Daltan’s Kambingan opens new branch today

THE Cagayan de Oro’s prime for goat-meat meals, Daltan’s Kambingan Restaurant, opens its second and bigger branch today (June 18) at Tiano-Borja Street.

Following the success of its pioneer branch in Capistrano-Cruz Taal Streets, this second branch will serve more customers, this time, in the heart of the city. Its location is near to various business hubs and schools such as Xavier University.

HBC Ventures Chief Executive Officer and restaurant owner, Mr. Henry B. Chua, said that together with the launching of their new branch, a couple of specialties in the menu were also added.

“Thank you very much for your help. I was really not expecting this,” said Sawitan, one of the pioneer tobacco farmers here.

She said that she was “encouraged” to venture into flue cured (Virginia) tobacco farming because of the cigarette manufacturing giant’s promised of taking great care of the farmers.

She said: “The company also encouraged us to practice crop rotation. So I still plant corn and cassava after harvesting my tobacco leaf four months after transplanting them.”

Crop rotation or planting corn after harvesting the tobacco or vice versa is mandatory for all tobacco farmers here as this practice is one of the many ways to avoid crop diseases. It also help soil regeneration.

Sawitan started tobacco in 2012 on a two-hectare farm. Since then, she is receiving more than P1,000 a week from the sale of her tobacco leaf. While her sales of tobacco is “just comparable” to her sales of corn and cassava before, she said she will not abandon tobacco farming because she can harvest the tobacco leaf two plants after transplanting tobacco.

Also, “tobacco brings us a weekly income of not less than P1,000.”

This town, the only landlocked municipality in Misamis Oriental, is the site of PMFTC’s continuous production operations as tobacco leaf is grown and harvested all year round.

Farmers here plant the fluecured variety which matches the excellent variety grown in the United States and Brazil.

For farmers here, tobacco farming is way much better than growing other crops because they are assured of a market at fixed contracted price, farms inputs assistance, free of charge transportation for the leaf harvest

Gandamra said that it was already stipulated in Resolution No. 81-1277 passed by the Civil Service Commission (CSC) and was implemented since 1991 allowing employees who practice the Islamic religion to render office between 7:30 a.m. to 3:30 p.m. without noon break.

“That is already counted as one day of service rendered so they could go home and be with their families early to pray solemnly,” he said.

He also added that this working system must continue till the end of the solemn month which would be the holy day of Eidl Fitr.

The said CSC resolution further stated that the difference of two hours is not counted as undertime.

“The commission recognizes the constitutional right of the Muslims to the free exercise of our faith,” Gandamra said.

This, even as Gandamra also called on all private businesses in Northern Mindanao to also allow their Muslim employees to render flexible time during the whole month.

“Even if this is not mandated by law yet, I still hope that our esteemed business

community here will consider and honor the customs of their Muslim workers,” he added.

Ramadan is observed in the ninth month of the Islamic calendar and will start on the day the New Moon is sighted. Fasting is obligatory for adult Muslims except those who are suffering from illness, traveling, elderly, pregnant, breastfeeding, diabetic or going through menstrual

bleeding. From dawn until sunset, Muslim refrain from consuming food, drinking liquids, smoking and engaging in sexual relations.

Gandamra said Ramadan is a time of spiritual reflection, improvement and increased devotion and worship. “Muslims are expected to put more effort into following the teachings of Islam. We must be enhanced and enlightened more spiritually,” he said.

Project Tabuk Because Sawitan took risks in planting tobacco despite the drought, PMFTC “rewarded” her, and other tobacco farmers who risked, with cash and grocery items under the Project Tabuk (crossover) of the company’s Farmers Assistance Program.

Project Tabuk is a oneof-a-kind relief program of PMFTC, Inc. that aims to ease farmers’ burden of loss income due to the drought.

It also aims to help tobacco farmers “crossover” from the prolonged dry spell to the rainy season.

The project has two components, Cost Recovery Package and Food Package.

The Cost Recovery Package allows farmers to recover

their cost of production.

To c omp e n s at e f or their losses because of the drought, PMFTC pays farmers for the difference between the total labor and machinery rental costs and the total value of tobacco purchases. Thus, not all tobacco farmers who took the risk of planting despite the drought got the same amount, said Ravi Lumunsad, operations manager of PMFTC Claveria.

The Food Package, on the other hand, covers the margin of income the farmers would have earned under normal conditions. The amount of assistance is 50 percent of the estimated margin of earning of each farmer.

Farmers who took the risks received P10,000 worth of food package assistance (P4,000 worth of rice and P6,000 worth of grocery items) for every hectare planted to tobacco.

For tobacco farmers who did not plant because of the El Nino, they still re-

ceive food packages worth P1,500, said lawyer Wilma “Amy’ Eisma, PMFTC Public Affairs and Contributions manager.

