PNP-10 head urges public to be vigilant

CAGAYAN de Oro City-Chief Supt. Noel Constantino, the head of Philippine National Police in Region 10 (PNP-10), has ordered all police units in the region to strengthen and intensify its intelligence monitoring.

Constantino has instructed the policemen on the ground to conduct checkpoint to constrict the entry of the terror groups, who stormed the Marawi City jail on Sautrday that

Digong expected to escort lumads return to their homes

SAN FRANCISCO, Agusan del Sur—President Rodrigo Duterte is expected to personally supervise the planned safe return of the more than 3,000 Manobo “lumad” evacuees on September 2 in Lianga town in Surigao del Sur. Bishop Modesto Villasanta of the United Church of the Philippines (UCCP) who is convenor of Friends of the Lumad in Caraga, said he is hopeful that the president would make good on his commitment to be in Tandag City on that day based on what they have discussed in their meeting in Malacanang on August 15.

The meeting with the president was arranged by UCCP Council of Bishops led by Bishop Reul Norman Marigza, secretary-general of the council.

“The president himself had assured us during our meeting that he will personally supervise the safe return of the lumads back to their communities,” Villasanta said.

The scheduled homecoming of the displaced lumads will happen exactly a year and a day after they were forced to leave their communities when members of the paramilitary

group Magahat-Bagani killed three lumad leaders in the village of Diatagon town on September 1 last year.

Col. Isidro Purisima, commanding officer of the 75th Infantry Battalion, has assured that his troops will pull out from their Army camp in Sitio Han-ayan when the lumads will notify them on their confirmed date of their return.

Purisima said the Army will just assist the residents upon their return and will informally turn over Sitio (subvillage) Han-ayan when they reach there to ensure that they are safe and show them that the military has not damaged anything of their properties.

“Even before, we are ready to assist them. This is our mandate to protect the civilians from any harm,” he said.

The Army official said they will discuss the details of the turn over and military pull out in Han-ayan during their meeting with the representatives of the lumads including Villasanta on Tuesday.

He denied claims from Malahutayong Pakigbisog sa mga Sumusunod (Persevering Struggle for the Next Generation) or Mapasu, an indigenous peoples’ organization, that his men have

ransacked the houses and damaged the facilities of the lumad school Alternative Learning Center for Agriculture and Livelihood Development (Alcadev).

“There is no truth about it. In fact, we guarded Hanayan from anybody who will infiltrate the community while the residents were away,” Purisima said.

But Mapasu said members of the group that visited the site on August 24 were “enraged upon seeing the large military camps in our communities in Kilometer 9 and Han-ayan.” The ocular inspection in 11 communities was initiated by the provincial government.

“Our hearts were crushed upon seeing our houses damaged, our once productive farms covered with weeds and our schools rendered unusable,” Mapasu said in a statement.

The lumads left their homes last year after three lumad leaders, Dionel Campus, Emerito Samarca, administrator of the Alternative Learning Center for Agriculture and Livelihood Development (Alcadev), and Juvello “Bello” Sinzo were shot and killed by Magahat-Bagani militiamen in Han-ayan.

Five-decade conflict ends as communist rebels sign joint agreement with PH government

OSLO, Norway--The Communist party of Philippines announced an indefinite ceasefire in a joint statement with the Philippines government bringing a five-decade long conflict to an end.

“The joint statement we are signing manifests the historic significance of what we have achieved,” said Jose Maria Sison, founder of the Philippines Communist Party.

Philippines presidential peace adviser Jesus Dureza called the decision of the Communist party a “historic and unprecedented event.”

it to President Rodrigo Duterte for the incident.

The Philippine government had announced unilateral ceasefire the last week itself and President Duterte had released 16 rebels ahead of the talks to accelerate the peace process.

As part of the agreement, the Communists have decided to put down their arms. The two parties also agreed to speed up economic and social reforms within six months.

The two sides are expected to reach an agreement on political and constitutional reforms, before they negotiate a final agreement on ending the armed conflict.

“We are on the highway to peace and we are talking of a timeline of maximum 12 months,” Silvestre Bello, the Philippine government delegation’s head of negotiations reportedly said.

The announcement by the Communist Party came during negotiations between the rebels and the Philippine government in Oslo, Norway.

Ahead of the talks, the head of the rebel delegation, Luis Jalandoni had expressed optimism about the talks.

Both sides have agreed to meet in Oslo again between October 8 and 12.

The Communist Party had started rebellion against the Philippines government in 1968.

Over 150,000 people are believed to have died in the conflict that has raged for five decades. The armed faction of the Communist party has only 4,000 gunmen left today as opposed to the 26,000 soldiers in their ranks in the 1980s. Big News Network.com

Organic farming: Only way to arrest global soil crisis Last of two-part series

CAGAYAN de Oro City-Soil is vital for human survival. It is the core basis of agriculture. Therefore, building soil of high quality is critical to sustain life.

Life, however, is being threatened by a crisis more pernicious and insidious since it exacerbates climate change, among others. If not removed, this has the power to destroy all life from the face of the Earth. This threat has been observed for millennia and is attributed to have caused the destruction of countless civilizations since the Neolithic age.

But it was only two years ago that the alarm has been sounded.

This threat is called the Global Soil Crisis.

“If current rates of degradation continue, all of the world’s topsoil could be gone within 60 years,” said Maria-Helena Semedo, deputy director-general for natural resources of the UN’s Food and Agriculture Organization (FAO) during a forum marking World Soil Day in December 2014.

“Soils are the basis of life.

Ninety-five percent of our food comes from the soil,” Semedo added.

“A rough calculation of current rates of soil degradation suggests we have about 60 years of topsoil left. Some forty percent (40%) of soil used for agriculture around the world is classed as either degraded or seriously degraded – the latter means that 70% of the topsoil, the layer allowing plants to grow, is gone.

Shortsighted agri policies blamed The unpre ce dente d rate of soil degradation is blamed on various human activities. “The loss of over 25 billion tons of topsoil from our cropland each year is the price we pay for shortsighted agricultural policies designed to boost food output at the expense of soils, and of failed or nonexistent population policies,” lamented the Washington D.C.-based Worldwatch Institute.

In his first briefing as Agriculture secretary last July, Emmanuel “Manny” Piñol discovered that the Department of Agriculture has been using a 40-year-old soils data simply because previous administrations refused to grant the financial request for soil mapping by the Bureau of Soil and Water Management (BSWM).

“In the first briefing I received from officials of the Department of Agriculture (DA), I found out that the soils analysis data used by the department in waging a war against hunger were actually gathered over 40 years ago...An official of the Bureau of Soil and Water

Management (BSWM) told me that they have been asking for additional budget for the soil mapping but the request was not granted,” Piñol wrote in a note in his Facebook page. He said he asked for the BSWM official “to submit to me an estimated budget requirement for the conduct of a national soil testing so that.. the DA [can] come up with a Color-Coded Agriculture Guide Map.” “A national soil testing and sampling is very vital in determining which region of the country could grow which crop best based on soil components and fertility. Also, it would effectively guide the DA and the farmers in determining what nutrients are deficient in the soil in specific areas,” Piñol said.

Healthy topsoil, healthy earth Soil degradation is a silent epidemic. Every nation is affected. The pressures on soil are increasing as the world population grows. Thus, keeping topsoil healthy is synonymous to keeping the earth healthy.

