Peace and order in Misor is back to normal: Emano
MISAMIS Oriental––After a weeklong sporadic fighting in some areas in Misamis Oriental, the peace and order condition in the province remains generally normal, Gov. Yevgeny Vincente Emano said on Thursday. Emano said that the armed encounter between the communist guerrillas and the government troopers in the hinterland villages of Balingasag and Lagonglong, all in the province’s east district, did not hamper the daily activities of Misamis Oriental. The operation of the provincial government remains in shape while assistance were extended to about 500 people displaced when armed encounters broke out in separate villages in Misamis Oriental a week ago, Emano said. He said the evacuees would be returning back to their homes anytime soon as the military mounted hot pursuit operations against fleeing communist guerrillas who attacked an army post in Lantad, an erstwhile communist stronghold in the outskirt of Balingasag a week ago. Pursuing government troops engaged the communist rebels in a running gun battle deep in the borders of Balingasag and Lagonglong last Monday which led to the evacuation of 350 individuals there. Emano said that the peace and order conditions in conflict areas had tapered down but the provincial personnel remained in the evacuation centers to assist the needs of the elderly, the children, and the women caught in the armed conflict. Proponent drops bid for P2b PPP Agusan River dredging By PAT SAMONTE Regional Editor-Caraga
BUTUAN City––A Filipino-Korean corporation, formerly engaged in buying, selling and processing sawn lumber and veneer products, has reportedly withdrawn from its proposal to dredge the Agusan River. Lohas Ventures International Corporation, with office on T. Calo Street here, proposed to the PublicPrivate Partnership (PPP) Council under the city mayor’s office, a P2-billion deal for the Agusan River dredging under the PPP scheme. However, the proponent backed off unnoticed by the local media. When asked about Lohas’ withdrawal, Mayor Ferdinand Amante, Jr. said he merely advised the proponent that the offer would be subjected to a study or evaluation.

Annaliza Gonzales, the city’s legal officer, said some 10 companies proposed to “challenge” Lohas Ventures’ offer. She did not offer an answer to the question on why Lohas Ventures’ withdrew. Fidelis Calo confirmed that his company backed out of its bid saying that an explanation was submitted to the PPP council. It was gathered that a mining company and a Vietnamese dredging firm previously offered to dredge the Agusan River. While they had complete equipment and facilities to do the job, both proposals were declined when they could not give an answer on the city environment and natural resources’ question on where they would dispose of dredged materials.

He said during the operation a resident in the area had told him bluntly, “ Nganong initan man ninyo ni nga gamay nga negosyo? (Why are you interfering this petty business?). Mentero said the residents in the area have already learned on effects of Pablo’s wrath which destroyed their homes but they were still enticed with the prospects of quick cash from illegal loggers. “I believed there’s somebody behind this,” he said as he admitted that he himself received threats from illegal loggers through phone calls.

JOSEFA, Agusan del Sur--- Local officials here have seized truckloads of “hot” logs illegally cut inside the timberland areas of two mountain villages heavily devastated by the onslaught of Typhoon Pablo in December last year. The villages of Awao and Sayon where the truckloads of illegal logs were discovered were the areas hardest hit by Typhoon Pablo after practically all houses were wiped out and three residents were killed by a landslide.
A composite task force led by Mayor Jann Roby Otero swooped down on some 400 pieces of illegally sawn lauan logs in a surprise operation inside the 990 hectares timberland areas covered by the Community Based Forest Management Program (CBFM) of the Department of Environment and Natural Resources. Surprisingly, Community Environment and Natural Resources Officer Modesto Lagumbay based in Bunawan town was not aware that there was a major crackdown operation against ill-gotten logs felled by illegal loggers
at the two adjacent villages of Awao and Sayon where 85 percent of forest areas were damaged by Typhoon Pablo. “I was not told about it,” Lagumbay told MINDANAO DAILY NEWS in a phone interview as he quickly added that he will assign Forester Victor Saburnido, head of forestry services at CENRO, to closely coordinate with the local government of Sta. Josefa. Otero, who personally supervised the operation since Tuesday night said he was surprised to learn that they would uncover huge cache of illegal logs hidden in stocks in four areas of the mountain which were more than they were initially reported. He said another big operation will be launched in Sayon village where most of the illegal logs were reportedly slipped out in another road leading to Monkayo town in Compostela Val-

Marines hoist PH flag in Malik homebase in Sulu

ALIPAO, Sulu —The Philippine Marines based in this town early Wednesday hoisted the Philippine flag at the residence of Ustadz Habier Malik in Tuyang village. “This [Talipao town] is the base also of Maas,” said a resident, who declined to give her name for security reasons. Maas is the revered title that some Tausugs use in reference to Nur Misuari, founder of the Moro National Liberation Front (MNLF). This morning, MindaNews saw Talipao residents leading the officers and men of the Marine Battalion Landing Team 2 to the
