Changes and Developments

T

he past few months have seen some interesting developments within the asbestos removal industry.

Detailed guidance has been issued by the HSE with regards to Plans of Work, titled ‘Asbestos Regulation 7 Plans of Work – purpose and core principles.’ The status of the document is that it is an Open Circular, this category of document makes available the current internal instructions and guidance that HSE uses to carry out its core operational work of inspecting, investigating, permissioning and enforcing. Therefore it constitutes transparent instructions to regulators.

The Plans of Work guidance makes it clear that ‘generic information about frequently used company procedures will not need to be in the site-specific plan’ and that ‘the standard procedures on which it is based need to be available on-site’. At the recent round of regional meetings, I was informed that some HSE inspectors are still insisting that generic standard procedures are included within the Plan of Work, hopefully this new guidance will help alleviate this problem.

This guidance also addresses the issue of the client requiring generic information to be included within the Plan of Work which often makes the plan overlong, with crucial detail lost among pages of lengthy descriptions.

Clients should take note of this guidance and consider what Licensed Contractors are trying to achieve with regards to a Plan of Work and assist them in producing a Plan of Work which is fit-for-purpose. Similarly, contractors should point to the requirements of the guidance to clients when they are insisting that unnecessary generic information be included in the plan (reference page 9).

At the start of November, Licensed Contractors were informed of changes to the asbestos licensing procedure. Renewals of all asbestos licences which expire from April 1st 2019 onwards will be made electronically and the evidence to support those applications will be emailed to the HSE. The HSE Asbestos Licensing Unit will assess applications using the evidence sent to ALU by the applicant and HSE’s experience of the applicant’s performance from site inspections. HSE have said that the evidence that needs to be provided will not really change from what is provided during assessment interviews now.

It is how the evidence gets to HSE, and the fact that it will be assessed by ALU staff in the first instance, with the possibility of a licensing decision being made at that stage, that are new (reference page 7).

This was discussed at the recent ARCA regional meetings and members expressed concern that this new process may lead to a lowering of standards with regards to HSE acceptance criteria for the granting of a licence. Members felt that the absence of the mandatory ‘face to face’ interview would make it difficult for HSE to adequately assess the leadership and management aspects which are so crucial to the company’s performance.

HSE are looking at having a joint conversation with ARCA to explain some of the thoughts behind the new process and are currently discussing how this would best be arranged.

I am pleased to report that the Asbestos Liaison Group is being revised. Going forward it will be known as the Asbestos Leadership Council (ALC), and as part of the changes, new sub-groups have been established including a sub-group dedicated to Licensed Asbestos, which will enable the representatives of asbestos licence holders to meet with the ALU. The aims of this sub-group are consistency of benchmark standards and action in relation to these, any associated work practices that are of note and need addressing, sharing information about what is being found, both good and bad practice. There will also be a sub-group for analysts and surveyors to discuss issues within their industry. I look forward to reporting on the outcomes and outputs from these subgroups in future editions of ARCA News and at the next round of ARCA regional meetings (dates are on page 8).

ARCA Standardisation Meetings

£1 Billion Asbestos Removal Industry in the UK “I

f there’s one question I have been asked over the last 18 years, more than any other, it is ‘What is the size of the asbestos removal industry?’ My answer has always been based on a gut feeling or a finger in the air,” stated Steve Sadley, Chief Executive of ARCA. “Now, for the first time, I am able to answer that question, based on more solid information.

That is, data provided by ARCA asbestos removal contractor members on their annual questionnaire (ARCA Annual Declaration).

This data covers the period July 1st 2017 to June 30th 2018 and was provided by over 40% of the industry.

Therefore, using the data provided by 40% of the industry, it can be extrapolated to give a

reasonable estimate of the industry as a whole. w Estimated number of asbestos operatives employed by Licensed Asbestos Removal Companies - 5,908 w Estimated number of asbestos supervisors employed by Licensed Asbestos Removal Companies – 3,281 w Estimated number of CSCS cards issued to asbestos operatives and supervisors – 7,167 w Estimated number of staff employed by companies holding an asbestos removal licence - 25,000 Also, we used the data to estimate the total turnover for Licensed Asbestos Removal Contractors on asbestos works in the UK for the last financial year. The answer was £1,053,980,000”

ARCA staff study for NEBOSH Diploma A

RCA managers, trainers and auditors, a group of 8, have begun studying for the NEBOSH National Diploma in Occupational Health and Safety. They will be studying for this diploma over two years, through distance learning.

NEBOSH Diplomas are globally recognised qualifications, with the National Diploma the flagship NEBOSH award. This diploma provides core health and safety knowledge, which, combined with understanding and appropriate application, underpins the competent performance of an Occupational Health and Safety Practitioner. The qualification covers four units; managing health and safety, hazardous agents in the workplace, workplace and work equipment safety and the application of health and safety management in the workplace.

“Here at ARCA we are committed to supporting continuous professional development, and undertaking this diploma will expand our knowledge and understanding of health and safety in its widest sense,” comments Steve Sadley, Chief Executive of ARCA. “Gaining this qualification will mean a lot of studying, so I’m delighted to see the staff embracing this opportunity.”

