SP adopts 3 resolutions on Hall of Justice fire incident CAGAYAN de Oro City–– The City Council headed by Vice Mayor Caesar Ian E. Acenas has adopted three legislative measures in response to the fire incident on Friday that gutted down the Hall of Justice building in the city. Councilor Ramon G. Rodriguez, of Cagayan De Oro City, is pushing for the creation of a resource center for indigenous cultural communities (ICC) to attend to the needs of the country’s 15 million indigenous peoples (IPs). Rodriguez said on Monday that he has filed House Bill 5351 to give effect to the constitutional recognition and cognizance of the plight of the 12 to 15 million IPs in the country. The ‘Pandora’s Box’ of Maguindanao It seems that the case of the botched operations of the PNP-SAF in Maguindanao could open a Pandora’s Box. With the revelation of Police Director Getulio Napeñas Jr, the sacked SAF commander, of the alleged participation of the suspended PNP Chief, Director General Alan Purisima in the SAF mission, the investigation of the death of 44 SAF operatives would certainly take a new course. Napeñas said that he was reporting directly to Purisima during the operation in Maguindanao. In other words, Purisima is aware of the operation right from the start. The sacked police general also disclosed that the operation to get Jemaah Islamiyah terrorist Zulkifil Abdhir, a.k.a. “Marwan,” a bomb expert who had been training Filipino terrorists in Mindanao, was a brainchild Purisima prior to his suspension in December. Perhaps, that was the
reason why Napeñas has been reporting directly to the suspended Purisima. We suspect that Napeñas has been personally directed by Purisima to keep things under wrap for fear that the operation would bungle. Napeñas also alleged that the operation always failed every time the army is involved. Was Napeñas accusing the men of the Armed Forces of the Philippines (AFP) headed by General Gregorio Catapang responsible for spilling the beans every time an operation to get Marwan then? Or, was Napeñas trying to justify the move of the SAF, which was under him at that time, to break the chain of command because he has the blessing of the suspended PNP Director General? Napeñas, however, said that Purisima did not give orders to execute the Maguindanao operations. If not Purisima, who gave

Napeñas the go signal to proceed to Mamapasano, Maguindanao to allegedly serve the warrant of arrest against “Marwan?” While top government officials and retired military Generals have the notion that President Aquino could be held responsible as the Commander-in-Chief, both Napeñas and Catapang had issued statements exonerating the President. Napeñas said that he has already submitted evidence
to the Board of Inquiry that would shed light about the Maguindanao incident. By the way, who are the members of the Board of Inquiry? It appears that various investigative bodies of the government are now dipping their fingers into the Maguindanao incident where 44 SAF operatives were killed. We could sense that the investigation into the incident would turn haywire as conflicting and varied results of the investigative bodies clash to arrive at a consensus of absolving one person – the President. But, we could also feel that the more the incumbent administration tries to cover up the involvement and culpability of “high valued” public officials, the more the infectious arguments would surface to unravel the unseen hands behind the carnage of 44 SAF operatives in Maguindanao. -0- react: crisguardian@ yahoo.com
The facts Admitted by both the government and the Moro Islamic Liberation Front (MILF)-Bangsamoro Islamic Freedom Fighters (BIFF) is the armed clash between their forces early morning on Jan. 25 that lasted for 11 hours claiming more or less 56 lives, 44 from the state security forces and 12 from the other side. The armed clash was an offshoot of the killing by the 390-man Philippine National Police Special Action Force (SAF) commandos who swooped down into the MILF-BIFF lair in one of the barangays in Mamapasano town in Maguindanao to effect the arrest of two well-known bomb experts linked to an international terrorist group, the Jemaah Islamiya. The SAF commandos went to the rebel lair covertly for obvious reasons. Announcing their arrival would alert and thus prepare those who may be protecting the bomb-making experts, Malaysian terrorist Zulkifli bin Hir, alias “Marwan,” and local terrorist Abdul Basit Usman, who carried prices on their heads totaling $9 million. carried out by any person or unit in authority such as the police and any other state security force. It was just right for the SAF to take upon themselves the task of carrying out the court issued warrants of arrest for the two terrorists. The fact that there were 392 SAF commandos summoned to undertake this very critical arrest proved beyond doubt that the leadership of that police force did not take lightly the subjects they took upon themselves to arrest. The secrecy by which they carried out their task was definitely understandable. The SAF unit was not expected to go on radio to announce what they were tasked to undertake. Eve r y d e c is i on t he leadership of that police unit made to carry out its self-imposed task could be considered judgment
