Davao’s advisory center helps investors find best locations

AVAO City - The establishment of an advisory center by the Davao City Investment and Promotion Center (DCIPC) will make life easy for prospective in-

vestors in this city to know the best place to locate their investment projects.

DCIPC head Ivan Cortez said the center is managed by their office and this is aimed at helping prospective investors and the

micro, small and medium entrepreneurs in finding the area suited for their businesses.

Cortes said “It has been our objective to bring investments also to other areas of the city, adding that there

are still areas here with less business activities and we wanted to bring these new projects there.”

He said that through the advisory center there could be proper distribution of businesses instead

of settling in one area with similar products or businesses.

Meanwhile, Cortez said they are in talks with other local government units with regards to entry of investors in Davao.

CLARIN, Misamis Occidental – The Forest Products Research and Development Institute (FPRDI) from Los Ba?os, Laguna has given the bamboo industry, here, a boost with a 10-day training on bamboo processing.

Aimed to enhance the know-how, as well, as share and learn skills with the local bamboo growers, the training held August 19-28, at the Municipal Gym, was conducted under the Enhanced Livelihood Support Activity (ELSA) program of the local government unit (LGU).

Included in the training are drying, EBamboo handicraft and furniture making and finishing and the proper use and care of equipment and transfer of modern technology, specifically in the bamboo industry, mayor Elsa F. Navarro said.

Navarro said the FPRDI has encouraged the use of bamboo as a high value product because of its potential for environmental protection in preventing soil erosion and sequestration of carbon.

The city mayor has been incessantly coordinating with PCA-Gingoog Field Office workers led by Donato Jomen for the increase of coco production which translates to farmers’ economic progress and familial welfare in general.

She extends her sincere congratulations to PCA for generously considering the long-awaited plan of the coop represented by its chairman of the Board of Directors Anacleto Mejares in availing such grant for Coconut Coir Decorticating Plant to be built at barangay Pangasihan from the Japanese government through Japan-ASEAN Integration Fund-Emergency Economic Assistance (JAIFEEA) via a project entitled “Strengthening of the Small Holder Coconut-based Industries Project.”

The mayor said this administration also gives life to farmers and to their coco farms.

In offering economic acceleration to coco farmers, the city government’s counterpart to this promising investment is the donation of the parcel of land measuring to 10,000 square meters located in Pangasihan wherein the processing plant will be constructed.

Furthermore, the chief executive has expressed her warm felicitations to all GinFAMCO members for a dream-come-true due to their arduous undertakings in making this Japanese grant into a reality.

She has been encouraging all cooperators to work hard and offer their commitment for the success of this millionvalued investment.

Her regime is aware that Gingoog is popularly known as “coconut city” wherein numerous coco farmers are depending their livelihood on coconuts, hence she has been doing ways to increase their production together with PCA’s services to them.

While concentrating on cocos, the city government works closely with the

KAANIB Enterprise Development Project (KEDP) by implementing coconut-coffee based intercropping project among the city’s nine sites covering 350 hectares, by realizing coconut timber utilization project, by sharing counterpart for coco sugar production at Brgy. Agayayan. Further, by having cacao and corn intercropping.

In addition, she has been linking with the City Agriculturist Office head Eduardo Sanchez in facilitating the 25,000 bags for salt fertilization program with PCA. Besides, her personnel have been fielding out for the coconut seedling dispersal project aiming to cover city’s 150 hectares.

Meanwhile, Jomen praises mayor Guingona’s full support for farmers’ betterment.

Nat’l ICT Summit to review ASEAN ICT Masterplan

DAVAO CITY -- The upcoming 6th Summit of the National ICT Confederation of the Philippines (NICP) hosted by Davao City on October 24, 2014, will highlight the ASEAN ICT Masterplan in preparation for the BIMP-EAGA Fair also in October.

NICP chairperson Lizabel Holganza said the review is necessary in order for the ICT sector to know what initiatives the government had put in place in the master plan.

Holganza said the Summit will be held in time for the 2014 Brunei Darusalam-Indonesia-Malaysia-Philippines East Asean Growth Area (BIMP-EAGA) and Indonesia-MalaysiaThailand Growth Triangle (IMT-GT) Trade Fair and Business Leaders Conference on October 23 to 26, 2014.

The national summit will also be joined in by the respective ICT councils of the five countries and we

are expecting about 300 to 400 delegates, she said.

According to her, it is also important to look into the rising opportunities within the five countries, Brunei, Indonesia, Malaysia, Philippines, Thailand.

She said there are opportunities in Brunei where ICT infrastructure is good but could be lacking in talents.

She said “Our country could come in given the edge of the English speaking human resource.” There are so many areas to look at and ICT would play an important role, she added.

Also, Holganza highlighted a trend among big multinational companies directing their corporate social responsibility to the marginalized communities.

With this, she said the directions are geared towards establishing centers in the community where the youth, the women could be tapped to do less complicated internet driven work.

Smart Communications’ data exchange up by 121% in 1H

mart Communications, Inc. (Smart) saw a 121 percent surge to over 15,000 terabytes (or 15 million gigabyte) of data exchanged through its network for the first half of the year.

In a statement, Smart noted that the availability of content services such as mobile music, books, magazines, games, and video offered by Smart has contributed to the fast-rising user demand for mobile data.

The company is making multimedia content more accessible through its expansive 4G-LTE network nationwide.

Smart Chief Wireless Advisor Orlando B. Vea said in a statement that the company is making the leap toward 5G network connectivity to deliver the best mobile multimedia experience to users.

Vea said that this would be made possible by the recent activation of its first ‘5G’ LTEAdvanced site in the country in Mandaluyong City.

He also said that the availability of a robust mobile network and multimedia content offerings has likewise contributed in smartphone adoption among Smart’s subscribers.

Currently, more than a 20 percent of the telco’s user base is using Internet-enabled smartphones, which can be used to access multimedia services “All of these mobile multimedia services require a ‘supercharged’ network that can deliver the necessary bandwidth to make the user’s experience seamless and hassle-free,” Vea said.

“This is a promise that only Smart can deliver today,” he added.

