Lawmaker calls for meeting of municipal police commanders

By GERRY LEE GORIT, Correspondent MISAMIS Oriental provincial board member Bebeng Dumadag has called for a meeting of all municipal police station commanders on Thursday.

Dumadag said she plans to pass a resolution for the installation of mobile checkpoints in strategic areas in Misamis Oriental.

“We had been witness to

the surging criminalities in the different municipalities of the province,” she said.

She said the purpose of the meeting is to discuss the viability of the proposed resolution.

The meeting will be chaired by the committee on peace and order.

ON top of lending to corporate clients, the Philippine Veterans Bank (PVB) is tapping the local government units (LGU) to boost their lending business.

“We are strengthening our grip on the LGU market.

We want to make this segment a main driver of the bank’s growth,” said Miguel Angelo Villa-Real, PVB vice-president for corporate communications and marketing services, referring to the numerous LGU projects across the country that the bank can help finance.

Duterte warns Davao bizmen against corrupting employees on renewal of permits

AVAO CIT Y -Mayor Ro drigo Duterte has warned businessmen against corrupting government employees by offering money to speed up business permit renewal, saying, “I will throw all your papers.”

“Do not abet corruption. Do not corrupt us,” Duterte said, adding, “Kundi magkaka-problema kayo sa akin (Or else you will have problems with me).”

against giving even for one peso to any government employee or official. He also warned employees against accepting money from businessmen or face outright dismissal from service.

Duterte said he has no

problem if businessmen would use and pay fixers such as accountants and bookkeepers if they do not have enough time to process their permits at City Hall. The mayor, however, emphasized the need to follow government rules.

The mayor also told Bureau of Fire Protection (BFP) personnel to refrain from acting as middlemen for fire extinguisher producers.

Iconic pipe bridge crossing to rise in Davao DAVAO CIT Y -- An eye-pleasing pipe bridge crossing will soon be a landmark along Davao City's historic Governor Generoso Bridge.

The Davao City Water District (DCWD) is currently building a suspension-type of pipe bridge crossing Davao River that will hold its 1000 millimeter water pipe.

The earlier pipe bridge which held 650 and 700 mm pipes was destroyed by floods two years ago and the temporary remedy was to place the pipes along the bridge. However Department of Public Works and Highways limited the capacity to just two 200 mm pipes.

"It drastically reduced capacity to 65%, affecting 45,000 connections." said DCWD spokesman Atty.

With the new pipes which has actually a bigger area than the combined 650 and 700 mm pipes there will be an 8% increase in water capacity as compared to the previous plain-looking pipe bridge before it was damaged by the flood.

Delima said the Bankerohan Pipe Bridge Crossing will be a suspension-type bridge structure similar to the famed San Francisco's Golden Gate Bridge or Cebu's Marcelo Fernan Bridge.

They are planning to put up lighting in the bridge which will be aesthetically pleasing and can be a tourism attraction in Davao City.

Aside from aesthetics, the high tension cables in the suspension bridge holds the trusses that carries the pipes making it structurally durable. The bridge posts are hidden behind the road bridge posts so as to be protected from future flood debris.

Just in case the pipe brige will be knocked down by floods again, DCWD is planning to build a reserve pipe bridge crossing along Bolton Bridge.

The budget of the project will be around P105million and is expected to be completed by March this year. (PIA/RG Alama)

Bring Back the Children

When I think about children, I think about love. I think about the love that gleams from the mother’s eyes as she cradles the child to her chest. I also think about innocence, of how children seem so pure and satisfied, oblivious to the horrible things that keep happening to our world. I think about freedom, too. Children are free to run as far as their legs can take them. While being a child encompasses all of these things, sadly the truth is becoming a part of the past.

Children are supposed to be free. The world should be their playground. They should have no worries about running outside with their friends. But what’s happening? Reports of kidnapping are nothing new anymore. Outside, the child is vulnerable to many evils. There is a new sense of fear that troubles parents. Soon, they begin to look at the playground not as a safe place to let their child be free, but as an eerie landscape for possible unwanted misfortunes.

Children are supposed to be innocent. The darkness of the world should not be their problem. But reality says otherwise. On the frail shoulders of a young boy, we can see a sack filled with salvaged materials which he found under the heat of the sun. He has been thrown into the mess of this world so early and so unprepared. Innocence is no more as he ventures further into a world of drugs, theft, alcohol and violence.

Children are supposed to have love. They should feel the love that their parents shower them with.

They should drown in the love in their homes as they breathe it in everyday. The child’s home is a place of love, but sometimes, it is the exact opposite of that. The home becomes a house. It becomes a dangerous cage for the child. He does not wait for daddy to come home bearing gifts, but he cowers and prays he returns sober. He does not watch TV, but watches mother get beaten up and hopes it does not happen to him as well the love from his family fades away quickly, and so does the love that he has for them.

