FORMER presidential assistant on food security and Senatorial candidate Francis Pangilinan continued to drum up support for his agricultural concerns and vowed to rally this to the Senate once he gets elected.

Pangilinan met with local agricultural leaders in Cagayan de Oro City Tuesday and hopped to Iligan City and neighboring areas by afternoon, also meeting with farmers there who reported their El Niño concerns to him.

Along this line, Pangilinan also continued bat-

ting for the passage of his baby initiative, the Sagip Saka. His Farmer Entrepreneurship and Development Bill pushes for farmers to become entrepreneurs so they can move away from subsistence farming into viable farm enterprises and creating more jobs.

To change this mentality,

Pangilinan bats for even greater government intervention and incentives to get the agricultural sector back on its feet and moving away from the “isang kahig, isang tuka” mentality.

“Our farmers earn a measly P23,000 a year, less than P2,000 a month.

CBCP exec slams delayed release of funds to farmers A

N official from the social action arm of the Catholic Bishops’ Conference of the Philippines (CBCP) has expressed alarm over reports of delayed release of government funds that would help ease the burden of farmers suffering from the ill effects of the El Niño phenomenon.

National Secretariat for Social Action (NASSA)/ Caritas Philippines Executive Secretary Fr. Edwin Gariguez is referring to the available funds from the national government such as the quick response funds (QRF), which were not yet fully disbursed despite requests by local government units of areas hit by El Niño.

rooted from the government’s inaction to this national concern,” Gariguez pointed out.

The statement was made in light of the recent violent dispersal of farmers rallying for food aid in Kidapawan City which resulted in the death of at least two farmers and dozens more injured.

A ranking official of the Autonomous Region in Muslim Mindanao (ARMM)

recently confirmed that their “letter request for funding has not been acted upon despite follow-ups.”

This was also the sentiment of the governor of North Cotabato, who said that they had not received any funding from the national government although the request was made as early as March.

“Time is of the essence here. The government needs

to act now and disburse the funds intended for the farmers, who have suffered enough. Loss of livelihood means hunger for our people who are already living in poverty to start with,” the priest stressed.

The church official added that several dioceses in Mindanao particularly the Archdiocese of Cotabato and the Diocese of Marbel have already raised

the concern about how the drought is taking its toll to their farmers.

The Department of Social Welfare and Development earlier claimed the availability of Php 1.32 billion QRF for 2016 and another Php 6.7 billion for the implementation of cash-for-work and livelihood assistance for families affected by El Niño. But these funds were not yet fully downloaded to the affected LGUs. Apart from implementing the Catholic Church’s largest rehabilitation program for Yolanda survivors, NASSA/Caritas Philippines has always been a staunch supporter of farmers’ rights, advocating agrarian reform and land rights, good governance, and sustainable agriculture.

NASSA/Caritas Philippines also currently implements a climate change adaptation program called FARM-FIRST in eight provinces by helping farmers and fishermen adapt to changing environmental conditions for food security and environmental preservation.

as the City Mayor of El Salvador. The case would provide his closest rival an upper hand as the May 9 election draws near.

The political leaders and followers of Tan would certainly dismember – most of them would definitely jump to the other side of the political fence.

In other words, with the impending warrant of arrest and suspicion of failing health, the mayoral contest in El Salvador would become uncontested in favor of Tan’s closest rival, former Mayor Emelita Almirante.

Looking at the issue,

however, the Cynosure believes that Tan, as a lawyer, could get away with the case filed against him with the anti-graft court.

But, Tan’s failure to submit a counter affidavit to refute the complaint filed against him with the Ombudsman might have an effect on the perception of the Sandiganbayan at first glance.

Before anything else, the Cynosure already learned about the anti-graft case filed against Tan by the Ombudsman with the Sandiganbayan in December last year.

A reader emailed a copy of the Ombudsman order to file the graft raps against Tan with violation of Republic Act 3019 or the “Anti-Graft and Corrupt Practices Act.” Despite knowing the earlier filing of the graft case against Tan with the Sandiganbayan, the Cynosure exercised restrain in writing the story until the “hard copy” of the document relative to the case was furnished last Monday.

The case stemmed from a complaint that accused Tan of alleged “illegal demolition” of the tourism building along the El Salvador highway, nearer to the church sometime in 2012.

Incidentally, the tourism building known as the “House of Pasalubong” was constructed in the amount of Php 987,500 during the incumbency of Mayor Emelita Almirante when El Salvador was still a town in 2007.

