Duterte ends speculations on presidential bid in 2016

DAVAO City––Mayor Rodrigo Duterte ended speculation on his probability to run for president or any national position in 2016, saying “I intend to retire (from politics) after this term.”

“Gusto ko na mag-retire matanda na ako (I want to retire I am old),” Duterte said in an interview with reporters on Wednesday night.

IN a statement, Guiamel Alim, a member of the Council of Elders of the Consortium of Bangsamoro Civil Society (CBCS), said the submission of the draft BBL to Congress is “another milestone in the GPH-MILF peace process.”

“The fact that the MILF

agreed to the latest version of the draft , we can only assume that it is (the draft) a good legal framework that will govern the Bangsamoro autonomy,” Alim said.

He said they are elated to know that while the timeline is tight, passage of the bill is still “doable” within the year and that ratification is possible within the first quarter of next year.

AVAO City - The Cacao Industry Development Association of Mindanao (CIDAMI) in partnership with SM City Davao will hold the first Davao Chocolate Festival today until September 14 at the Atrium at SM Annex along Ecoland, Quimpo Blvd., this city.

He said educating the

people here about the production of this highvalue crop will also promote consumption of chocolates.

About a dozen exhibitors and key players will be joining the Festival as Turtur said there will be actual demonstration of cacao processing right at the venue.

The end of the world?

SINCE long time already, we are fret about several illnesses and epidemic centers all around our globe.

Now politicians, business leaders and aid organizations have called for the lifting of travel restrictions on Ebola affected nations.

They say consequences of travel bans are more serious than the virus itself.

Is this really the solution?

Doesn’t it just show another example of man’s powerlessness, being helpless in the face of Ebola?

Up to 400,000 people suffer from hunger in Ebola affected regions as a result of blocking trade routes.

The economies of these countries have also been weakened, says Jochen Moninger.

He works in Sierra Leone for the Welthungerhilfe, a German development organization that fights global hunger and promotes food security.

Moninger’s statement lets one become eye-teared, “Farm lands are not being tilled, they are no harvesters, foreign investors are holding back, there are no buyers for cocoa and other commodities”.

Eleven directors of large companies operating in West Africa have also appealed for the travel restrictions to be lifted.

They argued that the restrictions have only exacerbated the humanitarian crisis.

At a time when the deadly Ebola virus is spreading rapidly in West Africa, the demand made by Nkosazana Dlamini-Zuma, chairperson of the African Union (AU) sounds outrageous.

Speaking at the end of a crisis summit on Ebola, which took place on last Monday (September 8), in Ethiopia’s capital Addis Ababa, Dlamini-Zuma called on member states to remove travel restrictions so that people can move and trade.

“We must be careful not to introduce measures that

may have more social and economic impact than the disease itself,” DlaminiZuma said.

As we all learned during recent weeks, many countries have closed their borders to Ebola affected nations.

International airlines have also suspended flights to Liberia, Guinea and Sierra Leone in a desperate bid to prevent the virus from spreading to other countries.

However, this isolation has led to massive economic losses for the three hardesthit countries.

However, temperature checks in many international airports are now globally common.

The World Health Organization spokesperson in Sierra Leone, Nyka Alexander said her organization was facing more hurdles to bring in personnel and relief supplies due to the restrictions.

“I think the overall impact of border closures and airlines limits is a negative one,” Nyka Alexander said.

“When health workers can not fly in and out because there are no flights, then the situation becomes worse.”

Think a minute - it’s indeed correct what Nyka said. But, let’s face it: the virus is starting to spread more and more. This is the dangerousness and risk we are all in.

Is there a way to combat

the virus?

What is important, Nyka Alexander says, is to focus on the regions where the virus is spreading particularly quickly.

Instead of closing borders, better treatment options and access to food and water must be ensured.

The challenge to stop the virus is indeed huge and seems to remain impossible.

Montserado County, which includes Liberia’s capital Monrovia, lacks 1,000 beds for Ebola patients – the numbers keep rising.

Ironically, the Liberian government had to close several hospitals, as its Information Minister, Lewis Brown explained in several interviews screened over BBC and CNN. “Hospitals and clinics, rather than places for help, became places where the virus was being spread.”

According to the WHO the number of those killed by the Ebola virus stands at 2,300.

Conservative estimates reckon by the end of the epidemic, around 20,000 people would have died.