At present, Smart leads in the deployment of highspeed mobile broadband in the Philippines, with the country’s largest 4G network.

P1.5-B for 3 resort projects readied over Cebu, Palawan The Cebu-based Unchuan Development Corporation, the operator of Cebu White Sands Resort and Spa, will pour PHP 1.5 billion investments on three big-ticket projects starting next year.

Francisco Unchuan, the company’s president and chief executive officer, said the group will develop a six-star island resort to be called Abana Island Resort on the three islets called “Islas Tres Rosas,” located across Mactan Island.

Unchuan said this Maldives-inspired development will have 16 exclusive cottages.

The company is finalizing plans to develop the

close to 40 hectares mountain resort at the southern part of Cebu in Barili town.

He said they will build a few cottages for visitors but the resort will be dedicated to farm lovers.

RTA’s implementation of traffic rules Implementing traffic rules in this city of Golden Friendship are on the right track. At least, this is the perception of the public, especially commuters, who seek convenient travel and sightseeing in highly-commercialized areas like the Divisoria Park.

We agree with Czar, Atty. Egay Uy and RTA head Deloso that soon the clamor for “Hapsay Dalan” will be addressed fully.

Jaywalking areas, however, must be fully identified and the public needs to be taught about the me aning painted signs because Editorial not all drivers and commuters are fully knowledgeable of these.

Media, on the other hand, has the duty and responsibility to help promote these traffic rules and regulations by urging the public to obey such. In the end it is only the public who will suffer inconvenience if they do not cooperate.

Take for example the rule on “Yellow Box.” Commuters must be taught why they should alight or take a ride in the Yellow Boxes only.

In Metro Manila, the commuters and waiting passengers are now disciplined to “tow the line,” meaning, they have to make a line in order to board passenger vehicles.

Drivers and motorists, on the other hand, must stop when there are people crossing the streets.

They should also follow the regulation of 20 kilometers per hour (kph) speed when near schools and public places. These will avoid accidents, and inconvenience to the commuters.

Using the assigned pedestrian lanes is also important and necessary because if people will cross streets wherever they want to, easy traffic would be hampered, and there would even be risks of accidents.

Kudos to the City Government’s initiative on the traffic improvement, and the RTA’s implementation. Indeed Cagayan de Oro needs it as the country’s most competitive city.

Blaming Manila

CAGAYAN de Oro City–– Remember how Mindanao came to be billed as “The Land of Promise”? It was to hype up the interest of the landless and dispossessed in Luzon and other parts to move here and colonize it.

Mindanao was the Promise Land according to the gospel of Manuel L. Quezon, master demagogue, famed for declaring he would prefer a Philippines “run like hell by Filipinos than like

heaven by Americans”—a sort of doomsday prophecy that became reality and continues to bedevil our society to this day.

Leadership challenge If you head a business organization, a government agency, or even a church, by now you must be able to recite the benefits of a positive team spirit in the organization. It is not hard to pinpoint that being able to realize your vision and mission is the overarching be-all and end-all of having an organizational atmosphere where people, after discussions and agreements reached, are headed to the same direction with enthusiasm that impact positively those they journey with.

A leader worth his perks knows that a positive team spirit is about him and the people he leads, the main characters in building a positive organizational life. Let us start with the people. I came across an online discussion (http://coachhuey.com) that mentioned four basic types of people in the organization and I am using this typology here. These are the adders, the subtractors, the multipliers, and the dividers.

The adders are those who make positive contribution to the organization.

They use their talents to the hilt, give their best to the work assigned to them and in the process contribute in attaining the goals of the organization. They are enthusiastic about doing their work and turn in good outputs. However, they do very little or nothing at all to have a positive impact on others.

As the label indicates, subtractors subtract from the organization. They are characterized with lack of involvement, staying in the background and devoid of any interest in how the organization can attain its objectives. If there is good at all about the subtractors, it is the fact that these people do not actively spread a bad attitude, though being what they are already stirs whatever little unhappiness and malaise in those around

LANDBANK on track to meet full-year profit target of P12B

L

ANDBANK reported a net income of P 6.0 billion for the first half of the year, 29 percent lower than the P 8.5 billion registered in the same period last year.

But despite the decline, the Bank remains confident in meeting its full-year profit target of P12 billion.

“The decrease in our net income is due primarily to lower trading gains as brought about by unfavourable market conditions, which is prevalent among the country’s largest lenders.

We still managed to surpass the year-to-date target net revenue by 5 percent and remain on track to meet our

year-end target net income,” said LANDBANK President and CEO Gilda E. Pico.

The Bank’s BASEL 3 Capital Adequacy Ratio also remains strong at 15.5 percent.

LANDBANK’s total assets grew by 38 percent to P942 billion from P 681 billion last year. Total deposits likewise registered significant growth to P 808.4 billion, 49 percent higher than the P 542.8 billion in June last year. Total capital meanwhile stood at P 70.4 billion.

The Bank’s return on equity and net interest margin at 12.7 percent and 3.6

percent remain higher than the latest industry average of 10.1 percent and 3.2 percent, respectively.

LANDBANK celebrated its 51st anniversary last August 8, with the launch of its new tagline, “We Help You Grow” to further cement its commitment to help its clients and publics grow.

BSP bans issuance of pre-approved credit cards MANILA - The Bangko Sentral ng Pilipinas (BSP) has put a lid on the issuance of pre-approved credit cards.

In a Circular, the central bank defines preapproved credit cards as the “unsolicited credit cards issued by credit card issuers to consumers who have not applied for such credit cards.”

The circular also defined the term “applica-

tion” as “a documented request of the credit card applicant to a credit card issuer for the availment of a credit card.” ” The intention and consent for the availment of the credit card must be clear and explicit,” it said.

The central bank has identified seven acts on the part of the credit cardissuing entities that are equivalent to issuing preapproved credit cards.

These include sending of credit cards to consumers with no prior application and sending of unsolicited supplementary cards that are not replacement or substitute to the initial credit card.

Banks will also be considered to have violated the rules if their staff made unsolicited calls to card holders to request for updated information in exchange for a reward.

Banks are also prohibited to send via mails credit cards that “will be deemed accepted upon the receipt of such card by a receiver, whether authorized or not.”

