وﺟﺑﺔ ﻗﺎﻧوﻧﯾﺔ راﺋﻌﺔ ﻋن اﻟﻔﺻل اﻟﺗﻌﺳﻔﻲ اﺟزاء ﻣن ﺻﺣﯾﻔﺔ دﻋوى ﻗﺿﻰ ﻓﯾﮭﺎ ﺑﺎﻟﻘﺑول و اﻻﻟزام اﻟﻔﺻل اﻟﺗﻌﺳﻔﻲ -اﻟﺗﻌوﯾض ﻋن اﻧﮭﺎء ﻋﻘد اﻟﻌﻣل ﻏﯾر ﻣﺣدد اﻟﻣدة ﺑدون ﻣﺑرر ﻗﺎﻧوﻧﻲ طﺑﻘﺎ ﻟﻘﺎﻧون اﻟﻌﻣل و اﻟﻘﺎﻧون اﻟﻣدﻧﻲ و اﻟرﺑط ﺑﯾن اﻟﻘﺎﻧوﻧﯾن ﻓﻲ دﻋﺎوى اﻟﺗﻌوﯾض ﻋن اﻟﻔﺻل اﻟﺗﻌﺳﻔﻲ .. أوﻻً :ﺗواﻓر ارﻛﺎن اﻟﻣﺳﺋوﻟﯾﺔ ﻣن ﺧطﺄ و ﺿرر و راﺑطﺔ ﺳﺑﺑﯾﺔ ﺑﺎﻟﻧﺳﺑﺔ ﻟﻠﺷرﻛﺔ ﻣﻣﺎ ﯾﺳﺗﺣﻖ ﻣﻌﮫ اﻟﻌﺎﻣل اﻟﺗﻌوﯾض : ﻓﻘد ﺟرى ﻧص اﻟﻣﺎدة ) (163ﻣن اﻟﻘﺎﻧون اﻟﻣدﻧﻲ ﻋﻠﻰ ان ﻛل ﺧطﺄ ﺳﺑب ﺿررا ﻟﻠﻐﯾر ﯾﻠزم ﻣن ارﺗﻛﺑﮫ ﺑﺎﻟﺗﻌوﯾض .....ﻓﻼﺑد اذ ﻟﻘﯾﺎم اﻟﻣﺳﺋوﻟﯾﺔ ﻣن ﺗواﻓر ﺧطﺄ و ﺿرر ﺛم ﻋﻼﻗﺔ ﺳﺑﺑﯾﺔ ﺑﯾﻧﮭﻣﺎ .و ﯾﻌﻧﻲ ﻟﻔظ ﺧطﺄ ﻓﻲ ھذا اﻟﻣﻘﺎم ﻋﻠﻰ ﻧﺣو ﻣﺎ ﻋﺑرت ﻋﻧﮫ ﻣذﻛرة اﻟﻣﺷروع اﻟﺗﻣﮭﯾدي ﻟﻠﻘﺎﻧون ﺳﺎﺋر اﻟﻧﻌوت و اﻟﻛﻧﻲ اﻟﺗﻲ ﺗﺧطر ﻟﻠﺑﻌض ﻓﯾﺗﻧﺎول اﻟﻔﻌل اﻟﺳﻠﺑﻲ )اﻻﻣﺗﻧﺎع( و اﻟﻔﻌل اﻻﯾﺟﺎﺑﻲ ﻋﻠﻰ ﺣد ﺳواء ,و ﺗﻧﺻرف دﻻﻟﺗﮫ اﻟﻰ ﻣﺟرد اﻻھﻣﺎل و اﻟﻔﻌل اﻟﻌﻣد ﻋﻠﻰ ﺣد ﺳواء ,ﺣﯾث ﺟﺎءت ﻋﺑﺎرة اﻟﻧص ﻋﺎﻣﺔ ﻣﻣﺎ ﯾﺟﻌﻠﮭﺎ ﺷﺎﻣﻠﺔ ﻟﻛل ﻓﻌل او ﻗول ﺧﺎطﺊ ﺳواء اﻛﺎن ﻣﻛوﻧﺎ ﻟﺟرﯾﻣﺔ ﻣﻌﺎﻗﺑﺎ ﻋﻠﯾﮭﺎ ام ﻻ ﯾﻘﻊ ﺗﺣت طﺎﺋﻠﺔ اﻟﻘﺎﻧون . و ﺣﯾث ان اﻟﻣﺳﺋوﻟﯾﺔ اﻟﻣﺗرﺗﺑﺔ ﻋﻠﻰ اﻟﺗﻌﺳف ھﻲ داﺋﻣﺎ ﻣﺳﺋوﻟﯾﺔ ﺗﻘﺻﯾرﯾﺔ و ﻟو ﻛﺎن ﻣﺣل اﻟﺗﻌﺳف ﺣﻘﺎ ﻋﻘدﯾﺎ و ﯾﺻدق ذﻟك ﻋﻠﻰ ﺣﺎﻟﺔ اﻟﺗﻌﺳف ﻓﻲ اﻧﮭﺎء ﻋﻘد اﻟﻌﻣل ﻏﯾر ﻣﺣدد اﻟﻣدة ) اﻟدﻛﺗور اﻟﺳﻧﮭوري – اﻟوﺳﯾط – ج )(1 اﻟطﺑﻌﺔ اﻟﺛﺎﻧﯾﺔ ﺻــــــ 955و ﻣﺎ ﺑﻌدھﺎ ,ﻓﺗﺣﻲ ﻋﺑد اﻟﺻﺑور ﺻــ , 416اﺣﻣد ﺷوﻗﻲ ﻋﺑد اﻟرﺣﻣن ﺻــــ – 311ﻣﺷﺎر اﻟﯾﮫ ﻓﻲ ﻣوﺳوﻋﺔ اﻟﻔﻘﮫ و اﻟﻘﺿﺎء و اﻟﺗﺷرﯾﻊ ﻓﻲ ﻗﺎﻧون اﻟﻌﻣل اﻟﺟدﯾد – ﻟﻠﻣﺳﺗﺷﺎر ﻣﺣﻣد ﻋزﻣﻲ اﻟﺑﻛري رﺋﯾس ﻣﺣﻛﻣﺔ اﻻﺳﺗﺋﻧﺎف اﻟﺟزء اﻟﺛﺎﻧﻲ ﺻــ . اﻟﺧطﺄ :و ﺧطﺄ اﻟﺷرﻛﺔ ﯾﺗﻣﺛل ﻓﻲ ﻣﺧﺎﻟﻔﺔ اﻟﻘﺎﻧون و ﺧﺎﺻﺔ ﻧﺻوص ﻗﺎﻧون اﻟﻌﻣل رﻗم 12ﻟﺳﻧﺔ 2003ﻓﻘدﻧﺻت اﻟﻣﺎدة ) (68ﻣن ﻗﺎﻧون اﻟﻌﻣل رﻗم 12ﻟﺳﻧﺔ 2003ﻋﻠﻰ ان ﯾﻛون اﻻﺧﺗﺻﺎص ﻓﻲ ﺗوﻗﯾﻊ ﺟزاء اﻟﻔﺻل ﻟﻠﻣﺣﻛﻣﺔ اﻟﻌﻣﺎﻟﯾﺔ وﺣدھﺎ و ﻻ ﯾﻣﻠك ﺻﺎﺣب اﻟﻌﻣل ﺗوﻗﯾﻊ ذﻟك اﻟﺟزاء ,ﻛﻣﺎ ﻧﺻت اﻟﻣﺎدة ) (69ﻣن ﻧﻔس اﻟﻘﺎﻧون ﻋﻠﻰ اﻧﮫ ﻻ ﯾﺟوز ﻓﺻل اﻟﻌﺎﻣل اﻻ اذا ارﺗﻛب ﺧطﺄ ﺟﺳﯾم و اﻟزﻣت ﺻﺎﺣب اﻟﻌﻣل ﻋﻠﻰ وﺟوب اﻻﺧطﺎر اﻟﺳﺎﺑﻖ ﻟﻠﻌﺎﻣل و ھذا اﻟﺷرط ﻧﺻت ﻋﻠﯾﮫ اﻟﻔﻘرة اﻻوﻟﻰ ﻣن اﻟﻣﺎدة 110ﻣن اﻟﻘﺎﻧون . 