PMFTC also condoned the loans the farmers owed the company, Lumunsad said.

Partners in development Didet Danguilan, PMFTC communications manager, said that based on their records, there are 221 “risk-taker” tobacco farmers in Claveria while those who did not take risk or planted

other crops than tobacco or have stopped farming altogether because of the drought totaled 449. “All of them are the beneficiaries of Project Tabuk.”

PMFTC are taking very good care of tobacco farmers here and in other parts of the country where it has an operation because the company considers them as “partners in development.”

“Without these farmers, it will be very hard for us to continue in the business,” Danguilan said.

Aside from tobacco farmers, the cigarette manufacturing giant will also be extending assistance to other farmers here, not just the tobacco farmers, said Eisma.

“We will also be giving 50 cavans of rice to other farmers here but these will be coursed through the local government unit under the Office of the Municipal Mayor,” she said, as she explained that farmers should be given assistance See REWARDS, page A11

A political party is serious business. It should be treated seriously. It’s supposed to be the quality-control mechanism for democratic politics—identifying and nominating worthy candidates, sorting out undesirable wannabes.

But we have such dysfunctional “parties” today, some headed by flunkies or dropouts with wrong notions of the role a party performs in a democracy. ***** These makeshift parties shouldn’t have been allowed to crash into the electoral arena stuffing our political system with misfits, charlatans, and undeserving political parasites.

The dominance of these make-believe parties deprives us of a civilized way to ensure that a candidate is really qualified and can really be trusted. Not only that, they make it impossible to keep a level playing field for all legitimate contenders.

All they can present each time is an undistinguished lineup of candidates, mostly ambitious people with money or moneyed backers

Let Go of the Controls Think A Minute

Think a minute…

A pilot was flying his small airplane, a Cessna 150, when suddenly he lost control. His plane began spinning and falling to the ground! He panicked and began doing everything he could think of with the controls. Finally, after a few seconds, he remembered his teacher’s words of instruction: “If you ever go into a spin and start falling in this plane, the Cessna 150, just let go of the controls!

This kind of plane will stop falling and fly straight again by itself.”

But letting go of the controls and trusting the plane to fly straight and save him was the hardest, scariest thing for this pilot to do. Finally, he pulled his hands off the controls and waited. After many seconds of his Cessna plane spinning and falling, it returned to just normal, level flying and he was safe again! Even though the plane fell more than half a mile, the pilot survived because he trusted the plane enough to let go.

If you’re in trouble or going through a major problem, decision, or crisis in your life. You may be feeling like you must do all kinds of things to fix it. But nothing you’re doing is working, so you’re frustrated and worried. You know the best thing you can do is what that pilot finally did. Just take your hands off the controls and stop trying to change and fix that situation or person yourself. It’s hard to do, especially if you feel you’re the only person who is trying to do anything about it.

DAR marks CARP 27th anniversary, hands farmers P17.755M equipment assistance B

UTUAN CITY – In commemoration of the 27th Anniversary of the Comprehensive Agrarian Reform Program (CARP), the Department of Agrarian Reform (DAR) in Caraga gave out P17.755 million worth of farm equipment, credit assistance and crop protection insurance to agrarian reform beneficiaries (ARBs) in Region 13 Tuesday at the Main Atrium of Robinsons Place here.

The affair was led by newly-assigned Caraga Regional Director Julita A. Ragandang, who assured to continue the distribution of the remaining agricultural lands to qualified farmerbeneficiaries in the region.

Ragandang took over last April 14 the DAR-Caraga top post from Director Faisar A. Mambuay, who

was assigned as Regional Director of DAR-Region 10 pursuant to Secretary Virgilio delos Reyes’ Department Order No. 107, Series of 2015.

Totalling P9,489,066, the farm equipment consisted of two 4WD tractors, seven rice threshers, two power cultivators and a reaper from the Agrarian Reform

Community Connectivity and Economic Services (ARCCESS), a project implemented by DAR to help improve productivity and income of ARBs through their organizations. The beneficiaries were three cooperatives from Agusan del Sur, one from Las Nieves, Agusan del Norte, one from Cabadbaran City, six from

SB RESOLUTION No. ( 06-24-13 ) – 097 RESOLUTION APPROVING ORDINANCE NO. 42, S-2013 OTHERWISE KNOWN AS THE “ CODE OF POLICIES IN THE DISPOSITION AND IMPLEMENTATION OF VILLA ELENA HOUSING PROJECT ON LOT NO. 1087, PLS-35 SITUATED AT POBLACION, KAPTAGAN, LANAO DEL NORTE”.

