Finies les splendeurs macédoniennes sur les rives du Golfe Thermaïque à Thessalonique, finis les commerçants des villes hanséatiques du Nord et l’Art Nouveau à Riga, finis les pieux et preux Chevaliers de Malte à La Valette; en 2013 tous à Porto ! En effet, les prochaines assises auront lieu dans cette ville du Nord du Portugal (la « capitale du Nord », la cité « invaincue ») du 26 au 31 mai 2013.

Dans le cadre de ces assises se tiendra évidemment et obligatoirement l’Assemblée générale annuelle de l’AIACE internationale. Il s’agira d’une AG importante car le Statut du Service public européen et nos pensions sont attaqués par de nombreuses délégations au sein du Conseil. Des personnalités y feront le point à l’issue des longues et complexes négociations.

Ces assises sont aussi l’occasion de retrouvailles entre anciens collègues répartis dans toute l’Europe, ce qui permet souvent des rencontres nouvelles, amicales et sympathiques. Les anciens ont encore souvent à cœur de continuer à promouvoir leur idéal européen. Et tout ceci relève précisément d’un des buts de l’AIACE. Aller à Porto, ce sera l’occasion de découvrir cette ville charmante, désignée comme meilleure destination européenne de l’année 2012 et de plus classée Patrimoine universel par l’UNESCO ; une ville relativement méconnue, surtout depuis sa renaissance des dernières années, qui la rendra méconnaissable à celles et ceux qui l’ont connue sale et délabrée. Il reste certes encore du pain sur la planche, mais la ville présente une pléiade de sites, de quartiers et de monuments particulièrement intéressants à découvrir. A côté de l’architecture religieuse traditionnelle et des mondialement connus azulejos (carreaux de faïence émaillés), il y a toute une série de petites merveilles Art Nouveau ainsi que des édifices néoclassiques et romantiques du 19ème siècle à admirer. Mais il y a aussi les quartiers animés de Ribeira le long du fleuve Douro (prononcer « dorou », comprenne qui pourra …), l’architecture métallique (particulièrement visible dans les ponts construits ou conçus par Gustave Eiffel ou ses disciples).

700 files were closed during 2011 – Of the 700 EU Pilot files in 2011, the Commission closed 508 files because the Member State provided a satisfactory response. This is a 72.5 % resolution rate for the Member States (an 8.5 % decrease from the 2010 rate of 81 %).17

1. TRANSPOSITION OF DIRECTIVES

1096 files remained pending – By the end of 2011, most of the EU Pilot files were addressed to Italy (371), followed by Spain (365) and Germany (193). From the point of view of policy areas, environment was the leading field with 335 open dossiers before internal market & services (129) and taxation & customs union (117).

1.1. OVERVIEW OF THE 2011 TRANSPOSITION WORK

The Commission closed 183 EU Pilot files last year by launching formal infringement procedures. Negative outcomes of the procedure under EU Pilot were most frequent in dossiers on environment (49 such cases), taxation and customs union (24) and transport (21 refusals). Italy, Poland and Spain had the highest number of such transfers to infringement proceedings (21, 15 and 14 files, respectively).

Member States had to transpose more directives in 2011 compared to the previous year (i.e. 131 in contrast to 111 directives in 2010).

There has been a significant increase in late transposition in 2011 compared to the previous year. The Commission launched 1185 late transposition infringements in 2011 compared to 855 in 2010 and 531 in 2009. Compared to the end of 2010, 763 late transposition cases were open at the end of 2011, representing a 60 % increase. Monitoring late transposition is a Commission priority3 and the Commission proposes fines under the special penalty regime established by Article 260(3) TFEU against Member States if they do not transpose directives in time (details in point 1.2 below).

GENERAL STATISTICS There were 117 open infringements against Belgium at the end of 2011, which is the third-worst result among the EU-27.

Belgium’s performance is below average in its reference group46: Romania had 47 open infringements, Hungary 54, the Czech Republic 65, the Netherlands and Portugal 71 and 84 respectively and Greece 123. However, Belgium closed the year with fewer infringements than in 2010 (126) and 2009 (128). The following chart shows the four policy areas where Belgium was most frequently subject to infringement procedures

Six cases were submitted to the Court against Belgium during 2011 (by contrast to the 11 submissions in 2010). The Commission contested: the discriminatory nature of the de facto exemption granted to Belgian (but not to EU) investment companies from interest and dividend tax,47 the failure to adopt river basin management plans48 and the lack of indexation of Belgian pensions when paid to certain non-resident persons.49 Within the reference group, no cases were brought against Romania or Hungary;there were three against Portugal and four each against the Netherlands, the Czech Republic and Greece.

