Changing Times Continue

A

s we approach the end of the year the spectre of COVID-19 still hangs over us, as it has done for most of the year. The recent news about the early success of the vaccine trials does at least give us some hope that the worst is almost over, and the situation has the prospect of improving as we move into next year, let us hope so.

One of our events that suffered because of COVID-19 was the ARCA Annual General Meeting. We are legally obliged to hold an AGM at least once every calendar year and so needed to hold an AGM before 31st December 2020. With no real prospect of the COVID-19 restrictions being lifted before the end of the year the decision was taken to hold the AGM remotely on the usual first Friday in October, which this year was October 2nd. The event was held via Zoom and in the region of 100 people logged on to watch the proceedings from the comfort of their office or home.

During the AGM the outgoing Chairman, Jason Davy, introduced various members of the ARCA Management team to give presentations on the work that had been done by the Association over the past 12 months.

Much of the content of these presentations is reproduced in various articles throughout this issue of ARCA News. The final act of the 2020 ARCA AGM was for the outgoing Chairman to welcome and introduce the incoming Chairman, Scott Murray of ECT Environmental Ltd. Scott gave the incoming Chairman’s address and reflected on the original goals of the ARCA founder members, which were to promote professionalism and improve standards within the industry, something Scott vowed to continue to strive to achieve.

Last month we completed the second round of regional meetings via Zoom. While not a substitute for getting out and meeting members around the country, it at least keeps us in contact and allows us to provide you with the industry updates that I know you want to hear about at these meetings. I am hoping that we will be able to resume face to face regional meetings at some point next year. I imagine that the meetings planned for February will still have to be remote, but it would be nice to think that we can have a face to face meeting at the usual regional meeting venues by the summer of next year. When face to face regional meetings do resume, we are planning to add a remote meeting to

the usual series of meetings. This will allow members who cannot make the face to face meetings for whatever reason to participate in the regional meetings. The same philosophy applies to our training provision, the remote courses we have developed will continue to be delivered alongside our face to face training courses even after COVID-19 restrictions have passed.

In the previous edition of ARCA News, I was pleased to be able to report that the Asbestos Labour Feedback App (ALFA) had been launched. In this issue I am delighted to be able to inform you that ALFA goes from strength to strength. As of the date of writing this Chief Executives Comment (23rd November 2020), there are over 840 operatives registered on the App, that means over 840 operatives have accepted the invitation to register on ALFA and to submit themselves for ratings while working on ARCA members asbestos removal sites. Over 1,700 ratings have already been submitted and over 120 operatives have already been given at least 5 ratings and as such awarded an overall performance rating. Members are already reporting that the competency of the shortterm operatives they are sourcing from labour suppliers is noticeably improved because of the introduction of ALFA. It is great to see that ALFA is having the effect on the industry that we hoped it would. We will continue to support and develop the App, so continuing to provide a valuable tool for all parties who are committed to improving professionalism and standards within the industry, namely ARCA, ARCA members, ARCA Labour Supply members and the short-term operatives they supply.

Finally, with the year coming to an end, I would like to take the opportunity to wish all our members and readers a very Merry Christmas, and let’s hope and pray for a much better year to come in 2021.

obs continue to be inputted into ALFA, the Asbestos Labour Feedback App, and the registered operatives placed on these jobs are being rated.

ARCA member contractors are registered in ALFA, with over 55 having had or have a job in the App, and therefore have rated the agency operatives they have had working on site.

Infact, over 1,300 operative placements have now been made in ALFA. There are over 840 operatives registered in ALFA, with over 120 who have already received over 5 ratings so have an overall performance rating.

It is positive to see that the average

rating for all operatives on the system over the last 12 months is 4.9, where 4 is generally satisfactory and 5 is good.

Gathering ratings for operatives on all their placements, usually from multiple contractors, and then calculating an overall (average) performance rating, provides some reassurance to contractors of operatives’ competency before arriving on site. The main aim of ALFA. Also, the certificate management system within the App, is proving helpful to agencies and operatives, especially as certificates are flagged 30 days prior to expiry.

A wide range of asbestos training courses is available, centre-based and remote, to fit your business and staff needs. Also, operative and supervisor refresher courses have been scheduled on selected Saturdays.

Members don’t forget to use your training credits for an ARCA training course, including Saturday training, or towards another ARCA service.

ARCA Virtual Annual General Meeting 2nd October 2020 The COVID-19 pandemic has had a major impact upon many of ARCA’s activities over the majority of 2020 and the Annual General Meeting was no exception.

In keeping with many business meetings this year, the ARCA AGM was held virtually and online for the first time.

The Chairman, Jason Davy, welcomed everyone to the meeting and started by thanking all the staff at ARCA, and said that even with all the problems and issues over the last few months the ARCA staff had done an exceptional job in continuing to support members. The Chairman thanked the Governing Council members who had also given up a lot of time and effort during the lockdown period.

The Chief Executive, Steve Sadley, reflected on the past year and said when the unprecedented step to lockdown the nation was taken, the first thing ARCA did was cease face to face training and site auditing, followed by furloughing most of the ARCA staff from 1st April. A small nucleus of 5 staff, working from home, was retained to ensure we could still provide the service members needed during the lockdown.

The Chief Executive also reported the following.

As a result of the first lockdown, ARCA began developing and delivering remote training courses such as RPE maintenance and COVID-19 Safe Working, which were delivered free to members and their staff throughout April, May and June via Zoom.

ARCA also developed the operative, supervisor and contract manager refresher courses to be delivered remotely, and adapted the training centres so that ARCA could deliver face to face training and NVQ assessments in a COVID-19 secure way.

