Mayor Duterte twits Secretary De Lima over DOJ prohibition of allowances for gov’t prosecutors

AVAO City - Prosecutors here will continue to receive allowances from the local government despite the directive from Department of Justice, which prohibits prosecutors all over the country from receiving such grants.

Mayor Rodrigo Duterte on Wednesday said he will not abide by Justice Secretary Leila de Lima’s order.

Speaking during the 27th National Convention of Prosecutors at the SMX Convention Center, Duterte said the granting of allowances and other benefits is “provided by law”.

“I will not adhere with her order,” Duterte said.

“Bakit mo tatanggalin yung nakakatulong?” he added.

“I hope that this (the granting of allowances) will be modified simply because it is not good… it is not good to us, mga local officials, because the implication is takot kayo baka may hingiin kami,” Duterte explained.

De Lima had said last month during the 15th Integrated Bar of the Philippines (IBP) Convention in Cebu City that she would issue a directive prohibiting all prosecutors and employees of prosecution services nationwide from receiving allowances and other forms of benefits from LGUs. The Justice secretary said it is to ensure that the prosecutors will not feel beholden to local politicians who might affect their independence and partiality in the discharge of their mandate.

De Lima said the directive would be for strict compliance.

But in his ke ynote

speech during the 27th national convention of the Prosecutors League of the Philippines (PLP) at the SMX Convention Center , Duterte said De Lima was wrong since there are laws that allow the LGUs to give allowances to prosecutors.

Duterte said the order of Secretary De Lima is discriminatory because only prosecutors will be prohibited from receiving the allowance while others such as the court judge can still accept it.

“If I may ask, why? What is the reason you came up with this silly thing?”

Duterte said, addressing de Lima.

According to Regional State Prosecutor for Region XI, Antonio Arellano, there are actually three legal bases in which prosecutors are allowed to accept allowances from the LGU. Arellano first cited Presidential Decree (PD) No. 1275 or the Creation of the National Prosecution Service which provides that LGUs will provide allow-

ances to the prosecutors and employees “including even the rental for buildings and other requirements on the administration of criminal justice.”

Under section 14 of PD 1257, “the salaries of provincial and city fiscals and their assistants shall be paid entirely out of national funds and included in the annual appropriations of the DOJ. This is without prejudice to the grant of allowances to the above-mentioned fiscals by their respective local governments, in amounts not exceeding 25 percent of their basic salaries.”

It also stated that the salaries of clerks, stenographers and other subordinate employees in the offices of the provincial and city fiscals shall be paid by the province or city.

Arellano also quoted the Republic Act (RA) 7160 or the Local Government Code of 1991 which allows LGUs to provide assistance to the prosecutor offices in the country.

“The third is the new law which was enacted several years ago that is Republic Act No. 10071 (“Prosecution Service Act of 2010”) which also allows local government units to grant allowances to prosecutors provided that the allowance will not go beyond 50 percent of their basic salary,” he said.

There is also the Act Granting Additional Compensation in the form of Special Allowances for the Members of the National Prosecution Services and the State Counsels (RA 9279).

Under Section 16 of RA 10071, the salaries and allowances of regional, provincial and city prosecutors and their assistants, and the members of the prosecution staff, including the prosecution attorneys, shall be paid entirely out of national funds and included in the annual appropriations of the DOJ. Provided, however, this provision is without prejudice to the grant of allow-

ances to the prosecutors by their respective local governments in amounts not exceeding 50 percent of their basic salaries, Arellano said the PLP, Chief Prosecutors Association and Regional Prosecutors Council already wrote a letter to de Lima asking her to reconsider the order.

“We are with her in her desire to really come up with higher standards of governance.

But we are saying, considering the situation of the prosecution on the field in the regional areas in the regional offices and in the cities and provincial offices, the resources from the national government is very inadequate,” Arellano said.

The Office of the City Prosecutor has an allocation of P359, 937 in the proposed Supplemental Budget No.2 of Davao City as aid of the city government.

Prosecutors in Davao City receive a uniform allowance of P8,000 a month from the Davao City local government.

CAGAYAN de Oro City--A village chief has expressed optimism that the city government and the tourism department will help develop the Sinulom Falls found in the hinterland Barangay Tignapoloan.

Jay Roa Pascual, barangay chairman of Tignapoloan, was optimistic that Sinulom Waterfalls will soon become the mustvisit tourist destination in Cagayan de Oro City after the Department of Agriculture (DA) will construct a farm-to-market road leading to the waterfalls.

