CSCS Cards, Supervisor Qualification and Industry Training Standards
A
t the time of writing this piece I am in the middle of the series of regional meetings with a further three to complete. At these regional meetings I have been updating members on the progress with regards to CSCS cards.

Contrary to information you may well have seen issued from other sources, black CSCS Asbestos Removal Manager cards are available via the ARMI Skills Card scheme operated by ARCA. CITB and CSCS have confirmed that the accepted qualification for this card will be the RSPH Level 4 Certificate in Asbestos Removal for Contract Managers. More information on black CSCS cards for Contract Managers is available on page 7 of this issue. CSCS cards for Analysts and Surveyors are also available via the ARMI Skills Card scheme operated by ATaC. Academically Qualified Person (AQP) cards are available for Analysts, Surveyors and Analyst / Surveyors. In addition, red trainee cards are available for the same disciplines and a red Analyst / Surveyor Apprentice card is available for those individuals who enrol on the Trailblazer Apprenticeship Scheme when it is launched. The current situation with the NVQ for Asbestos Supervisors is that progress has stalled. A framework for this NVQ has been submitted to the CITB Sector Skills Council and is awaiting approval. I hope by the time this issue of ARCA News is published I will be reporting that this NVQ has been approved. The framework for the NVQ has been reviewed at the regional meetings that have taken place to date, and members present have given it unanimous support. Members present at the regional meetings were also given a practical demonstration of the ARCA electronic audit app and how they could take advantage of this useful tool to conduct their own internal site audits. More information on this product is available on page 8 of this issue.
I am pleased to report that CITB has commenced work on Training Standards for the Construction Industry, and this will include Training Standards for the asbestos removal and management industry. A consistent and credible framework for training, along with independent third-party Quality Assurance, is long overdue for our industry and is something we look forward to working towards. We anticipate that the Training Standards will represent good practice, and by this we mean they will be compliant with and in the spirit of, Control of Asbestos Regulations 2012 (CAR 2012), Approved Code of Practice accompanying CAR 2102 (ACoP) and guidance. If they meet these requirements, then we look forward to standards providing reassurance, to ARCA members and Licensed Asbestos Removal Contractors in general, that the training they are receiving from training organisations (approved by CITB), at least meets their training obligations as employers, as far as the regulations and HSE are concerned. And so, as another year draws to a close, we look forward to the coming year and the landmark 100th edition of ARCA News being published in the Spring of 2018. For the 100th edition we are looking to do something a bit different to mark this occasion. Until then I would like to wish readers a Merry Christmas, and a prosperous and peaceful New Year.

Head of HSE Asbestos Licensing Unit presents at ARCA AGM Archie Mitchell, Head of HSE Asbestos Licensing Unit, spoke to ARCA Members at the Association’s Annual General Meeting on the 6th October 2017 at Lords Cricket Ground, London

rchie Mitchell has worked for the HSE for about 20 years, being the Head of the HSE Asbestos Licensing Unit for four years. This was the second year that Archie has spoken to ARCA members at the Association’s AGM.
Control of Asbestos Regulations 2012 In the last year the ‘Post Implementation Review’ of the Control of Asbestos Regulations 2012 was undertaken, as a statutory requirement to review the regulations after 5 years was part of the regulations. The report, which is available online, talks about the costs of asbestos to the UK, this includes the costs of managing asbestos and removing it, and the costs of healthcare and so on. The costs go into the billions. The report looks at how the HSE regulates and how the HSE has regulated in the past and how effective they have been, and how effective they think they have been. The result of the ‘Post Implementation Review’ is that the regulations will remain but there will be some changes. During the review some information and statistics came to light. The obvious thing is the big boom in asbestos exposures through the 1960’s and the consequences, the incidence of mesothelioma through the years and the astronomical rise up, until the peak which we believe to be about now. The doctors, medical professionals and epidemiologists’ opinion is that it will now start to decline. It is expected that in one of the years not too far away from now, the HSE will be saying that there have been fewer deaths from asbestos than in previous years rather than there have been more. So, there will have to be a different message going out. Looking at the bigger picture this is a success in one direction. Today, there are around 2,000
mesothelioma deaths from asbestos exposure, however, projections based upon different mathematical models and if we did nothing different than we do today, the mesothelioma deaths in 2040 were projected in the order of 400 deaths per year and worst-case scenario for 2040 was 800 deaths per year. It is important that improvements keep being made as it has a long-term effect. So, when asbestos removal contractors feel that HSE is on their case, there is a big driver for that and that is the long-term effects in the future. It is always important to keep this in mind as the reason why HSE are pushing for improvement.
Is progress being made? These day’s HSE are always looking for wet stripping in all but a few exceptional circumstances. Looking at reported wet stripping and dry stripping going back as far 2004, the amount of dry stripping being carried out since then has massively reduced. HSE know that this has got an enormous benefit. HSE believe that the UK succeeds better than other nations in controlling exposure, in as much as, if you control at source then you are not challenging the RPE. If there is a breach in the enclosure you are reducing the amount that you are releasing, so there are a lot of benefits.
Guidance on Plans of Work Another recommendation from the ‘Post Implementation Review’ is guidance on Plans of Work, a part ARCA contributed to. There are a range of views on Plans of Work, and there are also shades of a professional opinion about them. The challenge for something like guidance, is that people expect that there would be one piece of paper which you could just follow and then that would be the perfect Plan of Work. When HSE put
out guidance it will be an overarching document and describe aims in particular areas and in different categories of work. What HSE will not be publishing is a large document. The problem with issuing highly detailed guidance is that ARCA members carry out all types of work from removing AIB from a cupboard in a semi-detached house in Essex to having a work force off for three weeks offshore on a North Sea oil platform. One ‘Plan of Work’ piece of guidance is not going to cover both of these if you put it in fine detail. This has to be in place by October 2018. HSE will be speaking to ARCA and other trade associations during development of the guidance. What will also be in the guidance, and what HSE will expect to see in the Plan of Work, is some acknowledgement of how long cleaning is going to take and how long the clearance is expected to take. There would be some expectation of how long it is going to take for the supervisor to check the enclosure has been thoroughly cleaned and the areas the analyst will be expected to inspect and test during the 4-stage clearance. HSE are aware that there are pressures from clients who like to see large Plans of Work as clients think they are getting value for money that way. HSE push against this. Clients can have their appendix if they want it, but what HSE want to see in a Plan of Work is a clear and obvious description for the supervisor of what the job is. HSE should be able to pick it up when they visit, look at it, and think that makes sense. If HSE ask the supervisor about the job they should be able to explain what they are going to do and point out the key points. If the supervisor describes what he is going to do to the HSE inspector, and the inspector can’t see any description of that in the Plan of Work, then clearly HSE will be thinking that is not sufficient.

