1,500 businessmen to gather in GenSan for 23rd Minbizcon

development and improve the quality of education to be at par with other ASEAN member states. It said the “educational system in the Philippines is not competitive with the rest of the ASEAN member countries and want to include topics on the region in the curriculum.” Also in the agenda for the business confab is the current state of the canning and manufacturing sector in the island. Mindanao is home to two major fish canning industries, particularly in General Santos for tuna and Zamboanga for sardines. Documents obtained from conferences sources said Mindanao businessmen find weak support from the Bureau of Fisheries and Aquatic Resources (BFAR) in further developing the Philippine canning sector “specifically on policy of limiting catches of fishes that are acceptable for canning.” BFAR, it said, “will need to fast track research on certain fish species which are identified as non-cannable.” The Philippines faces stiff competition, particularly in the canned tuna export and tuna production industries, as Thailand remains Asia’s top canned tuna producer while Vietnam is rapidly progressing as one

of the biggest tuna catchers in the region. The Philippines is the world’s 2nd biggest producer of canned tuna products and is also globally the 7th largest tuna producer while ranking 11th among the world’s fishing countries. Thailand however is globally ranked 1st in canned tuna production. Billena said there is a need to improve seaports and airports throughout Mindanao. “We just came in from Manado in Indonesia. Twenty years ago, the airport there was like an airstrip. Now it is better than most of our airports in Mindanao,” he said. The Mindanao business group likewise encouraged the government to open up more flights connecting Mindanao to other cities in the ASEAN region. Specifically, it pushed for the re-opening of ZamboangaMalaysia air route. More importantly, the conference wants the government to immediately address the power supply problem in Mindanao. Pancake House approves issuance of 300 million common shares

ancake House Inc’s (PCKH) Board of Directors has approved the issuance of 300 million common shares, which are part unissued and authorized shares. ”The Board approved and authorized the followon offering and sale of up to 300,136,430 common shares, consisting of up to 34,106,416 new shares to be issued out of the authorized and unissued capital stock of the Corporation,” Pancake House said in a disclosure with the Philippine Stock Exchange (PSE) Wednesday. The 204,638,468 shares were identified as for the sale of full subsidiaries of PCKH, while 61,391,546 were repurchased from shareholders and will be sold yet again. More ove r, Pan c a ke House noted that the Board also backed the registration statement filing for the follow-on offer of shares to the Securities and Exchange Commission (SEC), along with the required listing application. Also, the company mentioned the election of Dave Fuentebella as Chief Finance Officer (CFO) of the Corporation. He was a banker, who served the Bank of the

Philippine Islands (BPI) Capital, Citibank, Standard Chartered Bank, Deutsche Bank and Credit Agricole. On the other hand, PCKH owns the following restaurants: Pan Dencio’s, Kabisera ng Dencio’s, Teriyaki Boy, Sizzlin’ Pepper Steak, Le Coeur De France, The Chicken Rice Shop, Maple, and Yellow Cab. Last February, Pancake House was acquired by the Max’s Group of Companies. However, it was agreed upon that the subsidiaries will still remain under the PCKH brand. For the 2nd quarter of 2014, PCKH earned Php951.8 million, lower than last year’s Php955 million. Consequently, shareholders suffered from a -23 centavo loss, compared to last year’s 17 centavos. RCBC confirms talks with Cathay Financial Holdings

MANILA -- Yuchengco-led Rizal Commercial Banking Corporation (RCBC) on ×Wednesday confirmed a news report that it is in discussion with Taiwan’s largest financial group, Cathay Financial Holdings Co. According to the report, the foreign financial group eyes minority stake in RCBC. In a disclosure with the Philippine Stock Exchange (PSE), the Philippines’ sixth largest domestic commercial bank in terms of assets said negotiations between the two entities are on-going but declined to elaborate.

It also cited that it has announced in its disclosure on August 13, 2014 that “there are ongoing discussion for a private placement which are not yet final.” ”A confidentiality agreement prevents RCBC from disclosing at this point in time the specific details until such time the negotiations are finalized,” it said. ”We will advise the ×Exchange as soon as there