With all of these things existing as the harsh truth, can a child still be a child? If all of these terrible things continue to happen, then soon we would not see children anymore. Their eyes would be filled with darkness and pain in a struggle to protect themselves from this twisted reality. Children should not be bothered with these problems. It is the duty of those who can help them to help them.

These children need to return. We need to bring back the children and give them what is rightfully theirs.

Organizations have come with hearts overflowing with willingness to save these children and bring them back. However, it is the prime duty of the parents to ensure the protection of the child. They

must make sure that they have innocence, freedom and love. It is our duty as well, even if we do not know the child. Inside, we know what it feels like to be a child. Wouldn’t we all like it if all children experienced the love that we had?

Let us leave the children be and allow them to be children. There may be other issues present, but is this not an issue that’s as deserving to be addressed?

If the world the children see today is grim, then how can they, as future leaders, build a community that is not? To protect the children is to protect their future – our future. If we do not, then it may be too late to bring the children back.

Children in Need of Protection Whenever you find yourself in the heart of the city, wherein you can feel the hustle and bustle of the streets as well as seeing people rushing out to work, you can notice several children wandering around alone and unprotected. Dressed in loose shirts and baggy underpants, you might be one of those who nonchalantly brush their extended hand off or just ignore them like a plague. You might catch yourself unaware of it, because for you, they are nothing but just children.

Right?

L et thes e s cenarios knock some sense to you.

Imagine your little brother waking up early at drawn, sporting his usual gears of plastic bags tied around his waist, and then riding his old “sikad” to a dump site.

In the middle of the hills filled with piled garbage and all the unimaginable wastes, picture him searching for recyclable bottles, tin cans and other stuff that he can sell to a junk shop. You can notice his calloused hands, smell his foul scent, and take a step back upon looking at his greasy and unkempt

appearance.

Next, here comes your little sister. You left her alone inside your house.

Bored, she goes outside to play. There is a drunkard who looks at her maliciously as she bounces around, laughing and having the time of her life playing with her friends. Suddenly, the drunkard corners your sister in a secluded area of your barangay. He rips her skirt off and does whatever evil things he fantasies at her. Once you came back to work, you find yourself shocked upon looking at your sister chilling from head to toe. She robs incessantly and jerks away whenever you try to touch her. Her eyes are clouded with fear and her thoughts are consumed with dread and miseries now that she is wrecked and sexually exploited.

Then, you have a cousin who just comes out from labor. You are delighted for having an addition to your big family. You get yourself too attached to your baby nephew that you want to hold him whole day and sing him lullabies to sleep. Unfortunately, your

Guest Editorial cousin cannot afford to raise the baby. The baby’s mother decides to put the baby up for adoption. You find yourself grieving and missing your nephews in the end.

These scenarios are some of the cases that concern child protection. Sure, you might hearing these stories year–round just by watching it on soap operas and whatnot. Still, these underscore great relevance to the authorities and to yourselves as well.

Children are said to be the most vulnerable sector of the society. Innocence is considered to be their middle name as they develop themselves to be mature individuals. Sadly, how can they fully and morally develop if their exposure relies in the harsh condition of the world?

In t he Ph i l ippi ne s, the Department of Social Welfare and Development (DSWD) is the leading agency that provides service concerning child and women protection.

According to Ms. Gloria

Mosqueda, Social Welfare Officer III of DSWD 10, child cases such as child labor and child trafficking are escalating yearly.

There are local social welfare centers open to all children who are abandoned and abused. Case management and counselling will be conducted to them so that their problems will be threshed out and also to aid their family to a renewed life.

Indeed, child protection is not just a responsibility carried out by the social welfare authorities. Parents, who are primarily responsible for bringing their children in the world, have to do their part as well.

Also, this goes without saying that as you find yourself facing a street kid, try not to get annoyed. Give them a penny or two because even an ounce of attention makes a great difference to them. To be evil The surprise inspection conducted by Justice Secretary Leila Delima at the New Bilibid Prisons facility in Muntinglupa middle of December last year proved beyond doubt how evil consumed every personnel of that facility.

Maximum security convicts serving their sentences for varying crimes were discovered to be living in luxury as if they were just staying in five star hotels.

Their prison cells were converted into luxury rooms complete with Jacuzzi, over-sized television sets complete with cable connections, use of telecommunications gadgets such as mobile phones with internet connections, firearms, and lots of cash, drugs and what have you.

Their scandalous living resulted in their being transferred to the National Bureau of Investigation prison facilities while their luxurious rooms were being dismantled and how corruption was able to seep into the national prisons facility was being studied and analyzed to prevent it from rearing its ugly head again.