The Plan of Work has to be auditable, there must be measures so it is measurable and HSE hope that this can be reflected in the new guidance. These are the kinds of overarching principles that HSE can give and that will give HSE and licensed contractors something to work with when assessing or preparing a Plan of Work. Big moves forward in technology means that the analysts guide will now mention photography of the enclosure, and photographic records. This provides a very different kind of presentation and a lot fewer words.
Short-Term Employment When HSE moved from having licensed labour agencies the expectation, and the clear line that HSE were taking, was that the responsibility for having asbestos workers on site belongs to the notifying licensed contractor. This is because they are employed by the licensed contractor and this is inherent in the regulations. However, this employment can be short-term employment. HSE now refer to short term employees rather than agency labour. When HSE hear licensed contractors talking about having problems with agency labour, HSE will be saying “I know but we gave you the licence, you have the power and you have the responsibility”. If the worker a licensed contractors is employing is not under their control, or he is self-employed, or some other model, he needs his own licence. HSE is looking for concurrent control of short term employed asbestos workers by those who have got the licence and are notifying the work. HSE will be looking for evidence of worker competence and that licence holders can demonstrate they know their ‘short-term employees’ are competent. There are debates about RPE and PPE, the law requires that the employer supplies them. Asbestos removal operatives will come with their favourite bit of RPE and say “I am using this”, HSE understand that. If the licensed contractor’s representative has examined it and it is good quality then fine, but HSE wouldn’t expect to see a licensed contractor advertising for labour and stating that the labour must come with their own RPE. If they do it is a benefit, if they don’t the legal responsibility is with the licensed contractor. HSE would always expect to see the records, medicals, face fits and checks for a short-term employee in the same way they would expect for a permanent member of staff. HSE expect licence holders to have evidence that workers who are working for them, and who are employed by them, are being treated the same way as any other employee.

nd ARCA Annual General Meeting was held for the first time at Lords Cricket Ground, London on the 6th October. The Chairman, Grant Beglan, welcomed everyone to the AGM, and thanked Archie Mitchell, Head of the HSE Asbestos Licensing Unit (ALU), for kindly speaking at the meeting. Archie provided the meeting with an informative presentation on ‘what was new, progress being made and current issues’. An overview of Archie’s presentation is provided in a separate article within this edition of ARCA News on page 5. Following Archie’s presentation, the Chairman introduced the Associations’ Chief Executive, ARCA Staff Members and Committee Chairmen to report on the activities of the Association over the past 12 months and outline the plans for the future. Members present heard that in August ARCA began to issue CSCS cards for operatives. Also, it was reported that ARCA had developed the experienced worker route for operatives to gain an NVQ, and that ARCA is still the only provider of that method of assessment. It was also reported that the CITB, under their new remit, is keen to set training standards for the construction industry as a whole and carry out some third-party quality assurance of that training provision. As one of the Sector Representative Organisations, ARCA will be assisting CITB in developing this. ATaC members heard that a Trailblazer Apprenticeship Scheme for analysts and surveyors was in the process of being
developed. The standard has been accepted by the Institute for Apprenticeships, and ATaC are now awaiting approval of the end-point assessment. This scheme will allow analytical laboratories to take on apprentices and take advantage of the generous financial funding that is available for their training, qualifications and assessment. This AGM was the final meeting as Chairman for Grant Beglan, as he handed over the Chairmanship of the Association to Alan Davies of Asbestos Business Contractors Ltd. Alan closed the meeting with his incoming Chairman’s speech and stated that: ‘The Governing Council is dedicated to continuing the challenge of raising the standards in the whole of our asbestos industry by introducing further qualifications and improving the standards of all employees, whether based on-site or in the office. Also assisting our members with practical help by providing competent advice and a helping hand where needed.’ Following the meeting members enjoyed a 3-course silver service lunch in the Thomas Lord Suite, and were entertained by former world snooker champion, Dennis Taylor, who provided the after-dinner speech. Feedback on the venue was very positive so Lords Cricket Ground has already been booked for 2018. The ARCA AGM is always held on the first Friday of October, so in next year this will be the 5th October, so please put this date in your diary now.

ARCA now issuing CSCS Manager Cards
Red and Black ARMI Skills Cards now available through the Association

RCA is now issuing Asbestos Removal Manager CSCS cards, under the ARMI Skills Card Scheme. Both temporary red and 5-year black cards are available as physical smartcards and also as virtual smartcards.