Pacman should back away from China’s embrace CAGAYAN de Oro City–– Maybe Manny Pacquiao didn’t get to consider the down side of his China deal thoroughly, but it’s not too late for him to back away from the embrace of the Communist Chinese government.

When he announced his deal with China (last week in San Francisco) he may not have realized what he was getting into aside from just training Chinese boxers.

What he did was to let the Chinese Communists dragoon him into what could be a tangled web of who-knows what motives, intrigues, or objectives are behind the deal.

Ke ep i n mind t hat Chinese politics, governance, and foreign relations evolved from thousands of years of court intrigues, conspiracies, and internecine rivalries. ***** The Chinese authorities know how popular Pacman is. They know what his endorsement, or mere presence, can do to soften Filipino resistance to any project they contemplate in any part of the Philippine archipelago.

Such is China’s economic clout today that they’re already challenging America and the world in most areas of competition.

Many diplomatic, economic, and political issues face China in the Philippines and in other members of the Association of South East Asian Nations (ASEAN) today. What role Manny Pacquiao may play in the Chinese game plan at this time or later, no one can tell, maybe not even Manny himself. ***** In his arrival interview at San Francisco Airport, Manny sounded confident and cocky. Asked whether he was worried about spreading himself too thinly by undertaking too many projects—being already congressman, family man,

playing coach, entertainer, endorser, plus his active boxing schedule—he replied that it was all a matter of “time management.” Wow! Someone should tell him he’ll be better off helping train Filipinos, especially his brother Bobby who has yet to make a name for himself.

Whatever motivated him to enter into the China deal, it should be clarified to him now that kowtowing to a hostile China is an unworthy enterprise for a congressman and a reserve officer of the Philippine Army.

China’s hostile acts in the West Philippine Sea recklessly placed that country in a position of conflict with our government. If Manny wants to help normalize the situation, he should tell China to stop its trespass of our maritime jurisdiction and stop their fisher-folks from illegally harvesting our marine resources. Then he should tell them to withdraw forces they’ve deployed in Philippine waters and dismantle the infrastructure they’ve erected in strategic islands. ***** If the Communist Chinese use Pacman to soften Filipino anger and resistance to what they’re doing, the trick may backfire. Filipinos may lose their respect for him, declare him a traitor, and treat him accordingly.

Because of China’s incursion into the West Philippine Sea, a delicate diplomatic situation obtains between the two countries now, tension rising, with potential for armed conflict. This makes Manny’s engagement with the Chinese Communists totally inappropriate.

He can’t hire himself out to the Communist Chinese for whatever purpose. One, he’s a Congressman—sworn to uphold the territorial integrity of the Philippine Republic.

Two, he’s a reserve officer of the Philippine Army (a lieutentant colonel)—sworn to fight and defend the nation’s security. Three, he’s a Filipino citizen—sworn to fight in peace or war for the nation.

In other words, Manny Pacquiao is an official of the Philippine Government.

As such, it’s his duty to resist incursions or stop trespassers, not help them steal our natural resources or grab our islands and inland waters ***** If he proceeds with this deal, he should resign his commission and rank in the Army’s reserve corps, or be stripped of it. He should also apologize to the people of Saranggani for betraying their trust and abusing their mandate—then resign forthwith as their repre-

sentative in Congress, or be stripped of his seat and replaced with a trustworthy representative who will not leave the congressional seat for Saranggani vacant again.

It’s very important for Manny to understand the gravity of being a hireling of this bullying Chinese Dragon.

He must understand how China insults our sovereignty by building structures within our territorial waters.

And so it is important for him to know how the Maoist New People’s Army daily assaults our communities in the countryside—to affirm its commitment to the Chinese Communists and prove its loyalty to the Chinese Communist Government.

If Manny doesn’t understand why he should not play ball with Communists—in China or in our provinces—he has no business being a congressman of our Republic.

It’s time someone brief him on the case our government has filed with the United Nations against China. MGen Lactao said, “I vow to reduce the threat level of violence in Northern Mindanao. I will provide security and peace of mind to our people and assist them in improving their way of life, improving our communities and of course our beloved country. We have to have a peaceful and ready for development provinces by this year and next year.”

Security forces now stronger to fight terrorism, insurgents in Western Mindanao

AMBOANGA CITY – Military and police authorities in western Mindanao have signed an agreement that would unify efforts in battling insurgencies and terrorism in that part of the southern Philippines.

