CAGAYAN de Oro City--A landowner has accused a group of residents in San Miguel Village in Barangay Lapasan here of harassment. Mindanao Health Care Corporation (MHCC) President Manolo J. de Leon, who owned the P60-million worth of land, told reporters that residents on Pimentel road have violated his rights as landowners. De Leon said the residents were throwing stones and Molotov bomb when his men started to level off his piece of land-and even used children as human shelter during a protest rally.

He said the residents started to complain when he ordered to close the Pimentel road to develop the area as he is planning to sell it to potential investor. The affected residents are complaining that de Leon has encroached the 20-percent equivalent of the total area, saying the land has been donated to them. But de Leon belied the accusation. He said those residents living in the San Miguel Village have violated his right as violated. “We did not violate the rights of the residents. Ex-Davao judge asserts respect, protection for family to his client's case DAVAO CITY – A retired city court judge here has asserted that family as an inviolable institution shall be protected by the state and as husband and wife they are obliged to live together, “observe mutual love, respect and fidelity, and render mutual help and support”. This is the argument interposed by Atty. Apolinario Veruasa, a retired judge of Municipal Trial Court in Cities (MTCC), in a case of violation of Republic Act 9262 (Anti-Violence Against Women and Their Children Act of 2004), filed by his client against her American husband who got married twice. Veruasa’s client accused her American husband of abandoning her by cohabiting and marrying with another woman in Cebu despite the fact that their marriage still had existed for more than 18 years. The complainant said her husband left her in May 2008 and live with another woman in Lapu-lapu City in Cebu causing her “mental and emotional anguish”, prompting her to sue the foreigner for violence against women. The complainant learned that her husband also contracted a second marriage with the woman through Muslim rights. The court battle between the couple was just a battle of affidavits as they did not anymore appeared in court and only their affidavits were presented during the trial. In his defense, the husband admitted having contracted a second marriage on May 17, 2008, since he converted to Islam religion. The husband claimed that he left their home in the city due to the constant nagging and lying of his wife-complainant. He said he even left the complainant

In supporting the complaint, the complainant’s lawyer, Veruasa, argued that the American accused had violated the Family Code of the Philippines, Civil Code of the Philippines and the Philippine Constitution, strengthening the family as an institution. Veruasa said being converted to Islam to have a second wife “is not a defense” of the accused. But assessing the evidence on record, family court Judge Pelagio Paguican of RTC Branch 12, ruled that the prosecution failed to prove the guilt of the accused American national to the offense charged beyond reasonable doubt. Paguican noted the accused demurrer to evidence that aside from allegations made by the complainant that she suffered mental and emotional anguish, there no other evidence such as psychological examination result, presented to prove her claim. In acquitting the accused, Paguican cited Supreme Court rulings stating that in any criminal prosecution, conviction must rest on proof beyond reasonable doubt. “Mere speculation and probabilities cannot substitute for proof required to establish the guilt of an accused beyond reasonable doubt,” Paguican ruled citing SC ruling. But Veruasa asserted that the accused should be held liable for abandoning his wife in violation of the Family Code of the Philippines, Civil Code of the Philippines and the Philippine Constitution. Though unsatisfied with Paguican’s ruling, Veruasa could not appeal the case since an acquittal in a criminal case is final and unappealable.” (PNA)

AVAOCITY -- More than 200 barangay officials, cluster heads, deputy mayors and supporters, here, convened on Saturday, January 10, to show support to the movement -- Mayor Rody Duterte for Federalism.

The coordinating office for Barangay and Cultural Communities Affairs Division (BCCAD) and the City Information Office (CIO) said the activity was an information drive to all barangay officials about the Federal Form of government. The organizers invited Mayor Leoncio B. Evasco Jr. of the Municipality of Maribojoc, Bohol, a longtime friend and supporter of Mayor Duterte and an advocate of Federalism. Mayor Evasco oriented the barangays officials about federalism and explained to them salient features of the Federal form of government. supreme government that holds the authority over and makes the decisions for subordinate local governments. He said that the Philippines is adopting a form of government in which the powers of all provincial and local governments are specified by a single national government. In comparison, Evasco said the Federal form of government is a government system in which the power is distributed between numerous regional (state/provinces) governments and a central, national government in rough balance (although the central government may be stronger or weaker, overall, than the regional governments). He recalled that even