The central bank has been vigilant against the issue of credit cards after receiving lots of complaints such on the interest rate and the alleged harassment by credit card collecting agents. (PNA)

MILF commander, village chief son killed in ambush by rival rebel commander in Maguindanao

COTABATO CITY – A brigade commander of Moro Islamic Liberation Front and his son, a barangay chairman, were killed in an ambush by a group of another MILF commander in Sultan sa Barongis town in Maguindanao.

Tanialap Utap, the town administrator of Sultan sa Barongis, confirmed the killing took around

noontime Wednesdaywhen the father and son victims was traversing the area of Barangay Tugal aboard a motorcycle.

Senior Supt. Rodelio Jocson, Maguindanao provincial police director, identified the victims as Kumander Tato Mohammad and Ankayamat barangay chairman Sadam Mohammad.

“We had conducted investigation and identified the suspects

based on the statement of the witnesses,” Jocson said, relaying the statement of his police chief on the ground, Inspector Cesar Ibal Jr. Investigation revealed that the killing was headed by a certain Kumander Taya, supposedly of the MILF’s national guard and long-time adversary of Mohammad.

There is reportedly a long-standing land dispute and political rivalry

among the two.

Assemblyman Khadaffy Mangudadatu, representative of the second district of Maguindanao in the Regional Legislative Assembly of the Autonomous Region in Muslim Mindanao (ARMM) and vice chair of the committee on public order and security, urged the MILF central committee to resolve the internal problem among their ground commanders.

“Let the CCCH (Coordinating Committee on the Cessation of Hostilities) and AHJAG (Ad-hoc

Joint Action Group) do their job”, he said.

Mangudadatu also called the attention of Maguindanao Task Force Reconciliation and Unification (MTFRU) to immediately intervene in the area to contain any escalation of the conflict and safeguard the interest of the civilians.

Jocson added that the Maguindanao police has coordinated with the local government of Sultan sa Barongis and the MILF hierarchy to extend all efforts to curb any attempt of escalation of conflict.

According to Toks Upam, of the MILF-CCCH’s monitoring team in Maguindanao, the MILF central committee has called the attention of the ground commanders from both parties for an emergency meeting today (Thursday) in the MILF’s main headquarters in Camp Darapanan, Sultan Kudarat town in Maguindanao to address the conflict.

CA stops NTC order to telcos to refund subscribers

THE Court of Appeals (CA) has stopped the implementation of an order by the National Telecommunications Commission (NTC) directing the telecommunications companies (telcos) to refund to their subscribers the excess collection from text messages or the short message service (SMS).

The CA’s Sixth Division has issued a temporary restraining order (TRO) as prayed for in the petition filed by the Digitel Philippines Incorporated (Digitel).

In a four-page resolution dated Aug. 20, 2014, the CA stopped the implementation of the Nov. 7, 2012 and May 7, 2014 order of the NTC directing the telcos to make a refund to their subscribers because of excessive collection in their SMS rate.

CAGAYAN DE ORO CITY -- The New People’s Army (NPA) admitted responsibility to the assasination of a municipal councilor last Thursday, August 21, at Opol, Misamis Oriental.

In s statement issued after the ambush of town councilor Cecilio “Anggong” Abuhan, the NPA said a team under the Regional Command of the North Central Mindanao Region assasinated Councilor Abuhan, at 4:00 pm on August 21, 2014, at Bagocboc, Opol, Misamis Oriental.

Abuhan succumbed to eight bullet wounds -- six in the head and two in the body.

He was riding a single motorcycle when ambushed by armed men who escaped using motorcycle and hid their identities by using helmets.

DAVAO City––Close to a thousand micro, small, medium entrepreneurs (MSMEs) joining the just-concluded two-day National MSMEs Summit in Davao City, were assured by Department of Trade and Industr y (DTI) Secretary Gregorio L. Domingo on unifying and simplifying procedures for business registrations.

S ecretar y Domingo, who was the speaker at the MSMEs summit held at the SMX Convention Center on August 20–21, said the Go Negosyo Act authored by Senator Bam Aquino will serve as basis for a more unified and simplified procedures to help small entrepreneurs.

“Under the new Act, the DTI is tasked to es-

tablish Negosyo Centers in all provinces, cities and municipalities in all provinces, cities and municipalities in the country that will provide a unified and simplified business registration process through the Philippine Business Registry System and the Business Permits and Licensing System,” he said.

He said DTI at present, is finalizing the Implementing Rules and Regulations of the Go Negosyo Act, adding that oversight of the Negosyo Centers is vested in the Micro, Small and Medium Enterprise Development (MSMED) Council where it is tasked to make it substantially easier to establish business anywhere and everywhere.

It is aimed also to provide enabling environment for entrepreneurship to further grow and flourish throughout the country.

Among others, Domingo also highlighted that Go Negosyo will facilitate market linkages to develop and sustain competitiveness of MSMEs and help sell their products and services to existing and new markets both domestic and international.

Aside from facilitating access of funds to financial assistance and grants such as start-up funds, it will also design and undertake programs that will promote entrepreneurship, particularly among the youth and women.

Domingo on the other hand, acknowledged the

hosting of Davao City for the National MSMEs Summit as it is fitting that Davao is the venue being a haven for business especially for MSMEs and primary destination for wholesome tourism.

He said Davao ranked as the country’s 4th most competitive city in the entire country, did well in economic dynamism and scored high in government efficiency and ranked first in infrastructure adequacy.

The customer as a king?

WITHOUT further ado and on the spot, I have been connected to the “Big Boss” of a well known company.

Innumerable complaints had been made without success.

I wondered why, because I really didn’t plan to waste the General Manager’s time, who really has other things to do than listen to my problems. But experience showed that this is really the only way sometimes.

Is a customer still a king?

I’m sorry to say: many times no more. Many times we are not even the king’s lackey anymore.

“After sales service” or “friendly and polite customer services” seem to become foreign words.

The clientele and even regular customers disappear more and more while expecting a supposedly better service from the competitors. Sure, being in competition with each other can be found at any corner. It’s necessary and important.

But, the customer seldom remains as a king.