ARCA announces winners of Gold Site Audit Award 2017
A
t the Association’s AGM in October, ARCA announced the fifteen member companies who achieved the Gold Site Audit Award for 2017. To achieve this award, Asbestos Removal Contractor members needed to achieve Grades A-C, with an average of at least a Grade B, in six consecutive audits (that is across a 3 year period ending 30th June 2017). As all site audits became ‘unannounced’ in January this year, a weighted adjustment has been introduced to account for any variation in the extent of auditable work on-site. The award has been designed to acknowledge consistent performance, demonstrated over a sustained time period. Of the fifteen companies achieving the award, twelve have retained the award from 2016, with three companies being newcomers. “Congratulations to all the award winners,”
said ARCA Membership Compliance Manager, Geoff Silver. “This acknowledges the work that has been put into their participation in the ARCA Site Audit Accreditation Scheme (SAAS).” “This year has seen a number of initiatives from ARCA with regard to the audit scheme. Firstly, in January all site audits became unannounced, followed by the development and roll-out of an electronic audit app. Also, the in-house audit team was strengthened, with full-time ARCA auditors now based in the Midlands and South of England.” ARCA offers members a range of support services, including additional site audits, and last month announced the availability of a ‘Member Internal Site Audit App’ (see page 8). This is an exciting new product development which will help enhance members’ audit programmes and therefore their businesses.

However, often these two elements can differ in what is audited, limiting the scope of analysing the audit results collectively. The compilation of all audit results for statistical analysis creates a stronger management tool.
The App, which is a web and remote device based application suitable for IOS, Android and Windows handheld platforms, enables auditors to collect audit data, including photographs, in an efficient way. It is user friendly, incorporates guidance with each audit question and can be used on sites even with no internet connection. Trailblazer Apprenticeship for Asbestos Analysts and Surveyors
As a trade association ATaC regularly hears about the shortage of skilled labour across the industry, so the availability of this apprenticeship scheme will be a huge support to reduce that skills gap.

he Asbestos Analysts and Surveyors Apprenticeship Scheme has been designed for any organisation thinking of recruiting new staff to conduct asbestos fibre counting and 4-stage re-occupation tests, bulk asbestos identification and surveying for asbestos containing materials. Therefore, this trailblazer apprenticeship scheme will include three RSPH qualifications, which are all Ofqual regulated - RSPH Level 3 Award in Asbestos Surveying, RSPH Level 3 Award in Air Monitoring and Clearance Procedures and RSPH Level 3 Award in Asbestos Bulk Analysis.
With a funding cap of £9,000, the scheme will also include a number of training modules covering asbestos removal, Plans of Work and risk assessment. This will mean that on successful completion, an apprentice will have a unique skill set. ATaC will make information available and will hold a number of workshops to explain the application process, as soon as this trailblazer apprenticeship scheme is finalised.

Developer fined after failing to safely carry out demolition work T
he owner of block of flats was prosecuted after a Health and Safety Executive (HSE) inspection identified serious safety breaches while it was being demolished. Westminster Magistrates’ Court heard that a member of the public raised concerns about the conditions at the site at 60 Pitcairn Road, Mitcham. Selliah Sivaneswaran was the owner of the property, but had failed to make appropriate appointments for the development project. The site had been inspected by HSE in October 2016 and the work halted due to the workers being exposed to a range of risks including exposure to asbestos, falling from height, and fire. HSE revisited the site on 4 January 2017 and found the work had restarted while the site was still unsafe, despite enforcement notices being served and advice being provided. The demolition continued to be carried out by hand with workers climbing onto the unguarded roof and throwing the debris down. Workers were at risk of falling up to four metres through holes in the floors and partly demolished staircase. No welfare facilities had been provided and there
was a significant risk of fire with the workers not being able to escape. The Court heard that two days before the sentencing hearing, HSE had to return to the site and take further action. The project involved the demolition of the old flats and the construction of four onebedroom flats and two two-bedroom flats on a site bought for £115,000 in 2001. The Court heard that despite the foreseeably large financial return from the project, Mr. Sivaneswaran put profit before safety and paid cash in hand to untrained workers, did not engage a site manager, and provided none of the legally-required site documentation. Selliah Sivguru Sivaneswaran of Harlyn Drive, Pinner pleaded guilty to breaching Regulation 13(1) and 4(1) of the Construction (Design and Management) Regulations 2015 (CDM) and was fined £200,000 and ordered to pay £1,421.20 in costs. HSE inspector Andrew Verrall-Withers commented after the hearing: “Mr. Sivaneswaran was a commercial client as he was carrying out work as part of a business. When he failed to appoint a principal contractor, their duties fell on him. “Thanks to a member of the public reporting the dangerous conditions HSE was able to take action. It was just good fortune that no one had been killed at the site”. “Instead of taking the support and advice provided by HSE, Mr. Sivaneswaran continued to let the workers operate in appalling conditions where they were at risk of being killed. He did not even provide them with a WC or washing facilities”.

Waste removal contractor fined after asbestos concerns A
waste removal contractor from Bridgend has been sentenced after undertaking asbestos removal work at two locations without being licensed to do so. Swansea Magistrates’ Court heard how, on two occasions 1 September and 7 November 2016 Mark John Gibson, who advertised as an asbestos removal service, was contracted to remove asbestos containing materials from properties in Pont Y Clun and Dyffryn Chapel, Caerau. An investigation by the Health and Safety Executive (HSE) found that Mr Gibson (trading as All-Gone Waste) worked with asbestos containing materials that required him to have a licence from the HSE. He did not and has never had a licence issued to him for this purpose.

Mark John Gibson of High View, Bridgend pleaded guilty to breaching Regulations 8 (1) of the Control of Asbestos Regulations 2012, and Regulations 2(1) and 3(1) of the Health and Safety at Work etc. Act 1974. He has been fined £1500.00 and ordered to pay costs of £2657.00 Speaking after the hearing HSE inspector Phil Nicolle said: “Mr Gibson undertook asbestos removal work which he was not licensed to do. “Asbestos removal must be done by HSE licensed contractors to ensure the highest standards are met to prevent health risks to employees and members of public.”

