DAVAO CITY -- The Department of Trade Industry (DTI) and the Department of Interior and Local Government (DILG) is initiating reforms to raise awareness on local government units (LGUs) in providing efficient delivery of services particularly in reducing red tape.

Uy attends two-day international conference for female parliamentarians

SECOND district Rep. Juliette T. Uy of Misamis Oriental represented the Philippines in the just-held International Conference for Female Parliamentarians held in Naypyidaw in Myanmar on October 4-5, 2013.

The conference carries the theme “Women’s Leadership in Politics: Promoting Women’s Interests in Parliament.”

During the conference, Uy, who spoke on the topic of female parliamentarians focus on specific policy areas, was joined by Leyte Rep. Lucy Torres-Gomez (4th District) who tackled the role of Philippine women in political transition processes.

The conference was organized and fully-sponsored by the Konrad Adenauer Stiftung and neophyte Rep. Uy ably engaged their counterparts from Asian and European nations. (MRS)

‘Worst flood’ hits Zambo

ZAMBOANGA CITY — Floods due to intermittent heavy rains since Friday submerged parts of this city Tuesday in what an official said is “the worst flood to hit Zamboanga City in recent memory.”

Adriano Fuego, Office of Civil Defense director for Region 9, told MindaNews Tuesday morning that at least 11 villages in the city

were flooded.

100 days: An ‘acid test,’ Emano

GINGOOG City, Misamis Oriental––Although developing tourism took center stage, the alleged corruption of the previous administration became the major topic of the provincial governor’s 100-day report here on Tuesday.

Gov. Yevgeny Vincente Emano told a jam packed crowd of over 1,000 at the Lugod Gym when he delivered his 100-day office report since he assumed the gubernatorial post of Misamis Oriental last July 1, 2013 that his administration has been “burning candles” to overcome the current financial malady of the province.

“My 100 days in office was an ‘acid test’ of an infantile administration marred by alleged corruption and financial mismanagement of the previous administration,” Emano said accompanied by a power point presentation of the financial

woes because of alleged squandering by the former Gov. Oscar Moreno.

Emano delivered the 100-day report in Gingoog City Tuesday morning while his provincial administrator Edmundo Pacamalan Jr. separately rendered the same report at the provincial Capitol in Cagayan de Oro City on the same day.

The governor has chosen Gingoog City, a component city, some 200 kms east of Cagayan de Oro City, as the

venue of his 100 days in the office report as a symbolic gesture of bringing his administration closer to the people of Misamis Oriental.

Emano told the crowd that the development of the tourism industry would become the flagship of his administration armed with the pessimism of transforming Misamis Oriental as the tourism hub in Northern Mindanao in the coming years.

“It would excite the people of Misamis Oriental if they will learn that the two-day tourism summit held last week in Medina was excessively successful,” Emano said.

He said that the term “excessively successful” was an exaggerated figure of speech that aptly described the positive responses of stakeholders in the tourism industry during the two-day summit.

“The province of Misamis Oriental got the commitment of support amounting to over P100 million from the private and public sectors, notably, the Department of Tourism and the “Tourism Infrastructure Enterprise Zone,” Emano added.

He said that TIEZA has already committed P 48 million for the initial development of bankable tourist sites in the province aside from including Misamis Oriental in the P 17 billion budget for the development of various tourist spots in the country next year.

“While we were extremely happy with the commitments and pledges from the private and government sectors to push for the development of the province’s tourism industry, we were also equally sad that the previous administration has drained the provincial cof-

fers to bankruptcy,” Emano added.

He said that an audit report of the Commissions on Audit for the 2012-2013 confirmed that Gov. Oscar Moreno has left the province reeling in debts, a financial shortage of over P 500 million, and the accountability of various equipment and properties owned by the provincial government.

“We have been collating evidence to build a strong case against those who have plundered the province of Misamis Oriental. We have started the filing of initial graft charges against those be believed were accountable,” Emano said.

The more than 1,000 contracts and job order workers who were left unpaid for more than P 14 million for several months have already received their salaries albeit on a staggered basis, he said. The provincial

government has stopped the renewal of contract workers except those working in hospitals whose services were urgently needed. After three-month in office, the province has gradually recovered from the financial crisis.

“The province was able to improve its revenue income to over P 200 million in just three months and was able to save over P 100 million after paying its obligations during the same period,” Emano said.

