CAGAYAN de Oro City–– The City Council would tackle allegation of “abuses” by traffic aides toward the sidewalk vendors in the city’s public markets here, a City Councilor said here.

City Councilor Alexander Dacer said that the city council Committee on economic enterprise would conduct a probe into

the complaints of sidewalk vendors against traffic aides assigned in the city’s public market in Cogon here.

Dacer said that the vendors have complained that the traffic aides seized their wares and carts while plying along the market sidewalks.

Duterte tops Aksyon Radyo, DWIZ presidential pick surveys

D

avao City Mayor Rodrigo Duterte continues to dominate the surveys for the 2016 presidential derby conducted by at least two radio stations last week.

In a radio survey thru SMS (short messaging system) conducted by Aksyon Radyo 5 at 92.3 FM station last May 19, the tough talking Davao City mayor was very much ahead of his potential opponents in the presidential race.

The radio station program received a total of 1,444 SMS based on the question “Sino ang napupusuan nyo na susunod na maging pangulo ng bansa,” (Who would you like to be the next President of the Philippines).

And out of the 1,444 votes, Duterte garnered the highest score with 728 votes, surprising the two Aksyon Radyo 5 anchors of the result of their own poll that saw the Davao mayor as the runaway winner.

The popular Senator Grace Poe, who is one of

the front runners in the next year’s poll, was afar 2nd with 256 votes while the scandal-ridden VicePresident Jejomar Binay, who always emerged as number one in recent surveys, was at 3rd place with 204 votes.

The other possible presidential contenders who were chosen by texters in the Aksyon Radyo 5 poll survey were Senator Bongbong Marcos with 74 votes; former Sen Panfilo Lacson - 59; Sen Miriam Defensor Santiago -32; Interior and Local Government Secretary Mar Roxas – 28; Manila Mayor Joseph Estrada- 18; Sen. Allan Peter Cayetano – 13; Sen Francis “Chiz” Escudero- 12; Sen Antonio Trillanes IV - 9 votes; former Sen Manny Villar – 6; former Defense Secretary Gilbert “Gibo” Teodoro – 3, and Brother

Eddie Villanueva, 2 votes.

In another survey conducted by DWIZ 882 last March 25, Duterte again emerged as the winner with 29 percent of the votes followed by Grace Poe with 18 percent.

The DWIZ sur vey of presidentiables was part of the “Boses ni Juan 2016 Survey” wherein the question asked was: "Kung Ngayon ang Eleksyon, Sino ang iboboto Mo?" The results were based on the survey conducted by DWIZ in Manila, Legaspi, Naga, Cebu, Iloilo, General Santos, Davao, Cagayan De Oro and Palawan.

Duterte’s big lead over

his possible rivals came as a surprise considering that he has not yet confirmed of his intention to run for the presidency in next year’s general elections.

Duterte has been on his “Listening Tour” in the last two and half-months, espousing for the adoption of Federalism which he said is the lasting solution to many ills afflicting our country.

He reiterated that under Federal system of government, patterned after the US

style of government system, the President of the Republic will be directly elected by the people and he will still be the head of state and head of government.

Duterte had said he wants a Constitutional Convention to decide whether the Filipino people would like a shift from a highly centralized government to a Federal Parliamentary system.

He also believes that rising criminality requires drastic solutions.

DAVAO City – Four army soldiers were wounded in fierce clashes with communist rebels in the southern Philippine province of Davao Oriental, officials said on Wednesday.

Capt. Alberto Caber, a spokesman for the Eastern Mindanao Command, said the fighting erupted in the village called Aragon in Cateel town on Tuesday after patrolling soldiers crossed path with New People’s Army rebels.

He said troops from the 67th Infantry Battalion recovered two improvised bombs and three automatic rifles, including more than a dozen backpacks, left

behind by fleeing rebels.

He said an undetermined number of rebels were believed killed or wounded in the fighting.

“Four soldiers were wounded while a still undetermined number of gunmen were also slain or injured in the clash. Pursuit operations are still on-going,” Caber told the regional newspaper Mindanao Examiner.

Caber said military operations continued on Wednesday against the rebels, but there were no reports of fresh clashes.

There was no immediate statement from the NPA which is fighting for the establishment of a Maoist state in the country.

