CAGAYAN DE ORO CITY -- The Regional Development Council of Northern Mindanao (RDC-10) expressed, during the August 25, 2016 RDC reorganization meeting, its affirmation and support to Bukidnon Governor Jose Maria Zubiri, Jr. as RDC-10 Chairperson for the term 2016-2019.

Governor Zubiri conveyed appreciation for the members’ support and vowed to fight against criminality, graft and corruption, and poverty in the region. Describing himself as a hands-on government official, he urged everyone to work together especially in providing livelihood for the people. Lu) EXPLANATORY NOTE WHEREAS, The proposed Gender and Development (GAD) Code of the Municipality of Kadingilan, Province of Bukidnon, favorably recommended by the Committee on Laws in its Committee Report No. 2016-12 was presented and submitted for consideration and enactment of the August Body; WHEREAS, the proposed GAD Code has based its pertinent provisions on RA 7192, otherwise known as “Women in Development and Nation-Building Act”; RA 7877, or Anti- Sexual Harassment Act of 1995; RA 8353, or Anti-Rape Law of 1997; RA 8505, or Rape Victim Assistance and Protection Act of 1998; RA 9208, or Anti-Trafficking in Persons Act of 2003; RA 9262, or Anti-Violence Against Women and their Children Act of 2004; RA 9710, or the Magna Carta of Women; Article II Section 14 of the 1987 Philippine Constitution, which provides that “The State recognizes the role of women in nation-building, and shall ensure the fundamental equality before the law of women and men”; the statements of other ordinances, resolutions, or policy statements of this LGU in support of the Gender and Development (GAD); and the inclusion of some comments and suggestions amended by the members of the Sangguniang Bayan and other parties who shared their contribution in the preliminary drafting and review of this Code, particularly the women sector in the Municipality of Kadingilan; WHEREAS, the 11th Sangguniang Panlalawigan of Bukidnon passed a resolution during its Regular Session held on May 11, 2011, entitled: RESOLUTION ENCOURAGING THE LEGISLATIVE BODIES OF ALL CITIES AND MUNICIPALITIES OF THIS PROVINCE TO ENACT A GENDER AND DEVELOPMENT (GAD) CODE, AND IF AVAILING, CAUSE ITS AMENDMENT TO CONFORM TO THE PROVISIONS OF R.A. 9710, OTHERWISE KNOWN AS THE MAGNA CARTA OF WOMEN; WHEREAS, RA 9710, or the Magna Carta of Women is a piece of legislation, which is a comprehensive human rights law which exhorts the State’s policy of full integration of women’s concern in the mainstream of development and guarantees to provide support services and programs for women to encourage them to actively participate in nation-building. The Act, which is a consolidation of Senate Bill No. 2396 and House Bill No. 4273, was finally passed by the Senate and the House of Representatives on May 19, 2009 and May 20, 2009, respectively. It was signed into law by President Gloria Macapagal-Arroyo on August 14, 2009; WHEREAS, the aforementioned law provides that all Local Government Units (LGUs) are encourage to develop a Gender and Development (GAD) Code in their respective localities based on consultation with their women constituents; WHEREAS, this proposed Ordinance seeks to pass a legislative measure to promote and protect women’s rights and outlining the response to practical needs of women in the context of the socioeconomic and political realities of the Philippine society; WHEREAS, historically, Filipino women had enjoyed equal rights with Filipino men before the colonization and domination of Spain, the US and Japan. Historical records further testify that women had become chiefs of the villages, performed the role of priestesses, while customary laws gave firm recognition to the principle of the equality of the sexes, who after marriage, could trade with their own money, and maintain an independent income from their businesses; WHEREAS, two decades have passed in women-led study and action to transform Philippine society in protest against the prevailing gender asymmetery in roles and status among women and men, affecting all Filipino women, rendering them vulnerable in the most

number of victims of violence and especially the women from the poor sectors and the indigenous who bear the heaviest brunt of poverty, marginalization and overburdened condition. Filipino women today, as in past regimes, suffer from various forms of violence against their persons. Neediness to say, grassroots women are confronted with problems related to food, security, landlessness, land and crop conversions, mining operations, deforestation and other forms of environmental degradation. Undocumented horror stories of women including death occurrence continue to haunt other women, increasing their fears and insecurities for the future of their children; WHEREAS, moreover, women are inadequately protected by the law from cases of violence Patriarchal laws views women as the property of men and are more concerned with violation of their chastity rather than of their persons. However, there are national laws and local ordinances aimed to regulate the prevailing gender asymmetery in roles and status in society; WHEREAS, there is lack of programs, both government and nongovernment, to respond to violence against women and other women’s crises. Although some innovative support programs and projects have been initiated by the local women NGO’s/PO’s, these are very few and limited in resources; WHEREAS, some government programs aggravate the problem because of gender-insensitive approaches. Law enforcement agencies, especially, need to be sensitized to women’s needs. There is generally a low consciousness of the rights of women, even among the women themselves; WHEREAS, moreover, mass media play an important role in shaping the image of women, and have been guilty of “virgin of vamp” portrayal. Now women are depicted as victims of violence by media in ways that again do violate to women; WHEREAS, the role of government development programs in opening rooms to violence must be noted. Sex-oriented tourist promotion, industrial zone projects that displace women from land, and encouragement of migration, put women at higher risk; WHEREAS, the national policy framework, on the other hand has adopted a Gender Responsive Development Plan from 1995-2025 and has directed all government agencies, departments, bureaus, offices and instrumentalities to ensure full implementation to institutionalize gender and development concerns in planning in agency performance, budget, work and financial plans; WHEREAS, as an expression of its conscious effort, the Philippine government, in plenary speeches at the 1995 Fourth World Conference on Women in Beijing, presented the following commitments: mandate that all government offices allocate a portion of their annual budget to women-specific and gender-oriented programs; intensify training of rural women and give them more access to credit; impose more stringent penalties for those who engage in trafficking; WHEREAS, meanwhile, Kadingilan potential for economic growth with its critical membership in the East Asian Growth Area (EAGA), may not lead to equal distribution of the benefits among women and men, for as in all developing countries, the elite few get the bulk of economic benefits, violence in the workplace and the home in endemic, and women are marginalized and powerless within the particular socio-economic-cultural contexts of their communities as settlers and Lumads; WHEREAS, the Filipino women now want to restore equal with the hope of transforming the oppressive structures in society which could lay the growth for women’s total emancipation; WHEREAS, thus, this Ordinance, known as the “Gender Development Code of Kadingilan”, is an initial response towards meeting more strategic needs of women and men in the Municipality of Kadingilan; WHEREAS, though the document is strewed with gender schemes based from the concrete proposals of women in Kadingilan and patterned from United Nation’s Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) on which the Philippines is a signatory, it is not seen as the “tool” for women’s liberation. The great responsibility lies on the State to provide the ripe conditions for both women and men to grow and develop as human persons in an environment free from dependence and foreign domination; NOW, THEREFORE: BE IT RESOLVED, as it is hereby RESOLVED, to enact the following ordinance: ORDINANCE NO. 2016-07 AN ORDINANCE PROVIDING FOR A MUNICIPAL GENDER AND DEVELOPMENT CODE OF THE MUNICIPALITY OF KADINGILAN AND FOR OTHER PURPOSES Be it ordained by the Sangguniang Bayan of Kadingilan, Bukidnon in session assembled, that: BOOK 1 - GENERAL PROVISIONS CHAPTER ONE - BASIC PRINCIPLES ARTICLE I TITLE AND GENERAL POLICY Section 1. Title.- This Ordinance shall be known as the “GENDER AND DEVELOPMENT CODE OF THE MUNICIPALITY OF KADINGILAN.”

Section 2. Declaration of Policy and Principle of Kadingilan Municipal Government.- It shall be the policy of the Municipal Government of Kadingilan to ensure both women/girls and men/boys to equally and participate directly in the development programs and projects of its various departments to ensure the full participation and involvement of both men and women in the development process, pursuant to RA 7192. It shall also uphold the rights of women/girls and the belief in their worth and dignity of human beings in accordance with the fundamental freedoms guaranteed under the Constitution and the provisions of the Universal Declaration of Human Rights, Convention on the Elimination of All Forms of Discrimination Against Women and other international human rights instruments.

