‘Private sector failed to address corruption’

DAVAO City––Results of the SWS 2013 Enterprise Survey on Corruption indicated that private sector effort on the problem showed no improvement as to efforts on addressing the issue. This according to Social Weather Stations president Mahar K. Power plants’ ‘data logging’ system will determine cause of power outage, says NPC

CAGAYAN de Oro City–– The National Grid Corporation of the Philippines (NGCP) remained mum on the reason behind the power outage Thursday (Feb. 27), saying they are still determining the cause and will issue a statement when the investigation is completed.

However, Atty. Romero Pasilan, spokesman of the National Power Corporation, said a data reporting system embedded in all

power plants can generate data reporting of incidents to determine the cause.

A top power executives’ meeting was held Friday morning to look into the cause of the problem.

Atty. Romero Pasilan said there is no problem in the power plants, even as he does not want to prematurely judge other possible sources of the power failure.

He said all power plants have “data logging” of incidents installed in them that can generate reporting. The data are currently being downloaded from the plants

to determine the source of the power outage.

Atty. Pasilan refused to confirm a report circulated Thursday that said NGCP Tower 6 in Baloi, Lanao del Norte, was toppled down by explosives.

Being on the power generation side, Pasilan said NPC cannot issue such statement. It is the NGCP that should issue the statement, he said.

B’non sets public hearing for provincial revenue code MALAYBALAY City–– Bukidnon’s move to enact its first ever provincial revenue code will start with public hearings in the 20 municipalities and two component cities of the province from

March 11 to May 8.

In a notice of invitation, lawyer Apollo Maguale, Sangguniang Panlalawigan (SP) secretary, urged the public to attend the hearings and give suggestions to the

proposed code.

Maguale told MindaNews the provincial government will codify its revenue ordinances based on the Local Government Code of 1991.

In its explanatory note, the resolution proposing the enactment of the code cited that the provincial govern-

ment had approved the Strategic Financial Management Plan (SFMP), which identified existing and potential revenue sources.

Since year 2000, I’ve guided them to plant coconut trees around the school premises, fruit trees like mango, guyabano, star apple, santol, and vegetables including pechay, eggplant, patola, tomato, and malunggay.

My students have utilized most of West Central Elementary School’s available ground spaces for our vegetable production program.

Year in and year out, the program has been a successful endeavor with students gaining insights on how to plant and nurture vegetables and give themselves a sense of fulfillment as the vegetables grow and mature.

Since they’ve been oriented about the importance of planting vegetables in the government’s thrust for food sufficiency, the students’ awareness on the importance of their efforts is good enough for us mentors that we have successfully communicated our thoughts and purposes to them.

DOE monitoring situation in wake of Mindanao blackout

By PAT SAMONTE, Regional Editor-Caraga BUTUAN City––The Department of Energy (DOE) is closely monitoring the power situation in Mindanao as the investigation on the root-cause of the Friday system-wide shutdown is underway.

The National Grid Corporation of the Philippines (NGCP) reported that the Mindanao system demand stood at 785 megawatts and the supply was 853 MW accounting to 953 MW reserve when the incident occurred at around 3:52 am on February 27, 2014.

Initial reports indicate that the tripping emanated from the breaker of a switchyard in a power plant. The DOE and Transco are gathering facts to validate the reports from NGCP, National Power Corporation and independent power producers (IPPs).

NGCP’s Regional Corporate Public Affairs Officer for Mindanao Milfrance Capulong said the transmission company and NPC will conduct technical evaluation of the condition of the switchyard and the power plants, of which Transco is tasked to interpret the results.

Earlier, NGCP reported that the Mindanao grid has been fully re-energized as of 12:18 pm of February 27, 2014.

BUTUAN City––The Department of Public Works and Highways has blacklisted a construction firm owned by a city councilor here.

In Department Order No. 19 dated February 20, 2014, DPWH Secretary Rogelio L. Singson suspended/ blacklisted SCP Construction owned by Councilor Sergio C. Pascual from participating in any bidding or entering into any contract with the DPWH and its line

agencies.