Ultimately, it is keeping life healthy.

Scholars believed that food insecurity is one of the threats that modern society must face especially since global population has grown exponentially.

As of mid-2011, estimates put the world population at 7,021,836,029 and are

expected to rise to 9.3 billion in 2050. Scholars also postulated that the world’s population will double in the next 50 years if the current growth rate of 1.3 percent continues. Food production, however, has continually declined. And this is blamed mostly on global warming, urban sprawl, and land degradation — which is blamed on loss of topsoil from water erosion and fertility decline.

food demand, the UN estimates that about 6 million hectares of new farmland will be needed every year.

Instead, 12 million hectares a year are lost through soil degradation.

“We need to keep our soil healthy, which means we have to make it fertile, always,” Honorio Cervantes said. “To keep soil fertile, we need to add organic matters to it. In short, we need to practice organic agriculture,” added Dr. Elmer Sayre.

Cervantes is the Philippine innovator of the square-foot gardening whose SquareFoot Garden in Barangay Pagatpat, Cagayan de Oro City is an Agricultural Training Institute (ATI) learning site that is hailed for Good Agricultural Practices (GAP). Sayre, on the other hand, is the founder and in-house adviser of the internationally-acclaimed Water, Agroforestry, Nutrition and Development (WAND) Foundation, based in Libertad, Misamis Oriental.

Topsoil, that upper layer of the earth’s surface which varies in depth from an inch to 8 inches, plays a very important part to agricultural productivity because it is where most of the earth’s biological soil activity occurs and has the highest concentration of organic matter, nutrients and mi-

croorganisms. Typically, plants generally concentrate their roots in and obtain most of their vital nutrients from this layer. Loss of topsoil, therefore, is one of the most significant barriers to agricultural productivity.

Thus, keeping our topsoil healthy is one of the most critical factors in keeping the Earth healthy.

“The secret to successful agriculture is giving the soil an enabling environment for water, air and micro-organisms to stay harmoniously healthy,” said internationally-recognized Jojo Rom, innovator and father of Urban Container Gardening (UCG). And this can only be done through organic farming.

Organic farming is a strong economic driver in improving soils. And humans need to improve soils since soils provide ecosystems services and is very important in achieving the UN Sustainable Development Goals, said Cristina Grandi, chief food security campaigner at the International Federations of Organic Agriculture Movements (IFOAM)—Organics International.

IN any state (a country), it is common for the leader finding difficulty in the beginning of the government. This is obvious when the government administration is during the postpresidential election. In such a situation, multi-interests among the oligarchies come up—hindering the existing government development program. In that case, there is always uncertainty such as which one is to be put the first and which one is the later.

Cabinet reshuffle may happen so sudden that it can also slow down the track of the government administration operation. Logically, changing the cabinet means having a new adaptation to the new system. And, that is why, in such a condition, the existing government administration tends to be bogged down in making important policies.

It is common, especially for the developing countries, where the people are easily attracted by the polemic of the political issues. Political issues always raise the weaknesses of the existing government administration and the cabinets. Mostly, the criticism is done by those who are in group of political powers—oligarchies. They are the handicaps—making the government administra-

tion bogged down. However, their criticism can also be a good input for the government.

They have their own interests which have been defined since the previous government. In that atmosphere, there are always criticisms directed towards the existing government.

Cabinet reshuffle and scrutinizing the replacements are the duties of the smart leader in the state, if it is necessary. Choosing the new cabinet member without hard scrutiny will result in dispute for there are always oligarchies.

The oligarchies with their own interest should be crystallized during the process of selecting the cabinet, especially when cabinet reshuffle is done. Only can the smart leader select the government organs in such a difficult situation. This leader might have some bright people surrounding

one can deny the policies directed to providing the best public services to the whole people in the state.

Crystallizing the multiinterests of the oligarchies and selecting the cabinets for making the best policies are the tasks of the smart leader. The chosen cabinet member representing the oligarchies and their power can smoothen any policy being made. That is the smart strategy to crystallize the multi-interests among the oligarchies.

There is no multi-interest, but public interest in serving the whole people in a state. Security, a good living standard, education, health care, as well as infrastructures for public purposes are the examples of the products of the best strategies.

The truth is that, the Bible contains warnings about the occurrence of deadly and destructive earthquakes all around the world. The most fearsome of these warnings comes from Jesus Christ, our God and Savior.

In Matthew 24:7, Luke 21:11, and Mark 13:8, Jesus said there will be earthquakes in various places.

Side by side with this natural calamity would be famines among many peoples, and wars between nations and kingdoms. But, aside from death and destruction, what do these dangerous calamitous occurrences portend?

Two things. The first is the return of Jesus to earth.

The second is the destruction of the world or, as some others would say, the end of the world. Of course, many treat these predictions as nothing but old men’s myths, but the question that is compelling is this: if the part of the predictions about earthquakes, famines, and wars, are proving to be correct, cannot the other

part pertaining to the return of Jesus and the end of the world be similarly accurate?

I am amused that no one seems interested to talk about what the Constitution provides on this issue. Why? Maybe because they are aware that the Constitution severely restricts the grant of emergency powers to any president, such that no emergency powers could be given to him just to solve a traffic problem.

The public silence in the culture of death

THE death toll surges since President Rodrigo Duterte has intensified his war against crime and drugs.

His war has taken more than 700 lives, including different law offenders, from robbers, users, and pushers, embroiling even suspects and mistaken identities.

This spike of killings has been condemned by different voices and organizations. Senators’ privilege speeches call that the killings must be stopped.

The presidents of the top universities have voiced their opposition against the emerging culture of death. Religious institutions, human rights groups,

and concerned citizens also condemn the apparent lack of due process through extrajudicial killings and summary execution, which aim to sweep the streets of criminals and make it safe for the citizens by law. They think these methods to combat crimes and drugs are against the fundamental right of every human being—the right to life.

While some groups have advocated the stop of the killings, why most of the Filipinos have tacitly supported the bloody means of the new administration?

We have been warned

by Duterte during his election campaign that his war

will be “bloody”; he has stated brusquely that he will “kill” those who are involved in crime and drugs.

His thuggish words inspire vigilantism and unlawful method to combat crime. There’s a reason why he is called as the “the Punisher.”

Yet despite all his admonitions, we embraced him.

Social media reacts to his whimsical and fiery comments approvingly. We gave him more than 16 million presidential votes overwhelming his opponents.

And at the recent Pulse Asia Survey, the president sets a record high of 91% trust rating from the Filipino people.

Our public silence and tacit support from all the killings stem from our helplessness from the previous injustices and deprivation for an execution of a fair justice system.

As a nation, we are still the corpses of the bloody gladiators being dragged in the Spoliarium. Juan Luna painted the gory sight more than a century ago, but its images still resonate the

injustices of the present. Our condition might no longer as bloody and brutal when the scene was painted, but our bodies are still as weary as we ache for real justice that has been -- for a long time -- deprived to us.

For more than 300 years, we understood that justice is only for the Spaniards; and for more than 40 years, we understood that justice is only for the Americans.

And until today, although our colonizers are gone, justice remains only for the few. Justice is a privilege of the powerful and the influential.

Fresh in our memory is the massacre of 58 bodies, killed in the town of Ampatuan, Maguindanao,

a night in November 2009.

