4Ps digitalization DAVAO City – The Department of Science and Technology in Davao ration (DOST-11) said on Tuesday it gave a P1 million fund to the University of Mindanao (UM) here for its research on the Pantawid Pamilyang Pilipino Program (4Ps). The fund, granted through the agency's Philippine Council for Industry, Energy, and Emerging Technology Research and Development (DOST-PCIEERD), aims to plot a visual system to improve the monitoring of the country's 4Ps program. The study will be completed in partnership with the Digos City government in Davao del Sur.

Seal of good governance BUTUAN CIty – Fifty-three villages in the Caraga Region have passed the 2021 Seal of Good Local Governance for Barangay (SGLGB), the regional office of the Department of the Interior and Local Government (DILG-13) said Wednesday. The SGLGB aims to encourage the barangays to scale up their performance and practices of good governance. According to DILG-13 data, Surigao del Norte got the highest number of barangays that passed the SGLGB with 17, followed by Surigao del Sur with 13, and Agusan del Norte with 12.

Protecting tourist spot BUTUAN City – The local government unit of Sibagat in Agusan del Sur announced Wednesday the start of the implementation of environmental measures to protect the Pinandagatan Falls, one of its primary tourist destinations. A three-day tree planting and massive info campaign will be conducted by the LGU until Friday with the aim to sustain the natural habitat of the waterfalls in Barangay Tubigon. It said the activity targets to plant around 250 seedlings of trees and more tree planting activities will be conducted after the threeday activity.

In a courtesy visit 04 July 2022 at the City Mayor’s Office, Oro Chamber President Raymundo Talimio Jr. formally invited the city through City Mayor Rolando A. Uy to Co-Host the upcoming Mindanao Food

Congress and OROBEST EXPO. Specifically, Oro Chamber requested the city government to host the 2nd-day Fellowship Night on October 27, 2022.

Mayor Uy requested the Oro Chamber to send him a letter of intent on this to effect preparation and planning for the event.

Davao Cacao Council to firm up local market to boost sales

AVAO City – The Davao Regional Cacao Industry Council (DRCIC) is eyeing to increase local patronage for cacao byproducts, noting that Dabawenyos only make up 30 percent of their average monthly sales.

“In Cacao City, only 30 percent of consumers are Dabawenyos. It is the tourists who generate the biggest portions of our sales,” said Toto Muyco, the DRCIC chair, during a press briefing here Wednesday.

near the Davao City Investment Promotions Center here. It is formed by cacao entrepreneurs in the region with support from the government.

Muyco said the group is also keen on establishing pop-up stalls and “tsokolate” shops in the future to capture the younger market.

To increase consumption of “tsokolate,” the council announced it will distribute free treats to Dabawenyos who will join their three-day Chocolate Fair starting July 7, coinciding with the World Chocolate Day, in

Abreeza Ayala Mall here.

Wit Holganza, the event organizer, pointed out that many Dabawenyos prefer fastfood chocolates as they assume that those made from local cacao beans are more expensive.

“In the event, we will offer cacao products that offer an indulgent experience. Also, these products are healthy and recommended for moodboosting which we all need at this time of the pandemic,” Holganza said.

Over a dozen exhibitors are expected to display their products during the fair.

The exhibitors, Holganza said, have been recipients of various global recognition for their quality and taste.

“Our local beans varieties making it to the world competition for Top 50 best cacao beans in recent years

has resulted in making the Philippines worldrenowned and is increasingly sought after by chocolate makers,” she said.

This city has been recognized as the Chocolate Capital of the Philippines and the

entire Davao Region as the Cacao Capital of the Philippines through the Republic Act 115471.

The DRCIC said the recognition is a testament to the contribution of the cacao sector as a key driver of rural development. (PNA)

In addition to the harvest, BFAR10 formally turned over the bangus Norweigian HDPE fish cage worth P1.3 million, FRB boat, caretaker’s hut, commercial feeds, Bangus fingerlings, and fishing supplies to the Local Government of Naawan through municipal mayor Dennis Roa, which was officially rewarded to the LFA. Meanwhile, the Mindanao Development Authority (MinDA) and LGU Naawan challenged the LFA members to commit, protect the fishing environment, actively participate in community activities and sustain the given fishery projects.

MinDA’s initiative, Republic Act No. 11321 or the ‘Sagip Saka Act’ was strongly carried out in the implementation of the projects, which required the government to buy directly from fisherfolks to do away with middlemen.

“With MinDA’s initiative, the Sagip Saka Act was treated as a foundation to help increase the income of our fisherfolk amid the unabated fuel price hikes. The act ensures our beneficiary association to tap the appropriate market which gives a fitting price for our fisherfolk who were novices of a fishing trade of this scale,” MinDA representative Lordelie Eljambre said. THE use of thoughts and creative ideas chiefly in the creation of an imaginative work is more than an invention. Creativity is a method that requires a thorough process. A stimulating script, a fascinating art work, or an exceptional response, can be instances of creative effort.

