What is a ‘Take back’? QUESTION: What does it mean when a seller takes back a mortgage?
ANSWER:
Because today’s interest rates are so low we usually do not hear much about mortgage take-backs, Peter G. Miller but they remain a CTW Features potentially attractive financial option for some home sales. Let’s imagine that Smith has a house to sell. The selling price is $400,000. Smith is a longtime owner, and the property is mortgage-free. Jones wants to buy the house. Jones says to Smith, “I’ll pay full price if you’ll take back the mortgage. You get an instant sale, and I get instant financing.� With an offer on the table what does Smith say? After all, he’s getting full price. The suggestion of an owner take-back raises some important questions: First, does the owner need cash from the sale to buy a replacement property or pay taxes? If the answer is yes, then a big seller take-back won’t work. Second, how much down is the buyer offering? Real estate investing gurus have long championed the use of other people’s money to buy real estate. Those “other people� can be family and friends, but the easiest source of financing is the seller. Unless the buyer is willing to put up a sizable chunk of cash, say 30 percent, sellers should stay away from such offers. Third, is there an existing loan on the

Their success led them to establish the Passive House Institute US (PHIUS). Finding a builder or consultant with experience in passive house design used to be difficult, but PHIUS now offers certificate programs for both builders and consultants, where experts teach the concepts of design and construction. Does the buyer have to qualify with the lender to assume the current mortgage? If yes, why not just get a new loan? Fourth, why does the buyer want owner financing? Maury Harris, the managing director and chief economist for the Americas at UBS, estimates that banks have $2 trillion in excess reserves – so there’s no shortage of mortgage money. Freddie Mac says rates hit a seven-month low in late May. No less important, mortgage money is not hard to get: Ellie Mae reports that the average credit score for a successful mortgage application was 725 in March, down from 743 a year earlier. Maybe the buyer wants a seller take-back because he cannot qualify for a loan of sufficient size to buy the property. Or, maybe, the buyer has poor credit. In either case the seller is taking on a lot of risk by financing a property sale that commercial lenders won’t touch, a real concern if you need the monthly payments and the borrower is not sending checks. Ask yourself: Do you really want to hire a lawyer to foreclose if payments stop, an expensive process that could take months if not longer? If, for some reason, you are willing to take back financing make sure that all loan papers must be in a form that is “satisfactory� to you. See an attorney for specifics before signing a sale agreement and check with a tax professional before accepting to any take-back deal.
hile the number of passivehome projects in the U.S. is on the rise, the passive home is not a new concept. Heck, it doesn’t even use any breakthrough technology. Experimentation with the first superinsulated homes began in North America in the 1970s. While the model lost momentum in the U.S. and Canada, it gained popularity in Europe after Bo Adamson of Sweden and Wolfgang Feist of Germany maximized the concept for European climates. They designed a strict protocol for passive house design called the “Passivhaus standard� in 1988. They later founded the Passivhaus-Institut in 1996, to promote and control the standards of Passive House building. The first U.S. passive house was built in 2003 in Urbana, Illinois, by Katrin
