Briefly Burial protocols THE burial of the patient who died due to Covid-19 followed Islamic traditions as well as protocols set by the health authorities, the local government assured on Sunday.

Following the Department of Health protocols, the body of Patient 40 (PH40) was disinfected and placed in multiple airtight, leak-proof sealed cadaver bags to prevent contamination.

he Filipino Chinese Community of Cagayan de Oro is mobilizing much needed medical supplies to assist two government hospitals at the front line of the fight against the COVID-19 coronavirus.

“We will be donating P1million worth of medical supplies requested by the Northern Mindanao Medical

Center on Monday, March 23, 2020, to assist them in coping with the influx of persons under investigations (PUI)

BARMM education exec orders early release of teachers' salaries

OTABATO City – The Ministry of Basic Higher and Technical Education– Bangsamoro Autonomous Region in Muslim Mindanao (MBHTEBARMM) has issued an order to fast-track the early release of salaries for all teaching personnel in the region for this month.

The MBHTEBARMM directive came after President Rodrigo Duterte’s issuance of Presidential Proclamation 922 placing the entire country under a state of public health emergency

amid threat of the coronavirus disease 2019 (Covid-19).

"We made this move to ensure that our employees can act accordingly and finance their necessities in this time of pandemic condition," MBHTE Minister Mohagher Iqbal said in an interview Thursday.

The MBHTE is the largest ministry in the BARMM, covering 60 percent of the workforce in the entire region. It has over 20,000 teaching personnel under its supervision.

"Therefore, it is our

responsibility to aid them as much as we could extend in this kind of situation," Iqbal said.

The salary release will also cover the contract of service and casual employees of the ministry.

On top of this, the ministry has also requested the salary differentials for their employees to the Department of Budget and Management (DBM) through the region’s Ministry of Finance and Budget Management.

“The focus of the Bangsamoro government now is to keep our employees and

constituents safe while helping them in the best manner that we can," he

said.

Tribal leaders dare solon to help build IP schools BUTUAN City – Tribal leaders in the Surigao del Sur town of Lianga challenged on Thursday Bayan Muna Party-list Rep. Eufemia Cullamat to help build schools for the indigenous peoples’ (IP) communities.

“This is our challenge to Congresswoman Cullamat as a member of the House Representatives,” Hawudon Jumar Bucales, the Indigenous People Mandatory

Representative (IPMR) of Lianga, told the Philippine News Agency (PNA) in a phone interview.

Bucales issued the call on Cullamat amid the effort of the government to start the construction of government-run IP schools in the area.

In a separate statement released early this week, Datu Constancio Duhac, the Manobo tribal chieftain of Lianga, pointed out

that Cullamat, also of the Manobo tribe, continues to oppose the establishment of government-run IP schools in their villages.

Duhac said he is perplexed that Cullamat "favors the continuing operations" of the controversial schools with alleged links to the communist New People's Army (NPA), referring to the Alternative Learning Center for Agricultural Development (ALCADEV) and the Tribal Filipino Program in Surigao del Sur (TRIFPSS).

The military has long suspected both schools as part of a network run by the Communist Party of the Philippines (CPP) and its armed wing, the NPA. “Congresswoman Cullamat has not yet sponsored project for the Manobo tribe in Lianga, not even a school or farm-market road that will connect Manobo LEADERS/PAGE 11

HE Department of Trade and Industry (DTI) issued a Memorandum Circular (MC) on Thursday setting a limit in buying food and non-food products to avoid hoarding and panic buying amid the enhanced community quarantine in Luzon.

The MC No. 20-07 also aims to prevent unreasonable price increases in basic goods as well as products intended for health protection such as face masks, medical devices, alcohol, sanitizers, and disinfectants.

Retailers shall limit the selling of the following food products per transaction: • 5 pieces per type per brand for locally produced instant noodles; • 5 cans per type per brand for regular size and 3 cans per type per brand for big size for locally

produced canned sardines; • 5 cans per type per brand for small size and 2 cans per type per brand other than small size for canned regular milk; • 2 bundles per brand for powdered milk in sachet; • 2 bundles per brand of instant coffee in sachet; and • 10 small bottles, 8 medium bottles, 5 large bottles, and 2 extra-large bottles of any brand of mineral water For non-food products, consumers can only buy the following per transaction: • 2 pieces for 70 percent solution antiseptic or disinfectant alcohol, regardless of volume; • 2 pieces for hand sanitizer, regardless of size; • 2 pieces for disinfecting liquids, regardless of size; • 5 bars for bath soap if

individually sold and 1 pack if sold as pack; • 10 pieces for toilet paper if sold per roll and 1 pack if sold as pack; and • 5 pieces for any type of surgical and N95 face masks Retailers are directed to post notices about the allowed quantity of goods to be sold to customers per transaction, the MC stated.