Yet, the ways people create as they write, paint, and be of their opinion are the fundamental of creative methods. To interact with children will help us widen our perception. And it leads

to knowledge about the artistic process that could be useful for teachers, parents and other beings that collaborated with children.

Children are always surprising in their ability. They have a lot of curiosity and eagerness to try many things in which failure is not taken into consideration. They trust their aptitudes. They are always keen observers and closely look into new knowledge and learn from them. If we are to recall, children have passed through milestones. They came to this very world as a blank slate.

Right from their very first step until they learn to say words are part of their very nature.

Incapacitated at the beginning but can do great things in the imminent of time. There is

plenty of stuff which they can impart to us in our day-to-day life. Behind their innocence and vulnerabilities is an ability to touch the lives of humankind.

Fear nothing until the world oddly makes them scared is one of the creativity lessons that children have given to civilization. They don’t stop seeking new knowledge in the midst of being confused between right and wrong. Concurrently, kids are pure to their views and untainted to their thoughts.

Happy for today but never worry what tomorrow brings.

Transparent for anything and hides nothing, when it comes to their emotions.

To all adults who are heading far from children’s advancement may find themselves as good teachers towards the previously mentioned beings. In the real perspectives of life, we can only be efficient teachers if we learn from our children f i rst . D e p e nd i ng on how we will be able to grasp and clasp their lives will identify our competence. And that competence will define our efficacy and values. Children taught us the ver y humble lesson that this world has; do not include your children in your undertakings, be a part of their undertakings. If they want to swim, swim with them.

That's the way to recognize their necessities. In that manner you will absorb and learn the creativity lessons from them and through that very way you will be able to teach them well.

Pag-IBIG Fund releases record-high P40.41B home loans in Jan-May 2022, up 15% Pag-IBIG Fund again surpassed its own record by releasing over P40 billion in home loans in the first five months of 2022, top officials announced on Tuesday (June 28).

From January to May, the agency released home loans worth P40.41 billion, the highest ever amount released during the first five months of any year in its history.

Compared to the same period last year, the amount disbursed so far this year grew 15% from the P35.28 billion released during the same period in 2021.

“Pag-IBIG has once again set a new record in the amount of home loan releases to begin the first five months of the year. We are happy that the number of Filipino workers who are able to become homeowners through the Pag-IBIG home loan programs continue to grow. Our consistent performance also indicates that the home loan policies we have set in place have been effective, and we expect that these would continue to enable even more Filipino workers to

have decent and affordable homes in safe, sustainable and resilient communities,” said Secretary Eduardo D. del Rosario, who heads the Department of Human Settlements and Urban Development (DHSUD) and the 11-member Pag-IBIG Fund Board of Trustees.

Meanwhile, Pag-IBIG Fund Chief Executive Officer Acmad Rizaldy P. Moti said that the amount released as of May financed the acquisition and construction of 36,865 homes for PagIBIG Fund members, 5% higher than the 34,979 homes financed during the same period last year.

He added that out of the total number of homes financed, 6,787 or 18% were socialized housing units which are now owned by minimum-wage and low-income workers and their families.

“Last year, we surpassed the P100billion peso level in home

loan releases, a feat we previously thought was impossible. This year, with our record-high home loan releases from January to May, we are optimistic that Pag-IBIG Fund is well on its way to yet another banner year. Should the current trend hold, we expect to release at least P105 billion pesos in home loans by year's end.

I am confident that our outstanding performance on the home loan front will be sustained, especially under the leadership of our Deputy CEO for Home Lending Marilene C. Acosta, who has been instrumental in our record-breaking performance in home loan releases since 2017”, Moti said.

A great son Think a minute . . . This is a true story about a boy who dreamed of sailing around the world living a life of adventure on the sea. The day finally came at age 15 when he was old enough to follow his dream and join the Navy as a midshipman on a real war ship. Of course, his big challenge now was to convince his mother to let him go. But his dear mother had lost her husband only 5 years earlier and was left to raise more than a dozen children all by herself. So for her to give up her youngest son was asking almost too much. Yet she told him if that was what he really wanted, she would give her approval to let him go.

The day finally came to say goodbye. Her boy was standing in front of her in a dashing Navy uniform, ready to sail away. Suddenly his mother became overwhelmed with the pain of letting go of her youngest son. She began to cry uncontrollably and begged him to stay home to help her and the rest of the family. Her 15-year-old son was quiet for a long time before finally speaking. He

ORLAN R. RAVANERA Let us serve notice to one and all especially to the newly elected officials that even with a strong army, a country that has no ecological security is not secured at all! Our country has long lost its ecological integrity and security when we lost the 17 million hectares of dipterocarp forest which before was home then to billions of species of flora and fauna. Don’t you know that the number of flora and fauna found in 4,000-ha.-Mt. Makiling or in the 3,000-ha.

