Since the previous edition of ARCA News, several new digital products and services have been delivered. This includes the launch of the new ARCA and ATaC Websites and the Site Audit Portal. As mentioned in the previous issue of ARCA News, the new websites offer enhanced features, especially in the training section. Now, training can easily be booked online, and the website is connected to our CRM system, allowing PDF electronic training certificates to be downloaded from the Members Portal. Each certificate contains a QR code that links to the ARCA certificate checker, instantly confirming its authenticity.

The development of the ARCA eLearning platform is progressing well. While the Asbestos Removal Operative eRefresher course is still being finalised, its completion is nearing, and we are preparing for its upcoming launch. Once this course is launched, all the digital products currently under development will be completed, and work can start on the digital Personal Monitoring System.

Driving Excellence: Latest Digital Solutions, Staff Updates, and Achievement Celebrations

Recruiting and retaining excellent staff is crucial for providing outstanding service to our members. I am pleased to announce that we have recently welcomed two exceptional staff members: Eve Evans as a Training Administrator and Dan McClure as a Site Auditor. Members who have interacted with Eve or Dan during training bookings or site audits in the southern region will have already witnessed their professionalism and competence. Recruiting good staff is just the beginning; it is equally, if not more important, to retain them, and this requires investing in staff. In any business, your people are your competitive advantage, but that advantage is only realised when they are fully engaged. Over three years ago, ARCA began the Investors in People Scheme (IIP) and achieved silver status, a great outcome for our first assessment. Following this year’s assessment, we have been awarded gold status, recognising the additional work the association has done over the past three years in leading and supporting our staff, as well as the impact of change strategies and initiatives. Through our partnership with IIP, ARCA will continue to enhance our investment in staff and ensure the retention of the excellent team we have built.

Part of the IIP program involves recognising and rewarding high performance, which brings benefits to both individuals and organisations. We are aware that recruitment and retention of skilled staff is a major concern for our members. To assist our members, ARCA provides recognition for both individuals and organisations. We recognise member companies that excel in training or site audit results with gold awards, which are showcased in each issue of ARCA News, on social media, on the ARCA/ATaC websites, and at the association’s Annual General Meeting (AGM). Individuals are also acknowledged for their training results or qualifications in

ARCA News, on social media, and at the AGM. Recognising these achievements has several advantages for individuals and organisations. It provides individuals with a sense of accomplishment, motivating them to maintain high performance levels, boosting their motivation and engagement, and resulting in increased productivity and job satisfaction. When achievements are acknowledged and celebrated, individuals feel valued and appreciated, enhancing employee loyalty, and reducing turnover rates. Furthermore, recognition reinforces positive behaviours and performance standards, helping individuals understand their strengths and encouraging them to continue excelling in their roles, ultimately leading to continuous improvement and higher performance levels.

ATaC continues to represent UKAS accredited asbestos testing laboratories. The ATaC team has been engaging in discussions with the HSE and UKAS regarding the requirement in HSG 248 that ‘No Asbestos Detected’ samples score 2 points. This limitation severely restricts the number of samples a bulk analyst can analyse per day, in ATaC’s opinion, unnecessarily, increasing the laboratories’ costs, which are also passed on to the customers. We hope this issue will be resolved soon.

New Member Site Audit Portal

To support the compilation of all site audit results for statistical analysis ARCA has developed and launched a Site Audit Portal for members.

Six members have piloted the system and provided feedback that the system is a valuable addition to their site management, control, and continuous improvement process. As a result of the feedback, an additional feature was added that allows members to upload evidence to close out any non-compliances.

The Site Audit Portal stores all ARCA site audit reports (membership and additional audits) for individual members and data from internal audits via the Member Internal Site Audit App if used. Grades for all audits are displayed in table and graph form, and broken down into ‘Plan, Do, and Check’ elements, providing a more detailed management tool so contractors can clearly identify the ‘Action’ requirements.

The new Site Audit Portal can now be accessed through the members portal (separate logins are required).

ARCA Site Audit Best Practice Course

The ARCA Site Audit best practice course offers an excellent opportunity for site teams, including supervisors and operatives, to enhance their understanding of the ARCA audit process and improve their performance in health and safety management. The course provides valuable insights into the expectations of an auditor with site compliance and the contributions expected from different site team members.

The performance of ARCA site audits is assessed based on the areas outlined in

the HSE Document “Successful Health and Safety Management HSG65”, with each section and question categorised into Plan, Do, and Check performance categories

The new Site Audit portal analyses these categories to pinpoint areas that need improvement, with the aim of improving results on-site audits and addressing company-specific non-compliances.

Attendees will receive ARCA audit guidance notes for use during the course and for future reference. The course is offered mostly in-house to allow for the review and discussion of past company-

specific non-conformances in audits, which can be valuable in providing opportunities for improvement.