If a reception/telephone operator of a well-known hotel doesn’t use his/her training, experience and common sense on how to approach a caller/a customer, the receptionist is out of place. The telephone switchboard of every company is its calling card and sign.

If a secretary insists steadfast on her opinion that I should send my fax “next time” because she cannot load the fax machine with a new paper roll - okay, Miss, don’t be surprised if your boss will know about it one day. By the way: such things didn’t happen only once or twice.

If the sales staff of a big shopping mall act like an incompetent dope or sleepyhead - okay guys,

If I decide to dine out in a gourmet or the connoisseur restaurant as well as in a middle class one, I do expect a professional service and customer friendliness.

Sure, I wish to pay but I don’t plan to wait the moment the waiter might be finished muttering and messing about with his colleagues.

We are all servants to each other in our daily lives.

The J.R. Borja Memorial City Hospital (JRBMCH) was established through the vision of former Mayor Justiniano R. Borja on August 25, 1963 as a primary hospital to serve the health care needs of the populace of Cagayan de Oro City, particularly the poor and the indigent, who could not afford hospital care.

It was constructed on a 3-hectare lot donated to the city government by the Villarin family.

“At that time, central government was still in full control, local governments had no power, everything we needed we had to ask from the central government,” he noted. “Now we want to continue that dream especially with the empowerment of local government through the Local Govt Code incidentally also authored by a former mayor of Cagayan de Oro.” By virtue of City Ordinance in 10209-2006, the J.R. Borja Memorial City Hospital was renamed to the J.R. Borja General Hospital.

“When we took over last year there was still much to be desired but thanks to our team, the City Government, DOH and Philhealth for

supporting us in upgrading JR Borja,” said Mayor Moreno in a hospital held at the facility last year in honor of the visiting Interplast Australia and New Zealand surgical team. “Of course and partners like Rotary and our Australian surgeons from Interplast.

We intend to elevate JR Borja to greater heights.”

“I have no doubt at all and very confident JR Borja Hospital’s upgrade will take place. Thanks to our friends from Australia, for having confidence already in JR Borja Hospital at this time when we had to literally scamper in order to prepare the hospital given the little time that we had and we are happy with the way the hospital has been able to assist them in this venture,” he said. “We hope that JR Borja Hospital would be properly equipped so activities like this would be a normal occurrence here.”

Nancy wants Senate to probe child’s death SENATOR Nancy Binay has filed a resolution calling for an inquiry on the alleged refusal of hospitals to admit persons in need of immediate medical attention and to discharge patients when unable to provide deposit or payment of hospital dues, respectively.

The senator filed Senate Resolution No. 837 as response to information about a certain hospital’s alleged refusal to admit a child that was suffering from congenital heart disease, diabetes and kidney problems because the mother could not pay for the admission deposit for the intensive care unit in full.

The senator cited Article XIII, Section I of the 1987 Philippine Constitution which said that “The Congress shall give highest priority to the enactment of measures that protect and enhance the right of all the people to human dignity, reduce social economic, and political inequalities, and remove cultural inequities by equitably diffusing wealth and political power of the common good.”

S e n at or Bi n ay a l s o pointed out that Republic Act No. 8344, Section I states that “In emergency or serious cases, it shall by unlawful for any proprietor, president, director, man-

ager or any other officer, and/or medical practitioner of employee of a hospital or medical clinic to request, solicit, demand or accept any deposit or any other form of advance payment as a prerequisite for confinement or medical treatment of a patient in such hospital or medical clinic or to refuse to administer medical treatment and support as dictated by good practice of medicine to prevent death or permanent disability.”

Furthermore, R.A. 9439, Section I, provides: “It shall be unlawful for any hospital or medical clinic in the country to detain or to otherwise cause, directly or indirectly, the detention or patients in the country who have fully or partially recovered or have been adequately attended to or who may have died, for reasons of nonpayment in part or in full of hospital bills or medical expenses.”

“These are the laws on

healthcare in the country and yet, it seems that the Department of Health has been lax in ensuring that hospitals comply. The 1987 Constitution, clearly states that we have to look into cases like the death of this 10-year-old child.

“Meanwhile R.A. 8344 and R.A. 9439 prove that hospitals should not be implementing unjust practices. Sinasabi po sa batas na karapatan po ng mamamayang Pilipino ang mabigyan serbisyong medikal, isa po ito sa mga bagay na dapat siguraduhin ng ating gobyerno at sana po ay suportahan natin ang mga hakbang upang maisakatuparan ito,” Binay said.

QUINTILLA “AN ORDINANCE REGULATING THE USING , SELLING AND ADVERTISING OF TOBACCO PRODUCTS AND IMPOSING PENALTIES FOR VIOLATIONS THEREOF AND FOR OTHER PURPOSES”.

SECTION 1. Title – This ordinance shall be known as “AN ORDINANCE REGULATING THE USING, SELLING AND ADVERTISING OF TOBACCO PRODUCTS AND IMPOSING PENALTIES FOR VIOLATIONS THEREOF AND FOR OTHER PURPOSES”. Or otherwise known as “SMOKE FREE ORDINANCE OF IMELDA, ZAMBOANGA SIBUGAY”.

SECTION 2. Purpose – it is the purpose of this ordinance to safeguard public health and ensure the wellbeing of all its constituents by protecting them from the harmful effects of smoking and tobacco consumption, reducing potential exposure to tobacco marketing and advertising, restrict its accessibility and provide support and a conducive environment for tobacco users to quit.

SECTION 3. Coverage – This Ordinance shall apply to all persons, whether natural or juridical, whether resident or not, and in designated places, found within the territorial jurisdiction of Imelda, Zamboanga Sibugay.