WHEREAS, it is the policy of the State to promote social justice, to ensure the dignity, welfare and security of the people; WHEREAS, to promote social justice, the State shall establish, maintain and ensure adequate provisions and services for housing and land tenure to guarantee the enjoyment by the people of a decent physical and socio-economic standard of living; WHEREAS, the Local Government Unit of Kapatagan, Lanao del Norte has entered into a Swapping Agreement with the Department of National Defense (DND) whereby Lot No. 1087, Pls. 35 which was formerly declared as a military reservation is now owned by the Municipality of Kapatagan, Lanao del Norte by virtue of the said swapping agreement; WHEREAS, each local government unit shall exercise its power to create its own sources of revenue and to levy taxes, fees and charges subject to the provisions of RA 7160, consistent with the basic policy of local autonomy . Such taxes, fees and charges shall accrue exclusively to the local government units.

WHEREAS, in the disposition and implementation of the Villa Elena Housing Project at Lot No. 1087, Pls- 35, situated at Poblacion , Kapatagan, Lanao del Norte, a policy is herein established.

NOW THEREFORE, after due deliberation and upon motion of Hon. Guillermo B. Bandiala, unanimously seconded; BE IT ORDAIN , AS IT IS HEREBY ORDAINED by the sangguniang bayan in a session duly assembled to enact : ORDINANCE NO. 42, SERIES OF 2013 THE CODE OF POLICIES IN THE DISPOSITION AND IMPLEMENTATION OF THE VILLA ELENA HOUSING PROJECT AT LOT NO. 1087 PLS. 35 LOCATED AT POBLACION, KAPATAGAN, LANAO DEL NORTE. ARTICLE I : DECLARATION OF PRINCIPLES Section 1 : Declaration of Principles.

WHEREAS, it is the policy of the State to promote social justice, to ensure the dignity, welfare and security of the people; WHEREAS, to promote social justice, the State shall establish, maintain and ensure adequate provisions and services for housing and land tenure to guarantee the enjoyment by the people of a decent physical and socio-economic standard of living; WHEREAS, the Local Government Unit of Kapatagan, Lanao del Norte has entered into a Swapping Agreement with the Department of National Defense (DND) whereby Lot No. 1087, Pls. 35 which was formerly declared as a military reservation is now owned by the Municipality of Kapatagan, Lanao del Norte by virtue of the said swapping agreement; WHEREAS, the LGU Upgrading Program is designed to upgrade the legal, environmental, social and economic conditions of illegal residents and occupants within the Villa Elena Housing Project in line with the spirit of the constitutional provision guaranteeing housing and security of tenure for every Filipino; WHEREAS, the formulation, institution and enforcement of general and specific policies which shall ensure the success of the program is indispensable for the mutual guidance of the beneficiaries and program implementers; ARTICLE II : TITLE Section 1. Title : This code shall known as “ The Code Of Policies In The Disposition And Implementation of Villa Elena Housing Project at Lot No. 1087, Pls-25, Situated At Poblacion, Kapatagan, Lanao del Norte.

ARTICLE 111 : GENERAL PROVISIONS Section 1. Duties and responsibilities of the Municipal Housing Board.

The LGU-Kapatagan through the Municipal Housing Board, as Project Administrator shall be responsible to carry out, oversee manage, and administer all phases of the Villa Elena Housing Project in consultation with the Local Inter-Agency Committee (LIAC). The LGU shall likewise tap and harness to the fullest such inputs and resources from other government and non government organizations to complement program implementation and improve the socioeconomic conditions of the residents.

1. The LGU census of occupants and the tagging of existing structures shall be the primary basis for determining potential beneficiaries in the Villa Elena Housing Project.

2. Census and tagging and other related cases which may arise in the determination of qualified beneficiaries shall be resolved by the Awards and Arbitration and Beneficiary Selection Committee (AABSC) which shall be constituted for this purpose.

3. The award of rights over the land are non-transferable except with the written consent of the LGU through the Municipal Housing Board subject to existing rules, regulations and policies.

4. Maximum community involvement in the development efforts of the Villa Elena Housing Project shall be encouraged.

1. Alpha Listing – is the LGU consolidated Masterlist in alphabetical order for a more effective reference in the pre-qualification of housing applicants.

2. Absentee Censused Household – a censused household recorded in the official LGU census list who vacates a duly tagged structure and leaves the Villa Elena Housing Project for a continuous period of at least six (6) months without written notice to the Municipal Housing Board.

3. Absentee Structure Owner-any household who owns a duly tagged structure in the Villa Elena Housing Project but who does not reside in the said structure at the time of the official LGU census survey.

4. Actual Area Occupied – the surrounding area occupied by a structure wherein permanent improvements have been introduced by the occupants.

5. Affordability – the capacity of the beneficiary to pay the corresponding value of the lot allocated to him based on his maximum allowable loan under the Affordable Housing Program and End User Housing Program or payment in cash.