Utility company fined after exposing employees to asbestos
A
Paisley based utility services company has today been fined for exposing four of its employees to asbestos during work at Anderson Tower in Motherwell in 2014. Hamilton Sheriff Court today heard that four electricians employed by IQA Operations Group Ltd had been drilling through door transom panels to fit electric cables into each property within the tower block as part of the installation of a new low voltage distribution system. The company had identified that an asbestos survey was carried out ahead of the works starting but did not include a survey of the transom panels above each flat entrance door. The four electricians started work on the site on 23 June 2014 and drilled holes in the door transom panels in all 44 flats. The electricians were not aware that the panels contained asbestos so no measures were in place to control exposure to airborne asbestos fibres. On 2 July 2017, a resident raised a concern that the panels were asbestos, work was stopped and the panels tested. The samples tested positive for asbestos. Immediate action was taken to decontaminate the flats which involved the local council making arrangements for the residents to leave their properties while the work was being done. An investigation by the Health and Safety Executive (HSE) found that IQA Operations Group Ltd had failed to provide and maintain a safe system of work to identify the presence of asbestos in the transom panels and failed to carry out a suitable and sufficient assessment of risk to their employees from asbestos when carrying out cable routing work. IQA Operations Group Ltd of 101 Abercorn Street, Paisley, has today been fined £6000 after pleading guilty to a breach of Section 2 (1) of the Health and Safety at Work etc. Act 1974. Speaking after the hearing, Gerry Muir HM Inspector of Health and Safety said “This incident could have easily been avoided if the company had in place a system of work to ensure that the asbestos survey it requested to be carried out covered all of the intended work areas. Failing to do this resulted in 44 asbestos panels being drilled into with no measures in place to control the risk of exposure to the resultant asbestos fibres.”

Commercial Property Owners have Legal Responsibilities A
RCA, the UK’s leading association representing asbestos removal contractors, has made available a publication for commercial property owners and managers, giving an overview of their legal responsibilities on managing asbestos. Asbestos management is an issue faced by property owners and managers (the clients), whether owning/managing one premises or a large portfolio of premises, constructed prior to the year 2000. That is, they are responsible for ensuring that employees and non-employees are not exposed to health or safety risks as a result of the presence of asbestos. These clients have legal responsibilities to manage risks from asbestos, so to support them

ARCA has covered the main regulations in a new publication. The Health and Safety at Work Act 1974 places a duty on every employer to ensure, so far as is reasonably practicable, the health, safety and welfare at work of all employees and nonemployees who may be affected by the employers’ activities. The Control of Asbestos Regulations 2012 (CAR 2012), places a legal duty to ‘manage asbestos in non-domestic properties’, on those who own, occupy, manage or have responsibilities for premises that may contain asbestos. The Construction (Design and Management) Regulations 2015 (CDM 2015) places explicit responsibilities on clients, for example, if asbestos
removal is required the client needs to appoint a competent asbestos removal contractor. To support this last point, ARCA members need to complete two satisfactory site audits every year to maintain membership. In January 2017, ARCA made all site audits ‘unannounced’, meaning members (excluding Ireland) do not have prior knowledge of when, or where, an ARCA auditor will be assessing their performance. Therefore, being unannounced, ARCA site audits are now an even stronger system of reassurance for all parties, including end-clients. ASBESTOS Dust Wipe Sampling T
he following is a summary of the discussions and conclusions of the ALG Technical Working Group. Asbestos fibres are “naturally present” in extremely low levels in the air and surfaces of buildings which contain asbestos products. Therefore, where dust sampling (and sensitive analysis) is carried out, asbestos fibres will be detected from time to time on the surfaces in the normal occupancy areas of buildings. Their presence is not unexpected. Surface dust sampling often provides very limited meaningful information and the results of such sampling need to be carefully interpreted. The detection of a few individual asbestos fibres in surface dust does not provide a reliable measure of exposure or risk. Individual fibres present an inconsequential amount of asbestos. Fibres on some surfaces (e.g. highlevel surfaces) may have been present for a long period of time (possibly even years). In the absence of any other evidence of the presence of asbestos (e.g. debris or suspect material),
the dust would generally not even merit any specialist remedial action. Therefore, it is advised that asbestos in dust sampling is avoided or only carried out sparingly e.g. where there is an identifiable benefit. Speculative dust sampling is not advised particularly where there is no incident, debris or suspect material. As already pointed out random asbestos fibres may be detected on occasions. Such sampling is actually often unhelpful and can lead to incorrect conclusions on exposure and risk. The presence of low numbers of fibres can often be misinterpreted and lead to suggestions of significant contamination, unnecessary occupier alarm and expensive cleaning or “decontamination”. Sampling for asbestos in dust may have some practical application where it is linked to a recent suspected disturbance or incident, or a known source of contamination. The sampling may provide an indication of the severity and the extent of spread of contamination. However, the primary and
most useful assessment of asbestos spread in incidents should be the extent of any visible debris and particles. The focus in the investigation of an asbestos incident should be on the presence of any visible suspect asbestos debris/fragments (not general dust or debris). If there is no suspect debris or material, then the extent of spread will have been minimal and the risk to any occupants also minimal. Consequently, the need for and any value of cleaning up will be quite limited. Dust deposits are usually non-homogeneous and it is often difficult to take a representative sample. Therefore, dust samples analysed for the presence of asbestos should comprise a significant amount of loose dust (a minimum of approximately one tablespoon). Dust samples are best collected by scraping the dust layer into a pile and transferring into a suitable labelled container. It is not recommended that dust samples be collected as wipe samples on adhesive tapes, wet wipes or filters, due to unreliability in collection efficacy and as the types of asbestos present can be difficult to identify using the standard procedures.