Mt. Kitanglad was far greater in number compared to those found in one-billion hectarecontinent of North America?

That was how rich our tropical country endemically, oozing with life forms as one tree alone can house some 130 species of flowering plants, orchids, birds, ants and what have you? But that was before, not anymore now as only 5% of our natural forest remain after a century of massive logging.

The Philippines had then the finest trees in the world, i.e., red lauan, narra, mahogany, almaciga and what have you? In fact, the American colonizers had some plans then to leave the Philippines as our country is located in the other side of the globe as it would take the Americans months to travel by ship to the Philippines. Better

wanted with all his heart to become a Navy officer—but not if it was going to break his mother’s heart. He was deeply sad and disappointed, yet he returned home to help his mother take care of the rest of the family.

But that’s not the end o f t h e s t o r y. Fo r t h i s honorable young man who almost became a midshipman, later became the captain of a country. This devoted son who sacrificed everything became known as the Father of the Nation: George Washington, the first President of the United States.

colonize the neighboring countries like Cuba or Mexica. But in a big debate in the US Senate in the 1900, a certain US Senator by the name of Larry Hieney stood up and said that the US must continue its stranglehold of our country, stating that, “the forest of the Philippines can supply the timber needs of the world for century to come.”

And so we did. Even after the US Occupation of our country, the neo-colonizers and the oligarchs through their logging companies had subjected our forest to massive logging activities in utter disregard to the rule of law.

Our natural forest were well protected then by existing laws, i.e. no logging in highly- elevated- areas that have a topography of more than 1,000 meters above sea level, no logging in slopy areas with a gradient of more than 50% and no cutting of hard wood and finest of trees. All of these laws were grossly violated as one shipment of logs alone would earn a logger some 360 million pesos, massive raking that did not only go to the pockets of the loggers but to those who were tasked to enforce environmental laws. Based on the information gathered

by Task Force Macajalar, from 1950s to 1990s, some 50 10-wheeler logging trucks with armed escorts would pass the thorough fares of Cagayan de Oro from midnight till dawn, coming from the hinterlands of Bukidnon and Lanao, each passing logging truck would pay a check-point P5,000. That was the reason why we in Task Force Macajalar had to stage people’s direct actions through human barricades from 1991 to 2000, not cowed

by threats and attempts to our lives, highlighted by the throwing of an M2K2 hand grenade to us at dawn in the barricade area.

It was our battle cry that in this country, no one is above the law; all must bow down to the majesty of the law because we follow the rule of law and not of money or of powerful loggers some of whom have been voted as mayors, congressmen, governors and even senators.

It was so horrible even to contemplate that there was no such thing as rule of law on environment but rule of money and power – the reason why we have lost our dipterocarp forest. It was only through people’s direct actions that we were able to stop massive illegal logging.

But the wealth of our country is not only found above the ground; beneath the ground are some 72 kinds of minerals that were the subject of illegal mining activities.

In 2013, different ecological movements in Mindanao did join hands to apply for the “Writ of Kalikasan” under the SULOG COALITION to prevent the occurrence of another SENDONG which had killed some 3,000 people on Dec. 18,2011. In issuing the Writ, the Court of Appeals had ordered some 9 agencies of government and local government units to enforce the environmental laws together with representatives from SULOG. In one operation against illegal mining, we were shocked to discover in the mining campsite handgrenades, Armalites and AK-47. Arrested were five illegal miners who were all Chinese Nationals who were only carrying tourist visa.

They were detained for only

a week and allowed to go back to China. Why? I think the Bureau of Immigration must explain to the newly elected President why were Chinese Nationals carrying only tourist visa were doing massive illegal mining in the uplands of Cagayan de Oro and Iligan, and using bombs and powerful guns.

After that operation, our volunteer from SULOG by the name of Fausto Orasan, known as Datu Sandigan, the chieftain of the Higaonon Tribe in Cagayan de Oro and our fearless environmental colleague in Sulog was mu rd e re d i n B ar ang ay Tumpagon. Until now, no one was arrested. Ganyan ba ka powerful itong mga illegal miners? In fact, the five illegal Chinese miners were allowed to go back to China and we have heard, even escorted by a known personality. I hope under the leadership of President Ferdinand Bongbong Marcos, justice can be done to our fallen environmental warriorDatu Sandigan!