6. LGU- Local Government Unit of Kapatagan, Lanao del Norte 7. Board-Municipal Housing Board which shall be composed of the Municipal Mayor as Chairman, the Vice Mayor as Vice Chairman and representative from the MPDC, MEO, SB Chairman Committee on Landed Estate and the Municipal Assessor. To constitute quorum, the presence of a majority of all of its members shall be necessary. The Mayor or in his/her absence the Vice Mayor, as the case maybe, shall only vote in case of a tie among the members.

8. Beneficiary – a household who meets the beneficiary selection criteria set for the Villa Elena Housing Project and complies with the provisions of this Code of Policies and other implementing rules and regulations duly promulgated by the Local Government Unit.

9. Awards and Arbitration and Beneficiary Selection Committee- a body established

by LGU to entertain, investigate and recommend action regarding disputes over census claims, beneficiary and structure status and other similar cases. The Awards and Arbitration and Beneficiary Selection Committee is composed of one representative from the LGU Government of Kapatagan, Lanao del Norte, Barangay Poblacion, MSWD, MLGOO and Provincial Legal Officer/Municipal Legal Officer as the case maybe. To constitute quorum, a majority of all the members shall be present and they shall also elect among themselves the chairperson.

10. Census – the official registration of all household members and the recording/ tagging of all officially recognized structures by the LGU as the basis for beneficiary selection and lot allocation.

11. Census and Tagging Cases – cases that pertain to the beneficiary or nonbeneficiary status of persons in Villa Elena Housing Project as based in the official LGU Census List.

12. Census Household – any household registered in the official LGU Census List.

13. Municipality – the Local Government Unit of Kapatagan, Lanao del Norte as represented by the Mayor within whose particular jurisdiction, the Villa Elena Housing Project is being implemented.

14. Construction – the erection of a structure or the major repair or extension of an existing structure.

15. Disqualification – the official exclusion and cancellation of rights of a censused or uncensused household from the benefits under the Code of Policies.

16. Dismantling – the act of physically removing any structure or improvement or a part thereof upon the authorization or directive of the LGU through the Board.

17. Extension – any additional construction to the existing area of structure, which increases its size.

18. Ejectment/Eviction – an action instituted by the owner of an illegally or legally constructed and/or duly tagged structure within the Villa Elena Housing Project to oust the occupant of the same and to recover possession of his/her structure.

It can also mean the legal expulsion of an absentee structure owner.

19. Formal Notice – official written notification from the Board to any resident/ household of the Villa Elena Housing Project pursuant to this Code of Policies.

20. Household – a group of persons living in one structure who are related or unrelated by blood and have common arrangements for the preparation and consumption of food.

21. Household Head – the legitimate and legal head of the family of structure.

22. Illegal Construction – the construction or repair of a structure, extension of existing structure or a part thereof without the necessary permit and/or authorization from the LGU after the conduct of the official census and tagging exercise.

23. Illegal Occupant – any censused or uncensused household who occupies and settle in the property or in portions thereof without any authorization from the LGU. 24. Illegal Structure – any structure constructed or moved within the prescribed boundary of the Villa Elena Housing Project, after official termination of the census and tagging operations and without any written authorization from the Board.

25. Major Repair – the replacement of worn-out or damaged structural or architectural parts of a structure.

26. Minor Repair – the replacement of inconsiderable worn-out or damaged parts of a structure.

27. Project Area – for this purpose, a parcel of land declared partly for disposition to occupants, located in Purok 12, Poblacion, Kapatagan, Lanao del Norte covered

by Lot No. 1087 Pls, 35 in the name of Municipality of Kapatagan, Lanao del Norte, formerly known as Banana Village and now known as “Villa Elena”.

28. Reblocking – the process of cutting, chopping, modifying, re-aligning and dismantling structures within the project area to allow introduction of site improvements.

29. Relocation – the physical transfer of an existing structure affected by the reblocking to a new and specified location within the project area.

30. Primary Beneficiary – the legal and the legitimate head of the household, registered and/or recorded in the official census-tagging as the owner and actual

occupant.

31. Renter Occupant – any household other than the owner occupying a structure or portion thereof for monetary consideration and likewise considered as second priority in lot allocation.

32. Renter free occupant – any household other than the owner occupying or using a structure or portion thereof for no monetary consideration.

33. Right of Pre-emption – the right of the censused occupants (renters or rentfree occupants/sharers) of a structure to be given the first option to acquire or purchase a structure over all the other censused households in the project area. The same right shall also be extended or afforded to the Local Government Unit of Kapatagan, Lanao del Norte.

34. Security of Tenure – the right not to be ejected from the Villa Elena Housing Project except on legal and lawful grounds.

35. Socialized Pricing – the different pricing of lots based on size, location, condition and actual land use aside from housing.

36. Structure – a man-made facility built for the support, enclosure of persons or property of any kind.

37. Structure-Owner – any person who owns a structure or dwelling unit and can prove/demonstrate ownership of such.

38. Upgrading Area – the Villa Elena Housing Project where on-site physical and socio-economic improvements is effected for the beneficiaries.