the staunch advocate of Federalism, lawyer Reuben R. Canoy, founder of Radio Mindanao Network, once said that only a federal system can save the nation from "selfdestruction." CAGAYAN de Oro City–– The regional director of the Land Transportation Office has replied to a complaint that his office has failed to apprehend violators in relation to motor vehicle fines and penalties. LTO-10 Regional Director Hilarion E. Ulep said his office has not neglected to conduct traffic law enforcement in the region. Ulep said traffic law enforcement “is a year-round activity.” The complaint came from a certain Dr. Robert D. Uy who identified himself as the chairman of the Cagayan de Oro Chapter of the Misamis Oriental Riders Association. Spending the taxpayers’ money is no guess work There is no argument that the conflict of the City Executive and the City Council in Cagayan De Oro City in the appreciation of the approved annual budget for 2015 is part of the process of a democratic institution. Both the local executive and the legislative department of the local government have valid reasons. In the exercise of fairness, neither one among us could accuse either the executive or the city council of excesses in the exercise of their inherent powers. I agree with the argument of City Councilor Ramon Tabor when he argued that, no matter what the rabblerouser would say, the majority of the City Council have already approved the city’s P 2.08 billion 2015 budgets. City Mayor Oscar Moreno submitted a proposed P 3.8 billion budget 2015. The bulk of the proposal was alleged to be some P 1.7 billion defined only as “special projects.” The City Council rejected it! In a pluralistic system, the democratic process where the majority rule is the only accepted prin-

ciple. More often than not, the minority gripes in the belief that, in some cases, the majority is wrong. It is always the case because, in the absence of the power to decide, the minority’s only reason to be around is to listen, grumble, and criticize to their heart’s content. While the city executive exercises the power to veto or proscribed certain provisions of an approved legislation, the veto power loses significance when the majority overrides it. For instance, Moreno exercised his veto power on the approved 2015 budget of the city government. However, Moreno’s veto

Pope Francis arrives in the country tomorrow for a four-day pontifical and state visit. Like Christmas, the hope is that the Roman Catholic devotees in particular and the Filipinos in general will not miss the reason for the Pope’ visit which is to be in solidarity with the victims of natural disasters and the marginalized poor in this country as has been repeatedly announced by the Vatican. To recall, God becoming incarnate in Jesus so he can directly transform this world from decadence and rottenness as a result of greed due to humanity’s willful disobedience to his will had been reduced, albeit sadly, into a social event highlighted by gift-giving and merry-making where food and drinks abound. This is how Christendom celebrates Christmas today in total disregard of its true significance, which is God’s incarnation so he can save this world from the ill-effects of greed, which is the concrete manifestation of sin, by preaching and teaching about the Kingdom of God and by letting the sick and the outcast experi-

ence restoration into that Kingdom. Pope Francis is coming to our country to re-echo the message of Jesus about the Kingdom where no one is hungry, thirsty, naked, in prison, a stranger because greed has already lost its sting and the ideals of sharing, compassion, justice and love prevail as shown in the Parable of the Feeding of the 5,000. He is coming not to endorse the present economic order where only 41 families are enjoying the fruits of God’s providence thus depriving the 100 million Filipinos of their rightful share to such providence as if they are not children of God as well. Since his assumption to the Papacy, Francis is very clear that under his watch, the 1.2 billion-strong Roman Catholic church will be a church who just don’t teach preferential option for the poor but be actually with the poor in their struggles for survival as human beings in a world where they are deprived of their right to live decent lives, to have jobs that recognize them as true partners in the generation of wealth, to be assured of education, health care and

power lost its value when the City Council overrides it. Actually, a veto is an explanation why some provisions of a proposed legislative act are unacceptable. In the exercise of the veto power, an executive could veto the entire law – an approved Ordinance, in the case of the City Council – or part of the approved Ordinance aptly called “line items.” Now, it is incumbent upon the members of the City Council whether to agree or acquiesce with the vetoed items. Once the City Council approves the vetoed line item, they will amend the provision in order to conform with the desire of the City Executive. In the case, of the city government, the City Council did not conform with the City Mayor’s explanation. In the instant case, the city council overrides the veto power of the City Mayor. The City Council, then, approved, with finality, the P 2.08 billion 2015 budgets. The majority bloc of the City Council has exercised the essence of democracy.

