No, he isn’t Wyatt Earp, he is Rodrigo Duterte

n Las Vegas, Nevada where I eagerly await the historic boxing event of the century, I was entertained today by an article purportedly written by a columnist and investment banker, who likened Davao City Mayor Rody Duterte to Arizona's legendary law-enforcer Wyatt Earp published in the Philippine Daily Inquirer.

In an opinion article titled "Fate, Hope and Grace Poe," Dean De la Paz, who claimed to be an investment banker and consultant to foreign corporations, said Duterte, 70, mayor of Davao City for 23 years and Congressman for 3 years, has no national platform and "does not have the experience to tackle critical global security and eco-

nomic issues."

Aside from the fireworks of colourful language which I thought were really intended to impress readers of the writer's deep grasp of the English language, the article was hollow because it did not really look deeply into who Duterte is compared to the other candidates.

National platform?

Let us start with Vice President Jejomar Binay.

What is his national platform?

If we look deeply at the slogans of the Binay camp - "Kay Jojo Binay, Gaganda ang Buhay" and "Ganito Kami sa Makati..." apparently referring to the free birthday cakes, free movies for senior citizens, hospitalisation privileges, and scholarship grants - Binay's national platform would be no different than what is being done by this government today giving out cash coupons to the poor of this country as if this was the answer to the massive poverty, insecurity and joblessness.

I remember only one distinctive position that Vice President Binay made and this was on the question of China's occupation of the islets within the Exclusive Economic Zone (EEZ) of the country.

Binay said that China has so much money and the Philippines has no chance going head to head against the economic and military giant and that it would be best to allow China to stay in the islands for as long as they make investments in the country.

We go to Mar Roxas.

Honestly, until today, over four years after he was appointed as member of President Aquino's cabinet, I still could not make heads and tails of what it is that

Mar Roxas would do if by God's will he takes over the Presidency.

And finally, Grace Poe, who by the way, like Duterte has consistently denied that she is interested in running for President.

I like Grace Poe but if we are to look at her performance in the Senate as a basis to at least get an idea of her national platform, we will find no clue as to what it is that she would do if she were President.

Beyond the Mamasapano Report, the MRT investigation and the PNP Chief Allan Purisima corruption investigation, Grace Poe has been tested by more critical problems like "What would she do if China insisted on occupying the country's territory in the West Philippine Sea.?"

Duterte, the man described by De la Paz as the gun-toting and hip-shooting Wyatt Earp, in contrast to the three other presidential prospects has clearly outlined his position on critical issues.

On corruption, Duterte proposes a two-pronged approach: the re-imposition of death penalty for those found guilty of plunder and the re-introduction of values formation in the elementary grades and high schools in the country.

On drugs and criminality, Duterte says the penal code must be revisited to make drug dealers and criminals

realise that it does not pay to commit a crime.

On the China issue, Duterte supports President Aquino's move to bring the matter for arbitration but adds that there should be efforts to initiate bilateral talks. If everything else fails, he believes the Philippines should turn to its old ally, the United States in addressing the problem.

On the Communist Insurgency, Duterte says negotiations must be re-started and the new President must welcome members of the New People's Army (NPA) who would like to join a unity government while those who choose to continue the insurgency must be pursued without let-up.

On Agriculture, Duterte says that there must be a radical overhaul of the agriculture program to make sure that everybody in government understands that the primary obligation of government is to provide "Available and Affordable Food" for the Filipinos. It will be an agriculture program which would rely mainly on the capability of the Filipino farmers to produce the needs of the country rather than depend on imports.

On the Mindanao Problem and neglect of the Regions, Duterte has been moving around the country proposing a shift from Unitary Presidential to Federal Parliamentary form of

government which would result in the establishment of highly-autonomous Federal States. This he said is the best option to the endangered Bangsamoro Basic Law and would also lead to the development of the poor regions thus creating jobs in the countryside.

On Sabah, Duterte says the Philippine government must not abandon the proprietary claims of the Sultanate of Sulu over Sabah but at the same ensure that this is done in a diplomatic manner.

Honestly, I believe that Dean de la Paz has not heard of these issues being addressed by Duterte in his many sorties all over the country.

This is where the problem lies. It is when investment bankers who have never been to the countryside assume the role of experts who teach the Filipino who should be the next President based on what they read in the comforts of their luxurious and air-conditioned offices.