call, meaning it was made in exercise of a discretion that was theirs in the first place. But in the process of effecting the arrest, force had to be used, and in this case the subject international terrorist’s ability to fight back had to be contained hence the shot or shots that ended his life per story that came out in the media. The killing of Marwan must have alerted the MILF-BIFF forces in the area. If the combined forces of the two rebel groups were not in any way protecting the two suspects hiding in their lair, would they have reacted the way they reacted by engaging the arresting team in a running gun battle that lasted for 11 hours? Remember that the armed clash only started during that phase when the policemen involved in the operation were to be extracted from the area already. Were the policemen sacrificed as insinuated by some quarters? Certainly not! Were they just after of the tag price on the head of each terrorist as insinuated also by some quarters with nothing better to do? Certainly not also. The whole incident will answer the two questions above. What’s the need to sacrifice the policemen when their mission was

To view human nature and our limited perspective can be quite humorous at times. We want others to be patient with us, but we have difficulty being patient with others and especially if it has a negative impact on us. Notice how grateful we are when a driver behind us is patient and understanding with
accomplished and in fact it was their ability to carry out their mission that the combined MILF-BIFF armed groups retaliated? Do they want to say the retaliation was a calibrated one so the policemen could be sacrificed? Honestly, I don’t find any logic in this argument. Some others would like to accuse the policemen also that they were dispatched to Mamapasano town because of the price tags on the heads of Marwan and Usman. But like the other accusation, this one does not have any logic either. If they were just after of the money, why will they not ensure that everything will be to their favor? Do they want us to believe that the policemen were sacrificed so they can’t have a share of the bounty? But who ambushed or massacred the 44 SAF members during the extraction process? Their comrades? Were they not the MILF-BIFF forces? So why this tall tale? Was it failure of intelligence? I don’t think so also because they were able to pinpoint which house Marwan actually stayed? This brings us to the logical conclusion that the MILFBIFF forces were there to protect the two terrorists. Did the policemen know this? I think so also because See bacon, page A10

Investigation of mysterious crash of chopper continues By GERRY LEE GORIT Correspondent
THE Philippine Air Force (PAF) is now looking into three angles surrounding the mysterious crash of an UH-1 Huey helicopter on February 4 inside the parade ground of the 4th Infantry Division in Camp Evangelista, Cagayan de Oro City, said Armed Forces Chief Lt. Gen. Hernando DCA Iriberri yesterday. Iriberri, who was in Cagayan de Oro City to grace the 4th Founding Anniversary of the 4th ID on February 5, said there
are three things that the investigating team of PAF is looking into. First, he said whether the crash of Huey helicopter is caused by mechanical error or, a pilot error. And third, he added whether the weather or, environment has something to do with it. He also admitted that the helicopter, which crashed inside the 4th ID camp, was old. “Totoo na luma na, pero napakaganda naman ng maintenance na ginagawa ng Philippine Air Force,” Iriberri told reporters. “We really have to rely
on the outcome of the PAF investigation in regard to the unfortunate incident,” he said, adding, “sila naman talaga ang may supervision sa lahat ng ating aircraft.” At around 3:42 p.m. on February 4, a combat utility helicopter mysteriously turned upside down, inside the 4ID camp injuring one of the four passengers. 4ID Spokesperson Maj. Christian Uy said the crash happened while the helicopter was taking off. A pilot was injured while three other passengers were unharmed. The Vietnam-vintage
helicopter had just ferried 4ID chief Maj. Gen. Oscar Lactao and his staff from Butuan City when it met the accident. He said the helicopter was part of a two-chopper mission that brought him back to Cagayan de Oro from Bangasi, Butuan City. “We rode on the chopper from Butuan and there was no problem with it. I was already in my office when I heard a loud crash,” Lactao said. He said when he looked outside his window, he saw the helicopter lying on its back at the far end of the
golf course. According to Uy, the illfated helicopter will remain in its crash site until the conclusion of the investigation. It is not known whether the helicopter is part of the 21 newly “refurbished” Utility Helicopters delivered to the Philippine Air Force last year as part of the AFP’s modernization program. DOST releases funds to finance study on transgender in Zamboanga City ZAMBOANGA CITY The Department of Science and Technolog y (DOST) through the Philippine Council for Health Research and Development (DOST-PCHRD) has approved the release of almost P250,000 study grant on transgender in this city. DOST Regional Director Brenda NazarethManzano said Wednesday the study is entitled “Clinical and Metabolic Profile of Male-to-Female Transgender in Zamboanga City.” Ma n z a n o s a i d t h e study is expected to start next month and shall be completed in six months. Manzano said the research will receive funding assistance of P232,223 from the DOST-PCHRD through the Zamboanga Consortium for Health Research and Development (ZCHRD). Troops kill ASG member in Sulu clash

AMBOANGA CITY - The government troops have killed a member of the Abu Sayyaf Group (ASG) and recovered four high-power firearms following a firefight in the hinterlands of Sulu, the military reported Thursday.