More ARCA members are naturally moving to 3 site audits per year as their memberships renew. ARCA auditors resumed conducting site audits on June 1st and revision 13 of the Site Audit form was introduced, which along with some refinements to existing audit criteria, also included criteria to assess whether suitable COVID-19 precautions were being implemented on site.

The Asbestos Labour Feedback App (ALFA) was mentioned, and it was explained that it had been produced in response to members telling ARCA that their biggest problem was the quality

and competency of labour. The Chief Executive gave a special mention to the ARCA Labour Supply members, who had been key to the development of the App and thanked them for their help and assistance.

The Chief Executive said that If nothing else, when it has passed, COVID-19 will have left an indelible mark on ARCA’s operations. He said that he could see ARCA continuing to offer training and assessments, delivering member services, and conducting meetings remotely for many years to come, in addition to the face to face offerings that ARCA had traditionally provided.

The Chief Executive was proud to report that once again, the Association’s ISO 9001 Quality Management certification for membership services, training and auditing had been retained. With no non-conformances or opportunities for improvement identified. ARCA was also assessed against the Investors in People standard and was delighted to be awarded the silver award at the first attempt. Both awards, Investors in People Silver and ISO 9001, are testament to the way that the ARCA staff go about their work and the workplace culture they create.

New ARCA Chairman Scott Murray was introduced as the new ARCA Chairman and gave his incoming Chairman’s speech. He said that the original goals of the founder members of ARCA were to promote professionalism and improve standards.

His aim is to maintain ARCA’s position in the industry by providing the most comprehensive up to date portfolio of training to its members, including the expansion of webinar training courses that meet members’ needs.

The new Chairman said that practical training will always be a necessity with several of our training courses, and as such, it remains of paramount importance that the high standards of hygiene and social distancing are maintained within our many regional centres.

The Chairman remarked that it has often been stated, incorrectly, that ARCA only serves the larger organisations, and that future Chairmen are only selected from those companies, well clearly that is not the case. He went on to impress that every full contracting member has access to all the benefits of membership regardless of the size of their respective companies.

Let’s hope that next year we can have a face to face AGM. As ever, the date for the ARCA AGM is the first Friday of October, which in 2021 is 1st October.

This award is not for just one excellent audit in one year but for 6 consecutive excellent membership ‘unannounced’ audits spanning up to 3 years.

“This gold award is very significant and meaningful to the contractors, and also to their end-clients,” commented Geoff Silver, Membership Compliance Manager for ARCA. “This award is evidence that high standards and good practice is maintained over a lengthy period of time and over various removal jobs. Also, ARCA’s audits are unannounced, so the contractors have no idea that an auditor is coming on site to review their performance, so giving a more realistic view of a contractor’s usual performance.”

Under the Association’s membership audit scheme, contractors undertake three ‘unannounced’ site audits every membership year. These audits need to be passed satisfactorily for the company to maintain membership. For the Gold Site Audit Award, asbestos removal contractor members need to achieve Grades A-C, with an average of at least a Grade B, in 6 consecutive membership audits.

ARCA is committed to continually improving standards, so providing clients with a high level of reassurance.

By delivering asbestos training courses and undertaking assessments, as well as claiming CITB grants for members, an annual CITB audit reviews the quality of all ARCA’s training processes and procedures.

Following these processes and procedures demonstrates ARCA’s ability to consistently provide quality training and assessments.

Also, the audit covers training and NVQ documentation, such as, lesson plans, internal reviews and assessment evidence.

THE HARDENING INSURANCE MARKET IN THE ASBESTOS INDUSTRY and how this affects your Commercial Insurance

A

ll industries go through cycles of expansion and contraction, and the insurance industry is no different. In insurance, we run on cycles of ‘hard’ and ‘soft’ markets, both of which can impact commercial businesses in different ways.

Currently, the market is hardening, and this means that the demand for insurance exceeds the supply available by insurers. Characteristics of a hard market include low competition among insurers, increased premiums, reduced coverage, charges for cover extensions, harsher interpretation of claims and in some cases, there will be no cover available for clients. In short, a hard market can make it extremely difficult for a business to obtain commercial insurance cover at an affordable rate.

This is not the first time the UK has experienced a hard market however, this is the first hard market we have experienced since the early 2000’s, a significant period of time.

What has caused the market to harden?

There have been several events and factors in the lead up to 2020 that have contributed to the hardening market: 1) Solvency II – Insurers are having to double their reserves to meet the Solvency II requirement, leading to lower investments and less profit. Many insurers will therefore write less business or reduce their appetite to meet these requirements.

2) Ogden rate change – The negative Ogden rate has significantly increased

Liability rates, meaning large Personal Injury claims are here to stay for the foreseeable future. Therefore, the rates of most Motor and Liability books have had to increase to cover these additional insurer costs.

3) Low Commercial Property Insurance rates – At the end of 2019, the property insurance market was running on loss making rates. Regardless of what was to happen in 2020, these rates would increase.

4) Flooding – Despite the market already losing money, it is estimated that Storms Dennis and Ciara at the start of the year could cost the industry over £500 million in Property Damage and Business Interruption claims. Unfortunately, due to climate change, flooding is only going to get worse and insurance rates will need to increase to reflect this.

5) Reinsurance rates – Reinsurance premiums are rising significantly, well into double figures and are estimated to increase by over 20%.

6) Interest rates at an all-time low – Insurers will have to set rates for profit, not just for growth as they do not have investment income to rely on as they have in past times.

7) COVID-19 – Although most COVID-19 disruptions were not covered by insurers, the small percentage of business interruption coverages that will respond are estimated to cost insurers billions of pounds. The full impact on the insurance sector with regard to other classes of business such as Directors and Officers together with Liability Insurance is yet to be established.