Just recently, the Cynosure also learned that provincial Governor Yevgeny Vincente Emano, of Misamis Oriental, then the representative of the province’s second congressional district, helped in raising the government fund for the construction of the tourism building that display native products.

Anyway, with the anti-graft case filed by the Ombudsman in the Sandiganbayan, the burden of proof now lies in the hands of Mayor Tan. -0- Send comments to: crisguardian@yahoo.com

DFA? And yes, why did not the Bureau of Immigration inform the DFA of its grant of temporary visa to the Chinese operator? Was the grant of visa to this Chinese supposed to be a hush-hush or secret affair?

Why the apparent secrecy on the matter? Then, why did not the operator apply for a visa from Philippine embassy or consular officials based in China?

Why did it have to be the head office of the immigration bureau here in Manila which had to issue the visa to the operator?

Was the grant of temporary visa by the Bureau head office the handiwork of top bureau officials alone, or were they acting pursuant to the orders of some higher officials? And who could these “higher officials” be? I am sure there will be graver questions on this issue as the days go by so, watch out for the next story about this!

The end of the world, the Bible says, is going to come only after the Gospel of Jesus shall have been preached to the world. The preaching of the Bible, showing how salvation can come only to those who believe in Jesus as God and Savior, is going to be the last act, as it were, before the end happens. So, the question is: do you now believe and accept Jesus as God and Savior?

THE filing of the anti-graft charges by the Ombudsman against incumbent City Mayor Alfredo Tan, of El Salvador, Misamis Oriental, with the Sandiganbayan would only mean: -That, in no time, the Sandiganbayan might issue a warrant of arrest against Tan. Upon receipt of the warrant of arrest, Tan would immediately post “bail” else, he would languish in jail.

- If the warrant of arrest is issued on or before the May 9 election, the candidacy of Tan, who is running for reelection as City Mayor, would be imperiled.

- There are also apprehensions that the warrant of arrest might allegedly affect Tan’s health. In the absence of a medical certificate, however, the Cynosure considers the issue of Tan’s failing health as a mere propaganda of political opponents.

Anyway, the warrant of arrest against Tan would ensue in an irreparable damage against his candidacy and his reputation

Isabela City remembers April 13 bombings; Inter-Faith lights candle for peace

ISABELA CITY, Basilan -- “Thank you for coming together for remembering those who have shared their blood just to tell us, ‘Look, peace is worth dying for’.”

This was the statement of Claret College of Isabela President Rev. Fr. Edgar G. Rivero in his message during the Inter-religious Candle-Lighting for Peace held at Isabela City Plaza last April 13.

PASSING ON THE BLAME

A Grade one teacher blames the preschool teachers for the poor performance of the pupils.

Likewise, the high school teachers blame the grade school teachers for the deteriorating performance of the students. The same picture is reflected in the college where professors blame the former teachers of the struggling college students.

This story is very common in our time today.

Students who cannot read and write and cannot perform simple mathematical operations are accordingly the result of teachers’ mercy. These students are promoted to the higher level despite their poor performance in the hope that the next teacher will augment the gap of learning. As a result, students

stagnated as struggling learners.

The students, on the other hand, take advantage of the system. They are lax in submitting the subject requirements. They don’t take exams seriously. In fact, a math exam good for an hour is done in 20 minutes. They are not afraid to fail in their subjects.

Of course, it cannot be discounted that teachers’ instructional competence means a lot in the students’ academic success. Students will not perform well if they are not motivated to learn.

Success is emanated from the teachers’ commitment to teach.

It’s easy to pass on the blame. It is easier to ignore our mistake. However, it is easiest if we take the responsibility. Only then we can say that we have done our best and the failure is beyond our control.

zon City said establishing night classes for high school students will help address the dropout problem.

Vargas explained that holding evening classes offer a viable option for high school students to continue their studies--and at the same time fulfilling their obligations or, helping their families earn a living during the daytime.

Continuous Improvement-Based or CI-Based is the new format of educational research. What is it? How does it differ to the old format known as institutionalized research?

The institutionalized research follows the thesis format with the following parts: Chapter 1- Introduction, chapter 2- theoretical framework;chapter 3-methodology;chapter 4-consists of presentation, analysis, and interpretation of data. Chapter 5 is composed of summary, conclusions and recommendations.

The CI-based is composed of the three A’s that stands for Assess, Analyze and Act.Under stage 1Assess, the parts are: step 1. Get organizedwhich is establishing the CI organizational structure and the

key responsibilities;and step 2.Talk with customers.