Women shall be recognized as full and equal partners of men in development and nation building and women shall share equally with all forms of productive activities.

The Municipal Government shall actively contribute to the establishment of a national and international economic order based on sustained, equitable growth and balanced ecology. Any development that it undertakes should realize the rights of women, enhance women’s full potentials, uplift their status and lead to the improvement of the quality of lives, their families and communities.

Toward this end, the Municipal Government shall pursue and implement vigorously gender-responsive development policies; design and integrate specific gender and development support systems, taking into consideration women’s and girl’s right to economic survival, political participation, self-determination and personal empowerment; adopt and implement measures to protect and promote their rights; and ensure the direct participation of women from the local government, non-governmental organizations (NGOs) and people’s organizations (POs), and the private/business sector in all phases of the development program cycle.

TO ATTAIN THE FOREGOING POLICY:

1. All Municipal government departments, offices and instrumentalities shall ensure the women and girls’ benefit equally and participate directly in the development programs and projects of said departments and agencies, including those funded under official foreign development assistance, to ensure the full participation and involvement of women in the development process, pursuant to RA 7192, or the Women in Development and Nation Building Act. 2. All Municipal government project proposals shall ascertain the inclusion of gender-responsive indicators and guidelines while not be remiss in locating the roof of women’s oppression, pursuant to the United Nations Declarations and Conventions of Women of which the Philippine Government is a signatory.

3. All Municipal departments, offices, and instrumentalities upon effectivity of this Code, shall review and revise all their regulations, circulars, issuances and procedures to remove gender bias therein.

ARTICLE II RELATED PRINCIPLES Section 3. Rights of Women Defined-. Women’s rights are the rights of women that are defined and declared by the United Nations under the Convention on the Elimination of all Forms of Discrimination Against Women (CEDAW) are hereby adopted as follows: a. Women have the right to the prevention of and protection from all forms of violence and coercion against their person, their freedom, their sexuality, and their individuality. b. Women have the right to freely and fully participate individually or collectively in the political processes of their communities and nations. c. Women have the right to the means for assuring their economic welfare and security. d. Women have the right to the necessary knowledge and means for the full exercise of their reproductive choice in accordance to the constitution and their beliefs and preferences. e. Women have the right to choose a spouse in accordance with their values and preferences, maintain equality in marriage or its dissolution, and obtain adequate support for the rearing and caring of their children. f. Women have the right to adequate, relevant, and gender-fair education throughout their lives from childhood to adulthood. g. Women have the right to adequate nutrition and proper health care. h. Women have the right to a humane living condition. i. Women have the right to nurture their personhood, collectively and individually, to secure an image of themselves as whole and valuable human beings, to build relationships based on respect, trust and mutuality. j.

Women have the right to equality before the law in principle, as well as in practice.

f. Sexual abuse & assault committed by any person which includes physical attacks on the sexual parts of the victim’s body, acts covering or attempting to cause to the victim to engage in sexual activity by force, threat or force: physical or other harm of coercion.

Development - is the improvement of the quality of life regardless of age, sex, gender, tribe, race, creed and religion. It is characterized by an enrichment of Filipino indigenous resources, sustainable utilization of the natural resources of the country and freedom from dependency. It is therefore, sustainable, equitable and gender-responsive.

Section 4. Partner/Wife Abuse and Battering Defined.- Battering is any single or sporadic act violence which shall include the repeated and habitual cyclic pattern as means of intimidation and imposition of the batterer’s will and control over the survivor’s life. It constitutes the following kinds of behavior but is not limited to:

Discrimination Against Women - any distinction, exclusion or restriction made on the basis of sex has purpose or effect of impairing or nullifying the recognition, enjoyment or exercise by women of their rights irrespective of their marital status.

Commodification of Women - is a practice which puts women in a subordinate situation which leads in the treatment of women as both consumers and objects. As consumers, women are enticed to buy beauty products to enhance their physical attractiveness. As objects of consumption, women are reduced to a sexual commodity for manipulation and utilization for one’s sexual desire or interest, usually in exchange of money or goods so that women have no control or power to reject such utilization or manipulation.

CHAPTER TWO - DEVELOPMENT CONCERNS ARTICLE I VIOLENCE AGAINST WOMEN Section 1. Violence Against Women Defined.- Any act of gender-based violence that results in, more likely to result in physical, sexual, or psychological harm or suffering to women, including threats of such act, coercion, or arbitrary deprivation of liberty, whether occurring in public or private life as defined in the United Nations Declaration on the Elimination of Violence Against Women.

Section 2. Violence Against Women shall include but is not limited to:

a. Physical abuse and battering - this includes any form of inflicting wounds, pain, etc. on any part of the woman’s body of the threat of physical violence. b. Sexual abuse and assault - this includes physical attacks on the sexual parts of the victims body, acts covering or attempting to cause to the victim to engage in sexual activity by force, threat of force. Physical or other harm of coercion. c. Psychological Abuse - refers to acts or omissions causing or likely to cause mental or emotional suffering of the victim such as but not limited to intimidation, harassment, stalking, damage of property, public ridicule or humiliation, repeated verbal abuse and marital infidelity. d. Economic Abuse - refers to acts that make or attempt to make a woman financially dependent which includes, but is not limited to the following: 1.) Withdrawal of financial support or preventing the victim from engaging in any legitimate profession, occupation, business or activity. Except in cases wherein the other spouse/partner objects on valid, serious and moral grounds as defined in Article 73 of the Family Code.

2.) Deprivation or threat of deprivation of financial resources and the right to the use and enjoyment of the conjugal, community or property owned in common.

3.) Destroying household property 4.) Controlling the victim’s own money or properties on solely controlling the conjugal money or properties.

a. Physical, sexual and psychological violence occurring in the family regardless of relationships, including battering, sexual abuse of female children in the household, dowry-related violence, marital rape, female genital mutilation and other traditional practices harmful to women, non-spousal violence and violence related to exploitation.

Section 5. Mail-Order Bride Defined.- It is a practice where a women establishes a personal relations with male-foreign nationals via mail, electronic or similar means, upon recruitment by an individual or agency for the purpose of exploiting women in guise of marriage.

b. Physical, sexual and psychological violence occurring within the general community including rape, sexual abuse harassment, and intimidation at work in educational institutions and elsewhere, trafficking in women, and forced prostitution.

Section 6. Sexual Harassment Defined.- It is a form of misconduct involving an act or a series of unwelcome sexual advances, requests for sexual favors, or other verbal or physical behavior of a sexual nature, made directly, indirectly or impliedly.

c. Violations of the human rights of women in situations of armed conflict, in particular murder, physical and psychological torture, systematic rape, sexual slavery, and forced pregnancy.

Sexual harassment shall be unlawful in the employment, education or training environment as prescribed in RA 7877.

d. Forced sterilization and forced abortion, social stigmatization, coercive/forced use of contraceptives, prenatal sex selection, female infanticide, forced medical or psychological examinations without expressed approval of the concerned person. e. To buy and sell a woman or any of her body parts for profit. f. Sexual harassment and assault of women detention. g. Feminization of poverty which is regarded as a condition when gap between the rich and the poor widens and grassroots women bear the brunt as in economic instability and unequal distribution of wealth. Such gap reinforces non-response to both practical and strategic interests of women.