How does this affect my commercial insurance?

Unfortunately, a hard market has a negative impact on commercial insurance clients as insurers will write fewer insurance policies, some will pull out of certain markets and fewer insurers will be competing for new customers. As a result, it will often become difficult for a business to secure cover at a similar premium as rates are likely to increase at the next renewal, particularly for those operating in high-risk industries such as asbestos. These measures are not a way for insurers to protect profits, instead they ensure the insurer is financially secure enough to protect, insure clients and pay claims.

Every Audit tells a Story Every audit that is undertaken should be done to provide information about performance. If it is not going to tell us anything, we should question why it is even being done. Whether an audit identifies numerous non-conformances, or ideally none at

he most common approach to health and safety management is the ‘Plan, Do, Check, Act’ approach. This is favoured by the Health and Safety Executive (see publication HSG65, Managing for Health and Safety), and forms a core principle of the ISO standards 9001 (quality management systems) and 45001 (occupational health and safety management systems). This approach also forms the basis of licence renewal assessment by the Asbestos Licensing Unit.

A site audit should evaluate how thoroughly a job has been planned (‘Plan’), that the control measures detailed in the plan have been implemented on site (‘Do’), and the inspections, measurements and other checks made to demonstrate the effectiveness of those control measures throughout the job (‘Check’). The ‘Check’ stage includes the frequent inspections and measurements made by the site supervisor, air testing by the appointed analyst, and site audits whether conducted ‘in-house’ (an internal audit) or externally by an independent organisation such as ARCA. The value of the information obtained from audits is dependent on a number of factors, including: w the relevance of the ‘question set’ w the competence of the auditor w the reliability of the information generated w the consistency of approach w the extent to which the findings are acted on

The Relevance of the ‘Question Set’ The Plan of Work should be a practical and useful document, compiled prior to the 14-day notification period for the work, describing a safe working method for staff to follow. It should include details of the work, and the appropriate actions to control risk and prevent

audits it may tell us a story that we don’t particularly want to hear, but nevertheless we need to hear so that required actions can be taken.

Asking the right questions goes a long way towards establishing the true story that unfolds on site.

The Competence of the Auditor

harm. The audit should thoroughly assess the Plan of Work’s fitness for purpose, as the Plan of Work is a tool to measure how effective a business is in managing their work with asbestos.

The audit of the Plan of Work element should assess its completeness in addressing the key requirements, that the chosen methods and control measures are suitable for the asbestos containing material being worked on, and are in sufficient detail relating to the complexity of the job and the risks present and likely to be encountered. It should present clear, precise and unambiguous instruction to the site team, and the audit ‘questions’ should be of sufficient relevance to explore these key requirements. An example ‘question’ would be one to establish that “the selection of negative pressure unit in use is correct and fully demonstrated within the Plan of Work”.

Likewise, the audit should explore the extent of compliance by the site team in following the details contained in the Plan of Work, which by default should demonstrate full legal compliance. Following a suitable and sufficient Plan of Work is one of the standing licence conditions for the licensed asbestos removal contractor, and so the audit needs to be thorough in establishing compliance or otherwise. An example question could be one that records whether “waste is properly and promptly bagged”.

Similarly, the audit should establish that the required checks have been made and recorded (most of these will be by the site supervisor), and to establish, by a representative number of auditor checks, that the records are complete, reliable and accurate.

Hopefully, an audit will tell us the story we would want to hear, being an accurate and in-depth representation of what was found on site. Occasionally

There is currently no qualification available relating to demonstrating competence as a site auditor for asbestos work. Therefore, any asbestos related qualification will at least help to demonstrate familiarity with the industry, though relevant experience is that major factor in demonstrating competence. An auditing qualification, such as one relating to ISO9001:2015 or ISO45001:2018 would also be beneficial.

The fact that licensed contractors need to prepare site specific Plans of Work, rather than just generic method statements, confirms how individual each job is likely to be. The auditor will need sufficient experience to be able to audit the full range of jobs that could be encountered, all of the different scenarios that could be presented, and be aware of any situation where better planning would have resulted in a better selection of site arrangements and procedures. Ideally, there should also be a comprehensive standardisation process in place for organisations conducting audits to ensure consistency of auditors in approach, in drawing conclusions and in recommending actions, such as ARCA has implemented within the audit programmes provided for ARCA members.

A competent auditor, with the relevant support from a reputable organisation, will go a long way towards ensuring the audit story told is accurate and conducive to raising and maintaining the high standards expected of the permissioning regime of licensed asbestos removal.

The Reliability of the Information Generated The relevance of the question set and the competence of the auditor are major factors in giving an accurate account of the performance of the licensed contractor, both in planning and executing the plan. The competence of the auditor, and the support system of their organisation, are also a major factor in ensuring reliability of the information generated, and thus the reliability of what the audit findings are telling us.

For instance, the ARCA audits are graded against a standardised marking scheme which has been developed and regularly reviewed over many years by asbestos industry influencers and leaders, including licence holders, analytical companies and enforcing authority inspectors. The audit scheme is also embedded into ARCA’s ISO9001:2015 quality management system certification, which is audited annually by a UKAS accredited certification body.

The Consistency of Approach In addition to the consistency required of the auditor, the auditee can also contribute to the consistency of their broader audit programme. If every audit tells a story, then a set of audits in combination may speak volumes.

Should the three audits per year required for ARCA membership not happen to cover some activity types that you undertake, or not cover all of your site teams, you can arrange additional audits to cover these. Additional ARCA audits are conducted to the same exacting requirements of those under the Site Audit Accreditation Scheme.