Step3 of stage 1 is walk the processdone by collecting the data; step 4-identifyimprovement areas, which is accompanied by process map and situating the clouds.

BEYOND their motherhood statements about the role of youth and education, the five presidential candidates have not yet provided a definitive analysis of K-12 and higher education. Their campaign promises currently focus on either free or subsidized tuition for college students as well as the usual litany of scholarship grants and study loans.

The challenge remains for all national and local candidates to take a stand for or against the globalization of education in the country. There is a need to bring the issue of education. A majority of governments all over the world, including our

own, have made economic development the burden of education. History has proven that this formula is by no means a vision but a prescription for people to assume that there is no alternative to the system of education. While our national and local candidates are expected to support the development of higher education in the Philippines, it is high time that they define the nature of this development.

For instance, what are the candidates’ stance on general education? Remember that broad access to quality education and other opportunities that develop human potential will be key to creating a generation of skilled, innovative and tech-savvy Filipinos who can compete with the best in the world.

You can become a better reader by developing yourself as a well-rounded person. The more real-life activities you take part in, the more experiences you have, the more hobbies and interests you share, the more places you visit- in other words, the richer the background you build- the greater will be your ability to understand whatever you read.

The second step is curiosity. You must develop an interest to the world about you, in people if other lands, in nature and animals, in wide range of human problems. With curiosity you will find books that will satisfy your interest. The third step is word-consciousness.

You must learn new words from the context of our reading. The fourth step is

a taste for books. You must acquire an appetite for wide reading of all types. When you want a become a better reader, read everything you can. Do you remember how many miles Abe Lincoln walked in order to borrow a book? Surely, your school or library is closer to you.

The fifth and last step is to correct any faulty reading habits you may have.

Some Faulty Reading Habits Lip movement or whispering: Read silently with still lips for greater speed. You can read five times as fast silently as you can speak.

Mental Pronouncing: Avoid this kind of reading. Train yourself to read more rapidly and omit that echoing of the sound of words in your mind.

SCIENCE education is the field concerned with sharing science content and process with individuals not traditionally considered part of the scientific community. Obviously, this includes elementary and high school students.

The learners may be children, college students or adults within the general public. The field of science education includes work in science content and science process (the scientific method). The standards for science education provide expectations for the development of understanding for students through the entire course of their K-12 education and beyond.

The traditional subjects included in the standards are physics, life, earth, space and human sciences.

In the Philippines, science education aims to develop scientific literacy among learners that will prepare them to be informed and participative citizens who are able to make judgements and decisions regarding applications of scientific knowledge that may have social, health or environmental impacts. The science curriculum recognizes the place of science and technology in everyday human affairs. It integrates science and technology including indigenous technology, thus preserving our country’s cultural heritage. The K to 12 science curriculum will provide learners with a repertoire of competencies important in the world of work and in a knowledgebased society.

Disregard of proper Word Grouping: Watch the punctuation marks and the structure of the sentence instead of concentrating on individual words. Train your eyes to take in phrases and clauses as units f meaning.

Slow rate in Reading: Comprehension is always more important than speed. A normal reading rate is 300 words a minute for narrative material.

More difficult selections will naturally require more than time gasping the thought.

One of my concerns which I believe is a necessity, are the character traits of the students. I am saddened by my observation that most students today don’t know the word respect.

ADJUST TO ADAPT

Teaching in the 21-century poses challenge to teachers as this may affect many areas of teacher’s life. Having a sudden shift of paradigm and dealing with this type of students has not been that easy for a teacher. Definitely a totally new experience that every educator should learn from, since never before could learning be happening the way it is up to this time.

Recent technological advances have caused teachers to craft intervention on the prevailing problem. Teachers should admit that we are front with unusually scenarios inside the classroom: A challenging one. The way we communicate, collaborate, learn, and, of course, teach has been influenced by modernization. Along with that, those advances necessitated an expansion of our vocabulary and a widen imagination as this new

phenomenon requires.

But what does being a 21st-century teacher really mean? How should a classroom teacher address this problem?

Of course we have to “Adjust to Adapt” and established a learner-centred classroom. Today personalized instruction is needed as much as possible since students can anytime access any information possible, indeed there is no need to “spoon-feed” the knowledge or teach using the traditional pedagogy. As students have different personalities, goals, and needs for learning, offering personalized instructions is not just possible but also desirable. When students are allowed to make their own choices, they own and take much responsibility to their learning, increase intrinsic motivation, and put in more effort is an ideal recipe for better learning outcomes!