Section 3. Sexual Abuse Defined.- Sexual abuse shall include but is not limited to the following: a. When a man inserts or attempts to insert his penis into the mouth, genital or anus of a woman under any of the following: 1. Through force, threat or intimidation; 2. By means of abuse of authority or relationship; 3. When the offended party is deprived of reason or is otherwise unconscious; 4. When the offended party is below twelve years old, even though none of the above circumstances is present. b. When a person who inserts part of his or her body other than the sexual organ, or who introduces any object or instrument into the genital or anus of a woman under any of the situations stated in paragraph 1. c. When a person subjects another to have sexual intercourse with an animal under any of the circumstances stated in paragraph 1 or through any abnormal, unusual or ignominious sexual act. d. Sexual abuse in intimate relationships consisting of any form of forced sexual act by a partner to the other within intimate relations as defined in the Anti-Rape Law of 2001, such as those between men and women relations, married or unmarried, legally separated or separated in fact. e. Incestuous abuse committed by a person who has authority over a person by virtue of consanguinity and/or affinity such as those perpetrated by father, mother, grandparent, brother, sister, whether whole or half blood, an uncle, aunt, nephew or

Other Forms of Sexual Harassment.- Other than the definition provided by RA 7877, the following constitute sexual harassment some of which are covered by the Revised Penal Code under Acts of Lasciviousness: a. Persistent telling of offensive jokes such as green jokes or other analogous statements to someone who finds them offensive or humiliating; b. Taunting a person with constant talk about sex and sexual innuendoes; displaying offensive or lewd pictures and publications in the workplace; c. Interrogating someone about sexual activities or private life; during interviews for employment, scholarship grant or any lawful activity applied for; d. Making offensive hand or body gestures at someone; e. Repeatedly asking for dates despite verbal rejection; f. Staring or leering maliciously; g. Touching, pinching or brushing up against someone’s body unnecessarily or deliberately; h. Kissing embracing someone against her will; i. Requesting sexual favors in exchange for a good grade, obtaining a good job or promotion, etc; j. Cursing; whistling or calling a woman in public with words having dirty connotations or implications which tend to ridicule, humiliate or embarrass the women such as “puta”, “boring”, “peste”; etc.; k. Any other unnecessary acts during physical examinations; l. Requiring women to wear suggestive or provocative attire during interviews such as job hiring, promotion, admission; and m. Any expression of gender bias against a person with the intention to embarrass, humiliate, and stigmatize.

Section 8. Pedophilia Defined-. It is a form of sexual perversion where children are preferred victims for intercourse. It shall include the following acts but not be limited to the following: a. When the offender shall have sexual intercourse with a boy or a girl child; b. When the offender shall have anal intercourse with a boy or a girl child; c. When the offender does other sexual acts as fondling, kissing the private parts of a girl or boy child or taking photographs/video of the same for pornography; d. When the offender shall have in possession of pornographic photographs/video of the same.

Section 9. Commercial Exploitation of Women/Men and Girls/ Boys.- It shall be unlawful for a person to sell or market women’s and girl’s and boy’s bodies in various forms of packaging. These include

but are not limited to the following: a. Prostitution which is selling a woman’s body mainly for sex; b. Printing, publication, display, and distribution of pornographic scenes on movies/TV shows, trailers, posters, billboards, and other materials and literature that treat women/men and girls/ boys as sexual objects and commodities; c. Pornographic and indecent shows depicting women/men and girls/boys as sexual objects either in nude or provocative gestures; and/or d. Live shows whether women or girl-children are influenced or forced to dance of or do naked shows in public or private places for various purposes.

Section 10. Nondiscrimination of Gays, Lesbians, Bisexuals and Transgenders.– It shall be included a violation of human rights to discriminate against any person on the basis of her/his sexual preference or orientation for employment, participation in municipal development programs and projects, and for other family or community activities.

ARTICLE II SUPPORT MECHANISMS TO EMPOWER WOMEN AND PROMOTE AND RESPECT WOMEN’S RIGHTS Section 11. Comprehensive Support to Women-Survivors of Violence.- The Municipal government shall provide comprehensive support to women-survivors of violence which consists of but not limited to the following: a. Immediately conduct an investigation within twenty-four hours upon report of incidence; b. Provide for counseling and medical services for the offended party; c. Gather evidence for the arrest and prosecution of the offenders; d. Make a report of his/her investigation and on the basis of the offended party’s testimony and additional evidence, if any, endorse the same to the proper prosecution office within thirty-six (36) hours from the time of filing, regardless of his/her evaluation of the case; e. The investigation officer or the examining physician, if possible of the same sex as the offended party, ensures that only persons expressly authorized by the latter are allowed inside the room where the investigation or medical or physical examination is being conducted; f. Women victim-survivors of all forms of violence shall be registered in a community-based psychological program that shall assist the women in holistically rebuilding and empowering themselves; g. All investigations/hearing involving rape cases and other forms of violence against women conducted in the police stations, prosecution’s office and the trial courts shall recognize the survivor’s social support group as expressly allowed or requested by the offended party; h. A temporary shelter with appropriate support services for women in crisis shall be appropriately constructed under the management and supervision of the Municipal Social Welfare and Development Office; and i. Assist to women and victim-survivors to access legal services.

Section 12. Psychosocial Program.– It is an intervention using integration and holistic approach to conditions of women considering their differentiated needs within a social context.

Section 13. Survivor’s Support Group Defined.– It is an organized group of women to whom a woman-survivor of violence voluntarily agrees to go through a collective helping process.

Section 14. Support Services for Women in the Entertainment Industry, Entertainment Industry Defined.– Women in the entertainment industry are those women employed in establishments identified as places of amusements defined in the Revenue Code of Local Government Unit of Kadingilan under Municipal Ordinance No. 2014-02 and shall include, but not limited to, night clubs or day clubs, cocktail lounges, super or family clubs, karaoke and videoke bars, beer houses/gardens, fast-food centers, resorts which show TV/cable programs, films, movies, sports shows and other places of amusement where one seeks admission to entertain himself.

The Municipal government shall provide socioeconomic and health support services for women in the entertainment industry in order to respond to their practical needs.

ARTICLE III POLITICAL AND PUBLIC SPHERE OF WOMEN Section 15. Promoting Gender Balance at all levels of Municipality of Kadingilan Local Government Positions.- The Municipal Government shall promote gender balance of equal proportion of qualified women and men for opportunity to assure key positions at all levels of local government, whether elective or appointive. This should form part of the Municipal Government efforts to eliminate barriers to women’s participation in the public sphere. This shall include their equal representation in the structure of the Municipal Development Council (MDC) and the Barangay Development Council (BDC). Implementation guidelines shall be detailed in the Code’s Implementing Rules and Regulations.

Section 16. Barangay Gender and Development Committee.All barangays shall establish their respective Barangay Gender and Development Committee that shall ensure that gender issues and concerns be incorporated and addressed at the Barangay level and reflected in Barangay development plans. be represented in the committee as a cluster.

Section 17. Marking Significant Days for Women’s Action.- March 8 as International Women’s Day shall be declared as a Special Day for all women in the Municipality of Kadingilan through an Executive Order. There shall be coordinated Municipal and Barangay level activities for women to be conducted with the State of the Women Address by the Municipal Mayor reporting all accomplishments and plans to promote the status of women in the Municipality of Kadingilan. A Committee for this activity shall be convened and spearheaded by the Municipal GAD Focal Person.

A half-day leave with pay may be availed of by any women employee on March 8 in recognition of women’s contributions to society, commercial establishment shall be encouraged to give a twenty percent (20%) discount for women in March 8. Implementation guidelines shall be provided in this Code’s Implementing Rules and Regulation.

Section 18. Day of Action for Breast Cancer Awareness.The Local Government Unit of Kadingilan shall set a day in the third week of March to organize information campaign activities on breast cancer, as one of the top causes of maternal mortality. A coordinated Municipal and Barangay level activities shall be set and spearheaded by the Municipal Health Office to promote consciousness on breast cancer.

Section 19. Girl Child Week.- The Local Government Unit of Kadingilan shall set the first week of October organize activities to celebrate the Girl Child Week. It shall be spearheaded by the Schools District and the Municipal Social Welfare and Development Office.

Section 20. International Day of Action for Women’s Health.

The Municipal Government shall set May 28 to mark International Day of Action for Women’s Health, wellness and well-being when issues and concerns relative to the protection and promotion of Women’s health shall be examined, deliberated, projected and government action sought. A coordinated Municipal and Barangay level activities shall be set and spearheaded by the Municipal GAD Focal Point to promote women’s health and well-being.