B u t o u r c o u n t r y ’s ecological wealth does not stop at the shorelines as the Philippine Archipelago had been described before by no less than the President of the United Nations Food and Agricultural Organization, Dr. Kent Carpenter as “the center of the center of marine life on earth.” But not anymore as our archipelago had been the “dumping ground” of highly toxic garbage from Canada, Korea and Australia as our Navy was not wellequipped then to totally guard our seas. Even China has now taken over the West Philippine Sea. As we have lost our forests which we call our “invisible SECURITY/PAGE 11

Without cost you have received; without cost you are to give.” (Mt 10,7-8) Wo r d s o f C h r i s t addressed to his apostles and addressed to us also. They are a call to give ourselves completely to carry out the continuing mission of Christ which is the salvation of everyone.

This mission will definitely require everything from us. But neither should we forget that everything has also been given to us.

To be sure, Christ does not ask of us something that he himself would not enable us to do.

It’s a truth of our faith that we should vividly remember always, especially when we feel we are already at our limits in our self-giving to fulfil God’s will. God cannot be outdone in generosity. If we are generous with him and with others, the more

generous will God be with us!

We need to develop a keen sense of generosity and self-giving that is also a result of detachment. Let’s never forget that whatever we have comes from God who wants us to work for him and with him, and for the common good. Thus, we hear St. Paul saying, “What do you have that you did not receive?” (1 Cor 4,7) L et’s rememb er t hat generosity can on ly b e achieved if there is love.

Love and generosity cannot be separated. It’s in the very essence of love to give oneself without measure, without calculation, without expecting any return. It just gives and gives, even if along the way it encounters difficulties, rejection, s u f f e r i n g . It e m b r a c e s them, not flee from them.

By its nature, it is given gratuitously.

Ye s , l ove e nge n d e r s generosity and its relatives: magnanimity, magnificence, compassion, patience, pity,

etc. This is the language of love, the currencies it uses. It thinks big, even if the matter involved is small according to human standards. In fact, it’s love that makes small, ordinary things big and special.

And the object of our love and of our generosity should first of all be God, and then because of God, everybody else. That’s because love for God cannot be separated from love for neighbor. It would be no love for God if it does not translate itself into love for everybody else.

XXX SO ORDERED.” WHEREAS, Complaint reads: COMPLAINT (With Urgent Prayer for Issuance of Writ of Possession) Plaintiff, National Grid Corporation of the Philippines (NGCP), by counsel, respectfully states that: 1. Plaintiff is a private corporation created and existing under Philippine laws, with principal office address at NGCP Building, Quezon Avenue corner BIR Road, Diliman, Quezon City. It may be served with notices and other court processes through its Right-of-Way Department (ROWD) – Mindanao Division, Maria Cristina, Iligan City, copy furnished the afore-mentioned principal office.

2. Pursuant to Republic Act (R.A.) No. 9511, plaintiff was granted a franchise to operate, manage and maintain, and in connection therewith, to engage in the business of conveying or transmitting electricity through a high-voltage back-bone system of interconnected transmission lines, substations and related facilities, systems operations, and other activities that are necessary to support the safe and reliable operation of a transmission system and to construct, install, finance, manage, improve, expand, operate, maintain, rehabilitate, repair and refurbish the present nationwide transmission system of the Republic of the Philippines.

3. Under Section 4 of the same law, plaintiff was granted the power of eminent domain, subject to the requirements of the Constitution and existing laws.

4. Plaintiff is engaged in the business of transmitting electric power from the generating plants of power producers to distributors. As such, plaintiff’s business is imbued with public interest.

5. To address the country’s growing power demand and ensure continuous, reliable and efficient power supply, there is a need to interconnect the three (3) major power grids of Luzon, Visayas, and Mindanao into a single national grid. Aside from the sharing of systems reserve, the interconnection will also help optimize utilization of indigenous energy resources such as natural gas in Luzon, geothermal in the Visayas and hydro in Mindanao. Owing to this necessity, plaintiff must immediately construct the transmission lines that will transmit power to distributors of electricity not only in Mindanao but also in Luzon and Visayas. This undertaking is for the use and benefit of the public and part of it is known as the MINDANAO-VISAYAS INTERCONNECTION PROJECT (MVIP), integral part of which is the KOLAMBUGAN-LALA 20kV TRANSMISSION LINE PROJECT (Project).

6. The said MVIP of NGCP is the first project certified by the Department of Energy (DOE) as an Energy Project of National Significance (EPNS) pursuant to R.A. 7638 of DOE Act of 1992, as amended, entitled to all the rights and privileges provided under Executive Order No. 30, series of 2017, as evidenced by the Certification dated 8 May 2018 issued by the Energy Investment Coordinating Council. Hence, the immediate completion and energization of the said project is critically important.

7. Defendants Charlie V. Hernando and Edwin V. Hernando (Heirs of Catalino Hernando) are both of legal age, Filipinos and may be served with notices, summonses and other processes of this Honorable Court at their respective addresses, to wit:

Machine copies of the BIR Zonal Valuation applicable to the subject property, Report on the Counts of Improvement, Sworn Statement of Ownership/Undertaking with Waiver of Rights/Quitclaim, with Acknowledgment Receipt, as proof of payment of the affected improvements amounting to Php84,707.64 are attached and made integral parts of this complaint.