Had these people ventured to places where any others would fear to tread, they would have met leaders like Rodrigo Duterte.

Then, they would have realised that Duterte is not Wyatt Earp. He is a lawyer who was a no-nonsense public prosecutor and a foreign service graduate.

Most of all, he is Rodrigo Duterte, Mayor of the 4th Safest City in the World.

Group: B’non needs updated tax codes to draw investments MALAYBALAY City–– Bukidnon needs to reform its tax codes if it wants to attract more investors to the province, a business chamber official said.

“At the start of the day, you are supposed to put up signage saying Bukidnon is ready for investments, but you cannot (because of obsolete tax laws and other policies),” Roderico Bioco, president of the Bukidnon Kaamulan Chamber

of Commerce and Industry Inc. (BKCCII) said.

He said promoting investments is good but should be backed by a correct policy environment.

“If investors (check on government’s) due diligence; we can only get very brave investors, but they are not as aggressive,” he said, adding Bukidnon is not the only investment destination.

TESDA-10 Misamis Oriental Provincial Director Leo V. Velez told the Mindanao Daily News that TESDA under Secretary Joel Villanueva has put premium in quality management to provide better services for its customers.

“The certification bestowed on TESDA proves that after a very rigorous audit, our systems for Program Registration, Assessment and Certification, Standards Development and Support Services have demonstrated compliance with ISO 9001:2008 requirements,” said Villanueva in a news release posted on its website, http://www.tesda.gov.ph.

“We exist because of our customers,” said Velez, “and we measure our worth by the satisfaction of the customers we serve through strategic decisions, effectiveness, responsiveness, value adding, integrity, citizen focus, and efficiency.”

Dylin Marie S. Omaña, Internal Quality Audit Focal, admitted that ISO 9001:2008 has virtually changed TESDA-Misamis Oriental as the office has improved the physical facilities making the office more comfortable for the employees and the customers as well.

The ISO Journey has been tedious and it has truly improved not only the facilities but also the major processes of TESDA ; namely Program Registration and Competency Assessment and Certification.

“Today, if we say that certificates are issued in five days, it should be released in five days,” said Velez in an inclusive interview conducted by the Mindanao Daily News. He further said that the challenges at stake lies in sustaining the quality journey even surpassing the current status of recognition for the satisfaction and delight of the customers.

“This feat is another milestone and we are proud to be given such prestigious recognition as TESDA is the only ISO certified among the tripartite education sectors and the second agency under the executive branch. The Department of Health (DOH) was the first government agency to have received such status on December 18, 2013.

He said such law computes taxes based on gross sales. “But gross sales/receipts may include Valueadded tax (VAT). You cannot tax a tax,” he said, adding PD 236 was imposed when there was no VAT yet.

He cited the case of the trucking industry, where he is one of the players, which is also excluded from the tax computation based

on gross sales. “Only the provincial government can tax on trucking. Even with that, they can only tax per unit, not on gross receipts.”

These updates, he added, should be included in local tax codes.

Expanding coverage of SPES

The House Committee on Labor and Employment has recently approved a proposal to strengthen and expand the coverage of the Special Program for Employment of Students (SPES) to include not only currently enrolled poor students but also other disadvantaged youth, and to extend the maximum employment period from two months to three months.

This is a most welcome development. House Bill 5469 seeks to amend Republic Act 7323, otherwise known as the SPES, which provides employment to poor bur deserving students.

The bill is laudable as it seeks to expand the coverage of SPES to include out-of-school youth and dependents of displaced workers or would-be displaced workers due to business closures or work stoppages, intending to enroll in any secondary, tertiary, or technical-vocational institutions.

While it is recognized that SPES, as an employment bridging program, has changed the lives of many

Editorial Filipino youth, it cannot be denied that the implementation of the program has encountered multitude of problems, both procedural and substantial.

The current program covers only currently enrolled students, depriving other disadvantaged youth to pursue education. Difficulty is also encountered as to the mode of payment of wages to the beneficiaries.

With the improvement and expansion of SPES, this will allow more Filipino youth to pursue their education towards a better future through easy access to the program.