People’s Initiative

The People’s Initiative is a feature in the 1987 Constitution empowering the citizenry to directly enact pieces of legislation on top of those being crafted by the two chambers of Congress. The enactment of laws through this constitutional mechanism is, however, not that easy. The framers of the Constitution made it sure that any law passed through the People’s Initiative satisfies stringent measures to prevent it from being abused. As it stands now, a law passed through the People’s Initiative mechanism will have to be approved by not less than three percent of the total number of voters in every congressional district all over the country. This is to ensure that a sizable number of the citizenry is indeed for the enactment of the proposed law and not just a miniscule number. This is the route that the People’s Initiative for the Abolition of the Pork Barrel will have to take. It’ll be a circuitous and cumbersome route but its passage is assured if the people are indeed for the abolition of the pork. When three percent of the voters in every congressional district shall have affixed their signature on this proposed law, the citizenry would have proved to the entire nation their desire to have it become a law. I am for the passage of this proposed law through the People’s Initiative be-

cause I want the citizenry to realize how much power they have in their hands. This power gives them the right to enact pieces of legislation through their own initiative. This can be a good way for the people to be united as one because no law through this mean could ever be passed with a divided nation. One of the biggest problems the Filipino people as a nation is saddled with is its inability to unite as one people. In fact, I would dare say here now that up to this point we have not become a nation yet. Our being a nation is still just a product of our fertile imagination. We still have to understand what a nation is and what makes a nation. If through the People’s Initiative we’ll become a nation, let us then push vigorously the passage of this proposed law even if the Supreme Court has already ruled that the congressional pork and even the presidential pork are all unconstitutional. The advocates of the passage of a law abolishing the pork system through People’s Initiative may claim it is still not stricken off the budget or in the budget process hence the need for a law to finally write it off in the budget process, but the fact is indisputable it is not in the budget process anymore. Of course, anti-pork advocates do not believe the claim issued by Malacanang

that it has not included any lump sum allocations anymore where its disbursement is the sole discretion of certain officials such as the President and national legislators. The advocates want to ensure that every allocation has an identified program or project to be funded. These advocates are likewise pushing for the return to line item budgeting to ensure each allocation has a program or project or even service to be paid for with public money. They argue that at the moment so much discretion is being exercised by certain public officials on how certain lump sum items in the budget are to be expended. The clamor for the abolition of the pork may not be necessary anymore as expressed by certain quarters notably led by former Economics Adviser Solita “Mareng Winnie” Monsod. She is of the view the pork system in the past is no longer featured in the proposed budget being deliberated in Congress now for the Year 2015. For my part, I don’t want to be entangled with this debate. I’d rather look at the People’s Initiative from another perspective which is the positive result it could bring to the nation which is unite the people as one nation. If indeed there is no more pork in the proposed 2015 budget as claimed by Malacanang, the decision

However, if the abolition of the pork is directed by virtue of a law that was passed through the People’s Initiative succeeding Presidents will already be bound by law never to include any porky items in the budget. This is the difference. And a People’s Initiative passed law will make future Palace occupants to think twice in including any pork item in the budget afraid of any backlash should a future President dares to revive this much abused fund. Syrian President Bashir al-Assad is isolated on the world stage. But now he's offering the West military cooperation in the fight against "Islamic State," painting himself as a guarantor of stability. When the Arab Spring unfolded in Syria, it appeared that the Syrian president's fate was sealed. The heads of state of other Arab countries had fallen one by one: Ben Ali fled, Mubarak was ousted, Gadhafi was murdered. Things weren't looking good for Bashar-al-Assadin the autumn of 2011. Thousands of Syrians were protesting against their president, fighting his regime with all they had. But Assad refused to be chased away. He issued continual warnings against the "Islamist terrorists" in his country, and clamped down brutally on his own people. Three years and more than 190,000 deaths later, Assad's warning looks more and more like the truth. Militants of the "Islamic State" group are advancing across the country, fighting mercilessly for a religious state. They murder anyone who stands in their way. The Islamic extremists, supported by thousands of volunteer fighters from the Arab world and Europe, have taken hold of large areas of both Syria and Iraq. In the beginning, they mainly fought against Syrian rebels, strengthening the regime in Damascus. Now, the militants are also targeting Syria's government troops. The United States, as well as many European and Arab governments, sees the caliphate as a provocation. Islamic State has given Syria and the West a common enemy - something that could play into the hands of the government in Damascus, said

"From the very beginning, Assad denounced the revolution - which was actually about democracy and human rights - as an insurgency of Salafist jihadists," Becker said. At the same time, Becker added, Assad granted amnesty to a number of imprisoned jihadists at the start of the uprising, in the knowledge that they would try to establish terror cells in Syria: "He stood back and watched as jihadists spread across the country. He did everything he could to radicalize the forces at play in the revolution in order to support his narrative." Context Three decades ago, the Philippine higher education in De La Salle University was criticized by Bro. Andrew Gonzales. Philippines was noted of having had the third highest proportion of young adult population attending tertiary level schools. It was even accused of overtraining people yet creating unemployment. It was further noted that our college and university students had only 10-year basic education which was not efficient and sufficient to make quality tertiary graduates, unlike other countries’ graduates like Singapore which had 12-year education and two years of national service before university. Despite this reality that college graduates were really lacking some knowledge and skills to prepare them in the field of work, students would just take a course and began working. They would not consider graduate school unless it would enhance job opportunities. Experience Right after secondary school, I went immediately to tertiary school, taking a course of my choice-Bachelor in Elementary Education. For four years, I studied hard. Although I had high regards