Pascual said Sinulom Waterfalls is consist of 28 waterfalls and is situated in a 5-hectare land in the boundary of Barangay Tignapoloan in Cagayan de Oro

City and Talakag town in the province of Bukidnon.

He said Barangay Tignapoloan is approximately 43 kilometers from the city proper and that Sinulom Waterfalls can only be accessible by foot because of the still underdevelop road.

He added that Sinulom Waterfalls is also surrounded by virgin forest.

In fact, he told the Philippine Star, that monkeys, snakes, and monitor lizard can still be seen within the area where the infamous Sinulom’s 28 waterfalls are located.

Councilor Candy Darimbang, chair of the City Council committee on tourism, has assured Pascual that she will pass a resolution in the City Council to declare the area as a protected area.

Darimbang, who visited

the area, said Sinulom Waterfalls have the potential of becoming the must-visit tourism potential in Northern Mindanao given the presence of its 28 waterfalls.

Although not listed as among the tourist destination in Cagayan de Oro City by the Department of Tourism (DOT), Pascual has started developing the area.

Apart from constructing a cold spring swimming pool, Pascual said the area has Strawberry garden.

Soon, he added, he will build an Herb Garden, Fish farm, and mini zoo.

If develop, said Pascual, Sinulom Waterfalls will not only help boost the economy of Barangay Tignapoloan and the city government of Cagayan de Oro but, help generate more jobs.

The time comes for restitution A lot of whispers in the political circle are now getting louder. The rumors about the possible candidates are gradually emerging. But, who are the candidates? While there are those who are excited, many are also dismayed at hearing the names of wannabes – whether reelectionist or not.

Sometimes, one is astonished why people dislike names of candidates already known to them.

Thus, perhaps, there is the feeling that the public officials being unworthy of the votes. Any idea on how the electors measure the capability of the elected public officials?

Someone mused that there is no need to measure the worth of elected public officials. They said that the reactions and the frustrations of the constituents in the way these elected public officials are running the affairs of their administration speaks louder than words.

But, why blame the elected officials? Isn’t it that the voters sold their votes and that the elected public officials are not, in any way, compelled to serve them in return? Can the voters claim the right to demand services when they themselves are to be blamed of their misery?

Well, there are also insinuations that the voters did not actually vote the incumbent public officials.

The voters claimed they were cheated because they could not even account their own votes in their own precincts! These allegations are sometimes stranger than fiction. Nevertheless, with a widespread accusation of election fraud, the complaint could be true.

It is for this reason that one should seriously consider on whom to vote when elections come. If there are enough grounds – whether proven in court or not – that the elected public officials

are corrupt, by all means, the voters should campaign to get rid of these public officials perceived to be corrupt and immoral. These corrupt public officials have no place in public service!

In any case, there is no need to tell who these corrupt public officials are.

After all, we have written many times in the past that the public knows better the integrity of their leaders.

Now, as the election season is coming closer, it

is time to review how the incumbent public officials fare in the last three years. It is also fair to take a second look for those who lost in the 2013 elections. Thus, a careful assessment of the performance of the winner and the losers could provide the voters an informed decision.

Perhaps, if the voters have mistakenly voted for an incompetent and a corrupt public official, then, it is only fair to boot out the public official from office.

The fear of a formidable political machinery, especially the ruling political party, is not a ground to douse the resolve to kick the public officials out of office. The voters should not be cowed and be threatened with election fraud. ••• Although for a short span of years, I was assigned to cover the police beat and I used to mingle with some policemen in Divisoria before.

During that time, some, if not all, policemen are complaining for lack of support from the national government. Low salary, and benefits, slow promotion, not even issued a service firearm, no supply of ammunition, among others.

For sure, some of the problems before are still the same problems today.

First, the lack of support from the national––and even the local government.

For instance, policemen from Cugman police precinct in Cagayan de Oro are now in the limelight after they––by accident––arrested the two bike-riding men allegedly responsible for the death of former Councilor Marc Anthony Bagaipo of Gingoog City.

Rememb er that the killing of the 44-year-old Bagaipo happened in the evening of March 31 in Gingoog, a component city of Misamis Oriental, is approximately 122 kilometers east of Cagayan de Oro City and 74 kilometers west of Butuan City. And the alleged suspects were not arrested via hot pursuit

operations, but by accident; at a checkpoint set up along the national highway in Barangay Cugman in Cagayan de Oro City and is intended to implement the “No plate, No Travel” policy.

And to confirm the report, I dialled 117 and asked for the phone number of Cugman police precinct. A woman replied: 855-8861.