But lo and behold! While the convicts were temporarily housed at the NBI prison facilities, their temporary cells were again raided and their rooms yielded lots of cash kept in garbage bins and toilet water tanks. It was likewise discovered that they still have access to the outside world through Bluetooth connection.

This discovery proved beyond doubt as well that if the New Bilibid Prisons personnel could be made to close their eyes, ears and mouth to what was going on at the maximum prisons facility, NBI personnel incharge of its prisons facilities are likewise vulnerable.

The conversion of the

prison cells of these high profile convicts in the New Bilibid Prisons could not have been done without the approval and connivance of the prisons officials and personnel. How can those classy bathroom tiles, toilet bowls, and Jacuzzi bath tubs found their way into their cells without the prison officials noticing them?

How were they able to bring in those expensive wall paneling of their rooms, those appliances and communications gadgets without the knowledge of the prison officials and personnel? If they will say they honestly did not notice all these improvements and use by the high profile inmates of appliances and other communications gadgets, these prison guards and officials are either blind or blinded by wads of money causing their failure to prevent this travesty of the law from happening right before their own noses.

But look! Even NBI personnel are not immune to corruption by these high profile convicts. Just a few days of stay at the NBI prison facilities, the prisoners were able to already corrupt

the NBI personnel guarding them. For how can you explain the presence of those large amount of money and communication gadgets in the cells of these high profile convicts without the very people tasked to watch and guard them not noticing them?

I am afraid if these high profile convicts are allowed to stay at the NBI prison facilities a bit longer, it’ll not take them long to again convert their cells into hotel rooms complete with all the appliances and facilities one will find in a five star hotel.

This incident just proved how love of material things could consume a human being. The high profile prisoners want to continue their way of life when they were not yet in prison. Even when they were already in prison they still would like to enjoy the material things they enjoyed before they were thrown into prison hence their scandalous living while at the New Bilibid Prisons.

The prison officials and their subordinates would like to have a taste also of the kind of life these high profile prisoners were See bacon, page A9

Troops capture Urban Terrorist Group leader in Basilan

SABELA CITY, Basilan - Combined military and police forces have captured a suspected Urban Terrorist Group (UTG) leader of the Abu Sayyaf Group (ASG) following a shootout in the nearby town of Sumisip Wednesday, an official said.

Col. Eliglen Villaflor, Army’s 4th Special Forces Battalion commander, identified the captured UTG leader as Imran Daiyong Mijal alias Boh, who was wounded during the shootout.

Villaflor said the shootout ensued after Mijal “violently resisted” when they served warrant of arrest against the UTG leader

He said the troops have recovered from Mijal’s possession an M-16 Armalite rifle with several rounds of ammunitions, one rifle grenade, and a caliber .45 pistol with ammunitions.

He attributed the successful arrest of Mijal to the active participation of concerned citizens in information gathering and their sincere desire to end lawlessness in this province.(PNA)

A LAWMAKER from Mindanao has filed a bill declaring as a criminal offense the practice of the police authorities of naming crime gangs after their hometown or ethnic community.

Rep. Henry S. Oaminal (2nd District, Misamis Occidental) said House Bill 4758 prohibits the Philippine National Police (PNP) and other police agencies from using the names of places of origin of suspects in describing crime suspects, felons, wrongdoers, offenders and other malefactors.

“This police predisposition does not only smear and besmirch the name of the town or city but also the innocent people therein,” Oaminal said.

Oaminal said when the police fail to forthwith solve a crime, they promptly and facetiously tag the suspects with appellations or moni-

kers, which dovetail with the manner of the commission of the crime.

“Worst and far more unwarranted is the police predilection to identify criminals and gangsters from their suspected places of origin. Thus, we have the Ozamis Gang, the Ilonggo Gang and the Waray-Waray Gang, to name a few. Simply because the suspects have that regional diction or are friends with one or two from the area, they are dubbed as such,” Oaminal said.

“Imagine being tagged as the town mate or barangay mate of a certain criminal. Certainly, there can be far more congruous ways for the authorities to label felons and criminals,” Oaminal said.

THE Philippine Coconut Authority, Region 10 (PCA10) is embarking on a massive coconut growing project in Misamis Oriental.

Alongside with the 2nd Kuyamis Festival 2015 celebration this week with Kuyamis being a coconut variety, PCA 10 will implement a P50-million Japan International Cooperation Agency (JICA) project to put this program in motion.

KUYAMIS FESTIVAL is an occasion associated with the founding of the province of Misamis Oriental since it became a separate and independent local government unit on January 1, 1930 by virtue of Republic Act 3537.

Historical jottings and sources reveal that KUYAMIS is the original name of MISAMIS. It is a variety of sweet coconut, which was a staple food of the earliest known Negrito settlers of Misamis. The word “KUYAMIS” was later corrupted to “MISAMIS” when the Spanish colonizers came.