said the Joint Task Group Sulu identified the slain ASG member as a certain Murasil, a trusted aide of
Hatib Hajan Sawadjaan, a mid-level leader of the ASG. Muyuela said the firefight ensued around 9:10 a.m. Thursday at Sitio Kan Udang, Barangay Taglibi, Patikul, Sulu. Muyuela said the firefight broke out when the Joint Task Group Sulu headed by 1Lt. Dennis Arado chanced upon the group of Sawadjaan while
they were conducting law enforcement operation in Sitio Kan Udang, Barangay Taglibi. She said the troops have also recovered four highpower firearms abandoned by the Abu Sayyaf brigands. She said there was no casualty reported on the government troops who figured in the firefight. (PNA)

Agusan agri, trade, economic mobility get boost from Australian road rehab A GUSAN DEL SUR – A critical section of the National Road Junction (NRJ) – Sibagat – Esperanza Road has just undergone Rehabilitation with Minor Improvement (RMI) and has been turned over on Thursday to the provincial government here. Governor Adolph Edward Plaza, who received the symbolic handover from Counsellor Geoff King of the Australian Embassy, said that he has always been a staunch supporter of the program because he believes that the rehabilitation and maintenance of the road is crucial to trade and eco-
nomic mobility in the area. He is also very thankful for the assistance extended by the Australian government. The provincial road provides access to the municipalities of Sibagat and Esperanza, which are mostly agricultural and forest production areas supporting Bayugan City as the agri-
processing center for the province. Sibagat is the abaca and coconut production and processing center, while Esperanza is the source of rice, corn, as well as fresh and processed Tilapia. The RMI has improved the transport of agricultural produce in these towns toward Bayugan City. The project starts in Barangay San Vicente, Sibagat, which has a population of 30,074; and ends at Barangay Ilihan, Esperanza, which has a population of 47,659. BUTUAN CITY -- The Sangguniang Panlungsod of Butuan, in its regular session on February 3, 2015, passed a resolution recommending that the laboratory analysis of the potability of water provided by the local drinking water stations be done only in the city. In a resolution principally authored by Councilor Virgilio G. Nery Jr., the SP recommended that the City Health Office
(CHO) will facilitate the laboratory analysis within the city rather than travel outside, particularly to a DOH accredited facility in San Francisco, Agusan del Sur, to procure a certification of water potability. In an interview, Dr. Nery clarified that the city has its own DOH accredited laboratory located at the Butuan City Water District (BCWD). Further, Nery explained
that local drinking water operators incur additional expenses when the physical and laboratory tests of water samples are done outside the city. The resolution said that the conduct of the water potability testing in Butuan City is more convenient for drinking water operators with less cost. (Ma. Lourdes P. SAN JOSE, Dinagat Islands – The Provincial Environment and Natural Resources Office (PENRO) of Dinagat Islands has conducted a four-day writeshop conference for the preparation of the 10-Year provincial Solid Waste Management Plan (SWMP) held recently in this municipality. The activity aims to formulate the modules 3 and 4 of the 10-year SWMP of the province which focuses on the legal and institutional framework and plan strategy of the SWMP. The SWPM is a strategic tool used for more efficient implementation
of proper solid waste m an a ge m e nt s u ch a s maximizing the advent of technology by giving the solid waste generating indust r ies access to participate in recycling opportunities and other methods in order to handle the increasing wastes produced in the province. ernment helps provincial governments to improve governance systems that will enable them to maintain their roads over time, while rehabilitating and maintaining a critical core road network in 10 provinces in Mindanao and the Visayas. In addition to this road, there are four other road projects funded by PRMF in Agusan del Sur, amounting to a total cost of Php 27,897,611.07 and a total length of 33.10 km in RMI and Maintenanceby-Contract (MBC) works. Two of the projects are financed from the PRMF Incentive Fund for Agusan
del Sur, amounting to Php 13,662,859.49, as an added incentive for the Province to attain its committed performance targets. Agusan del Sur ranked first among the ten partner provinces in the incentive performance assessment. For FY 2013-2014 and FY 2014-2015, the PRMF will provide Agusan del sur with a package of capacity development activities amounting to P1,472,300. IT ALL BOILS DOWN TO US By Marnie M. Ricardo
With the heightened issue of the PNP SAF that has been ringing in our ears these days, it is just right to put into print a noteworthy act of PNP Values Formation Program National Lecturers of Camp Crame, Quezon City, Manila, namely: Gerson Ponce, Ronaldo Calumpiano and Shew Sulinay, who shared their time and insightful information on Values Formation to our teachers, parents and schoolchildren of Santiago Elementary School, Manolo Fortich 1 District, Manolo Fortich, Bukidnon last January 28, 2015. The School head of the said school, Cathy Jane Cuñada-Barron, happens to be my best friend. She
eagerly shared to me what transpired during that oneday activity which was attended by two hundred five (205) parents, one hundred forty (140) pupils and of course, eight (8) of her teaching force. Listening to her story, I was able to reflect on some important but taken for granted issue that is hurting our present generation. Surely, everyone was benefited with their lecture that day and it is my hope that they could cascade down what they learned not just to their children but to the whole community as well. As we all can see with today’s trend in our society, the children are the most affected and put in the hot seat in dealing with their everyday lives. And if we have to analyze it more intensely, it all boils
down to us – adults, whom they look up to and follow. One or two may agree with me that kids these days have more things to worry about, a little distraction to them can get them into trouble compared to kids from the past generations. They can easily be triggered and engage to unpleasant choices that they think would give them comfort, not knowing that little by little they are ruining their lives. With all these issues in the lives of our youth, there is a need for someone to step forward and do something. Parents, extended family and friends are automatically expected then to recognize these concerns and take upon themselves to make a move about it. But there are times when the people who are most involved in the life of the youth may not know how to help out
or may be preoccupied with their own lives that they fail to notice that he is falling through the cracks. This is when Churches, schools, youth organizations, teachers, parents, peers may come in. These would be wonderful groups and significant people to step in to support a youth dealing with his tough challenges. The school, with friends and teachers, primarily is the best avenue too for support when a child fails to get it from his family. Therefore, each one of us need to assess our own selves on our stand on values formation. With that school activity sponsored by our brothers from Camp Crame, I think we can best look into ourselves and improve where we need to… Because IT ALL BOILS DOWN TO US.

