AVAO C it y - T h e city government is collecting nearly Php2 million in fines and penalties from anti-smoking violators in the first six months of 2014 as the government continues to implement the law without let-up.

Und e r t he A nt i Smoking Ordinance, violators are fined Php1,000 for first offense, Php2,500 for second offense and Php5,000 for third and subsequent offenses. The last six months July to December 2013, the city treasurer has collected Php955,500 in fines from 1,911 violators.

Dr. Domilyn Villareiz, the Anti-Smoking Task Force co-chair, expected the revenue from smoking violation will double at the end of the year. The city is already aiming for a 100 percent no-smoking in public places and business establishments.

This year from January to June, the Task Force has already recorded 2,594 violators showing an increase of 191 compared to the same period last year with 2,403.

Smuggling of luxury cars alarmed solon

A lawmaker is calling on the House Committee on Good Government and Public Accountability and the Committee on Ways and Means to jointly probe the reported smuggling of brand new luxury vehicles into the country using certain ports of entries in Mindanao.

Rep. Henry Oaminal (2nd District, Misamis Occidental) sought the inquiry through House Resolution 1308, citing reports that within a five-week period alone from December 31,

2013 to February 8, 2014, some 34 brand new luxury vehicles were smuggled into the country.

“Unless and until these furtive activities are addressed and the connections of the smugglers are duly exposed, charged and punished accordingly, the much-ballyhooed government campaign to minimize smuggling will not just be a shot in the wilderness but worse, makes it a laughing stock. He said the alleged smuggled vehicles, with a reported gross value of P150 million, including top of the line Toyota Land Cruisers and Prados, Range Rovers, a Mercedes Benz and a BMW, among others, reportedly passed through the ports of Cagayan de Oro City and the sub ports of Misamis Oriental and Ozamis City, all in Northern Mindanao, before they were transported to Manila.

Oaminal, a vice chairman of the Committee on Mindanao Affairs, said the vehicles were reportedly brought in from Italy and at the United Arab Emirates (UAE), and declared as motor vehicle parts, which

facilitated and expedited their entry into the aforesaid ports.

“This in effect may indicate that some government employees were sleeping on their jobs or worse, were in cahoots with the smugglers,” said Oaminal.

Oaminal said the smuggling reports are not only alarming and disturbing, but worse, invariably places the city of Ozamis in a bad light as a smuggling haven.

“The allegations negate the contemporaneous stature of Ozamis City as the most promising and advancing city in Northern Mindanao in terms of economic, commercial, trade, social and political strides,” said Oaminal, also a vice chairman of the Committees on Constitutional Amend-

ments, Revision of Laws, and Economic Affairs.

Oaminal said reports also alleged that customs duties and dues were purportedly paid by the importers in Ozamis City, which account for the release of the vehicles. “But with inferences from sources that the items were misdeclared as motor parts, instead of whole vehicles, not the least to mention that they were reportedly undervalued, were the payments faithful?” Oaminal said.

He said the Bureau of Customs (BOC) is reportedly tracking these vehicles and coordinating with the Land Transportation Office (LTO) to prevent registration of said vehicles in the absence of proper customs clearances.

If there’s one thing said to be constant in this world, it would be change.

Three years ago the Division of Cagayan de Oro embraced one such change. The implementation of the Dynamic Learning Program which is popularly known as (DLP). Despite questions and apprehensions, everyone cooperated as mandated. And indeed three years after it was first implemented many changes did occur to teachers and students alike who danced their way through the system.

The teachers from Cagayan de Oro City shared their insights on the program after three years of having used it. They say that a lot of good things came out of it for the students and for the teachers as well. In this program, teachers who are the facilitators do less talk, thus decreasing the possibility of developing any kind of throat illness. Likewise, access to lessons and resources are straightforward because

everything is already plotted.

Furthermore, there were positive manifestations on the part of the students. Among them; 1. It provided for more independence in learning; hence, DLP focuses more on student activity, with the teacher acting simply as a facilitator.

2. It helped develop students writing abilities. The activity exposes the students to more writing opportunities.

3. It allows for a better interaction among peers for the program in more on studentstudent interaction.

4. The perennial problem of students going out of their classrooms has lessened for they would opt to gather inside their classroom and work on their activities, instead.

5. Students’ problems/difficulties are easily addressed because students’ individual progress can be regularly monitored.

On the other hand, the teachers identified some of the pro-

gram; downsides, among which are the following: A. Teacher’s Concern: 1. Teachers usually cram in transferring from one room to another as classes were done parallel; more so if a topic needs much time to be explained or discussed.

2. Checking of activity sheets took a toll on the teacher’s time, considering the number of classes a teacher holds or handles every day.

3. Deepening of a lesson already taken up is hard to integrate due to time constraint, not to mention the catching up with the lessons.

B. Student’s Concern; 1. Some say it is too exhausting on their part for they need to accomplish more than five activity sheets everyday.

2. For students considered to be academically late bloomers, they find the program difficult to cope with; of course we understand that they are among

those who need more time for discussion and explanation to ensure a better understanding of their lessons.