SECTION 4. Definition of Terms – As used in this Ordinance, the terms below shall have the meanings ascribed to them in this section. Any words or terms not defined shall be given their plain and customary meanings, unless the context requires otherwise, and shall be interpreted in a manner consistent with the purpose and spirit of this Ordinance. a) Advertising and promotion – means any form of commercial communications, recommendations or action with the aim, effect or likely effect of promoting a tobacco product or tobacco use either directly or indirectly. b) Civil society organization (CSC)- refers to a legally constituted voluntary civic and social organization or institution created with no participation of government organizations, including but not limited to charities, development non-governmental organizations (NGOs) community groups, women organizations, faith- based organizations, professional associations coalitions and advocacy groups duly recommended by the Office of the Municipal Health Officer and approved by the Municipal Mayor. As used in this ordinance, CSO does not include organizations or associations related to or connected with the tobacco industry in any way. c) Designated Smoking Area- refers to an outdoor space, duly approved by the Municipal health Officer, where smoking may be allowed without violating this ordinance, that meets the following requirements: 1) It shall not be located in an open-space with no permanent or temporary roof or walls in an outdoor area.

2) It is not located in entrances, exits, or any place where people pass or congregate.

3) It shall not have an area larger than 10 square meters.

4) Food or drinks are not served in the designated smoking area.

5) No building shall have more than one designated smoking area.

6) Minors or persons below the age of 18 shall not be allowed inside.

7) The designated smoking area has the following signage highly visible and prominently displayed: a) “Smoking Area” signage with message showing “Minors not allowed within these premises. b) Graphic health warnings on thee effects of tobacco use.

8) It shall not be located in places where absolute smoking bans are in effect, such as; but not limited to: centers of youth activity such as playschools, preparatory schools, elementary schools, high schools, colleges and universities, youth hostels and recreational facilities for persons under eighteen (18) years old; elevators and stairwells; locations in which fire hazards are present, including gas stations and storage areas for flammable liquids, gas, explosives or combustible materials; within the buildings and premises of public and private hospitals, medical, dental and optical clinics, health centers, nursing home dispensaries and laboratories; public conveyances and terminals; food preparation areas and other areas where absolute smoking ban is imposed under current laws, administrative and executive orders, memorandum circular and other policies. d) Enclosed or partially enclosed – means being covered by a roof or enclosed by one or more walls or sides, regardless of the type of material used for the roof, wall or sides, and regardless of whether the structure is permanent or temporary. e) Minor – refers to any person below eighteen (18) years old. f) Outdoor advertisement – refers to any sign, model, placard, board, billboard banner, bunting, poster, streamer, light display, device, structure or representation employed outdoors wholly of partially to advertise or promote a tobacco product to the public. g) Person-in-charge – refers to: in case of public places, public outdoor spaces and workplaces, the president/manager in case of a company, corporation or association, the owner/proprietor/ operator in case of a single proprietorship, or the administrator in case of government property, office or building, in case of public conveyance, the owner driver, operator, conductor, or the captain of the public conveyance; in case of schools, the provincial/municipal/city schools superintendent or the principal. h) Point-of-sale – refers to any locations at which an individuals can purchase otherwise obtain tobacco products. i) Public conveyance – refers to modes of transportation servicing the general population, such as, but not limited to elevators, airplane ships, jeepneys, buses, taxicabs, trains, light rails transits, tricycles, and other similar vehicles.

J) Public places- means all places, fixed or mobile, that are accessible open to the public or places for collective use, regardless of ownership or right to access, including but not limited to, schools, workplaces government facilities, establishments that provide food and drinks accommodation, merchandise, professional services, entertainments or other services. It also includes outdoor spaces where facilities are available for the public or where a crowd of people would gather, such as, but not limited to, playgrounds, sports grounds or center, church grounds, health/hospital compounds, transportation terminals, markets, parks, resorts, walkways, entrance ways, waiting areas, and the like. k) Second-hand smoke – means the smoke emitted from the burning end of a cigarette or from other tobacco products usually in combination with the smoke exhaled by the smoker. l) Smoke free air – is air that is 100% smoke free. This definition includes but is not limited to, air in which tobacco smoke cannot be seen smelled, sensed or measured. m) Smoking – means being in possession or control of a lit tobacco product regardless of whether the smoke is being actively inhaled or exhaled. n) Tobacco Products – means products entirely or partly made of the leaf tobacco as raw material which are manufactured to be used for smoking, sucking, chewing or snuffing such as but not limited cigarette, cigar, pipe and chewed tobacco. o) Tobacco Industry – refers to organizations, entities, associations, and individuals that work for or in behalf of the tobacco industry, such as, but not limited to, tobacco manufacturers, wholesale distributors, importers of tobacco products, tobacco retailers, front groups and any other individuals or organizations, including, but not limited to lawyers, scientist and lobbyists that work to further the interests of the tobacco industry that compete with those of tobacco control. p) Tobacco Industry Interference- refers to a broad array of tactics and strategies used by the tobacco industry to interfere with the setting and implementation of tobacco control measures. q) Workplace – means any place used by people during their employment or work, whether done for compensation or voluntarily, including all attached or associated places commonly used by the workers in the course of their work (for example, corridors, elevators, stairwells, toilets, lobbies, lounges). Vehicles used in the course of work are considered workplaces.