and trust to my teachers (most of them were education supervisors of Region X and of Division of Cagayan de Oro City), I also did my own independent learning. I could say that my college experience was worthwhile. When I got a job, it was then when I realized that there were still so many things that I needed to learn. I studied, researched, and attended trainings and seminars so that in the following school year, I would already know how to teach in my assigned grade level. I did it in the following years. Reflection Being in the educational system for eighteen years, I could say that I have done the task expected of me and have done it right. Being with the Department for quite a long time, I have watched my colleagues being promoted and enjoyed a higher salary. These were the people who really found time to go to graduate school. They spent time and money to earn even some units in master’s degree. For whatever reason they have in pursuing graduate studies, I guessed they benefited from it. Application It might be true that taking graduate education is costly. It might also be difficult to juggle work and schooling and family. Nevertheless,

personally, I could feel that graduate education is very important not just for job promotion but above all for personal and professional growth. If given the chance to be a school head, I will encourage or even require teachers to go to graduate school. Mindanao Daily B5 BUSINESS NEWS The mockery of the ‘National Economy’ law THE “Cha-Cha” or Charter Change is resurrecting in Congress. Indeed, some provisions of the 1987 Constitution, particularly on the issue of ownership by foreign and Filipino investors of businesses in the country, need amendment. The present constitution provides that the foreign investors should own only 40 per cent of the business while the remaining 60 per cent belongs to local or Filipino investors. The law implies about the total capital investment of a certain intensive business endeavor. For instance, if a business endeavor needs a capital investment of P 100 million, the present law provides that the P 60 million capital should be owned by the Filipinos while the remaining P 40 million for foreign partners. Article XII of the 1987 Philippine Constitution’s “National Economy and Patrimony,” is very clear that the sole ownership of businesses in the country should be reserved only for Filipino citizens. It seems, however, that constitutional provision of the National Economy and Patrimony no longer appeal to the present legislators. The amendment is imperative. Yet, before anything else, it is quite interesting to have an empirical review of the actual application of the law. The Section 10 of Article XII of the National Economy and Patrimony law, provides that…” when the national interest dictates, reserve to citizens of the Philippines or to corporations or associations at least sixty per centum of whose capital is owned by such citizens, or such higher percentage as Congress may prescribe, certain areas of investments.” The Section 11 provides that “the participation of foreign investors in the governing body of any public utility enterprise shall be limited to their proportionate share in its capital, and all the executive and managing officers of such corporation or association must be citizens of the

There is the notion that Section 10 and 11 of Article XII are classic examples of the “law of ambiguity.” It simply means “loopholes.” The phrase “when the national interest dictates” in Section 10 is a very disturbing provision. What does “national interest” means? The interrogative word “when” implies an ambiguous presumption that a lawyer could cleverly convert to favor a condition or situation. If the condition is presumed to be not of national interest, would the foreign investor owns the sixty per centum capital? Again, there is an apprehension that the provision of Section 11 is not followed in its real sense of the word. Who owns and control the corporations of foreign and Filipino investors in the Philippines? In truth and, in fact, the foreign investors owned and control the corporation because they control the majority of the investment. How? While the Filipino investors divide among three or four Filipino capitalists the 60 per centum capital investment, the foreign counterpart solely owns the remaining 40 per centum capital. By operation of the law, the foreign investor who solely owns the 40 per centum stocks of the corporation becomes the majority owner of the corporation. SSF is a livelihood assistance program aimed at allowing Micro Small Medium Enterprises (MSMEs) access to better technology and more sophisticated equipment to improve the salability, production and global competitiveness of their products. “The SSF project is aimed at assisting some 81, 221 SMEs with a good growth potential,” said Ma. Eliza A. Pabillore, DTI Misamis Oriental Provincial Director, organizer of this year’s event. “It also aims to