As previously stated, CHANGE is the only invariable thing in this world, and change if it is for the BETTER should always be welcomed. But because acceptance and implementation of change is always complied with responsibility, so we must also accept the fact that there is a need to revisit, and revise, if needed. Evaluation is always part and parcel of implementation.

Everyone needs to work flexibility through the system. We will not be able to achieve our aim if we don’t cooperate and are not open to change and other possibilities.

DLP? ……. The program, the system is good. All we have to do is look into its beneficial effects and nurture it. As to its negative side let us identify it, find ways and means to correct it and not be afraid to revise it or change it for the betterment of everyone.

SECTION 1. Title – This ordinance shall be known as “AN ORDINANCE REGULATING THE USING, SELLING AND ADVERTISING OF TOBACCO PRODUCTS AND IMPOSING PENALTIES FOR VIOLATIONS THEREOF AND FOR OTHER PURPOSES”. Or otherwise known as “SMOKE FREE ORDINANCE OF IMELDA, ZAMBOANGA SIBUGAY”.

SECTION 2. Purpose – it is the purpose of this ordinance to safeguard public health and ensure the wellbeing of all its constituents by protecting them from the harmful effects of smoking and tobacco consumption, reducing potential exposure to tobacco marketing and advertising, restrict its accessibility and provide support and a conducive environment for tobacco users to quit.

SECTION 3. Coverage – This Ordinance shall apply to all persons, whether natural or juridical, whether resident or not, and in designated places, found within the territorial jurisdiction of Imelda, Zamboanga Sibugay.

SECTION 4. Definition of Terms – As used in this Ordinance, the terms below shall have the meanings ascribed to them in this section. Any words or terms not defined shall be given their plain and customary meanings, unless the context requires otherwise, and shall be interpreted in a manner consistent with the purpose and spirit of this Ordinance. a) Advertising and promotion – means any form of commercial communications, recommendations or action with the aim, effect or likely effect of promoting a tobacco product or tobacco use either directly or indirectly. b) Civil society organization (CSC)- refers to a legally constituted voluntary civic and social organization or institution created with no participation of government organizations, including but not limited to charities, development non-governmental organizations (NGOs) community groups, women organizations, faith- based organizations, professional associations coalitions and advocacy groups duly recommended by the Office of the Municipal Health Officer and approved by the Municipal Mayor. As used in this ordinance, CSO does not include organizations or associations related to or connected with the tobacco industry in any way. c) Designated Smoking Area- refers to an outdoor space, duly approved by the Municipal health Officer, where smoking may be allowed without violating this ordinance, that meets the following requirements: 1) It shall not be located in an open-space with no permanent or temporary roof or walls in an outdoor area.

2) It is not located in entrances, exits, or any place where people pass or congregate.

3) It shall not have an area larger than 10 square meters.

4) Food or drinks are not served in the designated smoking area.

5) No building shall have more than one designated smoking area.

6) Minors or persons below the age of 18 shall not be allowed inside.

7) The designated smoking area has the following signage highly visible and prominently displayed: a) “Smoking Area” signage with message showing “Minors not allowed within these premises. b) Graphic health warnings on thee effects of tobacco use.

8) It shall not be located in places where absolute smoking bans are in effect, such as; but not limited to: centers of youth activity such as playschools, preparatory schools, elementary schools, high schools, colleges and universities, youth hostels and recreational facilities for persons under eighteen (18) years old; elevators and stairwells; locations in which fire hazards are present, including gas stations and storage areas for flammable liquids, gas, explosives or combustible materials; within the buildings and premises of public and private hospitals, medical, dental and optical clinics, health centers, nursing home dispensaries and laboratories; public conveyances and terminals; food preparation areas and other areas where absolute smoking ban is imposed under current laws, administrative and executive orders, memorandum circular and other policies. d) Enclosed or partially enclosed – means being covered by a roof or enclosed by one or more walls or sides, regardless of the type of material used for the roof, wall or sides, and regardless of whether the structure is permanent or temporary. e) Minor – refers to any person below eighteen (18) years old. f) Outdoor advertisement – refers to any sign, model, placard, board, billboard banner, bunting, poster, streamer, light display, device, structure or representation employed outdoors wholly of partially to advertise or promote a tobacco product to the public. g) Person-in-charge – refers to: in case of public places, public outdoor spaces and workplaces, the president/manager in case of a company, corporation or association, the owner/proprietor/ operator in case of a single proprietorship, or the administrator in case of government property, office or building, in case of public conveyance, the owner driver, operator, conductor, or the captain of the public conveyance; in case of schools, the provincial/municipal/city schools superintendent or the principal. h) Point-of-sale – refers to any locations at which an individuals can purchase otherwise obtain tobacco products. i) Public conveyance – refers to modes of transportation servicing the general population, such as, but not limited to elevators, airplane ships, jeepneys, buses, taxicabs, trains, light rails transits, tricycles, and other similar vehicles.