SECTION 5. Prohibited Acts – the following acts are declared unlawful and prohibited by this Ordinance: a. Smoking in enclosed or partially enclosed public places, workplaces, public conveyances (whether mobile or stationary) or other public places, as defined in Section 4; b. For persons in-charge to allow, abet or tolerate smoking in places enumerated in the preceding paragraph; c. Selling or distributing tobacco products in a school, public playground or other facility frequented by minors,(option: offices of the Department of Health (DOH) and attached agencies, hospitals and health facilities), or within 100 meters from any point in the perimeter of these places); d. Selling or distributing tobacco products to minors; e. Purchasing tobacco products from minors; f. Placing cinema and outdoor advertisements of tobacco products; g. Placing, posting, or distributing advertising and promoting materials of tobacco products, such as leaflets, posters and similar materials, in any place outside the premises of point-of-sale establishment. h. Placing posting or distributing advertising & promoting materials of tobacco products, such as leaflets, posters & similar materials, even inside the premises of point-of-sale establishments when the establishments are not allowed to sell distribute tobacco products, as in Section 5 (c) above SECTION 6. Duties and Obligations of Persons in-Charge - Persons in -Charge shall: a) Prominently post and display “No Smoking” signages in the locations most visible to the public in the area where smoking is prohibited. At the very least, a “No Smoking” sign must be posted at the entrance of the area. The “No Smoking” sign shall be at least 8X11 inches in size and the international No smoking No smoking symbol shall occupy no less that 70% of the signage. The remaining lower 30% of the signage shall show the following information: b) Prominently post and display “No Smoking” stickers in the most conspicuous location within the public conveyance. At the very least, the three and a half (3.5) square inch “No Smoking” stickers shall be placed on the windshield and the ten (10) square inch “No Smoking” sticker at the driver’s back seat; c) Remove from the place where smoking is prohibited all ashtrays and any other receptacles for disposing cigarette refuse; d) For persons-in-charge of schools, public playgrounds, health or other facilities frequented by minors, post the following statements in a clear and conspicuous manner; SELLING, DISTRIBUTING, ADVERTISING AND PROMOTING CIGARETTES OR OTHER TOBACCO PRODUCTS IS NOT ALLOWED WITHIN 100 METERS FROM ANY POINT IN THE PERIMETER OF (name of SCHOOL/PLAYGROUND/ETC.) e) For persons-in-charge of schools, public playgrounds or other facilities frequented by minors, officers of the DOH and attached agencies, hospitals and health facilities report to the Smoke free Task Force tobacco products sale, distributions, advertisement and promotion from establishments and properties located within 100 meters from its perimeter. f) For persons-in-charge of approved point-of-sale establishments, post the following statement, together with a pictorial health warning on the health consequences of tobacco use, as prescribed by the Municipal health office, in a clear and conspicuous manner.

SALE/DISTRIBUTION OF TOBACCO PRODUCTS TO MINORS IS UNLAWFUL

g) For person-in-charge of point-of-sale establishments, remove all forms of tobacco advertisements other than those found inside their premises; h) Establish internal procedure and measures through which this ordinance shall be implemented and enforced within the area of which he or she is in-charge. This includes compliance to the sales, distribution, advertising and promotion restrictions, warning smoking violators in banned areas and requesting them to stop smoking and if they refuse to comply, asking them to leave the premises and if they still refuse to comply, report the incident to the Municipal Health Office and the nearest peace officer or to any member of the Smoke Free Task Force. i) Ensure that all the employees in the establishment are aware of this ordinance and the procedure and measures for implementing and enforcing it.

SECTION 7. Persons Liable – the following persons shall be liable under this Ordinance: a) Any person or entity who commits any of the prohibited acts stated in Section 5 hereof; b) Persons-in-charge who knowingly allow, abet, or tolerate the prohibited acts enumerated in section 5 or who otherwise fail to fulfill the duties and obligations enumerated in Section 6 hereof.

SECTION 8. Penalties – the following penalties shall be imposed on violators of this Ordinance: a) Violation of Section 5 (a) and Section (6) i. First Offense ii. Second offense iii. Third & subsequent offense-

b) Violation of Section 5(b), (c), (d) and (e) i. First offense ii. Second offense - iii. Third & Subsequent offense

c. Violation of Section 5 (f), (g) and (h) i. First Offense ii. Second Offense iii. Third & Subsequent offense

P 200.00 or community service of 2 hours P 400.00 or community service of 4 hours P1,000.00 or imprisonment for a period of 6 hours and not exceeding 24 hours, or both at the discretion of the court. Suspension or revocation of business license or permit (in case of business entity or establishment) if applicable.

P 500.00 or community service of 5 hours.

P1,000.00 or community service of 10 hours.

P 1,500.00 or imprisonment for a period of 8 hours not exceeding 24 hours, or both at the discretion of the court. Suspension or revocation of business license or permit (in case of a business entity or establishment) if applicable.

P 1,000.00 or community service of 10 hours P 1,500.00 or community service of 15 hours P 2,500.00 or imprisonment for a period of 12 hours not exceeding 24 hours or both at the discretion of the court. Suspension or revocation of business license or permit(in case of a business entity or establishment) if applicable.

d) Community service – If a violator is unable to pay the fines imposed he or she may choose to render community service to the municipality of Imelda, Zamboanga Sibugay. Every hour of the community service is equivalent to P 100.00 of the fine. e) Revocation or Suspension of License. the license to operate of any establishment or of any public conveyance covered by this ordinance shall also be suspended or revoked should the same fail to perform the necessary action within fifteen (15) days upon receipt of violation notice or fail to pay the corresponding penalty as stated in the Citation ticket for the violation committed within seven (7) working days. However, the license to operate of any establishment or of any public conveyance shall be suspended for at least one (1) week but not more than one (1) month, or revoked. Should the license or permit to operate of a specific establishment or of any public conveyance, found to be in violation of this ordinance, fall outside of the jurisdiction of the municipality of Imelda, Zamboanga Sibugay, the recommendation for revocation of license shall be forwarded to the appropriated agency or governing body. The suspension or revocation of the license to operate of the erring establishment or public conveyance shall only be lifted once all the requirements set forth upon re-inspection and evaluation of the Health Department, the Business Permits and Licensing Office and the appropriate agency or governing body has been fully complied with.

SECTION 9. Citation Ticket System – Violators of this Ordinance shall be informed of their violation and the penalty associated with such violation by means of a Citation Ticket System with the following guidelines: a) Official booklets of Citation Tickets shall be issued by the Treasurer to duly authorize enforcers within ninety (90) calendar days of the affectivity of this ordinance. b) A Citation Tickets shall be issued to the person/s liable for any violation of this ordinance upon fining of the violation by duly authorized enforcers. c) A Citation Ticket shall contain the following information: 1. Checklist of the violations under this ordinance; 2. The fines associated with each violation; 3. Option to render community service in case violator is unable to pay fine; 4. Due date for compliance with the obligations imposed by the ticket. d. When Citation Tickets is issued to a violator, the violator shall report to the Treasurer’s office or its duly authorized collecting agent, within three (3) regular business days after such issuance, where he or she shall either pay the fine imposed or render community service under Section 8 (d) hereof. e. The Treasurer’s Office shall keep a duplicate of all Citation Tickets issued to violators as well as all other records of violations of this ordinance.