Section 21. International Week of Action Against GenderBased Violence.- The Municipal Government shall organize various events and activities to educate residents about violence against women and children every November 25-December 10 as the period marked as the International Week of Action Against Gender-based Violence and culminates on International Human Rights Day. The activities shall be spearheaded by the Municipal GAD Focal Point.

Section 22. Election of Women Sectoral Representative to the Sangguniang Bayan.- Women Sectoral Representative to the Sangguniang Bayan shall be elected by the members of the accredited women organization in Kadingilan as a concrete manifestation of women’s place in local governance and in accordance with RA 7160.

Section 23. Women’s Summit of Kadingilan.- A Women Summit shall be held on the last week of March every year which shall be convened and managed by a Joint Committee of Women People’s Organizations (POs) and Government Organizations (GOs).

ARTICLE IV LABOR AND EMPLOYMENT Section 24. Wage and benefits for Women.- Every employer shall comply with the minimum rate as stipulated by the Regional Wage Board or benefits to all women employees such as maternity leave, sick and vacation leave, retirement and other benefits provided by law. The same provision shall apply to benefits provided by law.

The same provision shall apply to benefits covered by the Collective Bargaining Agreement (CBA) between the concerned employee’s union management.

Section 25. Increase Maternity Leave Benefits as Incentives for Breastfeeding Mothers in the Private Sector.- Additional maternity leave benefits up to sixty (60) days from forty-five (45) days mandated by law under RA 8283 shall be extended to women employees in private offices and commercial/industrial establishments located in the Municipality, who have rendered at least one year continuous service, provided that this benefits shall be mutually agreed upon in the Collective Bargaining Agreement (CBA) between the concerned employees union and management.

Section 26. Increase Paternity Leave Benefits as Incentive for Fathers for Meaningful Participation in the Care of the New Born Child in the Private Sector.- Additional paternity leave benefits of fourteen (14) days from the seven (7) days mandated by law under RA 8187, maybe extended to male employees in private offices and commercial/industrial establishments located in the Municipality who have rendered at least one (1) year continuous service, provided, that this benefit shall be mutually agreed upon in Collective Bargaining Agreement (CBA) between the concerned employees union and management; Provided further, that any additional leave period shall be used for caring of the new-born baby by the concerned employee.

Section 27. Orientation on Sexual Harassment.- All government agencies and private offices, commercial/industrial establishments located in the Municipality of Kadingilan shall conduct regular orientation on sexual harassment for their respective employees.

Certificate of Compliance shall be submitted to the Municipal Gender and Development Focal Point.

on Decorum and Investigation (CODI) including the promulgation of the Implementing Rules and Regulations or Policy on Sexual Assessment that will provide/prescribe procedure for the investigation of sexual harassment cases and administrative sanction covering all Municipal officers and employees in accordance with the provision of 1877 and the Civil Service Rules and Regulation on Sexual Harassment.

The Municipal Government shall require in all private offices and commercial/ industrial establishments to set up and create the same CODI. Section 28. Setting up Grievance Machinery.- All grievance committees shall be set up in all government and private offices, commercial/industrial establishment located in the Municipality, to act on complaints/cases related to various forms of discrimination against women in the workplace such as hiring job training, promotion and the like.

Section 29. Equal Access to Job Training and Promotion.- No woman shall be deprived of job training and promotion on account of her gender age, ethnicity creed religion and civil status.

Section 30. Facilities and Support Systems for Women.- The Municipal Government shall ensure the occupational safety and health of women employees in both government and private offices and commercial/industrial establishment. In appropriate cases, it shall require employers to: a. Establish separate toilets rooms, lavatories, and lounge for men and women and provide at least appropriate dressing room for women.

Section 31. Household-based Workers or Women in the Informal Sector.- The Municipality shall ensure that social protection shall be accorded to women working in the informal economy. These are women vendors, sewers, laundry workers, and related occupation. Organized home-based workers may avail social security and employees’ compensation benefits and Philhealths upon proper documentation and registration with the Social Security System and Philhealth, respectively.

The Municipal Government, through Municipal Social Welfare and Development Office shall conduct an inventory of all women involved in the informal sector for consultation and provision of appropriate support services or the sector.

Section 32. Women in the Entertainment Industry.- Women engaged in legitimate occupation and entertainment industry such as singers, stage performers/ actresses, bar girls and receptionists, shall be recognized as wage earners and they shall receive minimum wage and benefits afforded to women workers and shall render services as set in the Job Contract and only in the place of works as specified in the business permit of the establishment concerned. It must be emphasized that employing minors in the entertainment industry is prohibited in accordance with RA 7658.

Section 33. Police Operation in Entertainment Establishment.- All police operations or raids conducted in any entertainment establishment must be undertaken with utmost care and respect for human rights.

Police officers shall not take this opportunity for sexual exploitation of or extortion from entertainers and other concerned parties. Violation of this provision is punishable under the Revised Penal Code and related laws.

Section 34. Tax Incentives for Business Entities.- The Municipal Government shall provide tax incentives to business entities as follows: a. Any amount used for the establishment, maintenance and operation of child-minding support service centers shall be tax-deductible; b. Annual tax credit per child regularly served for at least one year in the Center; Section 35. Monitoring System for Labor Standards.- A mechanism shall be installed by the Municipal GAD Focal Point to monitor all offices, agencies, and establishments or companies violating the Labor Code provisions and provisions of this Ordinance; prepare regular reports to concerned departments and recommend appropriate actions.

ARTICLE V HEALTH RIGHTS Section 36. Right to Health.- Article 12 of the UN International Convention on Economic Social Cultural Rights provides that women’s right to health, which includes women’s reproductive rights, is a fundamental human right. In recognition of the fact that women’s reproductive roles and social education have made health policies, programs and services to focus more on pregnancy and birth-related rather than on a more holistic approach, the Municipal Government shall respect and promote a rights-approach to women and men’s health by considering their respective specific realities and health needs in every stage in their lives. It shall also promote couple’s shared responsibilities for childbirth and child.

Section 37. Reproductive Health Defined.- As defined in the International Conference on Population and Development and World Health Organization, and affirmed in the International Women’s Conference in Beijing reproductive health is a state of complete physical, mental, and social well-being and not merely the absence of disease and infirmity in all matters relating to the reproductive system and to its function and processes, i,e., people are able to have satisfying and safe sex life and have the capability to reproduce and the freedom to decide to it, when and how to do so.

The Municipal Health Office shall adopt the reproductive health care approach at all level of health are delivery. Such approach integrated many issues not previously considered central population, sexually,

reproductive tract infection, gender power relations and domestic violence shall be limited to family planning and child bearing or safe motherhood.

Section 38. Health Care Delivery.- Quality health care and services shall be accessible to all women and men regardless of age, sex, creed, religion and ethnicity in the Municipality of Kadingilan.

No hospital in the Municipality shall deny women and men living below the poverty line of reproductive health services. A certificate of indigency shall be issued by the Punong Barangay for the purpose of verifications.

In case of emergency, a social worker or any authorized personnel shall be designated to conduct rapid appraisal of the socioeconomic status of the patient for admission purposes.

The Municipal Government must ensure regular expansion until upgrading of health care facilities to ensure access by all women and men.

Section 39. Women’s Control Over their Bodies.- Women’s decision to attain healthy sexual development and achieve their reproductive intention shall be given appropriate support and guidance by all health professional, private and public at a very minimal cost.

Provision of accurate and appropriate information on these matters and corresponding services shall be made available.

Section 40. Gender-Sensitive Women and Children Protection Unit (WCPU).- The Municipal Government shall establish a Gender-sensitive Crisis Intervention Unit at all levels of health care in the Municipality and shall provide service training to all health and other allied personnel who shall be assigned in this unit.

Section 41. Gender-Fair Approach to Pre-marital Counseling Program.- The Municipal Health Office and the Municipal Social Welfare and Development Office shall ensure gender-sensitivity orientation as a requirement in the application for marriage license with the Municipal Civil Registry.

Section 42. Mainstreaming Reproductive Health Framework through Primary Health Strategy.- In consonance with the Municipal Health Office policies, Child and Youth Welfare Code in pursuance of agreement made at the International Conference on Population and Development (ICPD), the Municipal Government shall mainstream the Reproductive Health Approach in health care services delivery using the primary health care strategy.