The Commission filed one case against Belgium under Article 260(2) TFEU with a request for financial sanctions due to Belgium’s failure to collect and/or treat urban waste water properly in some areas of the country.50

At the end of 2011, 1775 infringement cases were open.20 The number of open infringement cases has been falling year on year - 2100 cases in 2010 and nearly 2900 cases in 2009. The following charts break down infringements according to Member States and policy areas:

workers,inheritanceandsecuritiesincome;23complaints),environment (inadequate impact assessments, potential damages to Natura 2000 sites, nitrates pollution and urban waste water treatment; 14), free movement of persons (blocking family reunification with non-EU nationals and registration of double barrelled surnames; 9). Complaints also invoked car registration problems, passenger rights and mutual recognition of professional qualifications.

EARLY RESOLUTION OF INFRINGEMENTS Belgium joined EU Pilot in early 2011. By the end of the year, the Commission and the Belgian authorities were working on 42 newly opened files. Belgium’s average response time in EU Pilot (71 days) is only slightly above the 10-week benchmark.

Alignment of certain disputed Belgian laws with EU rules resulted in the closure of several infringements in 2011 in particular: the barriers to parallel imports of drugs were removed; unit rates for air terminal charges were notified51 the independence of the rail safety authority was ensured52 Belgian pensions were made payable to any bank account within the EU compliance was achieved with the drinking water directive;53 and two discriminatory tax regimes were adjusted (a flat-rate tax reduction available only to Flemish residents and tax deduction of interests paid to Belgian banks).54 IMPORTANT JUDGMENTS The three Belgian regions were found to have failed to lay down the necessary criteria and thresholds making projects subject to environmental impact assessment.55 Belgium was also found guilty of not requiring an impact assessment for projects likely to damage Natura 2000 sites such as the Étangs de Roly.56 In addition, the Court rejected the exercise of official authority as a justification for maintaining the nationality condition for public notaries.57 However, safeguarding the tax system’s cohesion did justify a discriminatory tax credit that was granted only to residents moving house within Flanders.58 The Court’s preliminary rulings clarified, among other things, that the mere conversion of an administrative decision into a national law does not automatically exempt a project from the requirements laid down in the Environmental Impact Assessment Directive.59

The Commission opened 45 infringement procedures against Belgium for late transposition of various directives in 2011. Belgium faced 14 such procedures in 2010. Ranking as the 17th in the EU-27, this result is still better than for the other Member States in the reference group except for the Netherlands.

The policy areas where Belgium experienced serious challenges in transposing EU directives are transport and internal market & services (10 late transposition infringements in each area) and energy (6).

In no case in 2011 did, the Commission refer Belgium to the Court with a request for financial sanctions (Article 260(3) TFEU) due to late transposition of directives.

This brochure, a concise guide for staff in the Cabinets, aims to address the ethical issues of relevance to most colleagues. However, we live in an ever-changing world and ethics rules might not always fully correspond to the real situation. In such cases, retain the spirit of the rules, add a good dose of common sense and ask for advice from the Ethics Correspondent.

Yes, there is a disciplinary system which applies to any failure by an official or former official to comply with his/her obligations (including offences under national criminal law) under the Staff Regulations, whether intentionally or through negligence. This also covers conduct in private life.

Professional ethics is therefore of paramount importance for European Commission staff. The Staff Regulations and the Code of Good Administrative Behaviour describe what is expected from you as a Commission employee, within and outside office walls, so as to maintain intact the independence and reputation of the Institution.

What if staff violates these common rules? Are there any sanctions?

Your behaviour and your decisions must be governed by the determination to serve the public interest and only the public interest. Therefore, you should resist pressure of any kind (political, lobby, private interests, etc.) and always aim to promote the common good.

The Commission is an institution under close public scrutiny. It takes pride in serving the citizen and working exclusively for the common European good. All its actions must prove that it deserves the high level of trust Europeans invest in it.

In a nutshell, the overarching principles guiding staff behaviour in the Commission are: independence, impartiality, objectivity, loyalty and dignity. They are not limited to your attitude and actions during working hours. Therefore, always bear in mind that you are the human face of the Commission, and make sure that your conduct is beyond reproach, by refraining from any action or behaviour that could harm your image and the reputation of the institution.

The Staff Regulations are centred on the golden principle of impartiality. They establish boundaries of acceptable behaviour for EC staff in such a way that our independence stays beyond doubt. The Commission’s Code of Good Administrative Behaviour supplements the Staff Regulations and represents a firm commitment of the Commission to provide high quality service to the European public.

Along with the documents mentioned in the annex, these are the key texts you must read to be fully aware of what is expected from you as Commission official.