Sought by the Bill among others, is to extend the maximum period of employment of poor but deserving students, out-of-school youths (OSYs) or dependents of workers displaced from work, from 52 working days or two months to 78 working days or three months.

Very good.

The concerned House committee should include

a provision in the bill providing for mentorship of students to prepare them to land a real job in the future.

Under the measure, any entity or person employing at least 10 persons may employ poor but deserving students, OSYs, or dependent or dependents of a displaced or would-be displaced workers due to business closures or work stoppages, intending to enroll in any secondary, tertiary or technical-vocational institutions, and aged 15 to 30 years old.

The measure also requires 60 percent of the salary or wage shall be paid by the employers in cash and 40 percent by the government also in the form of cash directly to the student, or through financial institutions or other payment facilities, subject to the existing rules on procurement in the case of payment for the student’s tuition fees, books, and other education-related expenses, including their daily allowance.

The 40 percent share shall be paid within 30 working days upon submission

of the partner-employer or participating establishment of their report on payment of salary or wages which shall be the basis of the 40 percent salary or wages to be paid by the government through the Department of Labor and Employment (DOLE).

In case of sickness, absence, or death of the SPES beneficiary, the immediate heirs may claim the salary upon presentation of proof, the bill provides.

The SPES beneficiary shall be entitled to social protection by virtue of an insurance coverage with the Government Service and Insurance Commission (GSIS) for a period of one year.

Employment facilitation services for SPES applicants shall be done by the Public Employment Service Office (PESO). The DOLE shall issue the implementing rules and regulations to carry out the purposes of the proposed Act. Kudos to the proponents.

The Bills needs full support and should be approved posthaste.

Battles that changed the course of history (15)

The Northern Luzon guerrilla ranks continued to swell especially after two consecutive U.S. submarine landings in late 1944. Stingray and USS Gar unloaded muchneeded arms and supplies for the resistance fighters.

The guerrillas eventually grew to more than 20,000 and were formally integrated into the allied forces as the United States Armed Force in the Philippines – Northern Luzon or USAFIP-NL. Except for its American commanding officer (Col. Russell Volkman) and three aides, the USAFIP-NL was an almost all Filipino group.

Zosimo Paredes, Emilio Narcise, Eulogio Balao, Simeon Valdez, Fortunato Abat, Gregorio Hufano, Faustino Somera would be remembered for their courage prior to, during and immediately after Bessang Pass. Thousands more nameless and faceless patriots would be remembered through the units under which they served (121st, 15th , 66th and the Provisional infantry regiment).

A group, aptly called as The Bolomen, volunteered to face the Japanese, armed only with their bolos and their stout hearts. Faustino Somera, Sr., a boloman,

would later be credited for the killing of General Hara of the Japanese Imperial Army “with a single stroke of his bolo.”

The Battle of Bessang Pass consisted of a series of battles fought over almost 6 months. The initial battle was fought in Bitalac, Tagudin on January 8, 1945 while the last was waged on June 14, 1945 at Nangyatan Hill. In between, bloody see-saw battles were fought in Lower Cadsu Ridge, Upper Cadsu Ridge, Lamagan Ridge, Laguiatan Hill, Magun Hill and Baracbac Point.

The USAFIP-NL fought the 4,000 strong Japanese shock troops directly under the command of General Yushiharu Ozaki. Ozaki was waging a bruising rearguard action to protect Tomoyuki Yamashita who had fled to Bontoc from his Baguio headquarters.

In a way, Ozaki was fighting his own Battle of Tirad Pass . Four decades earlier General Gregorio Del Pilar with his Gallant 60 fought a brave but futile day-long battle against the 300-strong soldiers of Major March.

Del Pilar was protecting the rear of President Aguinaldo who was retreating towards Isabela.

But Bessang Pass proved to be a more formidable stronghold which would take almost 6 months to overcome. The terrain of Bessang Pass has rendered it almost impervious to a ground assault. Bessang Pass is located in the mountainous area of Cervantes, Ilocos Sur. It is surrounded by a cluster of high peaks (Nagucan, Namandaraan, Nalidaoan, Libo-Libo and Buccual – all not less that 5,500 feet high) deep gorges and ridges.

Military historian Robert Ross Smith (“War in the Pacific: Triumph in the Philippines”) described the battleground. Most of the year, the weather was “wet, cold, misty, foggy and rainy” rendering the

grounds very muddy and slippery. The impenetrable forests were infested with malarial mosquitoes and leeches.