village of Tuyang, Malik’s residential area and MNLF homebase in Talipao town. Malik led the MNLF members who laid siege on some coastal villages in Zamboanga City on September 9. The military is still reportedly checking if he is still alive or was killed after three weeks of clashes that displaced 23,794 families or 118,819 individuals. “We have conducted a com-
munity dialogue with the people there. We did not go there to engage in war. We are there to heal the wounds of war,” Col. Jose Johriel Cenabre, Joint Task Force Sulu and 2nd Marine Brigade commander, told MindaNews. “The (Philippine) government is in a progressive engagement with the people, and the Marines entered Lampaya and reached Tuyang, the known lair of Ustadz Habier Malik,” he added. “We all care for the people especially here in Sulu, where the people in the area (of Malik) requested for the presence of the Marines,” Cenabre said. The Marines used community dialogue as an approach to seek alliance with the people, who
themselves led the soldiers to the area, he said. Malik’s relatives and the remaining MNLF members who were guarding the camp had already abandoned the place when the soldiers arrived. The Philippine flag was hoisted by 1Lt. Romelito Macaraig. This was followed by silence from the residents who witnessed the event in reverence to the panji (flag). “It is all in the name of kahunungan (tranquility) for Lupah Sug (Sulu),” Macaraig said. LABANGAN, Zamboanga del Sur – Peace is everybody’s business and not of the government only, according to BGen. Felicito Virgilio Trinidad Jr., commander of the 1st Infantry (Tabak) division. In a nationwide simultaneous candle lighting ceremony on Saturday marking the observance of national peace consciousness month, Trinidad emphasized before some 300 troopers and stakeholders gathered at Camp Major Cesar Sangan, Barangay Pulacan in this town that “the Armed Forces of the Philippines (AFP), as an organization advocating peace, sincerely p er for ms its duties and responsibilities in safeguarding the nation.” Trinidad said the AFP
also engages itself in certain events like the candle lighting for peace to get the real essence and understanding of tranquility, adding “the activity is a symbol of renewed commitment to share and advocate peace.” “It also helps strengthen and support our aspiration to end the turmoil in our society,” Trinidad stressed. Ipil lights candles, prays for peace in Zambo IPIL, Zamboanga Sibugay —People from all walks of life gathered here Tuesday evening to light candles and pray for peace in Zamboanga City and the rest of the Zamboanga Peninsula. Initiated by Bishop Julius Tonel of the Diocese of Ipil, an estimated 200 people joined the prayer rally at the cathedral ground here at exactly 6 p.m. Other dioceses in the region and some other parts of Mindanao also held a similar activity simultaneously. The par ticipants here formed the logo of peace and lighted candles as they hear the mass led by Father Iroderick Resma. After the mass, they stood in silence for three minutes to pray for peace. Berting Largo, of the Diocese of Ipil’s Social Action Ministry, said the activity was called by Bishop Tonel to urge all people to pray for the victims of the Zamboanga City crisis, which lasted for almost a month after members of the Moro National Liberation Front loyal to founding chair Nur Misuari laid siege to some coastal parts of the city. “We are praying for the victims of the crisis in Zamboanga City and we are praying that it will not happen again. We are praying for peace and an end to war and conflicts,” Largo said. Greed for power (Part 2)
Originally, the pork barrel was a tool used by US slave owners to exact loyalty, cooperation and support from their slaves. The barrel was a wooden one where pork lard was stored. They were stockpiled in the barnyards of slave owners to be used for purposes mentioned above when the slave owners feel the need to exact cooperation from their slaves. Remember that the slaves during that time were bought from slave traders and they were considered properties of their owners. It was not easy then to let the slaves work according to the wishes of the owners because deep in the heart of every slave is resentment for having been treated as commodities and not as human beings. It was also impossible to always use coercion, threat and intimidation to let the slaves perform hard labor. This situation gave birth

Conceptually, this is the idea behind the pork barrel system in the US when we copied that country’s presidential system where the three branches of government – executive, legislative and judicial – are co-equal to each other. The pork was used by the president in exacting support and cooperation from a hostile Congress. But it was not like the
abolished congressional pork barrel system in our jurisdiction where equal amount, in the millions of pesos, of course, are allocated yearly for each legislator – P70 million for congressmen and P200 million for senators. The fund allocated in the Philippine pork barrel system practically became the private money of legislators that they can spend as they please. Proof to this is the practice of Lower House legislators to allocate their pork barrel to projects outside of their congressional districts. If they are not treating this
fund as if it is their own, they would not have practiced this stupendous act. They should have allocated the fund for projects solely for their respective congressional districts. As practiced, the US pork barrel system is a mechanism where congressional legislators are given the chance by the president to endorse a pet project that he wants to pursue using federal funds. In giving in to the legislator’s wishes, the president is able to exact the legislator’s support for his legislative agenda. The current stand-off between the congressional Republicans and the senator Democrats over the Obama healthcare program issue that resulted in the nonpassage of that country’s national budget forcing the federal government to partially close some of its offices is classic example why a mechanism known See greed, page 11