“We have survived those trying days where, in the beginning, we saw only darkness,” Emano.

Now, after surmounting the crucial 100-day, “I am glad to report to the people of Misamis Oriental that we have accomplished more than we have expected and, once again, assured of brighter future ahead of us,” Emano said.

LAGONGLONG, Misamis Oriental – About 360 members of a tribal community in Misamis Oriental on Wednesday asked the military and the local government unit to send them back home to their farming villages.

The displaced group belonged to the Higa-onon

tribal community who were evacuated to safer grounds after fresh fighting between government troopers and armed communist guerillas ensued in the hinterlands of Lagonglong a week ago.

The Higaonon tribes who were living in the mountain towns of Lagonglong and Balingasag

in Misamis Oriental also called the local government officials in the province to step-in for the immediate pullout of more than 200 military forces in the tribal community’s farming villages.

“We want the military to pullout their patrol bases in the in Tapol and Minkamansi all in Barangay Banglay,” a tribal leader said on condition he not be identified.

The tribal leaders want the military to leave the tribal community’s ancestral domain so that members of the tribal group could go back to their farmland due to hardship in the evacuation center here.

The provincial government has been providing the evacuees of basic needs, particularly foods, blankets, and medicines for the children.and the elderly who were reported to have been suffering from stomach disorders.

Since last week, almost 400 Lumad civilians, including children, from the two towns of Lagonglong an Bal-

ingasag decided to evacuate for fear of their safety when over 200 combined elements of the 58th Infantry Battalion and soldiers from the 403 Brigade engaged in a running gunbattle with the communist New People’s Army (NPA) rebels.

“The soldiers arrived and started to occupy the area where our houses were just few kilometers away,” the tribal leader said..

At present, they are occupying the grounds of the Balingasag Elementary School and the covered court of Lagonglong, an adjacent town of Balingasag.

About 200: children evacuees were forced to stop schooling, a report from the local government said.

The tribal leader said that the tribal community has stopped visiting their farm lots due to the presence of the military in the area.

“Naa man ang military, so gubot na pud kay ang rebelde mo-atake man. Looy on among pen-name ug mga binuhi,” (The military is there which causes the trouble since NPA would attack every now and then at the expense of our plants and raised farm animals), he said.

Vice Governor Joey Pelaez of Misamis Oriental said he “support the call of the community for the military to leave the area to ease the conflict.,” Pelaez said he would immediately call to convene the provincial committee on peace and order to respond to the situation. CD with wire reports

Lawmakers want to increase fines for libel

Lawmakers on Wednesday moved to decriminalize libel by abolishing the penalty of imprisonment provision under the Revised Penal Code.

Instead, Reps. Rufus Rodriguez (2nd District, Cagayan de Oro City) and Maximo Rodriguez (Partylist, Abante Mindanao) filed House Bill 2562 increasing the fines for violators from the present P6,000 to P30,000.

“Although this bill abolishes the penalty of imprisonment, it has increased the amount from the present maximum of P6,000 to the maximum of P30,000, to accomplish the purpose of penalizing libel and deterring would be violators,” Rodriguez said.

Rodriguez said the present law on libel infringes on the freedom of speech and of expression and negatively impacts on media practitioners.

“We cannot have that libel law in a country where democracy is primarily infringed on the freedom of speech and of expression, and where media is considered the Fourth Estate,” Rodriguez said.

Libel is defined under Article 353 of the Revised Penal Code as “a public and malicious imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status, Publication Notice RA 10172

or circumstance tending to cause dishonour, discredit or contempt of a natural or juridical person, or to blacken the memory of one who is dead.”

Rodriguez said Under the law, one is liable for libel when there is an allegation of a discreditable act or condition concerning another, publication of the charge, identity of the person defamed and the existence of malice.

The current law provides that a person guilty of committing libel is penalized with imprisonment ranging from arresto mayor or one month and one day to 6 months, to prision correccional or 6 months and one day to six years, aside from the fine ranging from P200 to P6,000.

“Wile the penalty of fine must be sustained, for no crime should go unpunished, imposing a penalty of imprisonment will work more to discourage members of the media from performing their duties with zeal and vigilance,” Rodriguez said.

