GPH, NDFP reaffirm previous pacts

OSLO, Norway--The panelto-panel meeting between the Government of the Philippines (GPH) and the National Democratic Front of the Philippines (NDFP) commenced in the morning of August 23.

The panels finished the discussion on the affirmation of previous signed agreements, reconstitution of the Joint Agreement on Safety and Immunity Guarantees (JASIG) list and acceleration of the peace negotiations.

The meeting at the Reidar Andersen, Birger Ruud and Thorleif Haug Halls of the Scandic Holmenkollen Park Hotel came after the representatives of both panels had agreed and approved the program of the five-day formal peace talks the previous day.

On the first item of the agenda, the two panels agreed to reaffirm all previously signed agreements since The Hague Joint Dec-

laration of 1992 and resolved to conduct formal talks and consultations in accordance with said agreements.

Aside from The Hague Joint Declaration, both parties reaffirmed all the previous bilateral and binding agreements made in the peace negotiations that include the JASIG of 1995; Joint Agreement on the Formation, Sequence and Operationalization of the Reciprocal Working Com-

mittees of the GPH and NDFP Negotiating Panels of 1995; and the Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law (CARHRIHL) of 1998, the first of four items of the substantive agenda in the peace negotiations that have been agreed upon by both sides.

The NDFP panel presented the reconstituted list of holders of the NDFP

document of identification (DI) that gives them protection by the JASIG, which was acknowledged by the GPH panel. The GPH agreed to issue a letter of acknowledgment on the receipt of the NDFP list.

The JASIG is meant to provide the conditions conducive to free discussion and movement of NDFP personnel involved in the peace negotiations and to avert any incident that may jeopardize the peace negotiations. Without the JASIG, peace negotiations would not be possible.

Both parties agreed to accelerate the peace process and set the timeline

for the completion of the three remaining items in the substantive agenda namely, social and economic reforms, political and constitutional reforms and end of hostilities and disposition of forces.

The two sides agreed that the Reciprocal Working Committees on Social and Economic Reforms (RWCSER) of the GPH and NDFP shall meet in September. The RWC-SER shall tackle and strive to reach an agreement on genuine land reform, national industrialization, workers’ rights and welfare, social welfare, education and culture. They would also strive to finish within six months from September the tentative Comprehensive Agreement on Social and Economic Reforms to be submitted for approval by both panels.

The last session of the day consisted of the simultaneous meetings of the Reciprocal Working Committees on Social and Economic Reforms and the two Reciprocal Working Groups on Political and Constitutional Reforms and End of Hostilities and Disposition of Forces. They

Church leaders see end to conflict in Mindanao as peace talks start

CAGAYAN de Oro City-Church leaders in Northern Mindanao are optimistic that with the ongoing formal peace negotiations between the Philippine government and Communist rebels in Oslo, Norway, there will be no more bloodshed and displacement of innocent civilians.

Bishop Felixberto Calang, of the Iglesia Fili-

pina Independiente and national core member of the Philippine Ecumenical Peace Platform (PEPP), in an interview said he is hoping that the peace talks will have its effect on the conflict-ridden areas in some parts of Mindanao where confrontations between the military and the New People’s Army (NPA) has resulted to the deaths and forced evacuation of villagers.

The NPA is the armed

wing of the National Democratic Front (NDF) with links to the Communist Party of the Philippines.

The groups have been waging war against the Philippine government in the last 40 years or so.

According to reports, the NPA will declare temporary cessation of offensive operations starting August 26 in response to President Rodrigo Duterte’s order of a unilateral ceasefire.

In a separate interview, Cagayan de Oro Archbishop Antonio Ledesma, PEPP co-convenor, said he is also supporting for the two parties to sit down and discuss about peace and suspend combat operations at the same time.

Ledesma said it is contradictory to keep talking about peace and yet there is an ongoing conflict.

Also, both PEPP officials have welcomed the temporary release of im-

prisoned NDF leaders so they can join the formal negotiations as peace consultants in Oslo, Norway, this week.

In the past, PEPP has played a role in negotiating for the freedom of police and militar y personnel held captive by the NPA in Northern Mindanao and Caraga regions.

Two of the NDF leaders, Alfredo “Ka Paris” Mapano and Pedro “Gonyong” Codaste, were freed

on bail and have flown to Manila to join other peace consultants in Oslo.

Mapano, who is facing multiple charges for murder, multiple murder and robbery in four different regional trial courts in the cities of Malaybalay, was able to post the P100,000 bail.

Codastre, who was incarcerated at the Malaybalay city jail for the same offenses, also posted the same amount.

NIA-10 official faces raps

THE Office of the Ombudsman has found probable cause to indict National Irrigation Administration (NIA) Region 10 manager Julius Maquiling for perjury for willfully asserting a false statement in his 2009 Statement of Assets, Liabilities and Net Worth (SALN).