ways, these are not just to modernize form of teaching but also to make learning among students easier than usual. Text2Teach is a program for this kind of use. It is the Philippine version of the Global Bridge IT program which provides educational videos and lesson guides on hard-to-teach concepts and least-learned competencies in subjects such as English, Mathematics, Science, and Values Education. These videos and lesson guides are
aligned with the curriculum set by the Department of Education (DepEd) to be implemented in public elementary schools across the country. 11 countries all over the world, including Philippines already enjoy Text2Teach program. It is good how mobile technology can be used for education and how could be so beneficial to students, teachers, schools and to the country’s educational system, at large. Text2Teach program uses advanced mobile technology and is integrated with teacher-training method. Text2Teach program aims
to contribute to the quality of teaching and learning in underserved schools and communities in the Philippines. It is implemented in partnership with Microsoft, the Department of Education, local government units, Globe Telecom, and Pearson Foundation. The systems of education are levelling up just to cope up this generation’s mindset that sometimes a source of student problems. In solving such problem, it is big help that way of teaching must be upgraded through this modern time.
Surigao police facing blank wall in bus bombing SURIGAO CITY--Authorities are virtually facing a blank wall on Wednesday’s bus bombing incident in Claver town in Surigao del Norte that injured two persons. Senior . Supt. Julito M. Diray, police provincial director, told MindaNews this afternoon that they could not pinpoint anybody responsible for the bus bombing. “We are still conducting a thorough investigation,” he said in a text message. None of the passengers of Bachelor Express, Inc.’s bus number 365 were injured, but a passenger of another bus parked nearby and a restaurant employee were not spared by the blast. SPO2 Joel Verano, investigator of Claver Municipal Police Station, said no suspects
have been identified yet. Verano said he is waiting for the report of the Scene of the Crime Operatives (SOCO) on the type of improvised explosive device used during the bombing.

School-based management is an organizational approach that involves expanding of school responsibilities and authority for the improvement of school performance. It provides mechanisms for the introduction of new approaches to education that result in enhanced outcomes and that better fill the needs of the local community. The implementation of SBM represents a fundamental and systemic organizational change to increase the presence of four key resources: power, information, knowledge and skills, and performance-based rewards. Decentralization of power is one main focus of schoolbased management. Power is shifted most often from the central administration to a group. This group might be composed of administrators, teachers, parents, community members or students. Power can only be decentralized if assigned people have access to information needed to come up good decisions. In the private sector and public education, only the top positions of the organization
have much access to these pieces of information. Knowledge is also a key resource. Three kinds of knowledge and skills are important to decentralized management. First, employees need training to enhance their job skills and be a good contributor to the organization. Next, they need teamwork skills to participate effectively in problem-solving, decisionmaking and communicating. Finally, employees need organizational knowledge such as budgeting and personnel skills, understanding of the environment and strategies for responding to changes in the environment. Rewards is also a resource serving a key of SBM. This part allow organizations to reward employees for the knowledge and skills they possess. The creation of SBM is to direct an organization to improve performance. It is possible much if this approach is accompanied by organizational changes that enhance the information, knowledge and skills of participants that align the reward system with clear desired outcomes.

The squid investment came out to be the most profitable venture of the organization while engag-

AN ORDINANCE ESTABLISHING A PICK-UP TERMINAL FOR PUBLIC UTILITY BUSES, PUBLIC UTILITY JEEPNEYS, AND VANS FOR HIRE AT THE ROBINSONS MALL-BUTUAN GROUNDS AND IDENTIFYING THE LOADING, AND UNLOADING AREA FOR AUTO CALESA (AC) AND TRICYCLES-FOR HIRE, AND FOR OTHER PURPOSES Be it ordained by the Honorable Sangguniang Panlungsod of Butuan in session assembled, that: SECTION 1. TITLE. This Ordinance shall be known as the “Robinsons Place Butuan Pick-up Terminal”. SECTION 2. DECLARATION OF POLICY. It is the declared policy of the City Government of Butuan to exercise its powers in the promotion of the general welfare of its inhabitants. For the commuting public, the city shall, among others, provide safe, efficient and orderly use of the streets and adequate terminal services. It is also the declared policy of the City Government of Butuan to encourage Public-Private Partnership in the aspect of constructing public facilities subject, of course, to certain terms and conditions. SECTION 3. SCOPE OF APPLICATION. This Ordinance mandates the establishment of a pick-up terminal for various transport facilities at the Robinsons mall grounds. It also provides certain regulatory and management measures appurtenant thereto.