10. To enable plaintiff to construct and maintain the Project, it is both necessary and urgent to acquire, upon payment of just compensation, the portion of the defendants’ property, to ensure stability and reliability of the power supply in Mindanao and other regions of the country.

11. Plaintiff negotiated with defendants for the acquisition of the affected portion of the subject property and to pay the cost of improvements therein that may be damaged by the construction of the transmission line project. Defendant Arcelito H. Gordillo already accepted the cost of affected improvements found in the subject property. However, no agreement was reached between the parties as to the compensation of the affected lot.

12. Considering the urgent need for plaintiff to enter the subject property to implement and commence the necessary construction activities therein for its Project, plaintiff has no other recourse but to file the instant complaint.

13. Section 13 of R.A. 11361, provides that Rule 67 of the Revised Rules of Civil Procedure governs plaintiff’s expropriation cases.

Under Section 2 of Rule 67 of the Revised Rules of Civil Procedure, plaintiff may already enter and possess the portion of the subject property during the pendency of the expropriation case.

14. Section 2 of Rule 67 of the Revised Rules of Civil Procedure states that: “SEC. 2. Entry of plaintiff upon depositing value with authorized government depositary. – Upon the filing of the complaint or at any time thereafter and after due notice to the defendant, the plaintiff shall have the right to take or enter upon the possession of the real property involved if he deposits with the authorized government depositary an amount equivalent to the assessed value of the property for purposes of taxation to be held by such bank subject to the orders of the court. Such deposit shall be in money, unless in lieu thereof the court authorizes the deposit of a certificate of deposit of a government bank of the Republic of the Philippines payable on demand to the authorized government depositary.” [Emphasis supplied] 15. In compliance with the notice requirement, plaintiff notified defendants through a Letter Offer of its intention to file an expropriation case if the possession over the subject property cannot be timely secured and/or issues regarding compensation for the subject property cannot be resolved except through judicial intervention. Plaintiff further serves, simultaneous with the filing of the instant Complaint, a Notice to Take Possession (attached as Annex “A”) upon the defendants.

16. To comply with the deposit requirement, plaintiff, notwithstanding that R.A. 10752 does not specifically apply to it, shall deposit with the Honorable Court an amount equivalent to the 100% of the BIR zonal value of the land sought to be expropriated in the total amount of FIFTY-ONE THOUSAND NINE HUNDRED THIRTY PESOS (Php51,930.00) consistent with the purpose of the said law and OCA Circular No. 113-2019 to simplify the deposit requirement in expropriation cases for the benefit of the defendants and in the interest of immediate implementation of projects intended to benefit the public.

17. Upon deposit of the provisional amount, plaintiff would have fully complied with the requirements for the issuance of a writ of possession as mandated by law.

18. In a long line of cases and pursuant to OCA Circular No. 113-2019, once the above requirements are complied with it, it becomes the ministerial duty of the trial court to issue the writ of possession in favor of the plaintiff, without need of any further hearing. Thus: “Municipality of Cordova v. Pathfinder Development Corporation emphasizes the mandatory issuance of the writ of possession upon the receipt of the required deposit. “No hearing is actually required for the issuance of a writ of possession, which demands only two (2) requirements: (a) the sufficiency in form and substance of the complaint; and, (b) the required provisional deposit x x x x Upon compliance with these requirements, the petitioner in an expropriation case is entitled to a writ of possession as a matter of right and the issuance of the writ becomes ministerial.” (Emphasis supplied) 19. Moreover, it must be emphasized that an expropriation proceeding is an action quasi in rem, wherein the fact that the owners of the property are made parties is not essentially indispensable insofar as it concerns the immediate taking of possession of the property and the preliminary determination of its value, including the amount to be deposited.

20. An action quasi in rem names a person as defendant, but its object is to subject that person’s interest in a property to a corresponding lien or obligation. In a proceeding quasi in rem, jurisdiction over the person of the defendant is not a prerequisite to confer jurisdiction on the court, provided that the latter has jurisdiction over the res.

21. The purpose of summons in actions quasi in rem is not the acquisition of jurisdiction over the defendant but mainly to satisfy the constitutional requirement of due process. Since the issuance of writ of possession is ex-parte, ministerial, and non-litigious in nature, the issuance thereof, even prior to the service of summons, will not violate defendants’ right to due process as the same can be done even without defendants’ participation. Besides, the issuance of a writ of possession does not prevent defendants from raising objections to and defenses against the expropriation of their property.