J) Public places- means all places, fixed or mobile, that are accessible open to the public or places for collective use, regardless of ownership or right to access, including but not limited to, schools, workplaces government facilities, establishments that provide food and drinks accommodation, merchandise, professional services, entertainments or other services. It also includes outdoor spaces where facilities are available for the public or where a crowd of people would gather, such as, but not limited to, playgrounds, sports grounds or center, church grounds, health/hospital compounds, transportation terminals, markets, parks, resorts, walkways, entrance ways, waiting areas, and the like. k) Second-hand smoke – means the smoke emitted from the burning end of a cigarette or from other tobacco products usually in combination with the smoke exhaled by the smoker. l) Smoke free air – is air that is 100% smoke free. This definition includes but is not limited to, air in which tobacco smoke cannot be seen smelled, sensed or measured. m) Smoking – means being in possession or control of a lit tobacco product regardless of whether the smoke is being actively inhaled or exhaled. n) Tobacco Products – means products entirely or partly made of the leaf tobacco as raw material which are manufactured to be used for smoking, sucking, chewing or snuffing such as but not limited cigarette, cigar, pipe and chewed tobacco. o) Tobacco Industry – refers to organizations, entities, associations, and individuals that work for or in behalf of the tobacco industry, such as, but not limited to, tobacco manufacturers, wholesale distributors, importers of tobacco products, tobacco retailers, front groups and any other individuals or organizations, including, but not limited to lawyers, scientist and lobbyists that work to further the interests of the tobacco industry that compete with those of tobacco control. p) Tobacco Industry Interference- refers to a broad array of tactics and strategies used by the tobacco industry to interfere with the setting and implementation of tobacco control measures. q) Workplace – means any place used by people during their employment or work, whether done for compensation or voluntarily, including all attached or associated places commonly used by the workers in the course of their work (for example, corridors, elevators, stairwells, toilets, lobbies, lounges). Vehicles used in the course of work are considered workplaces.

SECTION 5. Prohibited Acts – the following acts are declared unlawful and prohibited by this Ordinance: a. Smoking in enclosed or partially enclosed public places, workplaces, public conveyances (whether mobile or stationary) or other public places, as defined in Section 4; b. For persons in-charge to allow, abet or tolerate smoking in places enumerated in the preceding paragraph; c. Selling or distributing tobacco products in a school, public playground or other facility frequented by minors,(option: offices of the Department of Health (DOH) and attached agencies, hospitals and health facilities), or within 100 meters from any point in the perimeter of these places); d. Selling or distributing tobacco products to minors; e. Purchasing tobacco products from minors; f. Placing cinema and outdoor advertisements of tobacco products; g. Placing, posting, or distributing advertising and promoting materials of tobacco products, such as leaflets, posters and similar materials, in any place outside the premises of point-of-sale establishment. h. Placing posting or distributing advertising & promoting materials of tobacco products, such as leaflets, posters & similar materials, even inside the premises of point-of-sale establishments when the establishments are not allowed to sell distribute tobacco products, as in Section 5 (c) above SECTION 6. Duties and Obligations of Persons in-Charge - Persons in -Charge shall: a) Prominently post and display “No Smoking” signages in the locations most visible to the public in the area where smoking is prohibited. At the very least, a “No Smoking” sign must be posted at the entrance of the area. The “No Smoking” sign shall be at least 8X11 inches in size and the international No smoking No smoking symbol shall occupy no less that 70% of the signage. The remaining lower 30% of the signage shall show the following information: b) Prominently post and display “No Smoking” stickers in the most conspicuous location within the public conveyance. At the very least, the three and a half (3.5) square inch “No Smoking” stickers shall be placed on the windshield and the ten (10) square inch “No Smoking” sticker at the driver’s back seat; c) Remove from the place where smoking is prohibited all ashtrays and any other receptacles for disposing cigarette refuse; d) For persons-in-charge of schools, public playgrounds, health or other facilities frequented by minors, post the following statements in a clear and conspicuous manner; SELLING, DISTRIBUTING, ADVERTISING AND PROMOTING CIGARETTES OR OTHER TOBACCO PRODUCTS IS NOT ALLOWED WITHIN 100 METERS FROM ANY POINT IN THE PERIMETER OF (name of SCHOOL/PLAYGROUND/ETC.) e) For persons-in-charge of schools, public playgrounds or other facilities frequented by minors, officers of the DOH and attached agencies, hospitals and health facilities report to the Smoke free Task Force tobacco products sale, distributions, advertisement and promotion from establishments and properties located within 100 meters from its perimeter. f) For persons-in-charge of approved point-of-sale establishments, post the following statement, together with a pictorial health warning on the health consequences of tobacco use, as prescribed by the Municipal health office, in a clear and conspicuous manner.

SALE/DISTRIBUTION OF TOBACCO PRODUCTS TO MINORS IS UNLAWFUL

g) For person-in-charge of point-of-sale establishments, remove all forms of tobacco advertisements other than those found inside their premises; h) Establish internal procedure and measures through which this ordinance shall be implemented and enforced within the area of which he or she is in-charge. This includes compliance to the sales, distribution, advertising and promotion restrictions, warning smoking violators in banned areas and requesting them to stop smoking and if they refuse to comply, asking them to leave the premises and if they still refuse to comply, report the incident to the Municipal Health Office and the nearest peace officer or to any member of the Smoke Free Task Force. i) Ensure that all the employees in the establishment are aware of this ordinance and the procedure and measures for implementing and enforcing it.