Try to dial it, and you will get a reply: “The number you dialed is not accessible at the moment.”

This kind of predicament goes to show how poor our PNP when it comes to support from the national government–-and even from the local government.

Ang linya sa telepono walay klaro and how can you expect an efficient service from this police precinct if it cannot be accessed by phone. Does it mean that when there is an emergency, one has to take a ride going to that police precinct to seek for police assistance.

Whew!

••• For a start, I have high hopes that Cagayan de Oro Vice Mayor Caesar Ian E. Acenas will be able to pass a City Ordinance providing all police precincts in Cagayan de Oro the needed stable telephone connections, computers and printers.

If we want stable peace and order in our locality, let us help our policemen.

Village chief escort killed in ASG ambush in Basilan

ISABELA City, Basilan -Troops have launched a pursuit operation against suspected members of the Abu Sayyaf Group (ASG) who ambushed a b arangay chair man and his escort Saturday morning in the nearby town of Sumisip.

S enior Superintendent Mar io Buyucan, provincial police director, identified the victims as Nurahman Japparul, 52, the barangay chairman (village chief ) of Mangal, Sumisip, and his security escort Hajim Barilyo.

Buyucan said the victims were ambushed around 6 a.m. Saturday i n t he b ou nd ar i e s of

Barangays Mangal and Central, Sumisip town.

Buyucan said the victims were aboard a motorcycle were traveling to Sitio Landing, Barangay Central when suspected Abu Sayyaf Group (ASG) bandits ambushed them.

Col. Rolando Joselito Bautista, Army’s 104th Infantry Brigade commander, said the bandits led by Juhaibel Alamsirul alias Abu Kik were the ones responsible in the ambush.

Baustista disclosed that troops from the Marine Battalion Landing Team-11 are pursuing the group of Alamsirul.

Zambo Norte steps up campaign vs rabies drive and anti-rabies vaccination to dogs in the two cities and 25 municipalities starting January this year.

It was learned that the province had five recorded deaths due to rabies last year.

Early this year the PROVET has already immunized 2,055 dogs other than those immunized during Bayanihan Outreach Program conducted in the area.

Rabies is a viral disease that causes acute inflammation of the brain in humans

and other warm-blooded animals. It is spread when an infected animal scratches or bites another animal or human or the saliva from an infected animal can also transmit rabies if the saliva comes into contact with the mouth, nose, or eyes.

Dr. Elmer M. Atienza, PROVET head, said that rabies will be eradicated through immunization of dogs and other animals.

He added that this immunization to animals by

the provincial government is free of charge with almost P1 million allocation eamarked by the provincial government for the purpose.

“Rabies is a deadly disease.

Doctors, nurses and other medical attendants need to be quarantined if their patient died due to rabies,” he stressed.

Globe expands sustainable livelihood opportunities for vocational students Globe Telecom recently collaborated with Educational Development Center (EDC), a global non-profit organization which addresses some of the world’s most urgent challenges in education, health and international development. This enabled the telco to provide new opportunities for public high school students to engage in sustainable livelihood.

Globe participated in the EDC’s Accelerating Work Achievement and Readiness for Employment (AWARE) program, where the company hosted 54 technicalvocational students from Benigno Ninoy Aquino High School (BNAHS) and Eulogio Amang Rodriguez Vocational School. By sharing its information and communications technology (ICT) expertise, Globe sought to enhance the work readiness of the students who wish to pursue a career in the said field.

The participating students were able to gain 40 hours of work exposure from the Information Systems Group (ISG) of Globe. They received mentoring on the latest technologies, shadowed Globe technicians, and received hands-on training on various hardware processes, including PC preparation, standard tools of work installation, email and network configuration,

personal computer troubleshooting and retirement, as well as software installation.

Likewise, it benefits social enterprises, micro enterprises and the underserved sectors of the society such as the Globetrained students.

On its 5th year, this time, CIC shall hold the very first Barangay Culinary Livelihood Program in the city titled Lutong Panginabuhian! with the theme: “Panginabuhian alang sa Kalamboan, Ialagad sa Katilingban.”

The main purpose of this event is for the school to impart and to share the CIC education to mothers and families in different Barangays focusing on practical livelihood topics, recipes and food sanitation.

One of the highlights of the BCLP is the Kagay-an Barangay Cook-Off. Five teams comprising five members each are to compete against each other and the dish that the teams shall cook will only be revealed during the Cook-Off. Barangay Lapasan was the fifth and the last Barangay that CIC visited for the Barangay Culinary Livelihood Program (BCLP) last April 8, 2015. Chef James I. Damasco, one of the CIC Chef Instructors, showcased a free cooking demonstration on different livelihood recipes and the audience members were given a copy of the recipes.