Rodriguez said a libel committed by means of writing, printing, lithography, engraving, radio, phonograph, painting, theatrical exhibition, cinematographic exhibition, or any similar means shall be punished by a fine ranging from P10,000 to P30,000, in addition to the civil action which may be brought by the offended

PDEA nabs 17 in Opol drug raid OPOL, Misamis Oriental––Exactly 17 individuals were collared in a raid over suspected dug dens in Opol, Misamis Oriental on Monday, a report from the Philippine Drug Enforcement Agency (PDEA) said on Wednesday.

Emerson L. Margate, PDEA regional director in Northern Mindanao, said that of the 17 arrested, five were suspected to be “drug den”owners while the 12 others were allegedly drug den visitors at the time of the raid.

Margate identified the alleged drug den owners as Debelyn Ganas y Pacaldo, Nacnel Obsioma, Eddie Cailing, Arlyn Cailing, Carlito Villanueva, and Grace Macapayag.

Margate said that PDEA agent Vincent Cecile Orcales led the arrest during a drug buy bust operation in Zone 5, Gordo, Barra, Opol in Misamis Oriental last Monday afternoon.

He said that PDEA operatives were able to recover from the suspects 10 grams of “shabu,” the poor man’s cocaine, contained in 35 pieces of different size heat sealed transparent plastic sachets with a street value of about P 100,000.00.

He said that the seized items were submitted to the police crime laboratory for examination while the suspects were held in custody at the PDEA regional detention cell pending filing of charges with violation of Republic Act 9165, or the anti-illegal drugs act law.

DAP mess to affect power supply of 5,000 households in remote villages

SAN Francisco, Agusan del Sur-Amid the controversy that is now hounding Malacanang’s Disbursement Acceleration Program (DAP), some 5,000 households in the remote villages of this province will be momentarily deprived of their much-awaited electricity at home.

“We expect an uncertain delay in the release of DAP funds while the issue is already being heard at the Supreme Court,” said Engr Emmanuel Galarse, general manager of Agusan del Sur Electric Cooperative, Inc. (Aselco).

The households in the far-flung villages are recipients of President

Benigno Aquino’s pet electrification projects in the countryside under Barangay Line Enhancement Program (BLEP) and the Sitio Electrification Program (SLEP) of which funds are taken from DAP since it was implemented in 2011.

Galarse said they received a notice from the National Electrification Administration (NEA) to put on hold the implementation of the DAP-funded program while waiting for the advice from the Department of Budget and Management.

Aselco is expecting P114 million fund this month to implement the second batch of BLEP and SLEP that will benefit at least 107 sitios (sub villages) and three villages targeted to be finished by December 15 this year.

“ The people really felt the benefits of having electricity at home,” Galarse said adding that many households in the farthest villages where electricity have already reached have been groping in the dark at night for many years in the past. Among the recipient villages were Sabang Gibong in Talacogon town and Sabang Adgawan in La Paz town where residents are living in floating houses around the watery ponds of the wide Agusan Marsh.

Galarse said President Benigno Aquino III has envisioned that electricity will cover practically all the far-flung areas in the country through BLEP and SLEP before his term ends in 2016.

For the meantime, Aselco offi-

cials are pinning hopes to President Aquino standing firm to defend DAP even as they already expected that there could be a delay in the implementation of the electrification program.

So far, ASELCO had already implemented around P248.9 million for BLEP and SEP projects from the DAP subsidy fund. The cooperative has been cited as the number one nationwide in the implementation of the program.

If things get worse that the Supreme Court will decide DAP to be unconstitutional, the Aselco board will vigorously lobby to make the program under the regular general appropriations of the national government to ensure its continuity.

PDEA-13 warns voters against ‘narco-politicians’

SU R I G AO C i t y – – T h e Philippine Drug Enforcement Agency in Region 13 (PDEA-13) warned voters against “narco-politicians” who will be seeking reelection during the barangay elections on October 28.

PDEA-Caraga Director Erwin Ogario told MindaNews in a phone interview

Tuesday that his office has been intensifying campaign against local officials directly or indirectly involved in illegal drug activities in the region.

Ogario, without naming names, said some of these reelectionists are close friends and relatives of known drug personalities who are under their drug watchlist.

“We have been monitor-

ing them. That’s why we ask the support of the public not to vote for these politicians who have been identified as into drug trade,” he said, adding that if these candidates will win again, there is a big possibility that illegal drugs will continue to proliferate in the region.