First, the City Council approved the 2015 budget and submitted it for the approval of the City Mayor. The City Mayor vetoed the approved Ordinance and threw it back to the City Council with an explanation of the disapproval. Then, the City Council overruled the veto and approved the city’s P 2.08 budget for 2015 with finality. The reason? The City Executive failed to explain for what purpose the proposed P 1.7 billion “special projects” were all about. The City Council opined that the august body could not simply spend the taxpayers’ money on the basis of “conjecture.” Moreno said that the approved 2015 budget is “illegal.” Well, as far as Moreno is concerned, he could shout to the four corners of the city to despise the approved budget. Moreno could also solicit the support of his political followers to drum up his displeasure. UTUAN CITY - The over 600-strong Caraga police contingent from Police Regional Office 13 have arrive safely in Tacloban City and are now in “high morale,” their overall contingent commander said. PSSupt. Benson D. Leleng, overall commander of the Caraga contingent, said in a local radio phonepatched interview direct from Tacloban City on

Tuesday morning that the “the members of the contingent from Caraga region are all in high spirit, saying we are here to do our task which is to help secure the Pope,” Leleng said. According to SSupt. Leleng, they have just conducted and inspection and accounting of the troops to determine its readiness which will be followed by a blessing and a briefing. The commander also disclosed that they have brought their own logistics and

supply with them, enough for the days of their stay in the area. Leleng said that the contingent will become part of the complimentary force to Police Regional Office 8 “to help maintain order, ensure and secure the visit of the Holy Father in the region.” The information office from the regional headquarters here said on Monday that the third part of the said contingent left Monday after some of them

went ahead to Tacloban on Saturday and Sunday. The deployed PNP personnel from this region will augment PRO 8 during the state visit and apostolic journey of His Holiness Pope Francis in the country from January 15-19. Part of his itinerary is to visit Palo Leyte and Tacloban City on January 17 to dine with typhoon Yolanda and Bohol earthquake survivors and officiate a mass at Daniel Z. GPP generates positive change BUTUAN CITY - The Gulayan sa Paaralan Program (GPP), now on its 4th year of implementation, has brought about positive changes not just among students but in the communities as well. GPP is a school vegetable gardening project that aims to address hunger and malnutrition problem. It is a partnership program of the Department of Agriculture (DA) and the Department of Education (DepEd). DA provides inputs, garden tools, and technical assistance through trainings of School GPP Coordinators. During the monitoring and evaluation of school gardens, the stakeholders shared their experiences and expressed notable impressions regarding the program. In Anomar National High School, school GPP coordinator Judith S. Mula said that GPP has really been effective in addressing malnutrition in their school. “Utilizing the vegetables we harvested from the school garden, we started our feeding program in July with 21 beneficiary malnourished students and by October, only 2 were left undernourished,” Mula said. Pagadian’s street dancing ritual competitions cancelled P AGADIAN CITY – Visitors and residents will miss the chance to witness this year’s much-awaited, breathtaking street dancing and ritual competitions, as Mayor Romeo Pulmones announced the cancellation of the event over the weekend. Mayor Pulmones told the members of Zamboanga del Sur-Pagadian City Press Club, Inc. during a press conference that the street dancing and ritual competitions would no longer push through. “I regret to inform the public that this year’s street dancing and ritual competitions will no longer push through due to security reasons,” Pulmones said.

When asked what specific threat does the city encounter, Pulmones answered he could not divulge the details to protect the informant. “What is important is that we are exerting all efforts to maintain peace and security especially in the perimeters of Sto. Nino Cathedral,” Pulmones explained. Pulmones said the activities of “Pangadyian Festival” (formerly “Pasalamat Fetival) were held in different locations: the street dancing competition is held in major streets and ritual dancing will be at the city gymnasium, the regatta and fluvial procession at wharf area, and the daily Novena

Pulmones further said the law enforcers would have the difficulty in securing the people since the events are not concentrated in one area. “The Philippine National Police (PNP) has a total strength of 169, which is insufficient to secure the 217,000 residents. Anything about Pope Francis is now being peddled in exchange for cash, an act that is really no different to the way the Temple leaders cashed in on religious rituals for their own profit, a practice that infuriated Jesus to the hilt hence his move of turning the money changer’s and vendors’ table at the Temple’s doors. With his humble ways, Pope Francis will for sure not tolerate this. But not having any means of knowing how unscrupulous modern day Temple leaders and even those unscrupulous entrepreneurs outside of the Temple grounds turned his coming into a commercial extravaganza just like what they have done to Christmas, the Pope will thus be made complicit into this sinfulness by the greedy few. But this is not to pray that the Pope will not come here anymore. His coming will surely have a great impact on the lives of the very people he desires to reach out during his four-day pontifical and state visit, the poor and the outcasts, even if the few will simply cash in on his coming. De Leon said that there was a piece of paper where the residents claimed it was an agreement between them and MHCC. But it was a piece of paper, a handwritten agreement with so many erasures, he added. He asked: “How can you call it legal?” “It is always a perennial. Long time ago, during the administration of our first president, these people have asked for favor if they can be allowed to pass along the area since it is more accessible. They call it now the Pimentel road,” said de Leon. He said: “We are just human, so, we said, yes, since the company is not using it yet,” he said. But what happened now is that,

these people are taking our property, assuming it is their piece of land and according to them there was an agreement (settlement) between them and MHCC.” De Leon said he understood why these people don’t want this piece of land to be closed since it is nearer to Limketkai and other business establishments. “But it’s really not their property,” he said, adding, “it is our property and we are selling it.” The affected residents, he said, are now trying to pressure local officials by exaggerating the issue. They are even mentioning political icons and other people that could possibly provoke the issue, he said. “They are pressuring the MHCC as well as the local government because they want to take that piece of land,” the MHCC president said. Earlier, Atty. Evangeline Carrasco, the legal counsel of the affected residents, sought the intervention of the City Council. Carrasco said her clients want to negotiate with the MHCC for it to instead donate the disputed piece of land rather than closing it. “Wala man sila pakialam ani niadtong una,” she said. Under the law, she added that when a property has not been used by the owner for 10 years, those people who have been taking it and make use of it can consider it their own. “This is our property. “Success in not a matter of chance, it is a matter of choice; it is not a thing to be waited for, it is a thing to be achieved.” – Samar Mansour Upgrading the basic education in the Philippine educational system marks an avenue for the total development of the constituents. Its goals include the heightening of the quality of instruction, boosting-up of lifelong learning and skills, accessing easy employment, and ensuring job-satisfaction which would have led to stress-free and blissful life in the future. This educational reform is set to address literacy and competency issues of Filipinos in accordance with the international ideals. The ultimatum is the stand of the authorities for global competitiveness through K to 12 Basic Education Program. The K to 12 Program provides spiral progression of learning. First, mother tongue is used as the medium of instruction in the first four formal years of primary education—Kindergarten to Grade 3. It is presumed that the native dialect of the community has to ferry the learners to self-efficacy, so they can eventually gain mastery of all the concepts under such program. Second, integration of both Filipino and English languages follows in the next year levels of schooling. Aside from the main English subject, other core disciplines such as Mathematics, Sciences, Technology and Livelihood Education and Music, Arts, Physical Education and Health are to be taught in English. Lastly, the twoyear senior high school program is added to the basic education of students. This instructional pursuit is expected to produce quality graduates equip with the necessary credentials to land a job even without baccalaureate degrees. Moreover, the educational agenda offers variety of choices to students. It has opened its doors to countless possibilities every Filipino may embraced with. It caters students’ interests in different fields of specialization— academic, arts, sports, technical-vocational and even entrepreneurship. It would have to bring out the best within every learner, since the innate skills and talents one has possesses are greatly taken into account. Nevertheless, there are still a number of parents who have doubted the efficacy of the K to 12 Program. They are uncertain on how could the newly adopted curriculum help the disfavored families in their fight against poverty.

These people are thinking that the program is not only a waste of time for their children but also an additional burden to their finances. These few unconvinced individuals are blinded with their eagerness to earn a meager income to augment the monetary capacity of the family. Though the number of doubtful Filipinos is only a pinch to worry about, an immediacy of reorienting the uneducated and those who are misled is a little bit necessary. We are working not only for ourselves but also for our compatriots. Our glory is their victory, and our triumph is their fame. Our success is their happiness, and our joy is their feat. Therefore, we must go on top together. We have to clear the foggy visions of our countrymen regarding K to 12, so they can see the beauty deep within the program. Right choice really matters. Choice dictates a person’s future, and it determines one’s destiny. The moment a man fails to choose rightfully, the least he can play is living in misery. DTI opens product showcase in mall

GENERAL SANTOS CITY -- In a bid to enhance their promotion and marketing, the Department of Trade and Industry (DTI) in Region 12 has opened a new display center for various local products in a shopping mall here. Richard Arceño, DTI Region 12 information officer, said Monday the expanded pasalubong center at the SM mall is now fully operational, catering to products from 113 micro, small and medium enterprises in the region. He said the facility serves as the main display area for unique handicrafts and food products made out of raw materials that are available in Region 12. Also known as Soccsksargen, Region 12 comprises the provinces of South Cotabato, Sultan Kudarat, Sarangani, North Cotabato and the cities of General Santos, Koronadal, Tacurong, Kidapawan and Cotabato. Arceño said they pushed for the opening of the new pasalubong center, which is located at the second level of the SM mall, to better promote the region’s products that now carry the “Treasures of Region 12” brand. “The pasalabong center is a component of our product development and marketing strategy for the Treasures of Region 12 brand,” he said in a statement. Arceño said the center showcases a variety of products like processed fruit jams and jellies, sinamak vinegar, pinasugbo, banana

and taro chips, processed tuna, native coffee, cacao tablea, and fruit juices like mangosteen, passion fruit, kalamansi and guyabano concentrate. Also displayed are unique handicrafts made of bamboo, beads and brass as well as fashion accessories and other collectible items, he said. “Through the facility, our MSMEs now have the chance to offer their products in an accessible and convenient location,” he said. Arceño said another attraction at the pasalubong center is the “corporate giveaways showcase” developed by the agency. He said the showcase is mainly an exhibit of different product packages that may be offered as gifts or tokens for various occasions. The packages are composed of around 20 assorted items like coffee, processed fruits, chips and dips, and handicrafts and with each package sold from P500 to P1,500. Among the center’s top patrons are local shoppers, tourists and vacationers who are looking for items to bring home as pasalubong and souvenirs. Arceño said they are currently coordinating with other MSMEs in the region to further expand the range of products displayed at the center. INVESTMENTS poured in the third quarter of last year in Northern Mindanao amounted to P5.42 billion, an overwhelming increase of 577 percent compared to the P800.41 million of investments generated in the same period of 2013. In its quarterly report released recently, the National Economic Development Authority (Neda) reported that Misamis Oriental cornered 93 percent to the total regional investments at P5.05 billion. The bulk of the investments poured into the province included construction of new power generation and distribution facilities, establishment of a new steel manufacturing firm and various new commercial establishments in the metal and other sectors. Bukidnon generated P125.61 million worth of investments in the agri-based and consumer manufacturing sectors most particularly the expansion of an oil palm plantation in Kalilangan town and the acquisition of a

manufacturing company’s new machineries. Misamis Occidental accounted P124.1 million of investments mostly in the realty sector including construction of new commercial buildings for rent, apartments, dormitories and a hospital. Camiguin’s total investments increased at P26.37 million with the development of a new resort and more infusion into agri-based businesses. Meanwhile, collections by the Bureau of Internal Revenue (BIR) 16 in the third quarter of 2014 rose at P2.47 billion, comprising income tax and value added tax (VAT). The Bureau of Customs (BOC) in the region also improved its collections at P1.942 billion. In the third quarter of 2014, a total of 3,800 flights were recorded in Laguindingan Airport hauling in a total of 171,518 incoming passengers. In Labo Airport in Ozamiz City, there were a total of 26,068 passengers while in Camiguin Airport, there were a total of 3,754 passengers for the period.

HE Philippines can continue to reinforce the importance of global value chains (GVCs) when the country hosts the AsiaPacific Economic meeting this year, recommends a study released by state think tank Philippine Institute for Development Studies (PIDS). The Policy Note, “Why global value chains and services matter: Implication for APEC 2015,” authored by PIDS Senior Research Fellow, Dr. Ramonette Serafica, depicts the aggregated GVC participation index of countries in the Asia-Pacific Region and demonstrates how GVCs dominate global trade. Serafica also underlines the opportunities in undertaking further analytical work on services GVCs. Global value chains are the sequence of activities around the world involved in the conception, production, distribution, usage, and other activities that add value to a product. Serafica highlights the benefits of GVCs for independent economies and the Asia-Pacific region and measures the extent of involvement of each individual economy through a participation index. The opportunities to increase and optimize GVC participation are plenty for APEC, claims Serafica. The trend for APEC nations is to target GVCs and segments that are congruent with the advantages and development objectives of their individual economies. Depending on the GVC requirements, APEC member countries can design busi-

ness facilitation measures and investment policies to encourage growth. With the right measures, individual economies can help capitalize on these advantages and create new specializations. Still there are risks to consider. GVC benefits are limited by the share of value added in the chain that a country is able to capture. Moreover, there are environmental and socio-cultural effects. And countries that become increasingly embedded in GVCs grow increasingly vulnerable to external shocks. Expanding a country’s share of value added in the services GVC depend largely on the quality of infrastructure and efficient services markets. APEC nations are collaborating to improve the transport sector, business services, telecommunications, and distribution channels. Overall, the challenge is in creating the environment for GVCs to thrive in the Asia-Pacific region. Serafica recommends that as the APEC 2015 host, the Philippines should build on the work already started and expand opportunities by undertaking further analytical work that focuses on the case studies of regional services value chains. There aren’t sufficient studies on the important role of services in GVCs and the potential for the region and the individual economies to benefit from the growth of services value chains, especially where small and medium enter-

prises, which are most engaged in GVCs, can better access them. The policy note recommends that studies be conducted on the following: input-output structure or the activities and segments in a services GVC and the corresponding structure of companies that participate in each activity or segment; geographic scope to understand the country-level positions within the chain; governance structure to understand the power dynamics that affect allocation and flow of resources within a chain; and the institutional framework, to understand the global conditions and policies that affect each stage of the GVC. The Philippines should also encourage the analysis of upgrading strategies undertaken by countries, regions and other economic stakeholders to move to higher-value activities in GVCs so as to increase the benefits captured. “Given the Philippines’ comparative advantage in ‘other business services’ and in ‘computer and information services’, advancing regional cooperation in services value chains can further strengthen our export position in these activities,” notes Serafica. Overall, the input from the recommended studies, research and analysis would help individual countries and the region to improve trade and investment policies, promote global services value chains growth, and ensure that individual economies capture the full benefits.

n February 13, 2015, five bands will clash at the Plaza Maestranza in historic Intramuros for the right to be called 2014 Red Horse Beer Pambansang Muziklaban Champion.

The five finalists—Blood Over Matter, Nobela, Ex Manager, Ikaco, and Through the Waves—will go head to head in the aptly named Pambansang Muziklaban Rakollision concert playoff, following a long line of prestigious champions, including Mayonnaise, A Music Theory, and last year’s champion, Manila Under Fire. This year, the road to rock stardom will be even more special for the aspiring rakistas. Their idol big-name bands Slapshock, Razorback, Wilabaliw, Greyhoundz, and

Kjwan will be mentoring them, helping them morph into rock celebrities. “Our most memorable experience of Pambansang Muziklaban is kung pano namin i-handle ang kaba namin and [yung] nakilala namin ang mga idolo naming banda,” according to Nobela vocalist Jimmy Jin de Guzman. The rest of the members are Mark Chester Crisostomo (guitarist and backing vocals), Von Galdo (bassist) and Rozal Labandia (drummer) in the band that was formed in 2010.

The bands’ Building a Rakista journeys will be chronicled on social media, showing friends and fans their transformations as they get rock style makeovers and sharpen their image, bearing, performance, and—most importantly—their sound. All their efforts will be put to the test at Pambansang Muziklaban Rakollision on February 13, 2015 at Plaza Maestranza, Intramuros, Manila, where the bands will be judged by some of the industry’s movers and shakers, including Ely Buendia. Concertgoers will be on hand to witness the declaration of the 2014 Muziklaban champion; they will also be the first to hear about, and get the chance to score tickets to the biggest rock festival in Southeast Asia in 2015. The concert will also feature performances by the rakista mentors, and rock legends Ely Buendia and Pepe Smith.