The Order will be for one year as administrative sanction to the construction firm as prescribed in the termination order of its two contracts in Region 10 dated October 8, 2013, namely: 1) Contract ID No. 08K00014 – Road Upgrading (Gravel to Paved) of Jct. FISHPOND PRODUCTION FOR SCHOOL FEEDING PROGRAM MRS. JULIET A. DIGAMO Grade 5 Teacher West Central Elementary School R. Palma Street, Butuan City

As head of agriculture of the PAGKAING SAPAT PARA SA BATANG CARAGA program at West Central Elementary School, Barangay Dagohoy, Butuan City, I thought of making use of the fishpond at the back of the school complex.

The fishpond has been there since I joined the institution 14 years ago and has been teeming with tilapia and haluan (local name for mudfish).

I mobilized able-bodied Grade V- VI students and armed them with nets to catch mature tilapia and other fishes. We sold our first

harvest to barangay residents and the PAGKAING SAPAT PARA SA BATANG CARAGA program profited P1,500 from the fish catch.

Aside from other sources, the school’s feeding program for children has benefited from the fish catch every three months since then.

I plan to request assistance from the Bureau of Fisheries and Aquatic Resources (BFAR) to develop and improve our school’s fishpond production to further help in the government’s school feeding program.

will be compelled to take the side of Coco and junk the Ombudsman’s decision to suspend her for six months.

The reason is that the Bible gives a very sound argument why the Ombudsman’s decision against Coco should not be taken seriously, and should in fact be reconsidered or withdrawn right away. I hope the Ombudsman should take time out to read the Bible, and see for itself the folly of its decision to suspend Coco, based on what the Bible says.

Government is bungling Mindanao power crisis again

THE People Opposed to Unwarranted Electricity Rates (POWER) expresses alarm at the government’s continuing failure to address the critical power crisis that has been plaguing Mindanao for the last five years.

Thursday’s island-wide blackout, the cause of which the Department of Energy (DOE) remained clueless 24 hours after the incident, comes at the heels of the surprise revelation that in the Pablo-struck areas of Southern Mindanao, 57 percent of villages still has no power more than a year after the storm and despite billions of pesos spent on rehabilitation.

Maybe it’s time Energy Secretary Jericho Petilla look for another job, probably as undersecretary of the Department of Social Welfare and Development (DSWD) where he can better tend to his constituents in disasterstruck Leyte.

Unfortunately, Mindanao’s power woes will get worse because the DOE under Sec. Petilla is bent on implementing the Interim Mindanao Electricity Market (IMEM), a clone of the dreaded Wholesale Electricity Spot Market (WESM) in Luzon that caused power rates to spike last November and December, making

Worse than WESM, which operates in Luzon’s limited power supply, IMEM will be operating in Mindanao where there is an acute power shortage.

This will definitely lead to even higher prices, with power generators having a heyday manipulating the spot market.

If IMEM is allowed to continue operating, the same WESM schemes like high clearing prices and automatic pass through charges will be experienced by electricity consumers all over Mindanao, leading to higher rates.

Already, Mindanao’s electric cooperatives are up in arms over IMEM’s more than P200 million in excess billing from November 26-December 25, where it charged the cooperatives for electricity that allegedly was neither ordered nor delivered.

The ECs have refused to pay said charges and are poised to ask the Courts to declare IMEM illegal.

Lousy Laguindingan airport Dear Editors, I am an American visitor, and I read with interest the Hammer and Anvil article by Mike Banos printed on February 3, 2014. I visited CDO city for my fifth time and the first time since the new airport was opened. I love vacationing in CDO city and Northern Mindanao. However, my first flight to CDO city was taken on to Davao and then back to Manila and I returned to Manila to stay over night, then travel to CDO. That day I flew about 2200 km and ended back at the place I started. On the departure of my vacation in CDO, I

was concerned about if I could get a flight out, so I left 3 days early to fly to Manila.

I feel that the person or persons who decided to open the new airport with out full capabilities have done the Northern Mindanao area a great disservice. As for me, I must seek other paths to travel and other places for my vacation. In the future, I will check and ensure my travels are safe and convenient. Thus my vacation plans may be altered to Palawan Island, Bohol Island, City of Surigao, or other places. I agree completely with Mike Banos, the lack of a good all weather airport is a hindrance to good travel, and good commerce in CDO city.

In defense of ERC Chairperson Atty. Zenaida G. Cruz-Ducut

By David A. Tauli This paper is being issued in reaction to a sinister campaign to oust ERC Chairperson Ducut by blaming the Energy Regulatory Commission for the high rates of MERALCO consequent to the Malampaya shutdown and excessive price spikes in the Wholesale Electricity Sport Market (WESM).