For your licence renewal, the Health and Safety Executive will want to know: w your audit strategy w how often audits (internal or external/independent) are carried out w How you ensure that audits are as effective as possible, e.g. whether they are announced or unannounced, and that they are asking the right questions w how you audit your own work internally.

Your own quality system should ensure consistency in your planning, which should extend to site implementation of the subsequent Plan of Work and associated Standard Procedures. Your management system should also provide consistency in the way audit findings are addressed and closed out, looking at both immediate and root causes to prevent future recurrence.

The Extent to which the Findings are Acted On During the licence renewal process, you will be required to describe to the assessing inspector how you review your performance and develop action plans. The inspector will want to see that all the findings have been actioned, and the extent to which this has been done. In other words, the inspector will be scrutinising numerous audit findings, together with findings from their own inspections, and formulating their own story of how effective your business is in managing work with asbestos. Difficulties arise when discrepancies are found when comparing their interpretation with yours. It is crucial that your audit reviews are as in-depth and thorough as would be undertaken by an assessing inspector.

Even the best companies use audits to tell their story, sometimes albeit a short story, but nevertheless a valuable one based on accurate and credible observations and findings. It is inevitable that, from time to time, the story may introduce an unexpected twist that needs to be unravelled, so robust auditing will tell us by providing early signs that some further actions are required.

This is the essence of the ‘Plan, Do, Check, Act’ approach – that it doesn’t end after the ‘Act’ stage, but that the story continues into the planning of the next job, thus being a platform for continuous improvement.

Every audit tells us a story if we are willing to listen.

A

RCA has always taken the view that each audit should produce a report that clearly and accurately conveys how a job has been planned, that plan implemented, records kept to show control measures maintained, and that any further actions required are introduced. This approach leads to improvements being made during the works whenever required, and subsequently for future similar works.

ARCA’s Membership Compliance Manager, Geoff Silver, has commented that “an audit should inform any stakeholder exactly what the state of the job was at the time of the audit, whether exemplary, deficient or anywhere in between. It should leave the reader in no doubt as to what has been done well, and where improvement needs to be made if an element of the audit did not meet the expected standard.”

One ARCA member recently took an in depth look at some of their recent audit findings. As a result, they identified some procedural changes that needed improvement, and some training needs. These were all actioned, and several additional audits arranged to measure how effective these changes had been embraced at site level. In response to an excellent audit result, one of the directors provided feedback that they were very pleased with both the findings and auditor’s comments, and that the audit grade demonstrated how the recent changes they made had a positive impact, and had been well received by the supervisors.

The management team of another ARCA member company courageously identified where they themselves had fallen short in supporting one of their supervisors, following some findings identified in a site audit. Instead of blaming the supervisor, their introspective stance identified some root causes beneath the site findings and put these right. As a result, the supervisor was better equipped to run sites, and a subsequent audit clearly demonstrated how the company’s actions had enhanced site performance.

This article gives an overview of the basic legal requirements for welfare provision on asbestos removal sites , and includes arrangements to be in place to be COVID-19 secure.

Any failure to provide adequate welfare facilities could have serious implications for HSE’s confidence in a contractors’ general management arrangements.

Welfare Facilities for Asbestos What are welfare facilities?

These are facilities that are necessary for the well-being of workers/employees, such as: w Toilets & washing facilities w Rest areas (incorporating a place for preparing hot drinks & eating food) w Access to drinking water w Changing rooms & lockers (where workers need to change into special clothing)

Who is responsible for welfare facilities?

All contractors need to ensure that there are adequate facilities for workers under their control.

In many cases, welfare provision will require cooperation and coordination between a number of different organisations. This coordination needs to be clearly addressed at the planning stage.

Welfare and health & safety management The Construction (Design and Management) Regulations 2015 (CDM 2015) place specific duties on contractors, clients and others involved in construction work.

The definition of ‘construction work’ is very broad and will include asbestos removal tasks (licensed and non-licensed). For example, it includes; alteration, conversion, fitting out, commissioning, renovation, repair, upkeep, redecoration or other maintenance (including cleaning which involves the use of water or an abrasive at high pressure,

or the use of corrosive or toxic substances), decommissioning, demolition or dismantling.

The minimum welfare facilities required for all construction sites is described in Schedule 2 of CDM 2015. Welfare requirements on contractors will apply regardless of whether or not the project is CDM 2015 “notifiable”.

A company’s approach to arranging welfare provision needs to consider: w The type of work being carried out w The number of workers and work location w Cleaning and maintenance responsibilities and regimes For licensed asbestos removal a ‘suitable and sufficient’ Plan of Work will identify where / how facilities are to be provided. General / generic statements (e.g. “Welfare to be provided by client”) are not sufficient as they do not explain what site teams should expect on-site.

‘plan of work to clearly state arrangements’ It follows that site assessors, planners, supervisors and auditors / visiting managers need to understand the minimum standards for welfare provision and take welfare facilities into account when considering workplace transport and other ‘access’ or site management issues.

In addition: w The company’s training and / or general procedures need to cover welfare requirements.

w The company’s general arrangements for monitoring performance must also look at welfare provision; ‘audits, senior management tours’ etc. should expect to identify where welfare provision does not meet the minimum legal standard.

Welfare facilities – basic requirements Any reference to something ‘provided or made available’ means that the facility is in a readily accessible, suitable location. For example, a toilet that is ‘made available’ but is a 30-minute walk away, is unlikely to be considered readily accessible.

Where possible there should be separate facilities for men and women - failing that, rooms with lockable doors.