Just recently, a rebel spokesman, Rigoberto Sanchez said NPA fighters killed a policeman and three army soldiers in separate attacks also in Davao Oriental.

He said members of the 3rd and 8th Pulang Bagani Companies carried out two raids that targeted the 67th Infantry Battalion and the 3rd Platoon Public Safety Company of the Philippine National Police in Taragona and Baganga towns.

He said rebel forces seized two M203 rifles, four M16 automatic rifles, two M14 rifles and four automatic pistol and several military packs, including two cell phones. The attacks, Sanchez said, were part of a continuing offensive against the police and military, and Gov. Corazon Malanyaon, who is a strong military supporter.

“The two ambushes are glaring testament to the superiority of guerrilla warfare amid intensive enemy offensives in the region.

The NPA attacks are conspicuous actions that further debunk the military and Gov. Malanyaon’s claim that Davao Oriental has already rid of the NPA,” he said.

Unconstitutional?

There is only one institution clothed by the Constitution with the power to declare a law unconstitutional and that is the Supreme Court not Miriam Defensor Santiago, the senator who prides herself as a constitutional expert.

It is for these reasons, the Constitutional mandate and Santiago’s supposed expertise in constitutional law that left me baffled by her move as chair of the Senate committee on constitutional amendments to have the Bangsamoro Basic Law declared by them as unconstitutional.

The role of the Senate in this process is to formulate that law as proposed by Malacanang. They either vote for it, amend it or reject it. It is beyond the Senate’s legislative power, as I understand the constitutional precepts, to have a proposed law declared by them as unconstitutional. In effect, this seems to be Santiago’s direction.

Let us all remember that the BBL at this point is still a proposed law thus still not justiciable, meaning, it could still not be subject to judicial review. If Santiago believes the proposed law should not be passed, then she should work hard to derail its passage.

In the event it is passed

by Congress and signed into law by President Aquino, then it is the only time the law can be subjected to judicial scrutiny to determine its constitutionality or the lack of it.

If those opposed to the proposed law’s passage have better things in mind, then they should propose amendments to the proposed law while it is still in that stage of the legislative process.

Undermining the proposed piece of legislation instead of enhancing it to improve it is not the right thing or the best thing to do, to say the least.

I have an issue against the process by which the Aquino administration reached this stage of its effort in fostering peace in Mindanao. It is its position, or seeming position, to have peace in Mindanao based on the religious affiliation of our brothers and sisters there that makes me uncomfortable about this peace process.

Religion, we all know, divides. But our Muslim brothers and sisters in Mindanao are first and foremost Filipinos like you and me and this should unite us as one nation. But the peace negotiators of the Aquino administration allowed the

-oooRP SAME SEX MARRIAGES NEED CHARTER CHANGE: Putting issues of spirituality aside, the petition filed by a gay lawyer with the Supreme Court basically asking for a repeal of the Family Code provision which allows marriages only between opposite sexes, to enable persons of the same sexes to marry here, ignores the Constitutional guarantee that the “State recognizes the sanctity of family life…”

Now, what does “family life” mean? It means, according to the Family Code of the Philippines,

the “permanent union between a man and a woman entered into in accordance with law (for conjugal relationships)…” According to www.yourdictionary.com, a conjugal relationship means sexual relations between a man and a woman.

Surely, the hands of the Supreme Court are tied on the matter by the foregoing provisions of the Constitution and of the Family Code.

What is clearly needed here is not a simple decision from the highest court of the land so same-sex marriages can be allowed here, nor a new law being passed by Congress. An amendment of the Constitution is necessary.

peace talks to zero in on the divisive issue of religion by even letting other Muslim countries mediate, serve as go between in the peace negotiations.

This is my only issue with the whole process. But this issue is subordinate to the intention of having peace in Mindanao. Peace is the imperative over anything else hence my support for the passage of the BBL. But if legislators like Santiago could propose amendments to the proposed law to make it relevant and responsive to the needs it proposes to address, then let them do it. It would be welcome.

It is when legislators legislate not from the point of view of those affected by such legislation that the process becomes out of touch, if not irrelevant. In this particular case, the legislators should look at the ramifications of the BBL on those who’ll eventually be affected by it. These are our brother and sister Filipinos made to suffer because of the decades-old armed conflict there.