SECTION 7. Persons Liable – the following persons shall be liable under this Ordinance: a) Any person or entity who commits any of the prohibited acts stated in Section 5 hereof; b) Persons-in-charge who knowingly allow, abet, or tolerate the prohibited acts enumerated in section 5 or who otherwise fail to fulfill the duties and obligations enumerated in Section 6 hereof.

SECTION 8. Penalties – the following penalties shall be imposed on violators of this Ordinance: a) Violation of Section 5 (a) and Section (6) i. First Offense ii. Second offense iii. Third & subsequent offense-

b) Violation of Section 5(b), (c), (d) and (e) i. First offense ii. Second offense - iii. Third & Subsequent offense

c. Violation of Section 5 (f), (g) and (h) i. First Offense ii. Second Offense iii. Third & Subsequent offense

P 200.00 or community service of 2 hours P 400.00 or community service of 4 hours P1,000.00 or imprisonment for a period of 6 hours and not exceeding 24 hours, or both at the discretion of the court. Suspension or revocation of business license or permit (in case of business entity or establishment) if applicable.

P 500.00 or community service of 5 hours.

P1,000.00 or community service of 10 hours.

P 1,500.00 or imprisonment for a period of 8 hours not exceeding 24 hours, or both at the discretion of the court. Suspension or revocation of business license or permit (in case of a business entity or establishment) if applicable.

P 1,000.00 or community service of 10 hours P 1,500.00 or community service of 15 hours P 2,500.00 or imprisonment for a period of 12 hours not exceeding 24 hours or both at the discretion of the court. Suspension or revocation of business license or permit(in case of a business entity or establishment) if applicable.

d) Community service – If a violator is unable to pay the fines imposed he or she may choose to render community service to the municipality of Imelda, Zamboanga Sibugay. Every hour of the community service is equivalent to P 100.00 of the fine. e) Revocation or Suspension of License. the license to operate of any establishment or of any public conveyance covered by this ordinance shall also be suspended or revoked should the same fail to perform the necessary action within fifteen (15) days upon receipt of violation notice or fail to pay the corresponding penalty as stated in the Citation ticket for the violation committed within seven (7) working days. However, the license to operate of any establishment or of any public conveyance shall be suspended for at least one (1) week but not more than one (1) month, or revoked. Should the license or permit to operate of a specific establishment or of any public conveyance, found to be in violation of this ordinance, fall outside of the jurisdiction of the municipality of Imelda, Zamboanga Sibugay, the recommendation for revocation of license shall be forwarded to the appropriated agency or governing body. The suspension or revocation of the license to operate of the erring establishment or public conveyance shall only be lifted once all the requirements set forth upon re-inspection and evaluation of the Health Department, the Business Permits and Licensing Office and the appropriate agency or governing body has been fully complied with.

SECTION 9. Citation Ticket System – Violators of this Ordinance shall be informed of their violation and the penalty associated with such violation by means of a Citation Ticket System with the following guidelines: a) Official booklets of Citation Tickets shall be issued by the Treasurer to duly authorize enforcers within ninety (90) calendar days of the affectivity of this ordinance. b) A Citation Tickets shall be issued to the person/s liable for any violation of this ordinance upon fining of the violation by duly authorized enforcers. c) A Citation Ticket shall contain the following information: 1. Checklist of the violations under this ordinance; 2. The fines associated with each violation; 3. Option to render community service in case violator is unable to pay fine; 4. Due date for compliance with the obligations imposed by the ticket. d. When Citation Tickets is issued to a violator, the violator shall report to the Treasurer’s office or its duly authorized collecting agent, within three (3) regular business days after such issuance, where he or she shall either pay the fine imposed or render community service under Section 8 (d) hereof. e. The Treasurer’s Office shall keep a duplicate of all Citation Tickets issued to violators as well as all other records of violations of this ordinance.

SECTION 10. Smoking Cessation Program – The health Officer with the assistance of the representative designated under Section 16 hereof, shall develop, promote and implement a Smoking Cessation Program and encourage the participation therein of public and private facilities which may be able to provide for its requirements. Smokers who are willing to quit and/or those found violating this ordinance may be referred to the Smoking Cessation Program and its facilities.

ENFORCEMENT SECTION 11. Smoke Free Task Force- Task force shall be created to aid in the implementation, enforcement and monitoring of this Ordinance and to protect the same from tobacco industry interference at all times, as well as to conduct educational awareness campaigns information dissemination programs, and capacity building, that will inform the constituents and train enforcement officers.

The Task Force chaired by the Municipal Mayor shall be composed of the following: a) Municipal Health Officer b) Municipal Engineer c) Representative/s of none or more civil society organizations (CSO) designated by the Health Officer under Section 16 hereof; d) Representative of the Philippine National Police (PNP); e) Municipal Treasurer; f) Environmental and Natural Resources Officer (ENRO); g) Representative from Dep Ed, CHED and /or Academe; h) Local President of the Municipal Liga ng mga Barangay ng Pilipinas (association of Barangay Captain); i) Public Safety Officer j) Other member/s identified by the Health Officer (whose specific function in the LGU and role may be relevant in the effective implementation of this ordinances).