It seems to me that the campaign versus Chairperson Ducut is being waged by allies of the PNOY administration in order to ensure that all five commissioners of the ERC will be appointees of the present administration. Chairperson Ducut is the only remaining ERC commissioner appointed during the PGMA administration.

My experience in the filing of cases in the ERC demonstrated that ERC Chairperson Ducut has been acting with the highest integrity as a commissioner, made more evident by contrary behavior on the part of other ERC commissioners.

This is in connection with ERC Case No. 2010-014 RC, entitled “In the Matter of the Application for Approval of the Ancillary Services Procurement Agreement (ASPA) between the National Grid Corporation of the Philippines and Therma Marine, Inc., with Prayer for Provisional Authority”, and the “sister” case, ERC Case No. 2010-011 RC. In this paper the two cases are called collectively the NGCP-TMI Case.

The NGCP-TMI Case consisted of applications for the approval by the ERC of the ASPA between NGCP and TMI so that the charges for the ancillary services provided by power barges PB 117 and

PB 118 could be recovered

by NGCP from Mindanao power consumers. The anomaly in the applications was that NGCP and TMI were asking for capital recovery in the amount of around ninety million US dollars, when the amount paid by TMI to the PSALM Corp for the purchase of the two power barges was only thirty million dollars.

Because of this, CEPALCO, of which I was then Senior Vice President, and others, including AMRECO and the Konsumanteng Kagay-anon, Inc. (KKI), registered their opposition against approval

by ERC of the NGCP-TMI application.

In its first decision on the NGCP-TMI Case, the ERC decided that capital recovery fees should cover only the purchase price of the power barges in the amount of thirty million dollars, plus around seven million dollars spent by TMI on the refurbishment of the power barges, and not the ninety million dollars that was applied for by the applicants.

NGCP and TMI filed a motion for reconsideration of the ERC decision, and, in an inexplicable flip-flop, the ERC, consisting of the same commissioners that made the first decision, overruled their own initial decision and approved a capital recovery fee in the amount of ninety million dollars. CEPALCO filed a motion for reconsideration of this second decision of the ERC. We were later informed

by ERC insiders that the commissioners decided four to one against NGCP-TMI in their first decision; and decided three to one with one abstention in favor of NGCP-TMI in their second

decision, with Commissioner Ducut being the only opposing vote.

After the ERC reversed their decision on the NGCPTMI Case, the Mindanao Coalition of Power Consumers (MCPC) launched a publicity campaign denouncing the flip-flop by the ERC on the NGCP-TMI Case. We brought the matter to our Mindanao congressional representatives, mainly to the Congressman Rufus Rodriguez and his brother Congressman Maximo Rodriguez, Jr. of party list ABAMIN. During the congressional hearings on the national government budget for the year 2011, the two congressmen conferred with ERC Chairperson Ducut on the NGCP-TMI Case.

Chairperson Ducut assured the congressmen that she will work for a decision favorable to the people of Mindanao.

In the course of the ERC hearings on the Motion for Reconsideration filed by CEPALCO on the NGCP-TMI Case, two of the ERC commissioners retired, and were replaced by appointees of the PNOY administration. Eventually the ERC decided to reinstate the initial decision on the Case, and reaffirmed that the capital recovery fee for ancillary services from the TMI power barges will be for thirty seven million dollars and not ninety million. (We were informed by ERC insiders that the vote was again three to one with one abstention, but this time reversing the second decision.) No motion for reconsideration was filed

by NGCP and TMI on this third decision of the ERC. In this particular case, ERC Chairperson main-

Commissioner Ducut stood firm in the midst of all those pressures.

The failure of the WESM and the consequent excessive rates of MERALCO are not valid grounds for the removal of Chairperson Ducut from the ERC because it is not the ERC that was the cause for the WESM failure and the high rates of MERALCO. The ERC decision-making on the NGCP-TMI Case should be enough proof that in Atty. Zenaida Cruz-Ducut, we have a good ERC commissioner.

Barangay officials to receive P100,000 retirement pay A lawmaker is proposing the grant of retirement pay of not more than P100,000 to barangay officials after their service in the barangay.