Ogario assured the public that PDEA-13 is zeroing in on these drug personalities and politicians.

Ogario said they were able to arrest a barangay councilman and his cohort in Rosario town in Agusan del Sur dawn last Saturday.

He identified the suspects as Cesar Sangalia Fuentes Jr., 39, a barangay kagawad of Libuac of the said town, and a certain Kim Rendon Chua. Ogario said that aside from the suspected shabu and paraphernalia, they also seized guns and

ammunitions from the suspects.

He appealed to the public to coordinate with them if they have information regarding the involvement of candidates in illegal drug activities.

“We are starting to win the war against illegal drugs. We have the public’s cooperation. We don’t want narco-politics,” Ogario said.

Agsur cops arrest father wanted for child abuse BUTUAN City––Police arrested a father who is facing two charges of child abuse and is in the list as the number 8 “most wanted” person in a city of Agusan del Sur, Tuesday evening.

Reports from Agusan del Sur Police Provincial Office identified the suspect as Renato Renegado Rozano, 41; a resident of Purok 23, Brgy. Poblacion, Bayugan City.

Rozano is facing two counts of child abuse cases docketed under Criminal Cases Nos. 3961 and 3962 at the sala of Judge Hector B. Salise of Branch 7, Regional Trial Court of Bayugan City in Agusan del Sur. Judge Salise ordered a warrant for his arrest on August 15, 2013 with recommended P80,000 bail each case.

Bayugan City Police arrested Rozano when he was spotted at his residence 6:40 p.m. Tuesday.

He did not resist the arrest, according to his apprehending officers.

Rozano is now detained at Bayugan City Police Station for proper disposition.

Floodwaters reach 6 feet in some Zambo villages; more residents flee for higher ground

AMBOANGA CITY - Several barangays in Zamboanga are currently submerged in flood as of noon today, as floodwaters have already reached past six feet in some villages sending more people to flee to evacuation centers.

As of this writing, the official number of affected barangays is yet to be released.

At dawn today, the body of an old woman between 65 to 70 years old was recovered in Gulayan, San Roque. She was reportedly the house-help of a certain Edwina Bernad, an accountant of the National Food Authority (NFA) here, who was also reported missing.

Neighbors in San Roe 3 Subdivision, San Roque said Bernad was swept away by the gush of floodwaters this morning.

A coast guard rescue team was dispatched to search for her body.

The city continues to experience heavy rains and the water level, as reported by the water district, has already gone past the normal 72-meter mark, going as high as 78 meters.

Journalist Frencie Carreon in a text message confirmed that the wall separating the San Jose Gusu River from MEIN College gave in. Water rushed inside the school

campus where some evacuees are sheltered.

Teodiver Arquiza of RMN News also reported that in Talon-Talon Loop near the dumpsite, water has reached shoulder level.

Some residents in nearby barangay Tugbungan said that they already moved to the second floor of their houses. Residents with one-storey houses have evacuated to elevated areas.

Meanwhile, Congressman Celso L. Lobregat made rounds in the different barangays and bared in a radio interview that the affected barangays are Tulungatung, Sinunuc, Pasonanca, San Roque, Tumaga, San Jose Gusu, Baliwasan.

He also went to barangay Putik to assess the damage to a rip-rap destroyed by floodwaters.

In Barangay Sinunuc, around a hundred houses situated near the riverbank were said to have been washed away by floodwaters at around 2 a.m. today.

The Philippine Coast Guard has already dispatched several rescue teams to the affected villages.

At around 6 a.m. today, Mayor Beng Climaco declared that all classes in all levels would be suspended and at past 7 a.m. she also

ordered all work in both government and private offices put off, except for those who are in frontline services.

In a related development, C ouncilor Mike Alavar also reported that there was already a traffic build-up reaching 1 km along the national highway at barangay Licomo, the easternmost edge of the city, going towards Upper Tungawan.

The other reason that I could see why people are not as enthusiastic anymore in joining protest actions against the pork barrel is that the succeeding protest actions from the one held in Luneta Park attended by a mammoth crowd carries with it an additional call which is the ouster of President Aquino as president either through resignation, people power or impeachment.

Originally, this oust Aquino call because of the pork barrel scam was not part of the political objective the people had in staging the Luneta Park rally. That gathering was purely an indignation rally aimed at airing the people’s collective opposition to the pork barrel fund thus their

call for its abolition.