22. Plaintiff intends to present three (3) witnesses, namely: a) Engr. Licinio B. Capili, b) Mr. Nolito L. Notar, and c) Mr. Michael E. Encarnado to establish, among others, NGCP’s authority to exercise the power of eminent domain, the propriety of its exercise in this case, and the bases for the determination of the just compensation. Copies of their Judicial Affidavits (with attached Exhibits “A” to “L”) are attached as Annexes B, C, and D and made an integral part hereof. Plaintiff intends to present additional witnesses if necessary.

PRAYER WHEREFORE, premises considered, plaintiff most respectfully prays of this Honorable Court to: 1. ISSUE a Writ of Possession in plaintiff’s favor; authorizing plaintiff to enter and take possession of the property subject of this complaint that will be affected by the construction and implementation of the Project, consisting of a total area of 1,154 square meters, more or less, as described in paragraph 9 hereof; clear the affected improvements or demolish the affected structures standing therein; order all defendants to vacate the portion of the subject property; and direct the Philippine National Police (PNP) to assist plaintiff in the implementation of the said writ of possession so that project construction can immediately commence even during the pendency of the case and/or for the conduct of the counting of affected improvements, if necessary; direct the Registry of Deeds for the Province of Lanao del Norte to enter the writ of Possession in the Primary Entry Book and annotate the same in the Registration Book pursuant to Section 69 of Presidential Decree No. 1529; 2. After issuance of Writ of Possession, ISSUE an Order of Publication allowing plaintiff to effect service of summons to defendants Charlie V. Hernando, Edwin V. Hernando, Jesus H. Gordillo, Rosvic E. Gordillo, Jeric E. Gordillo, Mark Anthony E. Gordillo, John Larry G. Sefuentes, Jane Sefuentes, Unknown Heirs of Catalino Hernando, and Unknown Heirs of Fernando H. Gordillo, by publication, pursuant to Sections 16 and 17, Rule 14 of the Revised Rules of Civil Procedure; 3. ISSUE an Order of Expropriation declaring that plaintiff has a lawful right to take possession and acquire the affected portion of the property specified in paragraph 9 hereof; 4. After the determination of just compensation, to authorize the payment thereof by plaintiff to the defendants after deducting the capital gains and documentary stamp taxes for the transfer of the affected portion of Lot No. 5, in the name of plaintiff, all other outstanding taxes under the National Internal Revenue Code, and all outstanding realty taxes and dues under the Local Government Code, which plaintiff shall remit to the Government; 5. The said MVIP of NGCP is the first project certified by the Department of Energy (DOE) as an Energy Project of National Significance (EPNS) pursuant to R.A. 7638 of DOE Act of 1992, as amended, entitled to all the rights and privileges provided under Executive Order No. 30, series of 2017, as evidenced by the Certification dated 8 May 2018 issued by the Energy Investment Coordinating Council. Hence, the immediate completion and energization of the said project are critically important.

7. Defendants Heirs of Emeliano Feliciano, namely: Leocadia P. Feliciano, Gwendolyn P. Feliciano, Jesus P. Feliciano, Mihai P. Feliciano, Diana P. Feliciano, Frances P. Feliciano, and Ma. Lorna P. Feliciano are all of legal age, Filipinos, with last known address in Ozamiz City, Misamis Occidental. Considering that their whereabouts are unknown and cannot be ascertained despite diligent inquiry and efforts exerted, plaintiff undertakes to cause the service of summons to them by publication pursuant to Sections 16 and 17, Rule 14 of the Revised Rules of Civil Procedure.

8. Defendants Heirs of George Dela Peña, namely: Maria Salome S. Dela Peña, Jeffrey Marco Segundino, Myra Grace A. Dela Peña, Jayson Mark A. Dela Peña, and Jomarie A. Dela Peña, are all of legal age and Filipinos. They may be served with notices, summonses and other processes of this Honorable Court at their respective addresses, to wit:

Copies of the BIR Zonal Valuation applicable to the subject property, Report on the Counts of Improvement, Sworn Statement of Ownership/Undertaking with Waiver of Rights/Quitclaim, with Acknowledgment Receipt, as proof of payment of affected improvements amounting to Php3,500.00, are attached and made an integral part of this complaint.

12. To enable plaintiff to construct and maintain the Project, it is both necessary and urgent to acquire, upon payment of just compensation, the portion of the defendants’ property, to ensure stability and reliability of the power supply in Mindanao and other regions of the country.

13. Plaintiff negotiated with defendants through Leopoldo A. Ponce for the acquisition of the affected portion of the subject property and to pay the cost of improvements therein that may be damaged by the construction of the transmission line project. While defendant Leopoldo Ponce already accepted payment for the cost of improvements, no agreement however, was reached between the other parties as to the compensation for the affected portion of the subject property.

14. Considering the urgent need for plaintiff to enter the subject property to implement and commence the necessary construction activities therein for its Project, plaintiff has no other recourse but to file the instant complaint.

15. Section 13 of R.A. 11361, provides that Rule 67 of the Revised Rules of Civil Procedure governs plaintiff’s expropriation cases.