The Cook Off immediately followed together with the announcement on the recipe

that the participants will cook. Most of the participants are members of the Barangay Women’s Development Council (BWDC). The program was more enjoyable with a raffle of CIC novelty and intermission numbers from the BWDC member.

Schools have ended.

Goodbye to home works and quizzes and say hello to summer. The heat of summer is sizzling. Summer schedules are already full.

Families opted to have their family picnics, reunions to meet relatives and love ones, children thank their parents by helping hand in daily house chores, some goes for computer games, but to those children who want to learn more opted to go summer classes and have fun.

Education doesn’t stop on summer. In line with Every Child a Reader Program (ECARP) under the Department of Education (DepED),

every summer encourages every pupil to attend summer classes. This program called Summer Reading Fun. It aims not to spoil the ambiance of summer instead making their summer worthwhile.

For several weeks, classes are held outside the classroom.

They are taught to love reading using the different arts of speaking. Teaching them as well in interacting with other children through group activities and by this building self-confidence is achieved.

Every day they learn something differently. They are taught to speak using verse choir, jazz chant, Chamber Theater and reader’s theater.

While in reading, they learn

oral interpretation. Giving life and colors to every word they read. And in team reading, comprehension and team work is recommended since they will answer questions from the book they read by team. The opinion and trust of every member is very important.

Summer reading fun develops the reading and speaking skills of every school child while they are having fun. They learn while they are enjoying and building confidence. Thus every summer belongs to one child to achieve their goals, as they enjoy the summer, the young generation acquires new knowledge and responsibilities.

REX has just finished his junior studies at Regional Science High School in Gusa and is now back home enjoying his vacation at Sta. Ana, Tagoloan.

This summer of 2015, he is looking forward dipping at Sta. Ana river. As he slowly inches towards the bank, he can visibly feel the heat of the summer simmering. The sun is rising to its zenith, dazzling and white like a mirror. And like a mirror breaking, its pieces fall shining and brilliant on the river.

As Rex is wading at the river, he spots someone who is gaily enjoying bathing. That someone looks back and Rex sees a familiar face – Maibee.

Fifteen-year-old Maibee is the only child of one of the remaining aristocratic families in Sta. Ana. Their house is the biggest in the village, enclosed with a wall topped with sharp glass shards. Maibee and Rex used to be playmates but they haven’t seen each other after sixth grade when Maibee transferred at an all-girls school in Cebu.

“The FOI will not only prevent graft and corruption, but more importantly, our citizens will learn to get involved and participate in government matters,” Poe said in her sponsorship speech.

However, the congress version which is still pending for its approval cited in its Declaration of Policy (Section 2 of the proposed FOI Bill) which provides “the State recognizes the right of the people to information on matters of public concern, and adopts and implements a policy of full public disclosure of all its transactions involving

public interest, subject to the procedures and limitations provided by this Act. This right is indispensable to the exercise of the right of the people and their organizations to effective and reasonable participation at all levels of social, political and economic decision making.”

With the premise of the “right to know,” Almonte said that, even if the FOI is still pending in the House, his committee is responsible for the information about what is going on with the proposed FOI bill and the BBL.

M’lang and Kabacan, two rice producing towns in North Cotabato, have been placed under state of calamity after damages to crops reached about P40 million and P21 million, respectively.

The declaration came after the Provincial Disaster Risk Reduction and Management Council recommendation to allow the local government units to use their calamity funds.

Among the heavily affected agricultural products are rubber and banana, two major agricultural products of M’lang next to rice.

Rice and corn fields in M’lang have dried up, forcing farmers to shift to heat resistant crops but these will take time to grow.

In Kabacan, Mayor Herlo Guzman Jr. said the municipal council has already issued the necessary legislation putting the entire town under state of calamity.

Guzman said the local agriculture office is finalizing the list of farmers to be given assistance after rice fields, corn fields, banana plantation and rubber plantation have dried up.

Grass fires which occur every now and then also threaten crops that can still be recovered.

Dr. Eliseo Mangliwan, North Cotabato provincial agriculturist, has recommended to the Department of Agriculture the conduct of cloud seeding operations.

While DA-12 is ready for the cloud seeding, Mangliwan said it cannot be carried out right away due to the absence of “seedable clouds.”

She said corn products have suffered the biggest loss with an estimated P67 million worth while palay losses have amounted to P11 million.