Marine Capt. Maria Rowena Muyuela said senior military and police officers led by Lt. Gen. Rustico Guerrero, of the Western Mindanao Command; and Police Director Edgardo Ingking, of the Directorate for Integrated Police Operations, signed the “Joint Letter Directives” that solidify the unity of effort between the Armed Forces of the Philippines and the Philippine National Police in addressing peace and security concerns in the region.

The accord will address the growing threats pose by the Abu Sayyaf and Jemaah Islamiya militants who are behind kidnappings for ransom and terrorism; and the communist New People’s Army rebels.

The signing ceremony – held at the Western Mindanao Command headquarters in Zamboanga City - was also witnessed Lt. Gen. Felicito Virgilio Trinidad Jr., the commander of Northern Luzon, who represented AFP Chief of Staff Gen. Gregorio Pio Catapang Jr., and Police Director Juanito Vaño, of the Directorate for Logistics, who represented PNP Director General Alan Purisima.

Baldoz unveils toolbox to boost MSMEs productivity Labor and Employment Secretary Rosalinda Dimapilis-Baldoz on Wednesday unveiled the DOLE’s productivity toolbox for micro, small, and medium enterprises that could further boost their productivity and competitiveness.

“This toolbox contains a package of developmental assistance to MSMEs to ensure that they transition to a more viable and competitive enterprises and eventually comply with labor laws, including safety and health standards,” Baldoz said after the National Wages and Productivity Commission presented to her the ladderized toolbox.

According to Baldoz, the NWPC Productivity Toolbox for MSMEs is a needs-based approach to productivity improvement and contains various training courses that MSMEs can avail of.

These training courses range from foundational courses, such as work values, housekeeping, and work systems, to the more advanced training courses (green productivity, service quality).

“We welcome the submission of the draft Bangsamoro Basic Law to Congress as the next major step towards achieving peace in the country,” the statement said.

for enhancement of peace and development in conflictaffected areas in Mindanao; that signed peace agreement namely: the Comprehensive Agreement on the Bangsamoro (CAB), will be realized and contribute to the upliftment of the lives of the people,” they said.

“Peace-building is a continuing process and we in the youth sector take the challenge to help ensure that the gains of peace in this generation will be sustained and benefit all,” they added.

The youth sector also called on members of Congress “to unite -- transcend political differences -- for the crucial passage of the BBL, which is a landmark law in the history of law-making and peace-making in the country.”

“Our future is what is at stake in the success of instituting genuine autonomy in the south that serves as a political solution in addressing the decades-old conflict and peace-building to resolve the Bangsamoro right to selfdetermination,” they said.

The group also called on their fellow youth and other stakeholders “to have an informed perspective on the Bangsamoro in building an environment of mutual respect, cultural tolerance and humane society.”

“Our diversity as a Filipino people -- in religion or ethnicity -- is a gift that is weaved by our common aspiration for peace and progress.

Together, let us be critical and vigilant in appreciating the merits of the BBL that will be opened to the public and undergo deliberations and consultations by Congress.

Once the BBL is open to the public, we call on our fellows in the civil society to engage in a productive dialogue as we make yesterday’s dream of a just and lasting peace a reality of today and tomorrow,” they said.

Meanwhile, the National Commission on Muslim Filipinos (NCMF) said the transmission to Congress of the draft BBL is a welcome development for all the stakeholders of the proposed measure.

Third largest exported goods of the Philippines in July this year was other man-

ufactures with revenue of USD365.25 million against July 2013’s USD337.48 million.

Fourth largest exported products in July 2014 was other mineral products valuing at USD365.25 million versus last year’s same month of USD199.76 million while the industry with fifth largest revenue share to exports value was woodcraft and furniture with earnings posted at USD279.10 million from 2013’s USD255.73 million.

Majority of merchandise exports of the Philippines in July this year went to Japan with amount posted at USD1.21 billion. Exports to Japan increased by 24.4 percent from last year’s same period of USD974.80 million.

Second largest export partner of the country in the same month of the current year was United States of America valuing at USD801.60 million; an increment of 28.1 percent

from July 2013’s amount of USD625.88 million.

China came as the top third destination for Philippine exports. Exports to China had a flat growth of 1.7 percent to USD700.45 million in July 2014 from USD688.41 million in July 2013.

The labor and employment chief said MSMEs that avail of the free productivity orientation and training programs in the Toolbox should go “all the way”.