“To gain a broader understanding of health and safety, not just the asbestos related aspects I know from working in the industry, is a great opportunity for me,” stated Duncan Williams, ARCA Auditor. “There is a lot of distance studying to undertake, however, we meet once a month for webinars and discussions, which helps us all in our learning and also makes you feel less ‘distant’.”

The ARCA team holds regular standardisation meetings, where managers, trainers and auditors, discuss and review their findings and feedback.

These discussions support standardisation across the organisation; increasing efficiencies and the knowledge of the team, as well as facilitating development, such as, refresher training course content.

Experienced Worker CSCS cards Don’t forget only valid for 1 year!

If you have operatives and/or supervisors with an experienced worker CSCS card they only have one-year to gain an NVQ. This may sound like a long time, however it’s best to book them onto the NVQ assessment process sooner rather than later.

The sooner you do, the more time ARCA has to work with you to plan the site(s) and the assessment date(s), and then produce the candidates’ portfolios of evidence for verification.

By doing this ARCA can support candidates to gain an NVQ within the one-year limit, enabling them to apply for a skilled worker card.

ARCA Annual General Meeting 2018 T

he 33rd ARCA Annual General Meeting (AGM) was held at Lords Cricket Ground, London on the 5th October.

The Chairman, Grant Beglan, welcomed everyone to the AGM and thanked Daniel Barrowcliffe, a Higher Scientist from the HSL’s Fibres and Minerals Team, for kindly speaking at the meeting.

Daniel’s presentation provided an update on the HSL’s Science Division research into exposures and work practices in the licensed asbestos removal industry. The research was being conducted to assess the effectiveness of control measures during work with asbestos.

Daniel explained that as part of the research, novel new sampling processes were being utilised, including saliva sampling for the presence of asbestos fibres and in-mask sampling to determine the effectiveness of the Respiratory Protective Equipment (RPE).

Following on the Chairman introduced the Associations’ Chief Executive, ARCA Staff Members and Committee Chairmen to report on the activities of the Association over the past 12 months and outline the plans for the future.

Members present heard that the HSE would be producing guidance on Plans of Work, as a result of the findings of the Post Implementation Review of the Control of Asbestos Regulations 2012 and that would be available by October 2018 (reference page 9). Members also heard that the Asbestos Liaison Group is being refocussed; as the aims and objectives of the group had been re-evaluated, and it will be relaunched, with sub-group devoted to the licensed asbestos industry. This will allow the representatives of asbestos licence holders to meet with the HSE Asbestos Licensing Unit and share information, with the overall aim of maintaining high standards of compliance within the asbestos removal industry.

In addition, for ATaC members, there will also be a sub-group devoted to analysts and surveyors with the same aim of maintaining high standards of compliance within that sector of the industry.

Members also heard that ARCA has continued to develop the routes to CSCS cards, providing a greater range of choice and options for members to achieve the qualifications necessary, such as the Experienced Worker route to the Operative

NVQ, and the first NVQ dedicated to Asbestos Removal Supervisors.

Members were informed that this year the Association had been raising awareness of the ARCA Site Audit Scheme, via speaking slots at exhibitions and events, through social media and ARCA News. ARCA believe that the Site Audit Scheme is something for both ARCA and its members to be extremely proud of.

There is no other industry auditing scheme that we know of that genuinely audits all of its members at least twice a year without their knowledge of when or where those audits will take place. ARCA is communicating this message to clients and reinforcing the fact that ARCA membership is more than a logo. That is, it has to be earned and maintained by demonstrating professionalism, compliance and high standards of work. Steve Sadley stated that it was a credit to ARCA members that they were willing to subject themselves to this level of scrutiny and that they produce the consistently high level of performance that we see.

ATaC members were informed that work continues on the Trailblazer Apprenticeship Scheme for Analysts and Surveyors. The Standard and the End Point Assessment are complete and approved. A delivery mechanism now needs to be put in place, which requires ARCA and ATaC to be registered with the Skills Funding Agency as an Approved Training Provider.

Finally, the Chairman, Grant Beglan, handed over the Chairmanship of the Association to Jason Davy of Rhodar Ltd. Jason closed the meeting with his incoming Chairman’s speech, stating that his key goals for the Association, during his two years as Chairman, were to continue to improve standards within the Association and the industry, including delivering even better training and to support better performing labour.

Following the meeting members enjoyed a 3-course silver service lunch and were entertained by Iain Lee, Talk Radio presenter and star of ‘I’m a Celebrity Get Me Out Of Here’ 2017.

The ARCA AGM is always held on the first Friday of October, so next year that will be the 4th October, and will be held at Lords Cricket Ground, London. Please put this date in your diary now.

ARCA announce winners of Gold Site Audit Award 2018 A

t the Association’s AGM in October, ARCA announced the twenty-one member companies who achieved the Gold Site Audit Award for 2018 The award has been designed to acknowledge consistent performance, demonstrated over a sustained time period.

So to gain this award, Asbestos Removal Contractor members, needed to achieve Grades A-C, with an average of at least a Grade B, in six consecutive audits (that is across a 3-year period ending 30th June 2018).

Of the twenty-one companies achieving the award, ten have retained the award from last year, with eleven companies being newcomers.