Rep. Mercedes K. Alvarez (6th District, Negros Occidental) said the provision of the additional benefit would serve as recognition to their vital contribution to the realm of public service.

Alvarez said at present, the members of the barangays only receive honoraria or allowances despite the fact that they are the first representatives of the government approached by their constituents for basic services and needs.

“The officials and employees of the barangays are the frontliners in public service and are also the first responders to any situation in their respective barangays,” Alvarez said.

House Bill 3763 provides that all barangay officials shall be entitled to a lump sum retirement pay equivalent to a oneyear honorarium but in no case shall exceed P100,000, to be taken from the barangay retirement fund.

To avail of such benefit, the measure requires that the retiree is at least 60 years of age with a minimum of nine years of service at the time of the retirement.

Under the bill, the term retiree includes all barangay officials, including barangay tanods, members of the Lupon ng Tagapamayapa, barangay health workers and barangay day care workers.

The Alvarez proposal also calls for the creation of the Barangay Retirement Fund (BRF), which shall be used to fund the retirement of barangay officials mentioned in this Act. The amount equivalent to one percent of the share of the national government under Section 284 of the Local Government Code of 1991, as amended, shall be used for this purpose.

Alvarez said that it should be the responsibility of the Department of the Interior and Local Government (DILG) to administer and ensure the appropriate disbursement of the fund.

The bill amends for the purpose Section 393 of Republic Act 7160, as amended, otherwise known as the “Local Government Code of 1991.”

FDC Misamis sponsors livelihood training program FDC Misamis Power Corporation, in partnership with the Municipality of Villanueva and Ang-Hortaleza Foundation Inc. (AHFI), recently sponsored a fiveday “Ganda Mo, Hanapbuhay Ko” basic cosmetology

training program from 24 to 28 February at the Villanueva Gymnasium.

Around 62 unemployed women and men from the municipality were taught the basics of haircutting and other hair treatments,

manicure, pedicure and foot spa. They also did actual hands-on work with “models” coming from the communities. The women had a written and practical exam on the last day which culminated in their

Two months hence, FDC Misamis and the Villanueva Municipality will conduct “Kamusta Na” to monitor the impact of the program on the beneficiaries. Graduates will be monitored and evaluated about how they have applied the skills they have learned to augment their family income.

“Parallel to our project implementation, we have initiated corporate social responsibility programs in the Municipality of Villanueva.

In addition to livelihood training, we will implement programs relating to health services, education and environment in the near future,” says Mario Pangilinan, FDC Misamis Executive Vice President.

FDC Misamis, a subsidiary of FDC Utilities, Inc., will build a 405 MW CFB coal-fired power plant in Phividec Industrial Estate, Municipality of Villanueva which is set for commercial operations by 2016.

Police Station 6 commander Chief Insp. Felixberto Martinez said the attending physician declared Estacio dead on arrival.

Martinez said investigation showed Estacio was driving his Honda CRV with registered plate number KCH-111 together with his wife on the way to the Court when repeatedly shot.

“According to the wife, only one person approached their vehicle. But she was not able to see gunmen during escape as she ducked for cover and felt the vehicle stopped after it bumped on a guava tree,” Martinez said.

He said the windshield of Estacio’s vehicle bore seven bullet holes--five on the side of the driver and two on the passenger side.

Estacio was born in Margosatubig, Zamboanga del Sur but was raised in Luzon when his family migrated to Bulacan.

Estacio has served as clerk of court at the Court of Appeals and as prosecutor in Caloocan City prior to his appointment as RTC Branch 14 judge in 2005.

He is set to retire in March 25, this year, according to Court employees.

Atty. Cesar Jimenez said they were saddened by the incident as he described Estacio as a soft-spoken person and “talks like a father to us.” (PNA)

SWS urges private sector to do its share to fight corruption

AVAO CITY -- Results of the SWS 2013 Enterprise Survey on Corruption indicated that private sector effort on the problem showed no improvement as to efforts on addressing the issue.

This according to Social Weather Stations president Mahar K. Mangahas in an interview after he presented the result in a Roadshow of "Boosting Regional Competitiveness through PublicPrivate Partnership" held on Friday at the Pinnacle Hotel in Davao City.

"The result showed a flat line on how private sector is addressing corruption," he said.

He said while there's a clamor for the government to act on corruption, the private sector must also do their share.

