Rotary Int’l District 3870 holds SAULOG! DISCON 2017

THE ROTARY DISCTRICT 3870 is holding this year’s District Conference in Valencia City, Bukidnon dubbed as SAULOG 2017!.

DISCON 2017 will be attended by some five hundred (500) rotarians who are executives, professionals, business and community leaders from all over Mindanao.

Seen as one of the most prestigious event, the Rotary International District 3870 33rd Conference at the City of Golden Harvest Valencia, Province of Bukidnon starts today April 29, and would wind up until May 1, 2017. Hosting the conference is the ever dynamic and active Rotary Club of Metro Valencia (RCMV), and the Local Government Unit of the City.

Under the leadership of District Governor Meriam Ruth “Jing” Dablio dela Calzada, DISCON 2017 appropriately themed SAULOG! which means to celebrate, serves as the biggest gathering and festive culmination of District 3870 as it wraps up another Rotary Year of “Service Above Self ”. The Philippines is seeking to complete this year the framework for a code of conduct in the South China Sea between ASEAN and China.

The ASEAN Economic Community (AEC) Blueprint, on the other hand,

ensures that the ASEAN Member States are economically, sustainably, and gainfully integrated in the global economy.

Meanwhile, the ASEAN Socio-Cultural Community (ASCC) Blueprint upholds ASEAN commitment to ad-

dress the region’s aspiration to lift the quality of life of its peoples.

"We are confident of our collective commitment to continue building ASEAN centrality and solidarity--an ASEAN that is peoplecentered, people-oriented

with communities that are secure and resilient through an organization that is responsive to the needs of the region, and most importantly, the needs of our people," the acting DFA Secretary underscored.

THE Regional Tripartite Wages and Productivity Board (RTWPB) in Northern Mindanao is expected to grant another wage increase within the next 30 days.

RTWPB 10 chair Joffrey Soyao disclosed this over the weekend, saying that the board is currently deliberating on the petition of the Associated Labor Union – Trade Union Congress of the Philippines (ALU-TUCP) for a P168 wage increase.

Davao-GenSan-Bitung trade route seen to spark more linkages in BIMP-EAGA DAVAO CIT Y -- The Davao-GenSan-Bitung Roll-On Roll-Off (RoRo) service could spark more sea and air linkages in the Brunei Darussalam, Indonesia, Malaysia, the Philippines - East ASEAN Growth Area (BIMP-EAGA) in the future, an official said.

Secretary Abul Khayr Alonto, chair of the Mindanao Development Authority (MinDA), said Thursday he expects “more transactions among business partners as a result of the DavaoGenSan-Bitung sea link.”

The new sea link will make the Philippines and Indonesian backdoor cities busier trading hubs, he added.

Alonto said it is “necessary to establish a direct air connectivity” and more sea routes from Davao City to Bitung as a result of the new trade link.

He said that Malaysia is also eyeing air links to Davao City and Palawan.

“Definitely, air connectivity is necessary for the movement of people,” he said.

The Davao-GenSanBitung RoRo service will be launched on Sunday in Kudos, Sasa Port here by President Rodrigo Duterte and Indonesian President Joko Widodo.

The route will be serviced by Super Shuttle RoRo, which is owned by Asian

Marine Transport Corporation.

Alonto said the sea link is a result of a feasibility study conducted by the Japan International Cooperation Agency as part of the ASEAN Connectivity Masterplan, the United States Agency for International Development, through Dr. Henry Basilio, and the Research Education and Institutional Development Foundation in 2010. ”It is a commitment made

The DTI Bagwis Award is a recognition program for business establishments that engage in fair trade business ethics and uphold consumers’ interest by embedding consumer protection at the core of their business operations.

The establishment of a Consumer Welfare Desk (CWD), among others, is a basic requirement to be considered for the program.

only way to smell sweet success is to wake up, so you can work up the ladder to where you want to be. Then after you’ve reached the level of success you want, work is the only way you can stay there to keep enjoying it. Remember, nothing just happens by itself; somebody has to do the work to make it happen.