“It is extremely positive to see an increase in the number of companies gaining this

award compared to last year, especially as ARCA introduced unannounced audits in January 2017. Meaning our members had no idea where or when an ARCA auditor was going to assess their work,” said Geoff Silver the ARCA Membership Compliance Manager.

“Congratulations to all the winners. This award acknowledges the work that has been put into their participation in the ARCA Site Audit Accreditation Scheme (SAAS).”

Changes to Asbestos Licensing Procedure A

t the start of November 2018, HSE announced that from 1 December 2018 HSE asbestos licence renewal applications will be made electronically and the evidence to support those applications will be emailed (and in later implementation stages uploaded) to HSE at the same time. There will also be a new, more detailed, application form.

ALU will assess applications using w the supporting evidence sent to ALU by the applicant; along with w HSE’s experience of the applicant’s performance from site inspections.

A licensing decision will be made based on that information. The outcomes of that assessment could be one of the following: 1. HSE grants a licence without further

intervention where there is enough evidence to support this, and where significant matters arising during the past licence period and past assessments have been effectively addressed; or 2. If there is insufficient evidence, but in a limited number of areas, HSE will contact the applicant and carry out a targeted assessment meeting. The assessment meeting will focus on the areas where there is not enough information or evidence and will not be as extensive as current assessment interviews. All the information HSE has after that meeting will be used to make a final decision on the licence application; or 3. If there is clearly insufficient evidence

sent electronically the application may be refused without an assessment meeting.

The change will start on 1 December 2018 for those licences that expire from 1 April 2019 onwards. ALU will continue to write to licensees four months before the expiry date, as it currently does, and invite a renewal application. At that point applicants will be given details and guidance on what to do.

This new approach will be evaluated as it progresses, and applicants will be informed of any changes prior to application.

New applicants will not be affected at this stage of the phased implementation of this new system.

HSE Guidance on

Plans of Work At the end of October 2018, HSE published guidance on Plans of Work, in response to a recommendation made by the report of the 2017 Post Implementation Review of the Control of Asbestos Regulations 2012.

This guidance will assist HSE inspectors to assess the suitability of Plans of Work (PoWs) and aid consistency, as well as being available for licensed contractors’ staff. The guidance can be read alongside ALG memo 04/12, issued under the umbrella of the ALG industry forum. The contents will eventually be included in the Licensed Contractors’ Guide (HSG 247) when revised.

Guidance Points 1. There are many ways to create a suitable PoW and comply with Regulation 7 of the Control of Asbestos Regulations 2012 (CAR 2012).

Reg. 7 describes specific absolute requirements for PoWs, these should be met. There is more detail in the Approved Code of Practice and guidance which accompanies Reg. 7, contained in “Managing and working with asbestos” (L143).

2. A PoW should be a practical and useful document describing a safe working method for staff to follow. It should include details of the work, and the appropriate actions to control risk and prevent harm. These are the core principles which underpin this guidance.

3. It is the duty of the employer to produce a suitable PoW. It must be ready at the time of notification. This is one of the standing licence conditions. It is not acceptable to produce an outline plan at the time of notification and develop the detail as the work progresses. The work must be planned before it starts. That is not to say that changes can’t be made to the written plan where that is unavoidable, but significant changes to the main parts of a PoW should be the exception rather than the rule.

4. A PoW’s fitness for purpose can be measured in its use on the job, and the licensed contractor should be able to demonstrate that with thorough site checks and audits. The PoW is not only there to direct and support the site team, it must also be available for others including: w the analyst who checks the PoW in detail against their findings on site before the 4-stage clearance process; w managers, clients and auditors; w HSE inspectors; so that they can check how effective it is in describing a safe method for the job and the performance of the site team.

6. HSE inspectors have reported that PoWs are often overlong, with crucial detail lost among pages of lengthy generic descriptions.

Companies tell HSE that some of the information which makes PoWs so long is put in at the request of the client. It remains HSE’s position that generic information about frequently used company procedures (such as standard ways of bagging waste, standard enclosure construction materials etc) will not need to be in the site-specific plan. Keeping generic information out of the site-specific plan means the standard procedures on which it is based need to be available on site in a readily accessible and readable format, be that electronic or hard copy.

7. It should be possible to strike a balance between producing a PoW that is complete but manageable in length. Diagrams, photographs and flowcharts can all help make PoWs less wordy. In all cases HSE would favour plans that are user friendly, easy to read and straightforward to follow.

8. Many licensed contractors already have formats and styles which are suitable and work for them. For those who need more guidance on how to turn their planning thoughts into a suitable digital or hard copy PoW, the following checklists, prompt questions and narrative examples are designed to help. They are not exhaustive lists which cover every possible situation.

9. The checklists, prompt questions and examples below (appendices) are intended as suggestions to assist with planning the work. They are grouped together as topics for consideration by those who produce PoWs. There is a brief explanation of what each topic means and intends to cover. Some of these suggestions will be relevant to a specific project, others will not. For some topics, narrative examples have been added to encourage users of this guidance to refresh how they think about PoWs.

Appendices When carrying out an assessment, inspectors are requested to refer to appendices 1 to 7. These appendices are also intended as suggestions to assist with planning the work.

Inspectors and other regulators, especially in a strict licensing regime, will also wish to use the PoW as a tool to measure how effective a business is in managing work with asbestos. A suitable PoW should be created in consultation with the client with the aim of making it less vulnerable to unrealistic constraints or time pressures placed on the licensed contractor by the client or other parties on site.