The ARCA Site Audit best practice course and audit portal can be highly beneficial for companies looking to enhance their health and safety management performance. This can also help ARCA members achieve the ARCA Site Audit Gold Award.

ARCA issues its 5,000th CSCS Card

ARCA has recently issued its 5,000th CSCS card, indicating a growing demand for the certification. The association is receiving daily applications, which its team processes in only four working days, demonstrating a commitment to efficiency.

While most applicants ask for physical smartcards, ARCA also offers virtual smartcards at no additional cost. This provides applicants with a convenient option to access their certification digitally.

The Online Card Checker called ‘Go Smart’, is available for the verification of CSCS smartcards online, ensuring their authenticity. The feature provides a reliable and efficient way for employers to check their workers’ credentials quickly and easily.

Joint ATaC and NORAC Seminars held in Leeds and London

Seminars were organised by ATaC and NORAC with the objective of reviewing the Annual Data Report on Asbestos in Buildings, and facilitating constructive dialogue on the status of the asbestos analytical industry. The meetings fostered candid and transparent exchanges on prevailing guidance and perspectives regarding compliance, and provided insights into areas where improvement could be made.

Jonathan Grant gave a short presentation detailing the findings of the initial report into asbestos in buildings, and the problems encountered with data collection of this scale.

We also had the privilege of hosting Saranjit Sihota from Mesothelioma UK, who shared insights on their ongoing “Don’t Let The Dust Settle” campaign”. The audience was moved by the powerful narratives of

Chris Emmitt, who cared for her brother when he had Mesothelioma, and Helen Bone, a Mesothelioma patient, as they spoke about their personal experiences. Their testimonies served as a poignant reminder of why we are committed to our work, and reinforced the significance of preventing this dreadful yet avoidable illness.

During his presentation, Mick Dawson highlighted how the understanding of data on asbestos-related diseases has evolved over time and discussed the potential for statistical distortion.

Lastly, John Richards delved into the specifications for forthcoming reports, which entailed incorporating additional parameters into the next data collection, and emphasised the necessity of standardising the information gathered during the surveying process.

The consensus of these seminars was that minor enhancements could have a substantial impact on the management of asbestos in the UK. For instance, streamlining the Priority Assessment process for duty holders could be a crucial step towards achieving this goal.

The objective is to establish the data analysis as an annual occurrence, and once again, we require as much data as possible to generate a comprehensive report. The data we possess is critical, and by working collectively, we can accomplish much more than we could individually. First Annual Data Analysis Report into Asbestos in UK Buildings Published

A report into asbestos in UK buildings was published in November 2022 following a collaboration between the two asbestos consulting trade associations, ATaC (Asbestos Testing and Consulting) and NORAC (National Organisation of Asbestos Consultants).

The report1, produced in response to the recent inquiry into asbestos management in the UK by the Work and Pensions Select Committee2, highlighted that little evidence exists about the amount and condition of asbestos in UK buildings. It collated and analysed over a million lines of data and is perhaps the most important indicator of the effectiveness of asbestos management in the UK, and a measure of the HSE’s flagship ‘Duty to Manage’3 regulation.

The collection of data was made easier as a large proportion of asbestos surveys are carried out using database software. With ATaC and NORAC representing the majority of United Kingdom Accreditation Service (UKAS) accredited asbestos surveying companies, the two organisations decided to combine efforts to provide a factual based review of the Duty to Manage.

The anonymised information comprised over one million data points derived from over 128,000 premises across the country. The size of the data set makes this the most significant overview of the condition of asbestos in UK buildings ever undertaken.

Key Findings

l Of the 128,000 buildings inspected, about 100,000 (78%) contained ACM.

l Within those 100,000 buildings, about 710,000 items of ACM were listed.

l Of the 710,000 items of ACM, about 507,000 (71%) were damaged4 with only 29% in a good condition.

l Of 710,000 items of ACM, 158,000 (22%) fall into the category of licensed work.

l Of the 158,00 items of licensed ACM, 29,000 (18%) had medium or high damage.

l 280,000 items were re-inspections of previously k nown ACM, of which 202,000 (72%) were damaged; w this means they were either damaged when originally found and have not been made safe, or have been damaged in the inter vening period. Both scenarios indicate a failure to manage.

Focussing specifically on the housing sector:

l about 94,000 of the 128,000 sites inspected (73%) were domestic5 proper ties, almost exclusively social housing

l around 80,000 (86%) of domestic dwellings had contained ACM (compared to 78% (of all buildings)

l 16% of housing (and 22% for all buildings) contained products that if removed would require licensed conractors to do the work

What does this tell us about asbestos management today?

This initial report has focused on the extent of damaged materials within the UK property portfolio. Given that the underlying premise of the ‘Duty to Manage’ is to maintain asbestos in a good condition, the quantity of damaged ACM does not make good reading.