Is Child Labor an Excuse to Absenteeism in School?

We have the so-called acceptable and unacceptable reason for student absences, but speaking of child labor it did not belonged. So, if parents would say that my son/daughter is absent from the class because of work is not a valid excuse.

Parents/guardians, let’s not lost sight of the fact, that attendance is an important factor in school success among children and youth. Studies show that better attendance is related to higher academic achievement for students of all backgrounds, but particularly for children with lower socio-economic status. Beginning in kindergarten, students who attend school regularly score higher on tests than their peers who are frequently absent.

Chronic truancy (frequent unexcused absence) is a strong predictor of undesirable outcomes in adolescence, including academic failure, dropping out

of school, substance abuse, gang involvement, and criminal activity. However, chronic absence (regardless of reason) is increasingly identified as an important “early warning sign” that a student is at risk for school failure and early dropout. Chronic absenteeism is usually defined as missing ten precents or more of school days. Unfortunately, few school districts currently have the capacity to analyse or shall I say maybe fails or wasn’t able to analyse attendance data to identify those students who are chronically absent.

Many factors can contribute to student absenteeism. Family health or financial concerns, poor school climate, drug and alcohol use, transportation problems, and differing community attitudes towards education are among the conditions that are often associated with a child’s frequent absence from school.

National public school database

TO streamline the enrollment process and make the administrative functions of the teachers more efficient, Rep. Sherwin T. Gatchalian of the first district of Valenzuela City filed House Bill No. 5974 at the House of the Representative.

The bill mandates the establishment of a National Public School Information Office, which shall develop and maintain a database containing student information such as school grades, personal data, good moral record and improvement tracking.

In proposing for the

automation of the National Public School Database, Gatchalian said the bill will not only promote easier public access to education, but will also serve as a layer of protection for the safekeeping of students’ records.

He said: “Documents are prone to getting lost and deterioration due to human error, flood, fire, and other natural disasters.

Storing student records in a database ensure that there is another source of information in case the documents get lost or destroyed.”

The proposed Public School Database Act of 2015 shall cover public elementary and secondary

education.

Under the bill, school administrators are authorized to access the National Public School Database for student records, including biographical data, admissions, discharges and transfers to other schools, and other student-specific data like exam scores, grade levels, attendance and immunization records.

The bill prohibits any person from using, access-

ing, or utilizing the National Public School Database for purposes other than what was provided under the act.

Any person caught illegally altering or falsifying student information in the database shall suffer the penalty of imprisonment of not less than six months but not more than one year or a fine of not less than P10,000 but not more than P50,000 or both at the discretion of the court. On 6 February 2016 and 22 February 2016, LANECO’s Bids and Awards Committee (BAC) conducted two (2) separate biddings for the supply of its electricity requirements, however, both had failed considering that only one (1) qualified bidder, SMCPC, submitted an offer on both occasions;

5.1 On 1 March 2016, LANECO’s BAC issued Resolution No. 10, Series of 2016 resorting to direct negotiation with SMCPC for the procurement of 5 MW electric energy for the period 2016-2026;

Nature of the Application 4.

The Joint Application for approval of the Power Supply Contract (PSC) dated 14 March 2016 entered into by and between LANECO and SMCPC, is being submitted to the Honorable Commission for its review and approval pursuant to Sections 25 and 45(b) of Republic Act No. 9136, otherwise known as the Electric Power Industry Reform Act of 2001 or the EPIRA, Rules 5, Section 4(e) and 11, Section 5 of its Implementing Rules and Regulations (IRR), Rule 20(B) of its Rules of Practice and Procedure, and other pertinent rules and regulations; Statement of Facts

5.2 On 3 March 2016, LANECO, through Mr. Sherwin C. Mañada, its Project Supervisor-Acting General Manager, invited SMCPC for a meeting for the negotiation of its power supply;

The Parties agree to adopt changes in any of the inflationary indices subject to prior notification by the Seller to the Buyer for the occurrence of any of the following events: a) shift made in the base year and other adjustments to such inflation index made by the relevant authorized entity; or b) the inflation index: i) becomes unavailable, ii) is replaced by a new benchmark rate as determined by the relevant authorized entity or its successor-in-interest, iii) ceases to exist, or iv) in the reasonable determination of either Party, fails to reflect the real costs and forms an integral part of this price adjustment formula;

5.3 After a thorough deliberation on SMCPC’s offer and subsequent negotiations in good faith, on 4 March 2016, LANECO’s Technical Working Group (TWG) on Power Supply issued Resolution No. 01, Series of 2016 endorsing to LANECO’s Board of Directors through its Management to enter into a power supply contract with SMCPC; 5.4 On 7 March 2016, LANECO’s Board issued Resolution No. 26, Series of 2016 authorizing, among others, Mr. Emmanuel A. Mejorada, its Board President, to sign the PSC with SMCPC for the supply of 5 MW electric energy to LANECO for the period 2016-2026; and 5.5 Thus, on 14 March 2016, LANECO and SMCPC executed the PSC, subject of the Joint Application; 6.