Kin of cops held by NPA want troop pullout for safe release of captives

URIGAO CITY - - The wives and relatives of three policemen who were snatched by the New People’s Army in Surigao del Norte almost two months ago on Monday asked the military for a troop pullout from the province’s hinterlands to facilitate the safe release of their loved ones.

“I’m asking the military to abide by the Suspension of Military Operations for the quick and safe release of our husbands because news reports said military operations are still ongoing.

We’re afraid that our loved ones would be endangered and this (operation) is preventing the release of the captives,” Matosalem L. Polvorosa, wife of PO3 Democrito Polvorosa Jr. said in Cebuano.

PO1 Jonry Amper’s wife, Christine, and relatives of PO1 Marichel Unclara Contemplo, another captive policeman, aired a similar appeal.

Amper was taken in Malimono town last Nov. 12 while Polvorosa and

Contemplo were seized in Alegria town last Nov. 16.

Amper was driving his XRM Honda motorbike in Barangay Bunyasan in Malimono town at 9:45 a.m. on Nov. 12 when he was flagged down by at least eight heavily armed suspected NPA members.

He was believed to have been brought to the mountainous part of Barangay Tinago, also in Malimono.

The rookie cop was conducting discreet surveillance on reports that unidentified armed men were roaming in Bunyasan.

Four days after, Polvorosa and Contemplo were abducted on the way to Barangay Pungtod aboard a patrol car supposedly for a meeting with personnel of the Department of Social Welfare and Development and local residents for the Pantawid Pampamilyang Pilipino Program.

In an email sent to MindaNews on December 21, National Democratic Front-Mindanao said they will release all the nine “prisoners of war” they were holding at the time.

Sadural also did not reply to a text on the alleged presence of troops in the mountains around Surigao del Norte.

Bishop Rhee Timbang, of the Philippine Independent Church in Surigao del Norte said his group also called on the military higher-ups for a troop pullout.

Timbang heads the third party facilitators that successfully negotiated for the release of four policemen abducted by the NPA also in Alegria town in July last year.

Former Surigao del Norte provincial board member Atty. Victor Bernal said had the military suspended their operations and had the Provincial Crisis Management Committee acted decisively, the

captives would have been long released.

“In short, the Provincial Crisis Management Committee and the military which is always pursuing the captors are the ones who don’t want the release [of the captives]. If possible, Governor [Sol] Matugas should ask the Philippine Army in Bad-as to stop the military operations,” Bernal said in Cebuano.

He urged Matugas to convene the committee to convince the military to stop their operations.

So right before their noses, these officials and their subordinates allowed this scandal, this anomaly from being carried out in the New Bilibid Prisons.

But the discovery of this scandal and anomaly would have taught others from allowing themselves to be corrupted by the very same germ that corrupted the New Bilibid Prison officials and guards. But sadly, even the NBI personnel proved to all and sundry that the lures of materialism are indeed hard to resist. They too allowed the very same scandal, the very same anomaly to be repeated again in so short a time in their own headquarters.

Indeed the love of material things is only possible if one does not have God in his or her heart. This is what secularism is all about. The absence of God in humans and society making people to worship material things hence their ability to do the unthinkable such as what the New Bilibid Prison officials and guards and the NBI personnel as well.

Corruption like this will forever continue if we collectively just fold our arms in resignation instead of putting up a fight against materialism and secularism because by not doing so will just make all of us vulnerable to commit the same mistake, wrong or sin the above New Bilibid and NBI officials and guards have frivolously committed.

Of the total P50 billion in deposits as of June 2014, Villa-Real said, P35 billion are government deposits, largely LGU deposits, and those of government-owned and controlled corporations (GOCCs).

Its lending to LGUs has helped move forward infrastructure projects, transport terminals and other developments, Villa-Real said.

Loan payments made by LGUs are taken from their combined revenues and Internal Revenue Allotment (IRA) from the National

To reach out to more LGUs in remote areas, he said PVB will tie up with rural banks.

Villa-Real recently conducted financial wellness seminars in cities and provinces.

Villa-Real said that employees were taught cash and debt management as well as making wise investments. The country needs to catch up in terms of savings and investments exposure because these activities remained low compared to that of neighboring countries.

He added the half-day seminar is just the start of the bank’s rollout for its LGU clients in Cebu and the Visayas, like Iloilo City and Tagbilaran City in Bohol, among others.

According to PCA10 manager Luis Cruz, the agency also has an existing farm to market road program where local government units (LGU) can avail of the project provided that the site is a coconut economy.

