C AG AYA N d e O r o City––Land transportation authorities will start implementing the stiffer, revised schedule of fines and penalties for violation of laws, rules, and regulations governing land transportation in the country on Thursday, June 19, even as operators and drivers are wary about its outcome.

Last June 4, the Department of Transportation and Communications (DOTC), the Land Transportation Franchising and Regulatory Board (LTFRB), and the Land Transportation Office (LTO) has issued Joint Administrative Order (JAO) No. 2014-01. The revised schedule of fines and penalties is intended to rid the streets of unauthorized public utility vehicle (PUV) operations, the DOTC said, bringing up to P1 million in fine for “colorum” buses. THOUSANDS of local residents in three barangays in Villanueva town in Misamis Oriental have benefitted from the medical mission organized by the couple Mayor Julio T. Uy and second district Rep. Juliette Uy, held at the San Martin Elementary School in Barangay San Martin on June 14. Local residents of barangays San Martin un-

der Punong Barangay Jeric Emano, Mohon, and Sta. Cruz availed of the various services offered during the 6th Medical Mission. Rep. Uy distributed her donation to students and children consisting of school supplies, raincoats, and a pair of low-heeled slippers during the medical mission. Some of the free services offered include dental, optical and medical check up, hair cutting courtesy of the beauticians from the town

of Villanueva, eye check up from the Eye Care International, feeding program, circumcision, civil registration, distribution of herbal plants, and the distribution of fruitbearing trees courtesy of the Steag-funded Villanueva Urban Forest Project. Dismantling of ‘Habal Habal’ in C. de Oro eyed By CRIS DIAZ Executive Editor

CAGAYAN de Oro City––The City Council’s committee on public utilities would look into complaints of the proliferation of illegal transport terminal at the city’s public markets here, City Councilor Roger Abaday said on Tuesday. The “Habal-Habal” motorcycles (a motorcycle used for conveying passengers) as a public transport is not sanctioned or recognized by the Land Transportation Office (LTO) and the Land Transportation and Franchising Board (LTFRB) because it jeopardizes the safety of the person as a passenger. Abaday said that the Agora West Bound Transport Operators/ Drivers Association (AWTODA) has sought the intervention of the

ABADAY city council to stop the operation of the “Habal-Habal” motorcycles in the public market. He said that AWTODA have made many attempts to stop the operation of the “Habal-Habal” within the area but these failed. “Obviously, the Habal-Habal was tolerated since it has become a source of the livelihood of the motorcycle owners,” he said.

The city’s Road and Traffic Administration (RTA) has reiterated that the “Habal-Habal” operations are not allowed within the city proper, Abaday added. He said the City Council would study the necessary measures to stop the operations of the Habal-Habal in the city in close coordination with the RTA and the local traffic enforcers. The “Habal-Habal” operations have been rampant in Cagayan De Oro City, particularly at night, where motorcycle owners hang around the street corner in LicoanClaro M. Recto Avenue and in the corner of Carmen’s Vamenta Blvd and Seriña street. Local residents and concerned citizens have been complaining about the presence of the illegal Habal-Habal motorcycles in the city, but the city government has turned deaf of the complaints.

Brgy officials urged to help fight ‘dengue’ CAGAYAN de Oro City––Local officials here are urging barangay officials to help in the fight against the spread of “Dengue” in this port capital of Cagayan De Oro City, Councilor Dante Pajo said on Tuesday. The City Council has enacted an Ordinance No. 10044-2006 to regulate the storing or stockpiling of used tires, tin cans, flower pots and other containers that are possible breeding grounds of Dengue carrier Mosquitoes, Pajo said. “The empty cans, used tires at vulcanizing shops, junk shops or the household can stock or collect water, especially during heavy rains, such should not be tolerated to prevent the breeding of dengue-carrying mosquitoes,” Pajo said.. The Ordinance prohibits the stockpiling or display of tires and other containers in open places, except when there is adequate protective roof or cover, he said. Pajo urged barangay officials to help in the strict implementation of the Ordinance in order to contain the spread of Dengue cases in the city. He said that the school officials, especially in grade schools, should also be aware of the anti-Dengue Ordinance in order to protect the children and pupils. Pajo said that the violators have to pay an administrative fine within 72 hours from receipt of notice of violation, for the first offense, P500.00; Second offense, P1,000 and third and subsequent offenses, P3,000.00 In case that the offender could not pay the administrative fine, he or she may opt to render community service that includes collection of garbage, cleaning of streets and graffiti, clearing of canals and drains and other tasks relative to the beautification and cleaning and greening program of the city, he added. BUTUAN City––The Department of Agrarian Reform in Caraga has shown its strong commitment and industriousness in implementing the Comprehensive Agrarian Reform Program (CARP) by exceeding its annual land distribution projections and improving the lives of the landless farmers who, since time immemorial, have depended on the soil their families’future.