Almost seven years after the tragic event, despite of 150 witnesses and documentary evidences, justice remains elusive. Not a single verdict is ruled against the suspects.

No wonder, three decades after martial rule, the human rights group Karapatan described our situation as “no better than martial law.” It could be an exaggeration, but the fact is the culture of impunity and rampant human rights violations remain.

During the Arroyo’s regime, the Commission on Human Rights (CHR), Karapatan, and Ibon Foundation recorded 1,200 victims of extrajudicial

TANDAG City--Communist guerillas freed yesterday the rookie police officer in a remote village here after 52 days of captivity.

The release of Police Officer 1 Richard Yu of Carmen Municipal Police Office in this province was more dramatic after the New Peoples Army front 30 even cleared him of the alleged drug charges he faced which prompted his arrest from the rebels in July 5.

The Alternative Learning System (ALS)

The basis of the implementation of Alternative Learning System (ALS) in the Philippines is stipulated in the 1987 Philippine Constitution that provides for the recognition and promotion of other forms of education other than formal education. Article XIV, Section 2, Paragraph (1)s declares that the State shall establish, maintain and support a complete, adequate and integrated system of education relevant to the needs of the people and society; and paragraph (4) concisely encourages non-formal, informal and indigenous learning systems as well as self-learning, independent and out-of-school study programs particularly those that respond to community needs (DepEd).

The Governance Act for Basic Education otherwise known as the Republic Act 9155 stipulates the establishment of the Alternative Learning System (ALS) to further provide out-ofschool children, youth and adults population with basic education.

There are two major programs on ALS that are being implemented by the Department of Education, through the Bureau of Alternative Learning System (BALS). One is the Basic Literacy Program and the other is the Continuing Education Program- Accreditation and Equivalency (A & E). Both programs are modular and flexible.

This means that learning can take place anytime and any place, depending on the convenience and availability of the learners.

3.18 Plastic Wastes refers to any plastic packaging material thrown as waste.

3.19 Plastics refers to a material that can be reshaped or remolded by applying heat and pressure. Most plastics are made from synthetic resins (polymers) through the industrial process of polymerization.

3.20 Plastics materials refers to plastic bags, plastic wares, plastic containers, plastic spoon and fork, plastic straw, Styrofoam.

3.21 Poly (caprolactone) that is produced via benzene and cyclohexanone which degrade readily in composts.

3.22 Polylactic acid PLA, that is produced from 2-hydroxypropanoic acid (lactic acid), fermentation of sugars from maize (corn syrup) and cane sugar (molasses) using the lactobacillus bacterium.

3.23 Poly (hydroxybutanoate), PHB a polyester that is produced by fermentation of glucose solutions, from hydrolyzed starch, to which propanoic acid and Ralstonia metallidurans have been added. It is readily hydrolyzed by acids and thus can be easily degraded.

3.24 Polyethylene (PE) is a polymer of ethylene, a non-renewable fossil fuel derivative that comprises most of the non-degradable plastics. It involves in the production of both the High-density polyethylene (HDPE) and Low-density Polyethylene (LDPE). It can also be called as polythene. Their recycling code is labeled 2 and 4 for HPDE and LDPE, respectively.

3.25 Polypropylene (PP) is a polymer of propylene, a non-renewable fossil fuel derivative that is used for making thin films of transparent pouches and smaller packaging wraps and containers.

3.26 Polystyrene foam means any styrene or vinyl chloride polymer which is blown into a foam-like material 3.27 Primary Packaging Material refers to those types of packaging for containing wet produce, snack foods, frozen foods, hardware, etc.

3.28 Provincial Environment Protection (PEP) Day refers to the banning of the use of plastics and other non-biodegradable materials every Wednesday and Sunday of the week in the Province of Misamis Occidental.

3.29 Recyclable are those made solely of materials that are capable of being separated from waste stream by food service business and made available for collection and delivery to a processor for reuse or remanufacture into the same or other products.

3.30 Recyclable paper bags means a paper bag that ( a) contains no old growth fiber, (b) is 100 percent recyclable overall and contains a minimum of 40 percent post consumer recycled content, (c) is compostable, and (d) displays the words “reusable” and “recyclable” in a highly visible manner on the outside of the bag.

3.31 Retail/business establishments means any retail and/or business establishments located within the jurisdiction of the Province of Misamis Occidental.

3.32 Reusable bag is a bag with handles that is specifically designed and manufactured for multiple reuse and is either (a) made of cloth or other machine-washable fabric, or (b) made of durable plastic that is at least 2.25 mm thick.

3.33 Store refers to a drugstore, supermarket, wet market, groceries, sari-sari or any wholesale or retail establishment which provides plastic carry-out bags to its customers as a result of the sale of the product.

3.34 Styrofoam refers to a kind of non-degradable packaging material used as food containers, disposable cups, plates, etc.

3.35 Styrofoam is a disposable product made of polystyrene, which is a petroleumbased plastic. Styrofoam is made through a process of heating and cooling.

This process enables the Styrofoam to break down when used in the microwave.

Once the product breaks down, plastic can leech into your food and get into your body.

3.36 Styrofoam (PS) is a polymer of styrene resin that is extruded to form food containers, such as disposable cups and plates. It is a non-degradable material, where its monomer is classified by the International Agency for Research on Cancer (IARC) as Group 2A – Probable Human Carcinogen. It posed both acute and chronic health effects to human, that is, it causes mucuous membrane irritation, gastrointestinal effects, headache, fatigue, weakness, hearing loss and peripheral neuropathy. Its recycling code is labeled 5.

3.37 Totally degradable plastics refers to that which contain prodegradant additive, such as 1 to 2% Cobalt (III) and manganese (III) octadencanoates or stearates that cause chain scission within the polyethylene materials, followed by bacterial degradation; 3.38 Wet Goods refers to any product that requires refrigeration or freezing to maintain such as fish, meat, fresh poultry products, fruits, vegetables, beverages and cooked foods in carinderias/eateries.

3.39 Wet Market generally refers to the store of products that requires refrigeration or freezing to maintain. These include the wet section in public markets. supermarkets, mini marts, restaurants and carinderias/ eateries.

3.40 Woven Bags (a.k.a. Bayong) -refers to biodegradable packaging material made of woven pandan or burl leaves and other similar materials.

BE IT ORDAINED, by the Sangguniang Panlalawigan in Session that:

SECTION 1. Title - This Ordinance shall be known as, “An Ordinance Regulating the Use of Non-Degradable Lightweight Plastic Packaging Materials and Food Containers, and Declaring Wednesdays and Sundays as Provincial Environment Protection (PEP) Days in the Province of Misamis Occidental”;

SECTION 2. Scope. - This Ordinance shall be enforced in all Local Government Units in the Province of Misamis Occidental;

SECTION 3. Definition of Terms. For purposes of this Ordinance, the following terms shall mean: 3.1 3.2

Biodegradable means capable of being decomposed through the action of biological agents.

Biopol is a random co-polymer with blocks of PHB and blocks of poly (hydroxypentanoate), (often known as polyhydroxyvalerate, PHV), used to wrap foods, coatings for paper and cardboard, kitchen ware (cups, saucers, plates), and many medical uses, including sutures, gauzes and coatings for medicines.

