FLSA CHANGES SET TO TAKE

MESSAGE FROM THE CEO EFFECT JANUARY 1 exemptions to overtime requirements increased from $35,568 to $43,888. As of Jan. 1, 2025, the annual salary threshold will rise to $58,656.

Mike Murphy President and CEO The Biden administration has finalized a significant new rule that will make millions more workers eligible for overtime pay in the U.S., representing the largest expansion of federal overtime eligibility in decades.

Under the white-collar exemption of the Fair Labor Standards Act (FLSA), executive, administrative, and professional employees can be exempt from overtime pay eligibility if they are paid on a salaried basis, make more than a certain amount per year, and have certain job duties.

Effective this past July, the FLSA’s annual salary-level threshold for white-collar

Employee eligibility for overtime pay is determined by their classification as exempt or nonexempt. Nonexempt employees must receive at least minimum wage for all hours worked and earn overtime pay for any hours exceeding 40 in a week. Exempt employees typically hold professional, executive, or administrative roles and must meet three criteria:

1. Their salary exceeds the standard weekly threshold (starting at $844 on July 1, 2024, and increasing to $1,128 by January 1, 2025);

2. They are paid a fixed salary (not based on hours worked), and;

3. Their job duties qualify for exemption.

Exemptions include:

Professional Exemption: Involves advanced degree work or roles that require discretion and originality.

having authority in hiring and firing decisions.

•

Administrative Exemption: Involves non-manual tasks that support business management and require independent judgment.

•

Additional exemptions exist for Outside Sales, Computer Employees, and Highly Compensated Employees (HCEs).

Employers are responsible for classifying their employees according to the rules which can be found on the Department of Labor’s website at www.dol.gov/agencies/ whd/fact-sheets/17a-overtime.

In Texas, shortly after the Department of Labor’s (DOL) final rule was issued, three federal lawsuits were filed seeking to block it. Previously, a Texas court had blocked enforcement of a similar rule in 2016, concluding that it improperly prioritized salary over an employee’s actual duties in determining the EAP exemption. A Texas court recently issued an injunction, but this injunction only applies to the State of Texas in its role as an employer of state employees. The rule remains effective for all other employers, both within and outside Texas.

As the “Overtime Rule” faces multiple legal challenges, it is possible that it could eventually be blocked nationwide.

Nevertheless, since the rule is currently in effect, compliance remains essential for employers. We will continue to monitor this situation and inform our members of any changes to this policy.

The new rule also broadens overtime eligibility for higher-compensated workers.

The existing annual threshold of $107,432 for highly compensated employees will rise to $132,964 on July 1 and $151,164 by the start of 2025.

ECONOMIC OUTLOOK BREAKFAST CURTIS DUBAY TO ONCE AGAIN KEYNOTE Carrollton Bank and The Greater Springfield Chamber of Commerce will present the 2024 Economic Outlook Breakfast on Thursday, November 7 at Lincoln Land Community College. Curtis Dubay, Chief Economist for the U.S. Chamber of Commerce, will discuss national economic data and trends and their potential impact at the local level.

LEADERSHIP SPRINGFIELD PROGRAM UNDERWAY NOW IN ITS 39TH YEAR

Leadership Springfield, a program of The Greater Springfield Chamber of Commerce, recently kicked off its 39th annual class.

Leadership Springfield exists to assist with the development of current and future leaders for area businesses, organizations, and the community at-large. Upon completion of the program, participants will be recognized and honored during our Annual Gala in 2025.

Outside of regular program sessions, participants are also challenged to exercise creativity and problem-solving skills by working as teams on projects for the benefit of area notfor-profit organizations.

Over 14 weeks this fall, participants will learn about various personality types, leadership styles and roles, leadership choices, time management, cultural intelligence, and team building. They will also enhance their leadership capabilities by learning from some our community’s best leaders, developing a deeper awareness of our community in the areas of Tourism, Healthcare, Education, Local & State Government, Homeland Security, Agriculture, and Technology.

We need leaders who, for decades to come, will understand how to bring people together to solve problems and not just talk about them. And, maybe most of all, we need leaders who want to and will do the right thing, even in the face of opposition.

Leadership Springfield may be more relevant today than any other time in the program’s history. When you consider our ever-changing culture, ongoing technological advances, and the need for leaders to guide organizations while connecting the right people to the right priorities – great leadership is essential.