WHEREAS, in order to provide safety to the riding public, pedestrians and to decongest traffic , this Traffic Ordinance is enacted to regulate the flow of traffic, movement of vehicle, pedestrians and to provide orderliness thereof. WHEREAS, in as much as open areas in the commercial area along the national highway is not enough to provide parking terminals to tricycles, jeeps, vans and provincial buses , temporary terminals are herein designated. WHEREAS, the Sanggunaing Bayan of the municipality of Kapatagan, Lanao del Norte has the power to regulate the operation of tricycles, sikad-sikad and grant franchises for the operation thereof within the territorial jurisdiction of the municipality. WHEREAS, consistent with the legislative authority of the sanggunian to enact rules and guidelines for an orderly traffic and its enforcement , Ordinance No. 31, S-2009 is hereby amended. WHEREFORE, after due deliberation and upon motion of Hon. Allan C. Tabaquero , unanimously seconded, BE IT ORDAIN, AS IT IS HEREBY ORDAINED by the sangguniamgn bayan, in a session duly assembled to amend Municipal Ordinance No. 31, S-2009, otherwise known as the Traffic Ordinance of the Municipality of Kapatagan, Lanao del Norte of 2009. ARTICLE 111 ( As amended ) TRAFFIC ADMINISTRATION Section 1.- Authority of the Sangguniang Bayan: In consonance with the authority granted in Section 447, par 5 ( sub-par v and vi ) of RA 7160, the sangguniang bayan shall exercise such functions as they may see fit from time to time:

RESOLUTION AMENDING ARTICLE 111, ARTICLE IX, ARTICLE XI, ARTICLE XIII, ARTICLE XIV, ARTICLE XV, ARTICLE XVII, ARTICLE XVIII OF ORDINANCE NO. 31, S-2009, OTHERWISE KNOWN AS THE TRAFFIC ORDINANCE OF THE MUNICIPALITY OF KAPATAGAN, LANAO DEL NORTE.
The one way traffic stated in par. ( d ) and ( e ) is hereby suspended due to bad road condition and shall be lifted as soon as the road condition becomes good.
1. Create, define, re-define, eliminate or change all speed zones, one-way streets, through streets, parking areas, crosswalk, loading and unloading areas, bus stops and designate the type of marking to be placed and maintained for the identification of such zones or area. 2. Determine and designate the type of all traffic signs and signboards which shall be uniformed and in so far as practicable conform to the current standard as approved by the DPWH and the LTO. 3. Determine those intersections at which drivers of vehicles shall not make a right turn, left or “U” turn and designate the place at which proper signs at such intersections shall be erected. 4. Authorize the Local Chief Executive for the deputation of Municipal Traffic Aides and Police for the efficient implementation of this code. 5. And shall exercise such authority granted in Section 4R.04 of Article R of the Local Revenue Code.
ARTICLE XI ( As amended ) ADMINISTRATIVE PROVISION FOR THE OPERATION OF TRISIKAD Section 1. Operation of Trisikad: Trisikad shall be allowed to operate within the limit of one barangay except when the driven trisikad is going to another barangay where the driver intends to operate for hire or going home to his barangay of origin. Section 2. Prohibition: a. No person/s shall be allowed to drive a trisikad unless he is eighteen ( 18 ) years of age, who is physically and mentally fit. b. No trisikad unit shall be allowed to operate for hire unless the same is duly registered with the Treasurer’s Office upon payment of the following; ( Local Revenue Code ) 1. The operation of trisikad shall be limited to one barangay only.

( B ) Functions of the Board- The Board shall have the following functions:
1. Monitor the implementation of this code. 2. Recommend corrective measures for the efficient implementation of traffic rules and regulations to the Sangguniang Bayan. 3. Exercise such other functions that is deemed necessary to ensure public safety and convenience, and whenever practicable recommend the re-routing of traffic specially during civic, military and religious parade without need of Sanggunian approval and only for a limited purpose and duration. 4. Section 3. Authority of the Traffic Enforcers- The Traffic Enforcers herein referred are those duly designated Traffic Police Officer/s , Traffic Aides paid by the local government of Kapatagan, Lanao del Norte , and those Barangay Tanuds which are designated and detailed as traffic aide by their respective Barangay Councils and assist Traffic Police Personnel, Traffic Management Group and LTO. ( A ) Functions of the Enforcers:
1. shall enforce the provisions of this code and assist Traffic Police Personnel, TMG and LTO in the implementation of all national laws . 2. shall take the name and address of traffic violators whether with or without a driver’s license number; the registration and plate number of the vehicle/s involved. 3. shall issue to the traffic violator a summon or citation ticket informing him/her of the charge/s against him/her and requiring him/her to answer the same at the time and place designated in the citation within seven ( 7 ) days after such violation. 4. shall impound any vehicle / motorcab/ trisikad/ habal-habal / tala-tala driven or operated by the traffic violator and to release the same only upon authority of the officer duly designated by the Local Chief Executive. ARTICLE IX ( As amended ) DESIGNATED ONE-WAY STREETS
SECTION 1. ONE-WAY STREETS.- (1) The streets or portions thereof described below are hereby designated one-way streets. Vehicular traffic, on said streets shall move only in the direction indicated by signs erected and maintain thereon. This provision does not apply in emergency cases but the driver of such vehicle shall exercise extra care in traversing the one-way street.