Toilets & washing facilities A ‘suitable and sufficient’ number of toilets must be provided or made available. This will depend on the number of workers and the type

guidance Drinking Water An adequate supply of drinking water must be provided or made available. Cups (or similar) must also be provided, unless the water is provided from a drinking jet / fountain etc.

Changing rooms and lockers Changing rooms must be provided in situations where workers need to change into special clothing and, for reasons of either health or propriety, they cannot be expected to change elsewhere. Changing rooms need to be equipped with seating and have places for workers to lock away clothing or personal effects.

Decontamination units as changing and washing facilities

Work of toilet provided. For example, HSE guidance recommends that no more than 7 persons should be expected to use a single portable toilet where it is being emptied on a weekly basis.

Washing facilities will include showers for very dirty or hazardous work and these will be separate from general washing facilities. Sinks should be large enough to wash face, hands and forearms. They must be provided in the immediate vicinity of every toilet. They should also be provided next to rest areas, where these are far from toilets.

All washing facilities must include: supply of hot and cold water; soap, or similar; towels, or other means of drying.

Rooms containing washing facilities and toilets must be kept clean and orderly; they must be adequately ventilated and lit.

‘welfare facilities should be readily accessible’ Rest areas or rest rooms Rest rooms or rest areas must be provided or made available. These areas will: w Have tables and chairs (with backs) to accommodate the number of people likely to use them at any one time w Include facilities to prepare / eat meals, including a kettle (or similar) w Be heated / ventilated as necessary to maintain a comfortable environment

Where decontamination units (DCUs) are required for removal work, these should be capable of meeting the ‘welfare’ requirement for changing rooms and lockers.

However, DCUs do not provide general washing facilities as defined above: use of the shower section of a DCU is subject to decontamination procedures and access is restricted to those working in asbestos areas. As mentioned above, washing facilities will be required with / near toilets (and rest areas, if these are a long way from toilets).

For asbestos removal work not requiring a DCU (i.e. non-licensed works) specific changing rooms are not required, as asbestos coveralls are generally worn over work clothing.

Small scale / short-duration asbestos work There is HSE guidance on welfare provision for work that is completed in less than a week, or for ‘transient’ activities (such as a sequence of short tasks carried out across various locations in a particular geographical area). In such cases it is accepted that contractors make use of a “client’s existing facilities, public facilities or local businesses”.

However, contractors need to be able to demonstrate that clear agreements have been made as part of planning for the work. In all cases workers must have facilities that are readily accessible (open at all relevant times), provided at no cost to workers and of an acceptable standard. In practice, it is unlikely that local businesses will offer such agreements.

A guidance note available on the ARCA website gives further information and example scenarios.

Being COVID-19 Secure Unlike conventional legislation and guidance, requirements relating to controlling the Coronavirus pandemic may vary according to nation and region, as well as change frequently over time, to address the constantly evolving situation. Although mostly provided as guidance to employers, enforcing authorities are likely

to view breaches as being non-compliant with the broader requirements of health and safety legislation to ensure the health and safety of employees and others who may be affected (e.g.

Health and Safety at Work etc. Act 1974, sections 2 and 3).

The general requirements, which are unlikely to change significantly, include: w Enhanced cleaning regimes of premises, facilities and equipment w Sufficient provision and use of washing facilities and/or hand sanitiser, particularly when entering and exiting premises w Maintaining physical distancing (e.g. 2 metres), and minimising any person to person contact w Not going to any workplace if displaying any of the coronavirus symptoms, and leaving the workplace if any symptoms develop w Self-isolating where required, for the full duration of the self-isolation w Having arrangements in place to manage any suspected or confirmed case It is also important to implement any specific local requirements that may be applicable from time to time.

Responsibilities as defined in CDM 2015 Responsibility for providing welfare may fall to multiple dutyholders. Therefore good cooperation, coordination and communication between these duty holders is very important.

Individual Contractors are responsible for planning and managing their work in order to comply with legal requirements. They must ensure adequate welfare arrangements are in place for their staff. For larger / more complex projects, contractors must coordinate their activities with others, particularly with the principal contractor and principal designer. On multi-contractor sites, asbestos contractors need to ensure that welfare arrangements are properly explored and clarified at the planning stage.

Asbestos Management – Clients Legal Duties O

wners and managers of a premises, whether an office, shop, factory or school, must understand their legal duties as a duty holder under Regulation 4 of the Control of Asbestos Regulations 2012, as the failure to effectively manage asbestos can and does lead to enforcement action from the Health and Safety Executive (HSE).

If the premises you manage or own was constructed prior to the year 2000, you need to know if asbestos is present and manage the associated risks, as you are responsible for ensuring that employees and non-employees are not exposed to health risks as a result of the

presence of asbestos.

Asbestos is a hidden danger as asbestos containing materials could be found in numerous places within a building, such as pipe lagging, insulation board, vinyl floor tiles and cement products. Being aware of where asbestos can be found, and how to manage the risks, is vital to reducing the health risks faced by workers and the public.

Legal duties are covered in the Health and Safety at Work Act etc. 1974., Control of Asbestos Regulations 2012 (CAR 2012) and Construction (Design and Management) Regulations 2015 (CDM 2015).

To meet these responsibilities duty holders need to understand the need for; an asbestos survey to locate asbestos containing materials, asbestos register and management plan, appointing a competent removal contractor, and what needs to happen after asbestos removal, before re-occupation of a premises.

Having an overall performance rating for an operative will provide the contractor with some reassurance of the competency of an agency operative before they arrive on site.

ALFA, a web-based application, has been developed

by ARCA to provide benefits for all parties, including: reassurance of labour competence, training needs and certificate management, that is certificate information for operatives is available within the App, and certificates due to expire are highlighted, so supporting timely renewal.