Speaking during a Kuyamis planting ceremony in Talisayan, Misamis Oriental last Tuesday, Cruz urged Gov. Yevgeny Vincente Emano to avail of the program by passing the necessary requirements such as the Sangguniang Panlalawigan (SP), municipal council and barangay council endorsements.

Emano responded by saying that he would call on SP members to immediately act on the matter. He also instructed Talisayan Mayor Rommel Maslog for a similar purpose.

Cruz said that the potential for coconut farming is so huge that even one farmer in Misamis Oriental alone is already earning at least P90,000 a month by solely harvesting coconuts.

barangay level regionwide and strongly urged LGUs to avail of their programs.

Seventy percent of coconuts produced in Misamis Oriental are for export. In the third quarter of 2014, the province has a total of 28,901 metric tons of copra production, 500,000 green nuts harvested and 93,816 metric tons in byproducts garnered in the form of coconut chemicals, coconut cream, coconut coir fiber, coconut milk fiber, coconut shell charcoal, coconut oil, coconut water, copra cake/meal, desiccated coconut and activated carbon. It has a total of 36,000 coconut farmers. Misamis Oriental also has six oil mills and four factories processing coconut sugar and coconut honey.

The 200 kuyamis propagules planted in Talisayan last Tuesday were just the beginning. Cruz said that the next batch of 600 coconut seedlings will be brought and sown in Magsaysay town.

Cruz told the 200 recipients of coconut seedlings in Talisayan that they could do intercropping in their lands and fill it with coffee, corn or cacao crops. They could then band together for a community-based enterprise development program.

Cruz also revealed some non-conventional uses of coco by-products. He said that freshly-harvested tuba can even be healthy for children if boiled and consumed immediately. He also said water with coco sugar is good for raising poultry.

11.9-MW bunker-fired power plant to rise in Koronadal City

ENERAL SANTOS CITY -- Distribution utility South Cotabato I Electric Cooperative (Socoteco I) is constructing an 11.9-megawatt (MW) bunker-fired power plant to augment the growing power requirements of industries and residential consumers in parts of South Cotabato and Sultan Kudarat provinces.

Santiago Tudio, Socoteco 1 general manager, said Wednesday they have partnered with energy firm Supreme Power Corporation for the construction and operationalization of

an embedded power plant that will be run by modular generator sets.

He said the construction of the plant will begin on Thursday in a property owned by the electric cooperative in Matulas, Barangay Paraiso in Koronadal City.

“We’re targeting to complete the construction and eventually operate the plant by July,” he said in an interview.

Citing their initial agreement with Supreme Power, he said the company will operate the plant for 15 years using imported generator sets from South Korea.

he Philippine Statistics Authority (PSA) will be conducting the January 2015 Labor Force Survey starting today, January 8, 2015 until the end of this month.

According to Engr. Eddie Nasol, Interim Regional Director of PSA Region 10, this undertaking aims to provide a quantitative framework for the preparation of plans and formulation of policies affecting the labor market.

More specifically, the survey is designed to provide statistics on levels and trends of employment, unemployment and underemployment for the

country, as a whole, and for each of the administrative regions, including provinces and key cities.

Nasol is encouraging all sample households to cooperate with this survey and to give truthful answers to the interviewers.

The interviewers are equipped with all necessary documents as well as proper identification cards.

All information that will be obtained by the interviewers will be held strictly confidential as indicated in Republic Act 10625, or the Philippine Statistical Act of 2013 governing the secrecy rule for the survey answers.

company on May 19 last year.

Tudio said they decided to deal for the building of an embedded bunker-fired power plant to address the continuing supply shortage in the Mindanao grid.

He said the plant will serve as insurance in case the hydropower plants of the National Power Corporation (NPC) in Lanao del Norte and Bukidnon would experience supply shortages and when other power plants in Mindanao will bog down.

He said they are anticipating a possible drought this year lasting three to four months that would drastically reduce the generating capacity of the

hydropower plants.

Socoteco 1’s peak power requirement increased to as high as 36 MW this year from 33 MW a year ago.

The cooperative mainly draws its supplies from the NPC and Aboitiz Power Corporation’s subsidiary Therma South Inc. It has a backup supply of 12 MW from a diesel-fired power plant operated by Mapalad Power Power Corporation (MPC), which is controlled by the Alcantara-owned Conal Holdings, and Aggreko Plc. in Barangay Morales in Koronadal City.

THE MISAMIS OCCIDENTAL HOUSING ORDINANCE OF 2014 PREFATORY STATEMENT

The Provincial Government of Misamis Occidental has initiated to reactivate the Provincial Housing Project with the intent of realizing the original goal to provide low-cost housing for its employees and for the general public. With this end in view, several amendments to the policies and guidelines of the Housing Project were introduced, thus, this new policies were formulated.