In applying the minimum air extraction rate of 1000m3/hr for small enclosures (i.e. <120m3), is there a point with very small enclosures that the airflow is too great, putting the enclosure integrity at risk? HSE research carried out in 2012/13 (Health and Safety Laboratory report RR988 “Ventilation of enclosures for removal of asbestos containing materials”) concluded that the standard enclosure construction of timber and polythene provides a sufficiently robust, strong and stable unit to withstand the new air extraction rate and significantly higher air flows. An air extraction rate of 1000m3/hr has no adverse effects on the stability and integrity of very small enclosures (e.g. 6m3).

Is it true that LARC’s are allowed to have both the airlock and baglock open at the same time? Enclosures with an air extraction volume flow of about 1500m3/hr should result in an airlock flap deflection of approximately 300mm (for a ‘standard’ 1m x 1m x 2m airlock), thus maintaining sufficient changing space in the airlock. For larger air extraction volume flows, there becomes an increasing necessity for another air inlet. A baglock (where fitted) provides an ideal second air inlet, which will also result in a purging of the baglock. This principle is illustrated in figure 6.13 on page 101
In July 2015, ARCA published guidance on Air Management in Asbestos Enclosures (reference GN006-V0715, available at www.arca.org.uk). This guidance has been well accepted and applied, evidenced by ARCA through the Site Audit Accreditation Scheme. However, several questions have been asked and we hope the following brings clarification. of the Licensed Contractors Guide (HSG247) and is acceptable and recommended practice. For much larger air extraction volume flows, e.g. above 4000m3/hr, further air inlets will be required, in addition to the baglock, to provide the additional make-up air.

Is it acceptable for my additional air inlet(s) to be a cut-out in the enclosure wall with a pre-filter fitted? This is acceptable, but it is also acceptable to fit a single chamber airlock cube, with weighted flaps front and back, to the enclosure wall. For the latter, it is strongly advised that the outer opening is covered with mesh / chicken wire to make it clear that the chamber is not in place for enclosure entry or exit, for passing equipment in or out, or for waste removal.

If I have excessive airlock flap deflection, can I control this by making use of the variable flow control(s) on my NPU(s)? Yes and no. If you can demonstrate that you have an excessive number of air changes per hour, you can reduce the airflow using the variable flow controls, but only down to the minimum 8 air changes per hour. To do this, you will need to be able to demonstrate how the airflow varies relative to adjustments

of the variable flow control. Remember that the 6-monthly inspection and test report will only state the measured airflow at the maximum flow setting. Therefore, airflow rates of the NPU’s will need to be accurately measured at least at the start of each job, at various settings, if variable flow controls are to be used to regulate make-up air. As ‘Air Out = Air In’, if you reduce the flow of extracted air too much, then your incoming air will be insufficient to meet the legally required number of air changes. Similarly, if you overly restrict the amount of incoming air (e.g. by having insufficient air inlets), then the volume of your extracted air may be considerably less than the calculated amount, and again you may not be achieving the legal requirement in terms of air changes.

We have a number of perfectly serviceable old 500cfm NPU’s (850m3/hr). Can these still be used? Used on their own they will almost certainly not meet the minimum 1000m3/hr requirement, but there is nothing to stop you using two or more, or using them in combination with other units, to meet the minimum air extraction rates required.

Understanding re-occupation testing
What clients need to know If you are a property owner/manager who may have licensed asbestos removal work undertaken at your premises, or involved in licensed asbestos removal works, you need to understand the re-occupation process. That is what needs to happen before the building, or area where the removal took place, can be allowed to be re-occupied. The 4-stage re-occupation test is a legal requirement as detailed in the Control of Asbestos Regulations 2012 (CAR 2012).
W
hen licensed asbestos removal work is planned by both the end-client and the Licensed Asbestos Removal Contractor (LARC), sufficient time has to be allowed to complete the re-occupation test. This time is in addition to the time taken for actually removing the asbestos containing material(s) and can range from one hour to 2-3 days depending on the complexity of the area affected. Planning this time is critical as delays may hold up other works and other contractors.
What is a 4-stage re-occupation test? This is a series of tests carried out after licensed asbestos removal and before the affected area is handed back to the client for re-occupation. (Licensed asbestos removal is usually undertaken inside a sealed enclosure). Its purpose is to ensure all proposed asbestos removal work has been carried out as per the pre-agreed Plan of Works, and that the area is clean, dry and dust free, as far as is reasonably practicable, and therefore fit for re-occupation.
Why do this test? The 4-stage re-occupation test is a legal requirement as detailed in the Control of Asbestos Regulations 2012 (CAR 2012) Regulation 17.
Who can conduct the test? The test can only be undertaken by a United Kingdom Accreditation Service (UKAS) accredited testing laboratory accredited to ISO 17025. This requirement is also highlighted in CAR 2012 Regulation 20. To avoid any perceived conflict of interest, the Health and Safety Executive (HSE) has long held the view that the analytical company contracted to carry out the 4-stage re-occupation test should be employed independently by the end-client.
What is the process for a 4-stage re-occupation test? As the name suggests there are four separate tests / stages which are carried out by a qualified analyst. These are: Stage 1 - Preliminary check of site condition and job completeness The areas examined are: w The plan of work (method statement) w The transit and waste route (the route to and from waste skips and decontamination unit) w The decontamination unit (the mobile unit used for decontamination including showering) w Areas surrounding where the work has been undertaken w Inside the enclosed area, by viewing from outside using the vision panel, or CCTV provided When the analyst carrying out the test is happy that it has met the criteria for Stage 1 he/she will move onto Stage 2. Stage 2 - A thorough visual inspection This will entail: w An examination of where the asbestos had been w All surfaces inside the enclosure w Ensuring the enclosure is clean, dry and dust free as far as is reasonably practicable The time spent on this stage will depend on the size and complexity of the enclosure and in some cases, may require more than one analyst to carry out the inspection. Stage 3 - Clearance air monitoring Air sampling will be conducted inside the enclosure to: w Ensure the airborne fibre concentration is below 0.010 fibres per cubic centimetre All surfaces are brushed vigorously for a minimum of 1.5 minutes per sampling location. When the air test has been carried out and the fibre concentration deemed to be less than 0.010
fibres per cubic centimetre the enclosure can be dismantled. Stage 4 - Final assessment post-enclosure / work area dismantling After the enclosure/work area has been carefully removed the analyst will undertake the final assessment: w Check the area for any asbestos containing materials that may have been hidden when Stage 2 was undertaken. * w Ensure that all materials used for erecting the enclosure have been removed and disposed of correctly. *If during this inspection any residual asbestos is identified from the removal works the enclosure may have to be re-built and the asbestos residue removed.
What is supplied to state that re-occupation is approved? A re-occupation certificate will be issued by the analyst to both the Licensed Asbestos Removal Contractor and the end-client. Photographic evidence of each stage should be provided to support this final re-occupation certification.

ver recent times, huge strides forward have been achieved in relation to asbestos linked healthcare issues, and one of the fundamental reasons behind the continued progression, is the work undertaken by the charity, Mesothelioma UK. Mesothelioma UK, is a national specialist resource centre, dedicated to providing information and support, and professional specialist nursing in NHS hospitals throughout the country. The network of specilaist nurses continues to increase, alongside a number of other significant developments, thanks to generous donations. One of which was a £1,500 grant from Mick George Ltd who struck a partnership with Mesothelioma UK earlier this year. Golden Anniversary From humble beginnings, Erith Haulage, as it was originally named, was formed in 1967 on the outskirts of the SouthEast London suburbs in Erith, Kent. With a career spanning over four decades, Managing Director Tony Darsey explains where the company is today and the importance of the ARCA Training Committee. “While many people think of Erith as a Demolition and Asbestos Removal service provider, we actually started off as a haulier. With one lorry, my dad Tom Darsey set up the venture; operating from our living room as a sole trader. Fast forwarding half a century reveals significant growth, with The Erith Group evolving into a multi-disciplinary service provider with over 700 employees. Recent statistics show that Erith have emerged as one of the biggest Asbestos Removal companies, not only across Kent and the South East, but across the UK - this February marks a one-year anniversary of the Group’s Scotland office. As impressive, is the ever-increasing finances. In 2016, turnover was at an all-time high - with the audited accounts displaying more than £150 million on the books generating a healthy pre-tax profit. The numbers are impressive, and it speaks volumes about the business we are
today, but for me what’s more important is the family ethos which has remained throughout. Steve my eldest brother remains the Group Chairman, I look after the Asbestos Removal and Nuclear Division and my younger brother David manages our Demolition and Basement operations. We’re all very much still active members of the business and despite the growth we have not for a second become a disjointed corporate contractor with an unapproachable Board of Directors; if an employee of mine has a concern - my door is always open. The asbestos removal business has seen a dynamic transition. Rewinding twenty years ago asbestos was very much a service provider for the demolition department, decontaminating and removing asbestos from buildings to enable follow-on demolition. This has changed drastically. Before, most of our works were small scale, predominantly serving the residential sector as part of term call-out contracts. Now, we have a presence within the Nuclear market with our biggest contract at Dungeness Power Station circa. £24M. The projects we tend to target are those of a complex and challenging nature whereby we can offer value engineering through pioneering solutions.” Tony’s involvement within the ARCA Training Committee spans over two decades. 2016 saw him receive a ‘Service to the Industry’ award for his continual support to the Association; as a Governing Council member
and for serving two terms as ARCA Chairman. ARCA were keen to pay testament to Tony’s achievements stating: “His continual drive has supported the Association in its delivery of exceptional training courses and qualifications.” Tony went on to explain; “Training is so integral in this licensed industry. With regulations changing and the strive for better practices, it’s important we share knowledge and provide the best possible training across our field of work.” I’m particularly keen to support continual improvement in industry training standards as a whole and I greatly encourage the attainment of professional qualifications which are now in existence. ARCA continues to develop training and qualifications for all level of roles within the asbestos management industry. This includes an ILM qualification, which supports the development of management and leadership skills, required for effectively managing the operations of asbestos removal projects. Also, for the industry is the Asbestos Removal Management Institute (ARMI), and as a business we now have four members of ARMI with a further three in the process of enrolling. Over the years the industry has seen many changes to regulations, operations, and health and safety. This and the commitment of ARCA (from training to unannounced site audits of members) has helped develop the professionalism found in the industry today.”

Guidance on the CDM 2015 regulation states: ‘When considering the requirements for designers and other construction professionals, due weight should also be given to membership of an established professional institution or body. For example, do these bodies have arrangements in place which provide some reassurance that health and safety is part of the route to membership of their profession?’ (i)

ARCA Membership is more than just a logo At the Asbestos Removal Contactors Association (ARCA) we believe membership is more than a logo. Why would we believe this?

However, do they know what a specific ‘logo’ really means? For example, how are standards maintained, and what is provided to give a level of reassurance regarding members. Don’t assume what a logo means as they can mean different things. Be curious, make sure what you want, is what you get.

‘They are the leading authority of the removal and management of asbestos in UK’
ARCA is passionate about making a difference and constantly improving standards within the industry. No other organisation has done more to develop qualifications for the asbestos management industry over the past 10 years. To support members, and the industry, the Association delivers first class training courses, developed and led by trainers with industry experience and who are qualified to teach. ARCA assessors are also qualified, and at ARCA there is separation between the trainer and assessor, so removing the conflict of interest and providing independent assessment, Members and non-members can undertake qualifications with ARCA, which are independently regulated by Ofqual via established awarding bodies, and all supported by an ISO 90001 management system.
Provide reassurance Membership is conditional on successful ongoing participation in the ARCA Site Audit Accreditation Scheme (SAAS). This scheme was introduced in 2000, as a requirement before membership is granted and also membership is maintained by passing two unannounced site audits each year. All site audits under the scheme became unannounced in January 2017, so strengthening the level of reassurance, the safe guard for end-clients and other parties. This has been welcomed by many end-clients, with some giving ARCA auditors an open invitation to any of their sites and assistance with access to site. ARCA is the only trade association for licensed asbestos removal contractors, who conducts all site audits of members as ‘unannounced’. The audits are a requirement to maintain membership and provide reassurance that health and safety standards, and good practices, are continually demonstrated.
Promote the Professional profile of the industry Members are required to; prove competence, train staff, have suitable & sufficient processes & procedures for the work they do, and prove it. The Association’s processes for membership, training, qualifications, auditing and services are all independently verified to global and national standards, ISO 9001.
Provide Industry Leadership and Be a Voice Over the years ARCA has taken the lead in many developments for the good of the whole industry. Working with awarding bodies, such as the CITB, RSPH and ILM, ARCA has developed and delivers a range of qualifications for asbestos removal operatives, asbestos surveyors and analysts, as well as a leadership and management qualification for licensed removal contractors. Currently, ATaC, the testing and consultancy division of ARCA, is working as part of the Trailblazer Group to produce an apprenticeship scheme for asbestos analysts and surveyors. The Association became involved to help reduce the skills gap which is an issue in this part of the asbestos management industry. The Association has been a voice with regard to the regulations. ARCA believed that the Control of Asbestos Regulations 2006 did not correctly transpose the requirements of the European Directive into National Law, so raised a complaint to the European Commission, as it saw this being a disadvantage to licensed asbestos removal contractors. The European commission agreed, which led to the Control of Asbestos Regulations 2012. No other organisations took up this cause on behalf of their members. However, the whole of the licensed asbestos industry benefited from this decision, as well as workers who undertake, what we now call, Notifiable Non Licensed Work, as they are better protected.
Members don’t just pay to join ARCA, they have to continually prove that they can use the logo. ARCA is more than just a logo.

Wearing these different hats, Louise’s day can be extremely varied. Recently she was running air monitoring tests at a chemical plant, which was being demolished during the removal of asbestos cement roof sheets (see image).

Recently we spoke with Louise Williams to discuss her role in asbestos management.
B
eing in the environmental industry wasn’t Louise’s original career path, as she completed a Sports and Science degree at University. However, after hearing from a friend how interesting the industry was, she wanted to see what it was all about. So, five years ago she started her career at an environmental company, completing all kinds of tasks on-site, including carrying ladders! After enjoying the diversity of working on-site, Louise thought on how to progress in this area and successfully completed the qualification to become an Asbestos Surveyor. Following this, Louise joined ASM Compliance, based near Swansea, three and a half years ago as an Asbestos Surveyor, and she has continued to develop her career by completing further qualifications, including the RSPH Level 3 Award in Air Monitoring and Clearance Procedures. Now, Louise co-ordinates projects, liaises with clients and assigns staff to jobs, as well as undertaking work on-site as an Asbestos Surveyor and Analyst.
“No day is ever the same. I enjoy the fast pace and I get to meet different professionals within the asbestos industry. As an Asbestos Surveyor, my duties range from carrying out management, refurbishment and demolition surveys of buildings, to liaising with clients on issues, such as; access and non-access areas. The most unusual project that I have surveyed so far was a ship based in Liverpool dry dock that was undergoing major refurbishment works.” “With my Analyst hat on, I can be carrying out testing during and after asbestos removal jobs and reading slides using the microscope at an on-site lab that I have set up.” “I’ve had some interesting projects, but probably my most memorable has got to be air monitoring at a night club in Swansea. It was reported in the papers that the building was a rarity in Britain regarding the amount of asbestos located within the building.” “Many sites containing asbestos can be dirty or hazardous, I think that’s why the asbestos removal industry is male dominated. However, as an Analyst, although I can be the only female on-site, I really enjoy my job and would definitely encourage more females to get into asbestos management.” “ASM Compliance has been very supportive and I’m keen to progress my development in the asbestos industry to a senior management role, with my main aim to eventually achieve the competent person status in the asbestos industry,” commented Louise.

ast month, Mark Koster joined the ARCA training team based at the Association’s centre in Rayleigh. Mark comes with an extensive background in the asbestos industry, having been an asbestos removal operative and supervisor, before moving to surveying and analyst work. Mark’s previous role included delivering training for asbestos awareness. Satish Patel, Training Manager at ARCA, commented; “Mark’s experience will be ideal for delivering training for ARCA, as he has first-hand experience of working in the industry and his training skill set will be built on over the coming months. Mark is working alongside Lee to deliver all our courses and assessments in the southern region.”

RCA’s ‘hands on experience’ training course for Admin Staff has been well received with additional dates being required in October. On this one-day training course administrators experience what working on-site is really like for colleagues, along with practical hands on tasks such as; use of RPE, elements