In a press conference to commemorate CARP’s 26th Anniversary at Robinson’s Place here on Monday, Regional Director Faisar Mambuay announced that DAR-Caraga is ranked number 1 percentage-wise for distributing 14,105 hectares of agricultural lands or 147 percent of its 9,500-hectare 2013 target. He said 122,264 farmers in Caraga have been empowered and are now occupying 259,220 hectares of DAR-distributed

agricultural lands. According to Mambuay, DAR-Caraga is faced with the highest target of 23,000 hectares for distribution this year. He revealed that 540 hectares had been turned over to farmers last June 10, while 275 hectares are set to be handed on June 19 to beneficiaries in Siargao, Surigao del Norte and 500 hectares to landless soil tillers in Dinagat Islands on June 20. MARAWI CITY, Lanao del Sur - About 10,000 public school teachers from this province flocked to the provincial capitol gymnasium Sunday, June 15, to receive their June salaries. The distribution of checks for the salaries of teachers from Lanao del Sur and Marawi City Schools Division was led by Autonomous Region in Muslim Mindanao (ARMM) regional governor Mujiv Hataman and assisted by regional vice governor Haroun Alrashid Lucman Jr. and provincial governor Mamintal Adiong Jr. Hataman said the release was made earlier in preparation for the Ramadhan or the fasting

month. Aside from the awarding of checks, the regional governor also relayed to the teachers that they can now avail of higher loanable amounts and retirement benefits from the Government Service Insurance System (GSIS). He said the GSIS, Department of Budget and Management (DBM) and the ARMM government has recently signed and sealed a tripartite agreement to settle the premiums-in-arrears of almost 26,000 DepEd-ARMM employees. Hataman said DepEdARMM and GSIS will soon issue guidelines on the requirements especially for those employees who have retired but have not received their retirement benefits.

With this development, the regional governor urged the teachers to also do their share and protect the interest of school children. “We are doing our best to protect your interest kaya sana gawin din ninyo ang lahat upang matuto at protektahan ang interest ng mga bata sa loob ng eskwelahan.” Meanwhile, 82 recipients of ARMM’s “Iskolar ng Bayan” scholarship program, from the province also received their stipend for one semester on Sunday. Arguably, the most important difference today is that the public has shown little if any inclination to go to the streets in large numbers. For many left leaning Filipino intellectuals who tend to idealize the popular protests of the past, this people power fatigue is a painful disappointment. The people’s passivity challenges the widespread perception that in the end of the day the masses will take their destiny into their own hands. Filipinos seem to have learned their lesson. Few would argue today that the two previous revolts led to an

improvement of the quality of their lives. Many would even say, and empirical data justifies their claim, that their situation has worsened. A recent opinion poll conducted by a reputable survey institute revealed how fed-up the people are with being sent to the streets by political agitators. Nationwide EDSA protests never took place even after Gloria Arroyo was besieged with the Hello Garci scandal and the graft and corruption charges. Do we not need another EDSA to remove all these politicians involved in the NAPOLES PDAF scam?

The K 11-12 dilemma

COME school year 20162017 until 2017-2018, colleges and universities in the country will not have any first year students enrolling during that period because of the government’s K-12 program. What will happen during those school years, fourth year high school students under the old program will not be going to college but will be made to enroll in Grade 11 on the first school year implementation of the K-12 program? On the second year of the program’s implementation those enrolled in Grade 11 in the previous school year will have to enroll in Grade 12. It is only after finishing Grade 12 that these students be admitted to college thus leaving the country’s colleges and universities with no college students during the aforementioned school years. This is the dilemma being faced by the country’s colleges and universities. This dilemma is com-