BE IT ORDAINED by the Sangguniang Panlalawigan of Misamis Occidental during its Regular Session that: ARTICLE I TITLE DECLATION OF PRINCIPLES

Section 1. TITLE- This Ordinance shall be known as, “The Misamis Occidental Housing Ordinance of 2014”;

Section 2. DECLARATION OF PRINCIPLES The Provincial Government of Misamis Occidental pursues the policy of the State to promote social justice to ensure the dignity, welfare and security of the people.

The Local Government Code of 1991 mandates local government units to establish, maintain and ensure adequate provision and services in the field of housing to guarantee the enjoyment by the people of a decent standard of living:

It is likewise the belief of the Provincial Government of Misamis Occidental that housing and land tenure is a development undertaking which encompasses not only the provision of shelter, but also the establishment of a community.

The Provincial Government of Misamis Occidental has further committed to allocate resources and develop areas for sites and services for the benefit of its qualified beneficiaries.

ARTICLE II GENERAL PROVISIONS

Section 3. APPLICATION. All stakeholders are mandated to strictly observe and adhere to the provisions of this Ordinance to achieve the objectives for which the housing project is promulgated.

Section 4. PROVINCIAL HOUSING MANAGEMENT COMMITTEE. The Provincial Housing Management Committee, through the Office of the Misamis Occidental Provincial Housing Project, shall be responsible for the management, administration and supervision of all phases of the Misamis Occidental Housing Project. It shall seek its authority from and shall function as a permanent Committee of the Economic Enterprise Management Board (EEMB) created by virtue of Ordinance 07-05, as amended. The Provincial Housing Management Committee shall have the authority to approve applications for housing units as well as disqualify applicants.

4.1 The Committee shall be composed of the following:

4.1.1. The Governor as Chairperson and Chief Executive Officer;

4.1.2. The Vice-Governor as Vice-Chairperson;

4.1.3. Members:

4.1.3.2. Provincial Administrator

4.1.3.3. Provincial Treasurer

4.1.3.4. Provincial Budget Officer

4.1.3.5. Provincial Planning Officer

ARTICLE VI LOT ALLOCATION

Section 17. A beneficiary may be allowed to purchase up to a maximum of two (2) house and lot packages depending on his/her capacity to pay and availability of units.

the acquisition of the subdivision lot and construction of a housing unit upon approval of the loan from the financial institution concerned and/or the release of the loan proceeds thereof.

Section 13. The Provincial Government of Misamis Occidental shall act as land developer of the housing project. It may opt to enter into a contract with private contractors to construct housing units;

Section 14. All applicants shall strictly adhere to the approved design and plans of the model houses of the project. Enhancements and/or revisions of the original prescribed models shall seek first the approval of the Committee;

Section 15. The applicant shall assign the entire loan proceeds, consisting of the actual cost of the land and construction cost of the house, to the Provincial Government of Misamis Occidental;

Section 16. Ownership of the Land Titles of lots paid in cash prior to the December 31, 2012 cut-off date shall be transferred to the name of the beneficiaries. a. Further, beneficiaries with Land Title in their names may construct house units with their preferred designs; provided it conforms to the general design and shall seek the approval of the Committee; b. In case of private individual takers, the provincial government may likewise allow them to undertake the house construction according to their desired design and building plan subject to the standard general design approved by the Committee.

4.2 The functions of the Committee shall be as follows: 4.2.1 Formulate development plans at the Provincial Housing Project and recommend the same to the EEMB for approval; 4.2.2 Ensure that activities at the Provincial Housing site are consistent with the policies and plans of the Provincial Government; 4.2.3 Monitor and supervise, through Economic Enterprise Office, the operations and activities of the Homeowner’s Association; 4.2.4 Take overall responsibility in the screening, selection and approval of housing applications; and 4.2.5 Others as may be designated by the EEMB and the Sangguniang Panlalawigan by way of legislation.

The Committee may create sub-committees and formulate guidelines necessary to carry out its tasks and functions.

CONTROL OF STRUCTURES

Section 18. The Certificate of Occupancy, duly signed by the Chairperson of the Committee, shall be the official basis for determining the legal existence of the structure within the Provincial Government Housing Project.

Thus, all structures without the written official approval of the Committee shall be deemed illegal.

Section 19. Any beneficiary who intends to vacate, sell, transfer any structure shall first seek the approval of the Committee. Such intention shall be manifested formally and in writing.

Section 20. LAND AND STRUCTURE RIGHTS. Land rights and rights to the structure shall be respected and given consideration, provided, they are consistent with existing laws and the provisions hereof.

ARTICLE VIII OCCUPANCY RULES AND REGULATIONS

Section 21. The housing units shall be used exclusively for residential purpose. No business or any commercial activity shall be undertaken within one’s residential unit.