ARTICLE VI EDUCATION RIGHTS Section 43. Conduct of Regular Gender-Sensitivity Training for all Teachers at all School Levels.- The School District in coordination with the Municipality of Kadingilan GAD Focal Point shall incorporate gender-sensitivity orientation in teachers’ orientation seminars and Parents-Teachers Association (PTAs) meeting conducted before classes start at the beginning of the school year.

Section 44. Developing Gender-Fair Educational Materials.The Schools District Office shall ensure that all educational materials developed by the Municipal School’s officials and the private sector are gender-fair and do not portray stereotyping of roles for women or boys and girls. It shall conduct a regular monitoring and review of existing educational materials to ensure that these are gendersensitive and fair.

Section 45. Promotion of Gender-Sensitive Curriculum. All public and private schools in the Municipality of Kadingilan shall actively promote gender-sensitivity in their subject/course curriculum and gender-fair socialization for school pupils. The Schools District Office shall also ensure that municipal school officials and the private sector professional school counseling career education programs are gender responsive.

Section 46. Promoting Gender-Sensitive Education Programs and Services.- All schools, offices, establishments or companies, departments and agencies including Barangay Government of the Municipal Government of Kadingilan shall initiate gender sensitivity orientation and training which shall equip them with theoretical and practical knowledge on gender justice.

Section 47. Gender-Responsive Non-formal Education for Youth and Adults.- The Schools District in coordination with Technical Education Services Development Authority (TESDA) shall conduct non-formal classes for women and men desiring to engage themselves in functional and practical education, to be held in school buildings or Barangay/Municipal Multipurpose Centers.

ARTICLE VII CULTURE AND MASS MEDIA Section 48. Gender-Sensitive Portrayals in Media.- The Municipal Government shall oblige all media institutions to be sensitive in the portrayal of women’s and men’s role, encourage positive images of women and discourage sexist and homophobic materials and broadcast programs.

Section 49. Gender-Sensitivity Training for Local Media Practitioners.- The Municipal Government shall encourage and support the conduct of gender-sensitivity workshop training for local media practitioners at the community level and tertiary schools See ordinance, page B5

Section 50. Regulation of Internet Cafes and Computer Shops.- The Municipal Government shall regulate the operation of internet service–providing establishments and entertainment computer shops in order to curb and prevent the proliferation of access to cybersex pornography of minors.

Section 51. Regulation of Media Coverage during Police Raids on Entertainment Establishments.- The Municipal Government shall regulate the media coverage of entertainment establishment raid operations for the prevention of exploitation of women and men entertainers and their necessary body public exposure and humiliation.

ARTICLE VIII SOCIO ECONOMIC RIGHTS Section 52. Gender-Responsive and Comprehensive Livelihood Program.- The Municipal Government shall allocate funds for socio-economic programs for poor women and men that include gender-responsive livelihood skills and values training seminars. The Comprehensive Livelihood Program shall include feasibility study, financing, monitoring sustainable paying scheme and incentive.

Section 53. Access to Investment and Loan Programs.Loans shall be extended to women engaged in small to medium scale enterprises as well as to displaced industrial workers under the principles of self-reliance and hard work.

Section 54. Low-Cost Basic Services.- The Municipal Government shall facilitate access of women and men to quality low-cost housing, safe water, electricity, communication, transportation and basic commodities.

Section 55. Monitoring on Standardization of Prices of Basic Commodities.- The Municipal Government shall ensure fair marketing practices and standard pricing of basic commodities through regular monitoring in local markets.

ARTICLE IX SPECIAL SECTORAL CONCERNS Section 56. Differently-Abled Women Defined.- Differentlyabled women are those who have one or a combination of physical impairment with distinct needs and potentials.

Section 57. Advocacy on Differently-Abled Women’s Rights and Support Mechanisms for Education and Employment.- The Municipal Government shall initiate active advocacy on the rights of differently-abled women; establish special education schools/classes for them through the Schools District which shall offer appropriate curriculum for their specific needs; and develop creative employment opportunities for them in recognition of their differentiated conditions and full potentials as human persons.

The Municipal Government, through the Municipal Engineer’s Office, shall ensure that all educational and commercial buildings are provided with ramps and toilets facilities for differently-abled persons.

The Municipal Government shall implement RA 7277 of the Magna Carta for Disabled Persons that serves five percent (5%) of contractual or emergency positions for persons with disabilities who are qualified for the position.

Section 58. Organization of Differently-Abled Women in the Community.- It shall be the duty of the Barangay GAD Committee to organize differently-abled women in the community in order to advance the interests of this special group of women and to monitor and report cases of harassment and discrimination committed against differently-abled women.

Section 59. Mobilizing Support for Elderly Women in the Community.- It shall be the duty of the Barangay GAD Committee to organize elderly women within the Barangay to advance their practical and logic interests and needs.

Section 60. Support to Women in Detention.- The rights of all women detainees shall be protected by ensuring them of (a) a speedy trial of their respective cases; (b) an appropriate program to respond their specific needs and problems as detainees; (c) a separate physical structure and space provisions for detention and rehabilitation.

ARTICLE X WOMEN AND CHILDREN SUPPORT SYSTEM Section 61. The Municipal Government shall implement systems and programs that are anchored by the United Nations Convention on the Rights of the Child (UN CRC) which stipulates the promotion and action of children’s rights to survival, development, and protection in national and local laws which now include the New Family Code and the Child and Youth Welfare Code.

Section 62. Gender-Responsive and Child-Friendly, Child Minding Center in Every Barangay.- The Municipal Government shall encourage that child-friendly and gender-responsive child day minding centers are set up in every Barangay to provide parents

support facilities for the care of their children when they go to work or school. The centers shall ensure that the basic early child education curriculum in the centers promote gender-fair socialization encourage the parents to participate in the development, care and nurturing of their children and boys and girls in the center are able to learn to respect rights of all children to the full enjoyment of their childhood and rights.

Section 63. Shared Parenting and Responsibilities.- The Municipal Government shall advocate both fathers and mothers share moral obligation and responsibility in assuring the rights and well-being of their children, such as caring and nurturing, regardless of sex, physiological and psychological conditions.

ARTICLE XI GENDER AND DEVELOPMENT Section 64. Gender and Development Defined.- Conscious efforts at improving the quality of life of women and men of all sexual orientations and identities based on sustained, equitable growth and balanced ecology. It sees society as a gender system in all its aspects - economic, political and social. It views expression in both private and public spheres recognizing women as agents of change through the orientation of the male-centered culture.

Section 65. Gender Sensitivity and Training, Gender Sensitization Defined.- It is a critical process of learning by an individual, female or male, of the causes and effects of the culturally determined roles of women and men.

All schools, offices, establishments or companies, departments and agencies of the Municipal Government shall be provided with gender sensitivity orientation and training which shall equip them with theoretical and practical knowledge on gender issues and concerns.

Likewise, all establishments, schools, colleges and universities shall develop assessment for gender biases.

Section 66. Active Support to Gender Studies.- The Local Government Unit of Kadingilan shall support to gender-related documentation and researches subject to the availability of funds.

Section 67. Production, Popularization and Campaign of Gender-Fair Materials.- The Municipal Government shall actively promote and publish popular forms of gender-fair materials through all concerned departments and local agencies/networks.

Section 68. Gender and Development Focal Point.- The Gender and Development Council shall be created through an Executive Order and shall be designated as the main GAD Focal Point of the Municipal Government. It shall be the major body that will initiate GAD programs, projects and activities of the Municipal constituents through the various Municipal departments and instrumentalities.

Section 69. Integrated Gender-Sensitive and Environment Friendly Zonification Plan of the Municipality of Kadingilan.- An integrated gender-sensitive environment-friendly Zonification Plan of the Municipality of Kadingilan shall constitute, but is not limited to, the following: a. The Municipal Government as far as practicable shall ensure that relocation of communities shall not deprive women and men of their sources to livelihood. b. Relocation sites shall not contribute to an increase in women’s burden in economic, home and social production.