Worlds first commercially viable asbestos recycling plant established in the UK Thermal recycling diverts asbestos containing material away from landfill, converts it into a new substance that is asbestos free, and that substance can then be used to produce a sustainable aggregate.

T

raditionally the only viable method of disposing of asbestos has been to load asbestos waste into a skip and then empty that skip into a landfill site.

Until now, there has been no alternative.

With Thermal Recycling there is now an alternative which can eradicate asbestos permanently.

Thermal Recycling completed the commissioning of a demonstration plant just outside of Wolverhampton to demonstrate that transforming asbestos into an inert aggregate is possible and can be carried out safely and efficiently. Thermal Recycling currently have an Environment Agency (EA) permit to treat 29,500 tonnes per year.

The process denatures the asbestos by applying intense heat. Denaturing is a process that changes the essential characteristics of a substance, so it is no longer that substance.

Heat is applied in a controlled, precise and scientific way and this leads to a number of chemical and physical transformations of the

material, so that by the end of the process what is left is no longer asbestos and no longer contains asbestos, it is a new substance.

During the testing phase of the project, over 350 samples of the denatured asbestos material were tested after it had been treated in the kiln. Following analysis, all samples were reported as ‘No Asbestos Detected’. It was clear that the treated material was no longer hazardous with regards to asbestos, but was it safe with regards to other substances which may be present? Samples of the material were taken and analysed using X-ray diffraction and X-ray fluorescence to understand the chemical and crystalline structure of the material. The conclusion was that the treated material was no more hazardous than the Portland cement from which it was derived.

The kiln is unique and has been designed specifically for this new process. It is a moving hood kiln which lifts, moves along, and is repositioned over a kiln base. It has a burner system which has a tight temperature control

of the heat which is applied. The fully enclosed system includes an after-burner system and a filtration system which removes the volatile organic compounds and other fumes and particulate matter from the exhaust emissions.

The emissions are fully cleaned prior to exhausting to atmosphere.

The asbestos cement sheets are delivered from construction sites to the treatment plant in specially designed easy to load bags. The bags are loaded onto the kiln base and then the hooded kiln system is moved over the base. Heat is applied to the material in the kiln and the denaturing process begins. It takes 24 hours for the entire load to be denatured. Once the material has cooled it is removed from the kiln and crushed to produce the recyclable aggregate. The whole plant has a High Efficiency Particulate Arrestor (HEPA) filtered Local Exhaust Ventilation (LEV) system to remove any dust in the workplace atmosphere and operates at a rate of 5 air changes per hour.

thermal recycling processed through the demonstration plant and over 350 samples of the treated material have been taken from over 1,800 different sheets.

The samples were analysed using Phased Light Microscopy (PLM), as well as samples being analysed using Scanning Electron Microscopy (SEM). Samples were also analysed by the Health and Safety Executive Laboratory (HSL) using Transmission Electron Microscopy (TEM).

In all the analysis undertaken no asbestos was detected in any of the samples.

The sampling plan was agreed in advance with the Environment Agency and was designed with the assistance of a university statistician to ensure that the results were statistically valid. The scale and nature of the sampling undertaken proved that had any asbestos actually been present after the asbestos containing sheets had been fired in the kiln there was an extremely high probability that it would have been detected. The results were consistent with the fact that the sheets had been converted into a new substance that does not contain asbestos.

Thermal Recycling have recently received a Smart Innovation grant from the UK Government to investigate the highest value use for the recyclable material produced by

the process. The next steps are to build a fullscale plant as soon as possible to do so and as soon as Thermal Recycling know they have the support and interest of the asbestos industry for that to be done.

Thermal Recycling know that their technology can treat all types of asbestos.

Currently their EA permit only allows for treating cement bound asbestos containing chrysotile. Graham Gould, Thermal Recycling Chairman said, ‘We know the process can work for other types of asbestos and we want to work with the Environment Agency to extend the range of types of asbestos that we can treat. We want to establish a network of treatment plants across the UK and internationally so that we can treat as much asbestos as possible and divert it away from landfill’.

n an industry as highly regulated and controlled as asbestos removal it is important to ensure the most stringent standards are maintained.

This applies within the temporary workforce, so it is important that clients, workers and agencies are all aware of their responsibilities to ensure high quality in the supply chain. It is also important for trade associations like ARCA and the Recruitment and Employment Confederation (REC) to tell their members in the simplest terms what compliance is necessary.

that an employment business has to confirm that all workers have “the experience, training, qualifications and any authorisation which the hirer considers are necessary, or which are required by law or by any professional body, to work in the position which the hirer seeks to fill” before letting that candidate do any work for a client. This helps to make sure that standards within the recruitment industry are maintained and only the best candidates are put into work. This is especially important for asbestos removal given the hazards involved.

One of the most important roles that an agency plays in the recruitment process is making sure that the candidates they introduce to the client have the required skills and qualifications to do their roles safely and compliantly. In the world of asbestos removal this would mean that evidence of appropriate training or ARCA ARMI Skills Cards would need to be shown to, and checked, by the recruitment business before those workers do any work for their clients. This is a requirement for the employment business under the Conduct Regulations, which is the main legal rulebook for the recruitment industry. These state

This means that all of the REC’s resources and guidance are available for those businesses to take advantage of. The REC has a whole range of contracts, templates, guidance and a free legal helpline that can be used to make following the rules as easy as possible. These resources are used by employment businesses to help them keep up with changing legal and compliance requirements and keep standards high. The REC demands a robust approach to compliance from its members who must pass a test every 2 years to demonstrate their commitment to high standards.