The Task Force shall not include as its member any person or entity upholding or accommodating tobacco industry interests or is connected in any way to the tobacco industry in order to protect the primary health objectives of this Ordinance from any and all interests prejudicial to tobacco control policies and to preserve its integrity. No member of the Task Force shall also receive for himself or for other individuals, beneficiaries or groups, any contribution or compensation, directly or indirectly, whether financial or otherwise, from the tobacco industry. Non-compliance of this provision, governing the Task Force, by the public official and government personnel, shall be subject to sanctions prescribed under CSC-DOH Joint Memorandum Circular 2010-001.

SECTION 12. Duties and Responsibilities of the Task Force- Other than (1) receiving reviewing and processing reports of and complaints for violation of this Ordinance and (2) deputizing enforcers under Section 13 to 16 hereof, the Task Force-headed by the Municipal Mayor shall have the following respective duties and responsibilities; a) The Health officers shall: 1. Serve as the overall coordinator among all the LGU officers involved in the implementation of this Ordinance; 2. Make tobacco control, including the implementation and enforcement of this Ordinance, a part of the health program to be proposed for funding by the general budget of the LGU; 3. Monitor compliance in public places, establishments, conveyances, point-of-sale, designated smoking areas (DSAs) and other offices in charge of enforcing this Ordinance; 4, Facilitate together with enforcers and/or Task Force members the imposition of Fines, suspension, or revocation of permits/licenses for violations of the same; 5 . Assign a hotline or any other number to which violations of this Ordinance may be reported by phone call or SMS and a person to operate the line and record reports; 6 Develop, promote and implement a Smoking Cessation Program as stated under Section 10.

7. Develop and produce information, education and communication materials on the harms of second-hand smokes well as on the provisions of this ordinance; 8. Encourage constituents of the LGU to monitor and report violations of this ordinance; 9. Monitor compliance in public places, establishments, conveyances, point-of-sale, designated smoking areas (DSAs), and other offices in charge of enforcing this ordinance; 10. Coordinate with enforcers and/or Task Force members the imposition of fines, suspension, or revocation of permits/licenses for violations of the same; b) Municipal Engineer shall: 1. Conduct, together with the Health Officers or on its own, inspection activities as provided in this Ordinance; 2. Determine whether or not enclosed or partially enclosed public places, workplaces or other public places, and point-of-sale establishments, comply with the requirements of this ordinance. c) Municipal Treasurer shall: 1) Print the Citation Tickets and copies of this Ordinance for distribution to the public; 2) Issue Official Citation Tickets to the enforcers; 3) Collect and receive fines paid by a violator and submit reports relating thereto to The Task Force; 4) Designate collection agents, as necessary, to assist in efficient collection of fines; 5) Make a primer summarizing the provisions of this Ordinance; 6) Order the suspension of revocation of permits and licenses of establishments found to have violated this ordinance, subject to the provisions of Section 8 hereof; 7) Deny renewal of permits and licenses of violators of this Ordinance; 8) Establish procedure for identifying and marking store/establishments covered by the 100-meter restriction on sale and distribution of tobacco products.

The environment and Natural Resources Officer and/or representative shall: 1) Assist in promoting awareness of this Ordinance as a component in the protection and conservation of the environment and in encouraging public support and participation in its implementation and enforcement; 2) Assist in inspecting and monitoring violations of the Ordinance on its own or with member of the Task Force; 3) Conduct periodic monitoring of air, water, soil quality and other studies pertinent to determining levels of exposure to tobacco smoke, residue by products and litter; 4) Provide the expertise in the application and management of appropriate technologies to avert environment risks and damage posed by tobacco smoke, residue by products and litter. g. The representative from DepEd, CHED and/or Academe shall: 1) Implement the department Orders on the integration of tobacco control education into the curricula; 2) Ensure strict compliance of Department Orders on protection of the bureaucracy from Tobacco industry interference as per FCTC Article 5.3; 3) Ensure strict compliance of schools in enforcing 100% smoke free campuses and school facilities including the schools vehicles; 4) Ensure the posting in clear and conspicuous manner No Smoking signs, and notices for No Selling of Tobacco products within 100 meters from its perimeter. h. The Local President of the Liga ng mga Barangay ng Pilipinas (Association of Barangay captains) shall: 1) Assist in promoting awareness of this Ordinance in encouraging public support and participation in its implementation and enforcement; 2) Coordinate with all Barangay Captains and the PNP in monitoring violations of the Ordinance within their jurisdiction; 3) Provide the necessary coordination among the Barangay Health Workers, Kagawads and Tanods and other enforcers (I,e. Coast Guards) for the implementation of activities pertinent to the ordinance; 4) Assist in the facilitation of an referrals to the Smoking cessation Program at the Barangay Level; SECTION 13. Enforcement on Individuals – members of the PNP and/or persons duly deputized by the Task Force shall apprehend and issue Citation Tickets against persons found in violation or have failed to comply with any provision enumerated under Section 5 and 6 hereof. They shall forward copies of the tickets they issue violators to the Treasurer’s office regularly or at least once a week. If the violator is a minor (person below 18) he or she must be brought to the nearest Social Welfare office for dispensation of appropriate action subject to RA 9344(Juvenile Justice and welfare Law).