Let us remember that it is Aquino himself who brought to fore how this particular fund had been abused by the legislators.

And for his act, the people will now demand for his ouster from office? I don’t think there is logic here if viewed from the people’s demand for the abolition of the pork for being the source of corruption among legislators.

In fact, it was only during Aquino’s presidency that big personalities such as incumbent senators, former cabinet secretaries and other high ranking functionaries in government had been haled to court for corruption. And you expect the people to reward Aquino with a call for his ouster for his Herculean effort at bringing these people before the bar of justice?

I strongly doubt if this is the people’s way of thanking a president who is doing his best to let the abusive corrupt officials and individuals in and outside of the government answer for their shenanigans. Truth of the matter is, only those who are haled to court, those who are being made to answer for their corrupt ways who will not welcome this move by Aquino.

Just think of this. Aquino

is very much contented living a simple life. Before he became president and up to this time his taste for food is as ordinary as the one we can all buy from McDonald’s. His only past time is play games in the computer. During meetings he is very much contented eating Cagayan de Oro’s Sler’s chicharon, drinks a glass of coke and eats Snickers chocolate from time to time.

He does not have an ambitious wife. He does not have ambitious children.

He does not have a taste for expensive signature clothes.

All these facts point to the fact that Aquino could never be gobbled up by the germ called corruption. By simply comparing his life with the life of Janet Lim-Napoles, the alleged brains behind the P10 billion pork barrel fund scam, one can immediately see Aquino will never be corrupt.

So why demand for his ouster when he is not engaged in corrupt practices?

These my friends are the reasons why the numbers attending anti-pork barrel protests are dwindling.

It is common for intellectual with the statement of “publish or perish” as the slogan for scientists with research publication. Research and findings which are not published will not be read by public, the world scientists. But, research and findings which are published will be beneficial for all human beings in the world. People can read the results of the results and they can make themselves updated. In such instances, research and publication is a must. Without publication all intellectuals will perish for their works cannot be seen by other intellectuals throughout the world.

The most important thing to be paid attention is plagiarism. This bad attitude must be avoided by the intellectuals in research and publication. So far, there has been polemic dealing with plagiarism.

In scientific communities, the members are always updated with the knowledge of research and methodology. By involving in certain scientific communities, the intellectuals can replicate the methodology and quoting the previous creator of such methodology. Being open and honest in quoting other’s ideas is a must.

Committing plagiarism is prohibited. It is a bad conduct for intellectuals.

In Indonesia, for example, the lecturers who commit plagiarism will be punished by the directorate general of higher education. They can be even fired from their position. Therefore, in this country, the hot topic until recently is about the ways of how to avoid plagiarism.

Some intellectual forums have been busy discussing this serious topic.

To avoid this, intellectuals should get involved in scientific com munities. Therefore, by joining some activities in scientific communities, all intellectuals will be much knowledgeable. Many wondered why the numbers of anti-pork rally participants held Friday last week at the heart of Makati’s business district have greatly dwindled. The question being raised now is whether the anti-pork pork people this early have lost steam already in their fight against this government allocation believed by many as source of corruption.

To recall, the first antipork rally dubbed Million People March held in Luneta Park on Aug. 26 drew over a hundred thousand participants. In fact, other observers say that during the rally’s peak, some 300,000 converged at its venue. Sadly, however, the second Million People March against pork Friday last week in Makati drew less than 3,000 participants only.

Have the people lost steam in fighting against pork and its causal result which is corruption? This is now the question begging for answers.

But from where I sit, I surmise the substantial decrease in numbers, actually I believe the decrease during Friday’s rally in Makati made that activity insignificant and of no value as far as political pressure is concerned, lies in the fundamental rationale of the political act itself.

In a 2008 document entitled “A win –win deal for LGUs and entrepreneurs: Streamlining the Business Permit and Licensing System, it has been noted that in most LGUS business owners are burdened and dissatisfied by the long and inefficient processes of renewing their Mayor’s business permit.

The practice has become a disincentive to new entrepreneurs and investors to place their investments in the country. Inefficient BPLS leads to the growth of underground enterprises in those LGUs hence loss of revenues.

The BPLS oversight committee is to be composed of DTI and DILG representatives as co-chairs, concerned government agencies such

as the National Computer Center, private business groups and development partners.