Donggay warned that if the privatization pushes through, power rates in Mindanao will level off

with that of Metro Manila’s, which, he said, is “highest in the world.”

“And, because of the high rate in electricity in the country, some locators are transferring to other Asian countries,” Donggay added.

Currently, the power rates in Mindanao are still competitive compared to other Asian countries, Donggay said.

Donggay said considering factories and industries are energy intensive, companies along this line of business are sensitive to high rates.

“If we want to promote industrialization through manufacturing, the country must have a competitive power rate,” said Donggay.

The promise of the Electric Power Industry Reform Act of 2001, otherwise known as EPIRA, according to Donggay, is security and affordability of electricity.

“But, what is happening now? After the passage of the law (EPIRA) 15 years ago, the Philippines now has the highest rate in the world,” Donggay said.

“The IPPAA is a privatization process being used by the PSALM Corporation to sell power from Mindanao Power plants at higher rates than those approved by the Energy Regulatory Commission (ERC),” said Engr. Tauli.

The third resolution calls for the holding in abeyance of PSALM’s plan to subject Steag coal power plants in Misamis Oriental to IPPA.

THE Office of Civil Defense (OCD) 10 provided technical assistance to the conduct of Basic Incident Command System for the municipality of Sinacaban, Misamis Occidental at Aicila Suites, Cebu City on April 6 to 8. Thirtynine members of the Sinacaban Municipal Disaster Risk Reduction and Management Council participated in the said training.

The Basic Incident Command System is a standard onscene, all hazard incident management concept. It allows its users to adopt an integrated organizational structure to match the complexities and demands of single or multiple incidents without being hindered by jurisdictional boundaries. It is a non-permanent structure that is only activated in response to disasters and emergencies.

“There is a need for an effective and efficient response management system because past lessons have shown the need for an organized on-scene response mechanism during disasters and calamities as mandated by RA 10121 otherwise known as The Philippine Disaster Risk Reduction and Management Act of 2010 and its Implementing Rules and Guidelines. ICS have been proven to be effective in managing wide range of emergencies and disasters,” said OCD 10 director Ana Cañeda.

It was learned that a National Disaster Risk Reduction and Management Council (NDRRMC) memorandum circular authorizes the use of ICS as an on-scene Disaster Response and Management Mechanism under the Philippine DRRM system. Executive Order No. 82 signed by President Aquino likewise advocates the use of Incident Command System.

And OCD is the agency tasked to implement ICS training to help capacitate local government units and other agencies in dealing with emergencies and disaster that may occur in their respective areas of responsibilities.

At the end of the course, the participants were able to enhance understanding of the Incident Command System as a vital tool for effective disaster response, provide an overview of ICS, its background, concepts, principles and features, capabilities, organization, facilities and common terminologies and; demonstrate knowledge on basic ICS functions through exercise and class discussion context Cañeda said that OCD 10 has scheduled this year more ICS trainings in other localities.

3rd SEABA U16 games set in Oro

CAGAYAN de Oro will be hosting for the first time FIBA (Federacion Internationale de Basketball) Asia U16 qualifying games under the 3rd Southeast Asian Basketball Association (SEABA) at Xavier University gymnasium on April 14 to 19 this year.

Teams from Brunei, Indonesia, Malaysia, Thailand and host country and two-time defending champion Philippines will be seeing action in a round-robin format, the top three will earn the berths for the 2015 FIBA Asia Under-16 Championships in India, according to Samahang Basketbol ng Pilipinas (SBP) executive director

Based on the SBP website, two games will be played every day at 4:00 p.m. and 6:00 p.m. starting April 14 where Indonesia will face Brunei and then Thailand against Malaysia.

The next day, it will be Brunei versus Thailand and Malaysia against the Philippines. No game is set on April 16.

On April 17, it will be a matchup between Indonesia and Malaysia; and Philippines against Thailand. It would be Thailand and Indonesia; and then Brunei ad Philippines on April 18, then on the final day, Malaysia versus Brunei and then Indonesia versus the

Philippines.

The Philippine team, dubbed Gilas Pilipinas U16, is under the mentorship of Tab Baldwin who took over the coaching tasks from Chot Reyes in December last year.

Two years ago, Indonesia hosted the 2nd SEABA and was held in Yogyakarta where the Philippines topped the tournament with Thailand and Malaysia taking the second and third qualifying spots while the host team was relegated to fourth-place finish. In 2011, the Philippines also emerged on top followed by Malaysia, Indonesia and Singapore.