Section 70. Community-Based Environment Plans and Programs.- Both men and women shall participate in pollution control, environmental and sanitation program.

Section 71. Role of Women and Men in Environment Impact Assessment Projects.- The Municipal Government shall promote the active role of women vis-à-vis men in environmental impact assessment of projects. Instruments for environmental impact assessment shall consciously determine sex-related data.

Section 72. Promotion of Appropriate Technology.- The Municipal Government of Kadingilan shall actively promote alternative technologies that are appropriate and safe for women.

Section 73. Allocate for Basic Social Services.- An appropriation for the basic social services for women and children in extremely difficult circumstances shall be incorporated in the Plans, Programs, Activities of the Local Government Unit of Kadingilan, Bukidnon.

Section 74. Investments and Loans.- The Municipal Government shall hold consultative assemblies with women NGOs/POs in establishing contracts for loans and investments to clarify implications women’s welfare and development at the Barangay level.

Section 75. Overseas Contract Workers’ (OCW) Wives and Children Support.- The Municipal Government shall conduct a survey of overseas contract workers at the Barangay level and results of which shall serve as basis for special support to OCW families, especially wives and children.

Section 76. Special Course on OCW.- A special course on overseas contract work primarily to orient women on the issues and concerns relative to migration shall be conducted in all barangays to be organized by their respective Barangay GAD Committee.

Section 77. Education on National Policies.- Women and men shall undertake education on national policies and their implications on women.

Section 78. Special Training for Lupong Tagapamayapa.- All training courses for Barangay Lupong Tagapamayapa and Barangay

Tanod shall include gender and development basic orientation.

Section 79. Gender and Population.- The Municipal Health Office shall review/design the population program based on the reproductive health framework.

Section 80. Training on Non-Traditional Occupation.- Women shall be given opportunity to acquire training on non-traditional occupation especially in the field of science and technology.

BOOK II – FINAL PROVISIONS CHAPTER ONE – PENAL PROVISIONS ARTICLE I VIOLENCE AGAINST WOMEN AND CHILDREN Section 1. Soliciting Sexual Services.- It is unlawful for a person to solicit a woman’s service sexual purposes as a gift, representation, public relations, or as an act of goodwill regardless of whether solicit or profits or not from such act without prejudice to the provision of the Revised Penal Code and RA 9208 or the Anti-Trafficking in Persons Act. Any person may file a complaint together with the affected women to the proper court. Violators of this Code shall suffer the penalty in accordance with RA 9208.

Section 2. Trafficking in Women and Children.- Any person or agency, who, with the use of force or deceit, lures a woman or boy/girl child to work abroad or in other provinces or cities in the Philippines for a particular job or a promise of high fees, but instead landed on prostitution, domestic help or other odd jobs. Violators of this provision shall be penalized in accordance with the penal provision under RA 9208 or the Anti-Trafficking in Person Act, RA 7610 or the Law on Protection Against Child Abuse, RA 7877 or the Anti-Sexual Harassment Law, RA 8353 or the Anti-Rape Law, and the Revised Penal Code.

Section 3. Prostitution Sex Trade.- An agency or person who shall engage in keeping women for sex for a fee shall suffer the penalty in accordance with the Revised Penal Code.

Entertainment establishment that promote prostitution as defined in this Code shall suffer the penalty in accordance with RA 7610, RA 9208, RA 7877, RA 8353 and RA 7658, RA 9262.

Section 4. Sex Tours.- No hotels, beach resorts, sauna baths and related establishments shall be allowed to operate as conduit for sex tours. Cancellation of business permit, a fine of Two Thousand Five Hundred Pesos (P2,500.00) and imprisonment of six (6) months shall constitute the penalty for violation.

Section 5. “Beauty” Contest.- Beauty contests which tend to commodify, abuse, humiliate and treat persons, especially women and homosexuals as sex objects shall strictly be prohibited in schools, communities, barangays and by the Municipal Government in its special celebrations, but in their stead the projection of women’s strengths and potentials, especially with regard to indigenous and culturally-relevant forms shall be encouraged.

Those who initiated the conceptualization and implementation of the beauty contest shall be subjected to a penalty consisting of the following: For business entities: a) Cancellation of business permit; b) Fine of Two Thousand Five Hundred Pesos (P2,500.00); c) Others, as prescribed in this Code; For representatives of agencies, departments or units of the local government of the Municipality of Kadingilan; a) Suspension for one month without pay; b) Fine of Two Thousand Five Hundred Pesos (P2,500.00); c) Others, as prescribed in this Code; For educational institutions, charity or welfare organizations: a) Cancellation of license to operate; b) Fine of Two Thousand Five Hundred Pesos (P2,500.00); c) or both at the discretion of the court.

Section 6. Fund-Raising Initiative Defined.- It refers to any activity, whether in whole or in part, integrated in any raffle draw, benefit or disco dance, premier showing of movies, or any similar fund-raising undertaking where women are used as donor prize, substitute for prizes won, a companion package for an award prize or recognition, or any manner, activity, come-on display, or exhibition which depicts a woman as central, partial or special focus in order to raise funds.

All fund-raising initiatives as defined in this Code shall be strictly prohibited in the Municipality of Kadingilan. Violators of this provision shall pay a fine of Two Thousand Five Hundred Pesos (P2,500.00) or imprisonment of six (6) months or both at the discretion of the court.

Section 7. Women and Girls in Detention.- No women or girl child shall be kept by any military detachment/checkpoint or any analogous quarter for purposes of comfort, and shall not be deprived of basic social service in detention. Violation shall be penalized through summary dismissal proceedings of the local AFP/PNP and/ or at the discretion of the Local Police Law Enforcement Board.

Section 8. Forced Marriage.- No woman shall be forced to marry on the basis of vitiated consent. Any person or representative committing a fraudulent or coercive act to cause and effect a forced marriage shall be liable under this Code by a fine of Two Thousand Five Hundred Pesos (P2,500.00) or an imprisonment of six (6) months, See ordinance, page B6

or both at the discretion of the court.

Section 9. Regular Surveillance of Entertainment Establishment.- A PNP shall conduct regular surveillance of business establishments involved in trading women’s bodies such as (a) prostitution, publication, display and distribution of pornographic scenes on movies/TV shows, trailers, billboards and other materials and literature that treat as sex objects and commodities; organizing and promotion of pornographic and indecent shows depicting women and girls as sexual objects either in nude provocative gestures and mounting live shows where women or girls-child are influenced or forced to enter or do naked shows in public or private places.

Any person or agency who engages in organizing or production these activities that exploit women or girls children violate human rights and shall be dealt with under the law.

Section 10. Violence Against Women.– Any violator of this Code as stipulated in Section 1, Chapter Two in Book I shall be penalized in accordance with R.A. 9262.

Section 11. Pedophilia.– Any act falling under the definition of pedophilia shall constitute a violation of this Code as stipulated in Section 9, Art. I Chapter Two in Book I. Any violator of this provision shall be penalized in accordance with R.A. 9262.

ARTICLE II LABOR AND EMPLOYMENT Section 12. Equal Access to Job Training and Promotion.– No woman shall be deprived of job hiring and promotion on account of her gender, age, ethnicity, creed, religion and civil status. Violations committed by employers shall constitute a fine of Two Thousand Five Hundred Pesos (P2,500.00) and temporary cancellation of business permit for the first offense and Two Thousand Five Hundred Pesos (P2,500.00) fine and permanent cancellation of business permit for the second offense or as prescribed by the court in accordance with penal provision under the Labor Code. The government unit or agency head is liable with the penalty of three months suspension and a fine of One Thousand Pesos (P1,000.00).

Section 13. Wage and Benefits for Women.- Every employer shall comply with the minimum wage as stipulated by the Regional Wage Board or passed by the Congress and shall grant all benefits to all women employees such as maternity leave, sick and vacation leave, retirement, termination and other benefits provided by law. Violation by private employers shall constitute a fine of Two Thousand Five Hundred Pesos (P2,500.00) and a cancellation of business permit or as prescribed by the Court in accordance with penal provision under the Labor Code. The agency or company head which violates this Code shall be liable with the penalty of three months suspension and a fine of One Thousand Pesos (P1,000.00).