The great music composers like Beethoven and Mozart did not sit around waiting to get inspired before they started working. They got inspired because they were already working at it.

But it’s not enough to work hard. An important question we need to ask

ICC has jurisdiction over President Duterte. Duterte does not enjoy any presidential immunity, if and when the ICC decides to pursue its investigations against him (that is, of course, a big “if and when”, because as I already wrote here, there are big obstacles against ICC investigating Duterte right away).

This jurisdiction to investigate even over a sitting president was granted to the ICC by the so-called Rome Statute, or the international treaty that created it. Art. 27 of that treaty says no immunity attaches to any head of state or government, or any government official or an elected representative.

This means, all officials are liable to be investigated, if the grounds are clear.

Beyond the bend

ICC IS NOT BOUND BY “PRESIDENTIAL IMMUNITY”: So Sen. Sotto can understand this better, I will reproduce the two sections comprising Art. 27 of the Rome Statute, which are self-explanatory.

This is necessary because of the misimpression that his statement---that ICC can have jurisdiction only if a leader or any other citizen of one country will do something against the citizen of another country--may have generated.

Section 1 of Art. 27 says: “This Statute shall apply equally to all persons without any distinction based on official capacity.

In particular, official capacity as a Head of State or Government, a member of a Government or parliament, an elected representative or

a government official shall in no case exempt a person from criminal responsibility under this Statute, nor shall it, in and of itself, constitute a ground for reduction of sentence.

Section 2 on the other hand says: “Immunities or special procedural rules which may attach to the official capacity of a person, whether under national or international law, shall not bar the Court from exercising its jurisdiction over such a person…”

On prescriptions concerning political parties in the new charter QUEZON CITY -- As most Filipinos would attest, political parties in the country are more renowned for their clever and catchy slogans than genuine reform platforms. The electoral experience after the EDSA People Power in 1986 have firmly established that political parties are simply pathways to acquire wealth and power.

In fact, in the aftermath of the 2016 elections, many members of Congress jumped ship to the ruling party to ally themselves with the newly elected leader who determines how state largess is allocated. President Rodrigo Duterte even ridiculed a recent transferee

saying that if Vice-President Leni Robredo suddenly became the Chief Executive, he would happily return to the fold of her political party. The bottom-line is, to characterize Philippine political parties as democratic institutions that safeguard national interests is quite simply, a very tough sell.

The health of a political system depends heavily on the quality of political parties. A robust democracy is only possible when political parties can do the following: 1) offer the polity coherent and viable policies and programs; 2) promote constitutional principles such as respect for human rights;

and, 3) genuinely thrive to reflect the aspirations of the people. Anything short of these standards can compromise a political system.

A complete overhaul of our political party system should be forthcoming because President Duterte won on the promise of change.

And helping him in the task of bringing this particular promise to fruition now falls on the administration’s Consultative Committee (Con-Com) on constitutional reform.

Accordingly, it is incumbent upon the Con-Com to ensure that their draft charter establishes a credible and coherent political party

regulat o r y f ramework. Obviously, not all the issues of the existing set-up can be addressed here. But a structure more substantial that the present one must be self-evident.

Article IX-C, Section 6 of the 1987 Constitution provides: “A free and open party system shall be allowed to evolve according to the free choice of the people, subject to the provisions of this Article.”

Without a doubt, the current constitutional prescription on political parties is thin. And the phrase

Winners of the 2017 Metrobank Math Challenge awarded The country’s math geniuses competed during the national finals of the 2017 Metrobank-MTAP-DepEd Math Challenge (MMC) National Finals, held last April 22, 2017 at the Metrobank Plaza Auditorium in Makati City.