5. There is a range of approaches to producing PoWs - from making them fully self-contained to leaving out all information that is already covered elsewhere and focussing on what is different or unusual about this job.

Asbestos-related diseases The Health and Safety Executive (HSE) has issued annual statistics (data up to December 2017) on asbestos-related diseases in Great Britain.

The report, published 31 October 2018, covers asbestos-related cancers and non-malignant asbestos-related disease.

Inhalation of asbestos fibres can cause a number of serious diseases most of which affect the lungs or pleura (the external lining of the lung). These include a number of forms of cancers such as mesothelioma and lung cancer, and other serious lung diseases such as asbestosis and pleural thickening.

All asbestos-related diseases typically take many years to develop so current statistics reflect the legacy of past working conditions.

All of these diseases have a long latency, meaning it takes a long time – typically decades – for symptoms to occur following exposure to asbestos. However, for cancers such as mesothelioma and lung cancer, cases are often rapidly fatal following disease onset, while conditions such as asbestosis may progress over time to seriously affect normal daily activity and lead to complications which can be fatal.

Widespread use of asbestos containing products in the past, particularly in the post-WWII building industry, led to a large increase in asbestos-related disease in Great Britain over the last few decades.

in Great Britain 2018 Asbestos-related cancer - Mesothelioma Mesothelioma is a form of cancer that principally affects the pleura (the external lining of the lung) and the peritoneum (the lining of the lower digestive tract). It takes many years to develop following the inhalation of asbestos fibres. Cases are often diagnosed at an advanced stage as symptoms are typically non-specific and appear late in the development of the disease. It is almost always fatal, and often within twelve months of symptom onset.

Mesothelioma has such a strong relationship with asbestos, that annual cases give a particularly clear view of the effect of past exposures. The disease is usually rapidly fatal following disease onset, the number of annual deaths closely approximates to the annual number of new cases (i.e. the annual disease incidence).

The latest information shows: w There were 2,595 mesothelioma deaths in Great Britain in 2016, broadly similar to the previous four years. w The latest projections suggest that there will continue to be around 2,500 deaths per year for the rest of this current decade before annual numbers begin to decline. w Annual deaths are continuing to increase among those aged 75 years or over, but are reducing among those aged below 70 years. w In 2016 there were 2,197 male deaths and 398 female deaths, broadly similar to the annual numbers among males and females in the previous four years. w There were 2,170 new cases of mesothelioma assessed for Industrial Injuries Disablement Benefit (IIDB) in 2016 of which 240 were female, compared with 2,130 in 2015 of which 220 were female. w Men who worked in the building industry when asbestos was used extensively are now among those most at risk of mesothelioma.

Asbestos-related lung cancer Asbestos is one of the most common causes of lung cancer after tobacco smoking. Lung cancer usually has no specific clinical signs associated with particular causes and so it is very difficult to be sure about the causes of individual cases. However, the overall proportion of annual deaths that are attributable to past asbestos exposures can be estimated from epidemiological information.

Lung cancer is still typically fatal within a few years of diagnosis and so, as with the mesothelioma, the number of annual deaths is similar to the annual incidence of new cases. w Research suggests there are currently about as many lung cancer deaths attributed to past asbestos exposure each year in Great Britain as there are mesothelioma deaths. There is considerable uncertainty associated with this estimate. w This implies there are currently around 2,500 asbestos-related lung cancer deaths each year. w Estimation of attributable deaths is complicated by the fact that asbestos and smoking act together to increase the risk of lung cancer. This means that many cases of lung cancer will be caused by both smoking and asbestos rather than by one or other of these exposures.

Selection of PPE

for work with Asbestos

T

he selection and use of protective clothing i.e. coveralls, footwear etc. when working with asbestos, is vital to the health and safety of the worker. Therefore, this article identifies good practices and provides practical guidance on selection, care and maintenance of PPE against risks from working with asbestos.

Due to the risks of asbestos removal work, employers and employees must ensure that they comply with both requirements of the Control of Asbestos Regulations 2012 (CAR 2012) and the Personal Protective Equipment at Work Regulations 1992.

Supply of Protective Clothing PPE must be supplied by the employer, free of charge, when an employee is expected to be exposed to a risk which cannot be controlled by any other means. Where staff work under the control of an asbestos licence holder, they are considered to be employees.

This is covered in CAR 2012 and the Personal Protective Equipment at Work Regulations 1992.

These regulations require that: w PPE must be appropriate to the risks and not increase the risk. w PPE must fit the wearer. w When wearing two or more items of protective equipment, these items must be compatible. w When employees are required to wear PPE, they must be trained in its use, care and maintenance. w PPE is required to be ‘CE’ marked as this signifies that the PPE satisfies certain basic safety requirements and, in most cases, will have been type tested and certified by an independent body.

w All PPE used at work must be certified with the letters CE followed by the Category of Approval.