Section 22. The dwelling/lot shall not be used for any immoral or illegal activity and no contraband or effects of crime, explosive or combustible materials shall be kept or maintained in the premises, except, those used for the normal cooking requirements of the whole household.

Section 23. Expansion or extension, both vertical and horizontal of existing structures is not allowed. However, a structure may be built solely for the purpose of providing a garage to the family service vehicle, provided, that the size and structure of the same should conform to that prescribed by the Committee.

No alteration and/or enhancements from the original design shall be made unless approved by the Committee.

Section 24. Fences between housing units and subdivision streets shall be limited to a maximum height of three (3) feet. However, residential units located along the perimeter of the subdivision may enhance the existing perimeter fence covering their property or construct one where there is none, provided such fence shall not exceed eight (8) feet

Section 25. Landscaping is mandatory and shall adhere to the general design imposed by the Provincial Housing Management Committee. Ornamental plants used in landscaping should not be permitted to grow over two (2) feet from the ground. Plants and trees within a residential lot must not encroach on other lots and common areas. Landscaping cost and maintenance shall be borne by the homeowner.

Section 26 All residential and household members shall take good care of all plants and trees on the common areas within their immediate surroundings. Plants and trees on the mini park is a collective responsibility of the community. Project beneficiaries shall endeavor to involve themselves in community works within the housing site.

Section 27. Homeowners, together with his/her household members, shall maintain and observe strict cleanliness and sanitation within the lot and its immediate surroundings, particularly the sanitary facilities, pathways, alleys, streets and recreational/public facilities. Garbage should not be allowed to accumulate, but shall be placed in receptacles within the unit away from public view, and be brought out only at designated hours for collection by the garbage truck. Trash or garbage shall not be thrown in the alleys, pathways, riverside, streets or any open space.

Section 28. Walkways, pathways and alleys intended for communal use should conform to the requirements of Batas Pambansa Blg. 344 and must be kept free from any obstruction, such as cloth dryers, equipment, motor vehicles and/or junk/scrap materials.

Section 29. Homeowners are not allowed to tend to or engage in the raising of poultry, piggery and other livestock either for commercial purposes or food consumption.

Section 30. Household pets such as dogs, cats or birds may be allowed provided these pets are confined inside the house or leashed/ caged within the perimeter of the house. When pets are taken out for a walk, they must be leashed and are to be escorted by a responsible person. Household pets should not be allowed to go astray in the subdivision.

Section 31. Even in the absence of the owner or occupant of a lot, entry thereof by a duly authorized representative of the Provincial Government of Misamis Occidental shall be allowed where there exists a threat to the life and limb of other residents or visitors of the subdivision or a threat which may cause obstruction of their properties and that such threat are caused by persons found within the lot or caused by equipment, tools materials within the lot.

Section 32. Every project beneficiary is required to strictly comply with and observe all the terms and conditions of this Ordinance which are deemed incorporated into the Agreement he/she enters with the Provincial Government, and such other rules and regulations that have been or may hereinafter be promulgated, provided, that due notice of the new rules and regulations shall be delivered/furnished or made known to him/her.

ARTICLE IX HOMEOWNER’S ASSOCIATION

Section 33. ORGANIZATION. Project beneficiaries shall organize a Homeowner’s Association to act as the governing body inside the subdivision premises; it shall ensure, among others, peace, harmony and security within the subdivision; they shall formulate rules and regulations consistent with the provisions of this Ordinance and other existing laws.

Section 34. SEC REGISTRATION AND SANGGUNIANG PANLALAWIGAN ACCREDITATION. The Homeowner’s Association shall apply for registration with the Securities and Exchange Commission and seek accreditation from the Sangguniang Panlalawigan of Misamis Occidental.

PENAL PROVISIONS

Section 5. APPLICATION AND ORDER OF PRIORITY- interested applicants shall accomplish a Misamis Occidental Housing Project Application Form before the Provincial Housing Office for initial local pre-screening. The Provincial Housing Management Committee shall approve and award such application upon recommendation of the Provincial Housing Office. Application shall be screened and awarded based on the following order of priority: a. Officials/employees of the Provincial Government; b. Municipal or city officials/employees in Misamis Occidental; c. Employees of national government offices serving in Misamis Occidental. Employees under letter a, b and c can avail of the Misamis Occidental Provincial Housing Project only once. Once a beneficiary, he is disqualified from future housing project of the Province; d. Subject to the availability of housing lots/units, a non-government employee/private Filipino individual may avail under the PAG-IBIG financing scheme or other financial institutions; otherwise, beneficiaries pay on a one-time cash basis.