With about 78% of the asbestos identified being categorised as non-licensed work, there appears to be a large proportion of work with asbestos that, whilst regulated, is largely unenforced and under the radar.

The report reveals some concerning asbestos management failings in the UK. Though the root causes of this ineffective

management are complex, the report shows that after 20 years of the ‘Duty to Manage’ regulation, there are major questions to be asked regarding its effectiveness.

The data also highlights the asbestos problem within social housing, an area largely ignored by the current regulations and one which clearly needs to be examined with some urgency.

Good asbestos management is about preventing the exposure of employees, householders and the general public to asbestos. This data indicates that the UK does not yet sufficiently do this. The legacy of asbestos related disease deaths, currently at 5500 a year6, has the potential to continue for many generations.

The publication of the report has shown the power of collaborative working, and the valuable support of the software providers means similar reports can be published on an annual basis. These will help identify developing trends in the identification and management of asbestos in UK buildings, and provide a counterpoint to the view that the regulations continue to fulfil their intended purpose.

The HSE schools inspection programme

Following the Work and Pensions Select Committee inquiry, the HSE instigated a programme of inspections7 in schools which began in the second half of 2022 and was due to be completed at the end of March this year. The purpose is to assess the level of compliance with asbestos regulations in a sample of 400 British schools (1.6% of the total).

It might come as a surprise that they are not unannounced inspections: the regulator has provided school leaders with advance notice of the visits.

The HSE has been assisting the education sector by sending out e-bulletins8 outlining which documents they should have in place during the visit, and what the inspectors will ask. There is also guidance on what to expect when an inspector calls9.

This suggests the report, due later this year, would be expected to demonstrate high compliance. However, a recent review of the HSE’s register of enforcement notices10 shows that in the first two months of the inspection programme, 17 schools were issued with enforcement notices for breaching the Duty to Manage. A selection of statements accompanying the notices is given below:

“You have not made arrangements for the regular checking and recording of the location and condition of substances suspected of containing asbestos in your premises, and for the provision of this information to every person liable to disturb it.” 11

“Asbestos-containing materials (ACMs) have been identified on the premises but there is no suitable written management plan to manage the identified asbestos.”12

“You have failed to make a suitable and sufficient risk assessment of asbestos containing materials (ACMs) present in the premises over which you have control. You have not produced a written plan for the premises which identifies the steps to be taken to manage the risk…”13

In many cases the inspection highlighted that although a school might have an asbestos survey, register or existing asbestos information, it has failed to produce a plan to manage the risk. This implies schools view their obligations as a “duty to survey” rather than a “duty to manage” and therefore one that stops after they have procured a survey.

When the ‘Duty to Manage’ was introduced in 2002, the HSE was very clear that it was not simply a requirement to have a survey completed, it was also necessary to act upon the information and manage the risk. Having a survey done is easy, you pay someone else to do it. Managing the results of the survey is harder because you have to do it yourself as the dutyholder.

The future of the Control of Asbestos Regulations 2012

The House of Lords is currently debating the Government’s Retained EU Law (REUL) Bill that will decide what to do with around 50 years of EU derived legislation: the “bonfire of legislation” as it has become known.

If the REUL does become law then potentially from 1st January 2024, there will be no asbestos regulations for the first time since 1930.

Unless the Lords force amendments to the Bill, or the Government provides alternatives to the 2400 pieces of EU-derived legislation, the default is that everything must go. Several scenarios present themselves:

n The Bill goes through as planned and CAR 2012 disappears on 31 December requiring the government to replace or sift through the entire body of Asbestos management regulations before the end of the year. (Although any new legislation has the Government stipulation that it must be “less burdensome”)

n CAR 2012 is included in the health and safety legislation to be retained.

n The “sunset” clause is extended to 2026 and CAR 2012 is kept until then.

The loss of CAR2012 without suitable replacement regulations would have serious consequences for the management of asbestos in UK buildings, which is a genuine cause for concern.

What has become apparent is that asbestos management is becoming caught up in the political crossfire with the firerelated Building Safety Act. In March 2023 the Government announced it intends to spend £42 million on recruiting 200 building safety inspectors and fire protection officers to support its new high-rise building safety regime14. Compare this with the number of HSE field inspectors, that has been cut from around 1500 in 2010 to fewer than 500 today.

If you want CAR to be meaningfully retained as the essential piece of legislation it is, then write to your MP and highlight its importance; the alternative could be harmful to the health of all of us.

Asbestos found in nearly 200 of Cornwall’s public buildingsfrom schools to office spaces

Asbestos has been found in at least 199 public buildings across Cornwall. Data released today (February 20) found that properties across Cornwall - from schools to office spaces and community centres - contain the potentially cancer-causing material.

While some of the asbestos may not be deemed harmful, once it is disturbed or in a state of disrepair it can quickly become very dangerous. Adrian Budgen, an asbestos-disease lawyer, says it’s “a huge concern” as many public buildings are old and maintenance budgets are sometimes stretched.