Cloth Bag (Katsa) refers to a reusable packaging material made of cloth (biodegradable) used in the packaging of flour, wheat and other similar goods.

Compostable Plastic Bags means a plastic carry-out bag that meets the Department of Trade & Industry’s Standard for compostable plastic.

Degradable plastic packaging material refers to a complex of plant or both plant and petroleum-derived materials that is capable of undergoing thermal and biological decomposition. This may also incorporate the addition of bacteria to further break down the material into carbon dioxide, water, inorganic compounds and biomass at a shorter decomposition rate. Examples of these materials are polyhydroxybutanoate, biopol, polylactic, polycaprolactone, oxo-biodegradable plastics, totally degradable plastics.

Dry Goods refers to any product that do not require refrigeration or freezing to maintain, such as textiles, clothing, medicines.

Dry Market generally refers to the store of products that do not require refrigeration or freezing to maintain.

Food service businesses means full-service restaurants, fast food restaurants, cafes, delicatessens, coffee shops, grocery stores, vending trucks or carts, business or institutional cafeterias, or other businesses, selling or providing food within the Province of Misamis Occidental for consumption on or off the premises.

Non-biodegradable refers to any material which is not capable of deteriorating itself without human intervention.

Non-degradable plastic packaging material refers to petroleum-derived material that is not capable of undergoing thermal and biological decomposition, that is, it cannot be photodegraded or biodegraded. Further, this material can’t be broken down into carbon dioxide, water, inorganic compounds and biomass at a shorter rate of decomposition. This is mostly composed of materials made up from polyethylene, polypropylene and polystyrene.

Operator means a person in control of, or having daily responsibility for the operation of a store, which may include, but not limited to, the owner of the store.

Paper carryout bag is a carryout bag made of paper that is provided by a store to a customer at the point of sale.

Person refers to any person either natural or judicial which shall be affected by the imposition thereof.

Photodegradable plastics refers to polymers, coming from non-renewable resources that disintegrate into smaller pieces upon absorption of UV radiation from the sunlight.

Plastic Bags also known as “sando bags”, pouch, plastic shopping bags and plastic film bags. It is a type of flexible packaging material made of thin, plastic film that is used for containing and transporting goods and other products.

It shall also refer to thin-gauge packaging medium that is used as bags or wraps.

Plastic carryout bag is a non-degradable or compostable plastic carryout bag that is provided by a store to a customer at the point of sale.

Plastic packaging materials refers to a medium or material that is made up of thin, flexible and nonwoven film of degradable and/or non-degradable polymers, that is used for wrapping, containing and transporting goods and

SECTION 4. Duties and Responsibilities.

Vendors and Operators of food service businesses, wholesale stores and retail business establishments, both at the wet markets and dry goods stores, shall observe the following duties and responsibilities: 4.1.1 Utilize biodegradable materials or compostable plastic bags that passed the standards set by the DTI; 4.1.2 Observe the Solid Waste Management Disposal of the respective Local Government Units; 4.1.3 Initiate ways on how to reduce and eventually totally eliminate the use of plastic materials and polystyrene foam; 4.1.4 Encourage its clients/customers to use alternative containers which are environment-friendly; 4.1.5 Make available alternative containers and bags; 4.1.6 Must observe PEP days.

Customers/Consumers shall observe the following duties and responsibilities: 4.2.1 Provide/bring their own containers which are environment–friendly and recyclable; 4.2.2 Provide/bring their own alternative packaging materials/containers which are environment –friendly and recyclable; 4.2.3 Dispose/segregate biodegradable and non-biodegradable wastes in accordance with the Solid Waste Management Disposal of their respective Local Government Units.

5.3.2 Ensure observance of PEP Days; 5.3.3 Monitor PEP Day observance of both business operators/vendors and 5.3.4 In case of violation/s, impose fines to both business operators/vendors and consumers, and or cancellation of permits of specific establishment, as the case may be.

SECTION 6. Alternative Packaging Materials and Containers. The following shall be considered as alternative packaging materials and containers: 6.1 6.2 6.3 6.4 6.5 6.6 6.7 6.8

SECTION 7. Prohibited Acts.

7.1

On PEP days, operators of food service businesses, vendors of wholesale stores and retail business establishments, both at the wet markets and dry goods stores, are prohibited from: 7.1.1 Selling and providing plastic bags to customers even as primary packaging material on wet goods; 7.1.2 Selling and providing plastic bags to customers as packaging material on dry goods; 7.1.3 Selling and providing Styrofoam as containers; 7.1.4 Disposing plastic wastes.

7.2

Likewise, customers/clients shall be fined, if, they commit the following: 7.2.1 Fail to provide/bring their own containers which are environment–friendly and recyclable.

7.2.2 Be enraged if not provided with plastic bags/Styrofoam by the storekeeper/owner.

7.2.3 Buy plastic bags/Styrofoam.

SECTION 8. Penal Clause. In case of violation of the provisions in Section 7 hereof, the following fines shall be imposed: Operator:

SECTION 9. Exemptions. The use of non-degradable plastics and styrofoams shall be allowed in the following circumstances: 9.1 9.2 9.3

In pre-packed products.

Packaging used at hospitals, nursing homes or other medical facilities.

Containers (Styrofoam) of perishable good such as, fish, marine, meat products and the like which is susceptible of deterioration, if not frozen.

SECTION 10. Information Campaign

The Provincial Government Environment and Natural Resources Office (PG-ENRO) in coordination with the City/Municipal Environment and Natural Resources Office, and the Department of Trade and Industry shall conduct a massive information campaign using quad media (print, radio, television and internet) to educate the constituents and business establishments in the Province on the regulation of the use of plastic materials and polystyrene foam, and the strict observance of the PEP Day.

SECTION 11. Monitoring. The PG-ENRO shall prepare a semi-annual report on the status of the implementation of this Ordinance.

SECTION 12. Rules and Regulations. Within 60 days from the approval of this Ordinance, the Provincial Governor, through the assistance of the Department of Environment and Natural Resources (DENR), the Provincial Government-Environment and Natural Resources Office and the Environment Management Bureau (EMB) shall formulate the Implementing Rules and Regulations necessary to carry out the provisions of this Ordinance.

SECTION 13. Transitory Provision. Except those included in the exemptions, two (2) years after the effectivity of this Ordinance, the use of all non-degradable plastic materials and polystyrene foam shall be banned within the Province of Misamis Occidental.

SECTION 14. Separability Clause. If any provision of this Ordinance is declared invalid, the remaining provisions hereof which are not affected thereby, shall remain in force and effect.

SECTION 15. Repealing Clause. All ordinances, resolutions or regulations or parts thereof inconsistent with the provisions of this Ordinance are hereby repealed.

SECTION 16. Effectivity. This Ordinance shall take effect 30 days after its publication in a local newspaper of general circulation in the Province.

ENACTED: June 16, 2016.

ORDINANCE NO. 42-16 AN ORDINANCE ADOPTING BANYAN TREE AS CLIMATE CHANGE MITIGATION IN MISAMIS OCCIDENTAL PROVIDING METHODS FOR ITS PROTECTION AND PRESERVATION AND PRESCRIBING PENALTIES THEREOF. Section 16, Article II of the Philippine Constitution provides, “The state shall protect and advance the right of the people to a balance and healthful ecology in accord with the rhythm and harmony of nature”. Likewise, Executive Order No. 26, S. 2011, “Declaring an Interdepartmental Convergence Initiative for a National Greening Program” states that poverty reduction, resource conservation and protection, productivity enhancement, climate change mitigation and adaptation, are among the priority programs of the government. Banyan Tree protection is also embodied in the Revised Environment Code of Misamis Occidental.