Under Section 2 of Rule 67 of the Revised Rules of Civil Procedure, plaintiff may already enter and possess the portion of the subject property during the pendency of the expropriation case.

16. Section 2 of Rule 67 of the Revised Rules of Civil Procedure states that: “SEC. 2. Entry of plaintiff upon depositing value with authorized government depositary. – Upon the filing of the complaint or at any time thereafter and after due notice to the defendant, the plaintiff shall have the right to take or enter upon the possession of the real property involved if he deposits with the authorized government depositary an amount equivalent to the assessed value of the property for purposes of taxation to be held by such bank subject to the orders of the court. Such deposit shall be in money, unless in lieu thereof the court authorizes the deposit of a certificate of deposit of a government bank of the Republic of the Philippines payable on demand to the authorized government depositary.” [Emphasis supplied] 17. In compliance with the notice requirement, plaintiff notified defendants through a Letter Offer of its intention to file an expropriation case if the possession over the affected portion of the subject property cannot be timely secured and/or issues regarding compensation for the portion of the subject property cannot be resolved except through judicial intervention. Plaintiff further serves, simultaneous with the filing of the instant Complaint, a Notice to Take Possession (attached as Annex “B”) upon the defendants.

18. To comply with the deposit requirement, plaintiff, notwithstanding that R.A. 10752 does not specifically apply to it, shall deposit with the Honorable Court an amount equivalent to the 100% of the BIR zonal value of the land sought to be expropriated in the total amount of TWENTY-SEVEN THOUSAND EIGHTY PESOS (Php27,080.00) consistent with the purpose of the said law and OCA Circular No. 113-2019 to simplify the deposit requirement in expropriation cases for the benefit of the defendants and in the interest of immediate implementation of projects intended to benefit the public.

19. Upon deposit of the provisional amount, plaintiff would have fully complied with the requirements for the issuance of a writ of possession as mandated by law.

20. In a long line of cases and pursuant to OCA Circular No. 113-2019, once the above requirements are complied with it, it becomes the ministerial duty of the trial court to issue the writ of possession in favor of the plaintiff, without need of any further hearing. Thus: “Municipality of Cordova v. Pathfinder Development Corporation emphasizes the mandatory issuance of the writ of possession upon the receipt of the required deposit. “No hearing is actually required for the issuance of a writ of possession, which demands only two (2) requirements: (a) the sufficiency in form and substance of the complaint; and, (b) the required provisional deposit x x x x Upon compliance with these requirements, the petitioner in an expropriation case is entitled to a writ of possession as a matter of right and the issuance of the writ becomes ministerial.” (Emphasis supplied) 21. Moreover, it must be emphasized that an expropriation proceeding is an action quasi in rem, wherein the fact that the owners of the property are made parties is not essentially indispensable insofar as it concerns the immediate taking of possession of the property and the preliminary determination of its value, including the amount to be deposited.

22. An action quasi in rem names a person as defendant, but its object is to subject that person’s interest in a property to a corresponding lien or obligation. In a proceeding quasi in rem, jurisdiction over the person of the defendant is not a prerequisite to confer jurisdiction on the court, provided that the latter has jurisdiction over the res.

23. The purpose of summons in actions quasi in rem is not the acquisition of jurisdiction over the defendant but mainly to satisfy the constitutional requirement of due process. Since the issuance of writ of possession is ex-parte, ministerial, and non-litigious in nature, the issuance thereof, even prior to the service of summons, will not violate defendants’ right to due process as the same can be done even without defendants’ participation. Besides, the issuance of a writ of possession does not prevent defendants from raising objections to and defenses against the expropriation of their property.

24. Plaintiff intends to present three (3) witnesses, namely: a) Engr. Licinio B. Capili, b) Engr. Kin C. Torayno, and c) Mr. Michael E. Encarnado to establish, among others, NGCP’s authority to exercise the power of eminent domain, the propriety of its exercise in this case, and the bases for the determination of the just compensation. Copies of their Judicial Affidavits (with attached Exhibits “A” to “N”) are attached as Annexes C, D, and E and made an integral part hereof. Plaintiff intends to present additional witnesses if necessary.