The establishment of the oversight committee is contained in the DTI-DILG Joint Department Administrative Order 10-07.

In the JDAO, the DILG thru the Local Government Academy shall act as the overall coordinator of the nationwide streamlining of

the BPLS of local government units among these functions include managing the capacity-building program for LGUs on BPLS streamlining.

AN ORDINANCE MANDATING THE INSTALLATION OF CLOSED CIRCUIT TELEVISION (CCTV) OR VIDEO SURVEILLANCE SYSTEM IN THE PREMISES OF PRIVATE ESTABLISHMENTS AND PUBLIC PLACES, PROVIDING PENALTY FOR VIOLATION THEREOF AND FOR OTHER PURPOSES. Be it ordained by the Honorable Sangguniang Panlungsod of Butuan City in session assembled and by authority of the same that: SECTION 1. TITLE: This Ordinance shall be known and cited as the “CCTV Installation Ordinance of 2013.”

SECTION 2. OBJECTIVES. This Ordinance aims: a. To provide a deterrent to crimes and vandalism. b. To enable clear identification of miscreants within the range of the cameras. c. To provide continuous recording of activities from all cameras in the system. d. To confer solution in identifying the perpetrators of crimes. e. To aid in the investigation of illegal activities. f. To assist in the prevention and detection of crime. g. To reduce the fear of crime. h. To improve public protection. i. To improve the safety and security of residents, visitors and the business community. j. To facilitate the apprehension and prosecution of offenders in both criminal and public order offenses. k. To discourage anti-social behavior including but not limited to alcohol and drug related issues. l. To assist in the monitoring and managing of assets and areas of responsibility. m. To help in monitoring and directing the traffic flow. n. To maintain peace and order. o. To protect and give safety to life and property.

SECTION 3. DEFINITION OF TERMS. The definitions and provisions contained in this Ordinance shall govern in the construction, meaning and application of the following words, terms and phrases as used herein shall be construed and mean as follows: A. “Bank” means an establishment whose primary function is related to the custody, loan, exchange, issuance of money, extension of credit, or transmission of funds. And, as defined and classified in RA 8791 or otherwise known as The General Banking Law of 2000.

B. “CCTV” means Closed-Circuit Television or also known as Video Surveillance system.

C. “Department Store” refers to a large store stocking many varieties of goods in different departments, or it is retail establishment with a building open to the public which offers a wide range of consumer goods such as clothing, house-wares, furniture and appliances; and typically offers a choice of multiple merchandise lines, at variable price points, in different product categories.

D. “Entertainment Area” means an open space where people converge for concerts, games and amusement.

L. “Restaurant” is a business establishment which prepares and serves food and drink to customers in return for money, either paid before the meal, or with a running tab in which meals are generally served and eaten on premises, but many restaurants also offer take-out food delivery services; and said establishment vary greatly in appearance and offerings, including a wide variety of the main chef ’s cuisines and service modes.

M. “Schools” refers to primary or secondary schools, colleges and universities and training institutes with 100 or more student population.

N. “Shopping Center” means a building or series of buildings containing a mix of commercial establishments in a single development or on a single parcel or area.

O. “Video Surveillance System” means a surveillance system including cameras, cabling, monitors,and digital video recorders (DVR) that records in color images from cameras. The system can capture, record, store, review, playback video materials from several cameras where signals are transmitted cable or wireless transmission to the video recorder such as a stand-alone DVR.

SECTION 4. COVERAGE. 4.1 Every bank, jewelry store, pawnshop, lending institution, money changer, grocery store, department store, shopping center/mall, school, gasoline station, convenience store, restaurant, nightclub, bar, function hall, hotel, entertainment area, bingo boutique, online gaming station and all similar establishments; 4.2 The City Government and other local, regional or national agencies shall likewise install Closed Circuit Television (CCTV) in public offices, buildings or places where the public frequently converge like markets, terminals, plazas or parks, main thoroughfares or in the entrance and exit points of the City as maybe recommended by the City Police Director or designated inspector; 4.3 Establishments or government agencies, which installed surveillance systems prior to the effectivity of this ordinance, shall ensure they are in full compliance with this Ordinance; 4.4 The video surveillance systems shall be in proper working order at all times and shall be in operation twenty four (24) hours, seven (7) days a week; and 4.5 The CCTV system must be checked and maintained regularly by a License Electronic Engineer and make such report for its working condition and is in compliance to the technical standard set by this Ordinance.