According to the MC, violators may face penalties “prescribed under relevant ordinances issued by local government units, and if circumstances warrant, charges and penalties under the Price Act and Consumer Act will be applied”.

Under the Price Act, hoarding is punishable with a fine ranging from P5,000 to P2 million and imprisonment not less than five years but not more than 15 years.

JOLLIBEE Foods Corporation (JFC) has allocated an emergency response fund amounting to P1 billion to provide its employees with the needed financial support to cope with the enhanced community quarantine being implemented in the whole of Luzon due to coronavirus disease 2019 (Covid-19) pandemic.

“This public health crisis challenges us as a company and as a nation in ways we’ve never seen before,” JFC chairman and founder Tony Tan Caktiong said in a statement Thursday.

The employee package covers all work teams of Jollibee Group’s offices, stores, commissaries, and logistics centers, including

the senior citizens and persons with disabilities (PWDs) assigned to stores under the joint employment program with local government units.

The assistance will also be extended to JFC's partner employers in the stores and other sites to provide financial support to their respective employees during this time.

“In these times, we know how people are worrying about their safety and how to take care of their families. We want to help lessen their worries and we are setting up this fund to help them through this difficult time. We are moved by how different individuals and sectors are JOLLIBEE/PAGE 11

“Through our co-

processing operations, we are able to lower our carbon footprint and help ease the waste management challenges of the country while producing an essential building material for development,” he added.

Traning for parents (Pt.1) Think a minute . . . Scientific studies have shown that if you put a frog into boiling water, it will jump out immediately to save its life. But if you put that same frog into water that is normal room temperature, then raise the heat of the water very slowly, the frog will just sit there until it boils to death! Why? Man harbors the enemy THESE are trying times. Never was there a period in the history of humankind that we face an invisible enemy almost as invincible as the Coronavirus Disease 2019 (Covid-19). The plague has traveled across the globe and infects people, rich or poor, black or white, men and women, young or aged.

No place on earth is so distant that the virus cannot inflict its scourge. Man with all his genius and hubris is helpless. Since the virus showed its toxic might in Wuhan, a progressive City in Hubei province of China, hundreds of thousands the world over had been found positive of

the virus now known to us as Covid-19.

Scientists had given the virus its name, while incorrigible politicians envious of the progress and development of erstwhile backward China, dub it Wuhan or China virus.

Earlier some unkind words and condemnation were written against China. We call it “sinophopbia”. And yet when the flu epidemic which emanated from the United States of America we never recalled calling it American virus.

Man’s insensitivity against fellowmen now translates into a worldwide plague. The

world over we scamper for solutions. Months had elapsed yet even the most powerful and advanced nations have yet to discover a vaccine.

We had remained clueless until we discover that the cure is not in an elixir or vaccine but in prevention. It is keeping the man in his abode. Lockdown is the order because man, it was found out, harbors the invisible enemy. What a classic irony and a humiliating means to bring the proud man bending on its knees in compliance for its own survival.

PROF. ENRIQUE SORIANO The month of May has been quite challenging. An ugly feud erupted for control of a family-owned business in country A and I have been requested to intervene.

The sons of the founder are attempting to wrest control of the company from their father. Several thousand miles away in country B, another scenario has befallen another company, this time pitting siblings against siblings after the sudden demise of the matriarch. In both cases, my intervention posthaste was due to recommendations from associates that felt

there was still a glimmer of hope for mediation.

The caveat is that should my initiatives fail in the next 12 months; a litigious process pitting lawyers from both sides will ensue. I can almost anticipate a ver y public mud-throwing spectacle between the warring parties much like the Lotte Group conflict in South Korea and the Philippine’s Ilusorio and Romero family disputes.

In my initial research, the problems started manifesting when the children were forced to join the business without any clarity related to their roles and responsibilities. After the ownership structure was distributed to the children, the plot to unseat their father intensified. I cannot pass judgment nor speculate on the motivation of the four siblings why they rebelled against their father. One thing is clear –– the issues are deep-seated and have created so much strain on the family. The children are

now in their early 40’s.

Theoretically, I refer to the first case as rebellious. It is one of the three patterns of ineffective succession where the next generation launches a clean slate approach to t he org ani z at i on as an overreaction to the founder’s control of the firm. As a result, traditions, legacies and even the business model are rejected and discarded.

This case is just one of a handful of unwarranted family squabbles where the children would attempt to dislodge their parents from controlling the companies that the older generation founded. Predictably, these conf licts implode when governance, succession and ownership processes are set aside. And these same type of issues can happen to any family owning business, big and small.

As a family business a d v i s o r, I h a v e n e v e r been remiss in constantly reminding leaders to initiate the process of succession immediately. Unfortunately,

procrastination, an air of invincibility (superman mentality) and an inflated ego can oftentimes obfuscate t h e f o u n d e r ’s r at i o n a l mindset.