What’ll the colleges and universities do with their faculty members teaching in the first and second year levels in the meantime that there are no freshmen students entering college during the mentioned period? Will they fire them with the promise to rehire them when the dilemma is over? Can these institutions offering tertiary level of education retire their faculty members teaching first and second year college subjects? Sadly, the brilliant boys and girls in the government who

drafted the K-12 program did not even try looking at this possible scenario. They were just focused on seeing to it that the K-12 program gets implemented without looking at its ramifications. Tertiary level education institutions are left to draw up their own plans on how to cope with this dilemma. Others are negotiating with their first and second year faculty members to go down and teach Grades 11 and 12 if they don’t want to be fired or retired. But this is easier said than done. Tertiary level educational institutions that have faculty unions or even those with no unions

will have to contend with the security of tenure mandate of the law. Can they just dismiss or retire their redundant faculty members during that two school year period? This dilemma was expressed to me by a friend who is the vice president for academic affairs of one of the universities in the capital region. And I was told that there is a strong resistance on the part of some college faculty members with doctors of philosophy and education degrees from teaching in Grades 11 and 12. Can these colleges and universities just order their reluctant faculty members to teach in high school levels? If they can, then there is really no problem. But what if they can’t because of labor union and other legal considerations? Should these educational institutions be required to continue paying the salaries of their faculty members who because of the K-12 program are See DILEMMA, page 11

Mindanao Shipping Conference focuses on BOC policy direction

AGAYAN DE ORO CIT Y -- Key Bureau of Customs (BOC) initiatives designed to streamline operations and cut corruption, including rationalizing operations and addressing loopholes on customs and trade practices, are the subject of a Bureau of Customs presentation, at the Mindanao Shipping Conference set today, June 18, at the Limketkai Luxe Hotel in Cagayan de Oro City. Customs deputy commissioner for Assessment and Operations Coordinating Group Atty. Agaton Teodoro Uvero tackles the recently implemented ruling on accreditation for importers and customs brokers; impending adoption of the load port survey (pre-shipment inspection) on containerized shipments; and plans for full computerization at the bureau as well as a host of other measures that the BOC will adopt in the next 12 months. One of these policies is the Department of Finance requirement for accreditation of all importers

and customs brokers at the BOC and the Bureau of Internal Revenue (BIR). Under the newly enacted rules, all importers and customs brokers will have to secure their BIR importer clearance certificate or BIR customs broker clearance certificate from the BIR head office in Quezon City. A separate accreditation from the BOC is also required so importers and customs brokers can transact with the customs agency. The load port survey on containerized shipments, on the other hand, is scheduled for implementation within the third quarter of the year based on a draft customs administrative order. At the end of his presentation, Uvero takes questions from conference delegates. Other conference speakers include former Socio-Economic Planning Secretary Dr Cayetano Paderanga, Jr, who will discuss economic prospects for Mindanao; Dr Adora Navarro whose presentation will focus on

the benefits of ASEAN integration on the logistics industry; and PIEMO Industries Association president Augustus Adis who will point out the needs of Mindanao shippers and cargo service providers. Cebu Pacific to fly to Sydney and Kuwait

The Philippines’ leading airline, C ebu Pacif ic (PSE:CEB) will operate direct flights from Manila to Sydney, Australia and to Kuwait this September, to serve Filipino expatriates and open more opportunities for tourism. CEB will be the only airline offering non-stop flights to Kuwait, which hosts more than 180,000 Filipinos workers. The new Manila-Kuwait thrice weekly service will start on September 2. Meanwhile, CEB will fly non-stop to and from Sydney four times a week, star ting on S eptember 9. As the only low-cost carrier offering this route, CEB hopes to stimulate travel both ways with this new ser vice. There are also over 300,000 Filipinos based in Australia. “Our trademark low fares will allow our kababayans abroad, the Global Filipinos, to visit home more often, as we had done in other destinations before, and at the same time attract Australian tourists into our shores,” said CEB President and CEO Lance Gokongwei. To mark its new service, CEB offers an introductory seat sale fare from June 16 to 19, 2014 or until seats last, for travel from the new route’s launch date until December 31, 2014. CEB is offering allin fares from Manila to Sydney, as low as P4,999. These are inclusive of the fare, fuel surcharge and other fees, but exclusive of the Philippine Travel Tax. After the seat sale, lowest year-round all-inclusive fares to Sydney start at P12,150.

Gov't forces nab 2 ASG members in Zamboanga City Z AMBOANGA CITY - The Presidential Anti-Organized Crime Commission (PAOCC) on Tuesday said that two alleged members of the Abu Sayyaf Group (ASG) were arrested in Zamboanga City in connection with the Kidnapping and Serious and Illegal Detention with Ransom case.