SECTION 5. FEEDS: VIDEO RECORDINGS. The establishment shall keep, maintain and preserve the continuous digital images recorded by the CCTV system for no less than thirty (30) days for review and reference purposes. After 30 days, the feeds or recordings may be destroyed unless their preservation is required by court order, the local police, National Bureau of Investigation (NBI), Criminal Investigation and Detection Group (CIDG), Philippine Drug Enforcement Agency (PDEA) or the City Mayor.

SECTION 6. ACCESS TO RECORDING. In the event of a crime, the operator, the employee or the owner of the establishment has reason to believe that a crime has occurred shall contact immediately the Butuan City Police Office or National Bureau of Investigation or any Law Enforcement Agency and shall provide access to the media/digital feeds/ CCTV/video recordings containing the recorded event to the authorities. Only the police investigators and those members of the law enforcement, legislative or investigative body shall be allowed to view the video footages, unless the law enforcers recommend for the publication on TV or local newspaper of general circulation in aid of their investigation.

SECTION 7. PROHIBITION. It shall be unlawful for any person to allow the unauthorized or unofficial use or viewing of any video-recording and the unauthorized public disclosure of identification of any person or client seen in the video without prior consent from the owner or authorities. The same shall not in any manner be used to infringe with the privacy of individuals, and those found in defiance shall be prosecuted under the laws violating the right to privacy.

SECTION 8. PROPER REQUEST FOR FEEDS. The Feeds may be used at any time to satisfy authorized subpoena or the written order of any court of competent jurisdiction.

SECTION 9. NO BROADCASTING. Subject to Section 6 above, the feeds shall not be: 9.1 Broadcast by the establishment on or through any medium other than the Monitors;

E. “Feeds” is the visual information transmitted by the CCTV cameras.

9.2 Viewed by any person other than employees who are authorized to view the Monitors;

F. “Hotel” is an establishment that provides lodging paid on a short-term basis such as inn, lodging house, apartel, condotel, motel and alike.

9.3 Transferred to any third party, whether for profit or not, except as provided in the preceding Section; or

G. “Lending Institutions” refers to an institution (private or public} which offers loan to borrowers.

9.4 Recorded or otherwise stored except in accordance with this Ordinance.

SECTION 10. MINIMUM TECHNOLOGICAL STANDARDS. The CCTV or video surveillance system must be capable to playback events of the activity and physical feature of persons or objects within the premises and must be able to record such images on a Philippine standard video format.

13.4 Persons violating any provisions of this Ordinance shall likewise be fined P5,000.00.

For this purpose, it shall at least meet the following specifications:

10.1 Digital Video Recorder a. b. c. d.

one dedicated channel for each camera in operation; minimum of 640 x 480 recording resolution; recording rate at fifteen (15) frames per second per camera; sufficient memory to retain data from all cameras for a period of thirty (30) days; e. ability to view and retrieve data while the system remains in operation/recording; f. ability to time and date stamped on the recorded images; g. ability to reproduce DVD-R or USB Flash Drive copy of desired data for evidentiary purposes in a format playable via Windows Media Player or a DVD player or equivalent; h. must be placed in a locked and secured location to prevent destruction or tampering; and i. live monitoring, recovery, playback, back-up and remote access through web browser;

13.5 For purposes of this Ordinance, each day that a violation continues shall be a separate violation.

SECTION 14, EXEMPTIONS. A business or agency which is required to install a video surveillance system within a period of two (2) months may, on an annual basis, apply to the City Peace and Order Council which shall recommend to the Sangguniang Panlungsod to exempt from or in part of this Ordinance. The CPOC may exempt a business or agency for a period of twelve (12) months if they find that the business has or will undertake alternate security procedures which are substantially equal to or more effective in preventing criminal activity and in assisting in the apprehension of the perpetrators of crime.

Such an exemption shall carry a maximum duration of twelve (12) months and a business establishment or a government agency must reapply for an exemption prior to the end of the exemption period or bring the system into conformance with this Ordinance. The City Police Director and/or his/her designees may also authorize temporary extensions of time for installation when a business or agency demonstrates that it is temporarily unable to comply for good cause shown.