For any violation under Section 3 hereof by any driver or operator of trisikad not otherwise fined in the immediately preceding paragraph , aside the impounding of the unit shall pay a fine of P100.00 for each violation. If the unit will not be claimed after one (1) year, it shall be sold to public auction under the following procedures; 1. The Municipal Treasurer shall post notice for auction sale for five(5) consecutive days in two (2) conspicuous places in the public market setting therein the floor price as determined by the appraisal committee duly constituted by the Municipal Mayor for the purpose; 2. In case the impounded trisikad is not disposed of within ten (10) days from the date of notice of the public auction, the same shall be considered sold to the Municipal Government and shall be disposed within the first thirty (30) days in accordance with the law; 1. Prospective operators of tricycles should first secure a Motorized Tricycle Operator’s Permit (MTOP) from the Sangguniang Bayan. b. The Sangguniang Bayan of this municipality shall : 1. Issue, amend, revise, renew, suspend, or cancel MTOP and prescribe the appropriate terms and conditions therefore; determine, fix, prescribe or periodically adjust fares or rates for the service provided in a zone after public hearing; prescribed and regulate zones of service in coordination with the barangay; fix, impose and collect, and periodically review and adjust but not often than once every three (3) years, reasonable fees and other related charges in the regulation of tricycles-for-hire; and establish and prescribe the conditions and qualifications of service. 2. Only Filipino citizens and partnership or corporation with sixty percent (60%) Filipino equity shall be granted the MTOP. No MTOP shall be granted by the municipality unless the applicant is in possession of units with valid registration papers from the Land Transportation Office (LTO). 3. The grantee of the MTOP shall provide common carrier’s insurance sufficient to answer for any liability it may incur to passengers and third parties in case of accidents; 4. Operators of tricycles-for-hire shall employ drivers duly licensed by LTO for tricycle-forhire. 5. Operators who intend to stop service completely, or suspend service for more than one (1) month shall report in writing such termination or suspension to the Sangguniang Bayan; 6. Tricycle operators are prohibited to operate on national highways utilized by 4-wheels vehicles greater than four (4) tons and where normal speed exceed forty (40) KPH. The Sangguniang Bayan may provide exceptions if there is no alternative route. 7. Tricycles-for-hire shall be allowed to operate like a taxi service, i.e., service is rendered upon demand and only on the approved fixed route within a zone. c. The Sangguniang Bayan may impose a common color for tricycles for hire in the same zone. Each tricycle unit shall be assigned and bear an identification number, aside from its LTO license plate number. The Sangguniang Bayan shall establish a fare structure that will provide the operator a reasonable return or profit, and still be affordable to the general public. The fare structure may either be flat (single fare regardless of distance) as a minimum amount plus a basic rate per kilometer.