Salient Features of the PSC. 6.1 Contract Capacity. The Contract Capacity for the duration of the PSC shall be 5,000 kW. The Buyer shall maintain a minimum hourly nomination of at least forty percent (40%) of the Contract Capacity for the duration of the PSC, as its share in the minimum stable load of the Power Plant. The Contract Capacity shall be subject to a separate nomination protocol set forth in Annex V of the said PSC; 6.2 Generation Source. SMCPC is constructing a 2 x 150 MW Circulating Fluidized Bed Coal-Fired Thermal Power Plant (the Plant) located in Barangay Culaman, Malita, Davao del Sur, which is expected to be commercially operational by the 1st quarter of calendar year 2016; 6.3 Contract Term. The PSC shall take effect between the Parties on the date of signing (Execution Date) and shall remain effective for a period of ten (10) years from Commercial Operations Date (COD). The supply of electric power by the Seller shall commence upon COD, and shall continue until the end of the Contract Term;

Case No. 2014-060 RC1 , the National Grid Corporation of the Philippines (NGCP) was authorized to construct the 230 kV Malita-Matanao Transmission Line in Malita, Davao del Sur. Upon completion of the said Transmission Line, SMCPC will execute the necessary Service Agreement with NGCP and undertakes to submit the same to the Honorable Commission; 6.8 Sources of Funds. The total estimated Project Cost of the Power Plant is PhP24,824 Million. SMC Global Power Holdings Corporation, SMCPC’s parent company, advanced a total amount of US$300 Million to commence and allow the on-going construction of the said Power Plant. It was initially financed through one hundred percent (100%) equity since the funding thereof was undertaken by the said parent company without interest payments. SMCPC intends to undertake project financing with a target Debt to Equity ratio of 70%:30%; 6.9 Discounts. The Seller provides for both Prompt Payment Discount (PPD) and Collection Efficiency Discount (CED); a) PPD. The Buyer may avail of the PPD equivalent to one percent (1%) of the total of the Capacity and Energy Charges and other components of the current power bill except the Interim Mindanao Electricity Market (IMEM) or the Wholesale Electricity Spot Market (WESM) charges and Replacement Power Cost, if any, provided that: i.

The Buyer has no arrears from previous power billings including the Security Deposit or any unpaid charges or penalties including VAT;

ii. The Buyer has submitted all necessary Bureau of Internal Revenue (BIR) Tax Certificates for all taxes withheld as well as for all zero (0)-rated VAT end-consumers; iii. The Buyer pays the power bill in full on or before the 10th day of the calendar month following the current Billing Period; and iv. The Buyer complies with other policies and procedures as may be required by the Seller, subject to prior notification by the Seller to the Buyer; b) CED. The Buyer shall be entitled to the following CED:

In order for the Buyer to avail of the CED, it must comply with the following conditions: i.

The Buyer has no outstanding obligations to the Seller from previous power bills including VAT; and

ii.

The Buyer shall submit to the Seller: a copy of its Monthly Financial and Statistical Report (MFSR)/ Collection Efficiency Report signed by its Finance Manager and General Manager, stamped “received” by the NEA; Audited Financial Statements (AFS) stamped “received” by the BIR (to be submitted to the Seller within three (3) calendar days from receipt of the BIR; zero (0)-rated VAT certificates as updated monthly; and a duly accomplished CED Availment Form;

6.10 Outages. The Seller shall be entitled to an Annual Outage Allowance Per Unit of one thousand one hundred fifty-eight (1,158) cumulative outage hours for each Contract Year at the cost specified in Annex II-A of the PSC. During this period, the Seller shall not be obligated to deliver energy to the Buyer;

The Seller shall be allowed an additional Major Maintenance Outage Allowance of seven hundred twenty (720) cumulative outage hours once every five (5) years from the first Major Maintenance of each Unit of the Power Plant. The Seller is not obligated to deliver energy during Major Maintenance Outage;