39. Vacant Lot – any parcel of land within the Villa Elena Housing Project that is not occupied by a person or by any structure or dwelling unit thereon at the time of the official LGU census and tagging operation.

ARTICLE V : BENEFICARY SELECTION AND LOT ALLOCATION Section 1. Guidelines in the selection and lot allocation : 1. The official LGU Census survey and tagging of structures conducted from November 15-29, 2012 shall be the primary basis for determining potential project beneficiaries in the Villa Elena Housing Project.

2. The issuance of the LGU tag number does not in any way constitute a guarantee for lot allocation in the Villa Elena Housing Project.

3. All potential project beneficiaries shall be registered voters and residents of the Municipality of Kapatagan, Lanao del Norte.

4. All cases and claims related to beneficiary selection shall be deliberated and resolved by the Awards and Arbitration and Beneficiary Selection Committee (AABSC). The decision of the AABSC shall be appealable within fifteen (15) days from receipt thereof to the Board, whose decision shall be final and executory.

5. In Villa Elena Housing Project area, the primary beneficiaries shall be the censused-owner occupants of duly tagged structures, the location of which are in conformance with the approved site development.

6. Maximum retention and minimum displacement shall be the guideline in the reblocking of structures.

7. Lot allocation shall be on “as is where is basis” referring to the actual location occupied by the actual occupant but not to exceed the maximum area of each block provided it conforms to the site development otherwise, it shall be relocated to an area as the Board shall determine.

8. The maximum lot size to be awarded shall be based on the actual area occupied by the structure of the project beneficiary provided it conforms to the approved site development and affordability to pay.

9. If there are any vacant residential lots within the Villa Elena Housing Project area following implementation of reblocking and site development, the following criteria shall be applied in the allocation of such vacant lots: a.) First priority shall be given to the censused owner-occupants of duly tagged structures within the project area, which must be transferred or dismantled to allow introduction of site improvements. b.) Second priority shall be given to the censused-renters and rent-free occupants of duly tagged structures within the project area. Affordability and length of residence shall be the primary consideration in the prioritization of such censused-renters and rent-free occupants for potential lot allocation. c.) Third priority shall be extended to the informal settlers occupying within National, Provincial and Municipal Roads within Kapatagan; and are registered voters and residents of the municipality of Kapatagan, Lanao del Norte. Provided that as a pre condition to the award, the said illegal occupant will sign a waiver in favor of the LGU and voluntarily demolish the illegal structures located along the national high way, provincial roads or municipal streets; d.) Fourth priority shall be given to the registered voters and residents of the municipality of Kapatagan, Lanao del Norte living outside the project area and is qualified to avail of the housing project.

10. In addition, in order to qualify as a beneficiary to the project, a person must be: a.) a household head; b.) a Filipino citizen, a voter and a resident of the municipality c.) at least twenty one (21) years of age; and d.) capable or can afford to pay the lot and a member of PAG-IBIG; e.) Has no residential landholdings in the Municipality of Kapatagan, Lanao del Norte of Six Hundred (600) square meters or more and not a previous government awardee of a housing program.

11. The Rule of Succession shall apply in the event of death or incapacity of the household head beneficiary to whom the lot allocated or awarded. The spouse and/or children actually residing in the structure shall be considered as the rightful successor to the lot and shall bear the responsibility for lot payments thereon.

12. All vacant lots found within Villa Elena Housing Project site shall not be subject to occupation without prior written approval of the LGU through the Municipal Housing Board.

13. A qualified censused household is entitled to only one (1) lot within the Villa Elena Housing Project area.

14. A Committee to be known as the Awards and Arbitration and Beneficiary Selection Committee (AABSC) shall be constituted in the Local Inter Agency Committee (LIAC) to be composed of the Municipal Assessor, MSWD, Municipal Budget Officer, representative from NHA, PAG-IBIG, DENR, Registry of Deeds, Municipal Police Station and MLGOO. The AABSC shall entertain, investigate, and recommend action regarding disputes over census claims, beneficiary and structure status, and other similar cases. It shall also safeguard the rights of the residents in the Villa Elena area by any legal means it may consider appropriate. All decisions of the AABSC shall be subject to review and approval of the Housing Board of the Municipality of Kapatagan, Lanao del Norte whose decision shall be final and executory.

Failure to comply with any of the specified options within the stipulated time frame shall render the censused household subject to disqualification and ejection.

In addition, it shall render the structures in question subject to dismantling by the LGU with the assistance of the Local Inter-Agency Committee.

1.

Any censused household shall be disqualified from the benefits of the LGU project on the following grounds: a.)

A censused household who leaves the project area for a continuous period of at least six (6) months without prior written notice to and approval of the Municipal Housing Board.

b.)