Section 14. Facilities and Support System for Women.– The Local Government Unit of Kadingilan shall ensure the safety and health of women employees. In appropriate cases it shall require employers to: a. Establish separate toilet rooms, lavatories and lounges for men and women, and provide at least additional dressing room for women.

Violation by private employers shall constitute a fine of Two Thousand Five Hundred Pesos (P2,500.00) and the cancellation of business permit of license to operate for six (6) months. For Local Government office or agency, administrative sanctions shall be imposed.

Section 15. Barangay Education on Gender Sensitivity.– All barangays in the Municipality of Kadingilan shall conduct compulsory training and education for both Barangay Tanod, Barangay Government Officials, house helpers, and house helper employers on gender sensitivity. An administrative sanction shall be imposed on any Barangay Council which fails to comply with this provision.

Section 16. Women in the Entertainment Industry.– Women engaged in the entertainment industry shall be recognized as wage earners and they shall receive a minimum wage and the benefits entitled to women workers and shall render services as set in the job contract and only in the place of work specified in the business permit of the establishment concerned. Violation of this provision shall be subjected to a fine of Two Thousand Five Hundred Pesos (P2,500.00) or cancellation of business permit, or both at the discretion of the Court.

Section 17. Police Operations in Entertainment Establishment.– All police operations or raids conducted in any entertainment establishment must be undertaken with utmost respect for human rights.

Police officers shall not take this opportunity for sexual exploitation of or extortion from entertainers and others concerned parties. The Municipal Government shall also regulate the media coverage.

ARTICLE III SPECIAL SECTORAL CONCERNS Section 18. Barangay-Level Sanction on Cases of Harassment Committed Against Differently-Abled and Elderly Women.All barangays in the Municipality of Kadingilan shall formulate a barangay-level sanction on cases of harassment committed against differently-abled and elderly women.

Failure to comply with this provision shall subject the Barangay Council to an administrative sanction.

Section 19. Gender Sensitivity Orientation and Training.- Schools, offices, establishments, departments and agencies including Barangay Government shall initiate gender sensitivity orientation and training which shall equip them with theoretical and practical knowledge of justice. Non-compliance of this provision shall requires the concerned party to pay a fine of Two Thousand Five Hundred Pesos (P2,500.00) and issuance of warning by the GAD Focal Point.

CHAPTER TWO ARTICLE I PROVISIONS FOR IMPLEMENTATION Section 20. The Municipal Gender and Development (GAD) Focal Point. The Municipal GAD Focal Point shall ensure the promotion of women’s empowerment and equality and equity between women and men in the Municipality, and is primarily responsible for ensuring the sustained implementation of this Municipal GAD Code. To achieve these, it shall perform the following powers and duties. a. Catalyze, coordinate, provide directives to monitor, and serve as technical adviser for programs/projects on women/gender and development consensus within the municipality; b. Review the mandated tasks of the LGU as per RA 7192 and other Presidential Directives on the course of action to be taken; c. Conduct a Gender Responsive Planning Workshop; d. Make a Comprehensive and Integrated Plan and Program for Women in the Municipality and ensure implementation thereof; e. Establish a Data Bank Unit; f. Prepare final draft of the GAD Plan and Budget; g. Prepare Gender and Development Code; h. Attend Annual Focal Point Assemblies and establish linkages with the National Commission on the Role of Filipino Women (NCRFW); i. Require the LGUs Personnel Unit to look into the situation of women and men within the unit and to review the policies and practices in relation to hiring, training, promotion and retirement to eliminate gender biases therein; j. Perform other related tasks as may be directed by the Municipal Mayor in order to produce desired output.

Section 21. Composition of the Municipal Gender and Development Focal Point.- The GAD Focal Point shall compose of the following: Mayor, Sangguniang Bayan – Chairperson of the Committee on Social Welfare, Family and Gender Development, Chairperson of the Committee on Women Development, Chairperson of the Committee on Health and Sanitation Development, Chairperson of the Committee on Labor, Employment and Overseas Development, Chairperson of the Committee on Good Governance, Rules and Laws, and People’s Empowerment Development, Sangguniang Kabataan Federation President, ABC President, Municipal Planning and Development Coordinator, Municipal Social Welfare and Development Officer, Designated GAD Focal Person, Municipal Budget Officer, Municipal Treasurer, Municipal Accountant, Municipal Health Officer, Municipal Agricultural Officer, Municipal Local Government Operations Officer, Human Resource and Management Officer, Municipal Civil Registrar, Chief of Police, PNP – Women’s Desk Officer, Bukidnon Environment and Natural Resource Officer (BENRO), Municipal Engineer, Secretary to the Sangguniang Bayan, MEEDO Manager, NHS Principal, CES Principal, DepEd Non-Formal Education Coordinator, Women’s Federation President, Senior Citizens’ Federation President, Youth Association President, Empowerment & Reaffirmation of Paternal Abilities (ERPAT) President, People with Disability Association President, Legislative Assistants, NGO/CSO/ PO Representative, 17 Focal Persons of the Barangays.

Section 22. Functions of the Gender and Development Focal Person.- The GAD Focal Person shall perform the following: a. Provide Secretariat services in the implementation of various activities of the GAD Focal Point; b. Provide technical assistance and administrative support in the operation of the GAD Focal Point; c. Serves as Coordinator of GAD related activities; d. Facilitate a Trainor’s Training on GAD; e. Ensure that GAD activities of the LGU are replicated in the barangay level; f. Facilitate GAD forums in different barangays of the municipality; g. Perform other function as may be requested by the GAD Focal Point.

The Council operations shall be detailed in the Implementing Rules and Regulations of this Code.

Section 23. Local Monitoring Board for Violence in Media. A local monitoring board for print, broadcast, and multimedia shall be set-up to classify measure, prohibit, or regulate the production of materials degrading women in the Municipality. The Board’s Function shall also extend to photo shops, electronic communication cable television, books and other forms of audiovisual channels.

Section 24. Creation of Women and Children’s Help Desk (WCHD).- The Municipal Government shall create the WCD and appoint a WCD Office in the police station in the Municipality of Kadingilan specifically to handle women and children’s concerns. Complaints filed by women on battering and other forms of abuse against them shall be handled by female officers in the local police force who shall avail special courses on handling cases affecting abused women.

Section 25. Creation of Medico-Legal Desk for Women and Children at the Municipal Health Office.- There shall be medico-legal desks for women at the Municipal Health Office to cater assistance specifically to women problems and concerns.

Section 26. Community Education on Trafficking.- The Barangay GAD Committees shall conduct massive information campaigns and continuing education on trafficking of women and children; monitor trafficking activities in their respective communities; and develop a system for reporting or referral of victims to appropriate agencies.

Section 27. Special Body to Investigate Cases of Violation of Women Under Police or Military Detention.- No women or girl child shall be kept by any military detachment/checkpoint or any analogous quarter for purposes of comfort, and shall not be deprived of basic social service in detention. Violation shall be penalized through summary dismissal proceedings of the local AFP/PNP and/ or at the discretion of the Local Police Law Enforcement Board.

Section 28. Generating Sex-Disaggregated Data and Undertaking Gender Analysis.- It will be the main function of all Barangay GAD Committees to periodically generate sex-disaggregated data of their respective communities. This shall all be the duty of all concerned Municipal Departments and of the partner NGOs/POs to enable them to provide situational analysis for better formulation of the Municipal GAD Plan.

Section 29. Guidelines for Determining Gender Biases. The Municipal Government, through the Office of the Municipal Mayor shall issue guidelines to determine gender biases in Municipal offices, departments and instrumentalities, schools, and private offices, commercial/industrial establishments, etc. and promote the prevention of these biases.