In a statement, PAOCC identified the suspects as Jimmy Nurilla and Bakrin Haris who were apprehended in Barangay Sangali, Zamboanga on Monday by the joint elements of the Philippine Center on Transnational Crime, Spe-

cial Project Mindanao Khilafa Islamiyya, Philippine National Police, and Armed Forces of the Philippines in a PAOCC-assisted operation. The duo were nabbed during the implementation of the Warrant of Arrest

issued by RTC 9th Judicial Region, Branch 16, Zamboanga City against alias Walid docketed under Criminal Case Nos. 24108. However, during the conduct of the operation, alias Walid was able to evade arrest. The operation also resulted in the seizure of some subversive documents and explosives from the arrested personalities. Nurilla and Haris were allegedly active members of ASG Kidnapping-forRansom Group operating in Zamboanga City. The two arrested suspects were reportedly part of the

group that abducted Warren Rodwell, an Australian National who was held in captivity for 15 months; Kevin Lunsman, an American Citizen who was kept in captivity for five months; Cathy Casipong, teacher from Sibogtok Elementary School in Limaong Island; and, businesswoman Sabrina Voon who is still in captivity. It was also said that they have links to the Basilanbased ASG under the leadership of Furiji Indama and Khair Mundos, who was also arrested last week. (PNA)

ISABELA CITY, Basilan – The Philippine Coconut Authority (PCA)-9 sought the help of stakeholders toward a strong and urgent collaborative approach in fighting the scale insect infestation in Isabela City and Basilan. Ralph S. Hamoy, PCA9 OIC/Regional Manager said that Basilan is a big contributor to the economy of Zamboanga Peninsula because of its coconut industry. But, the industry is now being threatened by the invasive scale insect that has infected over 70 thousand coconut trees in Isabela City and counting. “There is a plan for you [government agencies] to be greatly involved in the fight versus cocolisap because we have a hard time in dealing with the insect alone. We have done preventive and control measures, but [they] are not enough,” Hamoy said. He added that the spread of this insect pest is so massive that PCA could not handle alone and it requires the help and support of government agencies, the local government units (LGUs), and the farmers and landowners. He underscored the important role of the media in providing valuable information to the coconut farmers and the community affected by the infestation. “I would like to request or even appeal to your hearts to have some commitments, do something and input your ideas [in

this meeting] and efforts on how to address this situation,” he said. He revealed that numerous activities and actions were done by PCA, biologically and chemically to salvage what has been left of the coconut tree. “B u t i t’s j u s t n o t enough,” he said. He disclosed some problems encountered during those efforts of treating the infected coconuts, namely, the cooperation of some landowners, the passiveness of some of our “counterparts”, and the availability of water source as main ingredient in treating infected coconuts. He also revealed that the 52 emergency laborers hired by PCA for the purpose had stopped effective May 1 as they are yet to receive their 16 days salary. Different government agencies, farmers’ organizations, and the LGUs gathered at the Querexeta Formation Center last June 11 for an emergency meeting on some updates and development of the coconut scale insect infestation in Isabela City. Efren P. Carba, PCDM division chief reiterated that the degree of infestation in Isabela City already needs chemical treatment more than the biological control measures that were being done. AVAOCITY — Is a light rail transit (LRT) possible in Davao?

The city government thinks this could happen, as Mayor Rodrigo Duterte entered a deal with the Korean Engineering and Construction (KEC) to conduct a joint study and construction of this project. The joint project would be launched by September while the feasibility study may be completed by early 2015. Duterte said the LRT is a viable option for the city as he foresees problems in traffic congestion such as the rise in population, vehicles and businesses. “Right now, we have narrow roads that we can’t expand because we can’t buy the expensive lands (to expand the highway); our only option is to have

railways,” he told the delegation of the KEC after the signing. His point was supported by the study presented by KEC overseas manager Dae Kwon Jung, which showed Davao City’s population growth rate is at 2.7% annually and vehicles rising in Davao Region at 7.1% annually. The city’s main form of transportation comprises of multicabs, jeepneys, tricycles, buses and taxis. Jung said Davao City’s population may even reach 10 million by the year 2040, and at that time the city may be considered “one of the terribly trafficked cities” if no sound transport system is created. The project is a first in the Philippines for the private construction firm KEC. But its chief researcher, Chae Il Kwon, said the company’s credentials include the construction of the high-speed train projects in Korea, Singapore and Malaysia,

and other railway projects in Seoul. Jung presented four possible types of mass transit and four possible routes for this project. The company said the most economic route would be a 13 kilometer route plying Ateneo de Davao University in Roxas Street, Abreeza Mall in Davao, SM Mall Lanang, DIHO and the Davao International Airport in Buhangin. The three other routes will go through these same areas with additional areas. Jung proposed that the monorail type of LRT, with a capacity to carry five to twenty-thousand passengers in an hour running at 70 kilometers per hour, to be used for Davao City. He added that monorail train contributes less noise pollution and carbon emissions, factors that the Duterte considers as a “na-

ture saver”. Duterte said he favors this over another proposal from the city council’s transport committee for a public bus transit system in the city. “You will only have one engine running over the city. Can you imagine if you have many buses spewing more carbon emission that contributes to pollution,” he said. The mayor said the LRT is a long-term project that may be completed in the next decade, but he wants the feasibility to take place not later than early 2015 as the country will be heading towards the national election. Duterte said he will consult with various sectors such as business leaders and most especially public transport leaders representing 8,500 jeepney drivers and 14,000 tricycle drivers

The Office of the President is fine-tuning the draft BBL, which from Mohager Iqbal, chief peace negotiator of the Moro Islamic Liberation Front (MILF), submitted on April 22. Reports quoted House Majority Leader Neptali “Boyet” Gonzales II as having said that “an announcement will be made for Congressman Rufus to lead the ad hoc panel for the Bangsamoro bill.” Rodriguez, however, said that “it is just a recommendation. Nobody has approached me about this appointment yet.” Constitutional BBL “But if appointed, I can no longer serve as the socalled “champion” for the BBL because as chairman, my duty is to give space to all quarters regardless of political color and argument. I have to be neutral,” he added. Whether as “champion” of as chairman of the ad hoc committee, he said that he will exert all efforts so that Congress will pass a Constitutional BBL and help bring peace to his native Mindanao. Rodriguez disclosed that more than 60 percent of the 290 congressmen of the 16th Congress are in favor of the BBL and will vote for its passage. This is based on the result of an ongoing mapping of congressmen on the acceptability of the BBL being done by an international group. The Bangsamoro Basic Law was specifically designed to allow the Bangsamoro people to “fully exercise their rights based on their unique customs, traditions, beliefs and cultural identity.” Contrar y to unconfirmed reports that the House leadership will put the proposed BBL straight to the plenary for debates, Rodriguez said that it will be best for the proposed Organic Act of the proposed new Bangsamoro New Political Entity to undergo committee hearings before going into plenary. At the committee level, possible questions that will be raised in the plenary will have already been answered. Also, it is expected that during committee hearings, the proposed measure will have been scrutinized from its first letter in the first page to its last period in the last page, paving the way for a smooth passage in plenary. Constitutional Basis Groups and individuals supporting the BBL are confident that all constitutional issues have already been ironed out and adequately answered given that the draft BBL is itself based on the 1987 “Freedom” Constitution. On the question of territorial and political subdivisions, Article X, Section 1 of the Constitution defined

the territorial and political subdivisions of the Philippines as the provinces, cities, municipalities and barangays. But it also states “There shall be autonomous regions in Muslim Mindanao and the Cordilleras as herein after provided.” On the question of the creation of the autonomous region, Section 15 of Article X states that “there shall be created autonomous regions in Muslim Mindanao and in the Cordilleras consisting of provinces, cities municipalities, and geographical areas sharing common and distinctive historical and cultural heritage, economic and social structures, and other relevant characteristics.” On the structure of government, Article X, Section 18 states that “the organic act shall define the basic structure of government for the region consisting of the executive department and the legislative assembly, both of which shall be elected and representative of the constituent political units. The organic act shall likewise provide for special courts with personal, family, and property law jurisdiction consistent with the provisions of this Constitution and national laws.” On questions of the sharing of power and wealth, Article XII, Section 1 states that “the goals of the national economy are a more equitable distribution of opportunities, income and wealth; a sustained increase in the amount of goods and services produced by the nation for the benefit of the people; and an expanding productivity as the key to raising the quality of life for all, especially the underprivileged.” Article XIII, Section 1 of the Constitution also states that “the Congress shall give highest priority to the enactment of measures that protect and enhance the right of all the people to human dignity, reduce social, economic, and political inequalities, and remove cultural inequities by equally diffusing wealth and political power for the common good.” Also, Article X, Section 7 states that “local governments shall be entitled to an equitable share in the proceeds of the utilization and development of the national wealth within their respective areas, in the manner provided by law, including sharing the same with the inhabitants by way of direct benefits.” To be continued

Recently, Davao City Mayor Rodrigo Duterte has offered a business deal with the barangay folks of Paquibato district. This is in connection with the interest of a Malaysian company to develop about 100 to 1,000 hectares of agricultural lands in Paquibato to oil palm development. Duterte said he would communicate the matter to President Benigno Aquino III and the National Democratic Front of the Philippines (NDFP). He had said that the project would generate numerous jobs to Paquibato residents and eventually improve their lives, thus, creating peace and development in the rebel-infested Paquibato District. Councilor Danny Dayanghirang, chair of the committee on finance, ways, and means, for his part, said the city government’s focus on development now is geared towards the city’s rural area due to its agriculture development potentials.