Ozaki’s defenders initially enjoyed the advantage of high ground and normally kept the attacking forces pinned down on the slopes.

But as the battle progressed, the Japanese slowly lost their advantage.

On clear days which, however, did not come often, the USAFIP-NL was able to call in air strikes against Japanese positions.

At this stage of the war, the Filipinos could rely on resupply. Food and ammunition would occasionally be air dropped but in most cases they were brought to the front by hundreds of civilians who walked up narrow slippery trails carrying the food and munitions on their backs.

At this stage of the game, Bessang Pass became Bataan in reverse. The hungry, sick and ill-supplied Japanese were now taking the pounding from Filipino troops.

Ground-fighting became especially fierce towards the last two weeks of the battle.

The last bloody encounter took place on June 14, 1945.

of Adana’s abductors has been identified as Abral Abdusallam.

Abdusallam is suspected to be a member of a kidnap-forransom-group based in Zamboanga Sibugay province.

“While there may be some other parties involved, but definitely the ones holding (her) now are the (members of the) ASG,” Yoma said.

“That is the modus operandi now. Somebody will abduct the subject (victim) and transport them to either Basilan or Sulu and then the ASG will take care from there,” he added.

He said they have not information yet whether or not the ASG brigands has already demanded ransom in exchange for the release of the town mayor. (PNA)

Muslim leaders renew support to peace process ZAMBOANGA City – Muslim governors in Basilan, Sulu and Tawi-Tawi have renewed their support to the government’s peace process and have joined efforts to promote stability in the southern region.

Sulu Vice Governor Sakur, who represented Governor Totoh Tan, and governors Nurbert Sahali, of Tawi-Tawi and Jum Akbar, of Basilan said they are behind President Aquino’s peace initiatives in Mindanao.

“We are a lways for peace and we have been supporting President Aquino’s peace initiatives in this part of the country.

We are renewing our allout support to the peace process,” Tan said.

T h e i r c o m m it m e nt came following the public launching of ProPolitiCS or “Promoting Political Climate and Stability for Peace in the Bangsamoro” in Zamboanga City.

UTUAN City – To promote the government’s farm mechanization program, he Department of Agriculture in C ar aga and the Philippine Center for Postharvest Development Mechanization (Philmech) held a press conference last April 13 at the Goat2Geder Hotel and Restaurant here.

Dr. Rodolfo Estigoy, science research specialist and chief of Applied Communication Division of Philmech, said farm mechanization is a new way of helping farmers in producing higher yield through newly-invented technologies.

“Mechanization can increase yield, lower labor cost, and reduce losses. If it reduces losses, therefore, it increases rice availability and affordability,” Estigoy stressed.

Estigoy presented videos about “Agrinovations.” He said the new innovations are a system-approach invented by Philmech made especially for the farmers to make farm activities easier,” he pointed out. “’Agrinovations’ are important tools that improve farm production during planting, harvesting, and post-harvest periods,” he added.

The suspect, former Finance Officer Osmeña Montañer of the Department of Agriculture (DA) in Region 12, was not arrested. In fact, he sat at the Presidential table with officials who told MindaNews they did not know he was a wanted man.

Cotabato City-based reporter John Unson of Philippine Star posted on his Facebook wall on Friday morning a photograph of Montañer at the gathering, seated beside Col. Ariel dela Vega of the 603rd Infantry Brigade and Governor Mamintal Adiong Jr. and other officials.

Unson wrote on his FB wall a question addressed to Senior Inspector Benji Omalla, Malabang police chief. He asked “si dating budget officer Osmeña Montañer ng Dept. of Agriculture, Region 12, ay wanted for the murder of local print journalist (Marlene) Esperat, In fact yan ang reason kung bakit siya ay di na nakikita sa regional office ng DA-12 sa Koronadal City. Bakit dito sa nangyaring ‘rido’ settlement

It certainly was not fine for lawyer Nena Santos, Esperat’s friend who served as lawyer for her family after her murder. “He has a pending warrant of arrest issued by the Makati court for the murder of Marlene Esperat. The case is pending kasi di pa sya nahuli (because he has not been arrested). The people around him should arrest him and turn him over the authorities, otherwise, they will be charged with obstruction of justice.”