Section 30. Creation of a Municipal Tripartite Committee to Monitor the Implementation of Labor Standards.- There shall be a Tripartite Committee composed of representatives of the Sangguniang Bayan and Municipal Mayor’s Office, Organized labor and association of employers and employees. The Tripartite Committee shall be tasked to: a. Monitor the implementation of labor standards set under this Code; b. Establish a Labor Assistance Desk where women workers could file complaints or seek legal assistance advice on labor issues to promote industrial peace; c. Recommend to the Municipal Council on issues or complaints lodged with the Labor Assistance Desk; d. Formulate rules/mechanics for monitoring labor standards; and e. Conduct regular labor standards orientation for the Municipal Women Workers in coordination with the Municipal GAD Focal Point.

Section 31. Formulation of Implementing Rules and Regulations (IRR).- Within six (6) months after approval of this Code, the Municipal GAD Focal Point shall formulate and issue the appropriate rules and regulation necessary for the efficient and effective implementation of this Code.

A consultative body shall be convened after the initial formulation of the Code’s Implementing Rules and Regulations to validate the draft document. It shall be composed of representatives of the Focal Point and the municipal departments and offices, NGOs/POs and Barangay officials involved in the process of drafting this Code.

The IRR shall take effect after it is ratified through a resolution by the Sangguniang Bayan upon posting in conspicuous places in three (3) consecutive weeks.

Section 32. Compliance Report.- Within six (6) months from the effectivity of this Code and every six (6) months thereafter, the Municipal GAD Focal Point shall submit a report to the Municipal Mayor and the Sangguniang Bayan on their compliance with this Code.

Section 33. Appropriation.- For the effective implementation of this Ordinance, the Municipal Government shall appropriate not less than five percent (5%) of its Programs, Projects, and Activities (PPAs) which are Gender responsive.

CHAPTER THREE ARTICLE I FINAL PROVISIONS Section 34. Separability Clause. If, for any reason, any section or provision of this Ordinance is declared unconstitutional or invalid, the other sections or provision thereof which are not affected thereby shall continue to be in full force and effect.

Section 35. Repealing Clause.- All ordinances, rules and regulations, or part thereof, in conflict with, or inconsistent with the provisions of this Ordinance are hereby repealed or modified accordingly.

Section 36. Effectivity Clause. This ordinance shall take effect upon approval and after publication in the newspaper of general circulation.

a) Any person selling or serving liquors, alcoholic beverages, coconut wine (tuba), other nature wines and the like that cause intoxication are hereby prohibited to sell or serve the same beginning 10:00 o’clock in the evening (10:00 p.m.) until 8:00 o’clock in the morning (8:00 a.m.) of the following day; b) The drinking and consumption of liquors, alcoholic beverages, coconut wine, other nature wines and the like that causes intoxication within the establishments or in other public places such as, but not limited to: streets, plazas, parks, parking areas and other uninhabited places within the same period, that is beginning 10:00 o’clock in the evening (10:00 p.m.) to 8:00 o’clock in the morning (8:00 a.m.) of the following day are likewise prohibited; c) All business establishments shall stop selling or serving liquors, alcoholic beverages, coconut wine, other nature wines and the like within the same period;

Explanatory Note: WHEREAS, the Local Government Unit of Kadingilan provide the Boxing Ring and its Accessories for the entertainment of the constituents who chose boxing sports; WHEREAS, most of the growing children in the municipality like boxing event to improve their spirit of sportsmanship and develop their physical ability and mental alertness; WHEREAS, the endeavour of the Local Government Unit is to encourage the youth in getting sports to pre-empt and divert them from vices; WHEREAS, the Municipal Treasurer’s Office must collect rental of boxing ring and accessories to all users in the amount of Two Thousand (P2,000.00) Pesos for one day and additional of Five Hundred (P500.00) Pesos for the next succeeding day, to be picked up at the stationed location; WHEREAS, the proposed imposition of said rental fee is to help the LGU generate additional revenue for the proper maintenance of said boxing paraphernalia and for funding other sports improvement projects and activities for the eventual youth development;

Business Optimism Lower for Q3, Rises for Q4 2016 Business confidence is slightly lower than the previous quarter’s survey

Business outlook on the economy turned slightly less optimistic for Q3 2016, with the overall confidence index (C!) declining to 45.4 percent compared to 48.7 percent in the Q.2 2016 survey. This indicates that the number of optimists declined Cut continued to be greater than the number of pessimists during the quarter. The confidence index is computed as the percentage of firms that answered in the affirmative less the percentage of firms that answered in the negative with respect to their views on a given indicator.

Despite the typical decline in sentiment during the third quarter due to seasonal factors, the current quarter index is the highest Q.3 reading of all time. Respondents attributed their less buoyant out-

look to expectations of: (a) interruption of business activities during the rainy season, (b) slack in demand during the planting and closed milling seasons, (c) lower consumer demand as households prioritized enrolment expenses, (d) implementation of stricter new mining policies that put some mining concessions on hold, (e) closed fishing season in Davao Gulf from July to September, (f ) stiff competition, and (g) concerns over the weak global economy. The sentiment, of businesses in the Philippines mirrored the less buoyant business outlook in the US, UK, Germany and Hong Kong, but was in contrast to the more bullish views of those in France, Italy, South Korea, India and Switzerland.

For the quarter ahead

(Q4 2016), business outlook turned more upbeat as the next quarter index rose to 56.8 percent from 45.3 percent in the previous quarter’s survey results.

This reading suggests that growth could accelerate in the last quarter of 2016.

Respondents’ more positive outlook for Q4 2016 was due to expectations of; (a) the expected uptick in consumer demand during the holiday, harvest and milling seasons, (b) increased confidence in the new administration, (c) continued increase in orders f.md projects translating to higher volume of production, (d) expansion of businesses and new product lines, (e) introduction of new and enhanced business strategies and processes, (fl improved farm gate prices, and (g) onening of high seas/fishing operations in

October. Their more positive outlook was further driven by expectations of an acceleration in the rollout of infrastructure and other development projects under the public-private partnership (PPP) program and the favorable macroeconomic conditions in the country (particularly, stable inflation and low interest rates), sustained foreign investment inflows and the steady stream of overseas Filipinos’ (OFs) remittances.

The outlook across trade groups is mixed The outlook of businesses involved in international commodity trading was mixed for Q.3 2016.

Among business types, importers and domesticoriented firms’ views were relatively less favorable.

Meanwhile, the optimism of

exporters and dual-activity firms improved. For the quarter ahead (Q4 2016), the sentiment across different types of businesses was more optimistic, with the exception of dual-activity firms.

Business confidence across sectors is broadly less favorable Bus i ne ss s e nt i me nt across sectors was generally less upbeat for Q3 2016 and more buoyant for Q4 2016.

This is with the exception of the construction sector, whose outiook was more favorable for the current quarter but deteriorated slightly for the next quarter.

Industry firms (i.e., mining and quarrying, manufacturing, and electricity, gas and water) were less optimistic for Q3 2016 largely due to the usual slack in production activities dur-

ing the rainy season, stiffer competition, and decrease in sales receipts of energy firms with the decline in power rates. Meanwhile, firms in the agriculture, fishery and forestry subsector were bullish as they expected more favorable farming conditions with the end of El Nino.

Likewise, due to the seasonal slack in demand in the third quarter, the outlook of the wholesale and retail trade sector was less buoyant compared to that a quarter ago. Trading firms’ outlook was dampened by the sluggish demand during the planting season/closed milling season, adverse effects of weather disturbances (with the expected onset of La Nina), and concerns over the economic situation in Europe.

Under the new customs law, the BOC is required to come up with an improved system on customs administration and procedures that comply with international standards.

Amending certain provisions of the Tariff and Customs Code, RA 10863 sets tougher penalties against smuggling, with a maximum prison term of 20 to 40 years depending on the amount of goods illegally brought into the country.

Among the other expected reforms under the CMTA are the full electronic processing of all documents, forms, and receipts, along with streamlining methods for the examination and valuation of imports and exports.

Last Aug. 17, the DOF and the BOC held the first of a series of public consultations on the CMTA’s IRR at the Ayuntamiento de Manila in Intramuros, attended by some 100 stakeholders from the private sector. The dates of the next public consultations will be published on the microsite. (PNA)