As well as this the REC has its own Code of Professional Practice to ensure recruiters work ethically and promote good practice. This is enforced by the REC’s Complaints and Disciplinary Procedure which allows the REC to investigate complaints against members by workers and clients. The Code ensures that REC members operate to a higher standard, which in turn leads to high-quality candidates. The complaints team’s investigation process can result in cases being escalated where necessary to our industry-led Professional Standards Committee (PSC), of which both the TUC and CBI are members. The committee has the power to sanction or in extreme cases expel members. It is this process of maintains client trust in our members.

This all shows the commitment that agencies have to helping the asbestos removal sector maintain the highest standards by recruiting the best candidates. The REC and ARCA both recognise the importance of good compliance, and together with agencies, we can demonstrate this to clients in the industry.

Troubleshooting Plans of Work ‘Planning’ is a subject causing considerable challenges for many licensed contractors and attracting frequent criticism from the Health and Safety Executive (HSE). This brief article is intended to help contractors critically review their own approach, but it may also be of interest to clients and others with an interest in assessing plans, and health and safety management.

Regulation 7 of the Control of Asbestos Regulations requires employers to prepare a written plan before any asbestos work is carried out. Standard licence conditions require the production of a “suitable and sufficient” plan, prior to notification of work, and state that the plan must be followed on site.

Licence conditions mean that written plans must be at the heart of licence holders’ safety management systems: plans should clearly show what senior management expects a site team to do. The quality of planning is likely to be a major focus of licence assessments and inspections.

There is a problem when gaps open between actual practice and “paperwork”: asbestos removal is a practical job and it is a challenge to ensure that Plans of Work (PoW) are seen to help and guide the removal process. The key to closing this gap often lies in engaging relevant staff (particularly contract managers, supervisors and auditors) in the on-going development of the planning process.

Format and Quality Guidance “Asbestos Regulation 7 Plans of Work – Purpose and Core Principles”, which can be read alongside ALG memo 04/12, aids format and content for a suitable Plan of Work (this guidance is referenced at end of article).

Templates may be useful for those preparing the plan but are not necessarily helpful for those being asked to use the finished plan.

Following one format cannot guarantee that a plan will be “suitable and sufficient”: for example, the required section on air management might have been completed, but the contents might be incorrect or difficult to follow; a sketch may be included but it does not reflect site reality etc. In addition, any one particular format is likely to suit some types of jobs more than others.

Regardless of format, any reader should be able to quickly identify what the particular challenges are for this job and how management have decided these will be tackled. Where jobs are straightforward and simple, the plan should be. The main emphasis should always be on the quality of the information being given, not the format.

Who is the plan for?

Current guidance (Asbestos Regulation 7 Plans of Work – Purpose and Core Principles) lists what should be considered as part of a plan. The immediate purpose of the plan is to clearly address significant risks associated with a particular project. Standard procedures, industry guidance, ‘standard’ training courses, generic assessments etc. deal with the common situations associated with removal work. For example they address:

Templates often encourage repetition. For example, a “Method of Work” section describes what will be done, where and how and then later sections in the plan on “Controls” and “Equipment” repeat much of the same information. Often the location and layout of transit routes, enclosures and airlocks are described in writing and then also shown in a sketch.

During licence assessments, HSE examines a contractor’s general approach to planning: licences are not granted unless the ALU is confident licence conditions can be complied with. Between licence assessments, contractors may often encounter individual HSE inspectors demanding particular changes to plans. Inspectors provide invaluable input into particular controls for particular circumstances.

w Size of timber / grade of polythene to use for enclosures w Keeping areas tidy, to avoid slips and trips w Choosing ‘appropriate’ equipment for work at height and ‘appropriate lifting aids’ for manual handling etc.

A site-specific plan would refer to general procedures, but it would provide a very clear focus on, for example: w The particular access equipment for THIS job w What lifting aids are needed for THIS job w Details of specific welfare provision for THIS job w Given the size / fixings of THESE panels, how many operatives will be working together on THAT platform in order to lift, shadow vac, spray and bag etc?

To improve clarity and usefulness, it makes sense to be careful about how generic / standard issues are presented in the plan.

Non-specific, generic material will tend to make plans less user-friendly and less likely to be read. Generic information increases the chance of missing important, site-specific items.

Repetitions increase the chance of ‘cut and paste’ errors, increase length and complexity and therefore make plans less likely to be read.

Could the format encourage repetition?

Do POW reviews/audits check for consistency between sections?

What language?

The choice of language is a good indicator of WHO the plan has been written for. The following examples are common: w w

‘Access and egress will be via …’

‘H-Class vacs will be situated in the enclosure…’

‘Work will commence…’

Most people do not usually talk this way and this choice of language does not help to make a user-friendly document. More significantly, the choice of language encourages a perception that the plan is not really for the site team. Perception matters: if we want site teams to use plans, they must be produced in a style that is accessible for them.

Are plans written in plain English?

Are the particular challenges for this job obvious?

Is the scope and sequence/phasing of work clear?

Could visitors measure site conditions/progress against the plan?

Why use words?

Following on from the above, why use words at all when good sketches, flow charts and photographs would provide the same information more accurately and in a more user-friendly format?

Well-constructed sketches and photographs (marked with labels, arrows etc.), supported by flow charts showing the sequence of work and the precise methods expected.

Could some written information be replaced by diagrams etc.?

Do reviews/audits identify good and bad examples of sketches, photographs etc.?

However, if inspectors (or others) are insisting on changes to a contractor’s general approach to assessment and planning, then it would be advisable to discuss the issue with the ALPI (members can contact ARCA for advice in such situations).