Out of the 572,916 students who competed in the nationwide elimination rounds, 44 students representing 29 public and private schools successfully met the “hurdle rate” in their scores leading them to advance to the final leg of the MMC. The national f inals showcased the mathematical competence of Grade 6 and Grade 10 students who competed in individual and team categories. The challenge consisted of solving complex mathematical problems mentally within 15 seconds and additional rounds of 30-second and one-minute questions using pen and paper. As the first math competition in the Philippines to use technology that leads to faster generation of contest results, the MMC provides national finalists with tablet computers, through which

they send answers directly to the judges, who then immediately mark them as “correct” or “wrong”.

Out of the 29 competing schools, 9 have produced their first ever national finalist. They are Ilocos Sur National High School (Vigan City), College of the Holy Spirit of Tarlac (Tarlac City), Maliwalo High School (Tarlac City); De La Salle University Integrated School (Biñan City); Palawan State University Laborator y Elementar y School (Puerto Princesa City); Binalbagan Catholic College High School Department (Binalbagan, Negros Occidental); Mary Infant Jesus School (Iligan City); Mindanao State University – Iligan Institute of Technology Integrated Development School (Iligan City); Notre Dame of Dadiangas University (General Santos City); and Palanan Elementary School (Makati City).

CheckMySchool – uplifting public schools one at a time

WHEN Cagayan de Orobased community activist Jonathan Mongcal learned about the dilapidated plights of some of the public schools in the city in 2015, he scouted for a non-government organization (NGO) in Manila to help in his efforts.

And so Mongcal stumbled upon CheckMySchool.

CheckMySchool is a participatory monitoring initiative for the education sector in the country. It aims to continuously improve the quality of education services by bringing in the participation of citizens and communities into the governance of public schools in the

Philippines. It started in 2011 as an experimental partnership project with the Department of Education (DepEd) along the advocac y for access to information and social accountability.

In just two years, CheckMySchool has implemented a lot of projects in Cagayan de Oro. They were able to hand out educational toolkits to a total of 150 first graders in Kamakawan Elementary School (Indahag), Palalan Elementar y School (Tablon) and Linangohon Elementary School (Tablon).

selling of beer and for other purposes; WHEREAS, it has been observed that most of the provisions contained in the previous Ordinance were designed to prohibit the selling of liquor and other intoxicating substances, within one hundred (100) linear meters away from school and likewise prohibit the selling of the same to minors and students, and provides penalties thereof; WHEREAS, for quite some time, there are business establishments, store-owners, sari-sari stores and convenience stores which operate their business for twenty fours (24/7) in selling liquor, intoxicating substances and alcoholic beverages including coconut wine to the customers, which is perceived to be too much, thus contrary to public moral, good custom and prejudicial to the third person; WHEREAS, there was this clamor to pass an Ordinance prohibiting or banning business establishments, Inn, Tavern, Nightclub, Hotel and Restaurant, store-owner, sari-sari store, and convenience store to sell, serve, and prohibit individuals from drinking liquors, alcoholic beverages, intoxicating substances including coconut wine from 1:00 AM to 6:00 AM; WHEREAS, those mentioned intoxicating substances are considered mind altering and body destroying substances. People should be aware about this especially for those who love to party until the wee hours of the morning for they may have to make some adjustments in their lifestyle and advised to stock up on supply and just continue drinking at homeso as to avoid being involved in the increasing alcohol related incidents outside their homes; WHEREAS, this ungodly hours (1:00 AM to 6:00 AM) instigate people to patronize their wine products and the customers usually consume the same or in other words having a drinking spree in the said business establishment and even public places such as: parks, plazas, parking areas, and uninhabited private places, and as a result they get drunk and once a person is intoxicated or under the influence of liquor, become unruly causing trouble, making annoyances towards neighborhood tranquility;

WHEREAS, Davao City’s Ordinance No. 004-13 series of 2013 prohibited the selling, serving, drinking, and consumption of liquors, alcoholic beverages from 1:00 AM., until 8:00 AMis already successfully implemented in Davao City during Mayor Rodrigo Duterte’s time as he gained full support from the business sector which they had made some adjustments of their business hours to accommodate their valued customers and also to avoid huge losses of their sales;

WHEREAS, on June 24, 1951, the Municipal Board of Iligan City passed Ordinance No. 44. entitled “An Ordinance Prohibiting The Sale of Liquor and Any other Intoxicating Substance Within One Hundred Linear Meter From Any School, College or University”.