T h e f a c t s are c l e ar, seventy percent of wealth and ownership transitions are not su c c e ss f u l and seventy percent of family wealth ends with the 3rd generation.

So I am posing a direct challenge to family business ow ne rs : B e among t he thirty percent who have successfully transitioned their wealth and ownership to the next generation.

One of the worst mistakes entrepreneurs can make is to postpone naming a successor until just before they are ready to step down or when death comes knocking.

S omet imes founders avoid naming successors because they don’t want to hurt family members who are not chosen to succeed them. Yet, both the business and the family will be better CURSE/PAGE 10

UnionBank economist sees more cuts in BSP rates AN economist of Union Bank of the Philippines (UnionBank) forecasts an additional 50 basis points cut in the Bangko Sentral ng Pilipinas (BSP) key rates this year after a total of 75 basis points reduction to date.

“I do expect the BSP to continue rate cuts to help calm the domestic markets,” Ruben Carlo Asuncion told the Philippine News Agency (PNA) Thursday.

The central bank announced a 50-basispoint reduction in key rates after the second-rate setting meet of the policymaking Monetary Board (MB).

The new rate, which will take effect on Friday, is the lowest since the 3.50

percent in July 2014.

The rate reduction was made as the Board continues to see inflation within the government’s 2-4 percent target.

The Board even slashed the average inflation forecast for this year to 2.2 percent from 3 percent, and to 2.4 percent from 2.9 percent for next year.

“I do expect 50 bps more, but a May meeting decision may be too far because of the current situation.... It may be an off-cycle one,” he said.

The MB will have its third-rate setting meet for the year on May 21.

ADB announces $6.5-B initial response to Corona pandemic

T

HE Asian Development Bank (ADB) Wednesday announced a USD6.5-billion initial package to address the immediate needs of its developing member countries (DMCs) as they respond to the coronavirus disease 2019 (Covid-19) pandemic.

"This pandemic has become a major global crisis. It requires forceful action at national, regional, and global levels,” ADB president Masatsugu Asakawa said in a statement.

Based on close dialogue with members and peer institutions, Asakawa said the ADB is deploying the rescue package to meet the immediate needs of its members.

The initial package includes about USD3.6 billion in sovereign operations for a range of responses to the health and economic consequences of the pandemic, and USD1.6 billion in non-sovereign operations for micro, small, and medium-sized enterprises, domestic and regional trade, and firms directly impacted.

billion in concessional resources through reallocations from ongoing projects and assessing possible needs for contingencies.

It will also make available USD40 million in technical assistance and quick-disbursing grants.

“ADB stands ready to provide further financial assistance and policy advice down the road whenever the situation warrants, on top of the USD6.5 billion package,” Asakawa said.

BSP cuts key rates by 50 basis points PHILIPPINE monetary officials on Thursday slashed by 50 basis points the central bank’s key policy rates, echoing aggressive policy actions by other central banks aimed at supporting economic growth from threats of health pandemic and trade issues.

In a message sent to journalists Thursday, Bangko Sentral ng Pilipinas (BSP) Governor Benjamin Diokno said the overnight reverse

repurchase (RRP) facility rate will be 3.25 percent, the overnight deposit facility rate at 2.75 percent, and the overnight lending facility rate at 3.75 percent effective March 20.

The latest rate cut brought the total rate reduction this year to 75 basis points after the 25-basis-point cut during the rate setting meet last February 6.

Aside from the policy rate cuts, Diokno said the Board also “authorized the

time-bound, temporary relaxation of BSP regulations on compliance reporting by banks, calculations of penalties on required reserves, and single borrower limits.”

He added the Board also approved a temporary reduction in the term spread on rediscounting loans relative to the overnight lending rate to zero.

In a statement, the central bank said latest inflation projections

continue to show a within-target inflation rate, referring to the government’s 2-4 percent target band.

The Board forecasts average inflation this year to be at 2.2 percent, lower than the 3 percent projection announced last February; while the 2021 forecast is 2.4 percent, also lower compared to the 2.9-percent projection previously.

PLAINTIFF Republic of the Philippines, represented by the Department of Public Works and Highways (DPWH), through the Office of the Solicitor General (OSG), to this Honorable Court, respectfully states: 1. Plaintiff is a sovereign political entity vested with the power and authority to condemn and expropriate private property for public use upon payment of just compensation pursuant to Section 6 of Republic Act (RA) No. 10752 otherwise known as the “Right of Way Act” March 7, 2016. (1) One hundred percent (100%) of the value of the land based on the current relevant zonal valuation of the Bureau of Internal Revenue (BIR) issued not more than three (3) years prior to the filing of the expropriation compalint subject to subparagraph (c) of this section; Upon compliance with the guidelines above-mentioned, the court shall immediately issue to the implementing agency an order to take possession of the property and star the implementation of the project.