“This means allowing their workforce to undergo the training and to innovate by developing a workforce-led productivity improvement program/ project (PIP). Most importantly, the MSME must be committed to implement the PIP and document its outcomes,” she said.

According to Baldoz, because of the tough challenges MSMEs face, both owners/managers should

need to realize by embarking on a productivity journey that that simply cutting costs would not suffice.

“In this era of economic integration, in order to help drive sales, increase customer satisfaction, promote market diversity and develop market niches, innovation is imperative,” she explained.

She further said that the productivity technologies contained in the Toolbox are instrumental in enabling enterprises to be efficient by cutting on unnecessary costs, conserving resources, encouraging workers to innovate, embarking on a continuous process improvement, and designing and implementing recogni-

tion and reward systems.

“In this manner, enterprises become efficient by producing more using less inputs,” she said.

Baldoz bared that last year, workers in 10,532 MSMEs have availed of the Productivity Toolbox resulting to reduced costs, reduced waste/defects, organized and safer workplaces, better delivery of services, and improved workers’ morale arising from their ownership of their PIPs and recognition of their contribution.

“This year, as reflected in the DOLE Planning Tool approved by the President, we are committed to provide technical assistance to workers in 11,000 MSMEs

to improve workforce and enterprise productivity,” she also said.

She further said that the encouraging results of the 2014-15 Global Competitiveness Report provides the impetus to further intensify DOLE’s advocacy to promote productivity improvement programs among MSMEs. The country’s global competitiveness ranking went up to 52nd in 2014 from 59th I in 2013, up by 7 notches. One of the notable improvements is in the country’s labor market efficiency ranking, which improved by 9 notches, from 100th to 91st.

In the areas of wages and productivity, a significant

improvement in ranking can be observed in flexibility of wage determination (109th to 86th) and pay and productivity (44th to 27th).

Baldoz attributes this to the Two-Tiered Wage System, a new wage fixing approach introduced in 2012.

The new approach consists of two tiers: the first tier pertains to setting of mandatory minimum wage above the poverty threshold, but below average or market wage to allow bipartite negotiations to take place, while the second tier strengthens the link between pay and productivity through provision of productivity based pay schemes. Farm-to-market roads: Laying foundations for dynamic agri

F

or the past 40 years, Ramon Drilon, now 75, grows only corn and coconut in his farm located in the farthest village of Kitubod in Libungan, North Cotabato.

Much he wanted to, he and other farmers like him could not plant other crops such as banana because of the length of time it would take to transport farm produce to the nearest market and the prohibitive cost it would entail due to horrible road conditions.

“The muddy and bumpy road would take us at least two days to bring our products to the market. So why grow other crops such as banana if it would only be damaged during transport?” he said.

But now, Drilon, who is also the village chair, is expanding his farm and growing a hectare of lakatan banana.

He is also looking forward to additional income that would be raised from his nine-month-old banana farm.

Like him, other farmers in the village have also turned their idle lands into banana farms.

The sudden interest to expand to banana production was due to the newly rehabilitated 13.7-kilometer long farm-to-market road (FMR) that significantly eased the transport of their farm produce.

Rehabilitation of the FMR was completed under the Mindanao Rural Development Program (MRDP).

“Because of the new FMR, travel time has dramatically been reduced from two days to less than an hour now.

Hauling cost was also reduced from Php1.20 per kilo to only 90 centavos,” he said.

Bara said the barangay government used to impose a policy that after a heavy rain, no vehicle would be allowed to pass through the muddy road to avoid further damage.

This policy affected farmers as it caused delay in the delivery of their products.

Due to the longer delivery time, the quality of their products also dropped, resulting to lower sales and income.

“Since the road has been improved and most of the parts have been concreted, we no longer impose such policy. Vehicles are allowed to pass through anytime even during rainy season,” Bara said.

Because of the FMR, he said single-motorcycle or habal-habal fare has been reduced by half -- from Php100 to only Php50 per head -- while hauling fee of farm produce has been lessened from Php1.50 to only 50 centavos per kilo.

Aside from bringing benefits to farmers, the rehabilitated FMR has also improved the delivery of basic services such as education and health care.

Drilon said that before the rehabilitation of the FMR, school classrooms in their village were mostly made of wooden materials due to the difficulty of transporting concrete construction materials.

Residents also had difficulty in bringing their patients to the doctor of hospital, he added.