Section 35. PENALTY CLAUSE: A project beneficiary caught violating any of the immediately preceding provisions shall be subjected to the following penalties: a. Violation of Section 22, 23 and 24: a fine of P10, 000 plus the demolition of any unwanted structure at the expense of the concerned project beneficiary. If the Housing Board so orders, an additional penalty of EVICTION may be imposed on a beneficiary found violating the provision of Section 24. b. Violation of Section 25: a fine of P5,000 plus the destruction of plants that caused the violation at the expense of the concerned project beneficiary. c. Violation of Section 26: a fine of P5,000 for the neglect of plants and trees within the beneficiary’s immediate surrounding leading to their destruction, plus the restoration of such plants and trees at the expense of the concerned beneficiary. d. Violation of Section 27 and 28: a fine of P5,000 for every act of littering garbage along alleys, pathways, streets or any open space within the subdivision; or causing obstruction by placing such things such as cloths dryers, equipment, junk/scrap materials along walkways, pathways and alleys intended for communal use. e. Violation of Section 29: a fine of P5,000 for violation of the of the rule against raising of poultry, piggery, hogs and other livestock within the subdivision, and destruction of any structure built for animal raising at the expense of the concerned beneficiary. f. Violation of Section 30: a fine P2,000 for allowing unleashed and unaccompanied household pets to loiter the subdivision premises.

Section 6. Where the number of applicants exceeds the number of available housing units, those who do not own their residential houses are given preference over those who already own one. However, qualified and interested employees must immediately submit their accomplished application forms, otherwise available lots shall be offered to other interested/qualified applicants.

In case the Committee disapproves an application, due notice shall be sent to the applicant, indicating therein the reasons and grounds for disapproval.

The Committee shall have the authority to disqualify an applicant for failure or any defect in accomplishing the conditions specified under Article V, Sections 12, 13, 14 and 15 of this Ordinance.

ARTICLE IV BENEFICIARY DISQUALIFICATION

Section 7. Upon proper investigation, a beneficiary shall be disqualified from housing benefits under the program on the following grounds: a. When a beneficiary sells, disposes or transfers his/her rights over a lot or structure without approval of the Committee; b. When a beneficiary uses a dummy or allows himself/herself to be used as one for the purpose of acquiring a right over a lot/structure and other benefit in the Misamis Occidental Housing Program.

Unless justified, failure of an applicant to comply and submit the necessary requirements after the second verbal and/or written demand may be a ground for disqualification of such applicant by the Commission upon recommendation of the Provincial Housing Office.

Section 8. A beneficiary who has been disqualified pursuant to Section 7.a and 7.b hereof shall be penalized as follows: a. Perpetual disqualification from availment of future housing projects of the Province of Misamis Occidental. b. Payment of a fine of P20, 000.00

Section 9. An aggrieved beneficiary may appeal the decision of the Committee within ten (10) days from receipt of the decision disqualifying him/her as a beneficiary. The Committee shall then review the application and render its final decision.

ARTICLE V MODE OF ACQUISITION

Section 10. The applicant must be willing and qualified to avail of the housing loan program of the PAG-IBIG Fund or any applicable financial institution.

Section 11. Qualified applicants shall accomplish the corresponding house/lot loan application form and submit all pertinent supporting documents and pay a loan processing fee of TEN THOUSAND (P10, 000.00) PESOS within five (5) days from approval of the Provincial Housing Application.

These penalties are without prejudice to the criminal and civil actions which may be filed in court for any of the aforesaid violations.

Section 36. HOMEOWNERS ASSOCIATION’S SHARE. Thirty (30%) percent of the collected penalties under this Ordinance shall accrue to the Homeowner’s Association.

Section 37. AUTHORITY. This Ordinance is pursuant to Republic Act 7160, “The Local Government Code of 1991”;

Section 38. REPEALING CLAUSE. This Ordinance repeals the Ordinance No. 02-05 in its entirety.

Section 39. SEPARABILITY CLAUSE. If for any reason, any portion or provision of this Ordinance is declared unconstitutional or invalid, the other sections or provisions hereof which are not affected thereby shall continue in full force and effect.

Section 40. Effectivity. This Ordinance shall take effect after fifteen (15) days following its publication in a newspaper of general circulation in the Province.

It can help your long-term economic projections and help you obtain and maintain a business in the future. The

All public schools nationwide are encouraged to have its school validated to measure whether they adhere to the four principles stated in the SBM: Leadership and Governance, Curriculum and Learning, Accountability and Continuous Improvement and Resource Management and

Mobilization. All four principles are geared towards the improvement of students’ performance and the attainment of the EDUCATION FOR ALL (EFA) policy of the government by 2015.

The above mentioned principles are meticulously and passionately followed, studied and reviewed by the teachers, stakeholders, parents, student and only the Best Practices are retained, practiced and reviewed whether they are still significant, updated and application in today’s society.
