Mining firms face sanctions By Catherine J. Teves
MANILA -- Mining firms face sanctions if they are unable to pass government’s audit of their respective operations. Mines and Geosciences Bureau (MGB) mine safety chief Rodolfo Velasco gave such certainty, citing suspension and fines as among sanctions that can be imposed on audit-failing mining firms. “The sanctions will be on a case-to-case basis,” he
said. He said the results of the audit will determine the sanctions the government will impose. Department of Environment and Natural Resources (DENR) Memorandum Order 2016-01 set the nationwide audit covering all operating mines and mines under suspended and/or care and maintenance status. The same memoruandum also set a moratorium on approval of new mining projects in the country.
According to DENR Secretary Gina Lopez, the audit aims determining adequacy and efficiency of as well as gaps in each mining operation’s environmental protection measures. She said the audit also aims determining appropriate penalties for violating Philippine mining and environmental laws. In line with Malacanang’s bid for responsible mining nationwide, Lopez issued Memorandum Order 201601 last month and required
the audit to be in accordance with applicable laws and regulations. Among such laws are Republic Act No. 7942 (Philippine Mining Act of 1995), Executive Order 79 on reforms in the mining sector, and DENR Administrative Order 2015-07 mandating mining contractors to secure ISO 14001 certification, she noted. Velasco said the nationwide audit already commenced this August. “A total of 16 teams are
tasked with auditing 40 metallic mining companies in the country,” he said. The audit’s target conclusion is by the end of this month, he noted. Representatives from DENR’s central office, regional offices, MGB and Environmental Management Bureau as well as third party experts comprise the audit teams. “Third party experts we identified are Department of Health, Department of Agriculture, Bureau of Fish-
eries and Aquatic Resources and social action centers of provinces,” said Velasco. Memorandum Order 2016-01 called for the creation of an audit team in each region of the country. Three forestry experts from DENR’s Forest Management Bureau (FMB) are involved in the auditing activity to assess the mining firms’ compliance with Philippine forestry laws and regulations. CAGAYAN DE ORO CITY – The Department of Energy (DOE) gave a go-ahead for the city government to apprehend “resellers” of petroleum products. City Hall officials led by city treasurer Glenn C.