5.4 Traffic Management and Security Measures:
The LTTMO and the Butuan PNP Traffic Division in coordination with Robinsons security management shall impose strict compliance to traffic rules and regulations inside the pick-up terminal premises and shall assign traffic enforcement officers to maintain peace and order and to render an effective and efficient services to the riding public. The PNP Butuan and the OCEE security personnel in coordination with Robinsons security management shall provide and impose strict security measures to ensure and maintain a safe and secure environment for passengers including their belongings within the premises of the pick-up terminal.
5.5 Repairs and Maintenance. The maintenance of the stability of the terminal building shall be by Robinsons. The repair and maintenance, however, of the terminal facilities e.g. comfort rooms, benches, passengers’ lounges, air-conditioning units, steel barriers, etc., including the disposal of solid and liquid wastes, janitorial services,security services, and payments for power, water, and other utility bills shall be by the City.

5.6 Stalls for Rent. The leasing of commercial stalls of kiosks within the terminal premises, fixing and collection of rental, and maintenance thereof shall be by Robinsons. However, the City thru the CEEMB in coordination with Robinsons shall formulate strategic plans in assisting businesses, vendors and new entrepreneurs from the Integrated Terminal who may be affected by this Ordinance. In coordination with DTI, TESDA, NLRC and other private entities. OCEE may provide technical and financial assistance to the affected parties.
1. CITY - refers to the City Government of Butuan;
2. MALL – refers to Robinsons Place Butuan which is located along J.C. Aquino Avenue, Butuan City.
3. Pick-up Terminal – a designated area where passengers are to be pickedup from the mall wherein which public utility vehicles, vans, buses are all coming from the Integrated Terminal of the City. They are given not more than two (2) hours to pick-up passengers in the pick-up terminal.
4. ROBINSONS – refers to Robinsons Land Corporation.
5. STALL – refers to a space with structure for the purpose of displaying saleable goods and/or wares intended for public utility vehicle passengers.
6. TERMINAL – the public transport terminal facility for Public Utility Buses, Public Utility jeepneys, and Vans-for-hire which shall be established in the mall grounds.
Incoming: From Diosdado Macapagal Bridge, turn right to South Montilla Boulevard and proceed towards North Montilla Boulevard, turn Left to Salvador L. Calo Avenue, turn left to the Road beside the Lagoon, turn left to Andaya Road, then turn right towards Premium Bus Terminal. Upon leaving the Premium Bus Public Terminal, Public Utility Buses shall then proceed to Robinson’s Place Pick-up Terminal by turning right to Andaya Road, turn right to Montilla Boulevard, turn right to J. C. Aquino Avenue towards Robinsons Pick-up Terminal.
SECTION 5. MANDATE. There is hereby established at the Robinsons mall grounds, a pick-up terminal for public utility buses, public utility jeepneys, and vans for hire, including loading and unloading areas for Auto Calesas (AD) and tricycles-for-hire, under certain terms and conditions as may be agreed by the City and Robinsons, to provide the commuting public a safe, efficient and orderly use of transport facilities and free the city streets and highways from being utilized as parking areas or terminals for public transport vehicles.
Outgoing: From Robinsons Pick-up terminal, turn left to Capitol Bonbon road towards Capitol Drive, turn left to T. Guingona Sr. Avenue, turn right to Pizarro Street, turn right to South Montilla Boulevard towards Villa Kananga Road, turn left to Mayor Democrito Plaza Avenue passing Diosdado Macapagal Bridge, then turn right to Antongalon-Taligaman Junction and proceed to its destinations.
The Contract between the City Government and Robinsons Management shall be fifteen (15) years and renewable for another fifteen (15) years.
5.1 Location, Structure and Design. A pick-up terminal shall be constructed in an area to be identified and designated by Robinsons within the mall premises. The plan and design must be in accordance with the standard set by the National Building Code.
A loading and unloading area for tricycle-for-hire shall also be established along the Capitol-Bonbon road for the general welfare of the riding public and a waiting shed shall be constructed to protect the passengers from heat and rain.
The Terminal Manager in coordination with the LTTMO and the Robinson Manager shall jointly designate an Auto Calesa (AC) Bay Parking Area within the premises of Robinsons Place to load and unload its passengers.
5.2 Facilities: The terminal must have the following facilities:
Incoming: From J. C. Aquino Avenue, turn left to North Montilla Boulevard, turn left to Salvador L. Calo Avenue, turn right to the the Road beside the Lagoon, and proceed towards Van-for-hire Terminal. Upon leaving the Van-for-hire Terminal, they shall proceed to Robinsons Pick-Up Terminal by turning right Andaya Road, turn right to Montilla Boulevard, turn right to J.C. Aquino Avenue towards Robinson’s Place Pick-up Terminal.
