“The Commission will hear evidence of events involving certain financial services entities in the context of home lending that suggest that consumers have not always enjoyed the right to be treated honestly and fairly when it comes to home loans.

“Some of these events may have involved breaches of the law, while others may have involved departures from community standards and expectations.

“Each of these events give rise to important questions for consideration by the Commission, not least of which are how and why were such events permitted to occur, and what steps, if any, were taken at the time or have since been taken in response to those events, including steps to ensure that they do not recur.” ●

THE extent of unfair or dishonest practises when it comes to home lending will come under scrutiny when the Royal Commission into banks holds its first round of public hearings next month.

All Australians had the right to be treated honestly and fairly in their dealings with banks, commissioner Kenneth Hayne QC said when he opened the Royal Commission into misconduct in the Banking, Superannuation and Financial Services in Melbourne last week.

Whether or not consumers have been enjoying those rights when it comes to lending will be the subject of the first round of hearings.

Senior counsel assisting the commissioner, Rowena Orr SC, said products like home loans, car loans and credit cards would likely be examined, including unsuitable or inappropriate lending.

“The data published in the Commission’s first research paper ... indicates that home loans are the largest asset on the books of authorised deposittaking institutions, comprising around 42 per cent of the assets of such institutions as at the September 2017 quarter,” Ms Orr said.