The police chief, the Army brigade commander, the governor and regional vice governor all claimed they were not aware Montañer was a wanted man.

Heads must roll Rowena CarranzaParaan, chair of the National Union of Journalists of the Philippines (NUJP), told MindaNews it was “shocking to see a photo of a wanted murder suspect seated together with highranking officials with the latter seeming oblivious to the heinous murder that was condemned by the entire world.”

“It had always been perplexing how for the longest time the police could not serve the arrest warrant but it is clear from the photo that it has no intention of doing so. We demand an investigation on why a wanted suspected murderer was not arrested when there was opportunity to do so.

Was it mere stupidity or deliberate flouting of the law? Either way, heads must roll,” she said.

“Caught unaware” Omalla told MindaNews in a telephone interview that they merely provided security for the activity and was unaware that Montañer was a wanted man. “Caught unaware po kami,” he said, adding the activity was arranged by the governor’s office.

ARMM Vice Governor Haroun Al-Raschid Lucman told MindaNews he didn’t know Montañer was a wanted man.

Whistleblower Esperat, a chemist at the Department of Agriculture in Region 12 who turned whistleblower against the alleged corrupt practices in her office, implicating DA officials like Montañer and regional accountant Estrella Sabay, was gunned down in front of her children while having dinner at the family’s house in Tacurong, Sultan Kudarat on Maundy Thursday, March 24, 2005.

(CMFR) wrote on its profile of Esperat that while inside the DA, Esperat discovered that the fertilizers that the regional office were giving to the local farmers were insufficient, inferior, and far cheaper than what was originally listed at the official budget of the department.

Esperat exposed several corrupt practices, including the fertilizer scam that involved officials of the Arroyo administration.

She later joined The Midland Review in Tacurong as columnist and was president of Region 12’s Tri-Media Association.

Arrest warrants unserved Esperat had accused Montañer and Sabay for corrupt practices. Like Montañer, Sabay has yet to be arrested.

Esperat, along with several witnesses, also exposed the alleged deliberate burning of the DA office in Cotabato City on May 7, 1998 to destroy the hard evidence in the cases against Montañer and his companions.

The CMFR said that in early 2005, “Montañer and Sabay purportedly drew a plan to permanently silence Esperat, through ex-military intelligence officer Rowie Barua.”

The alleged gunman and lookout have been jailed but the two alleged masterminds, including Montañer, have yet to be arrested.

The prosecution found three witnesses but two of them recanted their testimonies, apparently for fear of their lives. The third and lone state witness, Rowee Barua, a police sergeant who acted as go-between for the alleged masterminds and the alleged hired guns, chose to tell all that he knew about Esperat’s murder and according to the Philippine Center for Investigative Journalism was “dismissed without honor” by the Philippine National Police on May 17, 2010. The PCIJ report posted on its blogsite on April 15, 2011 said Barua “sustains his eight children with the P5,000 he receives as monthly stipend from the Witness Protection Program of the Department of Justice.”

The courts had had to issue three warrants for the arrest of the alleged masterminds.

But in all instances, the alleged masterminds and their clearly more influential patrons and lawyers foiled the service of the warrants,” the PCIJ 2011 report said.

He said they plan to pass the revised ordinance this year so the new rules could become effective in January 2016. He said they were able to implement revisions in real property tax in January this year.

Bioco said the tax codes of Bukidnon’s 20 towns possibly carry the same defect as that of the two cities.

He said that while the provincial government had passed last year its own investment code, “there is disengagement” at the local level, referring to the towns and cities.

“Even if you expedite the business registration/ licensing process, you’ll get stuck in the tax computations,” he said, noting this has been an issue every year between tax payers and local governments.

Bioco said the chamber and the Department of Trade and Industry and the Department of the Interior and Local Government have signed a memorandum of agreement on how to address the problem.

For example, he said, they will hold a conference among local treasurers, assessors, planning and development officers on the need to reform local tax codes.

He said they consider it an appropriate step before pushing for the legislation of new local tax codes.

He said DTI and DILG wanted to institutionalize changes through business chambers like BKCCII. He added that aside from updating local tax codes his group is also campaigning for reforms in business permit processing and zoning ordinances, among others. (Walter I. Balane/MindaNews)