A censused household who continuously occupy and use more than one (1) lot other than the lot allocated to him within the Villa Elena Housing Project even after the expiration of the thirty (30) day notice to dispose of his other structures.

c.)

1. Residential lots for Villa Elena Housing Project shall be sold only to qualified beneficiaries of the project.

A censused household who transfers, sells, or in any other manner disposes of his rights as a project beneficiary.

d.)

A censused household who undertakes any unauthorized major repair or extension and who upon notice from the LGU fails to remove the said repair or extension.

e.)

A censused household who relocates his structure in any vacant lot within the Villa Elena Housing Project area without prior written authorization from the LGU through the Board.

f.)

A censused household who construct any new structure within the Villa Elena Housing Project area without prior written authorization from the LGU through the Board following completion of the official census and tagging exercise.

A qualified beneficiary who uses a dummy or allows himself to be used as a dummy for the purpose of acquiring rights over a lot, structure or dwelling unit within the Villa Elena Housing Project.

2. Only those beneficiaries whose lot allocations have been confirmed by the LGU shall be qualified for award.

3. Within fifteen (15) days after issuance of a Notice of Award, the LGU and the beneficiary shall execute the Conditional Contract to Sell , or a deed of sale in case of cash purchase and such other related documents over the awarded lot.

3.1. For cash purchase. The beneficiary shall pay within fifteen (15) days from receipt of the Notice of Award an amount equivalent to Two Hundred Pesos ( P 200.00) per square meter of the surveyed – awarded lot area stated in the Notice of Award as down payment and shall form part of purchase cash price. The remaining balance shall be paid on or before the 45th day following the first down payment.

g.)

In addition, the LGU shall not be precluded from taking other appropriate legal action against a disqualified household in accordance with existing laws, policies, rules and regulations.

Failure on the part of the beneficiary to comply with the above and pay the full amount within forty five ( 45) days thereafter shall be sufficient cause for the automatic forfeiture of the award and he/she shall be subjected to disqualification procedures pursuant to existing provisions of this code . In which case, the downpayment shall be returned to the beneficiary/ies and the lot awarded shall be re-raffled to other qualified beneficiaries.

4. All corresponding fees incidental to the registration of the sale, survey fees and the subsequent issuance of the Transfer Certificate of Title in favor of the awardee shall be borne by the awardee. This provision shall apply only where the Original Certificate of Title is under the name of the LGU.

A censused household who shall employ force, intimidation or threat against any qualified applicant; and

A censused household who shall interfere, tamper or otherwise employ any other means to defeat the proper carrying out of the plans for the development of the Villa Elena Housing Project.

All disqualified households shall comply with any of the following options within thirty (30) days from receipt of a formal notice from the Board:

With the prior written approval of the Board, sell the structure to the actual census occupants of the structure, who must also meet the qualifications as set out in this code of policies;

b.)

With the prior written approval of the Board, sell the structure to qualified buyer of his/her own choice only after the censused occupants have waived their rights of pre-emption. Further, actual censused occupants who have the pre-emptive rights shall be given thirty (30) days to exercise the rights of pre-emption. Failure on their part to exercise such option shall mean waiver of their right of pre-emption. In the event that the vendor and vendee cannot agree on the price of the structure, its value shall be determined by the Municipal Assessor’s office based on the prevailing market price in the area and available documents pertaining to the property like tax declarations. The decision of the Municipal Assessor is final and executory.

Voluntary dismantle the structure if such is not rented out or occupied by a duly censused household.

All censused renters and rent-free occupants intending to buy a structure within the Villa Elena Housing Project shall secure the written approval of the LGU. Failure to do so, and should the structure in question be affected by the reblocking activities or proposed development, the LGU shall not be

Any structure constructed after termination of the official LGU Census and Tagging of Structures and without written approval of the Board shall be dismantled.

2.

Any structure or dwelling unit found to be danger to life and property as certified by the building official.

3.

Any structure or dwelling unit where an unauthorized major repair or extension was introduced and not removed despite notice. The LGU shall adopt the procedure for dismantling pursuant to the guidelines as prescribed by existing laws, rules and regulations on the matter.

ARTICLE X : RIGHT OF FIRST REFUSAL BY THE LOCAL GOVERNMENT Section I. Lot Purchase thru a Lot Loan Program by any Financial Institution, default of amortization payment . In case the beneficiary defaulted in the payment of his/her lot loan amortization under the “ Lot Procurement Loan Program by any financial institution and a final Decree of Foreclosure has been issued by a competent court, the local government of Kapatagan, Lanao del Norte shall have the pre-empted right to redeem the subject property or shall exercise its right of first refusal.