Aside from perjury, Maquiling also faced charges for violation of Section 8(a) of Republic Act No. 6713 (The Code of Conduct and Ethical Standards for Public Officials and Employees).

De Lima, Gascon misleading on ICC probe of RP LIFE’S INSPIRATIONS: “…

-oooDE LIMA, GASCON, MISLEADING ON ICC PROBE OF RP: With due respect, it was totally misleading for Senator Leila De Lima and Chairman Luis Gascon of the Commission on Human Rights to raise the possibility that the International Criminal Court, or ICC, which is based in The Hague, Netherlands, could investigate the Philippines for the extrajudicial killings that have been happening in relation to the fierce antidrugs campaign of President Duterte.

I say it was misleading because, from the way De Lima and Gascon played out their “question and answer show” during the second day of the Senate inquiry into the extrajudicial killings on Tuesday, August 23, 2016, they tried hard to make it appear that the ICC can, at any moment, start investigating our country if the killings do not stop real soon.

National Police (PNP) and its chief, Director General Ronald “Bato” Dela Rosa, to go slow in their harsh campaign against illegal drugs and the killings that are associated with it.

-oooROME STATUTE DOES NOT ALLOW PROBE OF RP: The question, however, is this: does the ICC have the power to readily jump in, as it were, into the on-going killings in the Philippines and start an investigation preparatory to the filing of criminal cases before it?

Does the ICC have the legal right to investigate what is happening in the anti-drugs campaing of the Duterte government?

Based on the Rome Statute (or the multi-lateral treaty which serves as the ICC’s Constitution and which took effect in 2002), the ICC can only directly investigate

anyone if the conditions for such direct investigation are present. Without these conditions, the ICC cannot simply meddle, in a manner of speaking, in the affairs of its membercountries lest it is accused of unlawful intervention.

Art. 17 (1) (a) of the Rome Statute presents one important condition before the ICC can proceed with its investigation. It says: “the Court shall determine that a case is inadmissible where: (a) The case is being investigated or prosecuted by a State which has jurisdiction over it, unless the State is unwilling or unable genuinely to carry out the investigation or prosecution…”

-oooNO REASON FOR ICC TO INVESTIGATE EXTRAJUDICIAL KILLINGS: Without doubt, where the authorities of the country where the investigation is to be carried out are themselves already investigating an act or a series of act that maybe considered as a war crime, genocide, aggression, or, as De Lima and Gascon bruited about on Tuesday, a crime against humanity, the ICC cannot come in and do its own probing.

And this is what is happening with the so-called extrajudicial killings in the Philippines right now. Many

different agencies under the Duterte government are now carrying out their own investigations into these killings, notably the PNP, the Department of the Interior and Local Government, the Department of Justice, the CHR under Gascon and, of course, the Senate under De Lima.

There is therefore no reason for ICC to do any investigation. It has no legal basis to come to the Philippines to look into the so-called extrajudicial killings here, because its own charter, the Rome Statute, forbids it from doing so.

It is therefore the height of intellectual dishonesty for anyone to be claiming that the Philippines will be probed soon by the ICC. That simply is a factual and legal lie!

But many of us are like the university student who said: “I don’t like to think about things until they happen. Death is still a long way away.”

My grandmother used to tease my grandfather when he would leave the house to go for walks.

She’d say to him: “Now dear, don’t go so far you can’t get back!” You know, that’s exactly what happens

to us when we die.

We’ve gotten so far we can’t get back. Each of us gets only one chance to live and then we have to die.

We only get one chance to ‘fly’ before we have to ‘land.’ “What goes up, must come down.”

Ready or not, we’re going down! So we need to prepare for landing while we’ve still got time.

Dick pumps ‘Bato,’ DOJ on extrajudicial killings DIGGING deeper into extra-judicial killings, Senator Richard J. Gordon yesterday asked for a more comprehensive data on the killings committed by persons riding in tandems on motorcycles, or more commonly known as riding in tandems. These are considered extrajudicial killings.

During the joint Senate committee on extra-judicial killings, Gordon asked Philippine National Police Director General Ronald “Bato” Dela Rosa to give a comprehensive report on riding in tandems.

“I’d like to ask Gen. Dela Rosa if he could also bring the report on people killed by riding in tandems. For so many years, we have been inflicted with this malady called riding in tandem. People are killed and I don’t hear any solution to these cases...I want to know from the General, when he comes back, how many people have been killed by riding in tandems? How many cases have been reported and solved? How many have been prosecuted to the successful occurrence?” he said.

Gordon pointed out that extra-judicial killings have been occurring even before the Duterte administration, adding that the issue has already been a concern in the international community in the past.