generate 200,000 new jobs all over the country.” Although the number of exhibitors declined to 51 from 82 in the previous year and the exhibit duration cut to five days, Kahimunan 2013 nevertheless registered a 74% increase in total sales. Cash sales declined 28% but this was more than compensated for by the astounding 641% increase in booked sales. For this year, 51 small and medium enterprises from the five provinces of Northern Mindanao are showcasing the region’s best products at the Kahimunan Northern Mindanao 2014 Food and Lifestyle Show which concludes this weekend at SM City, Cagayan de Oro City. Kahimunan 2014 is a core event of the Higalaay Kagay-an Festival 2014, the annual city fiesta festival of Cagayan de Oro City. For the first time in its four year run, the show will recognize the Best Product Design for Housewares & Furnishings and Fashion Categories and the Most Innovative Food Product. THE Cagayan de Oro Chamber of Commerce and Industry Foundation, Inc. (Oro Chamber) will host the Mindanao Food Congress 2014, the largest gathering of agriculture and food industry players, government policy makers, exhibitors, businessmen and consumers in Mindanao. The Civil Aeronautics Board (CAB), in a recently concluded board meeting, granted additional entitlements to the Philippines' leading carrier, Cebu Pacific (PSE: CEB) for 5 international routes from Manila to Singapore, Myanmar, New Zealand and Macau; and from Cebu to Hong Kong. Cebu Pacific was granted seven flights weekly from Manila to New Zealand and 1,260 entitlements from Manila to Singapore, allowing the airline to upgrade its current daily Airbus A320 service to an Airbus A330 service. In the same meeting, CAB designated Cebu Pacific Air as an official Philippine carrier to New Zealand, Myanmar, and Canada. Cebu Pacific's opposition to extension of the codeshare agreement between Philippine Airlines (PAL) and Emirates on the Manila-Dubai route which is set to expire in October 2014 was also granted by the CAB. ZAMBOANGA City––The government mechanic who was seized last August 16 by the Abu Sayyaf brigands was released in a secluded place in the province of Sulu. Ronald Pelegrin, 38, said the Abu Sayyaf brigands released him Wednesday after sunset in Barangay Danag, Patikul, Sulu. From there, Pelegrin said he walked to the Provincial Engineer’s Office in downtown Patikul, where he is employed as chief mechanic. The Provincial Engineer’s Office contacted the Anti-Kidnapping Group (AKG). Pelegrin, escorted by AKG personnel, boarded a commercial ferry and arrived in this city early Thursday. Butuan fire destroys mall By PAT SAMONTE-Caraga Regional Editor

UTUAN City - A commercial building was destroyed in a fire investigators believed to have come from a faulty electrical connection near the corner of J. C. Aquino Avenue and Montilla Boulevard here Wednesday evening. What remained of ASIALINK Central Mall which sold mostly clothes and clothing materials after the conflagration were burnt and unburnt residues of these goods and concrete posts. Fire Investigator FO3 Virgilio Germata estimated the damage to reach P8 million. According to Germata, the blaze started at 10:10 pm at the second floor of the building based on the security guard’s account. He said four firetrucks from the Butuan City Fire Station immediately responded and arrived at the fire scene, a half kilometer away from the station, three minutes later. As the local firemen fought the blaze, a firetruck from Barangay Ampayon Fire Sub-station, another from Gaisano Mall, and two others from Buenavista, Agusan del Norte Fire Station and Bayugan, Agusan del Sur Fire Station arrived to assist. The firetrucks were posted at strategic points to prevent the fire to spread to adjoining Jollibee and Butuan City Colleges buildings. The whole effort was headed by Senior Inspector Rey Antonio Restauro, Garmata pointed out. The blaze was put under control at around 7:40 am Thursday, Germata said. Germania added an investigation on the fire was still on-going and its result will be released in due time. Meanwhile, Asialink’s owner Josefina Chan and manager Wilson James Chua could not be contacted.

DIPOLOG CITY – The city government here through the City Assessor’s Office (CAO) in collaboration with the Sangguniang Panlungsod is now conducting a series of public hearings on the proposed revision of real property taxes in eight clustered barangays. This undertaking is in response to the directive issued by the Department of Finance (DOF) urging the assessor’s office to effect revisions on the market values and assessment level including the classification of real properties in the city for the 2014 General Revision of Real Property Assessment as mandated by Republic Act 7160 or the Local Government Code of 1991. The last revision on real property assessment made by the city government was in 2007. “Supposedly, as provided under the law, the provincial, city or municipal assessor shall undertake a general revision of real property assessments every three years but it is only this year that

we will make revisions from 2007,” Liza Rasonable of the City Assessor’s Office said in an interview with the Philippine Information Agency (PIA). She added that for purposes of assessment, real property shall be classified as residential, agricultural, commercial, industrial, mineral, timberland or special including the buildings built thereon. The said public hearing will conducted in four remaining clusters remaining clusters, namely: Barangays of Galas and Olingan on Sept. 1; barangays Punta, Sinaman and San Jose on Sept. 3; barangays Cogon, Diwan and Sangkol on Sept. 5; and barangays Central and Miputak on Sept. 8. parents do not care to assist and supervise their children and their studies at home, the dream of quality education cannot be attained. Hence, the parent’s help is a must in the learning process. Their guidance and assistance is badly needed to

attain quality education in public elementary schools, they have a very vital role in teaching-learning process and teachers on the other hand, give their best level so that each pupil will learn fast and easily all the subjects being taught.