Achieving food and water security as the guiding principle in the utilization, management, development conservation and protection of banyan species. b) Enjoining all Barangay LGUs with rivers by planting enormous or canopy type of fig species with at least 10 m or 15 m distance at the riverbanks in order to maintain ecological balance. c) Enjoining all LGUs to provide a banyan tree nursery in order to support the Barangay LGUs on their future tree planting activities at their subsequent riverbanks. d) Conserving and protecting old wild growth of banyan trees and banyan endangered species, and to care for the habitat of wildlife and its biodiversity; e) Maintaining banyan trees that can provide alternative herbal medicines in the Province and for purposes of scientific studies; f) Managing the banyan heritage trees and its biodiversity consistent with the concept of an eco-tourism function; and g) Combat climate change using banyan as the natural flood control system, and to convey the ecological and tourism benefits by enhancing public environmental awareness through Information Education Campaign utilizing multi-media i.e. radio, television, prints and internet.

BE IT ORDAINED, by the Sangguniang Panlalawigan in Session that

SECTION 2. OBJECTIVES – This Ordinance aims: a) To protect and to preserve banyan trees whether it’s natural old growth, heritage, matured and especially the newly planted banyan saplings within the Province; b) To save banyan epiphytes in the host trees, roofs, cracks and crevices and other places for relocation in the nursery, in preparation for future replanting; c) To protect all banyan fruit eating animals like birds, bearcats and bats, among others; d) To enhance the ground water source by increasing vegetative cover with banyan species in order to maintain ecological balance for food security; e) To protect the spring water sources with grove of banyan trees with water holding capacity that can provide potable water for drinking and for agricultural use; f) To enhance biodiversity in support of research and eco-tourism development in the Province to augment rural employment and income; g) To utilize the resiliency of banyan trees as the natural flood control method of critically sloping watershed and highly degraded riverbanks and shorelines in order to prevent soil erosion and landslide; h) To raise more banyan conservationist and environmental advocates in the Province and promote banyan as alternative traditional herbal medicine. To utilize the fig fruits known to be rich in nutrition, for healthy living which could help alleviate poverty; i) To develop a rural forest area in the barangays with rivers and streams by planting endemic and indigenous banyan species for soil reinforcement; and j) To mitigate global warming by means of banyan trees proven by scientists as efficient carbon sequestration by transforming pollutants into life-needed oxygen.

SECTION 5. ECO-TOURISM a) The planting, production and propagation for tourism-related activities, involving banyan tree initiated either by the private or government sector must be coordinated with the Misamis Occidental Banyan Management Council (MBMC) to ensure the proper implementation of this Ordinance. b) Activities subject to the preceding section, but not limited to the following:

SECTION 1. TITLE – This Ordinance shall be known as, “ The Banyan Tree Ordinance of Misamis Occidental

Development of Ecological Tourism Areas to be planted with Banyan species such as: b.1 Public and private school campuses. Use under storey or medium, shrub or small and climbing fig type – suggested spaces: between 5 to 10 meters; b.2 Banyan Riparian Forest or river shoreline. Use emergent or giant, canopy or large fig – suggested spaces: 5 to 10 meters and under storey: 5 meters or it depends on the bank damage; b.3 Parks and Playgrounds, public and private places. Use banyan type with emergent – one tree per hectare, canopy – one tree per hectare, under storey – 2 to 3 trees per hectare; b.4 Botanical Garden or Arboretum. Use banyan type with emergentt – one tree per hectare, canopy – one tree per hectare, under storey – 2 to 3 trees per hectare, shrub – 5 to 10 trees; b.5 Landscapes and Seascapes or coastal beaches. Use banyan type with emergent or giant, canopy or large and under storey or medium – suggested distance: 5 meter to 10 meters; and b.6 Buffer Zones in National Highways, Roads and Streets. Use banyan type with under storey or medium, shrub or small and climbing fig in fences.

SECTION 6. PRESERVATION AND PROTECTION a)

DECLARATION OF HERITAGE BANYAN TREE

All banyan trees appraised at fifty (50) years or older in existence by a Botanist/Biologist or accredited research non-government organization such as, but not limited to those growing in the riverbanks, botanical garden, arboretum, cliffs, with spring amid sufficient water supply of potable water for drinking and banyan trees used as habitat by birds, bats, beehives, bearcats etc.

SECTION 3. DEFINITION OF TERMS – As used in this Ordinance, the following terms shall mean as follows: a) Aquifer is a ground water source of potable water for drinking. b) Banyan Heritage Tree refers to a fig that thrives from generation to generation with historical years of existence of at least more than fifty (50) years. c) Banyan Habitat means a place or environment where banyan species or banyan subspecies naturally occur or has naturally established its population. d) Banyan Tree refers to the internationally accepted name or title of fig species. e) Banyan Wood Slaughter means an extraction of beehive colonies, destroying the habitat of pollinators; maliciously uprooting, cutting to death of banyan, forming topiary without consultation with the Misamis Occidental Banyan Management Council. f) Bird and Bat Hunting refers to hunting of birds and bats which inhabit in the banyan trees securing food or refuge. g) Biodiversity refers to the variability among living organisms from all sources including terrestrial, marine, and other aquatic ecosystems, and the ecological complexes of which they are part; this includes diversity within species, between species and ecosystems. h) Canopy or Large Fig Type are figs with countless leaves covering for shelter in an acre of land. i) Climate change refers to the global warming due to excess emission of carbon in the atmosphere. j) Climbing Fig Type refers to a fig that supports itself by climbing, twining, or creeping along a surface. k) Conservation means preservation and sustainable utilization of banyan. l) Dominant Species relate to a single banyan plant species that is more numerous within a specific region or country over a specific period. m) Ecology is the study of the relationships between living organisms and their interactions with their natural or developed environment. n) Economically Important Banyan Species with potential value for herbal medicines.

e.1 Develops a Provincial Banyan Tree Management Plan as resilient mitigation to climate change. e.2 Adopts measures to promote and ensure the viability and effective implementation of banyan tree management as appropriate species for watershed forest restoration and riverbank stabilization. e.3 Adopts measures in data- banking, safeguarding and preserving all banyan trees growing and planted in the whole Province. e.4 Adopts biodiversity enhancement in support of Banyan Tree research and eco-tourism development in the Province. e.5 Oversees & monitors the implementation of the City/ Municipal Banyan Tree Management Plan through its various political subdivisions in cooperation with the private sector and the environmental NGOs; e.6 Adopts specific revenue-generating measures to promote the viability of Banyan Tree Management Plan; e.7 Develops a Community-Based Banyan Tree Management approach for each municipality and city and provide active and monitoring support at the Barangay-level. e.8 Assessment of the type, status, quality and quantity of banyan trees in the Province. e.9 Develops sources of alternative/or supplemental livelihood particularly micro-enterprise development while technical and financial support is obtained for plan implementation. e.10 Conducts information and education campaign to build awareness on Banyan Tree as climate change mitigation and other related issues. e.11 Develops a research framework and installation of a municipal/city database for Banyan Heritage Trees. e.12 Develops community- based eco-tourism enterprise and biodiversity conservation measures acceptable to the local communities. e.13 Undertakes community organizing and social preparation measures in implementing Banyan Trees planting and promotion activities. e.14 Provides guidelines and procedures in identifying resource “Banyan Heritage Trees” and areas with unique characteristics, unspoiled natural state, resources, or requiring immediate protection to maintain its economic, cultural, historical, social and ecological importance. e.15 Develops the specific mechanics and guidelines for the implementation of the City/ Municipal Banyan Tree Management Plan. e.16 Coordinates the efforts with its component barangays in the implementation of the city/ municipal Banyan Tree Management Plan.