Data supplied by Cornwall Council identified the county to have a total of 199 public buildings containing asbestos, making it the local authority with the ninth highest number of the 20 questioned. In addition, 203 asbestos surveys had been carried out in the past five years, however there were no asbestos removals reported. The buildings affected were not named.

Irwin Mitchell, which carried out the research, is calling for more to be done to eradicate the substance. Legal experts at the company believe that if the data provided is repeated around the country, it’s estimated

that across the 387 local authorities in England, Scotland and Wales combined, there are around 87,000 public buildings containing asbestos.

Many of those exposed to asbestos are later diagnosed with mesothelioma, a terminal cancer of the lining of the lungs, or asbestosis, a chronic lung disease, as a consequence of their exposure. This condition can cause progressive shortness of breath, and in severe cases can also be fatal.

Adrian Budgen, an asbestos-related disease lawyer at Irwin Mitchell, said: “Most people associate asbestos with historical exposure in factories or construction work, but these latest figures highlight the extensive risk still posed by the deadly substance across the UK in everyday buildings used by the public.

“Sadly, we come across families and individuals affected by asbestos most often after coming into contact with it in their workplace, and to have it confirmed that it’s not yet been eradicated from a large number of public buildings is incredibly concerning.

“One of the main problem areas is revealed to be schools, which are obviously

densely populated with pupils, teachers and other school workers for long hours at a time. It’s extremely worrying that so many still contain asbestos, essentially putting children at risk every day.

“Whilst some of the asbestos may not yet be deemed harmful, once it’s disturbed or in a state of disrepair it can quickly become very dangerous, and with many of our public buildings being old and maintenance budgets being stretched, it’s a huge concern.”

Cornwall Council’s website explains that properties built before the year 2000 may contain materials made from asbestos. It says asbestos will be found in most homes and can usually remain safely, while breathing in asbestos dust can be harmful.

Schools are the largest category of buildings affected by the cancer-causing substance across the UK, research has found

The figures, which include more than 4,500 public buildings, have been provided by 20 local authorities as part of new research undertaken by the legal experts Irwin Mitchell who support clients affected by exposure to the hazardous substance.

Many of those are diagnosed with mesothelioma, a terminal cancer of the lining of the lungs, or asbestosis, a chronic lung disease, as a consequence of their exposure.

Data supplied by Bradford Council identified it as the local authority with the seventh-highest number of public buildings containing asbestos, with a total of 238.

Irwin Mitchell has supported several clients from the Bradford area whose exposure occurred in public buildings.

These include Pauline Harrison who worked at a school in Bradford and sadly died from mesothelioma two years ago due to coming into contact with asbestos during her employment.

In November 2019, Pauline’s lawyers made a claim against Bradford Council.

Although Pauline died, aged 67, in November 2020 before the court case could be resolved. However, her loved ones continued with the case in her memory. It settled in October 2021.

“She fought bravely right to the end while undertaking her quest for answers,” said Pauline’s son Mark.

A spokesperson for Bradford Council said: “We extend our heartfelt condolences to Pauline Harrison’s family and friends for their sad loss.

“We understand the concern about asbestos in buildings and we take the issue extremely seriously.”

In April 2022, MPs recommended a 40-year deadline be set for the removal of asbestos from the estimated 300,000 public and commercial buildings that still contain asbestos. However, the report from the Work and Pensions Committee was rejected by the government.

Following the announcement, Irwin Mitchell contacted 20 local authorities in the UK to gain insight into the true picture of asbestos in public buildings.

More than 230 public buildings in Bradford contain asbestos

In response to requests submitted by law firm Irwin Mitchell under Freedom of Information Act (FOI), it was revealed that 4,533 public buildings across the 20 councils including Bradford, Leeds and Kirklees, still contain asbestos, averaging around 225 buildings per local authority.

Schools are the largest category of buildings affected, making up almost a quarter of the total number. This is followed by community centres, agricultural and park buildings, office space, libraries, leisure facilities and residential settings.

The figures also show that only 291 buildings across the 20 local authorities in question had asbestos removed from them in the last five years, but that 3,263 had had a survey undertaken within the same timeframe.

Bradford Council confirmed all 238 of their public buildings had surveys undertaken within the past five years, but no figures were provided on asbestos removals.

A spokesperson for Bradford Council added: “We comply with all the relevant laws relating to asbestos and have robust policies and procedures in place to deal with it.

“We have an Asbestos Management Unit at the council which provides each building under its control with an asbestos management plan.

“The plan makes sure the material is checked, managed and kept in good condition so that no-one is exposed to asbestos dust or fibres in any council building.

“We also train all our operational staff

and managers in asbestos awareness and before any intrusive work is done on any of our properties we carry out a refurbishment and demolition survey.

“Any local schools that contain asbestos have been given clear guidance on how to manage the material in order to protect pupils, visitors and staff.

