A Message from OSP Director Jim Casey

The new academic year is in full swing, and with the new academic year comes new challenges to tackle and goals to accomplish. Welcome to the August issue of the Sponsored Research Monthly.

As you all know, the past two years has been a time of building and change in the area of sponsored research. Most significantly has been the release of the NCURA Peer Review Report and our efforts to implement the recommendations thereof. As of this writing, more than 80% of the implementable recommendations have been put into place. By the end of Spring 2017 – if not before – the final recommendations will be in place. This is a significant accomplishment and one the entire AU research administration community can be proud of.

As has been written about previously in this column, the new research administration infrastructure includes the development of new policies and processes and the installation of national best practices. We cannot write a policy for every process, and nor would it be advisable to do so. We cannot write a policy for every technical question, or for every unique situation. The whole purpose of best practices is to install what successful and growing emerging research/research universities have in place to support the research – related aspirations of faculty and staff.

The following are some of the general research administration practices that are reflected by national best practices, policy and/or procedures: 

All sponsored research proposals need OSP approval before submission to sponsors.



Sponsored research awards requiring no cost extensions, revised budgets, transfer of grants to/from American University, and similar non – financial post award actions require OSP approval before submission to sponsors.



Unit leadership, faculty, and staff may not unilaterally negotiate agreements, subawards, or F&A reductions or waivers for sponsored research. While OSP and our partners take the lead in these areas, OSP will always keep the unit leadership, the PI, and unit research administration staff informed of the content of ongoing discussions.

It is important to note that OSP works with GCA and other unit/campus partners as necessary to effectuate a streamlined, efficient result.

The Difference between Subrecipients and Contractors

What is the difference between a subrecipient and a consultant and why does it matter? It is important to correctly choose the nature of a relationship because the terms of the relationship effect American University’s ability to be good stewards of its awards. Whether you choose to list an institution as a subrecipient or consultant depends upon the nature of the relationship with the partnering institutions. Knowing that subrecipients or other procurement actions are determined by the nature of the relationship they have with the prime institution is half the battle.

Relationships can be improperly defined when mental shortcuts are taken to decide whether a relationship is a subaward or a consulting agreement by assuming that all educational institutions are subrecipients, or all contracts with private firms are consulting agreements. Another pitfall is the temptation to list a PI at another institution as a consultant because setting up a subaward is more time-consuming than treating the relationship as a consulting agreement. Remember, every situation is unique and there is no single absolute rule to discern the nature of a relationship.

Under the Uniform Guidance (2 C.F.R. §200.330), an organization is considered a subrecipient of a federal award when it:     

Determines who is eligible to receive Federal assistance.

Performance is measured against whether the objectives of the Federal program are met.

Has responsibility for programmatic decision-making.

Has responsibility for adherence to applicable Federal program compliance responsibilities.

Uses the Federal funds to carry out a program of the organization as compared to providing goods and services for a program of the pass-through entity.

Under the Uniform Guidance (2 C.F.R. §200.330), an organization is considered a contractor (vendor) when it:     

Provides goods and services within normal business operations.

Provides similar goods and services to many different purchasers.

Operates in a competitive environment.

Provides goods or services that are ancillary to the operation of the Federal program.

Is not subject to compliance requirements of the Federal program.

A few questions you can ask to determine the nature of a relationship are: Are the goods or services being purchased from the other entity easily available for public purchase, or are they goods or services that are specifically tailored in response to a project and unavailable commercially?  Will the other entity only work within the specifications provided to them by the PI or will they work collaboratively with the PI to add significant input to the project?  Is the work paid at a fixed rate or is the work paid upon the receipt of deliverables? 

Please read through the scenarios below to determine which scenario describes a subrecipient relationship and which scenario describes a Vendor/Contractor/Consultant/Other Procurement Action relationship.

SCENARIO A

ANSWER

The PI at American University has designed a product satisfaction survey and is hiring a marketing firm to conduct the survey. They will collect the responses and turn them over to the PI for a fixed price. If the PI decides to add additional questions to the survey, extra charges will be incurred.

Scenario A descr ibes a Vendor / Contractor/Consultant/Other Procurement Action relationship because: this entity is being instructed on how to conduct the research; they could easily be replaced by another marketing firm; they are working for a fixed price; and they are not making significant intellectual contributions to the research being conducted.

