ARCA Qualifying the Industry
I
n January this year a further meeting was held with Build UK to discuss the future qualification requirements for CSCS cards.

The meeting involved Build UK, ARCA, ACAD, NFDC, CITB and CSCS. All agreed that the existing NVQ qualification for asbestos operatives needed to be reviewed to ensure it was fit for purpose. Once this had been completed the corresponding RSPH Level 2 Certificate for Asbestos Removal Operatives would be reviewed to ensure it mapped to the NVQ. Following this both qualifications will be recognised for the purposes of gaining a CSCS card. The next stage is then to develop fit for purpose qualifications for Asbestos Removal Supervisors and Asbestos Removal Managers. The existing qualifications such as the RSPH Level 3 Certificate for Asbestos Supervisors, the RSPH Level 4 Certificate for Asbestos Contract Managers and the NVQ Occupational Work Supervision courses will be utilised to develop these qualifications. The CSCS stated that they would continue to accept the existing qualifications for the purposes of issuing CSCS cards until the existing qualifications had been reviewed. The programme of member visits is well underway and many members will have already had a visit from an ARCA staff member to discuss the benefits of ARCA membership, what services ARCA offer, members opinions of ARCA and what additional services ARCA could offer in the future. Feedback so far from these meetings has been really positive and it is pleasing to see that members really value their ARCA membership and in particular rate the training and other services provided by ARCA very highly. In addition members are welcoming the planned unannounced site audits and can see the benefits to both their own organisation and to the standing of ARCA, and its members, with clients. ARCA is also working on producing an ‘electronic audit’, which will be completed on a tablet and emailed to the ARCA member immediately upon completion of the audit, internet connection permitting. Members will recall the ARMI guidance document ‘Competency within the Asbestos Removal Industry’ which was issued towards the end of last year. The guidance describes
a simple process of defining performance standards, measuring those standards, identifying where the standards are not met, producing a Training Needs Analysis (TNA) and delivering training to meet those needs. This process is put into an asbestos removal context and examples are given as to how this could be applied in the asbestos removal industry. At the ALG meeting in October 2015 we sought some HSE endorsement for the guidance and were advised to submit it to the HSE’s Publications Governance Group (PGG). I am pleased to report that the HSE endorsement was approved at the PGG’s February meeting. The Guidance is now in the process of being revised to include the HSE endorsement which includes ‘HSE endorses this guidance as describing a sensible and appropriate approach to managing training and competency’. Members can now be assured that if they follow this guidance it offers one way to manage training and competency. Since the beginning of 2016 ARCA has been working on the development of a new Customer Relationship Management system to replace the system we have been using since 2007. In addition new ARCA and ATaC websites are being developed. Both systems are linked and will go live in April 2016. The addition of these two new systems will result in an improved service to members from the ARCA staff and greater visibility of ARCA and its members to clients on the internet. Further information on these systems will be provided to members once the system is live. Finally I am pleased to report that ATaC has had a further RSPH qualification accepted by UKAS. The qualification is the RSPH Level 4 Certificate in Asbestos Laboratory / Project Management and it will be given equal standing to the BOHS Certificate of Competency in Asbestos by UKAS for the purpose of complying with LAB 30 and RG8.

ARCA presents at Asbestos Licensing Principal Inspectors conference
A
RCA was invited by the Health & Safety Executive to address the Asbestos Licensing Principal Inspectors’ 2015 conference. ARCA is in regular communication with the Health & Safety Executive (HSE) on various industry topics and guidance; however this invitation was an opportunity to directly address all of the Asbestos Licensing Principal Inspectors (ALPIs). Colin Seditas, Technical and Development Manager, represented ARCA at the conference. “Due to Colin’s previous experience of working for the asbestos regulator, he was in an ideal position to put ARCA members’ feedback of HSE’s inspections and assessments for
regulating asbestos work across the country,” commented Steve Sadley, Chief Executive of ARCA. “As an Association, representing the majority of UK-based asbestos removal contractors, this was a great opportunity to share some constructive feedback from the industry,” commented Colin. “Under the presentation title of ‘To see ourselves as others see us’, the main topic raised was in relation to the consistency of inspections and approach to assessments across HSE regions. All agreed that standards should be consistent - basically businesses across the UK require a level playing field.” “The feedback was received well and led to

positive discussion. I believe that speaking at this conference was very valuable, both to the inspectors and the industry,” concluded Colin. Archie Mitchell, Head of Asbestos Licensing Unit, commented, “I’d like to thank ARCA, and Colin, for the contribution at this year’s conference. It was exactly what was required and had a suitable challenging function.” ARCA and HSE have also discussed industry initiatives such as ARMI’s Competency Guidance, ARCA’s Institute of Leadership and Management approved courses and the practical application of the Health & Safety Laboratory’s (HSL) air management research.

s part of the Asbestos Liaison Group (ALG) sub-committee on Training and Competency ARCA assisted the subcommittee in producing industry guidance; ‘Competency within the Asbestos Removal Industry’, which was published at the end of last year by the Asbestos Removal Management Institute (ARMI). ARMI is please to announce that HSE has now endorsed this guidance as describing a sensible and appropriate approach to managing training and competency.
The document provides guidance on how to produce an effective competency management system, including Training Needs Analysis (TNA), and it is applicable to all categories of asbestos licence holders. It is the result of development work undertaken by the core members of ARMI, with the Health and Safety Executive (HSE) and its Asbestos Liaison Group (ALG) being fully consulted. Removal of asbestos in soils S
anctus Limited, a leading contractor specialising in the investigation, consultancy and remediation of contaminated land, has seen a massive increase in the identification and removal of asbestos in soils and made ground, over the last few years. As holders of a 3 year licence for working with asbestos, Sanctus has placed great emphasis on ensuring that employees are trained and competent to undertake work with asbestos on contaminated sites. A lack of guidance and training programmes within the contaminated land industry led Sanctus to search out the most suitable training provider. Training would need to be delivered in accordance with company TNAs
A new health and safety system strategy
D
uring the first two months of 2016 the HSE held a series of ‘Helping Great Britain work well’ engagement programmes. At these events vital discussions took place regarding the new strategy for Great Britain’s occupational health and safety system. ARCA was invited and attended the event in Birmingham on the 25th January. There was broad agreement amongst those attending the events that preventing harm to workers and the public is integral to businesses being successful and achieving sustained growth. The collective challenge is to ensure that this is known, understood and becomes embedded firmly in everyone’s thinking – and in all our actions.

After holding face to face discussions it was clear that ARCA fully understood the company requirements. Sanctus therefore commissioned ARCA to design and deliver a bespoke licensed supervisor course based on the identified training needs and taking into account the company’s standard operating procedures. The two day course covered topics such as decontamination procedures, wetting methods, RPE and PPE. “Feedback from the supervisors after the ARCA course was positive to say the least, after a number of years attending standardised industry led courses by other training

RCA has signed up to the Contamination Expo Series 2016 to be held on 12-13 October at ExCel London. The Contamination Expo Series launches this year to tackle solutions to contamination across six sectors, including hazardous waste. Held in association with the Environment Agency, the exhibition will co-locate with the successful Flood Expo. RSPH asbestos surveying & analysis qualifications gain Regulatory approval Qualifications delivered & assessed by ATaC now Ofqual regulated
A
TaC is pleased to announce that it has received approval from RSPH (Royal Society for Public Health), the regulated awarding organisation, to continue to deliver four asbestos qualifications which were recently approved for Ofqual registration. Ofqual (The Office of Qualifications and Examinations Regulation) is the regulator of qualifications, examinations and assessment in England, so responsible for making sure that: w regulated qualifications reliably indicate the knowledge, skills and understanding students have demonstrated w assessments and exams show what a student has achieved w people have confidence in the qualifications that Ofqual regulate w students and teachers have information on the full range of qualifications that Ofqual regulate The RSPH qualifications to gain this recognition are the Level 3 Awards in: asbestos surveying, asbestos air monitoring and clearance procedures, asbestos bulk analysis and asbestos management for duty holders. Gaining Ofqual accreditation means that these RSPH qualifications have met the required standards of the industry and are assessed at the appropriate level. So for candidates this means these qualifications

have received the stamp of approval from the regulator and there is assurance of high standards in all elements of the qualification. “We are delighted that these asbestos qualifications, which are unique to RSPH, have been added to the Register of Regulated Qualifications” stated Richard Burton, Head of Qualifications at RSPH. “This means candidates have access to nationally recognised qualifications. Also, as the awarding body we will continue to ensure that these qualifications meet the needs of the industry.” “Ofqual approval for these qualifications is excellent news,” commented Steve Platkiw, the ATaC Manager. “For candidates this gives assurance and comparability with other Ofqual recognised qualifications. Also, in the future this Ofqual status will benefit government funded apprenticeships for our industry.” As an RSPH approved centre for delivering these qualifications, ATaC undertook a thorough audit which covered a range of aspects such as, professional and consistent delivery and assessment, as well as, accessibility to qualifications and the welfare of candidates at ATaC’s facilities.

Personal Air Monitoring 1) ARCA is aware of concerns raised about the way personal air monitoring is routinely being carried out in the asbestos industry. Licence holders are advised to review • why they are collecting personal monitoring data • how data is being collected and • what is being done with the data. 2) Personal monitoring can be carried out for a variety of purposes. Many licensed contractors may be gathering data in a way that cannot be used to compare exposures with other jobs and cannot demonstrate meaningful personal exposure data. Licence holders also may be using sampling strategies that do not reflect a representative sample of their work and therefore cannot demonstrate effective performance. 3) Where this is the case, licence holders may be wasting significant time and money on sampling that adds little benefit or reassurance. This could also be seen as a wider failure of health and safety management when licence assessments are carried out.
a) Regulation 19 requires employers to arrange regular monitoring of airborne fibres and keep records of the results. Assessments of any proposed work must consider the results of this monitoring (regulation 6). The significant findings of asbestos assessments should be reflected in the plan of work (required by regulation 7). b) An organisation’s arrangements for providing information, instruction and training must include detail of any air monitoring results (regulation 10). c) Employers must ensure that personal exposure to asbestos is prevented, so far as is reasonably practicable (regulation 11). Licensed work, by definition, is likely to produce airborne concentrations that exceed the control limit: where exposure cannot be prevented, it must be kept as low as reasonably practicable. Respiratory Protective Equipment (RPE) provided must ensure that concentration of asbestos fibres within the respirator is kept below the control limit. d) The spread of asbestos must be prevented or reduced (regulation 16). e) Exposure records form part of the health records that must be kept for any employees engaged in licensed asbestos work (regulation 22). 5) Regulation 5 of the Management of Health and Safety at Work Regulations require employers to have effective arrangements in place for managing health and safety. Personal monitoring records should be an excellent indicator of performance and an aid to comparing and assessing removal situations. To achieve this, sampling must be planned and recorded in a meaningful way.

Legal requirements 4) The Control of Asbestos Regulations 2012 (CAR) contain numerous references to the requirement for personal and background monitoring.

Personal monitoring requirements must be considered when planning a job. The contractor should give the analyst clear instructions about the purpose of the sampling.

Sampling should be carried out for sufficient durations: shift duration (preferably 2-4 hour periods) or the duration of specific tasks being observed. Use the correct flow rate

6) Personal air monitoring can provide invaluable performance information: it should provide an accurate record of actual concentrations of airborne fibre generated by particular types of work in particular circumstances, and give licence holders confidence (and clients, regulators etc) that control methods are working, in practice. 7) In summary, CAR, the Approved Code of Practice and existing guidance give the following reasons for carrying out personal air monitoring: a) To check the effectiveness of the controlled method of removal (i.e. by comparison to previous concentrations of airborne fibre in similar situations and to the control limit) b) To provide data for personal exposure records c) To guide assessment (and planning) for future, similar jobs d) To confirm that appropriate RPE has been chosen.
Sampling: planning and engaging with the analyst 8) Decisions about the type(s) of monitoring to be done (and detail about how this will be carried out) should be considered at the planning stage. This will be reflected in the plan of work produced prior to notification and supported by standard procedures etc. 9) Effective monitoring will require good liaison and engagement between the licence holder and the analyst. The service agreement between the two organisations should make expectations clear (and take into account the issues described in this document). For example, if an analyst is expected to observe work activities during the sampling period, this may limit capacity for carrying out other types of air monitoring at the same time.
guidance notes Sampling methods 10) Sampling duration and flow rates a) So that sampling results can be compared between jobs, a standardised approach for gathering and recording is required. This should be specified in standard procedures and / or contractual arrangements with an appointed analyst. b) The control limit refers to a ‘time weighted average’ (TWA) of 0.1 fibres/cm3 of air averaged over a continuous period of 4 hours. Monitoring may also be carried out to assess fibre concentrations associated with particular short duration activities (“sporadic and low intensity” (SALI)), with reference to a 10 minute sampling period. c) Where the purpose is comparison with the control limit or gathering personal exposure data, HSE will expect sampling periods to be as close to 4-hour periods as is reasonably practicable; the results should be recorded as a 4-hour TWA. Analysts might use a succession of sampling periods, or a single shorter period that is representative of the work, but where this is the case licence holders should expect a clear explanation of the assumptions being made to report results as a 4-hour TWA. d) When considering exposures in relation to the 4-hour control limit, sampling rates should be 1 litre/minute. When taking shorter samples, for example in relation to “sporadic and low intensity” assessments and exposures, sampling rates should be 4 litres/minute. 11) Activity a) In the past, contractors have typically recorded the broad category of work being undertaken at the time of personal air sampling. For example, the sampling records may state “AIB removal”. This is not precise enough to allow for meaningful comparison between jobs. For example: the previous sampling might have involved a simple ‘clean’ activity of lifting boards from a grid; this can’t be compared against the removal of glued or nailed AIB. Relevant detail of the work activities should be addressed in a “suitable and sufficient” plan of work and might include: i) The scale of the work (1 small panel or 100m2 of panels?) ii) The type of fixings (screwed, nailed, glued, the presence of voids above AIB?) iii) Method of removal (Surfactant applied from above? Panels unscrewed whilst using shadow vacuum? Bagged or wrapped? etc.) iv) The condition of the tiles, surface treatments and ease of access etc. b) In addition, the analyst should also be able to give an opinion on the activity. Having observed the activity during the sampling period, did the control measures appear to be working effectively? Were there any difficulties observed? c) This level of detail about the actual activities being undertaken during the sampling period will be crucial for gathering meaningful sampling data. It is therefore important that the removal contractor gives clear instructions to the analyst: to provide meaningful data, analysts will be expected to observe what activities are taking place during the sampling period. 12) Records a) For useful comparisons, exposures should be recorded as TWA, unless the focus is on specific short-duration tasks. See the appendix, in the full ARCA Guidance Note available on the ARCA website, for a suggested ‘personal sampling’ template.
Strategies – planning sampling 13) It is common practice for licence holders to commit to sampling a percentage of jobs, depending on the type of material being removed (for example: 100% limpet jobs, 25% of AIB jobs, etc). As indicated above, this is not likely to be sensitive enough to provide a representative sample of the actual range of work being done.
14) Strategies for monitoring should be similar to strategies for targeting site visits / audits. I.e. they should ensure that a representative range of work is sampled. For example, the strategy should cover: a) A full range of work activities, as described above b) A full range of geographical locations: capturing ‘close to home’ and more remote work sites c) All supervisors / teams d) Over time, sampling should capture exposures to all operatives across a full range of activities. 15) For licensed contractors, a strategy should focus on activities expected to be higher hazard / risk. Over time, the strategy will ensure that a full, representative range of asbestos work is covered, but the focus of resources should be on activities where exposure is liable to be higher. For example: a) for ‘routine’ jobs, personal sampling is carried out during the actual removal activities where asbestos is most likely to be disturbed, not during set up; b) resources should initially be directed at licensed activities, rather than for sampling the removal of bonded products such as floor tiles or asbestos cement sheeting.
Recording and collating monitoring data 16) Licence holders may have collected monitoring data for many years. Unless that data can be clearly linked to particular asbestos activities, it may be difficult to use as a meaningful measure of performance or for meaningful comparison with current / future work. 17) In practice, many licence holders will need to define a better strategy for sampling and build a database of results for comparison. A licence holder’s strategy (as described above) should be described in company policies / procedures etc. Routine performance reviews and organisational targets etc could refer to the number (and quality) of samples being taken as well as recorded exposure levels for particular removal situations. 18) The appendix, in the full ARCA Guidance Note available on the ARCA website, provides a suggested template for gathering individual personal monitoring data. Analysts may provide additional, supporting records (stipulated by UKAS etc). 19) Individual monitoring results must then be collated and stored in a way that makes them easy to use in the future. For example, a database / spreadsheet a) should enable easy access to an individual’s personal exposure records b) should enable easy comparison / reference to levels of exposure ‘achieved’ during similar activities. 20) The Approved Code of Practice (paragraph 486) stresses that personal monitoring results should be “collated and submitted to HSE” as part of the licence renewal procedure. In practice, HSE’s ALPIs do not routinely ask for this information in advance. However, licence holders should expect monitoring results to feature in licence assessment meetings: they are likely to be seen as a critical indicator of how licence holders measure performance and assess risk.

or Licensed Asbestos Removal Contractors (LARC’s) the auditing of site activities has been a longstanding mandatory requirement of ARCA membership.
During an ARCA site audit, an LARC is assessed against approximately 100 predetermined criteria, which are all based on regulatory requirements, associated HSE guidance and current best practice.
The requirement has been for all Full Contracting ARCA Members to undertake a minimum of two site audits per year on a programmed basis. These audits form a vital element for LARC’s to facilitate their own performance monitoring – reviewing the ways in which a job has been planned, and how well those plans have been implemented on site. These site audits are scheduled to coincide with actual removal works, so between the smoke test and the commencement of the 4-stage clearance process.
Among the benefits for the LARC’s is the feedback available from this performance monitoring exercise at a time when they may least expect a visit. Despite the unannounced element, it is hoped that site performance and standards demonstrated through unannounced site audits will be no different to those shown through the current scheduled audits. Unannounced audits give ARCA members the opportunity to demonstrate that the standards required for ARCA membership will be evident on any site at any time.
Announcing the
Unannounced ARCA is now in a position to conduct site audits on an unannounced basis, whereby the company being audited has no knowledge of when or where their site audit will take place. This pioneering scheme is being trialled throughout 2016 with a view to becoming the future of all ARCA site audits under the Site Audit Accreditation Scheme. Checking performance against a range of pre-determined measures is one of the most frequently used techniques of monitoring. However, you need to be sure that your monitoring adds value and isn’t just a tickbox exercise. “Conducting site audits on an unannounced basis will certainly add value to the existing scheme” commented Geoff Silver, ARCA’s Membership Compliance Manager.

“Early reactions from ARCA members have been very positive”, stated Geoff Silver. “One member commented that their current organisational culture is to expect a visit on any job at any time, so a surprise visit should cause no inconvenience or disruption whatsoever. A
n Oxford based company has been fined after disturbing asbestos insulation board (AIB) at a school. Northampton Magistrates’ Court heard how Amey Communities Limited (ACL) were contracted to carry out roof refurbishment at Lings Primary School, Hayeswood Road, Northampton. During the course of this refurbishment workers from ACL disturbed AIB in a small plant room. An investigation by the Health and Safety Executive into the incident which occurred on 6 November 2014 found failings in ACL’s project management arrangements. They failed to monitor and identify asbestos materials during this specific roof refurbishment work at the school and ensure key personnel had suitable asbestos awareness training. Amey Community Limited, of Edmund Halley Road, Oxford, pleaded guilty to breaching Regulation 13(2) of the Construction (Design and Management) Regulations 2007, and was fined £20,000 and ordered to pay costs of £1,737.

food company and their contractor have been fined after asbestos was disturbed during building work and only identified by chance when an asbestos removal contractor attended site. Stafford Crown Court heard no asbestos survey had been carried out by Mizkan Euro Ltd or D H Welton & Co Ltd and either company could have commissioned a refurbishment/demolition survey before the work commenced. An investigation by the Health and Safety Executive found Mizkan Euro Ltd were undertaking a project to remove tanks from a factory which required the demolition of an external wall. They failed to provide an asbestos survey to enable their contractor DH Welton to quote and plan appropriately for the work to be undertaken. However, it also found DH Welton could have commissioned a survey when they discovered that Mizkan only had access to a management survey for the building. When the wall was demolished asbestos insulation board at the top of the wall was unknowingly broken up. A skip of demolition debris was found to contain asbestos insulation board, which had been identified by an asbestos contractor who had been called to site. For the
work to be undertaken correctly, a licensed asbestos removal contractor should have been appointed to remove the asbestos under controlled conditions prior to the wall being demolished. Mizkan Euro Ltd of Chiswick Park, Chiswick High Road, Chiswick, London pleaded guilty to breaching sections 2(1) and 3(1) of the Health and Safety at Work etc Act after failing to plan and manage the work carried out under their control without ensuring that risks to health and safety are prevented. It was fined £60,000 for each charge (£120k) and ordered to pay costs of £13,589. D H Welton & Co Ltd of Corn Street, Failsworth, Manchester admitted breaching Section 2(1) and 3(1) of the Health and Safety at Work etc Act and regulation 5(1)(a) Control of Asbestos Regulations 2012 after failing to carry out a suitable and sufficient assessment as to whether asbestos was present or liable to be present during the removal of a wall It was fined £15,000 for each charge (£45k) plus costs of £4,529.

n employee exposed his workers to asbestos fibres during the refurbishment of a social club in Ashington, Northumberland. Mid and South East Northumberland Magistrates’ Court heard how on purchasing the club, Timour Haghkar failed to have an asbestos survey carried out and as a result was unware of the presence of Asbestos Insulating Board (AIB) within the Excelsior Social Club building. The refurbishment works disturbed the AIB and no suitable controls were in place to protect the workers from the fibres produced or restrict the spread of those fibres. An investigation by the Health and Safety Executive (HSE) found that Timour Haghkar
removed the AIB in an uncontrolled manner and without using a licenced asbestos removal contractor. Timour Haghkar, of Woodhorn Road, Ashington, Northumberland was fined £560 after being found guilty of breaching Regulations 5 and 16 of the Control of Asbestos Regulations 2012. The company was also ordered to pay £795 costs. In addition to the fines imposed by the court Timour Haghkar has also been charged £8,391.29 in fees for the cost of the HSE investigation as well as having to pay out £36,000 for the subsequent safe removal of the asbestos waste by a licenced asbestos removal contractor.

Man fined for unlicensed removal of asbestos A
Surrey man was fined for exposing the residents of a house in Putney, himself and his assistant to asbestos. Westminster Magistrates’ Court heard how the owner of a three-storey town house in Putney was upgrading the central heating system of his home when his plumbers identified that the boiler cupboard in his loft was made of material they believed could contain asbestos. The owner contacted Dean Callaghan of Esher, Surrey, trading as Rubbish Taxi, after searching on the website, Checkatrade for asbestos removal companies. Dean Callaghan carried out the removal of the boiler cupboard, assisted by another worker, on 28 December 2014. During that day the homeowner witnessed panels of asbestos containing material (ACM) being carried down four flights of stairs. These panels were not bagged or wrapped, potentially spreading asbestos through the house. After the work was completed, he discovered a lot of dust and debris had been left in the loft area. He contacted an asbestos surveying company who sampled this material and found the loft to be widely contaminated with asbestos. The samples indicated that the material removed was probably asbestos insulation board (AIB). The homeowner
had ultimately to engage a licensed asbestos contractor to carry out an environmental clean of the loft area in his home to remove all asbestos debris. An investigation by the Health and Safety Executive (HSE) into the incident, identified that Dean Callaghan had removed approximately 8m² of asbestos insulation board and that the removal was poorly carried out. Work of this nature should only be carried out by companies who hold a

licence granted by the HSE and, although he had been on a training course for low risk, nonlicensable work with asbestos, Mr Callaghan did not hold such a licence. Dean Callaghan, of Hillcrest Gardens, Hinchley Wood, Esher, was fined a total of £2,500, with costs of £701 after pleading guilty to an offence under Regulation 11(1) of the Control of Asbestos Regulations 2012

Cinema director fined for asbestos management failings
A
St Albans cinema director has been fined after he put workers and members of the public at risk of exposure to asbestos. James Hannaway, 68, from Berkhampstead, the sole director of The Alpha Cinema (St Albans) Limited was prosecuted by the Health and Safety Executive (HSE) after he allowed refurbishment of the derelict multiscreen cinema to begin in 2010 without proper checks for asbestos. Stevenage Magistrates’ Court heard that in April 2012, James Hannaway went on to engage around 30 members of the public to remove the debris from the demolition work over the course of two days.

An asbestos survey was eventually carried out in early October 2012, which identified the presence of asbestos in the building (after the debris removal), and recommended that no-one entered the affected areas. Despite this, the court was told Hannaway was seen taking people into the building to view the ongoing work. James Hannaway of Waterside, Berkhampstead, Hertfordshire pleaded guilty to breaching Section 3 of the Health and Safety at Work etc. Act 1974 and to breaching Regulation 5 of the Control of Asbestos Regulations 2006 and Regulation 16 of the Control of Asbestos Regulations 2012. He was fined £11,660 and ordered to pay £7,000 in costs.
construction firm removed an asbestos ceiling in a school despite not being legally approved to do the work. Luton Magistrates’ Court heard that Clarks Construction Limited were contracted by the Board of Governors of Caddington Village School to refurbish changing rooms, toilets and associated areas at the school complex. The school had arranged for a specific refurbishment survey to be carried out for the presence of asbestos. The survey identified the presence of asbestos in a ceiling of one of the rooms. Clarks Construction Limited removed the ceiling in August 2013 without consultation with the school or effective reference to the asbestos survey. Clarks Construction Limited, of Windsor Street, Luton, was fined a total of £3,300, and ordered to pay £662 in costs after pleading guilty to a breach of Regulation 8(1) of the Control of Asbestos Regulations 2012 for carrying out the work which, given the inherent level of risk involved, requires a licensed contractor.

Wrapping of large items Many readers will be aware that for many years we have been concerned that the requirements of CAR 2012, regulations 16 & 24, and the ACOP (529 & 530) are not compatible with the ADR/CDG Regulations. ADR states that all UN2212 and UN2590 fibrous asbestos must be transported in UN-tested packaging while the CAR regulations and supporting ACOP prohibit the unnecessary breaking up of asbestos waste and requires large items, such as lengths of lagged pipe, to be wrapped twice in polythene instead. This could cause problems with enthusiastic enforcement officers, but more worryingly, could give insurers a reason to refuse to pay out in the event of a claim. We recently instigated a meeting with the HSE, the Dept. for Transport and ARCA to explain this issue and discuss possible solutions with all key stakeholders simultaneously. Our proposal that the DfT issue an Authorisation to permit the wrapping of large items was agreed. A copy is available at https://www. gov.uk/government/publications/carriage-ofdangerous-goods-authorisation-465 Although we requested that the Authorisation be valid for several years, the
DfT was only prepared to grant it until 31st January 2017, while ARCA (with our guidance) attempts to source suitable UN-tested packaging for items too large for currently available packaging.
What do you have to do differently now? Not much, continue to wrap large items of fibrous waste twice and secure with tape as described in the Authorisation, then fix a UN bag on the package. However, you must now carry a copy of the Authorisation on your vehicle. Please note that this Authorisation can only be used by HSE licensed asbestos removal contractors and waste carriers, registered with the Environment Agency, Scottish Environment Protection Agency or National Resources Wales, who subsequently transport waste packaged in this way, to transfer station or landfill.

Environment Agency News Premises Registration From 1st April 2016, the requirement for businesses producing, storing or handling 500kg or more of hazardous waste annually in England will no longer need to register the premises with the EA. This change only applies to premises in England, premises in Wales must continue to be registered with Natural Resources Wales.
Consignment Notes This change will cause a revision to the format of the Hazardous Waste Consignment Note, although a sample has not yet been published. It is expected that the only change to the layout will be in Part A with the removal of A3, the premises code. However, this will mean that English and Welsh consignment notes will be different. Each consignment note will still need a unique consignment note number, which is valid for only one consignment. The first six digits will become the first six letters/numbers (not symbols or spaces) of the waste producer’s name from A5, e.g. ASBEST. In the unlikely event of the company name being less than six letters, then Qs must be used for the missing ones, e.g. A1LTDQ. Businesses must ensure
consistent use of these six letters or numbers. “Exempt” will no longer be used. The EA’s view is that it will not be a problem where many companies have the same first six letters, or there are multiple branches of the same company, as they will be able to identify the company by the postcode. For consignee returns, the EA is saying that there will be no change required as the return has to provide the postcode anyway, so again, they will use the six letters of the company name with the postcode to identify producers. The second five digits can then be any combination of letters and numbers as before. However, where the waste is flytipped, the letter F must then be added to the five. Legally businesses are still required to use the current format on consignment notes up until 1 April 2016 and those with a valid premises code will be able to continue to use it until 30 June if they want. The changes to the format of the consignment note code, which appears on every consignment note, only apply to consignments starting in England. Consignment note codes for wastes originating in Wales, Scotland or Northern Ireland are not changing at this time.
SIC codes Again in England only and from 1st April, the SIC codes (Standard Industrial Classification codes) on Hazardous Waste Consignment Notes will change. The Environment Agency will no longer permit the use of SIC 2003, and will require SIC 2007, which matches the requirements for waste transfer notes used for non-hazardous waste. So, from that date, you must use the 2007 SIC code in Part B, for example Asbestos Removal Work was 45.25 under SIC 2003, it becomes 39.00. Demolition moves from 45.11 to 43.11.

hodar was commissioned by The Silvertown Partnership as Principal Contractor, as part of the £3.5billion Docklands Silvertown Regeneration project to oversee the process of returning the Millennium Mills building back to its original structural shell. This is in preparation for its development into a multi-use centre for new business and enterprise. Throughout 2015, Rhodar successfully removed a range of hazardous materials, using specialist techniques that ensured many of the original building features could be retained. Amongst other waste and recyclables, this resulted in the removal of over 660 tonnes of Asbestos Containing Materials (ACMs) over a 10 month programme period.

The iconic former flour mill is located on the Royal Docks alongside London Excel, the City Airport and the Thames Barrier. The sheer size and scale of the mill meant Rhodar had an extremely challenging task on their hands, but one that they mastered from the outset; through intricate planning and multi-disciplined, standard-setting methods. The 11-storey industrial mill occupies 55,000 cubic meters and sits within a site spanning 50 acres, it has been referred to as the last ‘part of the jigsaw’ for the regeneration of East London. On completion, the building is set to house half a million square feet for commerce and industry in the heart of the Docklands. At the beginning of the project, a number of challenges presented themselves, the entire building was structurally unsound and an extremely hazardous environment. Before any
activities could commence, all openings, drops and unsafe flooring had to be identified and then made safe for working. Rhodar achieved this by engaging with structural engineers so that a sequential working plan could be agreed and implemented. Rhodar’s large workforce utilised a precision ‘dustless blasting’ technique to facilitate the skilled asbestos removal process. This type of process uses specialist recycled substrates and was the most effective and efficient method to remove asbestos paint coatings on such a large scale; stripping back the surface of the walls and ceilings to the required ‘raw’ state. In order to preserve the heritage of the building and to follow the architectural design specifications, some of the most historical features, such as the existing mill equipment and delicate sought-after fixtures had to be

ast November 150 ARCA members and their guests enjoyed a superb evening’s entertainment at the ARCA Winter Party. The party was held at the newly refurbished Belfry Hotel & Resort in Warwickshire. The luxurious guest rooms, fine dining and new leisure facilities, supports the stunning world class golf course. Guests sat down to a three course meal while enjoying a fun night’s entertainment hosted by Ian Irvine with 70’s music provided by the Boogie Wonderband. Guests took the opportunity to dance the night away into the early hours! During the evening guests took part in a game of heads and tails, raising £1,240 for charity, in addition there was
a charity auction which raised a further £11,330. A grand total of £12,570 was raised for the charity. Charity monies for this year will be divided between the Chairman’s charity, the Indee Rose Trust, and the Association’s charity, Mesothelioma UK. The Indee Rose Trust is a charitable trust founded in July 2009. Their aim is to help children and their families who have been diagnosed with a brain or spinal tumour. Mesothelioma UK is a national resource centre dedicated to providing specialist mesothelioma information, support and improved care and treatment. A huge thank you to all who made donations during the evening, you can be confident that all money raised will be going to an extremely worthy cause.

ational asbestos and risk management specialist, Lucion Environmental is well on its way to becoming Level 2 building information modelling (BIM) certified ahead of the UK Government’s October 2016 target to electronically validate BIM information delivered from supply chains. Level 2 BIM will apply to any Whitehall

contracts procured for construction, regardless of their size or value, meaning that non-compliant building services companies will lose out on work. Principle contractors as well as their supply chains will feel the impact if they’re not prepared in time. Existing building plans are enhanced with 360º panoramic images and icons to locate hazards and safety equipment, which are then linked to web-based NexGen asbestos records. Lucion is working to develop the specialist technology for facility managers, project managers and safety managers who need to clearly communicate, what, where and how to mitigate asbestos safety risks. In its simplest form 2D plans are provided which for most buildings and facilities will be sufficient. Where the site is a more complex environment, 3D sets can be created using existing 3D designs or by deploying the use of the latest 3D laser scanning techniques to build a model from scratch. Charles Pickles, finance director at Lucion, said: “The race is on to be fully prepared for the legislation coming into force and we’re well on our way to achieving BIM level 2 certification. Building information models contain the design of a building and all of the data concerning the properties of its components, its construction and ongoing maintenance. At Lucion, we have a duty to ensure that clear asbestos information is provided to every person liable to disturb asbestos and BIM provides a quick and efficient way of doing that.”

oday a number of major construction companies are requiring workers who have management and supervisory roles on-site to have undertaken the SSSTS training course. To support our members ARCA has partnered with a training provider to supply the Site Supervisors Safety Training Scheme (SSSTS) course, nationally and at a competitive rate of £225 (exc vat) per delegate. The course is run over two days and provides an introduction to health and safety, welfare and environmental issues for those requiring an understanding of their legal responsibilities relevant to their work activities.
By providing a sound knowledge base, the course will enable delegates to give valuable assistance in safely managing a construction site. It can also be used as a precursor to attendance on the five-day Site Management Safety Training Scheme (SMSTS) course. Overview: This training imparts knowledge of those elements of the transport and waste regulations applicable to asbestos and ensures legal compliance with ADR and The Carriage of Dangerous Goods and Use of Transportable Pressure Equipment Regulations. These regulations require the employer to ensure that all staff involved in the transport of dangerous goods have received training in the general requirements of these regulations and also the specific requirements of the regulations which are appropriate to their duties.
Overview: This course covers: current legislation, regulations and guidance affecting working from low level access units and standard mobile access towers; PASMA Code of Practice, PAS250 (Publicly Available Specification); assembling, altering and dismantling, incorporates current best practice for fall protection, inspection of both low level and standard mobile access towers; tower inspection records; hazards affecting the use of units and platforms.
This applies to all operatives loading fibrous asbestos into skips, drivers moving exempt loads (all other drivers must hold an ADR licence) and crew travelling in the same vehicle as fibrous asbestos waste (in any quantity), as well as management, supervisors, admin staff and storemen.
n Safe Electrical Isolation of Low Voltage (City and Guilds Accredited) Duration: One day Overview: This course provides staff with the knowledge needed to perform safe isolation of low voltage systems and equipment. Assessment methods include a multi-choice examination, a written examination and a practical assessment.
n Working at Height Awareness Duration: Half-day Overview: This training session is intended as the foundation for working safely at height. Delegates will be provided with the basic information required for anyone tasked with or affected by work at height to ensure safety in the workplace. It does not cover any specific skills required to carry out a work task or to use specialist height safety equipment; these skills are dealt with by other training sessions. The course will identify the relevance and implications of the Work at Height Regulations 2005 so that the individual can comply with his/her duties, whether planning, controlling or conducting work tasks at height.
n Abrasive Wheels Awareness Duration: Half-day Overview: This course is designed for any person who may be required to use an abrasive wheel in the workplace or requires familiarisation with the associated regulations. Delegates will leave with a thorough understanding of the hazards associated with the use of abrasive wheels and be able to comply with the Provision and Use of Work Equipment Regulations (PUWER) in the safe mounting of abrasive wheels and discs on portable machinery.
n Confined Spaces Awareness / Entry Duration:Half-day and one day Overview: The aim of this course is to prepare trainees to enter and exit confined work spaces in safety. First ARCA candidates to receive NVQ certificates Rhodar Operatives receive Diploma
I
n January ARCA was pleased to announce that three candidates from Rhodar received their certificates for successfully completing the NVQ Level 2 Diploma for asbestos removal operatives. To gain this qualification the operatives undertook on-site assessments to demonstrate their abilities to the ARCA assessor, so providing actual evidence of their competency. Following this the ARCA assessor produced a portfolio of evidence for each candidate which were then submitted to the CITB National Specialists Accredited Centre (NSAC) for verification. “Congratulations to Jake, Gary and Chris on gaining their NVQ Diploma,” said Satish Patel, Training Manager for ARCA. “After a successful pilot we offer this NVQ to all our members to support CSCS card applications and also support members who pay the CITB levy as they can apply to the CITB for grants. My thanks to Steve Hyatt, from NSAC, for his support during the development of our assessment strategy.”