3. The proceeds of the sale shall be applied to satisfy the costs of impounding advertisement and conduct of sale. The residue over these costs shall accrue to the owner of the impounded tricycle. If he satisfactorily presented proof of ownership otherwise the residue will accrue to the General Fund of this Municipality. ARTICLE XIV ( As amended ) DESIGNATION OF TEMPORARY TERMINAL Loading and unloading stations Section 1. : Temporary Terminal : Refer to Traffic Routing Scheme ( Map ) The Temporary Terminal for habal-habal/tala-tala and tricycles are hereby change and adopted, the location of its terminal per zone is designated in the Traffic Locational MAP. See Annex A. Section 2. Loading and unloading at Poblacion along the National Highway: ) Station 1: Junction National Highway and Cangke St ( fronting LANECO Sub-station, both sides ) Station 2: Integrated Bus Terminal – designated area Station 3: Junction National Highway junction Anoya St and Bulahan Street, both sides. Section 3. Prohibition. No Provincial Buses, vans , jeepneys, and other puvs-for hire shall be allowed to load/unload at any point along the national highway in between junction Cangke Street up to junction Santol /Bulahan Street and vice versa. ARTICLE XV ( As amended ) DESIGNATION OF PERMANENT TERMINAL Section 1. Permanent Terminal – The Integrated Bus Terminal shall be the permanent terminal to all provincial buses, jeepneys, van and other puvs. Section 2. Prohibition : it shall be unlawful for any driver/s of provincial buses, van ,public utility vehicles to load, unload or drop passenger/s at any point along the national highway between junction Cangke Street up to Junction Santol/Bulahan Street and vice versa. ARTICLE XVII ( AS Amended ) MISCELLANEOUS PROVISIONS SECTION 1. – It shall be unlawful for any person to knowingly drop, place or throw or cause to drop, place or throw upon any highway, scattered or tacks, nails, wire, scrapped metals, broken glass, bottles or other substances or things injurious to the feet of the persons or animals or the tires or wheels of vehicles. SECTION 2. – It shall be unlawful for any person to puncture or cut or otherwise injure the tire to mar ( ruin ) the finish of or purposely damage, disconnect or take away part of any motor vehicle without the permission and consent of the owner. SECTION 3. – No driver or operator of a public utility service vehicle shall smoke while his vehicle is in motion and actually occupied with passengers nor should he converse or be talking with anybody in the vehicle except when ask to do so or for any valid reasons other merely chatting. SECTION 4. – No person having the control of any vehicle shall negligently allow it to bump, hit or go against or foul upon any person, vehicle or other thing whatsoever, nor shall any person fail to stop his car or vehicle at any place in a street when directed by any person in authority or by any police or peace officer. SECTION 5. – No person having the control of any vehicle shall fail to keep a vigilant watch for all vehicles and persons especially children and aged person nor shall any such person fail to strike his gong, bell or sound his horn several times in quick succession, reduce the speed of his car vehicle upon approaching any team, carriage or person about to cross his path. SECTION 6. – TRACKING MUD UNTO THE HIGHWAY. – No vehicle using the public highway shall track mud or dirt unto the traveled portion of such highway in such quantities as will constitute a hazard when the roadway is wet, or obscure the painted pavement markings thereon. In the event that mud or dirt is unavoidably tracked onto the highway, it shall be the duty of the operator of the offending vehicle to have said mud or dirt remove as quickly as possible. SECTION 7. – RIDING ON MOTORCYCLES – A person operating a motorcycle shall ride only upon the permanent and regular seat attached thereto, and such operator shall not carry any other person nor shall any other person ride on a motorcycle unless such motorcycle is designed to carry more than one person, in which event a passenger shall ride a straddle upon a permanent and regular seat to the rear or side of the operator, said motorcycle should be equipped with adequate foot rest and hand grips, nor shall any other person ride upon such motorcycle not equipped as herein above set forth.
The official rate to be initially adopted shall be a minimum fee of Five Pesos (P5.00) plus One Pesos (P5.00) per km. in excess of four (4.0) km. distance pending the enactment of the prescribed fare structure for the zone by the Sangguniang Bayan.
Section 8. ( amended version ) It shall be unlawful for any person except those authorized by the Local Chief Executive/ Chief of Police acting upon the directive of the Traffic Management Board or the sangguniang bayan to remove, alter, deface, injure or destroy traffic signs, signals where they are officially installed.
Operators of tricycles-for-hire are required to post in the conspicuous part of the tricycle the schedule of fares.

d. The zones must be within the boundaries of this municipality. The existing zones which covers the territorial unit not only of the municipality but other adjoining municipalities as well shall be maintained provided the operators serving the said zone secure the MTOP.
Penalty
Section 1. Penalty : Any violation of this ordinance not otherwise specified in any article shall be penalized by a fine of not less than P200 and not more than P1,000.00 or imprisonment of not less e. For the purpose of this Article, a Municipal Tricycle Operator’s Permit Regulatory Board is hereby one month but not more than four months or both in the discretion of the court. Provided , however, composed as follows: that should the violator opt not to be criminally prosecuted in court, an administrative fine shall be SB (Comm. On Transportation) Chairman imposed in the amount of P300.00 payable to the Municipal Treasurer’ Office or otherwise the violator SB Member may opt to render a voluntary civic action services for a period of three ( 3 ) hours. Section 2. PROCEDURE UPON ARREST.- Except when authorized or directed by law to immediately take a person arrested for violation of laws before the court, any authorized police officer or traffic enforcer , upon making the arrest for violation of traffic law , Land Transportation Code ( RA 4136 ) when authorized or this ordinance shall take the name , address and operator’s license number of the alleged violator and the registered number on the motor vehicle involved and shall issue to him in writhing a summon or citation, hereinafter described directing him to answer to the charge against him at a place within seven days after the arrest. Section 3. Summons or Citationa. Form of summons or citations is hereby used for citing traffic violations which do not mandate a physical arrest of the violator. Such form shall be that form which are commonly used by law enforcement agency and shall be adopted or prescribed by the Provincial Public Prosecutors . b. In every case, when a citation is used, the original shall be given to the violator or in the case of unattended vehicle, the original of the same shall be affixed. Section 4. Separability Clause: If for any reason, any section or provision of this code shall be declared unconstitutional or invalid by competent authority, such judgment or decree shall not affect or impair other sections or provisions thereof. Section 5. Applicability Clause. All other matters relating to the imposition in this ordinance shall be governed by pertinent provisions of existing laws and other ordinances. Section 6. Repealing Clause, as amended . All ordinances, rules and regulations or part thereof in conflict with or inconsistent with any provision of this ordinance are hereby repealed or modified accordingly. Section 7. Effectivity. RESOLUTION NO. 2008-082 RESOLUTION APPROVING ORDINANCE NO. 16, S – 2008, AN ORDINANCE REGULATING THE SELLING, DISTRIBUTION AND DRINKING OF LIQUORS, TUBA AND/OR INTOXICATING BEVERAGES UPON MINORS and ADULT PERSON, PROHIBITING HABITUAL DRUNKENESS IN PUBLIC PLACES , AND PROVIDING APPROPRIATE PENALTIES THEREFORE.