The Terminal Manager shall:

6.2.2 WESTBOUND ROUTE (Bound to Cagayan de Oro City)
1. Twelve (12) parking bays or more; 2. A waiting area sufficient for twenty (20) transport vehicles; 3. Office space for the terminal supervisor and other designated personnel; 4. Air-conditioned customers’ lounge; 5. Separate comfort rooms for male and female; 6. Baggage Counters; 7. Stalls for rent; 8. Drop-Off Area; 9. A mini-park; 10. Appropriate information and directional signs; and 11. Among all other facility which Robinson may construct for the safety and convenience of the riding public or passengers.
The provision of the building code requiring all building facilities must be followed as to the compliance of “Persons With Disability Act”. 5.3 Operation. The pick-up terminal shall be operated by the City. It shall be under the supervision and control of the Office of the City Economic Enterprises and shall be managed by a Terminal Manager whom the

Calo Avenue, turn left to the Road beside Lagoon and proceed towards Van-for-hire Terminal, they shall proceed to Robinsons Pick-Up Terminal turning right Andaya Road, turn right to Montilla Boulevard, turn right to J.C. Aquino Avenue towards Robinson’s Place Pick-Up Terminal. Outgoing: From Robinsons Place Pick-Up Terminal, turn left to Capitol-Bonbon road towards Capitol Drive, turn left to T. Guingona Sr. Avenue, turn right to Pizarro Street, turn left to Montilla Boulevard, turn right to J. C. PROHIBITION CLAUSE. Sub-leasing or assignment of any part or portion of the terminal or third party agreement involving the terminal without the written consent or approval of Robinsons is not allowed. Use of the terminal and its facilities by colorum vehicles is strictly prohibited. Parking or loading and unloading outside the designated areas are also strictly prohibited. The terminal premises is a strictly “No Illegal Vending or Peddling Zone”. SECTION 9. PENALTY CLAUSE. Violators of any provision of this Ordinance shall be penalized as follows: Description Amount 1. First Offense P 500.00 2. Second Offense P 1,000.00 3. Third Offense P 1,500.00 plus fifteen (15) days suspension from parking in the terminal, if the violator is a transport operator. 4. Fourth Offense P 2,000.00 plus recommendation for revocation of franchise by LTFRB. SECTION 10. ADMINISTRATIVE PROVISION. The Office of the City Economic Enterprises is hereby mandated to formulate the Implementing Rules and Regulations within thirty (30) days upon approval of this Ordinance, subject to the approval of the Sangguniang Panlungsod. Thereafter, a three (3) week dry-run shall be conducted by the LTTMO in coordination with the Office of the City Economic Enterprise to evaluate its practicability and orderliness, and submit a written report or recommendation to the Sangguniang Panlungsod upon the completion of the dry-run. SECTION 11. REPEALING CLAUSE. Ordinance, Resolutions, Executive Orders, and other issuances or provision/s thereof inconsistent with any of the provisions of this Ordinance are hereby repealed, amended or modified accordingly. SECTION 12. EFFECTIVITY. This Ordinance shall take effect after the completion of the Pick-Up Terminal and its facilities and the salient features published in a local newspaper of general circulation and posting of copies in the bulletin board in two (2) other conspicuous places in the City of Butuan. LET a copy thereof be provided to the City Mayor’s Office, City Administrator, City Legal Office, City Economic Enterprise Office, TEB/LTTMO, Permits and Licenses Division, the Presidents of the Van-for-Hire Associations and other transport cooperatives or organizations/associations, and to all others concerned for its widest dissemination, information and appropriate action. Yet, it is being held hostage to compel the MILF leaders to admit guilt and make amends. BBL entanglement Where are reason, fairness and truth in implicating the BBL and Bangsamoro? How the BBL is being entangled – held at gun-point, maligned – is outrageous. That’s bearing false witness against one’s neighbor. It is being argued that the Mamasapano massacre showed the insincerity of the MILF in negotiating peace with the government. It is being asked why, if there is an existing peace agreement, the MILF attacked the SAF commandos who, being on legitimate mission, they were supposed to support. They, the MILF, betrayed the government. The attack against the SAF commandos showed the Moro hostility to non-Moros in their controlled areas. Once the Bangsamoro is established, the Moros will restrict the entry of the non-Moro elements in their region. The MILF must show their sincerity. They must surrender their commanders and fighters who killed the SAF commandos. They must return all the guns, other battle gears, shoes and other personal belongings stripped from the 44 dead SAF commandos. The BBL bill must be reviewed or better still if scuttled. It must be asked: Why blame the MILF for the Mamasapano fiasco? Does the BBL embody the alleged MILF insincerity? Will the Bangsamoro