SECTION 10. Smoking Cessation Program – The health Officer with the assistance of the representative designated under Section 16 hereof, shall develop, promote and implement a Smoking Cessation Program and encourage the participation therein of public and private facilities which may be able to provide for its requirements. Smokers who are willing to quit and/or those found violating this ordinance may be referred to the Smoking Cessation Program and its facilities.

ENFORCEMENT SECTION 11. Smoke Free Task Force- Task force shall be created to aid in the implementation, enforcement and monitoring of this Ordinance and to protect the same from tobacco industry interference at all times, as well as to conduct educational awareness campaigns information dissemination programs, and capacity building, that will inform the constituents and train enforcement officers.

The Task Force chaired by the Municipal Mayor shall be composed of the following: a) Municipal Health Officer b) Municipal Engineer c) Representative/s of none or more civil society organizations (CSO) designated by the Health Officer under Section 16 hereof; d) Representative of the Philippine National Police (PNP); e) Municipal Treasurer; f) Environmental and Natural Resources Officer (ENRO); g) Representative from Dep Ed, CHED and /or Academe; h) Local President of the Municipal Liga ng mga Barangay ng Pilipinas (association of Barangay Captain); i) Public Safety Officer j) Other member/s identified by the Health Officer (whose specific function in the LGU and role may be relevant in the effective implementation of this ordinances).

The Task Force shall not include as its member any person or entity upholding or accommodating tobacco industry interests or is connected in any way to the tobacco industry in order to protect the primary health objectives of this Ordinance from any and all interests prejudicial to tobacco control policies and to preserve its integrity. No member of the Task Force shall also receive for himself or for other individuals, beneficiaries or groups, any contribution or compensation, directly or indirectly, whether financial or otherwise, from the tobacco industry. Non-compliance of this provision, governing the Task Force, by the public official and government personnel, shall be subject to sanctions prescribed under CSC-DOH Joint Memorandum Circular 2010-001.

SECTION 12. Duties and Responsibilities of the Task Force- Other than (1) receiving reviewing and processing reports of and complaints for violation of this Ordinance and (2) deputizing enforcers under Section 13 to 16 hereof, the Task Force-headed by the Municipal Mayor shall have the following respective duties and responsibilities; a) The Health officers shall: 1. Serve as the overall coordinator among all the LGU officers involved in the implementation of this Ordinance; 2. Make tobacco control, including the implementation and enforcement of this Ordinance, a part of the health program to be proposed for funding by the general budget of the LGU; 3. Monitor compliance in public places, establishments, conveyances, point-of-sale, designated smoking areas (DSAs) and other offices in charge of enforcing this Ordinance; 4, Facilitate together with enforcers and/or Task Force members the imposition of Fines, suspension, or revocation of permits/licenses for violations of the same; 5 . Assign a hotline or any other number to which violations of this Ordinance may be reported by phone call or SMS and a person to operate the line and record reports; 6 Develop, promote and implement a Smoking Cessation Program as stated under Section 10.

7. Develop and produce information, education and communication materials on the harms of second-hand smokes well as on the provisions of this ordinance; 8. Encourage constituents of the LGU to monitor and report violations of this ordinance; 9. Monitor compliance in public places, establishments, conveyances, point-of-sale, designated smoking areas (DSAs), and other offices in charge of enforcing this ordinance; 10. Coordinate with enforcers and/or Task Force members the imposition of fines, suspension, or revocation of permits/licenses for violations of the same; b) Municipal Engineer shall: 1. Conduct, together with the Health Officers or on its own, inspection activities as provided in this Ordinance; 2. Determine whether or not enclosed or partially enclosed public places, workplaces or other public places, and point-of-sale establishments, comply with the requirements of this ordinance. c) Municipal Treasurer shall: 1) Print the Citation Tickets and copies of this Ordinance for distribution to the public; 2) Issue Official Citation Tickets to the enforcers; 3) Collect and receive fines paid by a violator and submit reports relating thereto to The Task Force; 4) Designate collection agents, as necessary, to assist in efficient collection of fines; 5) Make a primer summarizing the provisions of this Ordinance; 6) Order the suspension of revocation of permits and licenses of establishments found to have violated this ordinance, subject to the provisions of Section 8 hereof; 7) Deny renewal of permits and licenses of violators of this Ordinance; 8) Establish procedure for identifying and marking store/establishments covered by the 100-meter restriction on sale and distribution of tobacco products.

The environment and Natural Resources Officer and/or representative shall: 1) Assist in promoting awareness of this Ordinance as a component in the protection and conservation of the environment and in encouraging public support and participation in its implementation and enforcement; 2) Assist in inspecting and monitoring violations of the Ordinance on its own or with member of the Task Force; 3) Conduct periodic monitoring of air, water, soil quality and other studies pertinent to determining levels of exposure to tobacco smoke, residue by products and litter; 4) Provide the expertise in the application and management of appropriate technologies to avert environment risks and damage posed by tobacco smoke, residue by products and litter. g. The representative from DepEd, CHED and/or Academe shall: 1) Implement the department Orders on the integration of tobacco control education into the curricula; 2) Ensure strict compliance of Department Orders on protection of the bureaucracy from Tobacco industry interference as per FCTC Article 5.3; 3) Ensure strict compliance of schools in enforcing 100% smoke free campuses and school facilities including the schools vehicles; 4) Ensure the posting in clear and conspicuous manner No Smoking signs, and notices for No Selling of Tobacco products within 100 meters from its perimeter. h. The Local President of the Liga ng mga Barangay ng Pilipinas (Association of Barangay captains) shall: 1) Assist in promoting awareness of this Ordinance in encouraging public support and participation in its implementation and enforcement; 2) Coordinate with all Barangay Captains and the PNP in monitoring violations of the Ordinance within their jurisdiction; 3) Provide the necessary coordination among the Barangay Health Workers, Kagawads and Tanods and other enforcers (I,e. Coast Guards) for the implementation of activities pertinent to the ordinance; 4) Assist in the facilitation of an referrals to the Smoking cessation Program at the Barangay Level; SECTION 13. Enforcement on Individuals – members of the PNP and/or persons duly deputized by the Task Force shall apprehend and issue Citation Tickets against persons found in violation or have failed to comply with any provision enumerated under Section 5 and 6 hereof. They shall forward copies of the tickets they issue violators to the Treasurer’s office regularly or at least once a week. If the violator is a minor (person below 18) he or she must be brought to the nearest Social Welfare office for dispensation of appropriate action subject to RA 9344(Juvenile Justice and welfare Law).