SECTION 14- Enforcement of Public Conveyances- Members of the PNP and/or persons duly deputized by the Task Force shall inspect public conveyances during their regular hours of operation and shall issue Citation Tickets upon discovery of any violation of this Ordinance. They shall forward copies of the tickets they issue violators to the Treasurer’s office regularly or at least once a week.

SECTION 15 –Enforcement of establishment – Ninety (90) calendar days after the effectivity of this ordinance, an inspection team composed of representative from the Municipal Health office, the Engineer’s office and the Treasurer’ Office, shall conduct inspection of establishments and buildings to determine their compliance with the provisions of this Ordinance. Regular inspection shall thereafter be conducted at least once every month or simultaneously with other regular inspections done by the LGU whichever is more frequent, during normal hours of operation of the establishment.

The inspection team shall issue a Citation Ticket against the establishment upon finding of non-compliance with or of any violation of this ordinance. A Citation Ticket may be issued for each day that the establishment is found to be non-complaint.

Re-inspection of the establishment shall be done on any day after the issuance of the Citation Ticket, but in no case more that ten (10) calendar days after such issuance.

If the establishment fails to comply with the obligations stated in the Citation Ticket upon re-inspection, the inspection team shall recommend the suspension of the license to operate of the establishment, consistent with Section 8(d) hereof.

In the course of inspection, the inspection teams may apprehend individual violators and request the assistance of the PNP in doing so.

SECTION 16- Civilian Participation in Enforcement – Within thirty (30) calendar days from the effectivity of this Ordinance, the Municipal Health Office shall designate, with the approval of the Office of the (Municipal Mayor), one or more Civil Society Organization (CSO) to discharge the duties and responsibilities enumerated in Section 12 (g) hereof.

The Task Force may deputize qualified civilians to serve as enforcers to this Ordinance.

Any person can file with the Task Force a report of or complaint for any violation of this Ordinance.

INFORMATION CAMPAIGN a. In coordination with the Office of the Mayor; 1) Provide at least two(2) copies of this Ordinance to every PNP station or precinct in the LGU; 2) Provide a primer on this Ordinance for every member of the PNP in the LGU & 3) Conduct lectures to brief members of the PNP members of the provisions of this Ordinances and or their responsibilities with respect to its enforcement. b. In coordination with the Treasurer’s office, give a copy of the Ordinance and its primer to all existing establishments that are licensed to operate and open to the public, as well as to those applying for a new license to operate. c. In coordination with the Health officer, give a / copy of this Ordinance and its primer to all public utility vehicle operators in the LGU. SECTION 17- Public Billboards, Notices in Barangays – Upon effectivity of this ordinance, the Engineer’s office shall put up billboards in conspicuous places in the LGU to notify the public of the restrictions and sanctions imposed by the ordinance.

Health officer shall also immediately issue for dissemination at the Barangay level notices regarding the obligations of persons under the ordinance.

SECTION 18- Conduct of Orientation Seminars and Trainings- Within sixty (60) calendar days from the effectivity of this Ordinance and periodically thereafter the Health officer and the CSO representative designated under Section 16 hereof, and/or other members of the Task Force, shall develop and conduct a series of orientation seminars and trainings for the enforcers of this ordinance at least one for each group, including but not limited to, deputized enforcers like Barangay health workers and the Barangay Tanod, and the local PNP. FINANCING SECTION 19- Funding – An initial funding to defray the expenses necessary for or incidental to the implementation of this Ordinance in the amount of P 50,000.00 shall be sourced from the Municipality of Imelda funds and is hereby allocated. Every year thereafter, at least P 100,000.00 shall automatically be included in the Annual Budget of the Municipality of Imelda’s plans and programs.

The above expenses include, but are not limited to: a. Costs of printing copies of this Ordinance, the Citation Tickets and information, education and communication materials, pertaining to tobacco control. b. Cost of inspection and enforcement by the Smokefree Task Force including allowances for meals and transportation, the amount of which shall be set by the office of the Municipal Mayor. c. Incentive or reward for private citizens who report violations of the Ordinance. d. Institution and operating expenses of the smoking cessation program and facility. e. Other expenses associated with the implementation and enforcement of this Ordinance.

Proceeds from the administrative fines shall form part of a trust Fund that will be used to defray costs of operation of the Smoke free Task Force, The latter shall be empowered to determine how the trust Fund is to be utilized in furtherance of this Ordinance.

SECTION 20- REPEALING Clause – All ordinances contrary to or inconsistent with this Ordinance are hereby repealed or modified accordingly.

SECTION 21 – Separability Clause – If any part or provision of this ordinance is declared unconstitutionally or invalid, the same shall not affect the validity and effectivity of the other parts or provision hereof.

SECTION 22- Effectivity Clause – This ordinance shall take effect fifteen (15) days after its publication in a newspaper of local or general circulation or posting in at least two (2) conspicuous places in the municipality of Imelda.

Add’l 30 bunkhouses up in Masepla TS

AMBOANGA CITY - The Department of Social Welfare and Development (DSWD) has committed to construct an additional 30 bunkhouses at the transitory site (TS) in Masepla, Mampang that can accommodate over 700 families more.

If this will be accomplished, decongestion of the Joaquin Enriquez Memorial Sports Complex (JEMSC) can be realized given the other temporary measures being implemented by humanitarian partners in cooperation with the local and national government.

