G

iven the news about General Motors’ pledge to stop making gasoline-powered cars by 2035, the pressure upon associations to make accommodations for the installation and use of charging stations for electric vehicles is greater than ever. While the numbers right now don’t seem all that impressive (less than 2% of the vehicles on the road today are electric-powered), the recent announcements by GM seem to be a signal that market forces are beginning to significantly shift. When the biggest car manufacturer in the country pledges that at least 40% of their new sales by 2025 will be battery-powered electrical vehicles, that pledge seems seismic.

As a state, Maryland appears fully charged. Currently, there is a bill pending in the Maryland General Assembly to amend the Maryland Condominium and Homeowners Association Acts to void any recorded covenant or restriction contained in a declaration, set of bylaws, or rules if such covenant, restriction, or provision effectively prohibits or unreasonably restricts the installation or use of electric vehicle (EV) charging equipment in an owner’s deeded parking space or a space that is designated for use by a particular owner.

APPLICATIONFORAPPROVALPROCESS As proposed, the legislation would require most Boards to establish an application-for-approval process for the installation of EV charging equipment and to accept an

owner’s proposed installation if it does not unreasonably impede the normal use of the area outside the parking space and is reasonably possible. In most cases, Boards would be required to act on an application within 60 days and render a decision either approving or denying the application in writing.

OWNER COMPLIANCE As proposed, the legislation permits Boards to require owners to comply with all relevant building codes, safety standards, and existing architectural standards. Boards may compel owners to obtain local permits, require the installation to be conducted by a licensed contractor, and require owners to pay for electricity usage through separate metering.