“Although the use of asbestos was banned in the UK in 1999, a significant amount of it remains in thousands of buildings across the UK.”

The Approved Code of Practice (ACoP), which accompanies CAR 2012, states that refresher training for work with asbestos should be appropriate to the individual’s job and based on a Training Needs Analysis (TNA) to determine the type of training necessary. For example, for those with extensive training needs, refresher training may involve classroom teaching or practical training. For others, it could be given as part of other health and safety updates, such as a short toolbox talk or e-Learning to refresh experienced workers on the main principles and expectations.

The e-Learning packages offered by ARCA comply with the ACoP e-Learning requirements and are intended for experienced employees who require only a refresher on the main principles and expectations.

Paragraph 251 of the ACoP details the training required for employees doing licensable work with asbestos and forms the basis of the ARCA e-Learning. ARCA e-Learning maps to the competency topics in the Asbestos Management Institute (AMI) publication, ‘Competency within the Asbestos Removal Industry’, which HSE endorses as ‘a sensible and appropriate approach to managing training and competency’.

ARCA e-Learning also maps to the Asbestos Labour Feedback App (ALFA) review criteria. If employees require additional training in any of the ALFA criteria, a specific e-Learning module can provide that training. The e-Learning modules can be individually selected to produce a combination of modules tailored to individual TNA requirements.

In summary, HSE recognises e-Learning refresher training for licensable asbestos work in the ACoP. The ARCA e-Learning modules map to the ALFA assessment criteria in the AMI publication, ‘Competency within the Asbestos Removal Industry’, which is endorsed by HSE as ‘a sensible and appropriate approach to managing training and competency’. Therefore, by using the ALFA app to carry out TNAs, and addressing any training needs using the appropriate e-Learning modules, ARCA members can ensure that the training requirements of their experienced workers are assessed, met, and recorded.

Packaging & Transporting Asbestos Cement Sheets for Disposal

In England and Wales, all asbestos waste containing more than 0.1% asbestos is classified as ‘hazardous waste,’ while in Scotland, it is classified as ‘special waste.’ The corresponding waste legislation is enforced by the Environment Agency, Natural Resources Wales, or the Scottish Environment Protection Agency.

When disposing of waste containing asbestos, it must be done in compliance with the relevant waste Regulations, which include a “duty of care.” One requirement of this duty of care is that duty holders must prevent the escape of the waste while it is under their control. Additionally, all movements of asbestos waste must be accompanied by a hazardous/special waste consignment note. The Control of Asbestos Regulations 2012 (CAR 2012) also apply.

ADR (The European Agreement concerning the International Carriage of Dangerous Goods by Road), exempts some asbestos products from compliance with ADR and the Carriage of Dangerous Goods and Use of Transportable Pressure Equipment Regulations 2009 (CDG). However, they are still subject to the Hazardous or Special Waste regulations and CAR 2012. The exemption applies to waste that is either bound in cement, plastic, or another binder to prevent the escape of fibres during transportation, or manufactured articles containing asbestos, such as asbestos cement sheets, drainpipes, or vinyl floor tiles.

Packaging of Large Asbestos Cement Sheets

Packaging for large asbestos cement (AC) sheets must include an Asbestos ‘a’ warning label in accordance with UK

REACH (Registration, Evaluation, Authorisation and Restriction of

Chemicals) Annex XVII, Appendix 7. The label is necessary to alert people that the package contains asbestos. For example, large AC sheets can be wrapped in polythene with an asbestos label applied, or a UN asbestos bag can be used, as it already has an Asbestos ‘a’ warning label on it. AC roof sheets, being manufactured articles, are not subject to the requirements of ADR if they are packed in a way that prevents asbestos fibres from escaping during transportation, even if they are damaged or have the potential to be damaged. There is no specific guidance within ADR regarding the nature of such packaging, so reference should be made to CAR 2012.

According to the Control of Asbestos

Regulations 2012:

(1) Employers who work with asbestos must ensure that raw asbestos or waste containing asbestos is not:

(a) Stored

(b) Received into or dispatched from any place of work

(c) ) Distributed within any place of work, except in a totally enclosed distribution system, unless it is in a sealed receptacle or, where more appropriate, sealed wrapping, clearly marked in accordance with paragraphs (2) and (3) indicating that it contains asbestos.

The Approved Code of Practice (ACoP) accompanying CAR 2012 provides guidance on packaging large items of waste, such as AC:

w 529 – Large items of rigid ACM, such as sheets of asbestos cement and textured coatings attached to a board, should not be broken up or cut down for disposal in plastic sacks whenever possible.

w 530 – Intac t rigid waste should be double-wrapped in suitable polythene sheeting (1000 gauge or equivalent) or other suitable material and labelled accordingly.

w 531 – If the asb estos waste is not to be disposed of immediately, the wrapped package should be placed in a suitable and clearly labelled sealed receptacle, such as a lockable skip or freight container.