Unutilized outage hours for a Contract Year shall not be carried over to the following Contract Year; and

Further, in compliance with Article VI, Sections 1 and 2 of the Honorable Commission’s Guidelines for the Recovery of Costs for the Generation Component of the Distribution Utilities’ (DU) Rates, copies of the foregoing are, likewise, attached to the Joint Application as annexes and made integral parts hereof:

15. Furthermore, the Joint Application is consistent and in accordance with the first (1st) and fifth (5th) “Whereas clauses” of the DOE Circular No. 2003-12-11 which are quoted hereunder:

6.11 Replacement Power. To ensure the uninterrupted supply of energy to the Buyer during the Annual Outage Allowance or Major Maintenance Outage hours, the Seller may procure replacement energy from other sources, the cost of which shall be passed-on to the Buyer; Rate Impact on LANECO’s Overall Generation Rate

The indicative rate impact on LANECO’s overall generation rate with and without the supply from SMCPC are as follows:

8. Environmental Compliance Certificate (ECC). On 7 June 2013, the Department of Environment and Natural Resources (DENR) has issued ECC No. ECC-CO-1304-0010 in favor of SMCPC; 9. Board of Investments (BOI) Certificate. On 24 June 2013, the Power Plant Project was registered with the BOI which issued Certificate of Registration No. 2013-137; 10.

Certificate of Compliance (COC). The Power Plant is still under construction and the target/estimated COD is sometime in June 2016. Hence, it is not yet covered by a COC. Nonetheless, SMCPC undertakes to file the necessary application for a COC at least three (3) months before the target COD;

11.

Further, SMCPC’s Power Plant is considered as a committed project, and is in the process of securing a certification from the Department of Energy (DOE) that the same is consistent with the Power Development Plan (PDP).

It undertakes to submit the certification as soon as the same becomes available;

12. Furthermore, SMCPC undertakes to submit a certification from the National Power Corporation (NPC) on the insufficiency of supply within the Mindanao Region during the term of the PSC;

Copies of the foregoing documents and/or information are attached to the Joint Application as annexes and made integral parts hereof:

“WHEREAS, Section 2 of Republic Act No. 9136, also known as the Electric Power Industry Reform Act of 2001 or EPIRA, declared as a policy of the State, among others, [to ensure the quality, reliability, security and affordability of the supply of electric power;” (first “whereas clause”, Department of Energy Circular No. 2003-12-11.Underscoring supplied.)

“WHEREAS, pursuant to Section 23 of EPIRA, all distribution utilities, as defined in the law, SHALL HAVE THE OBLIGATION TO SUPPLY ELECTRICITY IN THE LEAST COST MANNER TO ITS CAPTIVE MARKET subject to the collection of retail rate duly approved by the Energy Regulatory Commission;” (fifth “whereas clause”, ibid. The Joint Application is, likewise, consistent with Section 1 of the same Department Circular which declares as State policy, that:

“All distribution utilities must henceforth take cognizance and assume full responsibility to forecast, assure and contract for the supply of electric power in the respective franchise areas to meet their obligations as a distribution utility.” (Underscoring supplied.)

By way of emphasis, Resolution No. 21, Series of 2005 of the Honorable Commission dated 19 October 2005 had directed all Distribution Utilities (DUs) “to enter into future bilateral power supply contract with power producers to be subjected to a review by the Commission.” (Underscoring supplied.)

The PSC with SMCPC was made to ensure the continuous supply of power to LANECO and due to the former’s competitive pricing structure and other favorable terms of its contract, which will redound to the benefit of the latter and its end-consumers in terms of reliable and affordable power supply; Allegations in Support of the Confidential Treatment of Annexes “H”, and “I”, “I-1”, and “I-2”

Annex “H” contains the details of SMCPC’s power rate calculations and financial model as well as the manner by which these were derived. These information are proprietary in nature and should be protected as trade secrets as contemplated by law and jurisprudence. In the case of Air Philippines Corporation vs. Pennswell, Inc.2 , the Supreme Court defined a trade secret, as follows:

“A trade secret may consist of any formula, pattern, device, or compilation of information that: (1) is used in one’s business; and (2) gives the employer an opportunity to obtain an advantage over competitors who do not possess the information. Generally, a trade secret is a process or device intended for continuous use in the operation of the business, for example, a machine or formula, but can be a price list or catalogue or specialized customer list. It is indubitable that trade secrets constitute proprietary rights. The inventor, discoverer, or possessor of a trade secret or similar innovation has rights therein which may be treated as property, and ordinarily an injunction will be granted to prevent the disclosure of the trade secret by one who obtained the information “in confidence” or through a “confidential relationship”. American jurisprudence has utilized the following factors to determine if an information is a trade secret, to wit:

(1) the extent to which the information is known outside of the employer’s business;

(2) the extent to which the information is known by employees and others involved in the business;

(3) the extent of measures taken by the employer to guard the secrecy of the information;

(4) the value of the information to the employer and to competitors;

(5) the amount of effort or money expended by the company in developing the information; and

(6) the extent to which the information could be easily or readily obtained through an independent source.”(citations omitted, emphasis supplied)

The interest of the consuming public is sufficiently protected by the review and evaluation of the rates under the PSC by the Honorable Commission, without the need to disclose the contents of Annex “H”. The reasonableness and transparency of the prices of electricity is to be assured by the Honorable Commission through its own review and verification of SMCPC’s operating costs and expenses;

23. More importantly, SMCPC’s competitors, should they obtain the information in Annex “H”, will gain undue advantage thereon and have the opportunity to use the same in their operations. The negotiating power of SMCPC with parties it plans to contract with or who it is currently doing business with, will clearly be thwarted if it is compelled to disclose such information;

24. Further, Annexes “I”, “I-1”, and “I-2” pertain to the Supply, Construction, and Supervision Contracts, respectively, for the Power Plant. These contracts have counter-parties who are not parties to the Joint Application.

They contain highly technical designs, drawings and other information which are the intellectual property and trade secrets of the counter-parties, and therefore should not be disclosed to the public. LANECO and SMCPC, likewise, pray for the confidential treatment of Annexes “I”, “I-1”, and “I-2”, under the same premises above; and

Accordingly, LANECO and SMCPC submit one (1) copy each of Annexes “H”, “I”, “I-1”, and “I-2”, in a sealed envelope, with the said envelope and each page of the documents and/or information stamped with the word “Confidential”.

Prayer

WHEREFORE, the foregoing premises considered, the Joint Applicants Lanao del Norte Electric Cooperative, Incorporated (LANECO) and San Miguel Consolidated Power Corporation (SMCPC) most respectfully pray that after due notice and hearing, the Honorable Commission: 1. ISSUE an Order treating Annexes “H”, “I”, “I-1”, and “I-2”, and all the information contained therein as confidential, directing their non-disclosure to persons other than the officers and staff of the Honorable Commission, continuously protecting the said information from public disclosure by maintaining the same separate and apart from the records of the case, and ensuring that these are not divulged to unauthorized persons, pursuant to Rule 4 of its Rules of Practice and Procedure; and 2. ISSUE a Decision approving the Joint Application and the PSC between LANECO and SMCPC, and authorizing LANECO to charge and collect the fees therein from its member-consumers.

Other reliefs just and equitable under the premises are, likewise, prayed for.

Signed by Department of Environment and Natural Resources (DENR) Secretary Ramon J.P. Paje in October 2013, the treaty intends to reduce global mercury pollution by reducing mercury supply and trade, phasing out or phasing down mercurycontaining products and by controlling mercury emissions and releases.

While most agencies have provided the DENR with their respective certificates of concurrence, the DOE has yet to express its agreement with the move to get the treaty ratified, the group noted.

“DOE’s failure to issue its certificate of concurrence is slowing down DENR’s initiative to have the treaty ratified and subsequently concurred to by the Senate,” said Aileen Lucero, Coordinator, EcoWaste Coalition.

“Knowing DOE’s efforts to address mercury pollution, particularly from the improper disposal of busted fluorescent lamps, we see no reason for the department to hold back its support for the treaty ratification,” she said.

“The safe management of used fluorescent lamps is very important as these lamps can release significant amounts of mercury (including inhalable hazardous mercury vapor) when the bulb is broken, thrown in regular trash bins or disposed of in landfills or incinerators,” she pointed out.

The group noted that

the cloud seeding operations conducted by the Department of Agriculture.

“Surveillance flights made over Mt. Kitanglad over the weekend indicated there are no more signs of the grass fires.

The planes did not anymore spot smoke on the mountain range,” he said.

Velez said the grass fires in neighboring Mt. Kalatungan have been contained, too.

DOE issued a Joint Administrative Order JAO No. 2013-09-2001 with DENR establishing extended producer responsibility for mercury-containing lamps, as well as piloted a lamp waste recycling facility with mercury recovery.