En passant en revue les évènements de la planète de ces 12 derniers mois, tout le monde aurait tendance à se focaliser sur les aspects négatifs et pourrait énumérer toute une série de choses qui se sont mal, ou pas tout à fait bien, passées (guerres, conflits, catastrophes naturelles, … la crise économique persistante qui touche tous les pays d’Europe) et la photo qui en résulterait serait effectivement très sombre. Cependant, cette image de 2012 serait quelque peu déformée car cette année nous a tout de même apporté quelques bons moments comme les exploits des athlètes aux Jeux olympiques et Paralympiques de Londres, de nombreuses avancées et découvertes scientifiques, des sommets importants, etc. ainsi que l’attribution du Prix Nobel de la Paix à l’Union Européenne, dont nous pouvons tous être très fiers.

Avec un peu de recul et une analyse appropriée de tous ces évènements, nous pouvons donc trouver un certain équilibre, comme d’ailleurs dans notre vie professionnelle et notre vie privée : rien n’est tout à fait noir ou tout à fait blanc. Nous avons tous de bons jours et de moins bons, nous traversons tous des moments de crainte et des moments de bonheur, et 2012 n’a pas fait exception en ce sens. Au niveau professionnel, même si chacun et chacune d’entre nous a pu rencontrer l’une ou l’autre difficulté, nous pouvons tous être fiers de ce que nous avons accomplis et, en particulier, du maintien d’un taux de satisfaction très élevé envers nos services, 95.57%, qui est le reflet de vos efforts quotidiens, donc bravo à vous tous !

Quant à l’avenir : que va nous apporter 2013 ? Sans une boule de cristal, il est difficile de le dire avec précision, mais nous pouvons être sûrs d’un certain nombre d’avancées dans les domaines du développement social et humain et, d’après ce que j’ai lu, la NASA devrait envoyer des sondes vers Vénus et Mars (extraordinaire!) et quelques soldats supplémentaires seront sans doute retirés d’Afghanistan. Sur le front européen, la crise économique en Europe continuera probablement bien qu’une certaine croissance est prévue. Une décision sera également prise en début d’année sur le cadre financier pluriannuel pour la période 2014-2020 qui va déclencher de nouvelles discussions sur la réforme du statut, apportant avec elle des changements pour nous tous. En ce qui concerne le CPE.1, et en dépit des contraintes économiques et opérationnelles, l’accent sera mis sur la consolidation et l’amélioration du travail d’équipe ainsi que sur le bien-être du personnel. De manière plus générale, la Croatie devrait rejoindre l’Union européenne au cours de l’été et nous pouvons donc nous attendre à améliorer encore plus la mixité apportée par de nouveaux collègues. 2013 sera également l’Année européenne des Citoyens visant à faire connaître et comprendre les droits des citoyens - entre autres - le droit de vivre et de travailler partout dans l’UE. Bref, une année qui s’annonce à nouveau bien remplie et passionnante.

Mes remerciements vont à vous tous pour votre travail et votre contribution tout au long de 2012 et je voudrais saisir cette occasion pour vous souhaiter ainsi qu’à vos familles et vos proches un très joyeux et paisible Noël et une excellente année 2013.

Tous les 2 ans, l’OIB lance une enquête de satisfaction auprès des parents utilisateurs des crèches. Cette année, l’enquête portant sur les cinq crèches de la Commission: Beaulieu, Clovis, Cornet-Leman, Genève et Palmerston, ainsi que sur les trois crèches locales: Franklin, Froissart et Square Marie-Louise, a eu lieu du 16 avril au 05 mai 2012.

606 parents ont répondu sur les 1153 parents consultés, soit un taux de participation de 52,6%, taux comparable à ceux des enquêtes de 2006 et de 2008 et légèrement inférieur à celui de l’enquête de 2010.

Lors des enquêtes de 2006, 2008 et 2010, les questions étaient restées les mêmes afin de permettre une comparaison des résultats. En 2012, le questionnaire a été quelque peu modifié, et surtout complété afin d’obtenir l’avis des parents sur de nouveaux sujets, tels que l’administration des crèches par les gestionnaires ou le service fourni par le Bureau d’accueil. L’échantillonnage des réponses a également été modifié afin de permettre des réponses plus nuancées. Ces changements dans le questionnaire ne permettent plus une comparaison précise avec les résultats des enquêtes précédentes mais permettront un

meilleure analyse et un plan d’action d’autant plus adéquat.

Le taux de satisfaction global reste très élevé avec un score de 89% pour l’ensemble des crèches.