Mangahas said there is mark improvement as shown in the survey on how government addresses corruption under the Aquino administration.

He said it is very evident

as results showed "flat line" with regards the private sector efforts to fight corruption.

Davao City Chamber of Commerce and Industry, Inc. (DCCCII) president Antonio T. dela Cruz in a separate interview said they really need to look at this even as he said they need to police their ranks.

Dela Cruz said there are concerns that they need to fix and they have started steps on how to address it.

He said they have a program in partnership with Makati Business Club on integrity initiatives.

This concern he said is also being discussed at the regional competitive council as the body not only is concern in addressing corruption in government but

also in the private sector.

Meanwhile, Department of Trade and Industry (DTI) for Region 11 officer-incharge Maria Belinda Q. Ambi, said although the result in the Davao Region of addressing corruption is high this could be insignificant.

But she stressed that the private sector must double their efforts to complement the aggressive efforts of the government in addressing corruption.

She said this concern is also being tackled regularly during industry cluster conferences because efforts both private and public sectors must be complementary.

As shown in the summary of findings of the survey it stated that those seeing "a lot" of corruption in the public sector rose 56 percent in 2013 (second-lowest since 2000), from 43 percent in 2012 (record-low).

It also showed that 42 percent say "most/almost all" companies in my sector of business give bribes to win government contracts,

practically the same as the record-low 41 percent in 2012. And those with personal knowledge of public sector corruption in their sector of business in the last 3 months rose to 38 percent in 2012.

Those with "extensive knowledge" of the administration's anti-corruption efforts fell slightly to 35 percent in 2013, from 37 percent in 2012.

Respondents also said that the administration's steps to eradicate corruption are "somewhat/very effective" fell slightly to 73 percent in 2013, from 78 percent in 2012. Those saying that government “often/ almost always” punishes corrupt goverment officials fell to 20 percent in 2013, from 27 percent in 2012.

NPA political officer surrenders to Army troops in Davao Del Norte DAVAO del Nor te-The Eastern Mindanao Command on Saturday announced that a New People’s Army (NPA) political officer has voluntarily surrendered to troopers of the 72nd Infantry Battalion in Purok 6, Barangay Linao, San Isidro town, Davao Del Norte last Feb. 27.

Belated reports from Capt. Alberto Caber, the command's spokesperson, said this took place around 9 a.m.

He identified the surrenderee as Geneng M. Ambas The latter is the brain of the NPA’s illegal activities in the municipalities of Davao del Norte.

Caber said the surrender of Ambas was arranged by his relatives and the barangay officials.

Fuentes said they also saw huge potentials with the venture in terms of job generation, increase in local tax revenues, expansion of eco-tourism opportunities and enhancement of local and foreign investors’ confidence to the area.

massive investment that the company will contribute to the local economy, she said the local government initially offered a 10-year tax exemption to NV Vogt as incentive pending the revision of the province’s revenue code.

She said the provincial government will shoulder the costs of the concreting of three-kilometer road from the national highway leading to the solar farm as additional support for the project.

“We assured them that the province will exert all efforts to provide them with safe, secure and peaceful environment to conduct their business,” Fuentes said.

Aside from its initial US$12-million or roughly P535.49-million investment, the governor said NV Vogt signified to invest an additional US$10 million for the project’s expansion in the next few years.

She said the company committed to later fund the establishment of a training center on solar technology in the province.

The company signed an agreement with South C otabato I Electric Cooperative (Socoteco I) in June last year for the streaming of power supplies from the facility.

Socoteco I serves this city, eight municipalities in South Cotabato and Lutayan town in Sultan Kudarat.

The electric cooperative signed the supply contract with NV Vogt to provide additional power supplies to the area and cope with shortage caused by the declining capacity of the National Power C or p or at i on’s ( N P C ) hydropower plants.

In September last year, Socoteco I was forced to implement daily rotational brownouts lasting eight hours due to the reduction of its supply contract with the NPC by 20MW or 12MW less than the area’s daily peak demand of 32MW.

Sahi disclosed the power they received from the suppliers is lower by 33 megawatts (MW) since the cooperative’s peak load ranges from 85 MW to 88MW daily.

“We lack 33 MW and that is equivalent to eight hours blackout because every four MW shortage of power translate to one hour blackout,” Sahi explained.

Sahi said the rotational blackout Saturday, March 1, will range from eight to nine hours, which will be implemented in four frequencies at two hours per frequency.

However, on Friday, Feb. 28, the rotational blackout ranged from nine to 10 hours.

Sahi said that one of the reasons why there is shortage of power is that the Bukidnon-based Pulangi IV only provides 90-MW to the Mindanao

grid instead of 255-MW, its total generating capacity.

He said that the Agus II is still out of order up to now.

He said the Therma Marine Incorporated only generates P13.5-MW instead of 18-MW since its Barge No. 2 is out of order.

He said they are currently studying ways in a bid to lessen the number of blackout hours or to have a zero blackout daily.

THE Chinese consortium who won the bid to re h abi l it ate t h e Ag u s hydroelectric power plant in Lanao province has already started uprating the two units to increase its capacity of generating power for the Mindanao grid, the Power Sector Assets and Liabilities Management Corp (Psalm) said.

In December last year, the state-run Psalm awarded the contract to ITP Construction Inc and Guangxi Hydroelectric Construction Bureau to undertake the uprating of Units 1 and 2 of the Agus VI plant. The consortium’s offer of P1.59 billion was the lowest bid for the project.

two generating units is meant to increase the facilities’ output from 25 megawatts (MW) to 34.5 MW each, and to extend their economic life by another 30 years.

The project has been shortlisted among the measures government is banking on to increase electricity supply in Mindanao.

ENERAL Santos City - The provincial government of S outh Cotabato has formally endorsed the planned development starting this year of a US$12-million solar power plant project in Surallah town by a foreignbacked renewable energy company.

South Cotabato Gov. Daisy Avance-Fuentes said Wednesday they issued the endorsement to allow NV Vogt Philippines Inc. to begin with the preparations for the development phase of the five-megawatt (MW) solar power plant venture.

ZERO WASTE PROGRAM MRS. JULIET A. DIGAMO Grade 5 Teacher West Central Elementary School R. Palma Street, Butuan City

When the Butuan City government launched a Zero Waste Program to rid the streets, sidewalks, markets and surroundings of litter, garbage and wastes, the West Central Elementary School was in the forefront of the campaign.

The members of the entire school community were mobilized to make the institution a show window of cleanliness in the city.

Student groups from Grades I to VI were organized to enforce a no littering campaign in the school premises. Non-biodegradable wastes were turned over to the city garbage collector while a big concrete compost pit was constructed to store bio-degradable wastes. The compost was later used as fertilizer for vegetables

and fruit trees.

The Butuan City government noticed and awarded the West Central Elementary School with a certificate for its effective Waste Management program in September, 2013.

The waste management program accomplished two purposes: cleanliness in the school premises has been maintained until today, and vegetables have grown healthy and fast owing to the fertilizers from the bio-degradable wastes.

The endeavor has benefited not only the school but the city as well.

The program has taught the school children what cleanliness can do to oneself, to neighbors and the community.

The move will be “of great help to the provincial government, and the Code will ultimately guide and assist the implementor for its efficient and effective collection of revenues,” the note added.

Maguale said a technical working group led by acting provincial treasurer Teodora Dinlayan formulated the draft which the SP approved late last year.

But Maguale noted that as an ordinance, the proposed legislation needs to undergo public hearings and publication in a newspaper for it to be enforceable in case it is approved.

Review of local tax code sought COUNCILOR President D. Elipe on Monday called for a review of Ordinance No. 8847-2003, otherwise known as the Revenue Code of Cagayan de Oro City.

In his special report during the regular session presided over by Vice Mayor Caesar Ian E. Acenas, the councilor said the city’s Local Tax Code should be reviewed in such a way that it will not be subject to interpretation and negotiation.

The councilor, who chairs the committee on finance and ways and means, noted the increase in tax assessment and collections this year which became the subject of complaints of businessmen in the city.

He said it is about time to take another look at the revenue code, which was enacted in 2003.

Vice Mayor Acenas referred this to the committees on finance and on commerce chaired by Councilor Edna Dahino for study.

Councilor Elipe assured that public hearings and consultations will be held so people will be involved in the drafting of the new tax code.

“It is essential that we have hearings. But we have to start because the effectivity of any amendment to the tax code will take effect next year,” he added.