In summary:

CAR 2012 requires employers to prevent or minimise the exposure and spread of asbestos fibres during handling, transportation, and final disposal. What does this mean specifically for large quantities of intact AC roof sheets?

w The shee ts must not be broken up for waste disposal purposes.

w They must be protected from damage during transport, which could cause further spread of asbestos fibres. This can be achieved by securing and containing them in a metal skip or lorry with metal side panels to provide protection on three sides.

w The spre ad of fragments and dust must be minimised. This can be done by either double wrapping each sheet individually in 1000-gauge polythene or placing them in a suitable bag or a polythene-lined skip or lorry.

w The shee ts should be taken to a licensed waste facility.

l If they are going to a waste transfer station, the AC sheets must be double wrapped in polythene or another suitable material, as people will be handling them.

l If they are going straight to a landfill, the vehicle used for transport must be suitable for both transportation and tipping at the face of the landfill. Polythene-lined skips and lorries are accepted, but the waste must not be handled by operatives. It should be tipped in accordance with the site rules and procedures.

Note: A flatbed lorry would not be considered suitable as it does not provide physical protection to the secured load at the sides, unlike a skip or tipper truck.

ARCA supports the HSE campaign to highlight the risk of asbestos to those working in trades

Builders, carpenters, electricians, joiners, plasterers, plumbers, and roofers, are just some of the trades being urged to take the risks of asbestos seriously. That’s the message from the Health and Safety Executive (HSE).

The workplace regulator has launched (06/03/2023) a new campaign to raise awareness of the risks associated with the dangerous substance.

The campaign, called Asbestos and You, will target all tradespeople with a focus on younger workers who have recently joined the industry.

HSE wants to reach construction workers who started their careers after the use of asbestos was banned in 1999.

The HSE is concerned the length of time it takes for symptoms to develop after asbestos exposure could lead to a perception among today’s younger workers that it is something that only impacts older people who were working before the ban.

Five thousand people a year still die from asbestos-related illnesses and asbestos can still be found in buildings built or refurbished before the year 2000.

Asbestos-containing materials were

used extensively in the construction and maintenance of buildings in Great Britain from the 1950s until they were banned. That means construction workers of all ages could still be exposed to asbestos fibres today.

HSE’s chief executive Sarah Albon said: “Asbestos exposure in Great Britain is still the single greatest cause of work-related deaths. We are committed to protecting people in the workplace and reducing future work-related ill health”.

“Everyone working in construction today, of any age, must take the risk from asbestos seriously. Asbestos is dangerous when not maintained in a safe condition or if physically disturbed without the right

measures in place to avoid fibres being released into the air.”

If asbestos fibres are inhaled, they can cause serious diseases such as mesothelioma, asbestos related lung cancer, asbestosis, and pleural thickening. Construction tradespeople of any age are at significant risk if they disturb materials containing asbestos during repairs and refurbishment.

Key things to consider when insuring your commercial property:

Appoint - Plan - Remove

It is crucial for property owners and managers, including those overseeing commercial properties, NHS facilities, schools, and housing groups, to take asbestos risks seriously and manage asbestos in a controlled and safe manner. Even today, asbestos remains the leading cause of workrelated deaths in the UK, resulting in approximately 5,000 asbestos-related cancer deaths annually.

Owners and managers of properties built before the year 2000 have a responsibility to manage the risks associated with asbestos. They must ensure that both employees and non-employees are not exposed to health and safety hazards due to the presence of asbestos.

If asbestos-containing materials (ACMs) are found in a building and their condition necessitates removal, or if the building is undergoing renovation or demolition requiring ACM removal before work commences, clients have legal obligations to oversee the project and appoint a competent contractor.

Client duty to manage a project:

Clients have explicit responsibilities for managing construction projects in accordance with the Construction (Design and Management) Regulations 2015 (CDM 2015). As clients are at the top of the procurement chain, the law mandates that they establish appropriate measures to manage a project and continuously review these measures throughout its duration to ensure effective management of health and safety risks. It is not required for clients to possess expertise in construction or asbestos work, nor are they expected to directly supervise or manage the work themselves. However, they hold the responsibility of ensuring that suitable arrangements are in place for managing and organising projects during both the “preconstruction” and “construction” phases. This includes appointing competent individuals and providing them with adequate information, time, and resources to carry out their tasks safely and effectively.

If asbestos removal is necessary, the client must appoint a competent asbestos removal contractor. To ensure this, the client should conduct reasonable inquiries to confirm that contractors have the necessary resources and competence for the proposed work.

How can clients reassure themselves of competency?

Firstly, it is important to determine whether the type of asbestos-containing material requires a contractor to hold a licence from the Health & Safety Executive (HSE) for its removal under controlled conditions. A list of licensed contractors can be found on the HSE website.