be hostile to non-Moros? Deliberate evasion Who is responsible for the Mamasapano debacle? Where must the buck stop? Among the voluminous media reports since January 26 and still going on are the facts that deliberate evasions doomed the SAF operation to get Marwan and Usman. (Read in particular: Philippine Daily Inquirer reports of January 29, 2015: SAF chief: I am responsible; February 1: SAF chief: My men still alive at noon but no reinforcements came (1) and Army, MILF harmony turns fragile (2); February 2: ‘Don’t blame the military’, AFP to submit report finding SAF leader at fault; MindaNews, February 2, 2015: In pursuit of Marwan, deaths in the marshland; and, The Philippine Star, February 3, 2015: AFP ends inquiry, clears itself on SAF deaths). The facts: (1) Police Director Getulio Napeñas, the SAF chief, by-passed his immediate superiors in command; (2) the military had been kept in the dark until the operation had been launched and the SAF forces, pinned down, desperately needed support; and, (3) there was no coordination with the MILF. When Napeñas admitted, “I am responsible”, he meant that the buck should stop with him. Napeñas told Arlyn de la Cruz, Inquirer correspondent at large (PDI 2/1.1 above) that “his not coordinating the operation with his superiors – Deputy Director General Leonardo Espina, the PNP officer in charge, and Interior Secretary Mar Roxas – delayed the arrival of reinforcements, which cost the lives of his men”. He said “he just followed orders” without revealing
whose orders he followed. Reports point to suspended PNP Director Alan Purisima as the one who gave the go-signal. There are insinuations the President did. The plan to get Arwan was hatched in 2010 with Purisima in the lead role. The President in his televised address to the nation last January 28 said he had been continuously briefed about the plan. In another report, it was said he clarified that Purisima’s involvement ended on the day he was suspended by the Ombudsman. Did Napeñas mean that because he did not coordinate with his superiors they, in turn, did not coordinate with the military? In the reports, it was the military reinforcements that arrived too late. Had air, artillery and troop support started coming at 6 a.m. when the beleaguered SAF forces in Tukanalipao began calling, the blocking force could not have been wiped out by the MILF fighters. But the most fatal mistake was the non-coordination with the MILF according to the ceasefire agreement. Had there been coordination between the PNP-SAF and the MILF the Tukanalipao close fight – by the book, a “misencounter” – could not have happened. The coordination between the AFP/PNP and the MILF through the AHJAG (Ad Hoc Joint Action Group) is spelled out in a Joint Communique signed on May 6, 2002. Armed encounters – okay, “misencounters” – between the military and MILF forces had always been due to “lack of coordination”. Among the many instances – from security to military operations – she mentioned seven from 2012, the latest of which was the fall of the main camp of the BIFF 2nd Division in SK Pendatun, Maguindanao, town just across Liguasan Marsh from Mamasapano. In her report (PDI: 2/2 above), Cynthia D. Balana cited a military source who said that had the mission been coordinated with the military, the outcome would have been different because the military has many contacts in the MILF and that there had been no encounter between the Army and the MILF since 2010, “which means the MILF is faithful to the peace agreement”. Yet, the MILF is insincere in negotiating peace; the BBL is maligned. Inevitable consequences The Mamasapano mission or “Oplan Wolverine” was doomed right on the starting block. Secrecy without the necessary coordination proved suicidal. No amount of owning the responsibility, of finger-pointing, of passing the buck, of washing hands and of eulogies and honor awards could hide the betrayal of the 44 fallen SAF commandos by their superiors and others in the chain of command. As in classical tragedies, the tragic plot was irreversible. To sum up the inevitable: Unfamiliar with the terrain, the 80 (73 in the military report) commandos who went in were trapped. Did unfamiliarity explain why the rest of the 392-force did not enter to the rescue? In its investigative report, the military could only wonder. The 6th ID had support and reinforcement ready by 9 a.m. But the lack of proper communications tied down the military. They could not launch artillery or air support without the precise coordinates; the troops did not have the exact location of the pinned down commandos. The military finally located the commandos to recover their corpses. The AHJAG members were in Iligan City when contacted. They arrived at the scene together with the IMT (International Monitoring Group) at around 1 p.m. or 2 p.m. Only then was a ceasefire ordered – too late for the SAF blocking force trapped in the cornfield. Yet, firing did not cease. The SAF supreme commanders could only blame themselves. And, of course blame the MILF jointly with the outraged of the government and the public through the media. The widows of the slain are now crying for justice. Understanding Mamasapano Among the few open-minded, Davao City Mayor Rodrigo Duterte commented on the Mamasapano incident in simple clear common sense (Luwaran, February 1, 2015: Government violated peace deal: Mayor Duterte). He said: He, as part of the government, used the “tayo” or “we” point of view. “Pumasok ang SAF sa isang territory ng MILF, which in the first place, hindi tayo dapat pumasok. How can you correct that? Ikaw ay pumasok sa bahay ng isang tao, hindi ka naman imbitado. This is covered by a document signed by