a)

Banyan is genus ficus and has over one thousand (1,000) species globally with at least seven hundred (700) endemic species in the Philippines. It has seven types of sizes starting from emergent or giant, canopy or large, under storey or medium, shrub or small, vine type, meadow and climbing fig.

e) Powers, Duties and Functions of the Misamis Occidental Banyan Management Council (MBMC).

SECTION 4. DECLARATION OF POLICY – The following are the policies of the PGMO pertaining to this Ordinance:

Fig species also known as banyan trees is acknowledged as “keystone species” which is endemic in the Philippines. Typically, the dominant species are found in all watersheds of the country and are resilient to climate change. Studies suggest that figs belonging to the family Moraceae is the symbol of Philippine Biodiversity. It is highly recommended by the National Aeronautics Space Administration (NASA) and the International Scientists for Ecological Research (ISER), as the appropriate species for watershed forest restoration and riverbank stabilization due to its water holding capacity and its resiliency to mitigate climate change.

The Banyan Heritage Trees are abundant in the Province of Misamis Occidental with the oldest “balete” tree at Jimenez Catholic Cemetery appraised to be 500 years in existence.

It is vital to safeguard and preserve all ficus species growing and planted in the Province for resource conservation and protection and productivity enhancement.

b) Co-chaired by Provincial Board Member – the Chairperson of the Committee on Natural Resources, Environment & Ecology. d.3 Members a) Sangguniang Panlalawigan Members – the Chairpersons of the Committee on Public Works & Infrastructures, Committee on Health & Social Services, Committee on Education, Arts, Science & Technology, Committee on Blue Ribbon, Good Government and Investigation and FABC Ex-Officio Member; b) At least three (3) Accredited non-government organizations in the Province; c) Representative from the Department of Education in the Province and the 3 cities; d) Representative from the Department of Environment and Natural Resources Officer (PENRO/CENRO); e) Provincial Government- ENRO; f) Provincial PNP Director or his representative; g) Representative from the Provincial Tourism; h) Representative from the Provincial DRRMC; i) Representative from the Water Districts; j) Representative from the Electric Cooperatives of the Province; k) Representative from the Business Sector and l) Representative from the Kapisanan ng mga Broadkasters ng Pilipinas (KBP).

o) Ecosystem refers to the organisms and the environment or a group of interdependent organisms together with the environment that they inhabit and depend on. p) Emergent or Giant Fig Type is a banyan tree that stands taller than the surrounding trees equivalent to at least ten storey building or higher. q) Endangered Banyan Species refers to banyan species whose survival in the wild is easily under the casual factors of cutting. r) Endemic Banyan Species describes to a banyan species that is confined to a particular geographic region such as an island or river basin. s) Fig means banyan, the most ancient fruit-bearing tree for tropical animals such as pigeons, bearcats, toucans, monkeys, all types of fruit eating birds and bats. t) Fig Fruit is a turbinate or pear-shaped fruit of a tree or shrub belonging to the genus Ficus of the mulberry family which is native to southwestern Asia that is eaten fresh, preserved or dried. It is also the favorite fruit of Jesus Christ cited in Matthew 21:18-22 and Mark 11:12-14, 19-21. u) Forest Restoration means restoring the natural habitat with important species such as fig. v) Genus Ficus is a scientific name of banyan species. w) Heritage banyan tree refers to figs that grow old naturally in the wild as well, as in the critical habitat, such as riverbanks with at least more than fifty years in existence. x) Information Education and Communication (IEC) refers to the Center for banyan information which will be established for the effective implementation of this Ordinance. y) Keystone Species refers to the species which sustainably give life-support to fruit eating animals and human. z) MBMC refers to the Misamis Occidental Banyan Management Council which will be established for the effective implementation of this Ordinance. aa) Mitigation means to make something less harsh, severe or violent effect from catastrophes. bb) Moraceae refers to a family of all fig species as well as artocarpus. cc) Nature refers to the physical world including all natural phenomena and living things. dd) Oldest Balete refers to a single common fig species in the Philippines scientifically named as ficus philippinensis found in Jimenez cemetery which is 500 years old. ee) Preservation means protection from harm; guarding banyan trees from danger, harm, or injury; maintenance of its banyan aesthetic values especially its historic value in an unchanged condition. ff) Protection is the act of preventing damage on banyan trees, or the state of being kept safe. gg) PGMO means the Provincial Government of Misamis Occidental. hh) Riverbank Stabilization refers to an action to stabilize the riverbank with fig species vegetation. ii) Shrub or Small Woody Fig refers to several stems but shorter than medium type of fig. jj) Under Storey or Medium Fig Type refers to a layer of small fig trees below tall fig trees in a forest. kk) Watershed is the area that drains to a common outlet such as rivers. ll) Water Holding Capacity means capable of producing huge leaf litters which absorb rainwater that provide infiltration to the aquifer; and mm) Vine Fig Type is a weak flexible stem ascending on tall trees in the forest.

PRIORITY AREAS FOR BANYAN PLANTING USING EMERGENT, CANOPY OR VINE TYPE OF FIG b.1 Watershed and Riparian areas such as riverbanks, creek banks and sandy beaches; b.2 Mountain Cliffs and highly sloping areas prone to soil erosion and landslides; b.3 Industrial plant like Coal Plant or Large Commercial Factory Areas; b.4 Botanical Garden or Arboretum and Protected Area Buffer Zone; and b.5 Premises of piggery or poultry farms that emit carbon dioxide or methane gas and other forms of air pollutants.

PRIORITY AREAS FOR BANYAN PLANTING USING UNDER STOREY OR SHRUB TYPE OF FIG c.1 Road-Street buffer, but not under the electric cable lines; c.2 Shorelines, bridges, gabions and concrete flood control structures; c.3 Provincial, city, municipal and barangay parks and premises; c.4 Spring Water Sources and Eco-tourism Areas; and c.5 Churches, public and private cemetery or memorial parks and landfill areas.

MISAMIS OCCIDENTAL BANYAN MANAGEMENT COUNCIL (MBMC) d.1 Creation. There is hereby created the Misamis Occidental Banyan Management Council (MBMC) for efficient implementation of this Ordinance. d.2 Composition. The Council shall be composed of the following: a) The Provincial Governor who shall act as the Chairperson.

The MBMC shall submit an Annual Budget Proposal in the implementation of this Ordinance and for the Monitoring and Evaluation of projects such as establishment of nurseries and the tree planting activities following the right medium.