Meanwhile, Bara said the road from MRDP has also eased the schooling of children, as they no longer have to hike up to 12 kilometers just to reach the school.

Kitubod route, the number of school dropouts has significantly been reduced,” he noted.

In the meantime, the bridge component of the project connects both barangays to the adjacent town of Banisilan where farmers and residents from both areas could now easily transport and sell their farm produce.

tenance of the FMR, Bara and Drilon, as village chairs, have already issued local ordinances to that effect.

For MRDP, the acounts of Drilon and Bara showed how FMRs significantly contribute to rural development.

MRDP program director Lealyn Ramos said FMRs serve as the catalyst in improving Mindanao’s rural economy.

Data from MRDP Infographic revealed that the program had constructed a total of 1,000 kilometers of FMRs as of July 2014.

GOROSPE ESTATE DONATES LOT TO BALINGASAG

The Intestate Estate of the late Justice Benjamin K. Gorospe and Isabel P. Gorospe donated a one-hectare Lot to the Municipality of Balingasag for the latter’s BusTerminal yesterday in a formal ceremony held at the Municipality’s air-conditioned audio visual room.

The deed of donation was signed by Carlos P. Gorospe, Sr., youngest son of the family and witnessed by the widows of the late Benjie Gorospe and Edgar Gorospe, Fabiola Mariano and Lolita Roa, respectively.

The donation was accepted by Mayor Alexis S. Quina who was duly authorized therefor by the Municipal Council and was witnessed by Vice Mayor Marietta Roa-Abogado, the members of the municipal council and all Barangay Chairmen.

In an O rd e r d ate d September 2, 2014 Judge Dennis Alcantar of R T C Branch 18 of Misamis Oriental appointed Mr. Carlos P. Gorospe, Sr. as Special Administrator specifically empowering him to execute the deed of donation.

In a brief message Mr. Carlos Gorospe explained that all the heirs have taken great pride in fulfilling the “dream and the wish” of their parents in donating the one-hectare Lot. During their lifetime, Justice and Mrs. Gorospe already manifested their desire to give the area for either a public market or bus terminal, or a combination of both, in appreciation of the “humility, religiosity, their love for work, and their dedication towards development and progress” of the people of Balingasag.

On the other hand, Tinnex Jaraula invited the audience to look into the great “vista” of Balingasag having a new commercial center along the Highway with possibly Gaisano, Citi Hardware, Robinsons, and SM-SaveMore, Jollibee, McDonald’s and Chowking, among others. This will hasten the conversion of the municipality into a City, he added.

Mayor Quina expressed his deep appreciation and gratitude for the donation and undertook to start with the development of the Bus Terminal immediately, especially as the Land Bank has assured the Municipality of the availability of the loan of P15 Million for the Project.

try to live what they preach and do their very best to avoid the mistake of the past but living a life that is worthy of people’s respect.

You cannot judge a person’s motive but you can sure judge them by their actions. In other words, you will know a tree by its fruit.

I hope that this blog presents clearly if the people you know is in a state of remorse or repentance. Let us not be judgemental toward others when they fall or make mistakes. Even Jesus warns the religious people, “Let the man who had no mistakes cast the first stone.”

God is gracious to people who have done wrong. Because God knows everyone make mistakes. The issue is not the mistake but what we do with our mistakes?

Did we hide it, cover it up or even defend it?

Or did we admit it and apologize and said sorry to the people who was hurt?

i. “Incentive Law” shall refer to a law, such as the Omnibus Investments Ordinance, granting incentives to specific businesses at both the national and local levels, by virtue of the nature of their business activity pursued or the location where such business is going to be pursued or undertaken, as administered by a designated government agency or office (Registering Agency), such as the BOI.

j. “Investment Priorities Plan”/“IPP” shall refer to the annual listing of specific activities that have been identified as priority investment areas and thus encouraged by granting those engaging in the activities in the list the incentives under the Omnibus Investments Ordinance, approved by the President of the Philippines, subject to the recommendation of the BOI.

WHEREAS, Ordinance No.8268 – 2002, otherwise known as the Cagayan de Oro Investment Incentives Ordinance of 2002, provides for incentives to prospective and existing investors; WHEREAS, Ordinance No. 10014 – 2006 provides incentives to Information and Communications Technology (ICT) – related businesses;

k. “Investment Priority Areas” shall refer to the business activities which are entitled to incentives granted by the City, which investment area or business activity is specifically included in the Mandatory Investment Priority Areas (MIPAs) or Local Investment Priority Areas (LIPAs), and summarized in an Investment Priority Areas List (IPA List) which shall be amended, as necessary, once every two (2) years.