Is the conflict caused by the fact that some of our brother and sister Filipinos in Mindanao embraced the Muslim religion? I don’t think so. The Muslim and non-Muslims in Mindanao have co-existed as Filipinos for centuries now. The problem in Mindanao is still economic. There is so much poverty in the island.

In fact, a good number of provinces in the government’s list of poor provinces

are found in Mindanao.

What does this fact tell us? It tells us that people in Mindanao are in suffering and misery because of economic deprivation. This deprivation takes in many forms.

They are deprived of opportunities by the political lords there who’d rather see the poverty in the island perpetuated to reinforce the logic of domination. Indeed it is easier to dominate an economically challenged populace than the one that is economically full and abundant. If patronage politics in Mindanao has become a way of life there, credit this to the success of the island’s political lords to make poverty the rule rather than the exception.

What can’t be denied is the fact that the national government has done a lot in pouring scarce government resources to pump prime Mindanao’s economy. Yes it is also true that while the government has done its best to bail out Mindanao from economic rot, its best has been proved time and again not enough.

But while it is admittedly not enough, the corruption attending the disbursements of these funds aggravated the situation because a large chunk of it were not used as intended and just went to the pockets of these political lords in Mindanao.

(Northern Mindanao, PHILIPPINES)- This year marks the third season of the annual Body Painting Competition spare-headed by Easy Rock 96.9 FM Station in partnership with the leading Resort Hotel in Metro Cagayan de Oro, Apple Tree Resort and Hotel (ATRH).

Last May 24, 2015 (Sunday), became the most impressive annual event of the Body Painting Competition in its history as 6 renowned artists with their own models from different places in Northern Mindanao compete with the Brush, Sponge and Roller Category. This year’s theme adapts well into the realm of the ocean as the body painters created their exceptional makebelieve body art visions on the models as the “living canvases”. The models were painted with white paint before the beginning of the competition as artist-afterartist crafted their finest 2-hour given creations on the theme: “Under The Sea”.

Accordingly, the event was created to take a strong presence on the promotion of body painting as a form of fine art particularly in Northern Mindanao. It prides itself to discover the interactive art of the body painting which draws the best body painting artists and models in the region.

“Body Painting is not simply painting a body. Body painting is to conceptualize the living canvas into an entire scenery, to fabricate a body setting with the painters’ imaginative vision.”- Ms Tonette Lajos, Easy Rock event Project Head explained.

“We also added FREE Henna Tattoo by Mr Zaldy Yasar, a local Tattoo artist and FREE Zumba by the Beach with Mr Boyet Maandig and his Zumba ladies to spice the event.” she added.

With a strong field of the competition between the artists unique and creative vision, whose bodies of their models have all been meticulously painted with awe fashion amalgamated with fantastic headwears, false fingernails, fashion lenses, and eyelashes and polishing it with the Midas touch, the living art never looked so divine!

The criteria for artist are as follows: Creativity= 40%, Originality= 40%, Color Scheme= 20% while the Criteria for best model for male and female categories are: Portrayal of Role= 40%, Grace of Movement= 40%, Audience Appeal= 20%, a total of 100% each category.

Mr Lloyd Hinosolango, Portrait and Digital Graphic Artist who worked in the Middle East, and Mr Michael Bacol, a Visual Artist who is currently the President of the Cagayan de Oro Arts Guild, New York City’s Grant Recipient of Asian Cultural Council and Artist residency in both New York and San Francisco who had exhibits in the Cultural Center of the Philippines, Philippine Center- New York, National Museum of Singapore and National Museum of the Philippines were among the three judges of the said competition. Sirawai fishermen to benefit from DTI launches DOLE’s “Kabuhayan Program” “Negosyo Center”

DIPOLO G City – A group of marginal fishermen from Sirawai town will soon have a fishing boat complete with accessories after the Sangguniang Panlalawigan of Zamboanga del Norte has passed a resolution authorizing Governor Roberto Y. Uy to enter into a Memorandum of Ag re ement (MOA) with the Department of Labor and Employment (DOLE)-9

through Regional Director Sisinio Cano for the implementation of the agency’s “Kabuhayan Program.”