SECTION 7. PROHIBITED ACTS a) Cutting of old growth banyan trees appraised heritage tree(s), that are growing in the critical habitat areas such as watershed, riverbanks, riparian areas, shorelines, public and private parks, public and private school premises, or privately owned lands except when public safety order, welfare so requires. b) Maliciously uprooting of banyan seedlings or saplings and or newly planted banyan trees within the province. c) Planting of banyan saplings in wrong places like under the electric cable lines, road and streets affected by road widening, and areas with proposals for infrastructures. d) Destroying banyan habitat and critically endangered banyan species that is facing extremely high risk of extinction in the wild especially in the riverbanks; e) Cutting of the economically important banyan species for lumber trading purposes; f) Cutting of banyan roots in ecological tourism parks and critical habitat or ecosystem, except those areas recognized as banyan plantation for herbal medication by the community; g) Hunting of wildlife such as banyan fruit eating birds and bats among others; and h) Destroying and extraction of beehive colonies and habitat of pollinators in the banyan trees for whatever purpose.

SECTION 8. PENALTY CLAUSE – Any infraction committed against this Ordinance shall be fined of not less than Five Thousand Pesos (P5,000) and imprisonment of not more than one (1) year and/or community service depending on the decision of the court of competent jurisdiction.

SECTION 9. APPROPRIATION - The Provincial Government of Misamis Occidental shall provide funds at least one percent of the 20% Development Fund or reasonable, sufficient amount derived from revenue generating measures enacted specifically for the effective implementation of this Ordinance.

Trust Fund for the MBMC shall likewise be established for the efficient implementation of the projects.

SECTION 10. SEPARABILITY CLAUSE - If any part of this Ordinance shall be held invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the remaining valid portion of this Ordinance.

SECTION 11. EFFECTIVITY CLAUSE – This Ordinance shall take effect fifteen (15) days after publication in a local newspaper of general circulation in the Province of Misamis Occidental.

Encouraging out-of-school youth to enrol in ALS

As one of the government’s thrust, specifically in the Department of Education, to ensure and achieve the Education for All (EFA), its millennium development goal, it has been pouring and exerting its derived efforts to provide every young Filipino, every young learners the best quality education they ought to deserve. Thus, to further capacitate it, the Alternative Learning System (ALS) has been institutionalized and implemented.

According to the Department of Education (DepEd), ALS is the parallel learning system in the Philippines that provides a practical option to the existing formal instruction.

When one does not have or cannot access formal education in schools, ALS is an alternate or substitute.

ALS includes both the nonformal and informal sources of knowledge and skills.

As many Filipinos do not have a chance to attend and finish formal basic education due to many reasons, some drops out from school while some do not have schools in their communities. Since every Filipino has a right to free basic education, the government establishes ALS to provide all Filipinos the chance to have access to and complete basic education in a mode that fits their distinct situations and needs.

That is why, as an ALS district coordinator, it has been my fervent aspiration to better encourage and

serve those who inspires to enrol in ALS and little by little, help them build and realize their dreams and further maximize their full potential so that they would be better individuals and members of the community and they can an anchor to nation-building plus, pretty sure, they can land good job in the future, of course for their own betterment and sweet success.

Here, it is of utmost responsibility to encourage all the out-of school youth to be part of the ALS products. As accounted, learning through ALS is fun as well and it can be a good avenue also to educate oneself and skilled and equipped oneself for future dispositions. It can be of great help as well to their families and relatives and at the same time,

they can obtain better quality education through the Alternative Learning System.

Now, I am encouraging all the out-of-school youth to better enrol to ALS in your nearest vicinity. I can vouch that if you are an ALS graduate, you can also better compete with others, including in the global arena. Do not lose hope; with enough eagerness and faith, together we can achieve quality education for our common good.

With the help of ALS, it is not too late. Just continue on pursuing and chasing for your dreams and soon, in one way or the others, you can have the best life could ever offer. May the Father Almighty continue to bless this program and its implementers!

Elder Abuse refers to a single, or repeated act, or lack of appropriate action, occurring within any relationship where there is an expectation of trust which causes harm or distress to an older person. It also refers to an intentional act, or failure to act, by a caregiver or another person in a relationship involving an expectation of trust that causes or creates a risk of harm to the elderly.

ORDINANCE NO. 48-16 AN ORDINANCE PROHIBITING ACTS OF ABUSE AND ABANDONMENT COMMITTED

BY THE DIRECT DESCENDANTS AGAINST ELDERLY PARENTS AND PROVIDING PENALTIES THEREOF

8. Sustenance refers to the basic needs of food, clothing and shelter of an elderly parent.

SECTION 4. PROHIBITED ACTS AND OMISSIONS - The following acts and omissions are hereby prohibited and punished by this Ordinance:

a) Verbal forms of abuse may include intimidation, humiliation, ridicule, or habitual blaming or scapegoating. b) Non-verbal forms of abuse are ignoring the elderly person, isolating him or her from friends or other family members and activities, or terrorizing him or her. Committing acts of disrespect and insult against an elderly parent which includes, but not limited to, verbal abuse, threats and harassments, and any words or deed of a descendant which causes psychological and emotional damage to his elderly parent; 2. Economic abuse is a wilful refusal of a direct descendant to provide sustenance and support to the elderly who is in need.

BE IT ORDAINED by the Sangguniang Panlalawigan of Misamis Occidental in Session that:

4. Physical Abuse refers not only to physical assaults, such as hitting or showing, but also the inappropriate use of drugs, restraints or confinement.

SECTION 2. POLICY STATEMENT - It shall be the policy of the Province of Misamis Occidental to protect and promote to the fullest the safety and welfare of all senior citizens in its jurisdiction, and punish acts of abandonment and willful refusal of their direct descendants to support and attend to them in their times of need.

THE Philippine education system has been heavily influenced by its colonial history which has included periods of Spanish, American and Japanese rule and occupation. The United States has left the largest imprint on the education system with many academics at the nation’s universities having received their training at US universities.

Another hallmark of the US influence on the Philippine education system has been a relatively inclusive system of higher education to which access has traditionally been widely available. By 1970, the Philippines had achieved universal primary enrollment.

structural and curricular reforms with the Kindergarten Act of 2012 and the Enhanced Basic Education Act of 2013. Together, they extend formal education from just ten years to 13 years under a kindergarten through Grade 12 system by adding a mandatory year of kindergarten and two years of senior high school. Prior to 2011, kindergarten was optional and just six years of education were compulsory.

The transition period will end with the 2017-2018 school year when the first cohort graduates from the new primary and junior high cycles. Those graduating from the four-year junior high cycle will be the first in the nation to undertake the new two-year senior high school curriculum.

SECTION 6. NOTICE - Must be given by the implementing agency with the following provisions: 1. First Notice- In case of violation of Sec. 4 hereof, the implementing agency shall inform the descendant about the law/Ordinance and their obligations. Thereafter, the descendants are given within ninety (90) days to respond appropriately.

2. Second Notice- A Second Notice shall be served in case of failure of the descendants to respond within sixty (60) days.

3. Third & Final Notice- A Third and Final Notice shall be issued informing the descendants of the legal action undertaken by the Implementing Agency.

SECTION 7. PENALTIES - Any person found guilty of committing said acts of abuse and incurring said acts of abandonment enumerated in Section 4 hereof shall suffer the penalty of imprisonment of not exceeding one (1) year or a fine of not exceeding P 5,000.00 or both, in the discretion of the court.