WHEREAS, Ordinance No. 11219 – 2008, approved the establishment of the Cagayan de Oro Trade and Investment Promotions Center as a tripartite cooperation among the City Government of Cagayan de Oro, the DTI - Misamis Oriental and the Promote CDO Foundation; WHEREAS, Executive Order No. 55 – 2013 issued by the present administration, created the Local Investment Incentives Review Committee tasked to formulate and recommend appropriate investment policies that will enhance the city’s position as an investment haven;

l. “Local Investment Priority Areas”/“LIPAs” are investment areas/business activities recommended by the Board and approved by the Mayor to be priority investment areas specifically in the City which are not yet among the Mandatory Investment Priority Areas and are encouraged to be pursued within the City

WHEREAS, Section 12 of Ordinance No.8268-2002 states that “the City Mayor shall promulgate the Implementing Rules and Regulations including the negative list of investments”;

m. “Local Staff” refer to a worker or personnel who is a bonafide resident of the City for at least six (6) months where proof of residency consists of the presentation of voter’s ID/Registration and a Barangay Clearance from the barangay where he resides.

Where the eligibility of an applicant to avail of incentives is anchored on its ability to generate employment, it should meet the minimum ratio of Local Staff to non-Local Staff as prescribed.

WHEREAS, the City Government under the present administration has identified Investment as one vital component of its Eight-Point Agenda; NOW, THEREFORE, I, OSCAR S. MORENO, by virtue of the powers vested in me as the City Mayor of Cagayan de Oro, do hereby provide for the rules and regulations governing the implementation of the above mentioned ordinance as follows:

n. “Mandatory Investment Priority Areas”/“MIPA” are investment areas/business activities identified by the National Government as priority areas of investment and thus encouraged through the extension of incentives not only at the national but also at the local level pursuant to applicable Incentive Law, such as those included in the annual Investment Priorities Plan.

Title I – General Provisions SECTION 1. Scope and Application – These Implementing Rules and Regulations (IRR) shall govern the exercise of authority to grant tax exemption privileges by the City of Cagayan de Oro, by virtue of Ordinance No. 8268 – 2002, Ordinance No 10014 – 2006 and Ordinance No. 11219 – 2008; to new and prospective investors as well as existing investors that may relocate or expand their operation of business in the City of Cagayan de Oro and with investment activities as defined in the priority list and not otherwise included in the negative list.

o. “Modernization or Rehabilitation Projects” refer to projects of Existing Businesses or Registered Enterprises, which projects are eligible for registration and thus, eligible to incentives if any of following conditions are met:

SECTION 2. Objective – To update the guidelines to implement City Ordinance No. 8268-2002 so as to reflect current conditions and realities and enhance the city’s competitiveness thereby attracting additional investments.

1. at least twenty percent (20%) reduction in production cost, which if sold in the Philippines should result in the reduction of the selling price of the product; or 2. significant increase in productive efficiency including debottlenecking; or 3. meaningful upgrading of product quality; or 4. upgrade in the technology used in production to bring it at par with the technology used by leading manufacturers of the product manufactured by the Registered Enterprise.

SECTION 3. Definition of terms: a. “Ordinance” – refers to City Ordinance NO.8268-2002 or the Cagayan de Oro Investment Incentive Ordinance of 2002. b. “Board of Investments”/“BOI” shall refer to the implementing agency for Books One to Five of the Omnibus Investments Ordinance (EO No. 226 dated 27 February 1987) as created under the latter.