Any adult person caught in violation of this ordinance shall be penalized in the following: First Offense- shall undergo either physical set-ups , jogging and /or ground cleaning or community service for not more than one hour at the discretion of the court.
WHEREAS, consistent to Section 16 of Ra 7160, otherwise known as the Local Government of 1991, every local government unit shall exercise the powers expressly granted, those necessarily implied therefrom , as well as the powers necessary , appropriate , or incidental for its efficient and effective governance , and those which are essential to the promotion of the general welfare. Local government units shall ensure the promotion of health and safety, maintain peace and order, and preserve the comfort and convenience of the inhabitants.
Second Offense- imprisonment of not more than one week or community service of not more than three days or both at the discretion of the court. Third Offense or more - imprisonment of not more than one month or community service of not more than fifteen days or both at the discretion of the court.
WHEREAS, Section 446, par 1, sub par ( v ) of RA 7160 provides that the Sangguniang Bayan may pass ordinance intended to protect, suppress and impose appropriate penalties for habitual drunkenness in public places and may pass legislative measures for the protection of minor.
Section 8. Administrative Penalties Any business establishment found in violation of this ordinance shall be administratively penalized by cancellation of the business permit “ to sell liquors , tuba and /or intoxicating beverages.”
WHEREAS, the Sanggunian received various complaints of habitual drunkenness in public places resulting to public disturbance, discomfort , annoyance and public disorder ; and out of school minors who had become vagrant , problematic and psychologically uncontrollable. WHEREAS, the local government has the obligation to protect and safeguard minors from the bad influence or harmful effect of liquor and other intoxicating beverages.
Section 9. Construction This ordinance or any provision hereof shall be liberally construed in order not to defeat the spirit of this ordinance
NOW THEREFORE, after due deliberation and upon motion of Hon. Allan C. Tabaquero, duly seconded by Hon. Narciso B. Oporto, BE IT ORDAINED BY THE SANGGUNIAN in a session duly assembled ORDINANCE NO. 16, S-2008 AN ORDINANCE REGULATING THE SELLING, DISTRIBUTION AND DRINKING OF LIQUORS, TUBA AND/OR INTOXICATING BEVERAGES UPON MINORS AND ADULT PERSON, PROHIBITING HABITUAL DRUNKENESS IN PUBLIC PLACES , AND PROVIDING PENALTIES THEREFORE. Section 1. Definition of terms Drunkenness - high and /or under the influence of liquor, tuba, and/or intoxicating beverages. For purposes of this section, an intoxicating beverage can mean any form of beer product or beverage. Adult Person – any natural person 18 years old or above. Minor – any person under the age of 18. Selling – to dispose of the ownership of liquor , tuba and or intoxicating beverages to another or others in exchange for money. Distribution – the dealing of or marketing of liquor , tuba and or intoxicating beverages. Business Establishment – any store, café , disco bar , restaurant, beer house and the like. Habitual – regular , consistent , customary, routine Habitual drunkenness – any person who is regularly, consistently, and/or customarily high and/ or under the influence of liquor, tuba and /or intoxicating beverages. Section 2. Prohibition to sell, serve and drink liquor, tuba, and intoxicating beverages upon minors. It shall be unlawful for any business establishment to sell, serve and/or allow a minor to drink at his/her establishment any kind of liquor, tuba and/or intoxicating beverages. Section 3. Prohibition to sell liquor, tuba and other form of intoxicating beverages upon minors. Except when a minor is assisted by a parent , guardian or adult at the time of procurement, It shall be unlawful for any business establishment to sell liquor, tuba and /or other form of intoxicating beverages to minors at any time of the day and night Section 4. Regulation of time to sell and serve liquor, tuba, and intoxicating beverages upon any adult person. Except on special occasions such as but not limited to town or barrio fiesta, Araw ng Kapatagan and the like, it shall be unlawful for any business establishment to sell and serve to any adult person at his/her establishment any kind of liquor, tuba and/or intoxicating beverages beyond 10:00 in the late evening. Provided further, that no business establishment within a radius of 50 meters from vital learning institutions such as schools and courts shall serve and allow any person to drink at his/her establishment any kind of liquor, tuba and other intoxicating beverages from 7:00 o’clock in the morning to 5:00 o’clock in the afternoon. Section 5. Habitual Drunkenness Upon Any Person, Prohibition. It shall be unlawful for any person to be habitually drunk in any public places and at any time during the day or night. Section 6. Prohibition on Minors. It shall be unlawful for any minor to drink any form of liquor, tuba and/or intoxicating beverages in any business establishment. Section 7. Penalties. Any minor caught in violation of this ordinance shall be brought to the custody of the Municipal Social Welfare and Development. The MSWD shall thereinafter conduct a counseling - seminar on responsible childhood and parenthood to both the minor and the minor’s parent or guardian.