Said Ordinance imposed a fine of not less than P10.00 but not more than P100.00, and imprisonment of not less than ten (10) days but not more than three (3) months, or both at the sound discretion of the court;

WHEREAS, because of the rampant selling of liquor to minors and students, on September 19, 1968, the Sangguniang Panlungsod passed City Ordinance No. 497, entitled “An Ordinance Amending Ordinance No, 44, Prohibiting the Selling of Liquor and Any Other Intoxicating Substances Within the One Hundred (100) Linear Meters From Any School, College or University To Minors and Students WHEREFORE, on motion of Member Bernard Y. The administration’s Con-Com can do better than the South Korean approach and include in their draft charter a s t r i c t e r re g u l at or y mechanism covering the “objectives, organization, and activities” of political parties. A provision that unequivocally prohibits turncoatism would be a welcome game-changer.

As would a broad but sensible regulation relating to political finance.

A d d i t i o n a l l y, t h e Con-Com can include an explicit mandate on political parties to present credible “organizational arrangements for the people to participate in the formation of the political will.” Such a constitutional prescription is only fitting for it has been said that “democracy is not a spectator sport”.

In a fully-functioning democracy, political parties operate as a mouthpiece for policy ideas.

They play a key role in bringing people to engage in political discourse.

As many Filipinos now realize, without genuine political parties to guide the way, public discussion on burning political issues is severely dimin-

ished by social media hacks and irredeemable apologists employed by the powers-that-be.

The goal in articulating these prescriptions in the draft charter is to ensure political parties work towards maintaining a political system we can all be proud of.

Doing this will be very controversial for sure.

But if the Con-Com shirk their duty, many Filipinos, the 16 million most of all, would likely treat this as a betrayal of the President himself.

While the BTC is still working on the draft, the Office of the Presidential Adviser on the Peace Process (OPAPP), through the GRP Implementing Panel, is conducting consultations and peace tables to build a constituency that will support the peace process.

People’s support is needed in order for the new BBL to succeed and not suffer the same fate of the previous bill on questions of constitutionality, Santiago said.

Santiago said the holding of the women peace table is a manifestation that the government realizes the crucial

role that women play in the peace process, particularly in the normalization process.

“The BBL is important to establish the Bangsamoro government,” Santiago said, adding that BBL “is tied to the normalization process.”

Santiago said the normalization process is more complicated and needs longer work because this involves how to bring the decommissioned MILF forces to live normal lives.

Santiago also emphasized that the new BBL will not only involve the MILF. She said the two parties of MNLF, the Yusoph Jikiri and Misuari groups, are also involved. The Jikiri group has three members in the BTC while OPAPP Undersecretary Nabil Tan is working with the group of MNLF founding chair Nur Misuari.

Earlier, Presidential Peace Adviser Jesus Dureza underscored the importance of the peace tables because these are close engagements with stakeholders to bring about a new BBL. Dureza said the law would not pass Congress if it does not have the support of the people.

The Women Peace Conversation is so far the eighth engagement of the GRP Implementing Panel with stakeholders since January.

The ICC would be barred from investigating if the complaint is already being addressed in the country where it supposedly took place.

What is more, it should also be stressed that a complaint that the ICC will investigate cannot come from just about anyone, like the Filipino lawyer, or his clients. Under Art. 13 of the Rome Statute, the ICC is mandated to investigate a complaint only if was referred by the government of a country itself, or by the Security Council of the United Nations, or by the Prosecutor of the ICC. Clearly, therefore, the supposed “complaint” of the Filipino lawyer and his clients do not appear to be one of those that the ICC can investigate.

At best, that “complaint” could be treated by the ICC only as a mere “information”, nothing more, nothing less.