12/2003 و ﻗد اﺳﺗﻘرت اﺣﻛﺎم ﻣﺣﻛﻣﺔ اﻟﻧﻘض ﻋﻠﻰ اﻵﺗﻲ )) اذا ﻛﺎن اﻟﺣﻛم ﻗد اﺛﺑت ﺗﻌﺳف اﻟﺷرﻛﺔ اﻟﻣطﻌون ﻋﻠﯾﮭﺎ ﻓﻲ ﻓﺻل اﻟطﺎﻋن ﻣن ﻋﻣﻠﮫ ﻟﻣﺟرد رﻓﻌﮫ دﻋوى ﻟﻠﻣطﺎﻟﺑﺔ ﺑﻣﺎ ﯾﻌﺗﻘد اﻧﮫ ﻣن ﺣﻘﮫ و اﻋﺗﺑر اﻟﺣﻛم ان ھذا اﻟﻔﺻل اﻟﺗﻌﺳﻔﻲ ﺧطﺄ و رﺗب ﻋﻠﯾﮫ ﻣﺳﺋوﻟﯾﺔ اﻟﺷرﻛﺔ اﻟﻣطﻌون ﻋﻠﯾﮭﺎ ) (( ......اﻟﻣرﺟﻊ ﻣوﺳوﻋﺔ ﻗﺿﺎء اﻟﻧﻘض اﻟﻌﻣﺎﻟﻲ – ﻣﺟﻣوﻋﺔ اﻟﻣﺑﺎدئ اﻟﻘﺎﻧوﻧﯾﺔ اﻟﺗﻲ ﻗررﺗﮭﺎ ﻣﺣﻛﻣﺔ اﻟﻧﻘض ﺧﻼل ﺧﻣﺳﺔ و ﺧﻣﺳﯾن ﻋﺎﻣﺎ 1931م – 1986م – ﺳﻌﯾد ﺷﻌﻠﺔ – رﺋﯾس ﻧﯾﺎﺑﺔ اﻟﻧﻘض ﺻـــ . (76 و ﺑﺗطﺑﯾﻖ ﻣﺎ ﺳﺑﻖ ﻋﻠﻰ واﻗﻌﺔ اﻟدﻋوى اﻟﺣﺎﻟﯾﺔ ﻓﺎﻟﺷرﻛﺔ ﻟم ﺗﻠﺟﺄ اﻟﻰ اﻟﻣﺣﻛﻣﺔ اﻟﻌﻣﺎﻟﯾﺔ ﻟﻠﻣطﺎﻟﺑﺔ ﺑﻔﺻل اﻟﻌﺎﻣل ﺗطﺑﯾﻘﺎ ﻟﻧص اﻟﻣﺎدة 68ﻣن اﻟﻘﺎﻧون 12/2003و ﻟم ﯾرﺗﻛب اﻟﻌﺎﻣل اي ﺧطﺄ ﯾﺑرر ﻓﺻﻠﮫ ﻣن اﻟﻌﻣل طﺑﻘﺎ ﻟﻧص اﻟﻣﺎدة 69ﻣن ﻧﻔس اﻟﻘﺎﻧون و ﻟم ﺗﻘم ﺑﺎﺧطﺎره طﺑﻘﺎ ﻟﻧص اﻟﻣﺎدة 110ﻣن ﻗﺎﻧون اﻟﻌﻣل . اﻟﺿرر :ﻓﻘد اﺳﺗﻘرت اﺣﻛﺎم ﻣﺣﻛﻣﺔ اﻟﻧﻘض ﻋﻠﻰ اﻵﺗﻲ :)) اﻧﮭﺎء ﻋﻘد اﻟﻌﻣل ﺑﻐﯾر ﻣﺑرر ﻣﺷروع ﺣﻘﮫ ﻓﻲ اﻟﺗﻌوﯾض ﻣﺎ اﺻﺎﺑﮫ ﻣن ﺿرر ﻣﺎدي ﻣﺑﺎﺷر (( ) اﻟطﻌن رﻗم 143ﻟﺳﻧﺔ 29ق ﺟﻠﺳﺔ 15/3/1967اﻟﻣرﺟﻊ ﻣوﺳوﻋﺔ ﻗﺿﺎء اﻟﻧﻘض اﻟﻌﻣﺎﻟﻲ – ﺳﻌﯾد ﺷﻌﻠﺔ ﻣن ﺳﻧﺔ