the Republic of the Philippines.” Understanding the MILF view: “Sasabihin nila, kayo ang pumasok dito, kayo ang naghahanap ng away. May kasulatan tayo na hindi kami papasok dyan at huwag kayo papasok dito until after the peace process has been completed and there is a formula for peace already.” In a nutshell: Despite their agreement to mutually respect each other’s home, the government entered the MILF house looking for a fight. So, fight it got. While understanding the MILF, Duterte also blamed it together with the government. But instead of maligning the BBL and joining the voices to abort it, he urged that it be passed expeditiously. Meantime Government and MILF must “sort out things” and in response to the cry for justice, let justice fall on whom it should. The burden on the congress Members of the Senate and the House of Representative immediately responded with anger. They questioned the sincerity of the MILF in negotiating peace with the government and the wisdom of creating the Bangsamoro. The final hearings of the BBL in both Houses were partially suspended. In the latest reports, the final hearings will remain suspended until the AFP and the PNP can submit their investigation reports. Monday, February 9, is the new deadline. These will weigh heavily on the fate of the BBL. Ad Hoc Committee on BBL Chair Rufus Rodriguez said, “The report is crucial to help members make a decision on the BBL. Without the facts, we cannot move forward. There is a strong feeling among members for justice and more sincerity on the part of the MILF (Moro Islamic Liberation Front) to cooperate and return the firearms they took away from our SAF.” (Philippine Daily Inquirer, February 2, 2015: Lawmakers want full report on massacre by Monday) (Bold italics ours) The legislators, we believe, will ascertain from the military and police reports the culpability of the MILF to bolster, rather than change, their present thinking based on media reports. The BBL should be deliberated according the wordings and construction of its provisions. Why tie it to their perceptions of the sincerity of the MILF based on the Mamapasano incident that, in the first place, was launched without coordinating with the MILF according the long-existing, trustworthy agreement? It doesn’t augur well! The Senate and House leaderships have given the assurance that support for the BBL has not changed and it will be passed as recently schedule – the House, by the end of March. How binding is the assurance to the individual senators and representatives? How the Mamapasano fever has influenced their judgment, especially the uncommitted, will be seen during the plenary debates and the voting. In the Senate, two have withdrawn their sponsorship of SB 2804. Statements to the press of some others were not reassuring. Even without Mamapasano, the BBL is being saddled with constitutional issues. After the final hearing
of her committee on constitutional amendments, Sen. Miriam DefensorSantiago said, “The BBL cannot be passed as a mere piece of legislation at the Senate. It has to be done by revision or amendments” of the Constitution to pave way for the creation of a Bangsamoro government. Under this circumstance, the BBL will be passed by a two-third vote of all members of each House of the Congress, not by a simple majority of the quorum; and, it will be ratified in a national plebiscite, not just by the Bangsamoro constituent core areas. If this happens, the BBL will have to leap over very high hurdles. However, if the leaderships can have the BBL passed by simple majority, the questions of constitutionality and plebiscite may be elevated to the Supreme Court. Hope remains alive. But if the vote count will show that BBL is brought down in either or both the Senate and the House by the Mamapasano fever, it will be the innocent victim of the misadventure of the PNP-SAP and no hope can be expected from the Supreme Court. It’s Foundation Days fever once again TRADITIONALLY, the first quarter of the year is usually the most boring. And more so in February where Lenten season ushers in and events get to be more solemn. But things have actually changed this year. This month has more activities than ever before more so in the field of arts since National Arts Month is ongoing. In fact, I am making a second edition of my column about National Arts Month because the numerous activities slated for the occasion in this city of Cagayan de Oro alone cannot be contained in one column edition. So here goes.
Today is the sixth day of February. Let me pull up my sked on what’s gonna happen in the City by the Bay today in the field of arts. From 8:00 a.m. to 2:00 p.m., dozens of rock bands have been invited to perform at the MUST Open Stage. At 8:30 a.m., there will be a zumba session at MUST Gym. Even though zumba is a form of exercise, it can be considered an art form too as it incorporates dancing. At 10:00 a.m., there will be a verse choir performance at the MUST Performing Arts Theater. I’m particularly looking forward to this because this will be the

Apart from cosplay being an art in itself, the ability to sew one’s own costume using indigenous materials is another form of art that we ought to be proud of. At nearby MUST Grounds will be the MUST
Rap Battle. The rap community in CDO has grown larger and larger every year and MUST students are certainly growing in that circle. That’s why there are seven pairs participating in this rap battle plus a threeway battle between three veteran rappers. At about the same time, the Association of Private Secondary Schools in CDO will hold a beauty pageant at Limketkai Rotunda called APSSCO Campus Idol. In Xavier University at 7:30 p.m., the folks at Dulaang Atenista will stage a repeat of No Probs, It’s Improvs. Both Dulaang Atenista and The Xavier Stage can produce one play per season. That’s a total of four seasons a year, that’s why theater in Xavier University is very vibrant. Back to MUST Gym, indigenous dances will be presented at 8:00