SECTION 15. APPEAL PROCESS. Any establishment or agency found to be in violation of this Ordinance by the City Police Director and/or his/her designee shall have the right to a hearing before the City Mayor or his/her designee.

15.1 The City Police Director and/or his/her designee shall give the establishment written notice of the violation.The notice shall set forth the grounds for the violation, and shall inform the owner or principal business operator of the establishment or head of agency that he/she has ten (10) days from the date of mailing of the notice to file a written request for a hearing.

15.2 Within ten (10) days of mailing of the written notice of violation by the City Police Director and/or his/her designee, the owner or principal business operator or agency head may appeal by requesting a hearing before the City Mayor. Such a request must be made in writing and must set forth the specific grounds for the appeal.

10.3 Monitors a.

15.3 The City Mayor and/or his/her designee shall set a a time and place for the hearing within ten (10) days thereafter. All parties involved shall have the right to offer testimonial, documentary and tangible evidence bearing on the issues, to be represented by a counsel, and to confront and cross-examine any witness against them.

10.4 Power Supply Each system shall have a stable power source to prevent interrupted operation and preferably provide an Uninterrupted Power Supply (UPS) during failure of the main power.

SECTION 11. MINIMUM COVERAGE, SITE ASSESSMENT, AND SIGNAGE. 11.1 The video surveillance system shall have, at a minimum, separate cameras dedicated to cover registration area, check-in/check-out counters, entrance/exit doors and parking lot or area designated for customers and/or employees.

11.2 The engineering plan of the placement of cameras included in the video surveillance systems required under this Ordinance shall be prepared by a License Electronic Engineer and approved by the Police Department.

11.3 The City Police Director and/or his/her designee will conduct an assessment of each site required to install a video surveillance system prior to installation and upon approval will issue a certificate of compliance certificate which shall be placed and displayed in conspicuous view inside the premises.

11.4 A notice to the public that CCTV is in operation shall be posted at the entrance, at the point of entry and/or parking area.

SECTION 12. INSPECTIONS. The video surveillance system shall be subject to regular inspection by the City Police Director and/or his/her designee, who is authorized to inspect at reasonable time any video surveillance system to determine if the system conforms to this Ordinance. If the video surveillance system does not so conform; establishments must take immediate steps to bring the system back into conformance.

15.4 The decision of the City Mayor and/or his/her designee to deny the appeal shall be in writing.

SECTION 16. SEPARABILITY CLAUSE. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance.

SECTION 17. EFFECTIVITY. This Ordinance shall take effect ten (10) days after a copy of it is posted at the Bulletin Board in the City and in two (2) conspicuous places in the City and the salient features are published in a local newspaper of general circulation.

13.2 The violation of any provision of this Ordinance by any owner or principal operator of establishments subject to this Ordinance shall result in a notice or violation from the City Police Director and/or his designee. The City Police Director shall investigate all alleged violations. Violators shall have 30 days after receipt of the notice to provide proof of compliance. If the violation continues after the 30-day period, the City Police Director and/ or designee shall issue a citation against the violator and the violator shall pay a civil penalty not to exceed P5,000. The City Legal Office is hereby authorized to bring a civil action in any court of competent jurisdiction to recover such civil penalties.

13.3 In addition to the foregoing, the violation of any provision of

UFL Cup kicks off on Oct. 12 at Emperador Stadium at The Fort

by Manila Jeepney FC vs Ceres-La Salle FC at 8 p.m.

Stallion FC are the reigning champions, having defeated Global FC at the Rizal Memorial Football Stadium in 2012. More than 11,000 runners joining 37th National Milo Marathon Davao leg DAVAO CITY, Oct. 9 (PNA) – There are now more than 11,000 runners listed in the 37th National Milo Marathon qualifying leg slated on Sunday at Roxas Avenue here.

“We have more than 11,000 already all in the 5K while the rest are from the 21K, 10K and 3K,” said local race director Kenneth Sai of Vantage Sports.

There are 300 runners now in the 21K, 200 in 10K and 100 in the 3K. “The 5K is already closed for registration,” said Sai, who said that they are aiming a target of 14,000 runners.

Last year’s leg had 13,200 runners.

Kobe Bryant rejoins Lakers after knee procedure ONTARIO — Kobe Bryant rejoined the Lakers after having a procedure on his knee performed overseas earlier this week.