First and foremost, plans must work for the managers and supervisors etc. being asked to use them: they are central to an organisation’s management system and undue external influence may undermine this.

Are plans primarily produced for supervisors and contract managers, rather than clients / others?

How is it used?

The real test of whether or not a plan is ‘suitable and sufficient’ lies with site teams and their managers.

Do they find it useful? Could it be improved?

If plans are criticised, the response should not be limited to re-writing that particular plan and / or sending staff on a training course; it is much more positive to involve all relevant staff in reconsidering the general approach to producing and using plans.

Ward launches new asbestos drop off service for small loads

D

erbyshire based metal and waste recycling specialist, Ward, has launched a new asbestos drop off service for smaller loads or one-off jobs.

Asbestos is dangerous to human health and must be disposed of safely by a licensed contractor. It is not widely accepted at household waste recycling centres and so can often be difficult to dispose of.

The new service for the safe disposal of cement-bonded asbestos launched this month. It is aimed at residential and commercial customers who need a quick and reliable way to safely dispose of the hazardous material.

Donald Ward, Operations Director at Ward, said: “There are often cases where trades’ or householders working on smaller projects in renovations of older properties or

home DIY-ers dismantling a garage or lean-to unexpectedly find themselves with asbestos for disposal. Due to the minimum quantity limits at many disposal sites, they struggle to find somewhere to safely dispose of it at a competitive rate.”

“Our Chesterfield and Ilkeston facilities are fully licensed for handling hazardous waste and can accept small loads less than 150kgs at a new special rate or larger loads of asbestos up to a number of tonnes at the most comparative rates in the area. We’ve

Understanding re-occupation testing

What clients need to know If you are a property owner/manager who may have licensed asbestos removal work undertaken at your premises, or are involved in licensed asbestos removal works, you need to understand the re-occupation process. That is what needs to happen before the building, or area where the removal took place, can be allowed to be re-occupied.

The 4-stage re-occupation test is a legal requirement as detailed in the Control of Asbestos Regulations 2012 (CAR 2012).

W

hen licensed asbestos removal work is planned by both the end-client and the Licensed Asbestos Removal Contractor (LARC), sufficient time has to be allowed to complete the re-occupation test. This time is in addition to the time taken for actually removing the asbestos containing material(s) and can range from a few hours to 2-3 days depending on the complexity of the area affected. Planning this time is critical as delays may hold up other works and other contractors.

What is a 4-stage re-occupation test?

This is a series of tests carried out after licensed asbestos removal and before the affected area is handed back to the client for re-occupation. (Licensed asbestos removal is usually undertaken inside a sealed enclosure).

Its purpose is to ensure all proposed asbestos removal work has been carried out as per the pre-agreed Plan of Works, and that the area is clean, dry and dust free, as far as is reasonably practicable, and therefore fit for re-occupation.

Why do this test?

The 4-stage re-occupation test is a legal requirement as detailed in the Control of Asbestos Regulations 2012 (CAR 2012) Regulation 17.

Who can conduct the test?

The test can only be undertaken by a United Kingdom Accreditation Service (UKAS) accredited testing laboratory accredited to ISO 17025. This requirement is also highlighted in CAR 2012 Regulation 20.

To avoid any perceived conflict of interest, the Health and Safety Executive (HSE) has long held the view that the analytical company contracted to carry out the 4-stage re-occupation test should be employed independently by the end-client.

What is the process for a 4-stage re-occupation test?

As the name suggests there are four separate tests / stages which are carried out by a qualified analyst. These are: Stage 1 - Preliminary check of site condition and job completeness The areas examined are: w The plan of work (method statement) w The transit and waste route (the route to and from waste skips and decontamination unit) w The decontamination unit (the mobile unit used for decontamination including showering) w Areas surrounding where the work has been undertaken w Inside the enclosed area, by viewing from outside using the vision panel, or CCTV provided When the analyst carrying out the test is happy that it has met the criteria for Stage 1 he/she will move onto Stage 2.

Stage 2 - A thorough visual inspection This will entail: w An examination of where the asbestos had been w All surfaces inside the enclosure w Ensuring the enclosure is clean, dry and dust free as far as is reasonably practicable The time spent on this stage will depend on the size and complexity of the enclosure and in some cases, may require more than one analyst to carry out the inspection.

Stage 3 - Clearance air monitoring Air sampling will be conducted inside the enclosure to: w Ensure the airborne fibre concentration is below 0.010 fibres per cubic centimetre All surfaces are brushed vigorously for a minimum of 1.5 minutes per sampling location.

When the air test has been carried out and the fibre concentration deemed to be less than 0.010 fibres per cubic centimetre the enclosure can be dismantled.

Stage 4 - Final assessment post-enclosure / work area dismantling After the enclosure/work area has been carefully removed the analyst will undertake the final assessment: w Check the area for any asbestos containing materials that may have been hidden when Stage 2 was undertaken. * w Ensure that all materials used for erecting the enclosure have been removed and disposed of correctly. *If during this inspection any residual asbestos is identified from the removal works the enclosure may have to be re-built and the asbestos residue removed.

What is supplied to state that re-occupation is approved?

A re-occupation certificate will be issued by the analyst to both the Licensed Asbestos Removal Contractor and the end-client.

Photographic evidence of each stage should be provided to support this final re-occupation certification.

NOTE The 4-stage re-occupation test is described in ‘The Analysts Guide’ HSG 248 which currently is being updated by HSE. A draft of the new guide is available from the HSE website on www.hse.gov.uk Additional requirements in the draft guide are: w The time spent conducting the visual inspection (Stage 2) w The use of photographic evidence at each stage of the test w An official handover of the enclosure from the Licensed Removal Contractor to the analytical company