Selection of coveralls for work with asbestos ‘Managing and working with asbestos Control of Asbestos Regulations 2012 Approved Code of Practice and guidance’ L143 requires that the selection criteria for coveralls for work with asbestos should include the following: w They should fit the wearer w They should be comfortable w They should be one piece including the hood w They should allow for the effects of physical strain w The cuffs, wrists and hood should be elasticated w They should have no pockets w They should be easy to decontaminate w They should resist penetration by fibres Coveralls for use when working with asbestos meet most of these criteria; however, the subjects of durability and fibre penetration of coveralls continue to be an issue for contractors.

Most contractors who work with asbestos use disposable coveralls, both inside the enclosure, and when in transit. Disposable coveralls are not durable but may meet fibre penetration standards.

Non-disposable coveralls are more durable but do not meet fibre penetration standards, they also require specialist handling, decontamination and laundering. It should be noted that all clothing worn within an asbestos contaminated area must be laundered at a specialist laundry or disposed of as asbestos waste.

Durability The durability of a coverall depends upon three factors: w Size – coveralls often split because they are too small w Fabric strength – disposable coverall fabrics are not robust w Seam strength – seams which are single sewn will pull apart easier. Under stress it will be possible to see daylight through the seam. Seams should be over sewn to provide additional strength.

Fibre Penetration While coveralls reduce the amount of contamination to asbestos removal operatives, they do not totally prevent fibre penetration. Therefore, operatives undertake full decontamination at the end of each shift.

PPE is required to meet common standards of quality and performance. Therefore, must comply, and be CE marked, to indicate conformity with health, safety and environmental protection standards.

The following CE standards currently apply: w Category 1: ‘Simple Products’ – which are not suitable for protection against any hazard w Category 2: ‘Intermediate Products’ – which fall into neither category 1 or 3 w Category 3: ‘Complex Products’ – which are worn in order to provide protection against any hazard which may be life threatening Therefore, when working with asbestos, coveralls must meet Category 3 standard.

guidance prevent the ingress of dusts, liquids or vapours w Type 5 EN ISO 13982 -1 – protective clothing for use against solid particulate chemicals w Type 6 EN 13034 – reduced spray suits, suitable for protection against hazardous sprays and splashes as find droplet, non-directional sprays When using overalls complying with both Types 5 and 6 consideration must be given to determine that they are ‘breathable’ and that the Type 6 property has not compromised their ‘breathability’. Many brands of ‘Type 6’ coverall achieve their splash resistance by increasing the “plastic content” of the fabric, reducing their ventilation ability.

Coveralls for work with asbestos both inside enclosures and when transiting should exhibit properties consistent with Class 3, Type 5, in order to minimise body contamination leading to a more effective decontamination on leaving the enclosure.

ARCA recommended guidance is that transit overalls should be used on a single use.

Selection of underclothes and footwear Disposable underclothes should be worn to allow for the effects of chilling in low

temperatures. All disposable underclothes should be disposed of as contaminated waste in a manner similar to the coveralls.

What type of footwear should be worn in a particular situation? This is determined by the employer who should carry out a risk assessment to determine the type of footwear to be used in a given situation.

When removing asbestos inside enclosures, steel toe capped wellington boots are the preferred footwear, as they can easily be decontaminated. Lace up boots, with the laces taped up, are not recommended.

When transiting between the airlock of the asbestos enclosure and the hygiene unit, footwear should be easy to decontaminate.

Rubber slip-ons are recommended, however, the specific environment must be assessed, considering issues such as work at height or slip hazards, for example.

Asbestos in soil and construction and demolition materials:

what the asbestos removal industry needs to know

Management of asbestos contamination in the ground poses quite different challenges compared to ‘conventional’ approaches taken to the management and removal of asbestos in and from buildings.

The ‘asbestos problem’ mainly arises during the development process; remediation of asbestoscontaminated sites is largely driven by the desire to bring brownfield land back into beneficial use.

Critical to this process is the reuse of soil that may be, to an ‘acceptable degree’, contaminated. Asbestos is just one of many soil contaminants that must be addressed by developers and remediation professionals. For LARCs, when it comes to remediating such sites, it is important to understand that it is not always a straightforward ‘asbestos removal and waste disposal’ problem.

CAR-SOIL1 was published by CL:AIRE 2 ½ years ago, the culmination of a massive effort by the JIWG driven by the need to provide industry with a practical, pragmatic and risk-based approach to addressing the ‘asbestos in soils’ problem.

CAR-SOIL training course delegate Far from being the ‘opinion’ of the author, CAR-SOIL is acknowledged as being the definitive and authoritative guide on the interpretation of CAR 2012 and ACoP and guidance L143 as applied to working on asbestos-contaminated ground. 18 months in the making, the CAR-SOIL guidance was developed in consultation with and with contributions from representatives of the HSE, including the ALU, who provided considerable support. Extensively reviewed by HSEs lawyers and passed by

the Publications Governance Group, on publication, CAR-SOIL was issued to HSE Construction Division for use in the field by Principal Inspectors; it applies throughout the UK. Along with environmental regulators and many brownfield and asbestos industry stakeholders, as members of the JIWG, ARCA and ATaC reviewed and approved the draft guidance.

The CAR-SOIL guidance and associated risk management tools2 have become the go-to resource for practitioners in the geoenvironmental and asbestos sectors, in planning and executing works to identify and manage asbestos contamination in the ground, as well as construction sector planners and designers when considering the implications for development activities and risk that residual asbestos in the ground may pose to groundworkers.