The modernization or rehabilitation contemplated may or may not result in increase in the operating capacity/actual production output to be eligible for registration. p. “ New Projects” refer to projects or activities that have not started commercial operation, undertaken by (1) a newly organized/ formed enterprise; or 2) an Existing Business that proposes to engage in an entirely distinct activity from its existing business as would qualify as a Diversification.

c. “City” shall mean the City of Cagayan de Oro covering all the areas within its territorial jurisdiction as provided for by law and its charter. d. “Date of Official Acceptance” refers to the date the application for registration was received by the receiving personnel of the Oro- IPC and recorded in a logbook for the purpose.

q. “Project Study” refers to a project profile which presents, among others, highlights of the projected financial viability and environmental and socio- economic impact of the proposed business.

e. “Date of Registration” refers to the date when the Certificate of Registration is issued by the Mayor, through the Oro- IPC, which information shall be recorded in a Registration Logbook to be maintained by the Oro- IPC.

r. “Registered Enterprise” refers to any individual, partnership, cooperative, or corporation, whether a domestic or foreign corporation licensed to do business in the Philippines that has been issued a Certificate of Registration by the Board pursuant to this Ordinance.

f. “Diversification” refers to the introduction and production of a distinct line of products or services by an Existing Business, whether or not a Registered Enterprise; Provided, That, to be considered distinct, it should require new investment in terms of machinery or equipment or would involve the use of new skills set not currently used in the existing product or services, Provided further, That a new service or product may constitute a diversification even if such service or product is already within the scope of its original or existing business purposes.

s. “Registering Agency” refers to any other government agency/ office/instrumentality that is authorized to administer incentives under and register and regulate corporations that are enjoying incentives at the national level pursuant to an applicable Incentive Law, such as but not limited to the BOI and the PEZA. Title II – The Committee

g. “Existing Businesses” are businesses engaged in activities included in the IPA List but are already operating in the City and are intending to expand and/or diversify to other business ventures falling within the IPAs as defined herein.

SECTION 4. Composition - There shall be created the Investment Evaluation Committee to evaluate and recommend to the City Mayor the appropriate action on an application for local incentives to be composed of the following:

h. “Expansion” shall mean installation of additional facilities/equipment that will result in the increase in the production capacity of an Existing Business. It may include modernization and rehabilitation. No expansion for additional capacity shall be allowed unless applicant has attained, in general, 85% utilization of its

SECTION 29. CONTINUING ELIGIBILITY FOR REGISTRATION. – A Registered Enterprise shall continue to satisfy whatever criteria rendered it eligible for registration. Accordingly, if a Local Applicant was qualified for registration under the Incentives Ordinance, the Oro - IPC, shall have the authority to inspect the Registered Enterprise to verify that it, in fact, continues to meet the criteria. If the Registered Enterprise ceases to meet the said registration criteria that rendered it eligible for registration under this Ordinance, the Mayor shall have the authority to suspend all or some of the incentives of the Registered Enterprise or to revoke its registration subject to the provisions of Title XII below.

SECTION 30. PERIODIC AND OTHER COMPLIANCE REQUIREMENTS. – Nothing under the Ordinance exempts a Registered Enterprise from applicable requirements of the City on businesses, as generally applicable to all businesses or specifically applicable to the business activity or circumstances of the Registered Enterprise. Accordingly, Registered Businesses, except those specifically exempt under applicable law, shall

secure and comply with all the requirements to secure a Business Permit and renew the same annually.

Except as expressly provided under the Ordinance or the Incentive Law under which they are likewise registered, Registered Enterprises shall comply with all applicable laws as other enterprises engaged in the same business as they are engaged in are required to comply with.

Other than as provided under Section 2 above, Registered Enterprises shall not be required to comply with any other requirements that businesses not registered under the Ordinance are not required to comply with.

Registered Enterprise temporarily suspended upon any of the grounds provided in Section 32, Title IX, hereof. The cancellation or revocation of the Certificate of Registration shall mean withdrawal of all incentives granted under this Ordinance.

In case of cancellation or revocation of its Certificate of Registration due to fraudulent misrepresentation relating to a matter that would have otherwise disqualified from or rendered it ineligible for registration under this Ordinance, the Mayor shall require the refund of all incentives availed of. The effect of the cancellation or revocation of the Certificate of Registration of a Registered Enterprise shall retroact to the day when the continuing condition for registration under the Ordinance, as provided in the terms and conditions of the Certificate of Registration is proven to have been violated/had ceased to exist.

Nothing under this Ordinance prevents the imposition of other penalties that are properly imposable under applicable law depending on the nature of violation committed by a Registered Enterprise, as determined by the appropriate regulatory authority.

SECTION 31. ADDITIONAL CONDITIONS ON REGISTERED ENTERPRISE UNDER THE MIPA LIST. – Those enjoying incentives by virtue of their registration with a Registering Agency and pursuit of a business activity in the MIPA List shall submit annually to the Oro - IPC an original copy of a certification from the Registering Agency that it continues to be SECTION 36.