PRAYER WHEREFORE, premises considered, plaintiff most respectfully prays of this Honorable Court to: 1. ISSUE a Writ of Possession in plaintiff’s favor; authorizing plaintiff to enter and take possession of the property subject of this complaint that will be affected by the construction and implementation of the Project, consisting of a total area of 677 square meters, more or less, as described in paragraph 11 hereof; clear the affected improvements or demolish the affected structures standing therein; order all defendants to vacate the portion of the subject property; and direct the Philippine National Police (PNP) to assist plaintiff in the implementation of the said writ of possession so that project construction can immediately commence even during the pendency of the case; direct the Registry of Deeds for the Province of Lanao del Norte to enter the writ of Possession in the Primary Entry Book and annotate the same in the Registration Book pursuant to Section 69 of Presidential Decree No. 1529; 2. 11. Plaintiff intends to expropriate portion of a parcel of registered land identified as Lot No. H-59984, situated in Brgy. Pantar, Kolambugan, Lanao del Norte. XXX SO ORDERED.” WHEREAS, Complaint reads: COMPLAINT (With Urgent Prayer for Issuance of Writ of Possession) Plaintiff, National Grid Corporation of the Philippines (NGCP), by counsel, respectfully states that: 1. Plaintiff is a private corporation created and existing under Philippine laws, with principal office address at NGCP Building, Quezon Avenue corner BIR Road, Diliman, Quezon City. It may be served with notices and other court processes through its Right-of-Way Department (ROWD) – Mindanao Division, Maria Cristina, Iligan City, copy furnished the afore-mentioned principal office.

2. Pursuant to Republic Act (R.A.) No. 9511, plaintiff was granted a franchise to operate, manage and maintain, and in connection therewith, to engage in the business of conveying or transmitting electricity through a high-voltage back-bone system of interconnected transmission lines, substations and related facilities, systems operations, and other activities that are necessary to support the safe and reliable operation of a transmission system and to construct, install, finance, manage, improve, expand, operate, maintain, rehabilitate, repair and refurbish the present nationwide transmission system of the Republic of the Philippines.

3. Under Section 4 of the same law, plaintiff was granted the power of eminent domain, subject to the requirements of the Constitution and existing laws.

4. Plaintiff is engaged in the business of transmitting electric power from the generating plants of power producers to distributors.

As such, plaintiff’s business is imbued with public interest.

5. To address the country’s growing power demand and ensure continuous, reliable and efficient power supply, there is a need to interconnect the three (3) major power grids of Luzon, Visayas, and Mindanao into a single national grid. Aside from the sharing of systems reserve, the interconnection will also help optimize utilization of indigenous energy resources such as natural gas in Luzon, geothermal in the Visayas and hydro in Mindanao. Owing to this necessity, plaintiff must immediately construct the transmission lines that will transmit power to distributors of electricity not only in Mindanao but also in Luzon and Visayas. This undertaking is for the use and benefit of the public and part of it is known as the MINDANAO-VISAYAS INTERCONNECTION PROJECT (MVIP), integral part of which is the KOLAMBUGAN-LALA 20kV TRANSMISSION LINE PROJECT (Project).

Considering that the specific addresses of defendants Charlie V. Hernando and Edwin V. Hernando cannot be ascertained and that there are Unknown Heirs of Catalino Hernando, whose identities and whereabouts cannot likewise be ascertained despite diligent inquiry and efforts exerted, plaintiff undertakes to cause service of summons to them by publication pursuant to Sections 14 and 15, Rule 14 of the Revised Rules of Civil Procedure.

AVAO CITY - The three-day event last June 24-26, 2022, at the Waterfront here, was a collaboration of conscientious work of tapestries from philanthropic sponsors like Renée Salud, Jessie Maloles, Cristina Yip, and Event Director Arnold Larrobis Alvarez.

The current manager of Waterfront, Mr. Bryan Yves Lasala has been generously supportive throughout the event as he conveyed from his heartfelt speeches and leadership that integrity.

Together with his marketing manager, Paolo Rosello, the ambience of it all makes the array of models Abby and Renee of GLAM Model

House, Romechelle Escrin, Anne Barker, Katrina, Eloisa Jaud, Leren Mae M. Bautista, Jehza Huelar Simon, Arnel Calugay, Daniel along with other prime models from Davao City and Metro Manila an ecstasy beyond words!

Captured in candid photos such as shown, beauty is authenticity, confidence, goodness of heart exuding in one's character and

countenance.

The closed-door press conference on the 1st day of the said event, with the initial cutting of ribbon ceremony, and introduction of all the participants, had made the 1st day of value, as the visit to The House of Hope Foundation for Cancer patients brought tears, songs, prayers and benevolence of finances, foods and friendly conversations amongst the visitors and residents hit home.

The treats to Marilog, Dusit Thani, Matina, shopping Davao's goodies, and even visiting private homes for fellowship groups of guests showed hearts of prowess amongst the fashion world.

Mama Renée Salud explicitly shared why this event featured wedding gowns. That is to cater any one’s dream of walking on the aisle someday. On the Gala night, June 25, 2022, that became a reality and so

much more as the collection of Ms. Yip were also introduced together with all the other fashion icons.

Matigsalug tribe is one of the recipients of this event as the team went up to Marilog and shared the heart of such an endeavor!

From the moment of pledges during the Gala night with an exquisite cocktail buffet, Santa Cruzan, as a Filipino feast lit hope into a new world after the 2-year lockdown due to the Covid pandemic.