SECTION 14- Enforcement of Public Conveyances- Members of the PNP and/or persons duly deputized by the Task Force shall inspect public conveyances during their regular hours of operation and shall issue Citation Tickets upon discovery of any violation of this Ordinance. They shall forward copies of the tickets they issue violators to the Treasurer’s office regularly or at least once a week.

SECTION 15 –Enforcement of establishment – Ninety (90) calendar days after the effectivity of this ordinance, an inspection team composed of representative from the Municipal Health office, the Engineer’s office and the Treasurer’ Office, shall conduct inspection of establishments and buildings to determine their compliance with the provisions of this Ordinance. Regular inspection shall thereafter be conducted at least once every month or simultaneously with other regular inspections done by the LGU whichever is more frequent, during normal hours of operation of the establishment.

The inspection team shall issue a Citation Ticket against the establishment upon finding of non-compliance with or of any violation of this ordinance. A Citation Ticket may be issued for each day that the establishment is found to be non-complaint.

Re-inspection of the establishment shall be done on any day after the issuance of the Citation Ticket, but in no case more that ten (10) calendar days after such issuance.

If the establishment fails to comply with the obligations stated in the Citation Ticket upon re-inspection, the inspection team shall recommend the suspension of the license to operate of the establishment, consistent with Section 8(d) hereof.

In the course of inspection, the inspection teams may apprehend individual violators and request the assistance of the PNP in doing so.

SECTION 16- Civilian Participation in Enforcement – Within thirty (30) calendar days from the effectivity of this Ordinance, the Municipal Health Office shall designate, with the approval of the Office of the (Municipal Mayor), one or more Civil Society Organization (CSO) to discharge the duties and responsibilities enumerated in Section 12 (g) hereof.

The Task Force may deputize qualified civilians to serve as enforcers to this Ordinance.

Any person can file with the Task Force a report of or complaint for any violation of this Ordinance.

INFORMATION CAMPAIGN a. In coordination with the Office of the Mayor; 1) Provide at least two(2) copies of this Ordinance to every PNP station or precinct in the LGU; 2) Provide a primer on this Ordinance for every member of the PNP in the LGU & 3) Conduct lectures to brief members of the PNP members of the provisions of this Ordinances and or their responsibilities with respect to its enforcement. b. In coordination with the Treasurer’s office, give a copy of the Ordinance and its primer to all existing establishments that are licensed to operate and open to the public, as well as to those applying for a new license to operate. c. In coordination with the Health officer, give a / copy of this Ordinance and its primer to all public utility vehicle operators in the LGU. SECTION 17- Public Billboards, Notices in Barangays – Upon effectivity of this ordinance, the Engineer’s office shall put up billboards in conspicuous places in the LGU to notify the public of the restrictions and sanctions imposed by the ordinance.

Health officer shall also immediately issue for dissemination at the Barangay level notices regarding the obligations of persons under the ordinance.

SECTION 18- Conduct of Orientation Seminars and Trainings- Within sixty (60) calendar days from the effectivity of this Ordinance and periodically thereafter the Health officer and the CSO representative designated under Section 16 hereof, and/or other members of the Task Force, shall develop and conduct a series of orientation seminars and trainings for the enforcers of this ordinance at least one for each group, including but not limited to, deputized enforcers like Barangay health workers and the Barangay Tanod, and the local PNP. FINANCING SECTION 19- Funding – An initial funding to defray the expenses necessary for or incidental to the implementation of this Ordinance in the amount of P 50,000.00 shall be sourced from the Municipality of Imelda funds and is hereby allocated. Every year thereafter, at least P 100,000.00 shall automatically be included in the Annual Budget of the Municipality of Imelda’s plans and programs.

The above expenses include, but are not limited to: a. Costs of printing copies of this Ordinance, the Citation Tickets and information, education and communication materials, pertaining to tobacco control. b. Cost of inspection and enforcement by the Smokefree Task Force including allowances for meals and transportation, the amount of which shall be set by the office of the Municipal Mayor. c. Incentive or reward for private citizens who report violations of the Ordinance. d. Institution and operating expenses of the smoking cessation program and facility. e. Other expenses associated with the implementation and enforcement of this Ordinance.

Proceeds from the administrative fines shall form part of a trust Fund that will be used to defray costs of operation of the Smoke free Task Force, The latter shall be empowered to determine how the trust Fund is to be utilized in furtherance of this Ordinance.

SECTION 20- REPEALING Clause – All ordinances contrary to or inconsistent with this Ordinance are hereby repealed or modified accordingly.

SECTION 21 – Separability Clause – If any part or provision of this ordinance is declared unconstitutionally or invalid, the same shall not affect the validity and effectivity of the other parts or provision hereof.

SECTION 22- Effectivity Clause – This ordinance shall take effect fifteen (15) days after its publication in a newspaper of local or general circulation or posting in at least two (2) conspicuous places in the municipality of Imelda.

AG A DIA N CITY, Zamboanga del Sur – The Department of Interior and Local Government (DILG) is set to implement next month P9 million worth of water system projects in nine barangays of the nearby Municipality of Aurora, this province.

DILG Project Development Management Officer Eng’r. Ali Hassan said Friday the projects are funded by the Office of the Presidential Adviser on the Peace Process (OPAPP) through the PAyapa at MAsaganang PamayaNAn (PAMANA) program.

PIA conducts first leg of climate change advocacy forum

BAYOG, Zamboanga del Sur - A climate change advocacy forum was held at Bayog National High School (BNHS) on Aug. 20, spearheaded by the Philippine Information Agency (PIA) and the Department of Environment and Natural Resources (DENR).

This is the first among a series of advocacy campaigns in schools, tapping the youth to be advocates

for climate change adaptation and resiliency.

Mr. Danilo Ungang, BNHS school principal lauded the PIA for choosing their school as the pilot area in its advocacy campaign.