CAR-SOIL allows a certain degree of pragmatism and flexibility, for example when determining whether work on certain types of loose fibrous asbestos and asbestos board is non-licensable, whilst maintaining compliance with CAR 2012 and being protective of health and safety. This takes account of the particular constraints involved in confirming the type of Asbestos Containing Materials (ACMs) present in the ground.

land remediation/asbestos Risk Functions Five key factors are taken into account when we consider the risks that asbestoscontaminated ground materials might pose when disturbed during development.

1. ACMs/fibres in many ground materials are generally held to pose a significantly lower degree of potential risk compared to similar materials when encountered in buildings.

2. Matrix effects can often moderate fibre release; wet clayey soils bind ACMs/fibres, though crushed concrete/ aggregates may enhance the risk.

3. Moisture content of unexcavated ground materials is generally high, as a starting point.

4. The risks to workers carrying out remediation activities are moderated by significant dispersion and dilution factors.

5. The potential risks to others in proximity to remediation activities are moderated primarily by appropriate controls to prevent/minimise exposure and prevent spread.

Determination of Licensing Status of Remedial Activities Regulation 2 CAR 2012 is clear and CARSOIL guidance is consistent with this; work on clearly identifiable original form (CIOF) coatings, insulation and AIB materials is licensable, but in the case of the latter two, only if not Short Duration Work.

Likewise, work on any materials that is liable to or will exceed the Control Limit or the Short-Term Exposure Limit (not Sporadic and Low Intensity) will always be licensable. With asbestos in the ground, however, there is a large body of evidence that supports the baseline assessment that exceedances of these two limits is not (but sometimes may be) likely.

Due to the inherent difficulty in confirming the type of ACMs present in the ground, CAR-SOIL provides for two alternative descriptions for ACMs that may no longer be recognisable as CIOF products; loose fibrous asbestos debris and sheeting/ board debris.

For consistency, these alternative descriptors are also used in the Blue Book Method3 for the quantification of asbestos. If materials cannot be readily

identified in the field as coatings, insulation or AIB, e.g. where there is no contextual evidence to support the use of the CIOF descriptions, we can use, with justification, the alternative descriptors. What that means in practice is that work with certain materials that ordinarily, in buildings at least, would be licensable on account of their description, will not necessarily be licensable but will be Non-Licensed Work (NLW). In some cases, the work will become notifiable.

This is supported by ALG Appendix 2/174, although a word of caution is advised. The decision flow chart in this document does not present the full agreed framework for deciding if NLW is notifiable or not, whereas CAR-SOIL does. If we have less than ‘moderate’ levels of damaged ACMs/free fibres, work is not notifiable.

Use of Enclosures The default position in CAR-SOIL is that enclosures are not ‘reasonably practicable’ and so not generally required for external licensable (or other) work. Reinforced enclosures outdoors may be necessary during remediation, though this is most

likely when CIOF friable ACMs such as AIB or insulation are encountered, for example below a floor slab or in a duct than when similar material is encountered lying on the surface or dispersed throughout the soil.

Assessment of Work The JIWG Work Category/Receptor Risk Ranking Decision Support Tools (DSTs) provide a robust framework for determining licensing status and certain minimum control measures that can feed into the Risk Assessment and Plan of Work. Consideration of adjacent workers/ members of the public off-site can be made using the Receptor Risk Ranking DST, which may inform a consideration of increasing the minimum indicative level of

controls indicated by the Work Category DST. Together, the DSTs provide a robust assessment framework that uses either real data or assumed (carefully considered and justified) information, underpinned by high quality accredited soils analysis as per the Blue Book Method.

Business Risks for LARCs LARCs need to be fully aware of the CAR-SOIL framework, embrace it wholeheartedly in the spirit in which it was produced and ensure that they factor this in to the costing and planning of work.

In recent months, the author has been made aware of several cases where LARCs have not quite got it right.

Proposing the use of a reinforced enclosure for the remediation of soil impacted by small amounts of AIB and asbestos cement is not justifiable. Likewise, if a laboratory identifies and quantifies AIB as being present on a site and the work is not Short Duration Work, that work is licensable and requires 14-day prenotification as standard.

Getting it ‘not quite right’, or patently wrong, does not just open up possibilities for HSE enforcement action; in the extreme, it could result in potential client legal action for damages where the industry-standard guidance for soils has not been used and excessive costs have been incurred.

C

ontinuing professional development, or CPD, is the ongoing process of developing, maintaining and documenting professional skills.

These skills may be gained formally, through training courses, or informally such as on the job or professional/association meetings.

Some professions use the term ‘continuing professional development’ formally, and require a certain amount of development activity to be carried out and documented each year as a condition of maintaining membership of, or registration with, a professional body, or a licence to operate in that field.

In other areas, CPD is used more informally.

A commitment to learning and improving is, however, generally expected of anyone in a professional capacity.

The Continuing Professional Development Cycle The process of CPD is designed to help you identify and act on your own development needs.

The Continuous Professional Development Cycle shows that professional development is, like much other learning, best thought of as a circular series of activities.

The process moves from identifying your development needs through planning and then carrying out your learning activities, to reflecting on your learning, and then applying it and sharing it with others.

Continuing Professional Development Perhaps the most important thing about CPD is that it is personal.