Parmi les points forts pour toutes les crèches, l’aménagement des espaces en section obtient un score très positif avec une moyenne de 83% de parents satisfaits (la crèche Cornet-Leman obtenant 97% et celle de Clovis un score de 93%). Les jouets et matériel didactique mis à la disposition des enfants sont également très apprécié avec un résultat moyen de 94% (Beaulieu 97%, Cornet-Leman 96%, Palmerston et Genève obtenant 94%). L’hygiène des crèches est un autre point fort avec une moyenne de 87% pour toutes les crèches.

Les questions portant sur la communication obtiennent des résultats très positifs, avec seulement deux aspects qui pourraient encore être améliorés: la diffusion orale et/ou écrite de l’information pédagogique (longue absence d’une enseignante/puéricultrice, remplacement référente, organisation de réunions, d’activités, etc.) qui obtient un score de 64%, et le déroulement des réunions de parents qui atteint une moyenne de 59% pour toutes les crèches, avec les résultats les plus faibles pour Franklin, Froissart et Beaulieu.

pédagogique obtiennent des scores très élevés avec comme seul point plus faible la stabilité des équipe qui n’atteint que 66% de parents satisfaits.

Les questions sur l’information alimentaire et les repas obtiennent également toutes des scores supérieurs à 70% de parents satisfaits.

Les nouvelles questions portant sur l’administration des crèches et le service à la clientèle obtiennent des résultats satisfaisants avec la mise en évidence de quelques points qui pourraient être améliorés, comme la disponibilité du Bureau d’accueil des crèches (même si la moyenne des parents satisfaits atteint quand même 69%) et la qualité des réponses des gestionnaires des crèches (59%). Enfin, les horaires de fonctionnement des crèches et les horaires de fréquentation mi-temps sont relativement bien adaptés aux besoins des parents avec des scores respectivement de 85 et 88%.

Le CPE.1 se réjouit des bons résultats globaux obtenus et assure les parents de la continuité de ses efforts pour offrir un service de qualité aux parents et aux enfants.

Dear parents, I am delighted to be sending you this very first edition of Crèches Post, a newsletter especially for the parents of the children who attend the Commission’s nurseries and kindergarten. This newsletter has been designed in direct response to remarks made during the recent Satisfaction Survey requesting more regular information about the general organisation of the nurseries. Crèches Post will be published and sent to you three times a year (in January, May and September) and is just one of the actions being put in place as a result of the Satisfaction Survey – you will be kept informed as the other actions come on board. I do hope you appreciate this initiative and the information contained in this newsletter is of interest to you. Should you have any ideas as to how to improve the newsletter or would like to suggest a topic to be covered in a future edition, please send your remarks/suggestions to OIB CPE 1 GESTION QUOTIDIENNE. Looking back at world events over the last twelve months, one could focus just on the negative and list all the things that went wrong or not quite right (wars, strife, natural disasters … the continuing economic crisis affecting every country in Europe) and the picture would indeed be very bleak. However, that would be a rather distorted view as 2012 also brought us lots of good things such as the fantastic achievements of athletes at the London Olympics and Special Olympics, various scientific breakthroughs or milestones, important summits, etc. and also the awarding of the Nobel Peace Prize to the European Union of which we can all be very proud.

So, when you stand back and analyse things properly a certain general balance can be found. It is the same in our daily working or personal lives, all is neither black nor white. We all have good days and bad days, we all live through moments of fear and moments of joy, and 2012 was no different in that sense. From a work perspective, while each and every one of us faced some difficult days, we can generally be proud of our achievements however small, and in particular, the continuing high rate of satisfaction with our services which at 95.57% is a reflection of your daily efforts – so well done to all!

Looking forward, what will 2013 bring? Without a crystal ball it’s difficult to say precisely, however we can be sure of a certain number of advances in the fields of social and human development and, from what I read, NASA is set to send probes to Venus and Mars (extraordinary!) and some more troops will no doubt be withdrawn from Afghanistan. On the European front, the economic crisis in Europe will no doubt continue although some growth is forecasted. A decision will also be taken early in the year on the Multiannual Financial Framework for the period 2014-2020 which will trigger new discussions on the reform of the Staff Regulations, bringing with it changes for all of us.

With regard to CPE.1, and notwithstanding the economic and operational constraints the focus will be on more consolidation and better teamwork and also staff well-being. More broadly, Croatia is set to join the European Union in the summer and so we can look forward to enhancing the mix that new colleagues bring. 2013 will also be the European Year of Citizens designed to heighten awareness and understanding of citizens’ rights - inter alia - the right to live and work anywhere in the EU. So lots of things to keep us busy and look forward to.

My thanks go to all of you for your work and contribution throughout 2012 and may I take this opportunity to wish you and your families and loved ones a very happy and peaceful Christmas and a very good 2013.