SECTION 8. RIGHT OF THIRD PARTIES TO DEMAND REIMBURSEMENT OF EXPENSES ADVANCED FOR SUPPORT AND ASSISTANCE OF THE ELDERLY - Any person who attended to the needs of an elderly parent deprived of support and care by his/ her descendants shall have the right to demand from them all the expenses he/she incurred in attending to the elderly’s needs and sustenance.

SECTION 9. SEPARABILITY CLAUSE - If any part or portion of this Ordinance shall be declared invalid or unconstitutional, the remaining provisions not affected thereof shall remain in full force and effect.

“The other 20 prisoners were also released at the said barangay,” the report said.

Last Monday afternoon (August 22) , Army troops and policemen intercepted a Tamaraw FX van allegedly carrying explosives in Barangay Nanagun, Lumbayanague, Lanao del Sur. Maj . The arrested women were identified as Hafidah Romato Maute, Nasifa Pandug and Norhanna Balawag Maute.

Tan said the group was on the way to Marawi City from Butig town in Lanao del Sur when troops, acting on intelligence report, blocked them at the checkpoint in Barangay Nanagun.

“The fast reaction of troops and the information of concerned citizens was the key for thwarting a terror attack intended to kill innocent people in populated target areas. killings and more than 10,000 human-rights violations. These abuses continue during the Aquino administration, which commits 300 victims of extrajudicial killings, 56,945 victims of demolition and forced evacuation, and 65,712 victims of harassment. During the Aquino’s term, the UN refugee agency recorded 243,000 displaced people with inadequate food, shelter, and health care.

All these data show our overwhelming history of injustice that engulfs few instances where justice is seemingly working. For the longest time, Philippines clandestinely operates as an imperial Rome, and the oligarchs and lords are its rulers who maximize the culture of killings to serve their interests. Hence, it is inaccurate to claim that there’s a new emerging culture of death and impunity.

Killing has been the norm, and extra judicial killings and human rights violation in most cases serve those who are in power, and they are cloaking in our peaceful democracy.

We are not a heartless nation. But the ruthless persecution of the criminals and drug personalities somewhere, touches something in the Filipino psyche. The war against crime and drugs capture symbolically what we have been longing for so long: a public spectacle where we can witness law offenders suffer the highest the penalties of the state, a tangible sense that there is a working justice system.

If, at this point, for some, we have flawed sense of justice and forgot human rights, it is because our nation has witnessed a large amount of the injustices and forgetfulness of human rights that we have learned to accept it. Justice, for so long, is a just a word, an abstract idea but never made concrete.

Hence, if there’s anything that the war on crime and drugs, despite of all its criticisms, accomplished: it makes justice concrete.

Justice becomes real and tangible. And unfortunately, one of its manifestations is the utilization of killings and violation of rights to destroy an unquestionable

public enemy: the drugs and crimes and those that are involved.

Nevertheless, whether it tramples human rights and due process, it seems that for most of us, it does not matter, for what matters is that justice at this point can be felt. The longing that the law offenders suffer the highest penalty of the state is being satisfied. Whether rich or poor, it does not matter; the face of the law offender is faceless. Seemingly, justice is now working and justice has a new public face, and it is made with real flesh and blood.

“But there must be another way. There has to be another way.” Senator Leila De Lima hoped. And I hope too. I do not condone the killings, and I hope the state will recognize our basic rights as a human being.

But what is the other way?

Even the senator didn’t give any concrete suggestion.

Maybe she, too, didn’t know.

Or maybe there is no other way, for it has been the way.

If only history could march without the footprints of blood, and the fire of change could live without taking any life.

But it does not work that way. And at this point, we cannot just call to stop the killings, for it will not be heard by the people who is longing for change and accepting it whatever it takes.

We cannot just simply talk about justice, democracy, and rights as if ideals floating in heaven. They need to be clarified. They need to be grounded. They need to be understood in the context of our own history and culture.

Justice, democracy, and rights need to be redefined deep within the guts of the Filipino people.

At least the value transcends cultural boundaries.

Humane values, whether Asian, American or European, are the same. I thought the scene taught Holly and the children of Little Kingdom to be proud of who they are.

Of course, we would be happier to see characters on children’s television playing roles of people with history and culture more familiar to them.

For example, for my son whose mother is from the Bukidnon tribe, I would love to make him watch cartoon stories depicting the village’s favorite nanangen or oral folk stories.

Many years ago, we dreamt of children’s books from the tribes living in Mt. Kitanglad. I remember the energy of the Talaandig’s Waway Saway when

he shared his discovery in South Korea of thousands of children’s books published from the tribes.

I hope we could relive and make that dream come true. Maybe we can publish booklets of the children’s stories. Then we can produce radio drama shows and eventually television shows.

Maybe, someday, our shows will be the ones that they will show on Nickelodeon or Disney Jr. As an old friend would say, dream – and your dreams will fall short.

Globe goes full steam ahead on LTE 700 MHz deployment In line with commitment to improve internet services It’s full steam ahead for Globe Telecom in its aggressive deployment of the 700 megahertz (MHz) band by rolling out recently more than 150 sites mostly in Metro Manila as part of its commitment to improve

the mobile internet in the country.

Joel Agustin, Globe Senior Vice President for Program Governance, Network Technical Group revealed that Globe is fasttracking the rollout of LTE

service nationwide using the 700 MHz frequency under the co-use agreement approved by the National Telecommunications Commission (NTC). “We are confident that more and more of our customers

will experience improved services as adoption of LTEcapable devices increases and as we continue to deploy LTE 700 in more sites.

This is consistent with our strategy of continuously improving internet services

using the previously idle 700 MHz spectrum that the NTC now allowed us to co-use,” Agustin said.

According to Agustin, the LTE 700 sites cover major business districts and highly-urbanized and populated areas in the country, noting that customers using LTE 700 devices are steadily increasing in these areas.

Citing Quezon City, where Globe activated the first LTE 700 site in the country, Agustin said the technology now covers a majority portion of the city after the LTE 700 sites activated by Globe increased four times from the initial rollout of just 11 sites.

The company plans to activate more than 500 LTE 700 sites across the country by the end 2016, Agustin said. He added that majority of these sites are located in Metro Manila, enabling Globe to deliver close to 100% coverage of LTE 700 for the entire metropolitan area. This is turn, is expected to substantially improve mobile internet experience of customers in the region.

Globe Telecom is maximizing the use of the 700 MHz band in fulfillment of its commitment in the co-use agreement with BellTel following the sellout of San Miguel’s telco assets.

The company committed to deploy about 4,500 multiband, multimode software defined radio base station equipment to 95% of total municipalities and cities in the country.

This will improve overall customer experience in terms of speed and reliability of mobile internet services.

Aside from the 700 MHz, the NTC-approved co-use agreement also provided Globe with access to additional allocation in the 1800 MHz, 2300 MHz, and 2600 MHz bands.

This supports the capacity enhancement initiative launched by the company early this year amid growing customer requirement for bandwidth-intensive multimedia content. Globe also launched early this year an initiative of creating an internet superhighway by deploying fiber optic cables in 20,000 barangays all over the country to provide faster and more reliable Internet access in about 2 million homes nationwide.