employees to achieve? This is the second issue of ARCA News where we bring you an insight into one of the four modules of the ARCA ILM Leadership and Management Qualification. In this article we are covering Motivating People in the Workplace, by looking at how the strategies of Glenn Llopis a Cuban-American entrepreneur, bestselling author, speaker and a senior adviser to Fortune 500 companies has impacted those business he has advised and supported.
W
hen you wake up in the morning, what is the passion that fuels you to start your day? Are you living this in your work? If others asked you what drives you to achieve, would the answer be obvious? The triggers that motivate people to achieve are unique for everyone. Many would say its money; more people are starting to claim that they are driven to make a difference. Regardless of what motivates you and drives you to reach peak performance - it must be managed and balanced. Too much motivation in one area will weaken other parts of your game. Motivation has been studied for decades and leaders in the workplace have used assessments like DISC and Myers-Briggs to determine their employee’s personality types to better anticipate behaviours and tendencies. Additionally, motivational books are used as tools to get employees to increase their performance and / or get them back on track. While assessments, books and other tools can help project and inspire short and long performance, the factors that motivate employees to achieve evolve as they mature and
begin to truly understand what matters most to them. Therefore, as leaders we must hold ourselves accountable to build meaningful and purposeful relationships that matter with our employees. This allows us to better understand those we are serving, just as much as ourselves. As a leader, don’t just read the assessment scores, get to know those whom you are leading and be specific about how you help each of them achieve their goals, desires and aspirations. The objective should be to help one another and to accomplish this each of you must identify those things that motivate you both to work together. To help you get the most from your employee relationships, here are the nine (9) things that ultimately motivate employees to achieve. As you read this, think of how you associate with each of them. Share your story and perspectives – and comment about it. This is a hot topic and the more we can discuss it, we can help one another become better leaders.
1. Trustworthy Leadership Leaders that have your back and that are looking out for your best interests – will win the trust of their employees who in turn will be more motivated to achieve. I once had a department manager that always looked out for me. He was upfront in communicating his performance expectations and his feedback was direct. He never treated me like a subordinate and looked for ways to include me in senior management meetings. This opened my eyes to what lay ahead in my career and thus motivated me to reach the next level and in the process and exceed the expectations of my boss. Trust is a powerful motivational tool and those leaders that are more transparent with their employees will find surprising results and new types of opportunities to develop talent.
2. Being Relevant In today’s world where everyone wants to be noticed and recognised for their work employees are motivated to achieve to remain relevant. As such, employees are in search

training news of new ways to learn, improve their skills and invest in themselves. This is an opportunity for leaders to get involved and understand how to build the depth and breadth of their employee’s skill sets and aptitudes. For example, find ways to elevate your employees’ high-potential status. Helping employees increase their relevancy is important and those leaders that participate in this process will help cultivate increased performance levels and loyalty. Helping your employees get discovered will elevate their motivation to achieve.
3. Proving Others Wrong This particular motivation to achieve has been heighten as of late from younger professionals that seek to prove themselves faster amongst older generations in the workplace. Employees never want to be stereotyped or marginalized, but for many younger professionals this serves as the trigger to awaken them from within. This certainly is not a generational issue as many of us have been questioned about our ability to achieve at a high-level. I learned this the hard way throughout my career. For example, as a former C-level executive (in my early 30’s) and later as a successful entrepreneur - people begin to envy and / or doubt me thus igniting my hunger and drive to over achieve. As a leader, encourage your employees to exceed expectations by taking responsible risks. Embrace diverse thinking and measure one’s ability to innovate. Never underestimate an employee’s ability to perform until you have properly evaluated and tested their abilities and potential.
4. Career Advancement Perhaps the most important factor on this list is the ability to advance. Employees are extremely motivated to achieve if this means that advancement awaits them. This requires employees to be mindful of opportunities that lie around, beneath and beyond what they seek. As leaders, you will sustain high levels of motivation from your employees if you can open doors of opportunity and accelerate their chances for advancement. Remember, just because your employees may be relevant, it doesn’t guarantee advancement. So, make it a point to help them get there.
5. No Regrets People only have a few real chances in their careers to reach their ultimate goals. In fact, how many times do you meet people that are more successful than you are and you wonder how they got there. People don’t want to live with any regrets in their career/life and thus are motivated to not disappoint themselves. As a leader, don’t allow your employees to walk around carrying a load of guilt. Share your journey with them – your failures and successes. An employee that doesn’t believe will never achieve. Help your employees embrace the unexpected and help them navigate uncertainty and change. Many people are confused in today’s workplace about their future. Motivate them by giving them the perspectives they need to achieve.
6. Stable Future People are motivated to have safety and security. Everyone wants a stable future, but you never know when time will pass you by. That’s why we are all in a race against time and thus motivated to achieve faster than ever before. We have all learned from the 2008 economic collapse that we can all quickly become victims of unexpected change without preparation. As a leader, be mindful of providing security and stability in how you lead your employees – and watch their motivational levels rise.
7. Self-Indulgence This factor is quite interesting and extremely important to put into proper perspective. People are motivated for selfish reasons to achieve – albeit money, attention, fame, etc. Must we be reminded that greed and selfishness contributed greatly to America’s current economic hardship? Motivation that satisfies our self-indulgence can also be risky. It reminds me of a great quote from Peter Drucker in his book, “The Effective Executive” when he says that every time you meet a person with great strengths, you are also meeting someone with great weaknesses. As a leader, be aware that your employees motivations are balance and well intentioned. Self-indulgence can bring tremendous shortterm benefits – with longer term repercussions.
8. Impact As mentioned earlier on, today’s employees are motivated to achieve more than ever simply by the opportunity to create impact. As employees reflect on their lives and careers – they want to contribute in ways that measure their achievements based upon the long-term benefits that the company they serve bears. As a leader, allow your employees to have sustainable impact in the work they perform. Allow them to make a mark toward significance. Create the opportunity for their achievement to leave a long-lasting legacy that rewards the organization they serve and for future generations to learn from.
9. Happiness In the end, happiness is one of the greatest motivations to achieve. Happiness fuels one’s self-esteem and gives people hope for a better tomorrow. We are all victims of taking our work too seriously. Step back and enjoy the journey. Your motivation to achieve is ultimately based on earning a living that brings you tremendous joy and satisfaction. As a leader, be aware of whether your employees are satisfied in their work and that you are deliberate in having this type conversation with them. Never assume. Employees will smile to save their jobs even if they aren’t content. Assure your employees happiness shines and allow the previous eight motivational factors to influence the process organically.