SCENARIO B

ANSWER

A third party will design a survey on product satisfaction, collect data, and analyze it. They may end up surveying more people as needed. Only this third party is uniquely qualified to conduct the work and if they do not meet the PI’s deadline they will significantly impact the PI’s ability to conduct their sponsored project.

Scenario B descr ibes a subr ecipient r elationship because they are making significant intellectual contributions to the research being conducted by designing and implementing the survey; and they will not be paid until the satisfactory completion of their deliverables to the PI.

Research Data Sharing and Archiving Infrastructure for AU Faculty

Increasingly, research funders and journal publishers require submitters of grant applications or article manuscripts, respectively, to outline how they plan to make available the research data that will be created in the course of the proposed funded research, or has been created in the course of the work described in the article. Their fundamental motivation here is to enable replicability and openness of (especially publicly funded) research; but making research data available can also benefit researchers by potentially increasing citations of the publication(s) based on the research data.

Publishers and funders typically prefer the research data to be housed in an online repository with expectable long-term accessibility, stability, and archival dedication – as opposed to, say, made available via a personal website, which may be moved, change its web address, or disappear entirely in the future.

In the summer of 2015, AU Library launched its new Digital Research Archive (DRA), which has a growing Faculty Research collection (http://tinyurl.com/AUFacRes), and has since added functionality to the DRA to accommodate numeric/statistical research datasets from AU faculty members. The “Data Management Plans” guide at: http:// subjectguides.library.american.edu/dmp contains, under AU Campus Resources, a section on submitting data to the AU Digital Research Archive that describes this functionality in more detail, with links to background information.

An illustrative example of a dataset in the AU DRA is the List of U.S. Military Bases Abroad, 2016 by David Vine (Dept. of Anthropology): 

It has been assigned, by AU Library, a globally unique, stable identifier in the form of a DOI (Digital Object Identifier – originally developed for electronic journal articles) at which it can be accessed: http://dx.doi.org/10.17606/M6H599 - if the dataset is ever moved to another server or directory, which would change its URL and thus break any citations relying on that URL, the library will update the DOI to point to the new location, assuring long-term citation validity.



Under “related work,” the dataset metadata links to the book (Base Nation: How U.S. Military Bases Abroad Harm America and the World) that reports on his research. This can lead anyone who finds David’s dataset first to his book based on it!



The dataset metadata also contains a link to the creator’s ORCID profile, thereby leading to all the other research works listed therein. (For more on ORCID, see “Establishing your researcher identity with ORCID” at http://subjectguides.library.american.edu/ORCID).



The dataset is available both in the original Excel format and, for long-term preservation, as a CSV (comma-separated values) file. Both formats were provided by David Vine.

Mendel Fellowships The Lilly Library of Indiana University invites applications for fellowships of up to $40,000 during the academic year in support of research in the library's Bernardo Mendel collections, as noted below.

Established through a bequest by the estate of Johanna Lenz Mendel in 1998, the Mendel Fellowships are intended to support research by scholars from around the world in areas of particular interest to the Mendels, including: the history of the Spanish Colonial Empire; Latin American independence movements; European expansion in the Americas; voyages, travels and exploration; geography, navigation and cartography; German literature and history; and music, including sheet music. Kogod School of Business Business Women's Giving Circle Fund

Supporting innovation, entrepreneurship and inventive opportunities for women and girls. The Business Women's Giving Circle (BWGC) was established in early 2014 with the goal of empowering girls and women of all ages and preparing them for business success by supporting organizations that create connections, opportunities, and confidence. 

VentureWells Stage 3 program, called ASPIRE, focuses on helping teams develop a venture development plan to prepare for relationships with investors and strategic partners.