Each individual is expected to identify their own needs, organise their own training, and learn for themselves. Part of being a professional is taking responsibility for your own skills and recognising when they need to improve.

1. Identifying Your Needs There are a number of ways in which you can identify development needs.

For example, you can carry out a Training Needs Analysis. You may receive feedback from colleagues or your line manager about an area in which you are weaker. Alternatively, you may have an interest in a particular area and want to develop your knowledge.

Once you have identified your key areas for development, you then need to plan your activities.

2. Planning and Carrying Out Development Activities Development activities may be either: w Formal, such as training courses or particular qualifications. These are often, though not always, provided by an external provider, and may carry a cost. Your employer may have a limit on what they are prepared to pay, so you may need to consider self-funding or alternatives such as online resources that are cheaper or even free. w Informal learning, including side-by-side learning, video training, shadowing, mentoring, coaching or reading on the subject.

There is a growing recognition that continuing professional development is both essential and potentially expensive. Especially in developing

countries, professionals are using the internet to share teaching content for free, or at very low cost. You may find that an imaginative approach to seeking out development activities pays off.

3. Reflecting on Your Learning Reflecting on what you have learned is a vital part of continuing professional development.

Learning does not emerge only from activities that you designated as ‘development’, and you may find that you are learning at least as much from your day-to-day activities.

It is a good idea to keep a ‘learning log’ or diary. Make a habit of writing in it at least once a week, if not each day (if you leave it any longer, you probably won’t remember). For each event or activity that you find useful, make a note of: The situation; w What you learned; w What you will do differently as a result. w This diary can be used to assess your progress against your development goals.

For any formal or informal but designated development activity, you should record the activity, what you found useful or not useful about it, and what you have learned. In each case, make sure that you are clear about how it will change what you do in future (how you apply your learning).

4. Applying Your Learning Going on training courses or watching videos is only the start. You then have to apply what you have learned to your own job. This can be quite a clumsy process, especially at first.

The competence theory of learning sets out that we move through four stages when we learn:

1. Unconscious incompetence – not knowing what we don’t know; 2. Conscious incompetence – knowing where we need to develop and watching other people do it, but still unable to do it ourselves with any skill; 3. Unconscious competence – being able to do something almost instinctively, without needing to focus on it.

After each stage, you grow in knowledge, experience and application of skills.

When you have done some training or other development activity, you will probably be somewhere between conscious incompetence and conscious competence, depending on how much you have been able to practise.

You therefore need to spend time applying your learning and practising to move to a stage of unconscious competence.

Some commentators add a fifth stage to the competence cycle – being able to teach others.

It is certainly true that being able to articulate and share your learning is an important part of making sure that you have fully internalised it.

It is a good idea to get into the habit of discussing your learning with your colleagues on a regular basis. Sharing each other’s learning can be a really good development tool, and can help you identify new areas for development, or ideas for other development activities, as well as helping to refine what you have learnt in your mind.

Recording Your Development An important part of continuing professional development is being able to demonstrate it, especially if your membership of a professional body depends on it.

You should therefore keep a folder or portfolio of all your development activities, drawing on your learning diary. The aim of this is to be able to show how your skills and knowledge have developed over a period.

You should therefore: w Keep a note of your development needs and goals, and make a regular (quarterly, sixmonthly or annual) assessment of your progress against them; w Record any training courses attended, with a copy of any certificates or qualifications obtained. Keep a record of the date, provider,

aims of the training, and your thoughts on what you learned from it; w Make a note of any shadowing, videoassisted training or similar. In each case, record the provider, the aims, and your thoughts about what you learned; w For any coaching or mentoring sessions, make a note of the date, the person you were with, what you discussed, and what you intend to do differently as a result; w For any reading and other informal development that you do, make a note of the book or website, and what you have learned and will do differently as a result; w If you are involved in any critical incidents, or make particular mistakes from which you learn, record the details of the incident, what you learned, and what you will do differently as a result.

And finally…

Continuing professional development is an ongoing process, as well as a cycle. You are likely to continue to learn throughout your professional life.

It is therefore a good idea to develop a process for it that works for you at an early stage of your career.

Still today it is the greatest cause of work-related deaths in the UK, with currently approx. 5,000 asbestos related cancer deaths per year.

wners and managers of properties constructed prior to the year 2000 need to manage the risks from asbestos, as they are responsible for ensuring that employees and non-employees are not exposed to health and safety risks as a result of the presence of asbestos.

In the last issue of ARCA News we covered location, assessing and managing asbestos containing materials.

If the condition of asbestos containing materials (ACMs) means it needs to be removed, or the building is being renovated/demolished so therefore the ACMs need to be removed prior to work starting, there are legal responsibilities on the clients to manage the project and appoint a competent contractor. This is what we will cover in this article.

Client duty to manage a project Clients have explicit responsibilities on managing construction projects under the Construction (Design and Management) Regulations 2015 (CDM 2015). As they are at the head of the procurement chain, the law requires that clients make suitable arrangements for managing a project, and maintain and review these arrangements throughout the project, to ensure health and safety risks are managed appropriately.