The commitment was made

by DSWD Assistant Secretary Vilma Cabrera in a meeting with Mayor Beng Climaco in City Hall recently.

Last July, Social Welfare Secretary Dinky Soliman pledged to allocate P5 million for the construction of a proposed transitory site at the 25-hectare HGL property in Kasanyangan.

Mayor Climaco is hopeful that with all the interventions in place and the collaborative efforts of the concerned agencies in the implementation of the temporary

Teaching is often said a noble profession.

It’s a calling; a mission to fulfill. The society depends much on education to shape the future. And teachers are the prime movers of change/ progress that the society hopes to achieve.

In the educational system, a teacher plays a lot of role. A teacher serves as parent, a guidance counselor, a friend and even a nurse to the students. Practically, a teacher is all in one. But does anyone know the journey of a teacher with this all in one role?

The very basic role of as teacher is to provide the students with a good learning environment where the necessary knowledge and skills are acquired. Such acquisition prepares the students academically for the demands of the changing times. A teacher cautiously prepares and conducts lessons each day per learning area to develop the students’ mental capacity. The teacher strives hard so as to see his/her students land a good job in the future.

Another function of a teacher is to cater the students emotional neds. The emotional strength of the individual is one big aspect that determines his future. How a child treats the situation at hand is a very crucial thing that a teacher should handle. A students’ emotional stability is as important as his educational success. A teacher guides, assists and listens to each student for any emotional disturbances that the later may encounter along the way.

The physical growth of the students is also a teacher’s concern. He/ She ensures the students’ health and wellbeing. A physically fit student is so capable of internalizing the lessons presented. A teacher provides activities and programs to maintain good health and at times cure simple illnesses. There are times when a teacher provides food to the needy ones.

A teacher needs to have a constant communication with the parents and other adults surrounding every child so that they will “get on the same page” with regards to nurturing the child. There are times when a teacher has to conduct home visits especially to parents who are reluctant to go to school and to those who are so focused with earning a living that they forgot to monitor their student’s progress in school. It is the best avenue where parents/guardians and the teacher meet and discuss the child’s welfare.

A teacher can be a student’s best friend in whatever aspect of life. Students may share their feeling of happiness or bitterness to the teacher. A teacher cries and laughs with the student. It’s one best way to know the student better. It is also an effective way of saving students from danger should they be able to go to the wrong persons to open up to. As Mike Rose explains in “Lives in Boundaries”, an educator must be open

minded person that shows respect to the students’ diversity and give love and caring attitudes towards

students.

Those are just few of the many roles of a teacher. But to top it all,

LOVE is the key. A teacher performs his/her all in one role because of love. He/ She love his/her work and

students. He/ She is strongly devoted to guiding the students towards the road of success.

ANILA - A nationwide market study revealed that Philippine Long Distance Telephone Company (PLDT) Home is the broadband provider with the fastest and strongest internet connection among all internet service providers (ISP) in the country.

In the survey, which was conducted by market research organization Philippine Survey and Research Center (PSRC), showed that respondents who were aware of the different ISP brands, rated PLDT Home the highest marks.

This goes for both signal strength and internet speed, according to PLDT. The survey was con-

ducted in key cities and towns across the country among 1,200 male and female decision-makers or influencers of telecommunication services for the household, aged 18 to 60 years from ABCD homes.

The bane of an opinion writer I have been away for quite some time. The readers have been asking the whereabouts of this column.

Perhaps, I have reached a point of despair in writing opinions. Perhaps, it is the desolate feeling that to become an adversary of the status quo is a miserable proposition. Perhaps, I have reached a point that the journalist who fight for what is right is often the object of contempt of peers in the industry. Other accused those journalists who tell the truth as political drum beaters. There is a notion that underpaid, and oppressed, the journalists in this country become the subject of abused by the industry and the politicians. Those who have high respect of the profession of letters felt these agonizing thoughts.

In retrospect, the thought of doing evil becomes the best alternative of survival. We come to think that immorality has become the only option left to be respected and revered. That the politics

of personal destruction and the culture of deception has become a plague that has eroded the moral discernment of our society. These evils have tormented the people’s quest for fairness, for justice and destroy the moral ascendancy of our leaders.

The wickedness in our midst becomes transparent that an attempt to rectify it becomes a bane of evil forces. It is very unfortunate that to fight for truth and righteousness becomes a lonely battle of the few who resist becoming part of the conspiracy of malevolence.

Like the others, I also want to settle down in silence. I just want to keep my eyes close and pretend that I know nothing about the freedom of thoughts and ideas. Perhaps, like the monks in the barren

mountains, my mind will find solace in meditative silence. Perhaps, tolerance is the best antidote to remove the tumor of social and political corruption.

However, I am not convinced that a mediocre society would rise from the shackles of political and social venality. One should stand up to inform the people of the imperfection of their leaders.

Somebody must have the courage to speak up, to write, and expose the evils of those who are in power.

The act is not a challenge to wrest arms with the mighty in the political and social spectrum. It is an act aimed at opening the minds of the mediocre in order to awaken them – of the right to fight for equal justice and in the pursuit of worthy leaders.