This provision shall be annotated in the OCT or TCT. ARTICLE XI : FUND UTILIZATION Section 1. Fund Deposit and Utilization . All Proceeds from the sale of lots and/or buildings in the Villa Elena Housing Project shall be transferred from the general fund to a special trust account and shall only be used for the development of the Villa Elena Housing Project including but not limited to the redemption of lots/buildings unless otherwise allowed by the Honorable Sangguniang Bayan by virtue of an ordinance/resolution.

The use and/or utilization of funds for the preparation , development of resettlement area and construction of houses thereto is hereby authorized , provided that the agency concern shall submit to the sanggunian the corresponding plan and program of the resettlement project.

Section 2. Obligation of the Municipal Treasurer. The Municipal Treasurer shall deposit all proceeds from the sale of lots/building in the Villa Elena Housing Project in a trust account for Villa Elena Housing Project and be release only in accordance to the mandate of this code.

Section 1. Separability Clause. If for any reason, any section or provision of this coded shall be declared unconstitutional or invalid by competent authority , such judgment or decree shall not affect or impair other sections or provision thereof.

Section 2. Applicability Clause. All matters relating to the imposition in this coded shall be governed by pertinent provision of existing laws.

Section 3. Repealing Clause. All municipal ordinances , rules and regulations or part thereof inconsistent with any provision of this coded are hereby repealed, modified or amended.

ARTICLE XIII. EFFECTIVITY Section 1. Effectivity . This code shall take effect 10 days after its publication in a newspaper of general circulation within the province or its posting in the bulletin board at the municipal building.

Provided finally that if the beneficiary qualifies under the installment scheme, an interest of six (6) percent per annum shall be collected in addition to the balance of the purchase price and payable within a period of twenty four (24) monthly installments, to start on July 2014 until June 2016. In the event of default or failure to pay the monthly installments, the interest imposed shall likewise earned interest compounded monthly.

The formula for the monthly installment shall be computed as follows: The unpaid balance subject to installment payments of 24 months multiplied by the factor 0.04432 to get the amount which will represent the monthly installment of the 24-months period. b. Low-cost flood warning system saves lives in PH

THE Agusan Marsh is a 110,069 hectare-protected area in Mindanao, the southernmost region of the Philippines. Nearly 120,000 people inhabit its lakes, forests, and rice paddies, settling in stilted homes and floating communities. Around 80 percent of the population belong to the indigenous Manobo tribe. They depend on the marsh’s abundant resources for farming, fishing, firewood, and hunting wildlife.

Increasingly, villagers are being affected by floods, droughts, typhoons and other the impacts of climate change.

Romy Otacan, Chairperson of La Flora, Barangay (village) La Flora from the Municipality of Talacogon, explains that heavy rains overflow the rivers and lakes, sometimes submerging villages. “The people are accustomed to annual rains; but the floods are getting heavier and affecting more areas.”

In November 2012, USAID, in partnership with the Philippine Partnership for Development of Human Resources in Rural Areas, launched the Agusan Marsh Climate Change Adaptation Project (AMCCAP) to help 61 villages, including La Flora, increase their resil-

Besides developing farmers’ capacities on climatesmart agricultural practices and strengthening local policies on disaster risk reduction, the project developed hazard maps using Geographic Information Systems (GIS), as well as flood early warning systems. Outreach campaigns taught families how to prepare for and respond to natural disasters.

In La Flora, USAID introduced a simple flood early warning system featur-

ing color-coded markings painted on houses, electric posts, schools and other public structures. When water reaches the yellow mark, residents monitor weather forecasts. Orange signals residents to prepare belongings and pre-evacuate women, children, and the elderly, while red prompts evacuation.

The system was put to the test in January 2014 when Tropical Depression Omais swept through Mindanao, affecting nearly half a million people. “The water reached 24 feet. Only the tallest rooftops and floating houses could be seen. Everything else was underwater,” recalls Chairman Otacan. Prior to this, he says, floods only reached ten feet.

Despite the calamity, La Flora residents adhered to the flood warning system and the entire village of 1,120 people survived. “We could not have

been more prepared,” said Chairman Otacan.

The system helped La Flora resident Maribeth Amado protect her family.

“My husband and I watched the water rise, so we packed our marriage certificate, the birth certificates of our children, and land title,” she says.

When the water reached the orange mark, they moved

to safety.

Like Amado, families voluntarily moved when flooding neared dangerous levels. “Nobody was forced to evacuate, allowing rescue teams time to bring everybody to safety,” Chairman Otacan remarked.

USAID established the flood early warning system in 61 barangays throughout Agusan Marsh, benefiting nearly 100,000 people. To further strengthen local capacity for managing disasters, USAID trained more than 1,500 residents and local government officials to develop community-based flood early warning system protocol and hazard maps, conduct search and rescue operations, and manage climate risk data.

The project, which ends in October 2015, will leave behind a population more resilient to climate change, and better equipped to protect their communities.