If within seven (7) working days after the deposit to the court of the amount equivalent to the sum under subparagraphs (a) (1) to (a) (3) of this section, the court has not issued to the implementing agency a writ of possession for the affected property, the counsel of the implementing agency shall immediately seek from the court the issuance of the writ of possession. The court shall issue the writ of possession ex parte; no hearing shall be required.

The court shall release the amount to the owner upon presentation of sufficient profTs of ownership.

Upon the filing of the instant complaint, plaintiff is depositing with this Honorable Court in favor of defendant-owners the abovementioned amount of Php 933,450.00 pursuant to Secton 6(a) of RA No. 10752 and Supreme Court Circular No. 1132019 dated July 16, 2019 stating that it is ministerial on the part of the Clerk of Court to accept the check deposit without awaiting court order. The details of the subject property and the amounts required to be paid in order for plaintiff to be issued an order of possession are hereunder tabulated for easy reference:

3. Persons interested in Lot No. 1466-D are impleaded as defendants considering the uncertainty of ownership over the subject property as it is hereby declared under the name of Valentina Agawin, an apparent heir of Baldomero Agawin.

4. The DPWH is implementing the Construction of New Road and Raising of Existing Road for Evacuation in Bonbon-Kauswagan Stretch under the Flood Risk Management Project for Cagayan de Oro River (FRIMP_CDOR) in the City of Cagayan de Oro, a public purpose authorized by law. It aims to strengthen the resilience of the communities along the Cagayan de Oro River strecth from the Macajar Bay to Pelaez Bridge to climate change and other hydrometeorological hazards by mitigating flood risk in the area. Copies of the Approved Revised Parcellary Plan, Certification of Availability of Fund covering the amount needed for the acquisition of lots and improvements, Department of Environment and Natural Resources (DENR) Environment Compliance Certificate (ECC), and Project Briefer are hereto attached as Annexes “A”, “B”, “C”, and “D” respectively.

5. The implementation of the FRIMP-CDOOR Project for Cagayan de Oro River, necessitates the immediate acquisition of a property located at Barangay Kauswagan, Cagayan de Oro City, Misamis Oriental consisting of Three Hundred Eighty One square meters (381 sq.m.) and designated as Lot No. 1466-D, in plaintiffs subdivision plan.

6. The said lot is classified under Tax Declaration No. G-087482 declared in the name of Valentina Agawin, as residential. Copies of the plaintiffs Subdivision Plan and Technical Description for lot No. 1466-D, its corresponding Tax Declaration for Lot No. 1466-D, its corresponding Tax Declaration, are hereto attached as Annexes “E” and “F”, respectively.

7. Plaintiff failed to acquire the above-mentioned property by negotiated sale pursuant to Section 5 of R.A. 10752 and Section 6.7 of its Implementing Rules and Regulations (IRR), because ownership is uncertain, for which reason expropriation is sought herein.

8. Expropriation of Lot No. 1466-D is sought herein pursuant to Section 6 of R. A. 10752. A copy of the DPWH Letter dated November 26, 2019 endorsing the filing of expropriation complaint against the defendants property is hereto attached as Annex “G” 9. Lot No. 1466-D has not been previously applied to or expropriated for public use and is indispensable in implementing the FRIMP-CDOR Project. It was selected by plaintiff in a manner compatible with the greatest public good and with the least injury to private property.

10. Pursuant ot Sec. 22, Rule 141 of the Rules of Court, plaintiff is exempt from payment of legal fees relative to this complaint for expropriation.

ALLEGATIONS IN SUPPORT OF THE URGENT PRAYER FOR THE ISSUANCE OF A WRIT OF POSSESSION 11. Section 6 of R. A. 10752 lays down the guidelines in expropriation proceedings affecting land, as follows:

No. 10752.

17. For the protection of the interest of the government vis-a-vis its real rights over the subject property, it is imperative that the corresponding WOP issued in this case be entered in the Primary Entry Book of the Register of Deeds of the place having territorial jurisdiction over the subject property and, thereafter, annotated in the space provided in its Registration Book pursuant to Section 69 of Presidential Decree No. 1529, otherwise known as the "Property Registration Decree”:

An attachment, or a copy of any writ, order or process issued by a court of record, intended to create or preserve any lien, status, right, or attachment upon registered land, shall be filed and registered in the Registry of Deeds for the province or city in which the land lies, and, in addition to the particulars required in such papers for registration, shall contain a reference to the number of the certificate of title to be effected and the registered owner or owners thereof, and also if the attachment, order, process or lien is not claimed on all land in any certificate of title a description sufficiently accurate for identification of thye land or interest to be affected. A restraining order, injunction, or mandamus issued by the court shall be entered and registered on the certificate of title affected, free of charge.
