CAGAYAN de Oro City––“The Appeal must fail.” This is the decision rendered by Justice Secretary Leila De Lima in rendering the decision, dismissing the appeal of Cagayan de Oro City Mayor Oscar Moreno, assailing the constitutionality of the Ordinance No. 128602014, entitled “An Ordinance Providing For The 2015 Cagayan de Oro City Revenue Code and For Other Purposes,” passed by the City Council “for lack of merit.”

The Sanggunian Panglungsod of Cagayan de Oro City approved Resolution No. 12860-2014 on October 27, 2014.

“Appelant is assailing the constitutionality of the ordinance allegedly because (1) its enactment and passage violated and contravened the mandatory provisions of public hearing, publication or posting as provided in the Local Government Code and (2) that the ordinance is prejudicial to the public welfare,” De Lima’s decision, rendered on March 18, 2015, read.

De Lima said, on the first issue, Appellant (Moreno) alleges that prior to the enactment of Ordinance No. 12860-2014, the City Council did not conduct a public hearing on the proposed 2015 Revenue Code in the manner specifically provided for under Section 277 of the Local Government Code. Furthermore, the Appellant alleges that the proposed 2015 Revenue Code was not published by the City Council in a newspaper of local circulation for three (3) consecutive days and that its non-publication

is established by the fact that the City Government has not made any request for the release of funds in order to pay for the cost of publication.”

“On the second issue, Appellant alleges (1) that the ordinance which provides for the creation of the City Board of Assessment Appeal is invalid as this has similar functions with the Local Board of Assessment

Appeal and that the change of name of the Local Board of Assessment to City Board of Assessment would create confusion on the proper administrative remedies provided under the Local Government Code; (2) the reduction of tax on quarry, sand and gravel from 10% to 5% is prejudicial to the public welfare and repugnant to the Constitutional policy of the State to protect and

advance the right of people to a balanced and healthful ecology; (3) that the imposition of amusement tax on admission fees based on the gross sales contravenes the Local Government Code; (4) that 2.5% tax rate on electric pole or power is a pure disservice to the interest of the general public; and (5) that the creation of the City Business Tax Mediation Board is contrary to the Local Government Code,” the decision says.

To all the above, De Lima ruled that the “appeal must fail.”

While De Lima said that Moreno is right in contending that the proposed ordinance must be published or posted and that public hearings are required to be conducted prior to enactment of an ordinance imposing taxes, however, De Lima said, “it is worthy to note that Apellee (City Council) has submitted evidence, including but not

limited to notices of meeting, minutes of meeting, and position papers of several concerned or interested parties/entities, to prove that series of public hearings were indeed conducted before the said ordinance was adopted.

Also, contrary to Moreno’s claim that the proposed ordinance was neither published nor posted, certifications of posting were submitted to the Department of Justice to prove that copies of the proposed 2015 Revenue Code were posted in six conspicuous public places, namely: barangays Bulua, Puntod, 33, Puerto, Legislative Building of City Hall and Hall of Justice.

“Therefore, it bears to stress that all the procedural requirements for the enactment of tax ordinances as specified in the Local Government Code have indeed been observed in the instant case,” De Lima’s decision read.

I couldn’t hold my tears when German Wings victims have been remembered in solemn Cologne service.

Cathedral bells have marked the end of a somber memorial service held in the western German city of Cologne to pay tribute to the 150 people killed in last month’s German Wings plane crash.

The ceremony was at Cologne Cathedral, one of the biggest German cathedrals and many times my hidden place of prayers, for the victims of the German Wings crash ended just like it began, with the cathedral’s bells ringing out across the city on this sunny Friday afternoon, and a choir singing.

Hundreds of mourners attended the national memorial service in Cologne’s landmark cathedral on Friday, including German President Joachim Gauck and Chancellor Angela Merkel.

Gauck, the main speaker, told the service the nation was still in “enormous shock” over the tragedy of flight 4U 9525, which crashed into the French Alps on March 24, killing all 150 people on board.

If it is the responsibility of the NCIP to protect and promote the indigenous peoples’ rights it should be more responsible and fair in issuing ancestral domain titles, permits, and leases or grants for use of any portion of an ancestral domain.

Section 12 of IPRA states in part that individual members of

cultural communities, with respect to their individually-owned ancestral lands who, by themselves or through their predecessors-ininterest, have been in continuous possession and occupation of the same in the concept of owner since time immemorial or for a period of not less than 30 years immediately preceding the approval of RA 8371 and uncontested by the members of the same ICCs/IPs shall have the option to secure title to their ancestral lands under the provisions of Commonwealth Act 141, as amended, or the Land Registration Act 496.

