l cancellations like 50 pax (people) from small hotels,” Marques said. No major events have been cancelled, she added. She said the city was still expecting 100,000 visitors to the Kadayawan Festival in August. Department of Tourism assistant regional director Arturo Boncato Jr. said in a phone interview that the agency acknowledges the situation but has decided to go for a more proactive approach. “We have been dealing with the response from our own markets and called major players to convince them to still come over,” Boncato said.
He cited a group of Japanese investors who asked the department whether they should still come. He said he assured them the agency will do everything to make their visit as comfortable as possible. “As of today, Kadayawan is still a go, so we’re still working on that. Our obligation to the industry is inclusive growth,” he said.
“Proactive is the only way to go,” Boncato said in response to the unverified terror threat. “We should move toward quickly supplanting that perception of a threat.” Meanwhile, Central 911 chief Emmanuel Jaldon said
the city can expect the same level of emergency response that it is used to, with the department readily deploying at least 150 emergency personnel during the festivities. Among these are the See threat, page 11

Nat’l MSME summit to promote Davao tourism DAVAO CITY, The National Micro, Small and Medium Enterprises (MSME) Summit here on August 20-21 will help promote the city as a tourism and venue for big meetings, incentives, conventions and exhibitions (MICE), organizers said. With the theme “Philippine MSMEs: Beating Challenges… Accelerating Innovations,” the summit will take place at the SMX Convention Center and expects to draw at least 500 participants. Mary Ann M. Montemayor, National MSME Development Council vice chairperson and chair of the summit organizing committee, said the event will be “an affirmation of our claim as the thriving MICE destination of the Philippines.” “Davao as host and venue of the MSME summit stands to gain as a show window of the various products and services that we offer, as a vibrant tourism destination and haven for new investments,” she told MindaNews. In her presentation during the launching Thursday, Montemayor said the national event aimed to provide a venue to present the updated national MSME development plan for 2014-2016. She added it will be the venue to apprise the MSMEs and MSME Development Councils on vital development concerns or challenges. These include value chain upgrading and competitiveness, innovation, disaster preparedness and resiliency, green business or economy in light of Asean Economic Community 2015 and climate change phenomena, among others. Walden Bello even claimed that the decision was not retroactive and thus, President Aquino could not be held liable. However, Kabataan Party-list Rep. Terry Ridon was spot on when he pointed to the Supreme Court’s application of the “operative fact doctrine” in the decision to show why President Aquino and Sec. Abad are liable. The decision clearly states that: “…the doctrine of operative fact can apply only to the PAPs [program, activity, or project] that can no longer be undone, and whose beneficiaries relied in good faith on the validity of the DAP, but cannot apply to the authors, proponents and implementors of the DAP, unless there are concrete findings of good faith in their favor by the proper tribunals determining their criminal, civil, administrative and other liabilities.” (page 90) What is the principle of operative fact? Again quoting from the Supreme Court decision: “The doctrine of operative fact recognizes the existence of the law or executive act prior to the determination of its unconstitutionality as an operative fact that produced consequences that cannot always be erased, ignored or disregarded.” In layman’s terms, it means that one cannot simply undo or ignore what has been done because it might be unfair to the recipients of the programs, activities and projects of the DAP who accepted it in good faith (without knowing that it is unconstitutional) or it might be impractical for the government to undo everything. However, for the authors, proponents and implementors who include President Aquino, Budget Sec. Abad, senators and representatives of the lower house who benefited from it, they must prove before the courts that they acted in good faith, without knowing that the DAP is unconstitutional. Rep. Ridon also pointed that, at the minimum, President Aquino and Sec. Abad violated Article 220 of the Revised Penal Code. Rep. Ridon added that Kabataan Partylist is preparing an impeachment complaint against President Aquino as well as the charges to be filed against Sec. Abad. House Speaker Belmonte and other allies of the Aquino administration have declared that an impeachment complaint against the President would not pass the committee level. There is truth in this as the impeachment process in Congress is essentially
a political exercise. While there are appearances of hearings at the Lower House and the Senate, at the end of the day, representatives and senators vote along party lines. But whether the President’s acts with regards the DAP constitute a “culpable violation” of the Constitution or not and even if the Liberal Party has the numbers to throw out an impeachment complaint, not making any effort to hold the President and Sec. Abad accountable would only perpetuate impunity in the abuse of power and probably, corruption. And besides, in the event that the impeachment complaint hurdles the committee level and is tabled for discussion by the plenary, the public would get the opportunity to hear all aspects of the issue and decide whether President Aquino is guilty or not. For the President and Sec. Abad, it would do well to face the charges squarely instead of overcoming any complaint or charge with the strength of their numbers. Former president Gloria Macapagal-Arroyo was able to throw out several impeachment complaints, at least five, but in the eyes of the Filipino people, she has always been guilty of plunder. No amount of denials and legalese could erase it from the public’s mind. Also former president Arroyo set the precedent of running after her predecessor former president Joseph Estrada, after, of course, pressure from progressive groups and the Filipino people. It is now her turn to face plunder charges and is under custody, albeit in a hospital. President Aquino may face the same after his term ends, if he does an Arroyo while still in power.