Secondly, clients should inquire whether the contractor undergoes independent audits, specifically on-site verification inspections, to ensure compliance with the necessary requirements. Clients can verify this by checking whether the contractor is a member of a trade association. Some clients rely on trade associations to uphold industry standards and provide an additional level of assurance.

However, clients should not rely solely on a trade association logo. Asbestos removal entails significant health and safety risks, so it is essential to delve deeper into what membership of a trade association actually means.

To ensure compliance with relevant legislation and provide reassurance to all parties involved, the Asbestos Removal Contractors Association (ARCA) introduced the Site Audit Accreditation Scheme (SAAS) in 2000. The SAAS supports members’ performance and upholds standards. ARCA member contractors must undergo a satisfactory site audit to join the association (as well as an office audit), and then maintain membership by undergoing a number of site audits each year.

In January 2017, ARCA further enhanced its audit scheme by conducting unannounced site audits. The HSE provided ARCA with certain details (such as the licensee’s name, site location, dates of work, and nature of work) from the licensed contractors’ “notification of asbestos work” form. With this information, ARCA can arrange unannounced site

audits, adding an even stronger level of reassurance for all parties, including clients.

In January 2020, ARCA and its members committed to increasing the SAAS requirement from 2 to 3 unannounced site audits per membership year, which was increased to 4 site audits per membership year in January 2023.

Asbestos removal work:

Once a contractor is appointed, it is essential for the client to provide them with sufficient information, time, and resources to ensure the job is carried out properly. The client must supply appropriate preconstruction information to enable the contractor to develop a suitable Plan of Work. Additionally, contractors require adequate time and access to thoroughly assess the premises and discuss important site details with the client. The decisions, actions, or lack thereof on the part of the client can have a significant impact on the successful execution of the work.

Furthermore, the contractor is responsible for submitting a notification of work to the HSE at least two weeks before the work is scheduled to commence. This means that the work must be carefully planned prior to its initiation.

A Plan of Work:

The licensed asbestos removal contractor has the responsibility to develop a suitable Plan of Work (PoW) and adhere to Regulation 7 of the Control of Asbestos Regulations 2012 (CAR 2012). The PoW should be a practical and informative document that outlines the site details, asbestos locations, access points, waste routes, and more, providing a safe working method for the site staff to follow. It is important for the PoW to be comprehensive yet manageable in length. Utilising diagrams, photographs, and flowcharts can help make the PoW concise and easy to comprehend. The HSE supports the notion that generic information about commonly used company procedures, such as waste bagging methods or enclosure construction materials, does not need to be included in the site-specific plan. Instead, this generic information should be readily available on-site in a readable format, either electronically or in hard copy.

The asbestos removal contractor’s manager should collaborate with the client to develop the PoW, ensuring both parties are aware of any site constraints and the presence of other trades on-site. The PoW primarily serves as support for the site staff but should also be accessible to the analyst, manager, auditor, HSE inspector, and client. Successful project execution requires good coordination and cooperation among all parties involved. Inaugural AGM focuses on Aims and Objectives

Recently, AMI underwent a thorough review, refreshment, and relaunch, quickly become establishing itself within the asbestos management industry. A small team of NFDC and ARCA representatives oversaw changes to the website, Articles of Association, rules of membership and the CPD scheme. A slight change to the name was made and a new logo was developed.

Subsequently, AMI successfully held its inaugural Annual General Meeting (AGM) and elected its first Council of Management. The AGM, held on the 6th of April 2023, took place remotely via Zoom video conferencing. The meeting was open to both members and non-members with a total attendance of 167 people. During the meeting the annual accounts and the auditors for the current financial year were approved, and the Council of Management was elected.

During the AGM a series of presentations were delivered by guest speakers. Vernon Watson, President of the Institute of demolition Engineers (IDE), gave a presentation on ‘the Role of Professional

Bodies in Safety Critical Professions’. Matt Greenly, HSE Inspector, presented on ‘Welfare on Asbestos Removal Sites’. Saranjit Sihota, representing Mesothelioma UK, delivered a sobering presentation highlighting the current extent of the mesothelioma problem in the UK and its devastating impact on those diagnosed with the disease. Lastly, Rose Bricis from the HSE presented on ‘Asbestos Removal using Needle Guns, Abrasive Blasting and Floor Grinders’.

The newly elected AMI Council of Management held its first meeting on May 24th. The Council are excited about the Institute’s potential to positively influence the industry through better knowledge, improved standards, and safer management of asbestos. This in turn, will lead to reduced exposure and lower incidences of asbestos related disease.