Investing in the future PMFTC, Inc. — an affiliate of Philip Morris Interna-

tional and manufacturer of such brands as Marlboro, Philip Morris, Hope, Fortune, Champion, Jackpot, Westpoint, Bowling Gold, Miller and Stork — established its first Virginia tobacco experimental farm, covering 10 hectares, in Barangay Ane-I, Claveria, Misamis Oriental. The first batch of transplanting for the commercialization phase was conducted in November 2013. The pre-commercialization phase ended in October 2014 and thereafter it went into full commercialization.

“Since we started operation in 2012, tobacco planting in Claveria has brought better income to the farmers, better than when they planted traditional crops where the cost of production was high and the profit margin was minimal,” Lumunsad said.

Danguilan said that Claveria was chosen to grow Virginia tobacco because of its favorable weather with its even rainfall distribution and good soil which is of the clay loam type.

“Tobacco planting has become a cash crop for the residents as they gained better income allowing them to send their children to college and improve their lives. It also provided employment opportunities to the community and nearby municipalities,” she added.

PMFTC, Inc., which also exports brands Marlboro and L&M to Thailand since 2003, believes that Claveria holds the future of the company. It is investing more than US$50 million (over P2.2 billion) in the municipality over the next five to six years.

“We have a lot of capital expenditures at the moment [that are] being used on several projects, particularly the one in Claveria. We are helping farmers there now…We’re starting a whole new operation because it is quite a unique project that we got going on there—it’s the only second place in the world where we grow tobacco twice a year,” PMFTC President Paul Riley said in a statement. He noted that tobacco could be grown only once a year in the northern part of the country.

Riley said the US$50 million investment would be used to build curing barns as well as provide seedling trays to farmers in the area. “We’re not going away, so we have to invest in the future,” he stressed.

Municipality of Baroy held its th 11 Lechon Festival 2015

IN commemoration of the 66th founding anniversary and Charter Day of the progressive Municipality of Baroy, Province of Lanao del Norte the grandiose 11th Baroy Lechon Festival 2015 with much fun fare and festive celebration was held at the Municipal Tourism Plaza last June 10.

Giving thanks to the bountiful blessings the town has received from the ‘Magbabaya’ Our Heavenly Father Lechonan sa Baroy Festival is a one-day grand affair which starts with a festive parade of twenty three (23) roasted pigs from the different barangays fashionably dressed in different motifs and marched through out the town and ended at the municipal tourism plaza.

The beautifully dressed crispy and succulent lechon were displayed at the respective thematic “PISTA SA NAYON’ booths intricately, beautifully built and decorated by the different barangays who participated in the festival.

Together with the dressed LECHON, displayed are agricultural, seafood and other

native products showcasing the richness and bounty of the municipality of Baroy.

At a glance – The Local Government of BaroyProvince of Lanao del Norte is one of the most peaceful towns in the province with its strategic location compared to other municipalities and is endowed with local talents primarily engaged in producing tasty lechon (roasted pigs) especially seasoned with native spices to bring out the simplicity in Filipino cooking which makes it distinctively delectable and mouthwatering.

Having noticed this, the Local Government of Baroy found this to be helpful in boosting the economic growth and tourism potentials of the town and its people. With its sole intention of making the most of these talents profitably, the Lechonan sa Baroy Festival was born and celebrated every 10th day of June, Baroy’s Charter Day. The fashionable, succulent and crispy lechon were then judged the way it is presented, dressed and how it is being spiced up to give off the right balance of spices and salt that suits the taste of a famished

diner. Joining the local panel of judges were invited guest judges Ms. Edna Garmendia, a philanthropist and Ms. Maria Teresa M. Picardal-Manager of Bohemian Express Travel & Tours, Inc., of Cagayan de

Oro City, both are supporters of the tourism endeavors of the region. The special judges were invited by the ever- dynamic Tourism Czar-Regional Director Catalino ‘Butch’ E. Chan 111

of Department of Tourism X which was the major presenter of the grandiose 11th Lechonan sa Baroy Festival 2015. Barangay San Juan under the leadership of Barangay Chairman Hon.

Adelaido F. Laranjo, Jr. was the Grand Winner of the Festival.

Director Butch E. Chan encouraged the active Lady Mayor Honorable Rosa D. Olafsson of Baroy to continue promoting the tourism potentials of the town with its dynamic Tourism Officer-Ms. Rosalbeth C. Villarin to sustain and strengthen the Lechon Festival of Baroy-which is considered as one of a kind lechon festival in Northern Mindanao-the whole of Mindanao and in the country today.

Director Chan officially announced during the event that Baroy Lechon Festival will be brought to Baguio for next year’s Northern Mindanao Pasundayag 2016-a blessing to all the constituents of the Municipality of Baroy in their effort to continually promote its growing tourism industry.