Governor Uy earlier sought the Sangguniang Panlalawigan’s authority to sign a MOA with DOLE-9 as a requirement for the granting of a “Kabuhayan” project to a group of poor fishermen in Sirawai municipality, some 300 kilometers south of this city.

As DOLE’s Integrated Livelihood Program (DILP), the “Ka-

buhayan” project seeks to help existing livelihood transform into viable and sustainable business or community enterprise by maximizing the community resources and skills.

Sirawai is a coastal town where fishing and farming are the main occupations of the locals. Its major religion is Islam and a large number of its residents belong to the Kalibugan tribe. It is a fourth class municipality. (FPG/PIA9)

NDRRMC to hold contingency planning workshop in Zamboanga City

ZAMBOANGA City – The National Risk Reduction and Management Council (NDDRMC) is slated to conduct a three-day contingency planning workshop here on June 9-11, as part of the city government’s readiness pro-

gram against all forms of disasters and calamities.

The participants to this training include the barangay officials, City Disaster Risk Reduction Management Office (CDRRMO) and other key offices of the city government, Task Force Zamboanga, Philippine National Police (PNP),

the Western Mindanao Command, Department of Health (DOH), schools, hospitals and other stakeholders.

“If there’s anything that will happen again, we better prepare. This way, we would be able to cope up with any emergencies,” said Dr. Elmeir Apolinario, assistant city administrator and head of CDRRMO. Apolinario emphasized that preparedness initiatives of the city in worst case sce-

narios and human induced violence will be highlighted in the seminar-workshop.

NDRRMC Executive Director Undersecretary Alexander Pama, a former Navy chief, will join the workshop.

That petitioners are husband and wife respectively in a marriage performed under Civil rites on December 8, 2008 at Iligan City, they converted to Islam faith, of which conversions to Islam were duly registered with this court, both of them can be served with summons and other legal processes relative to this case at their residents at Hinaplanon, Iligan City and Brgy., Sto. Nino, Tugbok District, Davao City respectively;

That said marriage did not last long due to lack of love and affection until the relationship manifested incompatibility and sustained misunderstanding between petitioners and reached the point of irreconcilability and they separated for more than four (4) years already, they decided to separate live physically in bed and board, thereby, executed Memorandum of Agreement in order to formalized their separation.

Since their separation, they had never been communicating or supporting either financially or emotionally to each other, neither minding each other,neither minding each other affair’s; Petitioner’s seek judicial decree of divorce, thereby, severing their marriage bond on December 8, 2008, so that they will have free hand to do what a single man or woman could do without marital burdens. Reconciliation between them had already been diligently employed but all proved futile.

WHEREFORE, finding this petition to be sufficient in form and substance, set the initial hearing of this case on June 26, 2015 at 9:00 a.m at which time, date and place. Any interested party may appear and show why the petition should not be granted. Let copy of this Order be published in a news paper of General Circulation in the City of Iligan once a week for three (3) consecutive weeks at the expense of the petitioners.

PAGADIAN City – In keeping with Republic Act 10644, other wise known as “Go Negosyo Act”, the Department of Trade and Industry (DTI)-Zamboanga del Sur Provincial Office has led on Monday the launching and blessing of the Negosyo Center at the DTI provincial office compound, Capitol Site this city.

DTI-9 Regional Director Sitti Amina Jain lauded Provincial Director Maria Socorro Malate-Atay and her staff for establising the said center, making Zamboanga del Sur the first province in Zamboanga Peninsula to comply with RA 10644.

The establishment of “Negosyo Center” in all provinces is one of the salient features of the Go Negosyo Act. Jain said this Negosyo Center would serve as the nerve center for our assistance for the Micro, Small and Medium En-

terprises (MSMEs) in the province.

“In here, aside from business name registration, all technical assistance in the form of entrepreneurship development, product development, marketting, coaching, product design, exhibit, consultancies, handholding, mentoring the entrepreneurs will happen in this Negosyo Center,” Jain explained, as she urged all MSME’s in the province to make use of the center.

Four more Negosyo Centers will be established in the region this year, one in Zamboanga Sibugay on May 29; in Zamboanga del Norte by next month and in the cities of Zamboanga and Isabela by July, Jain said.

Go Negosyo Act was signed into law by President Benigno Aquino III on July 15, 2014 and it seeks to strengthen micro, small and medium enterprises (MSMEs) to create more job opportunities in the country.