Deadline: October 05, 2016 Securing Water for Food (SWFF) - Round 4 Through Grand Challenges for Development (GCD), the United States Agency for International Development (USAID) and its partners are sourcing, selecting, and accelerating science, technology, and business model innovations that have the potential to achieve large-scale development impact. Securing Water for Food: A Grand Challenge for Development (SWFF) is part of a portfolio of 7 GCDs, each tackling a critical and complex development challenge. SWFF's objective is to enable the production of more food with less water and/or make more water available for food production, processing, and distribution in developing and emerging countries. It is jointly funded by USAID, the South African Department of Science and Technology, Sweden through the Swedish International Development Cooperation Agency (Sida), and the Foreign Ministry of the Kingdom of the Netherlands (collectively, the "Founding Partners"). School of Communication Food and Farm Communications Fund Grants In 2010, the 11th Hour Project conducted a landscape assessment of the Good Food Movement that surveyed over 200 leaders working to create resilient and robust regional food systems. One of the overarching recommendations that came out of that study was that expanding the good food movement's communications capacity must be a funding priority. As indisputable as these findings were, the challenge we all collectively face is how to expand this capacity? It is apparent that funders need to facilitate strategic communications for transformative policy change, but to date it would be hard to argue that this has been occurring in a strategic fashion.

More specifically the FFCF looks for:  Creative, innovative and out-of the-box forms of communication. While this may or may not include feature-length docu-

mentaries, it can also include video games, comic books, theater arts, user-generated content/platforms, video channels, and other emerging forms of media.

 Communications that help make clear the links between domestic and global food systems and their implications including

the broader health/justice/economic development aspects of food and agriculture work.

 Projects that make clear the links between farms and the cultures and landscapes they are a part of. These may include

links to water/drought, climate change, and the importance of culture in food and farming for growers, producers and consumers alike.

 The FFCF seeks to leverage projects that support broader, higher risk efforts in terms of communications. With limited

resources, the fund is not seeking to support an organization's ongoing communications activities, but rather more out-ofthe-box thinking.

 The FFCF also seeks to commit a portion of funding toward communications activities with/for communities that have

been most disenfranchised and impacted by the current food system.

School of International Service Ron McKinley Philanthropy Fellowship The Ron McKinley Philanthropy Fellowship is dedicated to Ron McKinley, a longtime member of the philanthropic and nonprofit communities. He was a mentor to many and an advocate who embodied justice and equity. He worked tirelessly throughout his career to ensure that all those underrepresented in these communities were afforded equal access, opportunity and the resources necessary to fully participate and be heard.

The fellowship, which was launched as a partnership with the Minnesota Council on Foundations and Bush Foundation in 2013, will prepare individuals from underrepresented communities for careers in philanthropy.

School of International Service International Affairs Fellowship Launched in 1967, the International Affairs Fellowship (IAF) is a distinguished program offered by the Council on Foreign Relations (CFR) to assist mid-career scholars and professionals in advancing their analytic capabilities and broadening their foreign policy experience. Washington College of Law International Narcotics and Law Enforcement – Mexico Police Professionalization Program INL16CA0007- WHPMEXICO-11032015 INL Mexico seeks innovative, cutting-edge proposals for the Police Professionalization program from organizations that aim to assist Mexico in implementing reforms consistent with the objectives of Merida Initiative Pillar II. The Bureau of International Narcotics and Law Enforcement Affairs (INL) leads the Department of State’s anticrime and counter-narcotics efforts. INL assistance programs help partner nations to build their capacities to extend the reach of justice under the rule of law, including respect for human rights and gender equality, and to deny safe haven to criminals who would otherwise operate with near impunity.

The resources entrusted to us, enables INL to deliver technical assistance and capacity to: enhance international drug control through interdiction and supply reduction; develop civilian law enforcement capacity, regional partnerships, and information sharing; and further the administration of justice and corrections under the rule of law with respect for human rights. Applications will be reviewed as they are received on a rolling basis. Clerks are supervised by CEQs Office of the General Counsel, and provide critical research and writing assistance to both legal and policy staff on a variety of matters pertinent to CEQs functions, including oversight of the National Environmental Policy Act (NEPA).

Through CEQs participation in policy processes across the Federal government, clerks have the opportunity to perform diverse, substantive legal work, including: (1) Drafting memoranda on environmental, energy, natural resources, and general law issues; (2) Tracking Federal agency actions on environmental issues; (3) Attending interagency working group meetings; and (4) Assisting with responses to Freedom of Information Act requests and other inquiries regarding CEQs activities. Clerks also have the opportunity to help advise CEQs policy teams on legal issues, and to analyze significant draft regulations through CEQs participation in the interagency regulatory review process under Executive Order 12866.