Road concreting project in Gingoog City

GINGOOG City––Amid the burning heat of the sun, Mayor Marie de Lara Guingona spearheaded the ribbon cutting, turn-over and acceptance ceremony of the newly upgraded road connecting in barangays Capitulangan and Alagatan. In her speech, Guingona said the infrastructure project “paves, way for peace and progress.”

Titled as the upgrading of Brgy. Alagatan farm to market road (FMR), the lady mayor has acknowledged the efforts of the Department of Agriculture (DA) - Northern Mindanao under its Regional Executive Director Lealyn A. Ramos for allocating P1.8 million from Mindanao Rural Development Program (MRDP) under the second phase of the Adaptable Program Loan (APL2) which targets on Rural Infrastructure (Rl).

Her administration has cashed out its equity of same amount totaling the said project to P3.6 million which smoothens the former humpy-dumpy 2.1- kilometer road that now provides better access to commuters, reduces hauling costs of agricultural products, and lightens farmers’ daily travels.

She further extended her sincere recognition to the personnel of City Agriculturist Office led by Mr. Eduardo Garcia Sanchez and Engr. Randy Tecson in facilitating all MRDP-funded projects.

Prior to the ceremony of turning over the project certification to Punong Barangay Emilyn Bucio, the incumbent leader sentimentally narrated the tragic ambush of her beloved mother, former Mayor Ruthie, strafed at Barangay Capitulangan near the boundary of Barangay Binakalan after attending Barangay Alagatan’s 2013 fiesta-related affair. Responded with residents’ pensive mood, Mayor Marie shared to them the immeasurable pain and restless disposition she had felt during that terrible incident that hassled the entire city.

As a consultant, I have the privilege of seeing what is inside the organization and yet still perceived to be an outsider who can handle the secrets of the insiders. It is sad to see people suffer for feeling unappreciated, unnoticed. It is sad to hear people speak of being ignored and treated like a pair of hands, nothing more, nothing less. And the most unfortunate thing is when this kind of feeling continues for years! And then management wonders why productivity is low or why its star performer suddenly bolted out and joined the competition.

Like Robin Williams who had to fight addiction when he was not making audiences roll in laughter, organizational members also have imperfect lives that unfortunately are not left behind at the company door at 9 AM to be retrieved at 6 PM on the way home. And most importantly, as members of the human race, they scream for attention.

Along with the pulse of other observers, she has sensed that the wandering rebellion in these areas is never the solution to achieve peace and order. She has been challenging those who are in the armed struggle to lay down their

The importance of developing an inclusive climate in classrooms

Promoting learning is not just commonly on discussing lessons and making it certain that students remember each thought the next time a teacher asks for a recap, but it also means encouraging them to love learning, engage in most activities and be involved in classroom interaction. It is important that a productive and inclusive climate is seen inside the learning environment.

There are simple ways to realize an inclusive climate in the class that is the same time result to a productive outcomes.

Examining assumptions is important. True, it is common for instructors to assume that student share own background the same to the teacher, but this perception is not really good because a group of students in a classroom varies in religion, sexual orientation and economic class.

Using students’ names in class is also better. This

makes a student feel that he is given importance to. This also let the students know that a teacher makes an effort to remember names.

Establishing ground rules for interaction is also best way to assure that other students are also being inclusive and respectful. In order to generate maximal buy-in into the ground rules, a teacher can involve the students in the process of establishing them. He still need to enforce the ground rules and correct students for the occasional non-inclusive or disrespectful comment.

Being fair to all parties is also a help. This works in a class where multiple sections are merged, it is crucial to be perceived as fair, especially in grading and in implementing rules and regulations that should be observed inside the class.

If this matter is ignored, perceptions of teacher’s unfairness can encourage feelings of helplessness which are highly demotivating

This year has seen a rise in the frequency, duration and potential damage from DDoS attacks.

“Our data shows that up to one-third of DDoS attacks launched worldwide are directed at the financial sector. This includes banks, trade unions and the like,” said Donny Chong, Nexusguard Head of Products.

“This is a major threat, especially now that most banks and financial institutions have already established an online presence ? many have launched websites that customers can access to conduct anything from simply checking their account balance to transferring funds from one account to another,” added Nino Valmonte, IPC Director for Product Management & Marketing.

Chong warns against the financial impact of such attacks. “To put things in perspective, if a DDoS attack were to bring down the Philippine Stock Exchange (PSE), even if it is for a few hours during trading, the PSE would have to suspend all tradings for the day,” Chong said.

Apart from incurring financial losses, companies are also at risk of sustaining other forms of damage.

Valmonte notes, “Companies must understand that falling victim to these attacks will not only lead to financial implications, but may also tarnish their business’ reputation. Customers will have the perception that you’re not good enough to protect their interest. Also, losing data can leave your company open to lawsuits by clients whose private details were exposed because of an unmitigated attack.”

DDoS attacks happen when the target website is flooded by malicious traffic generated by infected systems called botnets, causing the targeted server to be overwhelmed with connections and crash, refusing new connections to be made.

However, according to IPC and Nexusguard, unscrupulous individuals and groups have devised new strategies utilizing DDoS attacks.

“Cyber criminals are now using DDoS attacks as an accessory to even bigger assaults such as illegal wire transfers and fraud,” said Chong.