Since their separation, they had never been communicating or supporting either financially or emotionally to each other, neither minding each other,neither minding each other affair’s; Petitioner’s seek judicial decree of divorce, thereby, severing their marriage bond on June 12, 1999, so that they will have free hand to do what a single man or woman could do without marital burdens. Reconciliation between them had already been diligently employed but all proved futile.

WHEREFORE, finding this petition to be sufficient in form and substance, set the initial hearing of this case on June 26, 2015 at 9:00 a.m at which time, date and place. CAGAYAN de Oro City--Police authorities are still tracking down the suspects who shot dead a businessman inside his shop along Pabayo Street on Thursday afternoon.

Chief Insp. Ariel Pontillas of the Cagayan de Oro Police Office (Cocpo) said a lone gunman shot dead 33-year-old Rolando Bonghanoy around 3:40 p.m. inside his store in Pabayo Street.

MISAMIS Oriental––The provincial board in Misamis Oriental has passed a resolution opposing the privatization of the Agus-Pulangi Hydropower complex in Bukidnon.

Provincial Vice Governor Joey Pelaez said that the provincial board passed the resolution during the board’s regular session Monday afternoon.

Pelaez said that the provincial board has joined the concern of various nongovernment organizations (NGOs) that expressed the concern that the privatization of Mindanao’s major source of energy would be inimical to the interest of the consuming public.

“We cannot allow the privatization of the AgusPulangi Hydropower complex, the crowning glory of Mindanao as a major source of energy that generates as much as 982 megawatts,” Pelaez said.

Republic Act No. 9136 carried two provisions, namely, the restructuring of the electricity supply industry and the privatization of the National Power Corporation (NPC).

Pelaez said that the privatization of the National Power Corporation (NPC) involves the sale of

the state-owned power firm’s generation and transmission assets (e.g., power plants and transmission facilities) to private investors.

The EPIRA law also that the sale of the Agus-Pulangi Hydropower complex plants under the privatization scheme would take place 10 years after the signing of R.A. 9136 into law.

Pelaez said that the people of Mindanao should oppose and resist the privatization of the Agus-Pulangi Hydropower complex for fear that the government would no longer be able to contain the cost of energy in the future.

One instance is the filing of charges against a convicted drug lord, Ruben Tiu, and a jail guard, Ahrbe Duron, who were caught peddling P1-million worth of shabu (mathamphetamine) outside the Sablayan penal colony in Barangay Yapang, Mindoro Occidental late April this year.

NBI Director Virgilio Mendez revealed Tiu even “offered their operatives huge amounts of bribes for him to be immediately returned to the penal colony and avoid any reports of the drug transaction, but was turned down by the operatives.”

Duron is now charged with violating Section 26 in relation to Section 5 (Conspiracy to Sell Dangerous Drugs) of RA 9165 and Article 223 (Conniving and Consenting to evasion) of the Revised Penal Code.

Tiu, who confessed that he received his supply of shabu from the New Bilibid Prison, is again charged with violating Section 5 (Sale of Dangerous Drugs) of RA 9165.

Also recently, the NBI discovered a new type of illegal drug during its raid in Mandaluyong City. The new drug was identified as Gamma-Hydroxylbutyric acid (GHB), a liquid type of ecstasy and considered a club drug or a “date rape” drug.

Atty. Tovera said it was the first time that the NBI recovered GHB during its buy-bust operations. “The GHB is usually given to unsuspecting victims prior to sexual assaults because the drug may induce amnesia to its victims who are usually high school and college students,” he added.

On the issue of de-clogging courts’ dockets, under HB 5793, “the Supreme Court shall insure the submission of an Executive Summary Report to Congress outlining the strict compliance of Dangerous Drugs Courts in de-clogging these drug cases in their court’s dockets up to the point when it would have already reduced it from 70% to more manageable and rational level like 205 if

not towards a desired zero backlog, whenever possible.”

Furthermore, the Supreme Court “shall be within its authority to create an ‘Inter-Agency Council’ from between and amongst the five pillars of the criminal justice system in order to effectively streamline and operationalize the provisions set forth under the proposed Act.” “Public trust is regained where the community can rest assured that the government is doing its best to rid the society of one of its worst plagues,” Castelo concluded.