Section 12, IPRA, dealing with the option

to secure certificate of title under Commonwealth Act 141, as amended, or the Land Registration Act of individually owned ancestral lands, has not been implemented ever since the law came to effect for lack of information dissemination when it is expressly stated that such option is set to expire after twenty years from the approval of said Act. The inquiry could help formulate and introduce legislation that would provide ample protection and remedies to the Indigenous Peoples.

In his address to the congregation, President Gauck offered his thanks to the French people for their role in leading the rescue operation at the crash site in the south of their country.

“For this touching sign of friendship between our countries we are all most deeply grateful,” the president, whose role is largely ceremonial, said.

French cabinet minister Alain Vidalies and Spanish Interior Minister Jorge Fernandez Diaz were also present at the service.

Deutsche Welle reporter Kate Brady was in Cologne, observing the proceedings on a big screen set up outside the cathedral. The service was also broadcast live on national German television.

Across Germany, flags flew at half-mast, while buses and trains in Cologne stood still for a minute of

silence as the cathedral service got underway. Inside the famous gothic structure, known in German as the “Kölner Dom,” a choir sang hymns, while small wooden angels were put in the pews.

The steps to the altar were covered with 150 candles - one for each person who died in the crash, including co-pilot Andreas Lubitz.

Referring to the decision to include a candle for Lubitz, Cardinal Woelki told Germany’s “Bild” newspaper: “It’s not for us to judge.”

President Gauck also asked the congregation to remember the co-pilot’s family. “On March 24 his relatives lost someone whom they loved and who leaves behind a hole in their lives - in a way that they find just as difficult to make sense of as all the other bereaved.”

BUTUAN City--Provincial Governor Ma. Angelica Rosedell “Angel” M. Amante-Matba ensured that Barangay Del Pilar of Cabadbaran City in the province of Agusan del Norte will receive the amount of P3,000,000 as funding support for the

construction of its Multipurpose Hall cum Evacuation Center.

This is a funding counterpart of the provincial government for the said project charged to the five percent Provincial Disaster Risk Reduction and Management Fund (PDRRMF)

CY 2014.

The proposed Multipurpose Hall cum Evacuation Center of Barangay Del Pilar is envisioned to serve as housing or evacuation facility during calamities and disasters, which is part of the emergency mitigating measures to save lives and

properties during occurrence of said events.

The project is in line with the disaster risk reduction management programs of the province to cater to the needs of the constituents during difficult times.

32,000 jobs up for grabs Labor Day Zambo jobs fair

ZAMBOANGA City––The Department of Labor and Employment (DOLE) announced that more than 32,000 job vacancies are up for grabs in the Labor Day Jobs Fair in this city.

The result is that they fail to appreciate and much more, learn reading.

Parents are partners in making Summer Reading Camp effective, for they are the ones who will continue to teach their children towards a reading-ready students.

It is important for parents

and teachers to understand the source of reading problem of each child in order for it to be addressed. The child might not recognize start or end sounds. Many children know their letter sounds, but cannot recognize these sounds when trying to sound out words. He cannot spell the word. While there are a number of spelling rules, conventions and exceptions that take time to learn, spelling in the early grades is only a concern if regular, phonetic words are misspelled. Spelling is a key decoding skill.

Parents and teachers, and activities that apply importance to reading skills such as this Summer Reading Camp play big role for a child to overcome difficulties in reading.

Computer Technology: Tool for K to 12 curriculum

K to 12 Basic Education is the new system of education in the Philippines, seen as an efficient strategy to elevate the economic status of the country through enhancing the skills and capabilities of its manpower.

In K to 12, some parts of the curriculum are modernized in ways that could parallel the kind of lifestyle this generation already has. For example is the Senior High School program where tracks or specializations are created in order to produce graduates that could be a great and good help for

a specific community.

Along with this elevation, there is also a need to level up the controlling system, especially when it comes to monitoring the implementation of K to 12 Basic Education Program.

Computers and Internet access are becoming increasingly frequent tools and resources. Teachers and other education personnel could do discussions and review of the K to 12 implementation through published documents online and other sources. This show the range of uses, suggest as the best practices with

respect to computer technology.

The positive things are coming to be recognized with respect to computer technology and its use in K to 12. Some of these practices are planning, staff development, curriculum integration, use of library media centers, and professional communications, among others.

Some other practices, such as creation of school websites so that K to 12 will be more understood and appreciated.

It is a fact that computer technology has already established a good use in society, especially in the field of information and education.

ONCE upon a time, the year was 2007. At the height of the fiesta season, I usually went to the Miss Kagay-an activities and got acquainted with a few of the candidates. One of them eventually became first runner-up, Dianne Galenzoga. Fast forward to 2008 when a gal named Joanne Galenzoga entered the Miss Kagay-an tilt that year. She eventually inherited the first runner-up crown from her big sister.

There are concerns that the criminal proceedings might derail the ongoing peace process between the government and rebel group especially the crafting of the Bangsamoro Basic Law (BBL), which is already in Congress.

“It should be separate, really, because the peace process is proceeding on its own track. It really should be a separate discussion,” Deputy presidential spokesperson Abigail Valte said in a radio interview on Saturday.

Valte said the Palace does not believe the MILF is using the peace talks to evade criminal prosecution regarding the Mamasapano incident.

Asked to comment if the Palace remains confident that the peace process could be finished in a timely manner despite what happened in Mamasapano, she said that although there are challenges, the administration remains optimistic.

“There have been challenges,” Valte told dzRB Radyo ng Bayan. “We have faced challenges in the past when it comes to the peace process and, you know, we remain optimistic that the discussion remains on the table and that it will be given attention by our legislators.”

“So hopefully, the discussions will push forward on the Bangsamoro Basic Law.” Commenting on the possible resurgence of violence if the BBL is not passed on time, Valte said the primary goal of the government is to address the root causes of Muslim separatism.

The administration believes that there will always be conflicts if issues such as poverty, health care, social welfare and other concerns are not addressed, she noted.

“Nobody wants that situation to happen. We want, at the soonest possible time, to be able to reach these people and to allow development in these areas,” she said.

Although the public remains emotional and many are rejecting the creation of a Bangsamoro entity because of the incident in Mamasapano, the Palace will continue explaining about the need to pass the Bangsamoro Basic Law to achieve a lasting peace in Mindanao, she added.

She noted the claim of the MILF about the possible liability of PO2 Christoper Lalan for the killing of civilians but “we made several requests to the MILF to allow us access to possible witnesses and families pero wala pa po silang response,” De Lima said.

Killing of civilians The MILF’s Special Investigative Commission (SIC) Report on the Mamasapano Incident said Lalan “killed the four MILF men when they were asleep inside the langgal who were in no position to defend themselves.”

“He should likewise be held accountable for killing Mohammad Ambilang, a civilian who has clearly shown no aggression as he in fact raised his hands and made known that he is a civilian. The injury sustained

by Ambilang in the back indicated that the killing was attended by qualifying circumstances that aggravated the actions of PO2 Lalan,” the report added.

It also said the PNP-SAF must be held accountable “for the death of Badruddin Langalen whose dead body was found inside the position of the 55SAC blocking force in Sitio Amilil” and the same accountability be sought for the killing of 8-year-old Sarah Tot. “We will pursue further investigation for the killing of the nine from the 84th SAC and also the killing of the civilians and possibly the MILF’s own casualties,” De Lima said, adding these are not included in the report “simply because wala pa kaming na-access (we haven’t gained access)” to third party eyewitnesses.

De Lima said the DOJ report is based on evidences found, eyewitnesses’ accounts and from the reports of the different bodies that investigated the Mamasapano tragedy: the PNP’s Board of Inquiry, the Senate House Committee on Public Order and Safety, the MILF’s Special Investigative Commission and the International Monitoring Team in the GPH-MILF peace process.

She said the previous reports are full of details but no eyewitnesses, “not even the survivor Lalan could identify” who killed his comrades.

GINGOOG City, Misamis Oriental--Mayor Marie Guingona on Monday ordered the local police to put up checkpoints here as a preemptive measure to check the rising criminality in the city.

I

N retrospect, Alfredo Yao can be considered a world pioneer.

He introduced to consumers worldwide the steri-pack system, a world’s first that allows the beverage to be enjoyed hot or cold while preserving its fitness. He also introduced an iced tea line that has five times more antioxidants than green tea. But who is Alfredo Yao? To understand better, let’s learn first about Zest-O Corporation.

As Zest-O Corporation celebrates 35 years in the industry, the Filipino homegrown company is set to conquer the North American market by acquiring a factory in Texas last March, paving the way for the mass production of Zest-O tropical juice drinks in the United States.

The company’s

growth through the decades started in 1979 when biscuit wrappers manufacturer Alfredo Yao toured Europe and was inspired with how a juice drink there was packaged using Doypack which has more aesthetical advantages than conventional packaging at the time.

Mr. Yao decided to replicate the same back in the Philippines and approached various local juice manufacturers. Yet everybody turned him down. But instead of being discouraged, Mr. Yao decided to use the technology to his advantage and tried a new venture. Soon, SEMEXCO Marketing Corporation was born.

The following year, Zest-O juice drink was launched and pretty soon, it became a big hit in the country, eventually capturing

80 percent of the market for ready-tojuice drinks. Soon, other flavors were introduced to the market such as orange, mango, grape, pineapple, strawberry, guyabano, apple, calamansi, mangoorange, mangocalamansi and mangolime flavors.

In 1983, another ready-to-drink fruit drink, Sun-Glo, was introduced to the Philippine market.

Variants of Sun-Glo juice drink available to Zest-O’s market today include orange, mango, grape, guava, lychee and peach flavors.

In 1988, acquisition of the Marilao plant enabled the now named Zest-O Corporation to process tropical fruits into purees. These high grade tropical fruit purees were meant for use as confectionery for baking, ice cream making and other similar purposes. It was both manufactured for local and international markets. This was also the time when Zest-O was venturing into food sauces and condiments manufacturing, offering Tita Frita tomato and banana catsups and Tita Frita hot sauce.

A year later, the company introduced Beam Toothpaste together with two foreign brands it was marketing/ distributing. It is the company’s answer to the numerous foreign brand toothpaste proliferating in the market. Although price-wise, Beam is 40 percent lower, the toothpaste is considered equal with any leading brands, thanks to its active fluoride system that gives teeth full protection and fresher breath.

In April 1990, the company launched Zest-O Iced tea in ready-to-drink Doypack and powdered mix form. Both are delightful tea drinks made even zestier by its delightful tinge of lemon flavoring. By August of the same year, another successful product was born when Quickchow Instant Mami was

introduced in the market. Already the number one brand in Visayas and Mindanao, Quickchow is able to capture the taste every Filipino is looking for instant noodles.

Patterned after the popular mami recipe, the noodles is available in chicken, beef, pork, hot and spicy chicken and beef flavors.

In 1994, Zest-O Corporation was able to enter the Chinese market by forming Huadong Zest-O Beverage Co. Ltd. Zest-O Cola was also introduced at this year. New varieties were introduced later on including Zest-O Rootbeer and Diet Rootbeer and Squiz Orange softdrinks.

In 1995, Zest-O entered the dairy market as it introduced Milk-O (ready-to-drink full cream milk) and Choc-O (chocolate milk drink). The product was packed using the steri-pack system, a world’s first that allows the beverage to be enjoyed hot or cold while preserving its freshness. By 1998, Zest-O introduced its latest canned carbonated beverage product – the Twist Lemon Lime softdrink.

In 2000, the company marks its 20th year in the industry with two new softdrinks innovations – the two-liter, nonreturnable bottle was introduced early that year. Another big news is the introduction of a whole new product category, the Zest-O Calamansi Soda. This healthy and refreshing product is the first of its kind and is currently carving its own niche in the softdrink business.

In 2005, the rising popularity of bottled iced tea paved the way for the new birth of Zest-O’s own line of products, One Iced Tea. By 2006, one of the latest products introduced are the Orchard Fresh juice drinks. October saw the launch of its four flavors – Dalandan, Mango, Orange and Calamansi. The brand later introduced three other variants in 2007 where it pioneered the first local Fruit and

Vegetable blend in PET bottle juices (fruitveggie blend). Also at this year, realizing the need to break against the iced tea clutter, One Iced Tea relaunched its White tea line and highlighted its unique superiority story over competition (5x more antioxidants than green tea).

In 2008, after months of research and product developments, the brand team decided to relaunch its Tekki Yakiudon brand via a revitalized marketing campaign and product format featuring flavors such as Chili Crab, Garlic Chicken and Beef BBQ. In 2010, the company ventured with PT Kalbe Farma Tbk of Indonesia into the manufacture of a new line of energy drinks. Extra Joss was born. For now, the Indonesian venture is exporting Extra Joss to New Zealand but has expressed plans to expand into mainland China, Vietnam and Western Africa.

Then in March this year, Mr. Yao, also concurrent chairman of the Philippine Chamber of Commerce and Industry, made a surprise announcement – the acquisition of a factory in Texas. With this, the firm will initially produce tropical

juices like mango, dalandan, guyabano and pineapple and then expand the product line to include traditional Western flavors like orange, apple and grape. This is also in line with the company’s vision to compete globally in the next ten years.

At present, Zest-O Corporation has five major plants all over the Philippines to reach the high demand of its products. These plants are located in Novaliches, Marilao, Canlubang, Mandaue City and El Salvador City, Misamis Oriental.

It also has 13 branches nationwide which handle distribution to different areas of the archipelago. To date, the company also exports mango purees to China, Australia, New Zealand, South Korea, Singapore, the United States and Europe. Looking back, it started with 20 employees in a small corner of a compound. Now, Zest-O is considered a phenomenon and part of the Filipino trademark.

Mr. Yao also owns hotels and resorts in Boracay, Palawan and Bohol, a minority stake in AirAsia Zest and the publicly-listed Philippine Business Bank. All that because of Doypack.