Section 10. Separability Clause If any provision hereof had been found to be inconsistent to national law or the constitution , the same does not affect the other provision of this ordinance. Section 11. Repealing Clause Any ordinance found inconsistent to this ordinance is accordingly repealed, modified and/or annulled. Section 12. Peace with local MNLF in Davao still holds Peace dialogue slated
DAVAO CITY -- A top military commander assessed that the peace with the local revolutionary committees of Moro National Liberation Front holds as government forces continue to conduct clearing operations against the MNLFNur Misuari Faction in Zamboanga City. Major General Ariel Bernardo, commander of the 10th Infantry Division, said no movement among local revolutionary committees of the MNLF occurred in Davao Region and even parts of Region XII since the siege of Zamboanga started more than two weeks ago. He said the local MNLF leaders have established an open-line of communication with the military even before the Zamboanga City conflict erupted. “The MNLF informed us about their peaceful assemblies and we permitted them. We just issued them specific guidelines not to carry firearms and to wear uniforms,” Bernardo said. He observed that the government’s openness to the local MNLF leaders for a peaceful dialogue works to quell any action for them to show sympathy to their comrades involved in the Zamboanga City incident. Bernardo said the local MNLF leaders even seek to have another dialogue with the government and the security sector anytime this week. He said that outside Davao Region, other MNLF groups are consolidating themselves giving their position against the rebellion headed by the Misuari faction in Zamboanga. “Most of them in Davao Region and outside Basilan, Sulu and Tawi-tawi, tells us that they do not agree Nur Misuari’s armed action in Zamboanga City. They are amenable for some peaceful approaches in airing their grievances and the full implementation of the peace agreement,” Bernardo said. He stressed that the MNLF gives importance for the tripartite review of the 1996 final peace involving them, the government and the Organization of Islamic Countries. Bernardo said the forthcoming three-day dialogue with key MNLF leaders is slated in Davao City and will have participation by MNLF groups and women’s groups from the provinces of Lanao, Maguindanao, South Cotabato, Sarangani, Sultan Kudarat, North Cotabato, Basilan, Sulu and Tawi-tawi. He said the MNLF leaders will have to talk among themselves for two days before the government through the Office of the Presidential Adviser on the Peace Process and the security sector will listen to them on the third day. “The real intent is to consolidate the MNLF groups and then deal with them so that they will no longer gravitate to the leaders who headed the clashes in Zamboanga City,” he said. DAVAO CITY -- Students and teachers of the Davao City schools here were excited with the opening on Tuesday of the Science Discovery Center (SDC) at SM Lanang Premier. Head of the high school department Luz Josol of the Philippine Nikkei Jin Kai International School (PNJKIS) here, said “the SDC is very relevant because it does not only provide entertain but better understanding of the things around us. It will really be of great help for our students to better understand their lessons especially on their Science subjects.” She said the trip to the Science Discovery Center will now be part of their school’s yearly activity and this early we already we already incorporated this to our school calendar of activities for 2014. TAGUM CITY, Davao del Norte --The military on Wednesday said a ranking leader of the communist New People’s Army was killed following a clash in Cateel town, Davao Oriental early on Tuesday. Five soldiers from the army’s 67th Infantry Battalion were also wounded as NPA guerrillas detonated an improvised landmine during
the firefight at Aliwagwag village around 2:00 a.m., said Capt. Raul Villegas, spokesperson of the Army’s 10th Infantry Division. Villegas said the clash occurred after residents reported to the army the alleged plan of the NPA to sow violence in Cateel. “The dead NPA bandit believed to be a high-ranking leader based on the high-
powered firearm found near his body, was brought to a local funeral home, while the wounded soldiers were immediately evacuated for treatment,” Villegas said. He said troops conducting clearing operations at 2:00 p.m. on the same day found a wounded rebel, identified later as one Kim Gargar, who was then brought to Cateel Medical Hospital for treatment.