As this was the inaugural meeting of the AMI Council of Management, it provided an opportunity to establish the foundation for the Institute’s future endeavours. The Council discussed a review of the mission

and vision to assess their ongoing relevance. They also addressed the Terms of Reference for the Council and a Code of Conduct for members. Additionally, they deliberated on the Aims and Objectives. These critical building blocks require more than on meeting to finalise and implement. However, certain decisions were made, forming the initial short-term objectives. The first objective is to write a guidance note on the use of needle guns during asbestos removal work. The second objective is to organise another remote seminar, open to all and free of charge, scheduled for mid-September. The second Council meeting is set for July 19th, as Council members are keen to maintain the momentum that has recently been developed.

Who can become a member?

Membership of the Institute is open to individuals engaged in professions relating to the removal and/or management of asbestos. These professions include asbestos removal managers, asbestos project managers, asbestos removal supervisors, asbestos analysts, asbestos surveyors, and asbestos consultants. The Institute offers seven grades of membership, including Fellow, Associate and Entrant members.

Professional Development

AMI focuses on recognising and promoting effective asbestos management, which is why members are encouraged to cultivate a culture of Continuing Professional Development (CPD). CPD entails a long-term commitment to improving knowledge, skills, and competence, serving as an investment in the future. The Institute has implemented a CPD Scheme that requires members to earn at least 10 points in any given calendar year through core and non-core activities, all directly related to asbestos management. To facilitate members’ CPD management, the Institute has developed a dedicated portal where members can access and record their own CPD activities.

Advancing Together: The President’s Aims and Objectives for the Asbestos Management Institute

With over 25 years of experience in the asbestos industry, I bring a deep passion and unwavering dedication to driving improvements, promoting awareness, and effecting positive change.

My journey in the industry began as an operative, where I gained valuable first-hand experience and earned my ‘battle scars.’ Over the years, I progressed through various roles, including asbestos supervisor, asbestos surveyor, and asbestos contracts manager. I also had the opportunity to work on the client side as an asbestos consultant for Serco at the Defence Academy of the UK. Currently, I hold the position of asbestos manager at Wring Group Ltd, a company specialising in demolition and asbestos removal.

Throughout my career in the industry, I have witnessed the good, the bad, and the ugly. However, my ability to effect change was limited to the organisations I worked for at the time. With my appointment as President of The Asbestos Management Institute, I am hopeful that the Institute can have a far-reaching impact across the asbestos network.

I have taken some time to consider my role and consider the aims and objectives for the Council of Management during my tenure; these are as follows:

A key objective is to increase the Institute’s membership. I firmly believe a larger, more diverse membership base will strengthen our collective expertise and amplify our impact on the industry. We need initiatives to attract new members and engage professionals involved in asbestos management, including contractors, consultants, researchers, and policymakers. By highlighting the benefits of membership and showcasing the Institute’s contributions to the profession, we can expand our reach and influence.

Open dialogue is crucial for progress in the asbestos industry, and I am committed to championing transparent and inclusive discussions. Creating a culture of open communication within the Institute encourages members to share their experiences, insights, and challenges. By raising important issues with policymakers, we can drive opportunities for change that benefit the whole industry. Facilitating forums, conferences, and workshops, will provide platforms for meaningful exchanges, enabling members to learn from one another, address common concerns, and collectively find solutions to complex asbestos management issues.

The construction industry holds a crucial position in the UK economy, playing a significant role in driving economic growth and offering employment opportunities to millions of people. However, the industry is currently facing a pronounced shortage of skilled workers. In response to this challenge, the Construction Industry Training Board (CITB) has taken steps to address the issue by implementing changes to its Grant Scheme. As part of these changes, the CITB now offers extra financial support to employers who provide construction-specific training to their workforce.

According to the latest Construction Skills Network report, the construction industry will require an additional 224,900 workers in the next five years to meet its demands. This highlights the need for employers to prioritise upskilling their workforce to meet industry requirements. To support this endeavour, the CITB has made significant changes by doubling the grant rates for short courses. Starting from April 1st, 2023, employers can now receive a grant of up to £240 when an individual successfully completes a short course. This increased financial support aims to assist employers in providing essential training to their

workforce and to encourage employees to enhance their skills through upskilling initiatives.

In response to feedback from CITB levy claimers, the CITB has extended the deadline for claims to 52 weeks, providing employers with an additional 32 weeks to submit their claims. This change allows companies a greater opportunity to utilise these grants. The increased grants and extended deadline aim to encourage more training in the skills required for the construction industry. The updated grant tiers are as follows:

w Tier 1 - Previously £30, now £60

w Tier 2 - Previously £70, now £140

w Tier 3 - Previously £120, now £240

The CITB Grants Scheme presents an excellent opportunity for employers to enhance the skills of their workforce and address the industry’s skills shortage. It also offers a means to reduce training and development costs. The scheme is available to all CITBregistered employers eligible to receive grants for various training courses and qualifications.

To enhance support for ARCA members who pay the CITB Levy, we offer monthly seminars conducted via Zoom. These seminars have proven consistently successful in helping ARCA members secure additional funding for their training and qualifications. The upcoming seminar dates for this year are:
