The 2015 Jr. NBA and Jr. WNBA All-Stars were selected from over 12,000 boys and girls who

– all under the watchful eyes of a boxing trainer.

The trainers, all former professional boxers, see to it that these boys and girls train hard so they can participate in the boxing events of Batang Pinoy, or the Philippine Youth Games, their first ticket to stardom.

Gadot and the 40 young boxers, including five girls, live in a house inside the yard that serves as their training camp in Aluba, Barangay Macasandig here.

The boxing trainers found them when they competed at the Boxing in the Park held every Sunday afternoon at the Amphitheater in Divisoria in this city.

After they were selected, the young boxers are invited to join the Cagayan de Oro boxing team and asked to live and train at the compound in Aluba.

Layoff of TV network employees ‘cruel’

AVAO CITY – The recent mass layoff of GMA network employees violated the workers’ rights to due process, a labor group said.

In a statement on Tuesday, Kilusang Mayo Uno said they condemn the mass layoff of hundreds of employees on some of GMA network’s regional stations. Around 290 employees and talents were reportedly laid off.

“Clearly, this act was done hastily, violating workers’ right to due process, all in the name of the management’s “strategic streamlining” efforts to rake in more profits and up the station’s ratings,” Carlo Olalo, KMU spokesperson said.

Olalo said the network’s move was baseless given its financial standing.

“GMA Network reported a net income P1.01 billion in 2014 and is definitely far from bleeding dry of profits.

The mass layoff is clearly an abuse of the exercise of the management prerogative to do, as it will without regard for the dignity and welfare of the workers affected,” Olalo said.

Olalo said the incident shows how the country’s labor framework is skewed

against the interests of the workers. The mass layoff of TV reporters and staff came just a few days before the International Labor Day. “By carrying out this mass layoff, the Kapuso Network has shown where its heart truly lies – for profits, above all,” Olalo said.

Olalo said they are sympathizing with hundreds of employees and their families who now face uncertainties.

“Media workers are beset with various labor issues such as the widespread practice of the “talent” system which is the concrete expression of contractualization in the media industry. The “talent” system prevents them from enjoying their rights as workers under the law, such as the right to form unions and the right to regular employment,” said Olalo.

He said that apart from job insecurity, media practitioners face imminent death in the exercise of their profession in a country considered to be the

second most dangerous for journalists.

“The media industry has lost 32 of its comrades under the Aquino administration alone,” said Olalo.

“The Aquino administration’s record on labor smacks of utter neglect with recordhigh unemployment as well as accelerated implementation of neoliberal policies resulting to low wages, massive contractualization, job insecurity and trade union repression,” Olalo said.

Olalo said they are encouraging the GMA Network employees to unite their ranks and organize citing the success of the radio workers union of RMN Davao who staged a 43day strike and “achieved a much-improved collective bargaining agreement.”

“We call on media workers and GMA Network employees to join other working people in their struggle to secure a living wage, job security, and the free exercise of their rights.

We encourage them to join protest actions on Labor Day so that together, we can advance our unified interest in achieving improvements to our political and economic well-being as working people,” said Olalo. (davaotoday.com)

PNP, AFP step up security as arrival of Palaro delegates starts Wednesday DAVAO CITY - The Philippine National Police (PNP) stepped up security arrangements for the 2015 Palarong Pambansa as delegates start arriving Wednesday in Tagum City.

PNP Police Regional Office (PRO) XI Chief of Staff P/Sr. Supt. Camilo Cascolan said they are expecting 10,500 delegates for the Palarong Pambansa by Saturday. While some games start on Sunday, the grand opening rites will be held on Monday afternoon.

According to Cascolan, police will not only be securing the games venue and billeting sites but they will also provide security for delegates going around tourism sites in Davao.

Illegal recruiter falls, 7 would-be victims rescued in Zambo port

AMBOANGA City – The multi-agency Sea-Based Anti-Human Trafficking Task Force (SABATTF) has arrested a suspected illegal recruiter and rescued seven wouldbe trafficking in person victims in this city, an official said Wednesday.

Senior Supt. Angelito Casimiro, Zamboanga City

police director, identified the suspect as Eliza Cabarubias, 32 of Davao City.

Casimiro said the suspect was arrested around 5 p.m. Tuesday at the local wharf.

Casimiro said that at the same time the task force has rescued seven would-be victims of illegal recruitment.

Casimiro did not reveal the identities of the wouldbe victims except in saying they were all women.

They were turned over to the custody of the Department of Social Welfare and Development (DSWD) for proper assistance.

Casimiro said the suspect recruited the victims and facilitated their travel

to Dubai via Malaysia.

He said the suspect promised them they will be employed “in the country of their destination.”

He said the suspect was turned over to custody of the Criminal Investigation and Detection Group (CIDG) for the filing of appropriate charges in court.

PNP, PDEA link with communicators to address drugs, crimes in Zambo

ZAMBOANGA City – The Philippine National Police (PNP) and the Philippine Drug Enforcement Agency (PDEA) joined hands with the media, government information agencies and civil society groups to help curb the spread of illegal drugs in the city as well as to reduce criminalities through advocacy and communication.

On Thursday (April 23) night, the PNP, PDEA, City Hall Public Information Office, the Philippine Information Agency (PIA), media practitioners and local civil society organizations met to re-visit the Integrated Communications Plan for Public Safety (ICP4PS) which was initially crafted last February through the facilitation of the United States Agency for International Development (USAID) Engage Project. This followthrough meeting aimed to concretize the action plan for operationalization by the different stakeholders.

Salva, who was 13 when he started training, won three amateur fights in in Gingoog when he was discovered by Pamisa and invited to join the Cagayan de Oro boxing team.

Like Gadot and the rest, Salva also dreamed to become the next Manny Pacquiao so he can at least bring some food to the table of his family in Gingoog.

Salva now receives P5,000 a month and has his own quarters at the Aluba boxing camp.

He is scheduled to fight in the next Batang Pinoy tournament in November.

It was granted a franchise by the National Electrification Commission to operate an electric light and power distribution service in the province of Misamis Occidental, particularly in the City of Oroquieta and the Municipalities of Aloran, Lopez Jaena, Plaridel, Calamba, Baliangao, Sapang Dalaga and Concepcion (the “Franchise Area”).

MOELCI I may be served with the orders, notices and processes of the Honorable Commission through undersigned counsel at the address indicated below.

Applicant TMI is a generation company duly organized and existing under the laws of the Republic of the Philippines with principal office address at the Mobile 2, Lawis, Sta. Ana, Nasipit, Agusan Del Norte. Copies of TMI’s Securities and Exchange Commission Certificate of Registration, Articles of Incorporation, General Information Sheet and Audited Financial Statements are attached hereto as Annexes “A”, “B”, “C” and “D”, respectively.

3.1 TMI owns and operates the 100MW Power Barge No. 117 (“PB 117”) in Nasipit, Agusan del Norte and the 100MW Power Barge No. 118 (“PB 118”) in Maco, Compostela Valley, which it acquired from the Power Sector Assets and Liabilities Management Corporation upon their privatization in accordance with Republic Act No. 9136, otherwise known as the “Electric Power Industry Reform Act of 2001 (“EPIRA”).

3.2 TMI is joining MOELCI I as co-applicant in this case in order to assist MOELCI I in securing approval of the terms and conditions provided in the of the Energy Supply Agreement dated 7 October 2011 (“ESA”), as supplemented by the Supplement to Energy Supply Agreement dated 17 March 2015 (the “Supplement Agreement”), entered into by and between MOELCI I and TMI.

TMI may be served with orders notices and other legal processes of the Honorable Commission through its undersigned counsel.

NATURE OF THE APPLICATION

The instant Application seeks approval by the Honorable Commission of the ESA, as supplemented by the Supplement Agreement, entered into by and between MOELCI and TMI, pursuant to Rule 20(B) of the Energy Regulatory Commission’s Rules of Practice and Procedure (“ERC Rules”).

Copies of the ESA and the Supplement Agreement are attached hereto as Annexes “E” and “F”, respectively.

STATEMENT OF THE FACTS

6.

MOELCI I currently sources the bulk of its electricity requirements from the Power Sector Assets and Liabilities Management Corporation (“PSALM”) and the remainder from King Energy Generation, Inc.( KEGI ) and TMI.

6.1 On 7 October 2011, MOELCI I entered into the ESA with TMI for the supply of 2 MW for a term of three (3) years from Effective Date (“Original Term”).

It is expected that the energy requirements of MOELCI I’s customers will significantly increase in the next few years as demonstrated by MOELCI I’s Distribution Development Plan (“DDP”), which is hereto attached as Annex “G.”

9.

The expiration of the PSALM Contract of Supply of Electric Energy on 25 December 2016, as well as the projected increase in the energy requirements of MOELCI I’s customers will result in a shortage of the energy available to MOELCI I and its customers.

10.

On 17 March 2015, MOELCI I and TMI executed the Supplement Agreement extending the term of the ESA for an additional period of three (3) years from the expiration of the Original Term (“Additional Term”) and stipulating the rights and obligations of the Parties during the Additional Term, which shall be under the same terms and conditions of the ESA, subject to the following: SALIENT PROVISIONS OF THE ESA AS SUPPLEMENTED BY THE SUPPLEMENT AGREEMENT 11. Additional Term. The Supplement to the ESA provides that the ESA shall remain in force for an additional period of three (3) years from the expiration of the Original Term, commencing on 8 May 2015, and shall terminate on 8 May 2018 unless either Party sends a written notice of pre-termination to the other Party at least sixty (60) days prior to the end of each contract year. The Supplement Agreement further provides that it may be terminated effective on the Operations Effective Date defined in the Energy Supply Agreement between MOELCI I and Therma South, Inc. (“TSI”), covering the supply of power from the coal-fired power plant of TSI or, if Operations Effective Date of the power plant of TSI has not yet occurred by the end of the Additional Term, the ESA shall be automatically renewed on a year-to-year basis, unless earlier terminated in accordance with the provisions of the ESA. Upon expiration of the Additional Term, and any extensions thereof, the Parties may agree to further extend the term of the Agreement under the same terms and conditions of the ESA, as supplemented by the Supplement Agreement.

12. Electricity Fees. Beginning on the expiration of the Renewal Term, the Electricity Fees shall be computed based on the following values:

14. Contract Energy. Under the ESA, TMI shall make available, on a monthly basis, the capacity of 2 MW, to be delivered in accordance with the Schedule of Contract Energy of the ESA. 15. Additional Energy. TMI may, at its option, make available to MOELCI I such energy in excess of the contracted energy for which MOELCI I shall be liable to pay the Additional Energy Fee consisting of variable and fixed charges pro-rated for the hours of delivery of the additional energy, subject to annual adjustments.

16. Load Curtailment Adjustment. For Contract Energy subject of load curtailment, MOELCI I shall pay the Load Curtailment Adjustment in lieu of the Capacity Fee component of the electricity fees. The same formula for the Load Curtailment Adjustment Rate under the ESA shall continue to be in effect.

17. Replacement Energy. TMI has the option but not the obligation to source replacement or alternative supply from its own back-up facility and/or any third party to supply all or part of the contract energy.

18. Security Deposit. No later than thirty (30) days before the commencement of the second (2nd) Contract Year and every Contract Year thereafter, MOELCI I shall provide TMI a Renewal Security Deposit in the form of a Standby Letter of Credit in an amount equivalent to the estimated average one month Invoice projected for the next twelve (12) months as agreed by TMI and MOELCI I or, in case of disagreement, in an amount equal to the highest Invoice issued by TMI to MOELCI I in the twelve (12) months immediately preceding the commencement of such Contract Year. 5

Application Costs. The Supplement Agreement provides that MOELCI I shall bear the costs of all filing fees, costs of publication, legal fees and similar costs arising from the preparation and filing of this Application.

20.

The extension of the Contract Term under the Supplement Agreement and the implementation thereof will redound to the benefit of the consumers of MOELCI I which may otherwise be forced to bear the cost of 2 MW purchased from the Interim Mindanao Electricity Market (“IMEM”) or to suffer a corresponding amount of brownouts. In undertaking the extension of the ESA the Supplement Agreement, MOELCI I seeks to comply with its obligation of providing stable and continuous power supply, pursuant to the Department Circular No. DC 2012-03-004 dated 19 March 2012 of the Department of Energy.

SUBMISSIONS

21.

In support of the instant application and in compliance with Rule 20(B) of the ERC Rules of Practice and Procedure, Applicants submit the following: a. Board of Investments Certificate of Registration of TMI (Annex “H”); b. Environmental Compliance Certificate issued by the Department of Environment and Natural Resources to TMI (Annex “I”); c. Certification dated 24 April 2015 issued by the National Grid Corporation of the Philippines (“NGCP”) (Annex “J”) d. Certificate of Compliance issued by the ERC to TMI (Annex “K”) e. In further compliance with the requirements of the Honorable Commission, the Applicants considered several scenarios based on the number of running hours of TMI. MOTIONS FOR PROVISIONAL AUTHORITY AND CONFIDENTIAL TREATMENT OF INFORMATION

23.

The Applicants move for the issuance of a provisional approval of the ESA, as supplemented by the Supplement Agreement, pending trial on the merits thereof, upon the following reasons: a. Mindanao power crisis. The power shortage in Mindanao has remained a critical problem for MOELCI I which continues to suffer rotating brownouts in the grid. A bilateral agreement, such as the Supplement Agreement, will significantly aid MOELCI I in minimizing or even eliminating the rotating brownouts in its franchise area which has had a debilitating impact upon the local economy. b. Insufficiency of NPC/PSALM supply. The reduction of the NPC/PSALM CSEE capacity from MOELCI I’s portfolio renders imperative a bilateral supply contract to answer for the equivalent capacity, lest MOELCI I be compelled to resort to the unpredictable and expectedly higher prices in the IMEM or, worse, be curtailed for insufficient contracted capacity. c. Continuing demand growth. As illustrated in its DDP, MOELCI I is expecting a growth in the total demand of its end-users so that, coupled with reduction of the NPC/PSALM capacity, there is a wide supply gap that urgently needs to be filled. Without the Supplement Agreement, MOELCI I will be incapable of satisfying the electricity requirements of its end-users who must be forced to suffer brownouts resulting from the curtailment of MOELCI I.

24.

Considering the foregoing, the Applicants respectfully request the Honorable Commission for the provisional approval of the ESA, as supplemented by the Supplement Agreement to enable MOELCI I to draw under the said agreement. This will avoid the power interruptions which have caused irreversible losses upon economic productivity within its franchise area. The Affidavit in support of the prayer for the issuance of Provisional Authority is attached hereto as Annex “V.”

Furthermore, under Section 13 of the ESA, each Party undertook to keep in strict confidence and not disclose to any third party any and all Confidential Information of the other Party.

26.

Under Rule 4 of the ERC Rules, this Honorable Commission may, upon request of a party and determination of the existence of conditions which would warrant such remedy, treat certain information submitted to it as confidential. Pursuant to its undertaking, MOELCI I respectfully moves that Annexes “M”, “N”, “O”, “P” and “Q” not be disclosed and be treated as confidential documents in accordance with Rule 4 of the ERC Rules and, accordingly, not be disclosed to persons other than the officers and staff of the Honorable Commission, as necessary. These documents contain certain non-public information, data and calculations involving business operations and financial trade secrets reflecting TMI’s investment and business calculations.

UTUAN City – To pursue the government’s farm mechanization program and empower farmers to become more productive, the Department of Agriculture (DA) in Caraga turned over 37 hand tractors to various farmers’ associations last April 15.

In a simple ceremony at the DA Regional Integrated Agricultural Research Station in Barangay Taguibo here, DA-13 Acting Director Edna Mabeza urged the recipients to maintain the farm equipment and utilize them to the fullest.

Tesda, solons augment Gingoog City’s tech-voc GINGOOG City--The Technical Education and Skills Development Authority (TESDA) granted Gingoog city a P1 million worth of Training for Work Scholarship Program (TWSP) for the technical-vocational in the city.

Further, Abante Mindanao (ABAMIN) party list Rep. Maximo Rodriguez Jr. and First District of Misamis Oriental Rep. Peter Unabia provided boxes of toolkits and training allowances to city’s Special Training for Employment Program (STEP) beneficiaries.

This project is a manifestation of a tri-focalized program of Tesda, Abamin, and Unabia for the out-of-school youth and aspiring individuals who want to obtain skills and land jobs for a living, said Tesda Misamis Oriental Field Office Director Leo Velez.

HE newly-formed world music band Freeppies headlined a mini-show during the first ever Social Development held last April 14 in Kiosko Kagawasan, Divisoria, this city.

Social Development Day was initiated by the CDO Peoples Council which in itself was culled from a project of the Xavier University – Research and Social Outreach called Providing Social Accountability to Foster Constructive Engagement of Stakeholders in Local Government Affairs of Cagayan de Oro. These organizations see that there are avenues where they could help craft the development agenda of the city. Funded by the Asian Development Bank’s (ADB) Partnership for Transparency Fund, the main objective of the engagement is to consolidate and strengthen various initiatives of civil society organizations in the city.

During the one-day event, there were learning sessions on best practices on social development programs and advancing a sustainable CDO.