“This encounter only shows that the NPAs are no longer welcome in Davao Oriental. The residents want genuine peace development, they do not want this to be disturbed by the NPAs,” Villegas said. The senator said DAP violates the constitutional provision that: “No law shall be passed authorizing any transfer of appropriations; however, the President, . . . may, by law, be authorized to augment any item in the general appropriations law for their respective offices from savings in other items of their respective appropriations.” Santiago said that the Constitution allows fund transfers, only if there are savings, meaning that the project was completed, and yet the appropriation was not exhausted; but there are no savings if a project was merely deferred. The senator said it appears that DAP funds were taken from alleged slowmoving projects. If so, no savings were generated, and therefore the DAP is illegal. “The first issue is that the DAP was not taken from savings. The second issue is that the DAP was not used to augment items in the budget that were previously authorized by Congress. The alleged savings were used to augment new budget items not previously authorized by Congress,” she said. Santiago said that the budget department should have sought the approval of Congress, because under the Constitution it is Congress that exercises the power of the purse. Santiago also said that in 2011, Pres. Aquino reacted to criticisms that his administration did not implement government programs fast enough. As a response, Pres. Aquino authorized the budget department to set aside P85.5 billion for the DAP, without getting prior congressional approval. “The budget secretary released a list of the beneficiaries of the DAP. Santiago said that to prevent the DAP from destroying the congressional power of the purse, Congress should pass a law patterned after the 1974 Congressional Budget and Impoundment Control Act of the United States. “Under American law, if the President discovers an enacted appropriation which has not been spent, the President cannot just cancel the appropriation. The President must first ask Congress for a rescission, meaning a cancellation or cut-back of appropriated funds for a project no longer considered necessary. The President cannot act by himself alone. Such a law would restore the balance of power between the executive and legislative branches,” she said. Santiago said that it was Pres. Aquino himself who, as a senator filed Senate Bill No. 3121, the proposed Budget Control and Impoundment Act. “Pres. Aquino’s proposed impoundment law takes a fiscally responsible position. If he doesn’t mind, I will simply refile it in the Senate, with an explanatory note that it was originally filed by Pres. Aquino,” Santiago said. Santiago said that the budget department is “chipping away at the legislative power of the purse by fiddling with the budget.” “The budget department website shows that it is running rings around the bud-
get. In certain cases, it has initially released the allotment, meaning an authority to spend. Then, claiming that the department head was slow in using the funds, it “retrieved” the released funds. Then it disbursed the funds for budgetary items not expressly authorized by Congress. The process is not at all transparent,” she said. Santiago said that the budget department is basically realigning funds without public discussion in Congress. “Congress has the power of continuing congressional oversight on the budget. In the Senate, we should demand more disaggregate reports from DBM, particularly on infrastructure and other capital outlays. The classification of public infrastructure should be broken up into the three categories of public infrastructure, other capital outlays, and military hardware, which has not even contributed to economic growth,” she said.

Legislators were looking at the possibility of King Energy operating an “island mode” whereby they supply the 10.4 MW directly to Moresco-II but this was not resolved. For her part, provincial board member Bebeng Dumadag moved to pass a resolution “earnestly requesting the ERC or NGCP to fast track the much needed communication facilities so as to immediately and permanently solve the power crisis.” Dumadag is the vice chairman of the committee on energy.

as pork barrel is needed in such a form of government. And to think that the US presidential form of government adopts the two-party system only while ours adopts the multi-party system thus making it harder for our president to exact support and cooperation from the co-equal legislature for the president’s legislative agenda. This is the reason why our pork barrel is embedded itself in the national budget thus making it more vulnerable to abuse. The mechanism aspect of our pork barrel system is no longer on the grant of funds for the legislator’s favorite project but on whether such fund is released to the hostile legislator. So to ensure the release of their pork, legislators simply ally themselves with the occupant of Malacanang even if previously they were political foes. This is the evil of our country’s pork barrel system. The congressional pork barrel in our setting is abominable because legislators are not elected to implement projects in whatever form. This is the reason our legislators have learned to love the pork barrel system. This is the reason why legislators abused and misused their pork barrel. And it is for this reason that the cry of the people is for its abolition that President Aquino acceded by not including any item anymore in the 2014 national budget for congressional pork funds. But let us never commit the error of equating the presidential discretionary fund as pork because the president does not need to exact support and cooperation from his own self so he can push for his legislative agenda. The president of the republic needs discretionary funds just like any mayor, governor and presidents of public and private corporations to ensure that he succeeds in his duty as president. To deprive the president of his discretionary fund is to ensure that he fails. So what do we want to happen to our president? Succeed or fail? Your answer to this is as good as mine.