“This has been going on long before. When I was lobbying for the Veterans’ Bill during my first stint in the Senate, no less than a senator from Vermont, USA (who chaired the Appropriations Committee) raised the cases of unexplained killings. they will not approve aid for the Philippines unless we do something about the unexplained killings,” he said.

Another point raised by the senator was the complaint about placards placed on top of the victims’ bodies that say “Drug pusher ako, wag tularan.” He said the shame campaign has been practiced even in past administrations.

The next step, he said, is for the committee to complete a report and informally talk to fellow senators to see if they agree with the decision.

Asked if the Senate and resource persons also agreed to extend the term of barangay officials, Angara said that the matter needs more consultation.

“Moving the term from three to five years needs more consultation, I don’t want to tackle that just yet.

We have to decide whether to postpone barangay elections first,” Angara said.

He said the Committee could come up with a substitute bill that does not include term extension.

“We can separate parts of the bill that we find separable and can make (that) the subject matter of a different bill,” the senator said.

Angara meanwhile reiterated that the idea is to separate national and barangay elections because barangay officials are nonpartisan.

As for youth council elections, Angara said that the Senate panel will also take into account the idea of holding village elections separate from youth council elections.

“We’ll take that into account. The option is to have elections separately. The NYC has not held elections in three (years) so they are anticipating it,” the senator said.

National Youth Commission (NYC) Chair, Cariza “Aiza” Seguerra, sought for youth council elections to “push through”, noting that youth-oriented projects have been put on hold for

almost three years.

“We really want to push through with it but I understand your stand for the postponement of barangay elections,” Seguerra said.

‘More time to prepare’ Angara also welcomed the insights gained from the hearing, noting that he was glad that most resource persons, particularly the DILG, have also expressed favor for postponement.

DILG Secretary Ismael Sueno, during the hearing, said if the elections push through, local governments will lose another 90 days for the implementation of projects.

“We already lost 90 days in the last election,” Sueno said, noting that many government projects have not been completed while others have not even started.

Sueno further said that the estimated PHP6 billion that will be needed for the elections can be used for other local government projects and programs, such as the construction of more rehabilitation centers.

“Over 6,000 drug pushers and users have surrendered.

Our jails can no longer accommodate them. With that PHP6 billion, we can put up rehabilitation centers in all the regions in the country.

We will be helping a lot of our people,” he said.

Comelec Chairman Andres Bautista meanwhile said that the Comelec has a neutral stand on whether to postpone elections or not but suggested that if it were postponed, there should be enough space between this election and the 2019 mid-elections.

“We are neutral. We can proceed with elections on Oct. 31, 2016 but we are also okay in case you would like to postpone it. (The) only point we want to raise is we want to space our elections from each other,” he said.

“The longer the time to prepare, the better. In case you postpone it to October 2018, we think that it’s too close to the 2019 mid-elections, so if you can consider, postpone it next year,” he added.

Bautista said the Comelec has already started printing ballots for the barangay elections and will go fullspeed on Sept. 1, printing one to two million ballots per day.

He however assured that the ballots can still be used if elections are moved next year. (PNA)

Both parties have complied with the first two lessons by coming here and resuming the stalled peace negotiations. Government

is committed to the process as what President Duterte declared “we have done what it takes to re-open the negotiations and I am willing to walk an extra mile to achieve peace.

What remains to be accomplished for both of us, therefore, is to complete the negotiations.

I have high hopes that our discussion for the following days will be cordial and frank, but nevertheless exacting for our tasks at hand. I expect, however, that the parties are mindful of the correctness of our language in the discussion to ensure that we can implement any agreement we reached. I borrow the counsel of Confucius with regard to talking with correctness, and I quote “if language is not correct, then what is said is not what is meant. And if what is said is not what is meant, then what ought to be done remains undone.”

In closing, may I also deeply acknowledge the unwavering support to our peace process of the Royal Norwegian Government, through Norwegian Foreign Minister Borge Brenden whose presence today is inspiring. Finally, from the DOJ also, I would like to know whether in fact, institutionally as the law provides and I reiterate this, how many cases of drug lords that have been incarcerated? Obviously, the cases have been dismissed in the lower courts. How many cases of confiscation of the profits of crime have there been? Meaning, how many cars, houses, money in banks have been confiscated by the DOJ and by law enforcement authorities? That is in the law,” he probed.

He added the 66th IB provided some documents signed by Purok chair Rex Basta and Purok secretary Nerisa Gollodo of Sitio Bongloy, Brgy. Pagsabangan that troops were allowed to enter the sitio but denied that they occupied the Salugpongan School.

He said the 66IB stayed 100 meters away from the Salugpongan school.

“As we have always said, the 10ID welcomes reports against our troops and encourages those who were victimized to file their complaints in appropriate agencies as we do not tolerate any misbehavior by our soldiers,” he said.