The group clarified to both the DOE and the PLIA that the mercury treaty does not entirely ban mercurycontaining lighting products, but seeks to phase out and ban those containing excess mercury.

Specifically, Article 4 of the treaty provides for the phase-out by 2020 of the following lamp types above a certain limit of mercury: compact fluorescent lamps (CFL) equal to or less than 30 watts containing more than 5 mg mercury per bulb, linear fluorescent bulbs triband lamps less than 60 watts and containing greater than 5 mg mercury, halophosphate lamps less than 40 watts and containing greater than 10 mg mercury, high pressure mercury vapor lamps, mercury in a variety of cold cathode fluorescent lamps (CCFL) and external electrode fluorescent lamps (EEFL).

“As our country does not manufacture mercurycontaining lamps, but relies solely on imported finished products, we believe fluorescent lamp importers and distributors should have no problem asking their suppliers for products that meet the teary requirements,” Lucero said.

“The local lighting industry should have no difficulty sourcing compliant products since all wellmeaning lamp manufacturers who would like to stay in business are expected to follow the treaty provisions,” she said.

“In fact, leading lighting companies are not only reducing the mercury content in fluorescent lamps, but also expanding the production of energy- efficient lamps containing no mercury such as light-emitting diode (LED) lights,” she added.

Twenty-five countries have so far ratified the treaty, which requires at least 50 ratifications to enter into force.

He said the two-week cloud seeding operations by a Baron Beechcraft plane contracted by the DA was a big help in containing the fires in Mt. Kitanglad and Mt. Kalatungan.

“It rained continuously for two days and it was enough to put out the fire on Mt. Kitanglad and Mt. Kalatungan,” said Ma. Theresa Allen, provincial environment officer.

She said the rains came just in

time before the fires can threaten the habitats of the Philippine Eagle in Mt. Dulang-dulang (in the Kitanglad range) and Lantapan, Bukidnon.

Allen said they are still making an assessment if the two-week grass fires did any damage to the two mountains’ wild life.

According to a 1996 study made by the Nordic Agency for Development and Ecology, 168 species of birds are found in Mt.

Kitanglad. The group said 62 percent of the bird species are endemic to the area.

“Good thing that the fires only burned the buffer areas of Mt. Kitanglad. The fire did not reach the forest zones,” Allen said.

She said a total of 162 hectares of forest land was burned in Mt. Kitanglad and another 292 hectares in nearby Mt. Kalatungan. (MindaNews)

Uy, the erstwhile LP head in the first district of Cagayan de Oro and a reelectionist congressman, merely said that he was supporting Poe because he saw her sincerity in serving the Filipinos despite her being a neophyte politician.

In return, Poe thanked Uy for continuing to support her even during the 2013 senatorial election where the ex-Movie and Television Review and Classification Board (MTRCB) chair rose to winning despite being at the bottom of the surveys months before the polls.

For the past months, Uy had been supporting Roxas all along.

Uy’s change of mind was

probably galvanized after rumors surfaced that his congressional challenger, Councilor Lourdes Darimbang, was being supported

by Roxas. Roxas was the transportation secretary when Darimbang’s spouse Mandangan was – and is still until the present – the Land Transportation Franchising and Regulatory Board (LTFRB) 10 director.

Darimbang confirmed that today in a short Facebook message to this writer: “Yes Mark, Secretary Mar is supporting me.”

Earlier in the day, Poe was also endorsed by Misamis Oriental gubernatorial candidate and concurrent Villanueva Mayor Julio Uy. He is not a relative of the congressman from Cagayan de Oro City.

US Embassy donates barracks to Sulu police DAVAO City––The United States Embassy in Manila donated to the Philippine National Police (PNP) a newly-refurbished building at the Sulu Training Center in Camp Kasim, Jolo, Sulu.

The donated barracks, according to a press release from the US Embassy, can accommodate 36 students.

Its ground floor consists of a conference room, an International Criminal Investigative Training Assistance training office, and two private offices, while the top floor consists of “both male and female barracks areas.”

The U.S. Pacific Command’s Joint Interagency Task Force West started construction of the barracks in early 2015 and completed it on April 4, 2016 at a cost of P16.9 million ($375,000).

The building will serve as barracks for PNP officers who are receiving U.S.-sponsored training at Camp Kasim and in Jolo.

PNP personnel from all over the island Sulu will be able to utilize the barracks during training sessions.