Clients do not need to be ‘experts’ in either construction work or asbestos work, and do not need to directly manage or supervise the work themselves. However, they are responsible for ensuring appropriate arrangements are in place to manage and organise projects during both the ‘pre-construction’ and ‘construction’ phases of the project. This means appointing suitably competent people and providing them with sufficient information, time and resources to do the job properly.

If asbestos removal is required, the client needs to appoint a competent asbestos removal contractor.

Therefore, they need to make reasonable enquiries to satisfy themselves that contractors are appropriately resourced and competent for the work.

managing asbestos will be assessing their performance. Therefore, being unannounced, ARCA site audits are an even stronger system of reassurance for all parties, including clients.

Asbestos removal work Once a contractor is appointed, the client will then need to provide the contractor with sufficient information, time and resources to do the job properly. For example, an asbestos removal contractor will need appropriate preconstruction information in order to prepare a suitable Plan of Work, and contractors need time (and access) to assess the premises properly and discuss key site information with the client. Clients’ decisions, actions and inaction have an enormous impact on how work can be delivered.

The contractor will need to submit notification of work to the HSE two weeks prior to work commencing. That is, the work must be planned before it starts.

A Plan of Work How can clients reassure themselves of competency?

Firstly, does the type of asbestos containing material require a contractor to have a licence from the Health & Safety Executive (HSE) to remove this material under controlled conditions? A list of licence holders is available on the HSE website.

Secondly, is the contractor independently audited, that is, undertakes on-site verification inspections to ensure compliance to requirements. How can a client check this?

One way to check is to see whether the contractor is a member of a trade association, as some clients expect a trade association to maintain industry standards and provide a safe guard.

Asbestos removal carries a high level of health and safety risks, so clients should look behind a trade association logo to see what reassurance that membership actually provides.

To provide reassurance for all parties of compliance with relevant legislation, ARCA introduced an audit scheme in 2000, to support members’ performance and therefore maintain standards. ARCA member contractors are required to have a satisfactory site audit to join [and an office audit], and then two satisfactory site audits every year to maintain membership of the Association.

ARCA took a further step towards supporting consistent high standards and a higher level of reassurance, by enhancing its audit scheme in January 2017.

Members still need to complete two satisfactory site audits every year to maintain membership, however, these audits are now unannounced. This has been made possible by the HSE providing ARCA with some details [name of licensee, site location, dates of work and nature of work] off the licensed contractors ‘notification of asbestos work’ form.

Using this information ARCA can arrange site audits, so that ARCA members (excluding Ireland) have no prior knowledge of when, or where, an ARCA auditor

It is the duty of the licensed asbestos removal contractor to produce a suitable Plan of Work (PoW) and comply with Regulation 7 of the Control of Asbestos Regulations 2012 (CAR 2012).

A PoW should be a practical and useful document describing the site, location of asbestos, access and waste routes, etc. so providing a safe working method for site staff to follow.

Also a PoW should be complete but manageable in length; for example the use of diagrams, photographs and flowcharts can all help make PoWs less wordy; and should be easy to read and straightforward to follow.

This is supported by HSE, as their position is that generic information about frequently used company procedures (such as standard ways of bagging waste, standard enclosure construction materials etc) will not need to be in the site-specific plan. Keeping generic information out of the site-specific plan means the standard procedures on which it is based need to be available on-site in a readily accessible and readable format, be that electronic or hard copy.

The asbestos removal contractors’ manager should create the PoW with the client, so both parties are aware of any site constraints, other trades on-site, etc.

Finally, a PoW is there to primarily support site staff, but should also be available for the analyst, manager, auditor, HSE inspector and client.

Good coordination and cooperation between all parties is a must for a project to be successful.

ION complete project for Sainsburys and start work at Bow Street Magistrates Court

CASA opens Cornwall office

ION Environmental recently completed an 8-week project at Sainsburys in Hove, East Sussex. The project involved approximately 90% of the works being carried out under fully controlled conditions, with 10% being carried out under locally controlled conditions.

During the project ION were subject to several audits, both internal and external, including an HSE inspection and two Dave Chudleigh, Branch Manager

Mick George supports schools with asbestos gauze collection

F

ollowing the Department for Education (DfE) instruction to schools to remove all Bunsen burner gauze mats after highlighting that the equipment may contain dangerous asbestos, Mick George Environmental arranged a special collection scheme to education providers throughout the counties of Cambridgeshire and Northamptonshire.

The firm, as part of their commitment to relieve any risk from asbestos contaminated materials conducted dedicated collections during October at a significantly reduced cost of just £1 per gauze mat. The company also vowed to donate proceeds raised to Mesothelioma UK - a national specialist resource centre, specifically for the asbestos-related cancer.

Training Certificate Expiry Service - Update T

o support members the training team have been sending letters monthly to remind members of up and coming training certificate expiries for their staff (operatives, supervisors, contract managers).

The training team has developed a new system whereby emails will be automatically generated and sent to the members’ training contact with a report attached.

The report will include the names of the staff and when their training certificate expires, along with information on

scheduled training courses at all ARCA centres over the next two months. This email communication service will start running in the new year.

“I’ve already received very positive feedback from members, as this service is seen as a great support. However, we felt we could automate the system further to issue emails [with reports attached] so creating a timely two-way communication.

We look forward to running this email service in the new year,” stated Satish Patel, Training Manager for ARCA.
